In the modern period, the most original and influential theories about law and politics were developed in connection with a set of far-reaching, interrelated questions about the definition of law, the purpose of law, the relationship between law and morality, and the existence of natural law and natural rights. In this entry I summarize the contributions of Charles-Louis de Secondat, Baron de La Brède et de Montesquieu; William Blackstone; Jeremy Bentham; and Immanuel Kant as exemplars of (...) the history of modern thought on law and politics. INTRODUÇÃO Para compreender como a Sociologia nasceu e se desenvolveu, é essencial analisar as transformações que ocorreram a partir do século XIV, na Europa ocidental, marcando a passagem da sociedade feudal para a sociedade capitalista, ou a passagem da sociedade medieval para a sociedade moderna. Para isso, é necessário realizar uma pequena viagem histórica, já que, para entender as ideias de um autor e de determinada época, é fundamental contextualizá-las historicamente. Em cada sociedade, em todos os tempos, os seres humanos (...) elaboraram explicações religiosas, míticas, culturais, étnicas etc. para as situações em que vivem. No século XIX, a busca por outro tipo de explicação para os fenômenos da sociedade – a explicação científica – deu origem à Sociologia. Para demonstrar como o pensamento social organizou-se historicamente e como a Sociologia estruturou o saber sobre a sociedade humana, este trabalho terá como objetivo estudar alguns autores que se sobressaíram no processo de desenvolvimento dessa ciência. PREMISSA A Sociologia surgiu como um corpo de ideias a respeito do processo de constituição, consolidação e desenvolvimento da sociedade moderna. É fruto da Revolução Industrial e, nesse sentido, é denominada “ciência da crise”, porque, com base nela, procurou-se dar respostas às questões sociais desencadeadas pelo processo revolucionário que, num primeiro momento, alterou a sociedade europeia e, depois, a maior parte do mundo. Como todas as ciências, a Sociologia não despontou de repente ou da reflexão de algum autor iluminado. Constituiu-se com base em conhecimentos sobre a natureza e a sociedade que se desenvolveram a partir do século XIV, acompanhando as mudanças que marcaram a transformação da sociedade feudal e a constituição da sociedade capitalista. Entre essas mudanças, a expansão marítima europeia e a ampliação do comércio ultramarino, a Reforma protestante e o desenvolvimento científico e tecnológico podem destacados. São o pano de fundo do movimento intelectual que alterou profundamente as formas de explicar a natureza e a sociedade. Essas mudanças estão todas vinculadas e não podem ser entendidas como eventos isolados. 1 A EXPANSÃO MARÍTIMA Com a circum-navegação da África e o descobrimento da rota para as Índias e para a América, a concepção de mundo dos europeus foi consideravelmente ampliada. A definição de um mundo territorialmente bem mais vasto, com outros povos, outras culturas e outros modos de explicar as coisas, requereu a reformulação da maneira de ver e de pensar dos europeus. Assim, ao mesmo tempo que conheciam novos povos e novas culturas, os europeus instalavam colônias na África, na Ásia e na América. Em razão disso, expandiu-se o comércio de mercadorias (sedas, especiarias e produtos tropicais, como açúcar, milho, tabaco e café) entre as metrópoles e as colônias, bem como entre os países europeus. Surgiu a possibilidade de um mercado muito mais amplo e com características mundiais. Este seria o primeiro grande movimento de globalização. A exploração de metais preciosos, principalmente na América, e o tráfico de escravos para suprir a mão de obra nas colônias deram grande impulso ao comércio, que não mais ficou restrito aos mercadores das cidades-repúblicas (Veneza, Florença ou Flandres), passando também para as mãos de grandes comerciantes e de soberanos dos Estados nacionais em formação na Europa. Toda essa expansão territorial e comercial acelerou o desenvolvimento da economia monetária, com a acumulação de capitais pela burguesia comercial, que, mais tarde, teve importância decisiva na gestação do processo de industrialização da Europa. 2 A REFORMA PROTESTANTE No século XVI, assistiu-se também ao movimento que ficaria conhecido como Reforma protestante. Os reformistas questionavam as condutas do clero, a estrutura da Igreja católica e a autoridade do Papa. Os líderes do movimento promoviam a valorização do indivíduo ao pregar a livre leitura das Escrituras Sagradas e dispensar a intermediação dos ministros da Igreja nas práticas religiosas e nos assuntos relativos à fé. A Reforma contribuiu, assim, para alimentar um movimento de resistência à autoridade e à tradição que desembocaria na Ilustração. Entre seus principais líderes figuram Martinho Lutero (1483-1546) e João Calvino (1509-1564). 3 O DESENVOLVIMENTO CIENTÍFICO E TECNOLÓGICO A nova maneira de se relacionar com as coisas sagradas foi acompanhada de uma nova forma de analisar o universo e a vida em sociedade. A razão passou a ser considerada essencial para conhecer o mundo; com base nela, as pessoas se consideraram livres para julgar, avaliar, pensar e emitir opiniões sem se submeter a nenhuma autoridade transcendente ou divina. A análise do universo e da vida em sociedade com base no conhecimento racional, fundado na observação e na experimentação, difundiu-se de maneira lenta, entre os séculos XV e XVII. Os pensadores que adotaram essa forma de análise enfrentaram o dogmatismo e a autoridade da Igreja. Por meio do Concílio de Trento (1545-1563) e dos processos da Inquisição, por exemplo, os membros do clero procuraram impedir toda e qualquer manifestação que pudesse pôr em dúvida a autoridade eclesiástica, fosse no campo da fé, fosse no das explicações que se propunham para a sociedade e a natureza. Os principais representantes do pensamento racional nos séculos XV a XVII foram Nicolau Maquiavel (1469-1527), Erasmo de Roterdã (1466-1536), Nicolau Copérnico (1473- 1543), Galileu Galilei (1564 -1642), Thomas Hobbes (1588 -1679), Francis Bacon (1561- 1626), René Descartes (1596 -1650) e Baruch Spinoza (1632 -1677). Os conhecimentos desses precursores alimentaram outros pensadores, como John Locke (1632-1704), Gottfried Leibniz (1646-1716) e Isaac Newton (1643-1727), que propuseram novos princípios para a compreensão da sociedade e da natureza. Vale salientar, por fim, que os pensadores europeus dos séculos XV a XVII buscaram compreender os fenômenos da natureza e da sociedade por meio da observação e da experimentação. 