This article analyses the epistemic status of law and its presumption of being a science in relation with the so-called demarcation criterion proposed by different philosophers of science. Such criteria are the main analytical elements to differentiate scientific discourses from those who are not and the ones who pretend to be. In relation to those, pseudoscience and law are treated, to finally conclude with the exposition of the case of Daubert v. Merrill Dow Pharmaceuticals, in which a judicial process defined (...) demarcation criteria. This paper shows how the demarcation criteria of science and the concept of pseudoscience cannot be applied to law science given its own rationality. (shrink)

Plurality implies a public sphere in which different worldviews (e.g. Secular Humanist, Christian, Jewish, Muslim and others) coexist respecting each other. Banning the presence of one or several of them from the public sphere is questionable in principle, and divisive in practice.

The work presented has the following approach: starting from the Pope's reflection on the planet and ecological problems, it is intended to show the philosophical influences that underlie Francisco's exposition. These influences make it possible to describe a philosophical profile present in the encyclical Laudato si’. In addition, since philosophy claims to know, it is not exhausted only in knowledge, but tries to know in order to act; therefore, the presence of an ethical proposal follows; and since all ethics leads (...) to action, it follows that action cannot be without some indicators, without an axiology on which human action on the planet revolves. The result is that Francisco offers an ethic of otherness that feels the other as an authentic neighbor, even those who are in the future. It is an ethic of common benefit and caring for the other whose fundamental axis is the person and for this reason he reflects the phenomenon of human life within life on Earth, with which its philosophical approach seems personalist, from a point of Christian view. The increasing number of residents and citizens with non-Western cultural backgrounds in the European Union (EU) has prompted the question of whether EU member states (and other Western democracies) can accommodate the newcomers and maintain their free polities (‘liberal democracies’). The answer depends on how important – if at all – cultural groundings are to democratic polities. The analysis of a fascinating Habermas-Ratzinger debate on the ‘pre-political moral foundations of the free-state’ suggests that while legitimacy originates on the will of (...) the citizens that conform the political community, liberal democracies might not be completely free from moral principles implicit in their political culture. This possibility has normative implications for the political future of the EU - and of the West in general - particularly regarding immigration, integration and citizenship policies. (shrink)

In 2004 Jürgen Habermas and Joseph Ratzinger participated in a debate on the ‘pre-political moral foundations of the free-state’. Their contributions showed broad agreement on the role of religion in today’s Western secular state and on areas of collaboration and mutual enrichment between Modernity and Christianity in Europe and the West. They diverged regarding the need or not of a common cultural background prior to the existence of the polity. Their diverging point becomes all the more fascinating to the extent (...) that the matter requires wider empirical, analytical and normative research before it can be settled. Nevertheless, the implications that derive from one or the other possibility are very different in terms, for instance, of immigration and citizenship policies. This is already clear in Europe and is becoming more evident in general in Western democracies. (shrink)

