Adam Ferguson’s imperial thought casts new light on the age-old republican dilemma of the tension between empire and liberty. Generations of republican writers had been haunted by this issue as the decline of Rome proved that imperial expansion would eventually ruin the liberty of a state. Many eighteenth-century Scottish thinkers regarded this as an insoluble conundrum and thus became critics of empire. Ferguson shared their basic views but, paradoxically, was still able to defend the British Empire in the debates over (...) the American Revolution. His argument effectively offered a viable solution to the republican dilemma, which distinguished him from his contemporaries. In light of this, I argue that political representation was the pivotal conception for Ferguson to make empire and liberty compatible. ABSTRACT Intellectual historians have tended to focus either on shifts in sensibility or, more analytically, on the substance and structure of thought. They might usefully, however, examine both, as well as the reciprocal action of the one upon the other. This applies equally to political and religious ideas. In early twentieth-century Ireland, it was the relationship between religion and politics that stirred controversy. How would the institutions of church and state function, respectively, under Home Rule and the Union. Opposing (...) camps advanced competing prognostications. This contest forces us to rethink the claim that revolutionary insurgency in Ireland was a species of ‘political religion’. The evidence points to a more complex picture while at the same time highlighting the persistence of sectarian attitudes in the historiography of the period. (shrink)

This article considers whether the 2016 EU referendum can be perceived as an English nationalist movement. Specifically, attention is given to examining how memories of the former British Empire were nostalgically enveloped in anxieties regarding England’s location within the devolved UK state. The comments and work of Enoch Powell and George Orwell are used to help explore the link between nostalgia and anxiety in accounts of English nationalism. Despite their opposing political orientations, when considered together, it is argued that both (...) men provide a unique cross-political perspective on Englishness, empire and nostalgia. By way of exploring these themes in relation to the EU referendum, Aughey’s assertion that English nationalism can be perceived as both a ‘mood’ and ‘movement’ is used to highlight how a sense of English anxiety regarding its lack of national sovereignty (mood), as well as a desire to reclaim this sovereignty by renegotiating trade relations with the ‘Anglo-sphere’ (movement), were conjoined in the popular referendum slogan, ‘take back control’. In conclusion, it is argued that the contextualization of the referendum can be predicated upon an orientation to empire that steers away from glorifying pro-imperial images of England/Britain, towards a more positive and progressive appropriation of the EU referendum as a statement of national change and belonging. The Fellowship of Confessing Anglicans (FCA), whose leaders govern well over half of the 80 million Anglicans worldwide, have put forward ‘a contemporary rule,’ called The Jerusalem Declaration, to guide the Anglican realignment movement. The FCA and its affiliates, e.g. the newly-formed Anglican Church in North America, require assent to the Declaration. To date, there has been little serious appraisal of the Declaration and the status accorded to it. I aim to correct that omission. Unlike ap-praisals in the social media, (...) however, mine grants the FCA’s conservative stand on same-sex unions and homosexual practice. Nevertheless, I argue, the Declaration mischaracterizes the traditional Christian teaching on marriage, binds Anglicans to falsehoods and dubieties in the Thirty-Nine Articles, and adds to the gospel. Two things follow. First, no one—especially no Anglican who identifies herself as con-servative, traditional, orthodox, evangelical, Anglo-catholic or simply concerned with the truth—should assent to the Jerusalem Declaration. Second, since the FCA and its affiliates know that these defects ex-ist in the Declaration, they should fess up to these shortcomings and retract the Declaration’s status as ‘a contemporary rule’ and they should stop requiring assent to it. Anything less constitutes intellectual dis-honesty of a most egregious sort. (shrink)

The future is evitable. That is to say if, as many of the contributors to Futures over the years have claimed, there is more than one future possible, and that more than one will be experienced, then talking about ‘inevitability’ is simply wrong. And what a task it is to attempt to say anything warranted, but nevertheless fresh concerning the futures of Europe—especially in such a context as considering the plural conception of futures in the title of this publication! Immediately (...) after the member states of the Union failed to agree the draft treaty on European Constitution at the Intergovernmental Conference ending on December 13, 2003, the Frankfurter Allgemeine Zeitung provided two full pages of political coverage under the rubric “After the Failure [or ‘running aground’] of Brussels— The EU in Crisis”, and on the front page reported “The EU at an Uncertain Future” [2]. Six months later, on the day after those same states agreed a Treaty Establishing a Constitution for Europe, The Irish Times reported that Sweden still supported the EU, but not the Euro, and that EU Council President Bertie Ahearn, the Irish Prime Minister, thanked all those who helped with ‘a ship that has been safely docked today’ [5]. Ships are useful not when they remain in port, but rather when they move, so six months later, after nearly four decades of failed attempts, on December 17, 2004, Turkey was given the possibility of opening talks for accession to the European Union. From the European docks of Ireland, Germany, Sweden, and the UK, there are contributions in this special edition of Futures on “The Futures of Europe”. Even within the geographic limits of Europe, the ships come at different speeds, as represented by two authors from outside the Eurozone and four within. There are also contributions from a ship between ports in Italy and the USA and from a ship between Germany and Turkey. And there is something from that port across the ocean—the USA. What may be perhaps the most telling contribution to this volume, however, is the one that is not here. I had invited a colleague from Beijing to provide a prospective from China on the futures of Europe, and he had enthusiastically accepted. (shrink)

Culturally Responsive Teaching (CRT) weaves together rigor and relevance while it improves student achievement and engagement. The Philippine Department of Education implemented Indigenous People’s education to respond to the demands for culturally responsive teaching. Teacher education graduates are expected to articulate the rootedness of education in sociocultural contexts in creating a learning environment that recognizes respect, connectedness, choice, personal relevance, challenges, engagement, authenticity, and effectiveness. Practice teachers need relevant exposure and immersion to fully develop their competence in CRT. This scenario (...) necessitates attention to assessing the competence of 191 practice teachers in CRT, correlating their competence across dimensions, and verifying the role of gender and degree programs in competence development. This investigation provides evidence on the role of gender in competence development toward culturally responsive teaching. Such competence is vital in practice teachers, especially because they are exposed to learners with diverse backgrounds during their teaching internship. This evidence informs supervising instructors in molding practice teachers. (shrink)