4 AS TRANSFORMAÇÕES NO SÉCULO XVIII No final do século XVIII, na maioria dos países europeus, a burguesia comercial, formada basicamente por comerciantes e banqueiros, constituía uma classe poderosa, em razão, na maior parte das vezes, das ligações econômicas que mantinha com as monarquias. Além de sustentar o comércio entre os países europeus, a burguesia europeia lançava seus tentáculos a vários pontos do mundo, até onde pudesse chegar, comprando e vendendo mercadorias. O capital mercantil estendia-se também a outro ramo de atividade: gradativamente se organizava a produção manufatureira. A compra de matérias-primas e a organização da produção, por meio do trabalho domiciliar ou do trabalho em oficinas, levavam ao desenvolvimento de um novo processo produtivo em contraposição ao das corporações de ofício. Os organizadores das manufaturas passaram a se interessar cada vez mais pelo aperfeiçoamento das técnicas de produção, a fim de produzir mais com menos gente e aumentar significativamente seus lucros. Para tanto, procuraram financiar a invenção de máquinas que pudessem ser utilizadas no processo produtivo. Com a invenção das máquinas de tecer e de descaroçar algodão, e a aplicação industrial da máquina a vapor e de outros tantos inventos destinados a aumentar a produtividade do trabalho, desenvolveu-se o fenômeno que veio a ser chamado de maquinofatura. O trabalho que as pessoas faziam com as mãos ou com ferramentas passava, a partir de então, a ser realizado por máquinas, elevando muito o volume da produção de mercadorias. A utilização da máquina a vapor, que podia mover outras tantas, impulsionou a indústria construtora de máquinas e, consequentemente, a indústria voltada para a produção de ferro e, posteriormente, de aço. Nesse contexto de profundas alterações no processo produtivo, no qual a utilização do trabalho mecânico era cada vez mais frequente, o trabalho artesanal continuou a existir. A maquinofatura se completou com o trabalho assalariado, no qual eram utilizadas, numa escala crescente, a mão de obra feminina e a infantil. Longe da Europa, explorava-se ouro no Brasil, prata no México e algodão nos Estados Unidos da América e na Índia. A maioria dessas atividades era realizada com a utilização do trabalho escravo ou servil. Esses elementos, conjugados, asseguraram as bases do processo de acumulação necessária para a expansão da indústria na Europa. Essas mudanças, somadas à herança cultural e intelectual do século XVII, definiram o século XVIII como explosivo. Se no século anterior a Revolução Inglesa determinou novas formas de organização política, no século XVIII a Revolução Americana e a Francesa alteraram o quadro político ocidental e serviram de exemplo e parâmetro para as revoluções políticas posteriores. As transformações na esfera da produção, a emergência de novas formas de organização política e a exigência da representação popular conferiram características muito específicas a esse século, em que pensadores como Charles de Montesquieu (1689 -1755), Voltaire (1694 - 1778), Denis Diderot (1713 -1784), Jean le Rond d’Alembert (1717 -1783), David Hume (1711 -1776), Jean-Jacques Rousseau (1712 -1778), Adam Smith (1723 -1790) e Immanuel Kant (1724 -1804) procuraram, por caminhos às vezes divergentes, refletir sobre a realidade, na tentativa de explicá-la. When David Hume wrote to Baron de Montesquieu ‘J’ai consacré ma vie à la philosophie et aux belles-lettres’,1 he was not describing himself as having two separate callings. His was a single vocation — one involving the expression of deep thought through beautiful writing.2 This vocation did not come naturally or easily to Hume. He struggled continually to reshape his approach to prose, famously renouncing the Treatise of Human Nature as a literary failure and radically revising the presentation (...) of his philosophy in the Essays and two Enquiries. This essay will focus on Hume’s struggle between two modes of moral-philosophical composition prevalent in his day: the cold, unemotional style associated with experimental science that Hume metaphorically labels anatomy’ and the warm, rhetorical style which he labels ‘painting’. L’objection la plus ancienne et la plus redoutable à la démocratie fait valoir que le gouvernement par le peuple dessert le gouvernement pour le peuple. Les citoyens manquant pour la plupart de sagesse ou de compétence, le bien commun serait mieux assuré en confiant le pouvoir à un individu éclairé ou à une élite experte. Une réponse commune à cette objection concède la prémisse mais affirme la priorité au gouvernement par le peuple sur le gouvernement pour le peuple : le (...) droit égal à la participation devrait l’emporter sur la promotion de la compétence, même si celle-ci est requise par le bon gouvernement. La démocratie se trouve alors réduite à un ensemble de procédures équitables, traitant les citoyens en égaux ; elle ne se définit plus par la poursuite du bien commun. Il est toutefois une autre réponse à l’objection, qui évite cette dérive vers un procéduralisme étroit. Elle consiste à nier la prémisse et à affirmer la sagesse politique du peuple. Il n’est pas vrai que le gouvernement pour le peuple serait mieux assuré en confiant le pouvoir à un petit nombre de sages ou d’experts, fussent-ils les meilleurs parmi les citoyens. Cette thèse remarquable peut paraître improbable. Sa défense peut pourtant s’appuyer sur l’un des arguments les plus intrigants élaborés par la philosophie politique aristotélicienne, qui inspire et éclaire les controverses philosophiques contemporaines sur la valeur du régime démocratique : l’argument de la sagesse de la multitude. À partir d’une analyse du rôle politique de la presse, qui contribue au droit de chacun à gouverner, Charles Girard s’interroge sur le renouvellement du métier de journaliste et sur les modes de délibération démocratique.