The Lautsi case in Italy attracted widespread attention in Europe and beyond. Though the issue under contention was a Christian symbol, the European Court of Human Rights (ECHR) judgements showed changes in assessment both about religion (in contrast with former cases regarding Muslim veils) and secularism (which did not have the same meaning for everyone). In light of those rulings, this paper reflects on the concepts of neutrality and secularism and their normative implications for European citizens in terms of (...) belonging, solidarity and cohesion. An open and plural public sphere, in which intercultural exchange can flourish, is crucial if Europe is serious about the integration of its immigrants, many of whom possess a Muslim background. A ‘post-secular’ Europe may have to reconsider long-held stereotypes about religion and nuance its self-understanding as ‘secular’, in a way that religious citizens can identify with Europe too. The discussion will draw on the ideas of Taylor, Casanova, Habermas, Weiler and Beck to illustrate some of the political, ethical and theoretical complexities of the Lautsi case, specifically issues to do with neutrality, secularism and the role of religion in the public sphere. The work consists of two parts: the first part, w e develop below, theological reflection on the most important aspects about religión, the debate on the arguments that justify the existente of God; the attributes of God; the occurrence of evil in the World; and, finally, the M ill's assesment about Christ. The second part, will focus on (...) aspects about utilitarian morality and the Christian religion; the proposal about new religión, M ankind's Religion; the happiness in your relationship with utilitarianism, happiness relates to Christianity and the common ground between Christian doctrine and utilitarian doctrine. In this work we argue that there is no strong demarcation between pure and applied mathematics. We show this first by stressing non-deductive components within pure mathematics, like axiomatization and theory-building in general. We also stress the “purer” components of applied mathematics, like the theory of the models that are concerned with practical purposes. We further show that some mathematical theories can be viewed through either a pure or applied lens. These different lenses are tied to different communities, which endorse (...) different evaluative standards for theories. We evaluate the distinction between pure and applied mathematics from a late Wittgensteinian perspective. We note that the classical exegesis of the later Wittgenstein’s philosophy of mathematics, due to Maddy, leads to a clear-cut but misguided demarcation. We then turn our attention to a more niche interpretation of Wittgenstein by Dawson, which captures aspects of the aforementioned distinction more accurately. Building on this newer, maverick interpretation of the later Wittgenstein’s philosophy of mathematics, and endorsing an extended notion of meaning as use which includes social, mundane uses, we elaborate a fuzzy, but more realistic, demarcation. This demarcation, relying on family resemblance, is based on how direct and intended technical applications are, the kind of evaluative standards featured, and the range of rhetorical purposes at stake. MacIntyre's is one approach among many to explain what philosophy ought to be. For Pieper (in: "Defence of Philosophy"), just to cite another one, "to engage in philosophy means to reflect on the totality of things we encounter, in view of their ultimate" or fundamental truth. And there are others. But my interest here is to explore the circumstances under which philosophers could claim a place in society due to a service they provide, as valuable as that of a mechanical (...) engineer in a factory, a waiter in a hotel or a pilot on an airplane. The circumstances, this is, which would make society see philosophers not (or not only) as oddly useless figures addressing intellectually engaging puzzles and uttering obscure conclusions, but as valuable contributors to the common good. En este contexto se sitúa el presente escrito. Se pretende describir el estado de una problemática antigua y nueva. Antigua, porque se remonta a los cimientos mismos de la filosofía y del pensar humano, varios miles de años antes de Cristo. Nueva, porque no han terminado en el siglo XX las discusiones sobre dicha problemática, ni las aplicaciones posibles que se derivan de ella. Se trata del principio de identidad. El presente trabajo partirá de la definición del principio de identidad (...) según Aristóteles. Se matizarán algunos aspectos de tal principio según otros autores que han perseguido sobre todo fines didácticos al presentarlo, ya sea para el desarrollo de la teología como para el de la epistemología o la metafísica. Finalmente, se expondrá —de una manera bastante elemental— la utilización y las conclusiones que algunos autores contemporáneos han efectuado con relación a la identidad. El trabajo se enmarca, así, en casi una pura descripción elemental que sienta las bases para una posterior profundización. (shrink)

A través de su historia, la práctica de la medicina ha estado imbuida de diversas concepciones sobre la naturaleza humana, así como sobre los elementos, estados o procesos (tanto internos como externos) que dan origen a la enfermedad y aquellos que propician la salud. Si se consideran seriamente, tales concepciones se pronuncian sobre cuestiones ontológicas y metafísicas. En la medida en que sean dignas de crédito, sus pronunciamientos ontológicos y metafísicos resultan relevantes para múltiples facetas de la práctica médica, como (...) el diagnóstico, el tratamiento, la investigación, la prevención y el control de enfermedades, pero también para el cuidado y la promoción de la salud. En este capítulo se exploran cuestiones metafísicas generales en torno a la concepción de la práctica médica más influyente en el mundo actual: la biomedicina. Sostengo que, a pesar de que el asombroso éxito de las ciencias biomédicas nos ofrece razones para creer en la verdad (aproximada) de las representaciones que toman como base, esa confianza no debería estar asociada selectivamente a pronunciamientos específicos sobre qué cosas existen y cómo se conectan; además, nuestro grado de convicción en los resultados de la investigación biomédica debería estar calibrado al tomar en cuenta vulnerabilidades ampliamente reconocidas de este ámbito de indagación. Comienzo caracterizando la biomedicina como la aplicación de los resultados de la investigación científica a la práctica médica. Examino razones generales para creer en la verdad de las representaciones con las que opera este modelo de la práctica médica, recapitulando de manera panorámica el debate en torno al realismo científico. Luego consideraro aspectos relevantes para este debate que conciernen específicamente a las ciencias biomédicas, así como algunas consecuencias para el ámbito de la biomedicina que se desprenden de adoptar varias posiciones en torno al realismo científico. Concluyo ofreciendo una defensa del realismo carte blanche como la posición más sensata que puede adoptarse en este ámbito. (shrink)

El presente artículo trata, desde una perspectiva histórica, mostrar el debate entre la Razón y la Fe en la Historia de la Filosofía.