COVID-19 virus caused drastic changes in people's lives, especially in terms of employment. Employees were greatly impacted by this pandemic, as there were terminated from their jobs. This study investigated how depression affects terminated workers and how they manage it throughout the pandemic. -/- A qualitative design was employed to perform this study. A structured type of interview was conducted on five samples using an online platform. To establish the number of samples required for the investigation, convenience sampling was used. (...) The data was analyzed in-depth using a narrative technique, which resulted in the study's findings and conclusions. Five (5) terminated employees such as professional photographer, construction worker, hairdresser, driver, and varsity coach were among the participants. -/- The participants in this study were found to experience depression due to family financial issues caused by the loss of a job during the pandemic. Participants reported feelings of sadness and loneliness, as well as inability to think, low self-esteem, insomnia and hypersomnia, a lack of ambition to accomplish anything, and suicidal or negative thoughts. Accordingly, through their families' emotional support, the participants have been able to overcome their depression. (shrink)

The world of entrepreneurship has historically been linked with taking risks and the potential for significant rewards. However, there persists a notable gender imbalance in the entrepreneurial landscape, wherein women entrepreneurs remain a minority. Women navigating the entrepreneurial path encounter distinct challenges, setting their experiences apart from their male counterparts. In Balayan, Batangas, despite strides towards gender equality, women entrepreneurs continue to face challenges in the entrepreneurial landscape. This qualitative study delves into the experiences of 10 successful female entrepreneurs who (...) met specific criteria. Accordingly, semi-structured interviews are conducted, exploring various aspects of participants' experiences and revealing their motivations, achievements, challenges, and strategies. Thematic analysis reveals the connection between familial, community-driven, and personal motivations that drive these entrepreneurs forward. Despite facing obstacles such as financial constraints and gender biases, they prioritize financial gains and personal growth. With resilience, innovation, and dedication, these women overcome challenges and achieve success, utilizing support networks and online marketing strategies to their advantage. Recommendations include empowering women in entrepreneurship, strengthening support networks, introducing tailored financial literacy programs, and advocating against gender biases. Implement skill development initiatives and provide specialized education in online marketing. Engage in policy advocacy, celebrate success stories, and continuously research challenges and successes. Foster collaborative partnerships between businesses, educational institutions, and communities, and advocate for increased funding opportunities for sustainable growth. This research emphasizes the strength and capabilities of women entrepreneurs in Balayan, Batangas, affirming that "pink doesn't mean weak.". (shrink)

In this paper, we focus on Berkeley's reasons for accepting the ‘resemblance thesis’ which entails that for one thing to represent another those two things must resemble one another. The resemblance thesis is a crucial premise in Berkeley's argument from the ‘likeness principle’ in §8 of the Principles. Yet, like the ‘likeness principle’, the resemblance thesis remains unargued for and is never explicitly defended. This has led several commentators to provide explanations as to why Berkeley accepts the resemblance thesis and (...) why he also takes his opponents to do so too. We provide a contextual answer to this question, focusing on epistemological discussions concerning resemblance and representation in Early Modern Irish Philosophy. We argue that the resemblance thesis is implicit in early responses to William Molyneux's famous example of the ‘man born blind made to see’ and trace the ‘Molyneux man’ thought experiment as it is employed by Irish thinkers such as William King and Berkeley himself. Ultimately, we conclude that Berkeley's acceptance of the resemblance thesis can be explained by the Irish intellectual climate in which he was writing. (shrink)

‘The Union of Cause and Effect in Aristotle : Physics III 3’, Oxford Studies in Ancient Philosophy, 32, pp. 205-232, May 2007.: I argue that Aristotle introduced a unique realist account of causation, which has not hitherto been appreciated in the history of philosophy: causal realism without a causal relation. In his account, cause and effect are unified by the ectopic actualization of the agent’s potentiality in the patient. His solution consists in the introduction of a property that belongs (...) to one subject but is realized in another subject on whose state this realization depends. I identify and analyze the multiple ontological dependencies between the causal state of the agent and that of the patient during their causal activity. (shrink)

William Molyneux was born in Dublin, studied in Trinity College Dublin, and was a founding member of the Dublin Philosophical Society (DPS), Ireland’s counterpart to the Royal Society in London. He was a central figure in the Irish intellectual milieu during the Early Modern period and – along with George Berkeley and Edmund Burke – is one of the best-known thinkers to have come out of that context and out of Irish thought more generally. In 1688, when Molyneux (...) wrote the letter to Locke in which he posed the now famous question about a man born blind made to see, he was an active member of the DPS and was on familiar terms with several other key figures in Irish philosophy at the time. For the most part, Irish thinkers in the seventeenth and eighteenth centuries answered “no” to Molyneux’s question of whether a blind man made to see could distinguish, by sight alone, between a cube and a sphere. This article focuses on the so-called “Area of Freedom, Security and Justice” (ASFJ), namely the policy field of the European Union (EU) that covers judicial and police cooperation, migration and asylum policies and the control of external borders. The article explores how the AFSJ has emerged and how, within it, the relationship between freedom and security has evolved over time and brought about a shift towards a “Security Union”.

