The popularisation of drawing up codes that are addressed to various social groups is one of the features of the modern world. However, researchers of the phenomenon have not yet reached a consensus about the moral validity and utility of this activity. The article thoroughly reviews the Polish literature on the subject with regard to the reasons for taking a moderate stance on the codification of ethical standards. The essay describes the main concepts of ethical codes as well as (...) arguments for their approval and rejection. Attention is drawn to the ways of improving the effectiveness of codes and to the ethical decision-making procedure that reconciles the positions of the supporters and opponents of codification. This paper aims to provide a mathematically tractable background against which to model both modal cognitivism and modal expressivism. I argue that epistemic modal algebras, endowed with a hyperintensional, topic-sensitive epistemic two-dimensional truthmaker semantics, comprise a materially adequate fragment of the language of thought. I demonstrate, then, how modal expressivism can be regimented by modal coalgebraic automata, to which the above epistemic modal algebras are categorically dual. I examine five methods for modeling the dynamics of conceptual engineering for intensions and (...) hyperintensions. I develop a novel topic-sensitive truthmaker semantics for dynamic epistemic logic, and develop a novel dynamic epistemic two-dimensional hyperintensional semantics. I examine then the virtues unique to the modal expressivist approach here proffered in the setting of the foundations of mathematics, by contrast to competing approaches based upon both the inferentialist approach to concept-individuation and the codification of speech acts via intensional semantics. Following the theater of war between the US-led NATO—Ukraine alliance and the Russian Federation, the 3rd World War situations intended to expand between Bangladesh and Myanmar. This doctrinal paper has been presented through codification of situations of the post-seizure war-fighting battles surviving cold and silent conflicts in Parbatya, Chittagong Hill Tracts, in order to deliver the seized nation onto a free pathway. The notion of relevance plays a role in many accounts of knowledge and knowledge ascription. Although use of the notion is well-motivated, theorists struggle to codify relevance. A reasonable person standard of relevance addresses this codification problem, and provides an objective and flexible standard of relevance; however, treating relevance as reasonableness seems to allow practical factors to determine whether one has knowledge or not—so-called “pragmatic encroachment.” I argue that a fuller understanding of reasonableness and of the role of practical (...) factors in the acquisition of knowledge lets us avoid pragmatic encroachment. Wiggins’ (2012) argument against propositional accounts of knowing how is based on a development of some considerations taken from Aristotle’s Nicomachean Ethics. Aristotle argued that the knowledge needed for participation in an ethos cannot be codified in propositional form so as to let it be imparted to someone who did not already have it. This is because any putative codification would be incomplete, and require that knowledge in order to extend it to novel cases. On a reasonable interpretation of (...) his argument, Wiggins claims that the same goes for practical knowledge in general, and that this shows that a propositional view of knowing how is incorrect. Introduction: This article discusses the brain hierarchical organization/evolution as a consequence of the information-induced brain development, from the perspective of the Informational Model of Consciousness. Analysis: In the frame of the Informational Model of Consciousness, a detailed info-neural analysis ispresented, concerning the specific properties/functions of the informational system of the human body composed by the Center of Acquisition and Storing of Information, Center of Decision and Command, Info-Emotional Center, Maintenance Informational System, Genetic Transmission System, Info Genetic Generator and Info- Connection (...) center, in relation with the neuro-connected brain areas, with a special attention to the Info-Connection and its specific properties. Besides a meticulous analysis of the info-connections/neuro-functions of these centers, a special attention was paid to limbic/cingulate cortex activities. Defined as a trust/confidence center, additional features are highlighted in correlation with the activity of the anterior cingulate cortex, consisting in the intervention/moderation of amygdala emotional signals, conflicting opposite YES/NO data and error elimination in the favor of the organism adaptation/survival, the intervention in the certainty/uncertainty balance to select a suitable pro-life information (antientropic effect), in moderation of pain and in the stimulation of the empathic inter-human relations/communication. Representing the correspondence between the informational subsystems and the brain area map, itis shown that the up/down integration of information by epigenetic mechanisms and the down/ up evolution are correlated. Results: The analysis of the functions of the anterior cingulate opens new gates of investigations concerning the involved intimate mechanisms at the level of cell microstructure, specifically on the compatibility with quantum assisted processes admitted by the Informational Model of Consciousness and the quantum-based models The discussion on the information integration/codification by epigenetic mechanisms shows that this process starts from the superior levels of brain conscious info-processing areas and progressively advances to the automatic/autonomic inferior levels ofthe informational system, under insistent/repetitive cues/stress conditions, pointing out an hierarchical functional/anatomical structure of the brain organization. Additional arguments are discussed, indicating thatthe down/up progressive scale representation is a suggestive illustration