Are we ever morally permitted to do what is morally wrong? It seems intuitive that we are, but evidence for dissociations among judgment of permissibility and wrongness are relatively scarce. Across 4 experiments (N = 1,438), we show that people judge that some behaviors can be morally wrong and permissible. The dissociations arise because these judgments track different morally relevant aspects of everyday moral encounters. Judgments of individual rights predicted permissibility but not wrongness, while character assessment predicted wrongness but not (...) permissibility. These findings suggest a picture in which moral evaluation is granular enough to express reasoning about different types of normative considerations, notably the possibility that people can exercise their rights in morally problematic ways. Por lo menos esa constituye la intuición inicial de este trabajo, que está motivado por buscar hasta qué punto la presentación de modelos puede repercutir eficazmente (...) en la educación moral de los ciudadanos del mañana. A stunning phenomenon has dramatically changed the way in which we in the West regard the public sphere in particular, and democracy in general in the twenty-first century: the re-emergence of religion.

The separation of church and state isn’t the same as separating religion from politics. Countries that have enshrined secularism have found themselves discussing religious architecture, law and clothing.

Brexit has been widely covered in the news. Much of the attention of the press in English has gone to the British perspective. This piece seeks to present a holistic view of this event, including the European perspective. It argues that, notwithstanding this break-up and the problems it highlights (especially the tiredness of citizens with traditional party politics), the European project can survive this crisis and forge ahead into the future.