Union Citizenship as currently implemented in the European Union introduces a distinct concept of citizenship that necessitates an adequate normative approach. The objective of this paper is to assess EU Citizenship against the theoretical background of multilateral democracy. This approach is specifically suited for this task, as it does not rely on a nation-state paradigm or the presumption of a further transformation into a federation or union. We propose three criteria by which to assess multilevel citizenship: equal (...) individual rights, equal sovereignty of peoples and the balancing of individuals' and peoples' interests. We argue that the current practice of Union Citizenship does not fully meet the proposed standards, regarding equal rights within and equal access to, the political system. Based on our assessment, we propose reform options of access to national and supranational citizenship and argue for supranational participation rights and equal transnational rights to gradually re-establish full membership for individuals. In this essay I argue that Berkeley is proto-phenomenologist. The term phenomenology will chiefly be understood in terms of the approach of Edmund Husserl. Berkeley is attentive to the correct use of significations in philosophical exposition, the subjective character of experience, the motility of the perceiver and the transcendence of things. Like the phenomenologists he rejects materialism, naturalism and scepticism. He seeks to preserve the evidences of ordinary perception, setting out an account of scientific theory that can cohere with them. (...) In the first part of this essay I go through some of the more clear-cut ways in which Berkeley anticipates Husserl and some of the latter’s successors. In the second part I lay out their criticisms of Berkeley, also indicating what they hold in common. In the third and final part I consider some of the ways in which Berkeley can meet these criticisms, either readily or through certain qualifications, and I bring out his most significant contributions as a proto-phenomenologist. My aim is to show there are more than traces of the phenomenological attitude in Berkeley. In his efforts to save the appearances, he goes back to that world in which we live and breathe, if not quite have our being. (shrink)

As a result, unions may soon lose their ability to protect workers from economic and personal abuse, as well as their significance as a political force. In the Name of Liberty responds to this worrying state of affairs by presenting a new argument for unionization, one that derives an argument for universal unionization in both the private and public sector (...) from concepts of liberty that we already accept. In short, In the Name of Liberty reclaims the argument for liberty from the political right, and shows how liberty not only requires the unionization of every workplace as a matter of background justice, but also supports a wide variety of other progressive policies. This paper inaugurates a discussion about the phenomenology of union decision-making. Phenomenology provides a new lens that may enable us to gain penetrating insights into how unions function in the fractious world of human resources management. The present paper is preliminary to any fieldwork that may be undertaken. Its main purposes are to identify theory that could be the foundation of further practical work, relate recent work in the phenomenology of management to union practices and to propose directions (...) of enquiry. The relevant theory is that of Edmund Husserl who provides us with a practical method of enquiry into the real world of human resource practice. Husserl’s work has already been applied in relation to local government functioning and some of the findings there appear relevant to the present enquiry. This article attempts to provide an insight about the status of Students Union in Nepal, and describes, how they are not been able to solve the problems arising in the daily life of students.

The article aims at clarifying the historical status and cognitive potentials of such a genre of contemporary historiography of philosophy as biographical encyclopedia (dictionary). Based on extensive bibliographic material, the author demonstrates that in the late XX – early XXI centuries in the English-speaking countries there was a real outbreak of interest in encyclopedias and dictionaries, compiled from personalized articles about the life and works of philosophers of certain epochs, countries, trends, etc. According to the author, the increasing popularity of (...) this genre can be considered as a logical continuation of the historical and biographical turns that took place in the Anglo-American (analytic) philosophy in the 1980s and 1990s, respectively. The author specifically emphasizes that it caused the appearance of a significant number of encyclopedias and dictionaries, which contain the well-known facts as well as the significant elements of scholar novelty. The article also shows that similar tendencies have taken place in the contemporary Ukrainian historiography of philosophy. It is shown that Ukrainian experts also made their own significant contribution to the development of this genre. They have successfully developed a special approach, which presupposes the focus on life and works of the representatives of a particular academic institution. The intellectual value of this approach is demonstrated by the example of the recently published two-volume encyclopedia “Kyiv Theological Academy in Names: 1819-1924”. It contains a systematic and very informative presentation of the biographies of many representatives of the national philosophy, whose activities were associated with this institution. The author also shows that from the perspective of the historiography of philosophy, the general methodological foundations of this encyclopedic research is a matter of special interest. (shrink)

Eleonore Stump has argued that the fulfilment of union between God and human beings requires a mode of relatedness that can be compared to joint attention, a phenomenon studied in contemporary experimental psychology. Stump’s account of union, however, is challenged by the fact that mother Teresa, despite her apparent manifestation of the love of God to others, herself experienced an interior ”dark night of the soul’ during which God seemed to be absent and to have rejected her completely. (...) The dark night of the soul poses a problem for Stump’s account, since, if anyone had a union of divine love with God, it would seem that mother Teresa did. Nevertheless, I argue that the isolation and abandonment of mother Teresa’s dark night are contrary to the conditions assumed to be required for joint attention with God. As an alternative to Stump’s account, I suggest that the dark night of the soul might be better understood by reference to a combination of joint attention and blindsight, according to which interpersonal closeness might be realized through a consistent pattern of external actions without, however, a direct awareness of one person by the other. This paper presents the design, development, and potential impact of Echoes of Union Depot, a virtual reality (VR) game aimed at promoting historic preservation and raising public awareness about El Paso's Union Depot, a building listed on the National Register of Historic Places Inventory. The game leverages the immersive capabilities of VR technology and 360° images to engage players in exploring the site's rich history and architectural evolution. Players assume the role of a time-traveling detective, guiding lost spirits (...) to resolve their past and move on. The paper outlines the development process, highlighting the use of 360° panoramic images and 3D Vista Virtual Tour Pro software to create an accessible and user-friendly experience that fosters historic preservation awareness and cultural appreciation. The study also discusses limitations and areas for future research, including expanding the scope to include other heritage sites, working with historians and cultural consultants for accurate representations, and evaluating the game's effectiveness in promoting awareness and fostering a sense of community pride. Th is work is a companion piece to "The American Worker," Karl Kautsky's reply to Werner Sombart’s Why Is There No Socialism in the United States? (1906), first published in English in the November 2003 edition of the journal Historial Materialism. In August 1909 Kautsky wrote an article on Samuel Gompers, the president of the American Federation of Labor, on the occasion of the latter's first European tour. Th e article was not only a criticism of Gompers’s anti-socialist "pure-and-simple" unionism (...) but also part of an ongoing battle between the revolutionary wing of German Social Democracy and the German trade-union officials. In this critical English edition we provide the historical background to the document as well as an overview of the issues raised by Gompers' visit to Germany, such as the bureaucratisation and increasing conservatism of the union leadership in both Germany and the United States, the role of the General Commission of Free Trade Unions in the abandonment of Marxism by the German Social-Democratic Party and the socialists’ attitude toward institutions promoting class collaboration like the National Civic Federation. The central aim of this article is to explore the power politics of perception between English and Irish representations within selected canonised Irish texts. The focal point of this article orbits around the relationship between the observer and the observed with an essential emphasis on the roles of defining and defined subjects. Focusing on the metaphorical framework of Father England as the authority of gaze and Mother Ireland as the object of gaze, this article introduces Ireland’s post-independence era (...) as the inception of a transformative journey that is characterised by a promise of self-definition after liberation from English dominion. In navigating the power dynamics of perception between Father England and Mother Ireland, this article takes a focused approach by analysing key literary works. Specifically, James Joyce’s “The Dead” (1914), Máirtín Ó Cadhain’s The Key (1949), and John Banville’s The Book of Evidence (1989) serve as illustrative examples. With these texts, this article aims to depict the trajectory of Ireland’s evolution from a position of being defined to a self-defining position. (shrink)