Past research on folk aesthetics has suggested that most people are subjectivists when it comes to aesthetic judgment. However, most people also make a distinction between good and bad aesthetic taste. To understand the extent to which these two observations conflict with one another, we need a better understanding of people's everyday concept of aesthetic taste. In this paper, we present the results of a study in which participants drawn from a representative sample of the US population were asked whether (...) they usually distinguish between good and bad taste, how they define them, and whether aesthetic taste can be improved. Those who answered positively to the first question were asked to provide their definition of good and bad taste, while those who answered positively to the third question were asked to detail by what means taste can be improved. Our results suggest that most people distinguish between good and bad taste, and think taste can be improved. People's definitions of good and bad taste were varied, and were torn between very subjectivist conceptions of taste and others that lent themselves to a more objectivist interpretation. Overall, our results suggest that the tension Hume observed in conceptions of aesthetic taste is still present today. (shrink)

Ce travail examine les revendications contemporaines de droits pour les robots. Il présente les principales formes argumentatives qui ont été développées en faveur d’une considération éthique ou de droits positifs pour ces machines. Il met en relation ces argumentations avec un travail de recherche-action afin de produire un retour critique sur l’idée de droit des robots. Il montre enfin le rapport complexe entre les récits de la modernité et la revendication de droits pour les robots. This article presents contemporary vindications (...) of robot rights. The first part exposes main argumentations in favor of moral consideration or legal personhood for robots. The second part builds on cooperative action research with several French roboticists and experts in order to evaluate these arguments. These dialogues eventually show the complex relationships between the narratives of modernity and the vindication of robot rights. (shrink)

Abstact : This article provides a critical examination of David Estlund’s epistemic proceduralism. Epistemic proceduralism suggests a promising way to justify democracy without renouncing the pursuit of truth. By making the legitimacy and authority of democratic institutions dependent on their general tendency to produce good decisions, rather than on the correctness of their results or on their mere procedural fairness, it shows that they can to be connected to substantial standards, such as justice, without ignoring the persistence of moral disagreements. (...) By subjecting political procedures to a dual requirement, both epistemic and egalitarian, it suggests that a mixed conception of the value of democracy can be articulated. But by refusing to take sides on the nature of truth, on the choice of the relevant substantial standard, or on the moral theory defining the constraints that equal respect imposes on the choice of political procedures, epistemic proceduralism fails in my view to offer a convincing defence of democracy. In order to explain what makes democracy valuable, a philosophical conception must take a position on the nature of truth, justice and equality. -/- Résumé : Cet article propose une relecture critique du procéduralisme épistémique élaboré par David Estlund. Cette théorie suggère une voie prometteuse pour justifier démocratie sans renoncer à la poursuite de de la vérité. En proposant de faire dépendre la légitimité et l’autorité des procédures démocratiques de leur tendance générale à produire de bonnes décisions, plutôt que de la justesse constante de leurs résultats ou à l’inverse de leur seule équité procédurale, il montre qu’elles peuvent être reliées à une visée substantielle, telle la justice, sans ignorer pour autant la persistance des désaccords à son endroit. En soumettant ces procédures à une double exigence, à la fois épistémique et égalitaire, il montre qu’une conception mixte de la valeur de la démocratie est concevable. Mais en refusant de prendre parti sur la nature de la vérité, sur le choix du critère objectif devant guider l’évaluation des décisions politiques ou sur la théorie morale permettant d’expliciter les contraintes que l’égal égard dû aux personnes impose au choix des procédures, le procéduralisme épistémique s’interdit de construire une justification convaincante de la démocratie. Une justification philosophique de la démocratie doit, pour rendre compte de ce qui fait sa valeur, prendre position sur la nature de la vérité, de la justice et de l’égalité. (shrink)

ABSTRACT: GEORGES CANGUILHEM’S BIOPHILOSOPHY The eminent French biologist and historian of biology, François Jacob, once notoriously declared «On n’interroge plus la vie dans les laboratoires»: laboratory research no longer inquires into the notion of “Life”. Certain influential French philosophers of science of the mid‐century such as Georges Canguilhem would disagree, or at least seek to resist some of Jacob’s diagnosis. Not by imposing a different kind of research program in laboratories, but by an unusual combination of historical and philosophical inquiry (...) into the foundations of the life sciences. Canguilhem speaks of «defending vitalist biology» and declares that Life cannot be grasped by logic. Is this history and philosophy of biology? Is it vitalism? It definitely is a different project from current philosophy of biology. One short‐lived term for it was “biophilosophy”. In this paper I explore the content of this term as it relates to the above questions. (shrink)