From the political point of view, European Union (EU) integration implies some kind of unity in the community constituted by EU citizens. Unity is difficult to attain if the diversity of citizens (and their nations) is to be respected. A thick bond that melts members' diversity into a 'European pot' is therefore out of the question. On the other hand, giving up unity altogether makes political integration impossible. Through a meta-theoretical analysis of normative positions, this paper proposes a composed notion (...) of European identity that links without binding. It contains four facets – cultural, political, social, external – with nuances, expressed in three binaries, that cut across all of them – history-project, ethos-achievement, commonness-uncommonness. I will submit that a workable European identity (and the related concepts of unity, polity and citizenship) can be better conceived as analogical – a mid way between blending unity and irreconcilable diversity. The human person has been analyzed from several points of view throughout the history. Great theologians, philosophers, anthropologists and sociologists and other specialists have written extensively on the subject. The philosophical contribution centered on the human person has been significant throughout history. In the last century, Romano Guardini, who received the Erasmus Prize for Best European Humanist and called "Master of Life" offers a view of reality man-centered, through a thin, deep and coherent approach on the individual. His work has (...) been labeled by some philosophers within the personalist current, and although his contributions were many, we want to highlight the elements of the meeting, the language and the self-acceptance. In this paper we propose how this approach to the human person can become an intinerary embodied in reality, that can help today to seek clarification and start delving into own personal knowledge enlightened by faith. -/- La persona humana ha sido analizada desde varios puntos de vista a lo largo de la historia. Grandes teólogos, filósofos, antropólogos y sociólogos entre otros especialistas han escrito profusamente acerca del tema. El aporte de una filosofía centrada en la persona humana ha sido significativo a lo largo de la historia. En el último siglo, Romano Guardini, quien recibió el Premio Erasmo al Mejor Humanista Europeo y llamado “Maestro de Vida”, propone una visión de la realidad centrada en el hombre, a través de una aproximación fina, profunda y coherente sobre la persona humana. Su trabajo ha sido catalogado por algunos filósofos dentro de la corriente personalista, y si bien sus aportes fueron muchos queremos resaltar los elementos del encuentro, el lenguaje y la aceptación de sí mismo. En este trabajo proponemos cómo dicha aproximación a la persona humana se puede convertir en un itinerario encarnado en la realidad que puede ayudar hoy en día a quienes buscan esclarecer y comenzar a ahondar en el propio conocimiento personal iluminados por la fe. No es usual leer un libro de un gran teólogo y a la vez de un gran artista. Ubicándonos en el siglo XXI, es fácil reconocer al personaje del cual estamos hablando: Marko I. Rupnik. La sensibilidad artística, unida a la profundidad teológica y a su ascendencia espiritual católica oriental, hacen de los escritos del padre Rupnik grandes novedades para la teología occidental actual. En su libro According to the Spirit, el padre Rupnik propone, siguiendo los lineamientos del papa Francisco, (...) que será una teología espiri-tual que exprese la renovación de la vida eclesial, la que podrá afrontar el periodo épico de transición en el cual nos encontramos. La Iglesia Católica necesita una nueva mentalidad que corresponde a una vida nueva, pero basada en una vida según el Espíritu, una vida espiritual que le haga espacio interior al Espíritu, recibiéndolo como un don, que nos libere del apego a nosotros mismos. Las aproximaciones exis-tenciales, así como la profundidad teológica y los matices fruto de la sensibilidad espiritual del padre Rupnik, hacen del libro una aguda, dura y muy acertada crítica a la situación actual de la Iglesia Católica, en sus métodos teológicos, evangelización y respuesta a las necesidades del mundo de hoy. The recent encyclical of Pope Francisco has been classified by many as the encyclical on the climate and the environment. However, father Francisco not only mentions several of the environmental problems of today’s world, including the more dramatic, but analyses the causes of such problems and seeks to shed plenty of light to find solutions. In the present investigation, it delves into the importance of the message of hope from Pope Francisco facing the serious crisis which describes in his Encyclical (...) insists on hope as a core element of an ethic that will help to get out of these problems, because without hope there is no possible ethics. The Encyclical is situated in the field of bioethics demonstrating the concern of the Pope at the general situation of the planet Earth, placing the human person at the Centre of this reflection, to then describe the positive elements of the diagnosis of the reality and bets that allow you to build a vision of hope. -/- La reciente encíclica del Papa Francisco ha sido catalogada por muchos como la encíclica sobre el clima y el medio ambiente. Sin embargo, el Papa Francisco no solo menciona varios de los problemas ambientales del mundo actual, incluyen-do los más dramáticos, sino que analiza las causas de dicha problemática y busca arrojar abundante luz para encontrarle soluciones. En la presente investigación, se ahonda en la importancia del mensaje de esperanza del Papa Francisco frente a la grave crisis que describe en su encíclica y se insiste en la esperanza como elemento medular de una ética que ayude a salir de dichos problemas, pues sin esperanza no hay ética posible. Se sitúa la encíclica en el ámbito de la bioética evidenciando la preocupación del Papa por la situación general del planeta Tie-rra, poniendo a la persona humana en el centro de dicha reflexión, para luego describir los elementos positivos del diagnóstico de la realidad y las apuestas que permiten construir una visión de esperanza. In a world in which emotions and feelings occupy a dominant place in daily human life and especially in decision-making circumstances, it is important for us to ask ourselves whether it is possible to talk about “new” ethics or “renewed ethics.” Actually, we do not face a re-creation of principles and values, but rather we face a need for deepening our understanding of human anthropology. Thinkers such as Dietrich von Hildebrand have proposed that affectivity can shed light on ethics comprehension. (...) By means of a study of some of the works of this contemporary philosopher, we state that ethics is the result of a harmony between a clear objective comprehension of reality and a straight comprehension of that reality within the sphere of an educated, formed and well-known affectivity of the human person, which would lead us beyond the common place understanding of ethics as something rigid and full of rules and restrictions. -/- En un mundo en el que las emociones y los sentimientos ocupan un lugar preponderante en la vida cotidiana de las personas y especialmente en las decisiones que toman, cabe preguntarnos si podemos hablar de una nueva ética o de una ética renovada. En realidad no nos enfrentamos a una recreación de nuevos principios y valores, sino a una necesidad de ahondar en la antropología de la persona humana. En esta profundización se ha revalorado el importante papel que juega la afectividad en la vida humana. Pensadores como Dietrich von Hildebrand han propuesto que la afectividad puede dar luces en la comprensión de la ética. A partir de un estudio de algunas de las obras de este filósofo contemporáneo proponemos que la ética vendría siendo el resultado de una armonía entre la clara comprensión objetiva de la realidad y una recta comprensión de dicha realidad dentro de una esfera afectiva educada, formada, y ante todo conocida por la propia persona, lo cual nos conduce más allá de una ética entendida muchas veces como algo rígido lleno de normas y restricciones. El artículo trata de mostrar las influencias de los ideales de la Ilustración en el pensamiento de John Stuart Mill. Así, puede comprobarse como en esos ideales de libertad, igualdad, tolerancia, respeto a la diferencia que propugna la Ilustración están presentes en el pensamiento de Mill y vertebran su filosofía.