Allo stesso tempo, la velocità con cui un prodotto viene offerto nel mercato dipende dalla capacità di integrare il design nel processo di produzione. Tuttavia, molte PMI - in particolare le nuove aziende basate sulla tecnologia - mancano di competenze specialistiche nella gestione del design e spesso non prestano sufficiente attenzione a questo aspetto. L'industria automobilistica e le grandi aziende come Philips e Braun (...) gestiscono e misurano l'impatto del design come strumento innovativo. Negli ultimi anni, le aziende industriali che sono in prima linea nella produzione di determinati prodotti stanno iniziando a sperimentare una forte concorrenza che non è egualmente protetta. Subiscono gli impatti dell'esperienza offerta da quasi gli stessi prodotti a prezzi inferiori, grazie a un minore investimento in ricerca e sviluppo, che riduce la struttura dei costi. (shrink)

Since the disintegration of the USSR Eurasia has gained a new geopolitical and strategic significance. Fifteen Countries emerged as a result of disintegration, among which only the Russian Federation was the successor state. The post-soviet era especially the era of the 1990s was a political and economic trauma for the Russian Federation and the post-soviet space. But Eurasianists were well aware of the American unilateralism and American ‘Grand Chessboard strategy” that was solely aimed at encircling Russian geography. With these concerns, (...) the Eurasianists advised the Russian political and military elites to initiate the Eurasian Union Project. This paper briefly sketches the Russian historical Eurasian dream, which deeply rooted in Russian imperial history, and discusses the importance of Eurasian philosophy for the political and economic stability of Russia-Eurasia. The paper also illustrates the challenges and opportunities for Eurasian integration and for the establishment of multipolar world order. Moreover, the paper also briefly outlines the geopolitical rationale behind the Eurasian project as a key objective of contemporary Russian foreign policy and geopolitics. (shrink)

When Neil MacCormick, in the wake of the launch of the Maastricht Treaty on European Union, went “beyond the Sovereign State” in 1993, he fundamentally challenged the heretofore dominant paradigm of legal ordering in the European context which considered law to be singular, unified and confined within sovereign nation states. The original insight of MacCormick might, however, be pushed even further, as a historical re-construction reveals that legal pluralism is not only a trademark of recent historical times, marked by (...) the European integration process, but has also been at the very core of legal evolution in Europe throughout its modern history. The introduction of modern law in Europe can be traced back to the eleventh and twelfth century Investiture Conflict between the Church and the Emperor, a conflict which solidified the existence of two parallel universes of law, one Church-based and one empire-based, both of which rested, in principle, upon mutually exclusive claims to superiority, but which nonetheless became institutionally stabilized in a manner which allowed for mutual co-existence between them. The existence of such parallel universes of law has throughout, also in the “Westphalian world”, been a central characteristic of European law. It is suggested that the current constellation between the EU and its Member States should be viewed in this light. (shrink)