of the brain evolution, induced/assisted/determined by information, accelerated at humans by the antientropic functions of the Info-Connection center. Conclusions: The hierarchical organization of the brain is a consequence of the integration process of information, defining its development accordingly to the adaptation requirements for survival during successive evolution stages of the organism, information playing a determinant/key role. Our aim is to argue for a deflationary interpretation of Aristotelian dialectic in the Topics, showing that dialectic is, for Aristotle, a specific sort of regulated debate, in contrast to a widely spread kind of interpretation which conceives dialectic as a method of philosophical investigation. Our claim is that an analysis carefully conducted of certain key texts does provide us with sufficient evidences for defending that the Topics is a handbook which codifies an existent art. This codification has a (...) descriptive character and reveals the rules of the debate, what is the specific kind of argument used in it, how premises are obtained and the predicative relation of the propositions used by the debaters. The mastery of the techniques required by the debate is not grounded in any sort of particular knowledge, rather in linguistic competence. It is by doing a technical usage of this competence that the Topics can be useful for philosophy. (shrink)

To date, both the United States federal government and twenty-one individual states have passed Religious Freedom Restoration Acts that aim to protect religious persons from having their sincere beliefs substantially burdened by governmental interests. RFRAs accomplish this by offering a three-pronged exemption test for religious objectors that is satisfied only when (1) an objector has a sincere belief that is being substantially burdened; (2) the government has a very good reason (e.g., health or safety) to interfere; and (3) there is (...) a reasonable alternative to serve the compelling interest. Legal balancing tests like those found in RFRA are content neutral insofar as they sideline the belief-content of conscientious objections as irrelevant when determining the permissibility of granting legal accommodations. However, some theorists worry that this legal picture may be backward: perhaps balancing tests should be content non-neutral given the usual features of conscientious objections. For example, Yossi Nehushtan contends that, contrary to their typical codification, religious conscience beliefs seem undeserving of special legal accommodations because they possess uniquely strong empirical and theoretical ties to intolerance. Thus, the illiberally intolerant content of these conscientious objections might actually give the state a reason to refuse to grant legal exemptions. In this paper, I offer a cursory defense of content neutrality with respect to balancing tests like those found in RFRA. To begin, I outline Nehushtan’s argument for content non-neutrality. The cornerstone of his argument is that illiberal intolerance is intolerable such that conscientious objections that are based upon illiberally intolerant values provide the state with strong, normally prevailing reason not to grant an exemption. I argue that, even when the illiberally intolerant content of one’s conscience constitutes a weighty and relevant factor in determining the permissibility of granting a legal exemption, there remain significant problems. It is difficult, for example, to determine which views are illiberally intolerant and difficult to say whether illiberally intolerant views can effectively serve as the principled demarcating line in balancing tests. To conclude, I offer several cursory arguments in favor of adopting content-neutral approaches without necessarily making a comprehensive case. By drawing on the work of Amy Sepinwall, Nadia Sawicki, and Nathan Chapman, I show that content-neutral approaches can help to safeguard robust protections for conscience by permitting atypical exercises of conscience, protect minority thoughts and practices from being coercively supplanted by majoritarian understandings of morality, appropriately maintain the skepticism and humility that we owe each other as compatriots in a pluralistic society, and allow the kind of justifiable civil disobedience that has an important place in political history among other things. In Mathematics is megethology. Philosophia Mathematica, 1, 3–23) David K. Lewis proposes a structuralist reconstruction of classical set theory based on mereology. In order to formulate suitable hypotheses about the size of the universe of individuals without the help of set-theoretical notions, he uses the device of Boolos’ plural quantification for treating second order logic without commitment to set-theoretical entities. In this paper we show how, assuming the existence of a pairing function on atoms, as the unique assumption non expressed (...) in a mereological language, a mereological foundation of set theory is achievable within first order logic. Furthermore, we show how a mereological codification of ordered pairs is achievable with a very restricted use of the notion of plurality without plural quantification. (shrink)