En décadas recientes se ha considerado que una formulación adecuada del autoconocimiento (AC) debería ser consistente con la tesis del externalismo (E). Michael McKinsey es uno de los personajes que ha enfatizado con mayor ahínco que la conjunción de ambas posturas es inconsistente. En este trabajo defiendo la idea de que las objeciones presentadas por McKinsey no afectan de manera importante la formulación davidsoniana de la autoridad de la primera persona (AC3) en conjunción con (E); señalo, además, que si no (...) pudiera hacerse una reconstrucción à la Davidson de (AC3) desde la postura de McKinsey sería en virtud de las diferencias metodológicas, semánticas, epistemológicas y ontológicas entre ambos autores, y no debido a que esta reconstrucción en sí misma sea incompatible con el externalismo. El presente artículo es un extracto de la Tesis Doctoral leída en la Facultad de Filosofía de la Universidad de Oviedo el 16 de abril de 2010 titulada Educación para la Libertad en el pensamiento de John Stuart Mill. Este artículo recoge de forma resumida, a lo largo de sus páginas, los aspectos más destacables de dicha Tesis Doctoral. Se subraya el aspecto de la educación como elemento fundamental en el pensamiento del filósofo inglés John Stuart Mill, en el sentido (...) de mostrar la educación como aquello que permite sacar al exterior las capacidades, talentos, destrezas que la persona posee. Al mismo tiempo es la educación, en el marco de la cultura, la que afina y refina a la persona, ayudándola a construirse como una persona que se incorpore a la ciudadanía con derechos y deberes y que ejerza esa ciudadanía responsablemente en aras del bien común. La educación hace al ser humano más libre, y la libertad es la esencia de la persona en el pensamiento de Stuart Mill. (shrink)

El trabajo que se presenta intenta mostrar, por un lado y siguiendo a Ortega y Gasset, la complejidad del fenómeno de la política; y por otro lado, a partir de la constatación anterior, la necesidad de una ética que haga de la política una actividad presidida por el diálogo, la integración y la búsqueda de soluciones a las complejidades de la sociedad actual. Son relevantes en este aspecto Apel y Habermas.

Este artículo trata de mostrar la idea de sociedad y de convivencia política de los ciudadanos en el pensamiento de John Stuart Mill desde su perspectiva utilitarista, en la cual el objetivo es la felicidad de las personas.

Una de las bifurcaciones en el debate contemporáneo sobre la legitimidad de la democracia explora si ésta ofrece ventajas distintivamente epistémicas frente a otras alternativas políticas. Quienes defienden la tesis de la democracia epistémica afirman que la democracia es instrumentalmente superior o equiparable a otras formas de organización política en lo que concierne a la obtención de varios bienes epistémicos. En este ensayo presento dos (grupos de) argumentos a favor de la democracia epistémica, que se inspiran en resultados formales: el (...) teorema del jurado de Condorcet [TJC] y el teorema ‘diversidad supera habilidad’ [DSH]. Pese a su gran atractivo, sostengo que estos argumentos son incapaces de respaldar dicha tesis: no brindan razones para considerar que la democracia es epistémicamente superior (o equiparable) a algunas alternativas políticas no democráticas. En su lugar, sugiero que, sin requerir un cambio radical en nuestras formas de organización política, la epistemología democrática –el estudio de las ‘circunstancias epistémicas de la democracia’– puede ofrecer valiosas lecciones de sobre cómo optimizar, en nuestra situación, instituciones y procedimientos de toma de decisiones. Para ello, primero distingo entre varias maneras de evaluar procedimientos de toma de decisión colectiva. Argumento que, al considerarlos como formas de organización política, un factor importante en la evaluación de tales procedimientos involucra asuntos fácticos sobre los cuales puede aspirarse a obtener o promover algunos bienes epistémicos. En este contexto, presento algunos de los argumentos más importantes a favor de la democracia epistémica. A continuación, reúno algunas de las objeciones sobre la aplicabilidad de dichos argumentos y ofrezco razones independientes para dudar de que ofrezcan apoyo a la tesis de la democracia epistémica. Finalmente, defiendo que la epistemología democrática puede desempeñar un papel significativo en la legitimación de formas de organización colectiva que podrían denominarse ‘democráticas’. (shrink)