The essay proceeds from the assumptions that for a economic/political integration group to succeed, first, its participants’ motives should ideally be as alike as possible and not oppose one another and, second, their expectations from integration should correspond to the organisation’s capabilities. In light of these assumptions, the study endeavours to assess the Eurasian Economic Union’s (EAEU) potential for stability and development. First, the author analyses the key motives that were driving its member states’ decisions to enter the organisation, (...) compares them with one another and discusses how the countries’ motives influence their conduct in the union. Second, the author confronts those motives against the EAEU’s activities and the general logic of interstate politics on the post-Soviet space to reckon up whether the bloc’s capabilities fit with the expectations of its member countries. Finally, based on that discussion, the author speculates on how the divergence/convergence of EAEU member states’ goals, as well as the (in-)feasibility of their expectations, affect the organisation’s development. Idea integracji europejskiej nie jest wymysłem naszych czasów. Jest to proces złożony, który dojrzewał na przestrzeni kilku wieków i który w naszym stuleciu zaczął nabierać wyrazistych kształtów. Społeczeństwa europejskie znużone bezsensem wzajemnie wyniszczających wojen, zaczęły poszukiwać takiej formy koegzystencji, która umożliwiłaby im wspólne decydowanie o polityce, gospodarce czy kulturze. W roku 1950 francuski minister spraw zagranicznych Robert Schuman zadeklarował gotowość rządu francuskiego do współpracy z rządem niemieckim w sektorze węgla i stali, w celu zagwarantowania pokoju na kontynencie. Plan Schumana urzeczywistnił (...) się z chwilą podpisania w Paryżu 18 kwietnia 1951 r. przez sześć państw zachodnioeuropejskich: Niemcy, Francję, Włochy, Luksemburg, Belgię i Holandię, układu o Europejskiej Wspólnocie Węgla i Stali (EWWiS). Kolejne dwa traktaty o utworzeniu Europejskiej Wspólnoty Gospodarczej (EWG) oraz Europejskiej Wspólnoty Energii Atomowej (Euratom) podpisane w Rzymie 25 marca 1957 r. miały na celu rozszerzenie współpracy gospodarczej na inne sektory, takie jak rolnictwo, rybołówstwo, komunikacja, handel zagraniczny oraz utworzenie wspólnego rynku gospodarczego. Aby cel ten został osiągnięty, państwa członkowskie zdecydowały się na kolejne kroki integracyjne, jakimi były unia gospodarcza i walutowa. Drogę do tego procesu otworzył podpisany 7 lutego 1992 r. w Maastricht Traktat o Unii Europejskiej. Ratyfikacja Układu z Maastricht stała się okazją dokonania pewnych zmian w niemieckiej konstytucji, do której wprowadzono nowy zapis w art. 23 o Unii Europejskiej. Unia stała się celem nadrzędnym państwa niemieckiego, a Bundestag i Bundesrat otrzymały jasne cele i zadania w sprawach dotyczących Unii Europejskiej. Fakt ten świadczy o ogromnym znaczeniu Unii dla Niemiec. Niemcy są jednym z najbogatszych państw piętnastki. Ich PKB przekracza 20 tys. ECU i jest jednym z najwyższych w Unii. Motorem niemieckiej gospodarki jest przemysł, a zwłaszcza prężnie rozwijający się przemysł samochodowy. Unia Europejska jest dla Niemiec ważnym rynkiem zbytu - 60% eksportu w ramach Unii Europejskiej zajmuje eksport niemiecki. Poziom, który Niemcy osiągnęli w przeciągu 50 lat od zakończenia drugiej wojny światowej, nie byłby możliwy bez ścisłej współpracy pozostałych państw europejskich. Zniesienie ceł oraz wszelkich barier gospodarczych stworzyło ogromne możliwości handlowe i nie tylko. Ważnym krokiem w intensyfikacji wzajemnych stosunków było utworzenie unii gospodarczej i monetarnej, mającej na celu wprowadzenie do 2002 wspólnej waluty EURO. Wraz z postępującą integracją wewnątrz Unii Europejskiej pod koniec lat osiemdziesiątych dokonały się w Europie ważne zmiany historyczne. Europa Środkowa i Wschodnia uwalnia się, w wyniku reform przeprowadzanych w Związku Radzieckim przez Michaiła Gorbaczowa, spod totalitarnych rządów komunistycznych. W roku 1991 wybucha w Moskwie pucz, który wykorzystują republiki radzieckie, ogłaszając swoją niepodległość. W Polsce i na Węgrzech odbywają się obrady okrągłego stołu, w wyniku których komuniści oddają władzę opozycji. Do ostrych konfliktów dochodzi natomiast w Czechosłowacji i Rumunii, gdzie oddanie władzy nie odbywa się bez przelewu krwi. Zmiany polityczne nie ominęły również NRD. W nocy z 9 na 10 listopada 1989 r. runął mur berliński, a 3 października 1990 r. dokonuje się zjednoczenie obu państw niemieckich. Wraz ze zjednoczeniem NRD staje się członkiem Unii Europejskiej. Proces ten odbywa się jednak na innych zasadach, niż przewidują to unijne procedury mówiące o przyjęciu nowych członków w swoje szeregi. W dniu zjednoczenia Wschodnie Niemcy przejmują prawo pierwotne oraz 80% prawa wtórnego Unii. Poza tym otrzymują znaczną pomoc w ramach funduszy strukturalnych. Wiele państw Europy Środkowo- Wschodniej chętnie podzieliłoby los NRD i szybko zintegrowałoby się z zachodnioeuropejskimi strukturami. Dlatego też od początku lat dziewięćdziesiątych zauważamy intensywne starania tych państw o przyjęcie w struktury Unii Europejskiej. W roku 1991 Polska i Węgry podpisały jako pierwsze państwa byłego Bloku Wschodniego Układy Europejskie. W ślad za nimi poszły Bułgaria, Litwa, Łotwa, Estonia, Rumunia, Słowenia, Słowacja i Czechy. Od 1994 r. kraje te wystąpiły oficjalnie o członkostwo w Unii Europejskiej. Przystąpienie do Unii spotyka się w społeczeństwie z wieloma negatywnymi reakcjami. Polacy coraz bardziej sceptycznie odnoszą się do spraw Unii Europejskiej i do przyszłego w niej członkostwa, choć z pewnością można by liczyć na wiele. Chociażby na ustabilizowanie gospodarki, młodej demokracji oraz stosunków polsko-niemieckich. Przeszkodą i problemem na drodze do integracji jest sytuacja polskiego rolnictwa, kwestia wykupu ziem polskich przez Niemców oraz utraty tożsamości narodowej. Również Niemcy obawiają się rozszerzenia. Politycy natomiast wydają się być motorem integracji europejskiej. Helmut Kohl, były kanclerz Niemiec, postawił sobie nawet za cel zintegrowanie krajów środkowoeuropejskich ze strukturami zachodnimi do 2002 r., podając za powód swej decyzji utrzymanie stabilności gospodarki i pokoju w tym regionie. Jego następca Gerhard Schröder nie jest już takim optymistą. Podczas niemieckiego przewodnictwa w Radzie Unii Europejskiej ma zamiar zająć się w pierwszej kolejności interesami niemieckimi oraz sprawami dotyczącymi wewnętrznych problemów Unii Europejskiej. Kwestia rozszerzenia zeszła na plan dalszy. Czy jest to słuszna koncepcja - pokaże czas. (shrink)