The discursive character of human rights prevents a precise summary of historical origin, rationale, or definition outside of the various codifications in religious texts, secular philosophies, founding national documents, and international treaties, charters, conventions, covenants, declarations, and protocols. Regarding the objects of human rights, we can speak of a “foundational five” 1) Personal security 2) Material subsistence 3) Elemental equality 4) Personal Freedom and 5) Recognition as a member of the human community. Despite, or perhaps because of its multivalence, the (...) concept of human rights has been criticized as “foundationalist,” “essentialist,” or “ethnocentric”—its universalism being used as a weapon against itself by critics of cultural imperialism. Even the tolerance discourses so popular in critical theory, however, gain their normative force from the same basic notion of individual or group rights. Notwithstanding these rhetorical abuses, the concept of human rights has proved robust as a doctrine of equality owing to its openness to a pluralism of justifications grounding the basic “goods” agreed as necessary for human development. Different societies came to consider certain behaviors as morally wrong, and, in time, due to a more or less general practice, those behaviors have also become legally prohibited. While, nowadays, the existence of legal responsibility of states and individuals for certain reprehensible acts committed during an armed conflict, international or non-international, is hard to be disputed, an inquiry into the manner in which the behavior of the belligerents has come to be considered reveals long discussions in the field of morals (...) and theory of morality, and, especially, regarding the different manner of establishing the elements to whom obedience is rather owed (the divinity, the sovereign, the law) and the relations between these. Hence, the present paper aims at analyzing the connections between moral responsibility and legal responsibility for wrongful behaviur during war in a diachronic approach, along with the major shifts in paradigm (codification and individual liability). Understanding morality as practice, convention, custom, we are arguing that the nowadays requirement of liability for war crimes appeared due to an assumed intention and practice of the decision-making entities (the sovereign, the state) and, ultimately, to a decision-making process of the most influential states. Social activity and public involvement in participatory practices, and the creation of civic spaces on the basis of the museum have become relevant for the formation of the concept of a modern museum. Such practices are especially important in times of crisis when history is being documented online and the Rapid Response Collecting (RRC) method is becoming widespread. Modern war discourse requires the newest forms of archiving and description because the recording of history is complicated by the volatility of the (...) military situation, the movement of large flows of displaced persons, and the departure of citizens abroad. The Ukrainian experience of documenting the war is examined in the article taking the example of the ATO Museum (an acronym for anti-terrorist operation) in Dnipro and the online Museum of Civilian Voices. It is important for us to pay attention to the national peculiarities of the codification of collective memory through individual experience and life stories during the full-scale military aggression against Ukraine, and to show the newest forms of presenting the evidence of war. Under the UDHR, all persons have the right to "seek and to enjoy . . . asylum from persecution." From this designation as fundamental followed codification of the right in the 1951 Convention relating to the Status of Refugees and the 1967 Protocol Relating (collectively 'the Convention'), the "centrepiece" of treaties and customary norms that make up international refugee law. It defines and regulates the status and rights of refugees; its purpose is to safeguard the basic rights of persons (...) "outside their country of origin," who have fled due to a legitimate fear of persecution. Fundamentally, it guarantees that asylees and refugees enjoy rights without discrimination; without penalization for illegal territorial entry; and, without expulsion or return to "territories where . . . life or freedom would be threatened on account of . . . race, religion, nationality, membership of a particular social group or political opinion," —or 'non-refoulement'. What follows is background on development of the principle of non-refoulement, evasive US Asylum Cooperative Agreements ('ACAs') and implementing legislation, and the resulting erosion to the right to asylum. This essay investigates the tensions between traditional music and its modern codification as intellectual property. It will begin by considering the myths concerning the divine source of music. In traditional music and in folk music, music is closely connected to religious ritual. In these rituals the source of the music is recognized and attributed to certain deities. For instance, in Thai traditional music, the Wai Khru ceremony venerates the Duriyathep or devatas drawn from Indian mythology: Phra Visawakarm, Phra Panjasinghkorn, (...) and Phra Parakhonthap (Narot). Much of modern and contemporary music has long been disengaged from ritual and its traditional forms of transmission. Especially since the nineteenth century with the growth of popularity of music printing, it has been subject to copyright law. With these restrictions in transmission, the more fluid routes of transmission have become broken and the ritualistic and religious identifications have been transferred to the cult of performers, to legal codification, to the control of corporations, and the construction of new mythologies through marketing. This essay will use Walter Benjamin’s reflections on the loss of “aura” in the reproduced work of art to try to understand the consequences of this transition in the function of music. And it will consider the situation in Thailand where traditional music and mythology stands side by side with marketed music, and traditional performance stands side by side with commercial performance. It will demonstrate that these conflicts cannot be resolved. But it is precisely in the appreciation and preservation of these conflicts, that traditional culture can itself be recognized and preserved. (shrink)

This paper aims to highlight the articulation of skin memory with trans-Caribbean aesthetics by exploring the diasporic works of female diasporic artists born in the West Indies who emigrated to the United States. We intend to show how these contemporary female artists rewrite the codification and reception of the skin-related memory by connecting their artwork to a genealogy of traumas and healing practices that call for the empowerment of the Caribbean skin ego.