The specific role of empeiria in Aristotle’s ethics has received much less attention than its role in his epistemology, despite the fact that Aristotle explicitly stresses the importance of empeiria as a requirement for the receptivity to ethical arguments and as a source for the formation of phronêsis.1 Thus, while empeiria is an integral part of all explanations that scholars give of the Aristotelian account of the acquisition of technê and epistêmê, it is usually not prominent in explanations of the (...) acquisition of phronêsis.2 The abundant mentions of empeiria in Aristotle’s ethical treatises are often eclipsed in the secondary literature... El presente estudio tiene como propósito presentar a un pensador que murió hace apenas doce años, y que por varios motivos pudiera considerarse un “hereje” para la ortodoxia que dictan las corrientes filosóficas en boga hoy. No se trata, todavía, de un filósofo reconocido ampliamente, ni de uno muy popular: su discurso es profundo y a veces resulta arduo de leer. Sin embargo —es la opinión que se mantiene aquí— su pensamiento es sumamente valioso. Va directamente al núcleo de los (...) problemas más intrincados de la filosofía actual, y, sobre todo en el ámbito de la metafísica, aporta vías de solución que merecen un atento análisis. El tema del amor no queda exento. Su situación en los campos ético y antropológico llega a la total confusión o, peor, al sinsentido y la cosificación. Y el fondo del problema es —eso creemos aquí— de índole metafísica. Por eso se emprende una descripción del pensamiento de Cardona al respecto, en tres momentos: primero, la fundamentación del amor en el acto de ser, segundo en la explicación de toda la realidad a través del amor, y su importancia como sentido del hombre. Reactivity, or the phenomenon by which subjects tend to modify their behavior in virtue of their being studied upon, is often cited as one of the most important difficulties involved in social scientific experiments, and yet, there is to date a persistent conceptual muddle when dealing with the many dimensions of reactivity. This paper offers a conceptual framework for reactivity that draws on an interventionist approach to causality. The framework allows us to offer an unambiguous definition of reactivity and distinguishes (...) it from placebo effects. Further, it allows us to distinguish between benign and malignant forms of the phenomenon, depending on whether reactivity constitutes a danger to the validity of the causal inferences drawn from experimental data. The cultural, economic and political crisis affecting the European Union (EU) today is manifested in the political community’s lack of enthusiasm and cohesion. An effort to reverse this situation – foster ‘EU identity’ – was the creation of EU citizenship. Citizen- ship implies a people and a polity. But EU citizens already belong to national polities. Should EU citizenship override national citizenship or coexist with it? Postnationalists like Habermas have suggested EU citizenship can overcome nationalisms, grounding political belonging on the (...) body of laws that members of the post- national polity generate in the public sphere. Cosmopolitan communitarianists like Bellamy, by contrast, think that EU citizens should form a mixed commonwealth, with political belonging based on national citizenship. I will argue in favour of the second option, and submit an analogical reading of the ensuing ideas of citizenship, identity and polity. Cosmopolitan communitarianist EU citizenship promises to better foster the great richness of European national cultural, religious, historical, political, legal and linguistic diversity in a ‘mixed’ polity. Its main challenge is how to keep the diverse, mixed polity together. (shrink)

Stuart Mill se adelanta a nuestra época y presenta a la educación como ese derecho básico de toda persona que ha de ser protegido, potenciado y proporcionado por los diversos Estados.

El presente texto muestra, dentro del pensamiento de John Stuart Mill, una idea de ser humano diverso y distinto que vive en una realidad también diversa. La convivencia de seres diversos en las distintas sociedades requiere de una organización política en la que la democracia representativa juega un papel importante, pero también unida a la política está la ética, la cual en Stuart Mill ha de ser una ética cívica, esto es, una ética en la que los ciudadanos, sujetos de (...) derechos y de deberes, desplieguen sus capacidades de modo libre, sin más freno que el perjuicio al semejante. The euro crisis has hit “Europe” (the European Union, or EU) at its root. Economic harshness, social unrest and political turmoil betray a deeper problem: a weak pan-European sense of belonging — a common political identity thanks to which European citizens may regard each other as equals, and therefore as deserving of recognition, trust, and solidarity. This paper explores interculturalism from an analogical perspective, looking at the harmonious interplay between human rights and cultural plurality, as a possible source of trust (...) and solidarity among European citizens. Only a common — even if analogical — political identity, whereby European citizens regard each other, if not as “siblings” at least as “cousins,” can make the sacrifices required to overcome the crisis meaningful — and therefore less unlikely to happen. En el presente artículo, el autor se ocupa de esbozar una caracterización general del autoengaño desde algunas de las principales perspectivas en la materia, señalando los problemas centrales que involucra y haciendo énfasis en la línea intencionalista. Luego analiza la relación que el autoengaño guarda con la autoridad de la primera persona y qué imagen resulta de una conjunción teórica de ambos problemas.