Cet article se propose de tracer les liens théoriques qu’entretiennent l’intelligence artificielle et certaines traditions philosophiques à propos de l’ontologie, du langage, et de l’esprit. On tâchera de mettre en perspective ce en quoi l’intelligence artificielle contemporaine hérite, poursuit, et renouvelle de façon pratique des problématiques anciennes concernant les caractéristiques de l’intelligence humaine et la représentation des connaissances. En introduisant les ontologies informatiques, on cherchera à présenter l’importance des sciences humaines aujourd’hui pour la recherche en intelligence artificielle, tout en soulignant (...) le dialogue permanent que celle-ci a pu entretenir avec la philosophie à travers l’histoire. Nous proposons une étude de la constitution du sens dans l'interaction humain-machine à partir des définitions que donnent Turing et Wittgenstein à propos de la pensée, la compréhension, et de la décision. Nous voulons montrer par l'analyse comparative des proximités et différences conceptuelles entre les deux auteurs que le sens commun entre humains et machines se co-constitue dans et à partir de l'action, et que c'est précisément dans cette co-constitution que réside la valeur sociale de leur interaction. Il s'agira pour (...) cela de problématiser l'interaction humain-machine autour de la question de ce que signifie « suivre une règle » pour définir et distinguer les modes interprétatifs et les comportements décisionnels de chacun. Nous en viendrons alors au constat que la mutualisation des signes qui s'opère à travers le dialogue humain-machine est au fondement de la constitution d'une société informatisée. (shrink)

L’idéal démocratique est accusé d’être irréaliste. Le gouvernement du peuple par le peuple et pour le peuple serait une chimère dans les sociétés contemporaines. Il faudrait lui préférer les visées plus modestes associées à l’élection : un droit de vote égal et la satisfaction du plus grand nombre. La démocratie ne se laisse pourtant pas réduire à la compétition électorale. Les acteurs et les institutions politiques qui s’en réclament invoquent non seulement un marché, où rivalisent des intérêts privés, mais un (...) forum, où s’affrontent des visions adverses de la justice. Ils attendent de la délibération collective qu’elle serve l’autonomie politique et le bien commun, mais savent aussi qu’elle peut les menacer, lorsque la liberté, l’égalité ou la publicité lui font défaut. Cette enquête philosophique interroge la pertinence de l’idéal démocratique pour des sociétés complexes, dotées d’institutions représentatives et soumises à la communication de masse. Elle montre à quelles conditions cet idéal peut aujourd’hui orienter la critique et l’action. Les citoyens peuvent encore aspirer à se gouverner eux-mêmes, donc à délibérer en égaux. -/- The democratic ideal is accused of being unrealistic. Government of the people by the people and for the people would be a chimera in contemporary societies. The more modest aims associated with election should be preferred: equal suffrage and the satisfaction of the greatest number. But democracy cannot be reduced to electoral competition. The political actors and institutions that claim it invoke not only a market, where private interests compete, but also a forum, where opposing visions of justice confront each other. They expect collective deliberation to serve political autonomy and the common good, but they also know that it can threaten them when it lacks freedom, equality or publicity. This philosophical inquiry questions the relevance of the democratic ideal for complex societies with representative institutions and subject to mass communication. It shows under what conditions a deliberative understanding of this ideal can today orient criticism and action. Citizens can still aspire to govern themselves, hence to deliberate as equals. La communication interdisciplinaire rencontre divers problématiques : l’hétérogénéités des informations (sémantique, standardisation des formats), les confusions linguistiques (intentions dans les énoncés, polysémie des mots) ou encore épistémologiques (expertises divergentes, terminologies inadéquates). Nous proposons pour favoriser l’intercommunication entre différents domaines de spécialité, l’emploi des ontologies informatiques : des artefacts informatiques permettant une représentation des concepts au sein d’un domaine de spécialité. Autour de la notion « d’interopérabilité sémantique », la capacité pour une machine et des acteurs de communiquer ensemble, nous viserons (...) à montrer en quoi les ontologies peuvent permettre à des acteurs de différentes disciplines de clarifier les notions propres à leurs domaines en fonction d’une analyse de leurs usages des mots. Nous tâchons ici de mettre en avant la capacité des ontologies de traiter le langage selon différents niveaux du sens d’un mot (du plus concret et appliqué, au plus abstrait et conceptuel), afin de mettre en perspective ce en quoi cette analyse basée sur les textes d’un corpus, permet de rendre compte de, si ce n’est un état du réalisme d’une discipline, du moins, servir d’outils pour aider les acteurs à normaliser leurs pratiques. En ce sens, les ontologies informatiques peuvent être considérées et utilisées comme autant de bases terminologiques servant comme outils de références pour faciliter la communication interdisciplinaire. The Racial Contract pone la teoría clásica del contrato social occidental, sin ambages, al servicio de un uso radical extraordinario. Con una mirada arrolladora sobre el expansionismo y el racismo europeos de los últimos quinientos años, Charles W. Mills demuestra cómo este peculiar y no reconocido "contrato" ha dado forma a un sistema de dominación europea global: cómo da lugar a la existencia de "blancos" y "no blancos", personas de pleno derecho y subpersonas, cómo influye en la teoría moral (...) y la psicología moral de los blancos; y cómo este sistema se impone a los no blancos mediante el condicionamiento ideológico y la violencia. The Racial Contract sostiene que la sociedad en la que vivimos es un estado continuado de supremacía blanca. Levantando un espejo ante la filosofía dominante, este provocativo libro explica el esquema evolutivo del contrato racial desde la época de la conquista del Nuevo Mundo y el posterior colonialismo, pasando por el contrato escrito de la esclavitud, hasta el sistema de segregación "separados pero iguales" en los Estados Unidos del siglo XX. Según Mills, el contrato ha proporcionado la arquitectura teórica que justifica toda una historia de atrocidades europeas contra los no blancos, desde las afirmaciones de David Hume e Immanuel Kant de que los negros tenían un poder cognitivo inferior, pasando por el Holocausto, hasta el tipo de imperialismo en Asia que se demostró con la guerra de Vietnam. Mills sugiere que la guetización del trabajo filosófico sobre la raza no es accidental. Este trabajo desafía la suposición de que la teoría dominante carece en sí misma de raza. Al igual que la teoría feminista ha revelado el sesgo invisible de la filosofía política hacia los hombres blancos, la explicación de Mills del contrato racial expone sus fundamentos raciales. In this essay, we tackle the misconception that panic is simply a state of being « overwhelmed by your fear. » Panic, in our view, is not an extreme fear that necessarily pushes the person into dysfunctional, counterproductive and irrational behaviors. On the contrary, as we will try to show here, it is an emotion in its own right that has its own cognitive and motivational functions. We will analyze panic here as a reaction to a danger perceived as major, (...) imminent and without clear solution, in the sense that the subject does not have a determined action plan to react to the danger. Panic thus implies special access to certain information or certain facts – a perception or apprehension of danger and its precise properties – and it is in this that it has a cognitive function. On the motivational level, we will defend the idea that panic involves tendencies to action appropriate to the situation as it is perceived. Contrary to popular opinion and that of philosophers,we will therefore propose away of conceiving panic as being able to be functional and thus, rational, insofar as this emotion helps us to reach our goals given the means of which we dispose. Contrary to what we might think, in some situations it is worth panicking. (shrink)