ABSTRACT. This essay addresses the interpretation of Descartes’ understanding of the mind-body relationship as a substantial union in light of a statement he makes in the Passions de l’âme regarding the role of the blood and vital heat. Here, it seems Descartes cites these corporeal properties as the essential dispositions responsible for accommodating the soul into the human fetus. I argue that this statement should be read in the context of certain medical texts with which Descartes was familiar, namely (...) those of Jean Fernel and William Harvey. Reviewing Fernel’s comments on substantial union, one finds that the soul joins the body on the basis of a celestial spirit that not only bears the vital heat, it also directs the generation of the body. Similar to Harvey, Descartes locates these properties in the blood itself, although, in contrast to Harvey, Descartes reduces these processes to matter and motion. Finally, I highlight the role this heat plays in Descartes’ embryological writing, contrasting it with that of Fernel. I conclude that although Descartes makes various comments supporting a reading of the mind-body relation as a substantial union, his physiological writings on generation and his idea of ‘life’ contradict this interpretation. -/- . This article proposes an understanding of the identity of God and Jesus that might be attractive and even plausible to persons of all monotheistic faiths. The basic thesis is that Jesus (as both "fully God and fully human") is best understood (...) to mean that Jesus fully identified with God experientially, psychologically, evaluationally, morally, and spiritually; and God fully identified with Jesus in similar ways. Con la entrada en vigor del Tratado de Lisboa, la Carta de Derechos Fundamentales adquiere eficacia jurídica, y se prevé la posibilidad de que la Unión Europea se adhiera al Convenio de Roma. En este trabajo pretendemos acercarnos a los antecedentes que han justificado una huída de la tutela de los derechos fundamentales de base jurisprudencial desarrollada por el Tribunal de Justicia hacia una formalización de la misma, a través de dos caminos: la formalización a través de una declaración de (...) derechos que se ha concretado en la Carta de Derechos Fundamentales, y la adhesión al Convenio de Roma. Finalmente trataremos de esbozar las perspectivas que se abren en el horizonte constitucional de la Unión Europea, donde gozamos ya de un Tribunal de Justicia que ejercerá una función tan constitucional como la tutela de los derechos fundamentales, contenidos ya en una declaración con fuerza jurídica, cuya interpretación se vincula al Convenio de Roma. Der normative Gehalt des Subsidiaritätsprinzips und seine Bedeutung für die Politische und Soziale Union Europas (S. 201-203) 1. Die Entwicklung des Maßstabs normativer Subsidiarität im ersten Kapitel beruht auf der Erkenntnis, dass dem Subsidiaritätsprinzip insbesondere von seinen protestantischen Wurzeln und seiner Ausprägung in der katholischen Soziallehre her ein spezifisch normativer Kerngehalt innewohnt, der als Idee auch dem Grundgesetzt als zwar weltanschaulich neutraler, aber nicht wertneutraler politischer Ordnung zugrunde liegt. Ausgehend von einem Menschenbild, das christliche Personalität und gesellschaftliche Solidarität umfasst, (...) setzt der materiale Gehalt des Subsidiaritätsprinzip insofern Grenzen, "als die Legitimation einer politischen Gemeinschaft nur von der Einzelperson im Sinne des individualistischen Liberalismus erfolgen kann und als die Anwendung des Subsidiaritätspinzips der Solidarität sozialer Einheiten bedarf. 2. Das ursprünglich von den deutschen Ländern anvisierte Ziel einer Verankerung des Strukturprinzips des Föderalismus im Vorfeld des Maastrichter Vertrages, ergänzt um das Subsidiaritätsprinzip als Prinzip der Kompetenzausübung, scheiterte am Widerstand Großbritanniens. Die Briten setzten das föderative Prinzip mit einem zentralistischen Bundesstaat gleich, den sie auf jeden Fall verhindern wollten. Fortan verbanden die Deutschen, insbesondere die deutschen Länder und Bundesregierung mit Unterstützung der beiden großen Kirchen einschließlich der kirchlichen Wohlfahrtsverbände, mit dem Subsidiaritätsprinzip neben einer Föderalisierung der Europäischen Union auch das Ziel, die Gesundheits- und Sozialpolitik auf europäischer Ebene auszubauen. Wenig später, schon im Verlauf der der Ratifikation des Vertrages, wird das Subsidiaritätsprinzip seitens der Bundesregierung und der deutschen Länder auf den Vorrang der der unteren Ebene umgemünzt. 3. Parallel zum Subsidiaritätsstreit in den 60er Jahren wird die Nähe zur Person bzw. zum Bürger instrumentalisiert, um dem Subsidiaritätsbegriff den Inhalt zu geben, der aus machtpolitischen Interessen opportun erscheint. Im innerdeutschen Subsidiaritätssstreit der 60er Jahre wurde die funktionale Dimension des Prinzips in den Vordergrund gedrängt, wohingegen seit 1993 seitens der Bundesregierung und der deutschen Länder im europäischen Kontext die territoriale Dimension des Prinzips, die sich gegen europäische Institutionen als Inbegriff bürgerferner, nicht demokratisch legitimierter Politik richtet, hervorgehoben wird. In beiden Fällen geht die aus Gründen normativer Subsidiarität gebotene Balance zwischen Identität und Funktion, zwischen Demokratie und Effizienz, verloren. 