In the concept of European citizenship, public and international law intersect. The unity of the European polity results from the interplay between national and European loyalties. Citizens’ allegiance to the European polity depends on how much they see the polity’s identity as theirs. Foundational ideals that shaped the European project’s identity included social reconciliation and peaceful coexistence, economic reconstruction and widespread prosperity, and the creation of supranational structures to rein in nationalism. A broad cultural consensus underlay the first impulse for (...) integration. Europeans had little trouble giving explicit or tacit allegiance to such a project, which resulted in an unparalleled success. However, roughly 60 years and 20 Member States later, social integration is being challenged as immigrants with diverse cultural backgrounds arrive, while far-right political parties surge in reaction; economic integration is confronted with a faltering euro and countries struggling to meet financial commitments; and political integration weakens as the EU seems to fail the democratic test. Cultural assumptions are no longer shared by all. Allegiance to today’s EU is problematic for the ordinary European citizen. This paper submits that careful attention to the spirit of the foundational ideals sheds light on how the present problems as well as future integration could and should be approached. (shrink)

In what ways and how far does virtue shield someone against suffering evils? In other words, how do non-moral evils affect the lives of virtuous people and to what extent can someone endure evils while staying happy? The central purpose of this chapter is to answer these questions by exploring what Aristotle has to say about the effects of evils in human well-being in general and his treatment of extreme misfortunes.

But it would be neither fair nor truthful to present to those perhaps less familiar with the EU and the 60 year old project of European integration, a picture which is only partial. The highly successful project of European integration, the EU, faces today (like it did 10, 20, 30 years ago) big challenges. Yet Brussels is, often, a very useful tool to face them is.

Sostenemos que este tipo de creatividad puede explicarse dentro de un enfoque cognitivo influyente, pero que dicho marco no es una receta para producir ejemplos novedosos de humor, e incluso puede excluirlos. Comenzaremos identificando tres grandes (...) problemas que surgen al tratar de precisar los rasgos centrales de la creatividad y algunas de las formas adoptadas por los estudios cognitivos en esta búsqueda. Luego consideraremos a qué llamamos «humor creativo», que exhibe las características centrales de la creatividad antes mencionada. A continuación exploraremos cómo un enfoque cognitivo clave para la comunicación humana puede explicar el humor creativo. Counselling y cuidados paliativos es el título del libro escrito por la doctora Esperanza Santos y el profesor José Carlos Bermejo. En esta obra, de fácil lectura y con consejos muy prácticos y útiles, se presentan elementos fundamentales para brindar un acompañamiento de óptima calidad en el cuidado paliativo, así como la posibilidad de hacer un autoexamen de cómo los cuidadores de los pacientes prestan sus servicios e incluso para no caer en burnout. Este libro es de gran utilidad, tanto (...) para los profesionales de la salud que trabajan en las unidades de cuidados paliativos, como para personas que dedican gran parte de su tiempo al cuidado de familiares con enfermedades terminales, o que pasan por procesos prolongados de enfermedad. One of the many proposals put forth recently in the revival of bioethics concerns solidarity, which is part of the agenda for the discipline in the twenty-first century. In this article, solidarity is proposed as a bioethical value, inasmuch as it cannot be achieved without considering the person towards whom one shows solidarity and without taking into account his or her environment. It is not possible to make bioethical judgments or to accomplish in-depth biological thinking when forgetting the person who (...) is at the source or heart of the matter. Based on a study of the experience of a group of health volunteers in Medellin (Colombia), this research found evidence of the existence of three elements that, together, serve as a hinge between solidarity and bioethics. -/- Entre las muchas propuestas que se han hecho recientemente en ese resurgir de la bioética se encuentra la solidaridad, consti­tuyéndose parte de la agenda del siglo XXI sobre esta disciplina. Proponemos la solidaridad como un valor bioético puesto que así como no se puede ser solidario sin tener en cuenta a la persona con quien soy solidario y su entorno, no se pueden emitir juicios bioéticos o hacer una reflexión bioética de fondo olvidando a quien se tiene en frente. A partir de un estudio de la expe­riencia de una población de voluntarios del sector salud en Medellín, Colombia, se logró evidenciar que existen tres elementos que, en conjunto, sirven de bisagra entre la solidaridad y la bioética. En este texto el autor nos pone frente a un término utilizado muy frecuentemente pero muchas veces am-biguo o que conduce a equívocos.