While mainstream religions’ followers could at least remain optimistic about the afterlife possibilities for the atheists, death would always represent a total disappearance from the face of the universe beyond the point of no return. However, recent scientific advancements cloning and sell replacement have led many to believe that biological immortality is a reality rather than a dream. According to some of the leading futurists (e.g. (...) De Grey) turning back the human clock and achieving an indefinite lifespan is just a matter of time, so those of us who are going to last long enough to witness these amazing scientific breakthroughs may be rewarded with another 1000 years or so to enjoy. The inclusion of De astrologia in the Lucianic corpus has been disputed for centuries since it appears to defend astrological practices that Lucian elsewhere undercuts. This paper argues for Lucian’s authorship by illustrating its masterful subversion of a captatio benevolentiae and subtle rejection of Stoic astrological practices. The narrator begins the text by blaming phony astrologers and their erroneous predictions for inciting others to “denounce the stars and hate astrology” (ἄστρων τε κατηγοροῦσιν καὶ αὐτὴν ἀστρολογίην μισέουσιν, 2). The narrator assures (...) readers that he, the knowledgeable astrologer, will correct for the “stupidity and laziness” (ἀμαθίῃ καὶ ῥαθυμίῃ, ibid.) that bring about false predictions. The narrator’s credibility quickly decays when he attempts to recast Orpheus, Bellerophon, Icarus, Daedalus, and a host of other mythological figures as Greek astrologers. Lucian’s audience would expect such far-fetched interpretations of myth from the stereotypical Stoic philosopher, a character lampooned elsewhere in the Lucianic corpus. (shrink)