4. In den 60er Jahren haben die Verbände der freien Wohlfahrtspflege ihre Freiheit gegen Staatsnähe eingetauscht. Daraus entstanden neo-korporatistische Strukturen, die die Verbände zu mächtigen Trägern sozialer Dienstleistungen werden ließen. Die Rolle der Verbände als intermediäres Bindeglied zwischen Bürger und Staat wurde vernachlässigt. 5. In den 90er Jahren im europäischen Kontext die funktionale Dimension des Subsidiaritätsprinzip auf den territorialen Rahmen der Mitgliedstaaten zurecht gestutzt. Im Vordergrund steht nicht die bestmögliche Lösung eines Problems. Man gibt sich mit der vermeintlich "ausreichenden" Lösung auf mitgliedsstaatlicher Ebene zufrieden. Die systematische Auslegung, die im Hinblick auf die Sicherung der Funktionsfähigkeit der Gemeinschaft von besonderer Bedeutung ist, ergibt hingegen, "dass das Subsidiaritätspinzip als Kompetenzausübungsprinzip verfasst ist und zweitens, dass eine Entscheidung sowohl auf der Ebene der Gemeinschaft als auch auf Ebene der Mitgliedstaaten bürgernah sein kann." Deutlich tritt hier die Kluft zwischen rechtlicher Konzeption, die Ausdruck universeller Geltung des Prinzips ist, und verfolgten politischen Eigeninteressen der Akteure hervor. 6. Wenngleich bei den Verbänden der freien Wohlfahrtspflege, insbesondere den kirchlichen, der Territorialaspekt des Subsidiaritätsprinzips dominiert, gibt es Anzeichen dafür, dass die Überzeugung wächst, dass ohne eine sachbezogene, auf weitere Integration gerichtete Europapolitik auch die drei Wohlfahrtspflege in Deutschland nicht aufrechtzuerhalten ist. So vertreten die kirchlichen Verbände im Rahmen einer von der Kommission initiierten Konsultation zu Armut und Ausgrenzung in Europa die Ansicht, dass eine Lösung auf mitgliedsstaatlicher Ebene nicht ausreichend sei. In welcher Form die sozialpolitische Verantwortung auf europäischer Ebene wahrgenommen werden soll, bleibt offen. 7. Weder das Hervorheben der Nation als die maßgebliche territoriale Größe, die ihren Bürgern Schutz und Sicherheit bieten kann, noch die Vorstellung, Europas Vielfalt durch die Mobilisierung der Selbstregulierungskräfte der Gesellschaft erhalten zu können, bieten Perspektiven, das Demokratie-Effizienz-Dilemma zu überwinden. 8. Der Erhalt europäischer Demokratien ist ohne das Herausbilden transnationaler Formen von Demokratie nicht denkbar. Denn der Nationalstaat allein kann die Substanz der Demokratie nicht gewährleisten. Der nationale Wohlfahrtsstaat wird ausgehöhlt. Übrig bleibt die leere Hülle nationaler Souveränität. 9. Aussicht bietet eine zivilgesellschaftliche Verschränkung von Politik und Gesellschaft. Repräsentative nationale Akteure kooperieren zur Erfüllung einer europäischen Aufgabe und entwickeln daraus eine europäische Identität. Aufgrund ihrer assoziativen Funktion sind hier vor allem zivilgesellschaftliche Akteure gefragt. Hier eröffnet sich den Wohlfahrtsverbänden die Chance, sich auf ihre Wurzeln zu besinnen und verstärkt ihre Rolle in der Gesellschaft wahrzunehmen, um sich so die Position der Repräsentativität nachhaltig zu sichern. 10. Eine gleichgewichtige funktionale Repräsentation wirtschaftlicher, sozialer und kultureller Interessen einschließlich Repräsentationsmonopol und Mitverantwortung für die ausgehandelten Ergebnisse kann einen Beitrag zur Behebung des europäischen Demokratiedefizit leisten. Dies setzt voraus, dass die Europäische Union staatsähnliche Eigenschaften ausbildet, die sie dazu befähigt, Verhandlungsgleichgewichte zwischen den Repräsentanten der verschiedenen Interessen herzustellen und autonom über Umverteilungsfragen zu entscheiden und eine entsprechende Politik auch durchzusetzen. A multilevel consultative approach to governmental decision-making is increasingly being adopted in the European Union. On the back of this shift, it is prudent to consider the use of such consultative approaches in reforming digital copyright law. The adoption of a multilevel consultative approach has the potential to significantly benefit European Member States and increase political integration in Europe. Such an approach can address the complex dispersion of power amongst different levels of public institutions in the European Union (...) and support effective decision-making. The 2014 Charter for Multilevel Governance (‘Charter’) established a sophisticated governance framework to enhance operational and institutional cooperation and decision-making mechanisms among European Member States. Subsequently, the Charter and the concept of multilevel consultation formed an important facet of the European Union’s review of copyright regulation. The objective of this article is to evaluate the merits of a multilevel consultative approach by analysing its use in the European Union digital copyright law review process. (shrink)