Our philosophical understanding of mental illness is being shaped by neuroscience. However, it has the paradoxical effect of igniting two radically opposed groups of philosophical views. On one side, skepticism and denialism assume that, lacking clear biological mechanisms and etiologies for most mental illnesses, we should infer they are constructions best explained by means of social factors. This is strongly associated with medical nihilism: it considers psychiatry more harmful than benign. On the other side of the divide, naturalism and reductionism (...) are on the look for failures in the biological functioning of the organism whenever a genuine mental illness occurs. Psychiatry as currently practiced, accordingly, exhibits the gaps of an ongoing research programme; a yet to be completed neuroscience would link mental illnesses with identifiable biological mechanisms. Both sides of this divide claim to be fostered by scientific discoveries and advances in neuroscience, when taken at face value. Against this background, we argue instead for a modest view. To that end, we draw attention to some nuances in the scientific realism debate. While contending that neuroscientific theories and models aim to provide true representations of their target systems, and can justifiably claim to have attained some, we argue that our confidence should not be placed beforehand in specific features of these scientific representations. Hence, it would be unwarranted to extract morals for psychiatry from posits (or their absence) in neuroscientific explanations of mental illnesses. To illustrate our position, we examine some recent discoveries in neuroscience concerning bipolar disorder. We conclude by linking our topic to a broader issue in the philosophy of medicine: insofar as psychiatry is a biomedical specialty, its classifications of health and disease are guided by pragmatic concerns, as well as by scientific discoveries. In the early 2000s, it was already mentioned that one of the problems of bioethics was a lack of wonder or amazement (Thaumazein in Greek). Today we see that the patient, the weak, and the helpless have become clients or objects at the disposal of personal, communal, and corporate whims based on functionality or utility that can take on a life of its own. Accordingly, this article proposes wonder or amazement as an attitude that not only makes it possible to (...) place the human being at the center and starting point of bioethical reflection, but it is those who suffer the most, the weak and the defenceless, who are predominantly at that center or starting point. -/- A comienzos de la década del 2000 ya se mencionaba que una de las cuestiones que aquejaba la Bioética era la falta de asombro. En la actualidad vemos que el paciente, el débil y el indefenso han pasado a ser clientes u objetos puestos a disposición de caprichos personales, comunitarios o empresariales basados en la funcionalidad o utilidad que pueda tener una vida en particular. Es por eso que en este trabajo proponemos el asombro como una actitud que permite no solo situar a la persona humana como centro y punto de partida de la reflexión bioética, sino que en dicho centro esté de manera preponderante el que más sufre, el débil y el indefenso. Palliative care seeks to provide holistic care to improve the quality of life for the sick, especially as they approach the end of their lives. Addressing the spiritual dimension of the human person is useful because it provides answers to the meaning of life. Spiritual care has been shown to be of great benefit to patients. Therefore, this paper explores the importance of the spiritual dimension in palliative care; highlight the act of listening as a key part of spiritual care, (...) showing that physician burnout is the main obstacle to improving listening as an appropriate service that is both comforting and healing. -/- Los cuidados paliativos buscan ofrecer una atención holística para brindar una mejor calidad de vida a los enfermos, especialmente cuando se aproximan al fin de su existencia. Profundizar en la dimensión espiritual de la persona humana resulta útil puesto que ofrece respuestas al sentido de la vida. Se ha constatado que la atención espiritual aporta grandes beneficios para el paciente. Es por eso que en este trabajo hemos querido profundizar en la importancia de la dimensión espiritual en los cuidados paliativos; se destaca la actitud de la escucha como pieza clave de dicha atención espiritual, lo que evidencia que el burnout de los médicos es el principal obstáculo para potenciar la escucha como una adecuada disposición que resulte consoladora y sanadora. In this paper I examine some of the positive epistemic and moral dimensions of anger in Plato’s dialogues. My aim is to show that while Plato is clearly aware that retaliatory anger has negative effects on people’s behavior, the strategy we find in his dialogues is not to eliminate anger altogether; instead, Plato aims to transform or rechannel destructive retaliatory anger into a different, more productive, reformative anger. I argue that this new form of anger plays a crucial positive role (...) in our intellectual and moral development. In relation to our intellectual development, anger is often part of people’s reactions to the Socratic interrogations and it often helps or hinders attempts to acknowledge one’s ignorance and become motivated to learn. For anger to play a positive role in the context of philosophical conversations, Plato suggests its transformation from being an outward-looking and reactive emotion oriented towards retaliation (refutation), into a mostly inward-looking emotion aimed at ones’ own moral and intellectual reform or self-betterment. In relation to our moral progress, anger is strategically linked both to the control of our appetites and to the virtue of courage, so anger is crucial to the psychology of the good citizen. Concretely, anger is needed both for the development of the right opposition to injustice and greed, and for the formation of an adequate sensitivity to justice. (shrink)