Sensibility, in any of its myriad realms – moral, physical, aesthetic, medical and so on – seems to be a paramount case of a higher-level, intentional property, not a basic property. Diderot famously made the bold and attributive move of postulating that matter itself senses, or that sensibility (perhaps better translated ‘sensitivity’ here) is a general or universal property of matter, even if he at times took a step back from this claim and called it a “supposition.” Crucially, sensibility is (...) here playing the role of a ‘booster’: it enables materialism to provide a full and rich account of the phenomena of conscious, sentient life, contrary to what its opponents hold: for if matter can sense, and sensibility is not a merely mechanical process, then the loftiest cognitive plateaus are accessible to materialist analysis, or at least belong to one and the same world as the rest of matter. This was noted by the astute anti-materialist critic, the Abbé Lelarge de Lignac, who, in his 1751 Lettres à un Amériquain, criticized Buffon for “granting to the body [la machine, a common term for the body at the time] a quality which is essential to minds, namely sensibility.” This view, here attributed to Buffon and definitely held by Diderot, was comparatively rare. If we look for the sources of this concept, the most notable ones are physiological and medical treatises by prominent figures such as Robert Whytt, Albrecht von Haller and the Montpellier vitalist Théophile de Bordeu. We then have, or so I shall try to sketch out, an intellectual landscape in which new – or newly articulated – properties such as irritability and sensibility are presented either as an experimental property of muscle fibers, that can be understood mechanistically (Hallerian irritability, as studied recently by Hubert Steinke and Dominique Boury) or a property of matter itself (whether specifically living matter as in Bordeu and his fellow montpelliérains Ménuret and Fouquet, or matter in general, as in Diderot). I am by no means convinced that it is one and the same ‘sensibility’ that is at issue in debates between these figures (as when Bordeu attacks Haller’s distinction between irritability and sensibility and claims that ‘his own’ property of sensibility is both more correct and more fundamental in organic beings), but I am interested in mapping out a topography of the problem of sensibility as property of matter or as vital force in mid-eighteenth-century debates – not an exhaustive cartography of all possible positions or theories, but an attempt to understand the ‘triangulation’ of three views: a vitalist view in which sensibility is fundamental, matching up with a conception of the organism as the sum of parts conceived as little lives (Bordeu et al.); a mechanist, or ‘enhanced mechanist’ view in which one can work upwards, step by step from the basic property of irritability to the higher-level property of sensibility (Haller); and, more eclectic, a materialist view which seeks to combine the mechanistic, componential rigour and explanatory power of the Hallerian approach, with the monistic and metaphysically explosive potential of the vitalist approach (Diderot). It is my hope that examining Diderot in the context of this triangulated topography of sensibility as property sheds light on his famous proclamation regarding sensibility as a universal property of matter. The materialist approach to the body is often, if not always understood in ‘mechanistic’ terms, as the view in which the properties unique to organic, living embodied agents are reduced to or described in terms of properties that characterize matter as a whole, which allow of mechanistic explanation. Indeed, from Hobbes and Descartes in the 17th century to the popularity of automata such as Vaucanson’s in the 18th century, this vision of things would seem to be correct. In this paper (...) I aim to correct this inaccurate vision of materialism. On the contrary, the materialist project on closer consideration reveals itself to be, significantly if not exclusively, (a) a body of theories specifically focused on the contribution that ‘biology’ or rather ‘natural history’ and physiology make to metaphysical debates, (b) much more intimately connected to what we now call ‘vitalism’ (a case in point is the presence of Théophile de Bordeu, a prominent Montpellier physician and theorist of vitalism, as a fictional character and spokesman of materialism, in Diderot’s novel D’Alembert’s Dream), and ultimately (c) an anti-mechanistic doctrine which focuses on the unique properties of organic beings. To establish this revised vision of materialism I examine philosophical texts such as La Mettrie’s Man a Machine and Diderot’s D’Alembert’s Dream; medical entries in the Encyclopédie by physicians such as Ménuret and Fouquet; and clandestine combinations of all such sources (Fontenelle, Gaultier and others). Locke and Leibniz deny that there are any such beings as ‘monsters’ (anomalies, natural curiosities, wonders, and marvels), for two very different reasons. For Locke, monsters are not ‘natural kinds’: the word ‘monster’ does not individuate any specific class of beings ‘out there’ in the natural world. Monsters depend on our subjective viewpoint. For Leibniz, there are no monsters because we are all parts of the Great Chain of Being. Everything that happens, happens for a reason, including a monstrous birth. (...) But what about materialism? Well, beginning with the anatomical interest into ‘monstrous births’ in the French Académie des Sciences in the first three decades of the eighteenth century, there is a shift away from ‘imaginationist’ claims such as those of Malebranche, that if a woman gives birth to a monstrous child it is a consequence of something she imagined. Anatomists such as Lemery and Winslow try to formulate a strictly mechanical explanation for such events, rejecting moral and metaphysical explanations. Picking up on this work, materialist thinkers like Diderot are compelled to reject the very idea of monsters. We are all material beings produced according to the same mechanisms or laws, some of us are more ‘successful’ products than others, i.e. some live longer than others. In his late Eléments de physiologie he says “L’homme est un effet commun, le monstre un effet rare.” Ultimately he arrives at a materialist version of Leibniz’s position: there are no monsters, we are all monsters in each other’s eyes, at one time or another. This conclusion is a pregnant one in light of twentieth century interest in the problem of ‘the normal and the pathological’ (Canguilhem), and the broader question of how materialism relates to the biological world. Readers of the recent Monist publication, The Relevance of Charles Peirce (La Salle, Illinois, 1983) may seek to locate Peirce's « relevance » in the number of contemporary philosophers influenced by any aspect of his work.I argue, instead, that Peirce is relevant because his central work, pragmatism, relates deeply to matters immediately at hand. Since he is trained in Cartesian-Kantian tradition of epistemology, Peirce's work interests disciples of that tradition. In the end, however, his pragmatism discloses the errent tendency of that tradition : to offer its disciples over-generalized epistemological uncertainty and, therefore, the compensatory need to engage in egocentric foundationalisms. The eminent French biologist and historian of biology, François Jacob, once notoriously declared “On n’interroge plus la vie dans les laboratoires”: laboratory research no longer inquires into the notion of ‘Life’. Nowadays, as David Hull puts it, “both scientists and philosophers take ontological reduction for granted… Organisms are ‘nothing but’ atoms, and that is that.” In the mid-twentieth century, from the immediate post-war period to the late 1960s, French philosophers of science such as Georges Canguilhem, Raymond Ruyer and Gilbert Simondon (...) returned to Jacob’s statement with an odd kind of pathos: they were determined to reverse course. Not by imposing a different kind of research program in laboratories, but by an unusual combination of historical and philosophical inquiry into the foundations of the life sciences (particularly medicine, physiology and the cluster of activities that were termed ‘biology’ in the early 1800s). Even in as straightforwardly scholarly a work as La formation du concept de réflexe aux XVIIe et XVIIIe siècles (1955), Canguilhem speaks oddly of “defending vitalist biology,” and declares that Life cannot be grasped by logic (or at least, “la vie déconcerte la logique”). Was all this historical and philosophical work merely a reassertion of ‘mysterian’, magical vitalism? In order to answer this question we need to achieve some perspective on Canguilhem’s ‘vitalism’, notably with respect to its philosophical influences such as Kurt Goldstein. (shrink)

In this essay I explore the potential contribution of Peirce's theory of scientific inquiry to moral philosophy. After a brief introduction, I outline Peirce's theory of inquiry. Next, I address why Peirce believed that this theory of inquiry is inapplicable to what he called "matters of vital importance," the latter including genuine moral problems. This leaves us in the end with two options: We can try to develop an alternative way of addressing moral problems or we can seek to reconcile (...) moral problems with scientific inquiry as described by Peirce. Though Peirce seems to argue for the former, I argue for the latter. (shrink)