Classic expression theory identified the emotional content of works of art with the feelings of the artists and the recipients. This content thus appeared to be external to the work itself. Consequently, formalism declared it to be irrelevant to a work’s value. A way out of this predicament – one which the Polish aesthetician Henryk Elzenberg (1887–1967) was among the first to propose – was suggested by the idea that physical, sensory objects can themselves possess emotional qualities. Thanks to Bouwsma (...) and Beardsley, this concept – of expressiveness as a quality – became common in Anglo-American aesthetics from the 1950s onwards. At the same time, these authors demanded that the term ‘expression’ be expunged from the language of aesthetics. But the widespread tendency to conceptualize the emotional content of art in terms of the expression of a certain subject (most often the artist) still requires some explanation – interpretation, rather than negation. One interpretation construes the expressiveness of works of art in terms of the expression of a fictitious subject, the ‘work’s persona’, conceived by Elzenberg in the 1950s and 1960s. This article discusses his concept and explains some of its more complex aspects, before addressing the emergence of a very similar concept within Anglo-American aesthetics. This concept was gradually elaborated in the 1970s and 1980s, but only in the 1990s did it become more fully developed and widely discussed. (shrink)

¿Cuáles son los desafíos a los que se enfrenta en este momento Europa? ¿Son de organización, de procedimientos, de técnica jurídica? ¿O apuntan a una crisis más profunda capaz de poner en tela de juicio sus propios fundamentos? Elemento clave en la configuración histórica de la civilización europea, el cristianismo, cuyo papel en la articulación de un ideal común de vida podía darse por sentado hasta hace apenas unas décadas, pasa ahora por una situación un tanto delicada. La dificultad se (...) agrava con el descrédito de ciertos modelos de integración social en el contexto del multiculturalismo, la posición de Europa ante la amenaza del terrorismo fundamentalista, la inestabilidad de la actual reconfiguración de fuerzas en el orden internacional o la propagación de un peligroso escepticismo hacia las instituciones comunitarias. Este volumen pretende iluminar todas estas cuestiones desde una perspectiva interdisciplinar, con una mirada atenta a los principios religiosos, culturales y morales que han dado forma a la Europa de hoy, y a las exigencias políticas y legales derivadas de los valores fundacionales de la Unión. When discussing the safety of research subjects, including their exploitation and vulnerability as well as failures in clinical research, recent commentators have focused mostly on countries with low or middle-income economies. High-income countries are seen as relatively safe and well-regulated. This article presents irregularities in clinical trials in an EU member state, Poland, which were revealed by the Supreme Audit Office of Poland (the NIK). Despite adopting many European Union regulations, including European Commission directives concerning Good Clinical Practice, these (...) irregularities occurred. Causes as well as potential solutions to make clinical trials more ethical and safer are discussed. (shrink)

Contemporary fascism is an understudied phenomenon in Latin America. As a contribution to this understudied area, this article analyzes the evolution of fascist thought in Peru from its interwar history to the twenty-first century. Following Roger Griffin’s influential ‘new consensus’ approach to fascism studies based on a fascist minimum, this study explores Peruvian fascism and will argue that fascism developed new expressions in the years after 1945. It will develop the terms ‘neo-fascism’ and ‘post-fascism’, based on Griffin’s fascist minimum, to (...) clarify the nature of the fascist movements to be analyzed. It will conclude that historically Peruvian fascism was exemplified by the Partido Unión Revolucionaria [Revolutionary Union Party], while in the postwar period, it took two parallel directions: the uniquely Peruvian neo-fascism of Acción Legionaria [Legionary Action] and the ethnocacerist or Andean post-fascism of Antauro Humala. In modern Anglo-European philosophy there is a distinct progression from the metaphysical realism of ancient and classical philosophy towards a type of scepticism that eventually leads towards nihilism. Interestingly this progression also appears in the doctrines of the Classical schools of Indian Buddhism that pre-date modern European philosophy by well over six centuries. This progression stems from the application of the same types of logical and philosophical reasoning to the problems of metaphysics. The movement from metaphysical realism to representationalism (...) to idealism and finally towards nihilism, which is seen within both the classical Indian Buddhist tradition and Modern Anglo-European philosophy, are products of a coherent and wholly logical progression from the acceptance of certain metaphysical principles. The fact that these same movements occur in two philosophical traditions that are separated by vast chasms in space, time and culture seems to point to an underlying commonality underlying human philosophical enquiry, whether this is a result of a common intelligible reality, an essential and universal human nature or both is a philosophical question we must continue to pursue. A contradiction is obtained, considering the axiom of infinity, then ℕ and Peano axioms, together a list of ℕ subsets and with inclusion relation and union operation. Natural numbers constitute an infinite set, ℕ, but we show the union of its proper subsets, with a specific form, isn’t an infinite set. Also we get a simpler explanation and a symbolic representation. Lastly, inconsistency of Peano successor axiom is a consequence of rejecting infinity.

En Europa vivimos inmersos dentro de una pluralidad de sistemas constitucionales: tanto los sistemas estatales como el sistema de la Unión Europea. Esto podía llevar a ciertas situaciones de conflicto, al menos en una perspectiva teórica en principio, y por ello se ha tratado de explicar y solucionar la tutela de los derechos fundamentales en la Unión Europea mediante la teoría llamada «pluralismo constitucional». Sin embargo, se plantean dudas que pueden llevarnos a considerar dicha teoría como una mera «construcción artificial» (...) que no haría sino ocultar los verdaderos problemas de la tutela de los derechos fundamentales en la Unión Europea. Recientemente el Pleno de la Sala de lo Civil del Tribunal Supremo ha venido a resolver, en Sentencia de 18 de junio de 2012 (rec. núm. 489/2007), un recurso de casación en el que se planteaba la cuestión de la eficacia en España, a efectos registrales, de una escritura otorgada ante notario alemán, dándole validez, y, por tanto, estableciendo su aptitud para generar la oportuna inscripción en el Registro de la Propiedad español. -/- Los argumentos fundamentales de la sentencia que (...) comentamos son dos: en primer lugar, la libre prestación de servicios en el ámbito de la Unión Europea excluiría la posibilidad de interpretar que se pueda imponer la intervención en todo caso de un notario español lo que constituiría una restricción de la libertad fundamental antes citada; y en segundo lugar, entendiendo que los efectos de la escritura pública alemana debían regirse por lo previsto en el Derecho español, esto es, los previstos en el artículo 1.462 del Código Civil, y no los previstos en el Derecho alemán, donde se exige un segundo acuerdo de carácter dispositivo para que se produzca la transmisión de la propiedad. El Tribunal de Justicia ha comenzado a utilizar la Carta de los Derechos Fundamentales de la Unión Europea como un instrumento con fuerza jurídica equivalente al Tratado, a la vez que amplía el ámbito de su control jurisdiccional y su posición como garante de los derechos fundamentales en la Unión Europea. Sin embargo, esto debería ir acompañado de una auténtica garantía de los mismos y una pormenorizada justificación de sus límites y restricciones, lo que no parece evidente en todos los (...) casos. I present some responses by means of a pastiche of a widely read European fiction writer.