Dans son article The Ground between the Gaps, Jonathan Shaffer développe une conception de l'explication métaphysique impliquant les notions de fondation et de loi métaphysique. Je soutiens ici qu'une telle conception se révèle inadéquate pour saisir les explications métaphysiques courantes des sciences empiriques. Ma démarche consiste à appliquer le cadre théorique de Schaffer à certains types d'explication de la chimie. Bien qu'il soit possible de dégager des lois métaphysiques en chimie, une codification de celles-ci se révèle toutefois impossible. Il (...) y a fort à parier que ce résultat est généralisable à l'ensemble des sciences empiriques. Au strict minimum, cela indique que la conception de l'explication métaphysique de Schaffer doit être révisée. (shrink)

This dissertation re-examines the principal philosophical thrusts of the German Enlightenment period, from the perspective of their totalizing-mythological function, and investigates how this function is criticized by the non-totalizing function of myth found within the primary mythical images in the work of Goethe, Nietzsche, Rilke, and Walter Benjamin. ;Utilizing the revolutionary book by Hans Blumenberg on the function of myth in German Idealism and Romanticism, I instigate a discourse between Blumenberg's totalizing work on myth and the negative-dialectical work on myth (...) as proposed by Theodor Adorno. I locate the German origins of this negative-dialectical myth-making in the work of Goethe, specifically his non-totalizing image, Wilhelm Meister. I locate the development of this use of myth in Nietzsche's Zarathustra, and, finally, trace a similar function at work in Rilke's Malte and Walter Benjamin's historical materialist. ;Contrary to Habermas, who argues that Nietzsche opened up two roads to postmodernity, one leading to the "ontologization of aesthetics" and the other to the "totalizing critique" of reason , I put forth the argument that the Nietzschean "two roads" metaphor is useful but needs to be re-shaped, configuring one road toward the mythological history and historical mythology of Rilke and Walter Benjamin, and another road the Theodor Adorno's "thorough critique" of reason. ;The need to revise Habermas's "two roads to post-modernity" theory mythographically, rests on the primary investigation of this dissertation: to trace by de-scription the practical incarnation of the word on German soil . I define this process of "practical incarnation" as that word which subversively desires to de-scribe and trans-figure the neurotic -psychotic structure that has defined the parameters of Western discourse, at least since neo-Platonic Christianity influenced cultural codifications of the West. Finally, I maintain that the primary image of criticism which emerges from the dialectical work of the writers herein, is the image of man-child, a classless, non-totalizing image implicit in Goethe's Wilhelm Meister, and developed in the Kind-Mensch constellation in the work of Nietzsche, Rilke, and Walter Benjamin. This paper investigates Robert Brandom’s programme of logical expressivism and in the process attempts to clarify his use of the term practice, by means of a detailed comparison with the works of sociologist and anthropologist Pierre Bourdieu. It turns out that the two scholars have a number of concerns in common, including the means by which core practices can be amalgamated into more sophisticated ones, and the possibility of explicating practices without distorting them or generating incoherent codifications. We find some (...) congruences between the two approaches but also a number of divergences. In particular, Bourdieu deprecates the well-known distinctions between langue and parole (Saussure), and competence and performance (Chomsky), while (we argue) Brandom ends up instituting his own “competence” model. We conclude by questioning how far this is compatible with his avowed aim of developing an “analytic pragmatism”. (shrink)