The concept of self has preeminently been asserted (in its many versions) as a core component of anti-reductionist, antinaturalistic philosophical positions, from Descartes to Husserl and beyond, with the exception of some hybrid or intermediate positions which declare rather glibly that, since we are biological entities which fully belong to the natural world, and we are conscious of ourselves as 'selves', therefore the self belongs to the natural world (this is characteristic e.g. of embodied phenomenology and enactivism). Nevertheless, from Cudworth (...) and More’s attacks on materialism all the way through twentieth-century argument against naturalism, the gulf between selfhood and the world of Nature appears unbridgeable. In contrast, my goal in this paper is to show that early modern materialism could yield a theory of the self according to which (1) the self belongs to the world of external relations (Spinoza), such that no one fact, including supposedly private facts, is only accessible to a single person; (2) the self can be reconstructed as a sense of “organic unity” which could be a condition for biological individuality (a central text here is Diderot’s 1769 Rêve de D’Alembert); yet this should not lead us to espouse a Romantic concept of organism as foundational or even ineffable subjectivity (a dimension present in Leibniz and made explicit in German idealism); (3) what we call 'self' might simply be a dynamic process of interpretive activity undertaken by the brain. This materialist theory of the self should not neglect the nature of experience, but it should also not have to take at face value the recurring invocations of a better, deeper “first-person perspective” or “first-person science.”. In der Dialektik der Kritk der reinen Vernunft entwickelt Kant eine Position, welche auf verschiedene Probleme anwendbar ist, bei denen die Vollständigkeit zu erfüllender Bedingungen wesentlicher Aspekt des Problems ist. Diese Position soll durch die hier angestellte Übertragung auf das systematische Problem der inferentiellen Rechtfertigung so klar wie möglich herausgearbeitet werden. Durch die Übertragung wird das Regressproblem und damit auch das Problem der Rechtfertigung in seiner gegenwärtigen Form aufgelöst.

This article is divided into three substantive sections. Section I delineates Aristotle’s theory of the soul as laid out in De Anima. Section II defines habeas corpus as a legal concept and demonstrates under what circumstances it should be granted. Section III applies Aristotle’s theory of the soul as a structure whereby animals could be granted habeas corpus rights.

In dem vorliegenden Aufsatz wird eine Herausforderung an die Philosophie diskutiert, die von verschiedenen Positionen, u. a. vom methodologischen Naturalismus, vorgetragen wird. Sie zielen allesamt darauf ab, das Ende des (herkömmlichen) Philosophierens, gleich welcher Richtung oder Schule, einzuläuten. Es wird versucht, diese Herausforderung zunächst begrifflich zu präzisieren, um ihr sodann auf diese Weise zu begegnen zu können. Wie sich zeigt, lassen sich die angestellten Überlegungen in Kants Überlegungen zum Begriff von Philosophie wiederfinden.

From Hegel to Engels, Sartre and Ruyer (Ruyer, 1933), to name only a few, materialism is viewed as a necropolis, or the metaphysics befitting such an abode; many speak of matter’s crudeness, bruteness, coldness or stupidity. Science or scientism, on this view, reduces the living world to ‘dead matter’, ‘brutish’, ‘mechanical, lifeless matter’, thereby also stripping it of its freedom (Crocker, 1959). Materialism is often wrongly presented as ‘mechanistic materialism’ – with ‘Death of Nature’ echoes of de-humanization and hostility to (...) the Scientific Revolution (which knew nothing of materialism!), also a powerful Christian theme in Cudworth, Clarke and beyond (Overhoff, 2000). Here I challenge this view, building on some aspects of Israel’s Radical Enlightenment concept (Israel, 2001), which has been controversial but for my purposes is a useful claim about the dissemination of a home-grown Spinozism, sometimes reformulated as an ontology of the life sciences, an aspect Israel does not address (compare Secrétan et al., eds., 2007; Citton, 2006). First, I examine some ‘moments’ of radical Enlightenment materialism such as La Mettrie and Diderot (including his Encyclopédie entry “Spinosiste”), but also anonymous, clandestine texts such as L’Âme Matérielle, to emphasize their distinctive focus on the specific existence of organic beings. Second, I show how this ‘embodied’, non-mechanistic character of Enlightenment ‘vital materialism’ makes it different from other episodes, and perhaps more of an ethics than is usually thought (also via the figure of the materialist as ‘laughing philosopher’). Third, I reflect on what this implies for our image of the Enlightenment – no longer a Frankfurt School and/or Foucaldian vision of ‘discipline’, regimentation and order (as in Mayr, 1986) – but ‘vital’, without, conversely, being a kind of holist vitalism “at odds with the universalizing discourse of Encyclopedist materialism, with its insistence on the uniformity of nature and the universality of physical laws” (Williams, 2003): vital materialism is still materialism. Its ethics tends towards hedonism, but its most radical proponents (Diderot, La Mettrie and later Sade) disagree as to what this means. (shrink)

The situated potentials for action between material things in the world and the interactional processes thereby afforded need to be seen as not only constituting the possibility of agency, but thereby also comprising it. Eo ipso, agency must be de-fused from any local, "contained" subject and be understood as a situational property in which subjects and objects can both participate. Any technological artifact should thus be understood as a complex of agential capacities that function relative to any number of social (...) and material factors. Keeping in mind that we are co-constituted by webs of relations involving increasingly complex collections of artefacts, networks, niches, and communities of practice, our investigation will be guided by interrogating the functional potential of a thing that in the last fifteen years has seamlessly worked its way into the everyday life of millions of human agents. This "thing," the smartphone, is merely a nodal point in a highly complex network. Recognizing this massive "collective," we nevertheless want to show some of the ways in which something as seemingly mundane as a smartphone can reflexively alter the range of actions available to a cognitive agent (Latour 1994). Specifically, we hope to shed light on some of the social-cognitive consequences of technological mediation by looking at the complementary, if not mutually implied, domains of memory and knowledge. In this paper we suggest a revisionist perspective on two significant figures in early modern life science and philosophy: William Harvey and John Locke. Harvey, the discoverer of the circulation of the blood, is often named as one of the rare representatives of the ‘life sciences’ who was a major figure in the Scientific Revolution. While this status itself is problematic, we would like to call attention to a different kind of problem: Harvey dislikes abstraction and controlled experiments (aside from (...) the ligature experiment in De Motu Cordis), tends to dismiss the value of instruments such as the microscope, and emphasizes instead the privileged status of ‘observed experience’. To use a contemporary term, Harvey appears to rely on, and chiefly value, ‘tacit knowledge’. Secondly, Locke’s project is often explained with reference to the image he uses in the Epistle to the Reader of his Essay, that he was an “underlabourer” of the sciences. In fact, despite the significant medical phase of his career, Locke’s ‘empiricism’ turns out to be above all a practical (i.e. ‘moral’) project, which focuses on the delimitation of our powers in order to achieve happiness, and rejects the possibility of naturalizing knowledge. When combined, these two cases suggest a different view of some canonical moments in early modern natural philosophy. (shrink)

Taking an 1893 exchange between Charles S. Peirce and Open Court editor Paul Carus as its point of departure, the paper explores the relation between religion and science while making the case that the attitude that scientists have to their subject is akin to a religious devotion. In this way it is argued that a reconciliation between science and religion cannot be confined to religion blindly accepting the results from science, but that such a reconciliation is possible only when (...) both (re)connect with what truly inspires them, the experience of reverent wonder about the world within which they find themselves. in this article, we experience the exercise of a screen ethnocartography in agency with the film Beasts of the southern wild by the director Benh Zeitlin. We tested a film experimentation that led to a renewed writing ways of life. We bet on cinema and childhood as possibilities for creating cracks and a stutter of language for the creation of new worlds and ways of living. In cinema images less as a representation, and more as art that proposes incompleteness, fissure, (...) a hole in appearances. In childhood as an exercise of differentiation and resistance to dominant narratives in a given context. In childhood as a limiting experience of/in language, tirelessly exposing the human condition in front of the world. Thus, accompanying the main character of the plot, little Hushpuppy — a six-year-old resident of the “Charles Doucet Island”, experienced as “the Bathtub” —, we are shaken by the forms of life there, considered bestial and not recognized by city humans. Hushpuppy, his father and friends resist attempts to destroy their existence by the forms of the state that try to domesticate them, imbued with the logic that primitives must come to civilization, just as children must become adults. This paper explores Berkeley's denial of matter in the light of criticisms voiced by Charles S. Peirce, who wrote two extensive review essays, one in 1871 and one in 1901, on the Fraser editions of Berkeley's Works. Elaborating upon Peirce's criticisms and utilizing Peirce's semiotics and pragmatism (two doctrines for which Peirce gives partial credit to Berkeley), it is shown that Berkeley's argument against matter is inconclusive, that the hypothesis of matter can be made to fit within Berkeley's thought, (...) and that doing so need not undermine the latter's esse is percipi doctrine. Trata-se de uma proposta de investigação das ideias cosmológicas de Charles S. Peirce, particularmente das que dizem respeito à pertinência da inclusão de esquemas de explicação que façam uso da causalidade final como instância determinante do desenvolvimento dos fenômenos naturais. Anterior à avaliação desse tipo de explicação cabe uma investigação sobre as características mais relevantes de seu pensamento, que o próprio autor julgava construído arquitetonicamente. Com esse objetivo, centramos a análise no conceito de continuum, que pode ser visto como (...) fundamental para o desenvolvimento da obra de Peirce. É o estudo do continuum que permitirá e conduzirá a investigação das categorias ontológicas peirceanas: acaso, existente e lei. A passagem do acaso à lei, isto é, a própria origem do cosmos, se dá por um processo evolutivo que tem na lei da mente seu principal motor. A lei da mente, por sua vez, atua de modo finalístico, tornando mais provável o desenvolvimento dos fenômenos em certas direções, restringindo, assim, o horizonte das possibilidades, sem, contudo, esgotá-lo. Este artigo tem por objetivo descrever e comparar as propostas da política de reconhecimento desenvolvidas por Axel Honneth, na obra Luta por reconhecimento, e por Charles Taylor, na obra Argumentos filosóficos. Ambos os pensadores buscam em Hegel uma referência teórica para renovar suas teorias. Em Honneth, a noção de reconhecimento está fortemente ancorada na intersubjetividade dos indivíduos, decorrente de uma luta por reconhecimento: o desrespeito a qualquer uma das formas de reconhecimento pleno – o amor, o direito e a (...) solidariedade – gera demandas sociais de reconhecimento e, consequentemente, a luta pelo mesmo. Em Taylor, o reconhecimento pressupõe uma noção ontológica de bem, prefigurado na linguagem, tradição, valores e costumes. Ambos os autores mantêm um vínculo forte com a ideia hegeliana da intersubjetividade como instância fundamental na formação das identidades, enquanto base coletiva dos movimentos sociais. (shrink)
