The main aim of this article is to reflect on the impact of biases related to artificial intelligence (AI) systems developed to tackle issues arising from the COVID-19 pandemic, with special focus on those developed for triage and risk prediction. A secondary aim is to review assessment tools that have been developed to prevent biases in AI systems. In addition, we provide a conceptual clarification for some terms related to biases in this particular context. We focus mainly on nonracial biases (...) that may be less considered when addressing biases in AI systems in the existing literature. In the manuscript, we found that the existence of bias in AI systems used for COVID-19 can result in algorithmic justice and that the legal frameworks and strategies developed to prevent the apparition of bias have failed to adequately consider social determinants of health. Finally, we make some recommendations on how to include more diverse professional profiles in order to develop AI systems that increase the epistemic diversity needed to tackle AI biases during the COVID-19 pandemic and beyond. Two competing accounts of value incomparability have been put forward in the recent literature. According to the standard account, developed most famously by Joseph Raz, ‘incomparability’ means determinate failure of the three classic value relations ( better than , worse than , and equally good ): two value-bearers are incomparable with respect to a value V if and only if (i) it is false that x is better than y with respect to V , (ii) it is false that x (...) is worse than y with respect to V and (iii) it is false that x and y are equally good with respect to V . Most philosophers have followed Raz in adopting this account of incomparability. Recently, however, John Broome has advocated an alternative view, on which value incomparability is explained in terms of vagueness or indeterminacy . In this paper I aim to further Broome’s view in two ways. Firstly, I want to supply independent reasons for thinking that the phenomenon of value incomparability is indeed a matter of the indeterminacy inherent in our comparative predicates. Secondly, I attempt to defend Broome’s account by warding off several objections that worry him, due mainly to Erik Carlson and Ruth Chang. (shrink)

Cognitive penetration of perception, broadly understood, is the influence that the cognitive system has on a perceptual system. The paper shows a form of cognitive penetration in the visual system which I call ‘architectural’. Architectural cognitive penetration is the process whereby the behaviour or the structure of the perceptual system is influenced by the cognitive system, which consequently may have an impact on the content of the perceptual experience. I scrutinize a study in perceptual learning that provides empirical evidence that (...) cognitive influences in the visual system produce neural reorganization in the primary visual cortex. Generics are sentences such as Birds fly, which express generalizations. They are prevalent in speech, and as far as is known, no human language lacks generics. Yet, it is very far from clear what they mean. After all, not all birds fly—penguins don’t! -/- There are two general views about the meaning of generics in the literature, and each view encompasses many specific theories. According to the inductivist view, a generic states that a sufficient number of individuals satisfy a certain (...) property—in the example above, it says that sufficiently many birds fly. This view faces the complicated problem of spelling out exactly how many is “sufficiently many” in a way that correctly captures the intuitive truth conditions of generics. -/- An alternative, the rules and regulations view, despairs from this project and proposes instead that generics directly express rules in the world. Rules are taken to be abstract objects, which are not related to the properties of specific individuals. This view faces the difficult problem of explaining how people come to know of such rules when judging the truth of falsity of generics, and accounting for the strong intuition that a sentence such as Birds fly talks about birds, not abstract objects. -/- What seems to be beyond dispute is that generics, even if they do not express rules, are lawlike: they state non-accidental generalizations. Many scholars have taken this fact to indicate that generics are parametric on possible worlds: they refer to worlds other than the actual world. This, again, raises the problem of how people come to know about what happens in these other worlds. However, a rigorous application of standard tests for intensionality shows that generics are not, in fact, parametric on possible worlds, but only on time. This unusual property may explain much of the mystery surrounding generics. -/- Another mysterious property of generics is that although there is no language without them, there is no linguistic construction that is devoted to the expression of genericity. Rather, generics can be expressed in a variety of ways, each of which can also express nongenerics. Yet, each manifestation of generics differs subtly (or sometimes not so subtly) in its meaning from the others. -/- Even when these and other puzzles of genericity are solved, one mystery would remain: Why are generics, which are so easy to produce and understand in conversation, so difficult to analyze? Some comparisons are hard. How should we think about such comparisons? According to John Broome, we should think about them in terms of vagueness. But the vagueness account has remained unpopular thus far. Here I try to bolster it by clarifying the notion of comparative vagueness that lies at its heart.

In this paper, we present a way to translate the metainferences of a mixed metainferential system into formulae of an extended-language system, called its associated σ-system. To do this, the σ-system will contain new operators (one for each standard), called the σ operators, which represent the notions of "belonging to a (given) standard". We first prove, in a model-theoretic way, that these translations preserve (in)validity. That is, that a metainference is valid in the base system if and only if its (...) translation is a tautology of its corresponding σ-system. We then use these results to obtain other key advantages. Most interestingly, we provide a recipe for building unlabeled sequent calculi for σ-systems. We then exemplify this with a σ-system useful for logics of the ST family, and prove soundness and completeness for it, which indirectly gives us a calculus for the metainferences of all those mixed systems. Finally, we respond to some possible objections and show how our σ-framework can shed light on the “obeying” discussion within mixed metainferential contexts. (shrink)

Achieving energy sovereignty is increasingly gaining prominence as a goal in energy politics. The aim of this paper is to provide a conceptual analysis of this principle from an ethics and social justice perspective. We rely on the literature on food sovereignty to identify through a comparative analysis the elements energy sovereignty will most likely demand and thereafter distinguish the unique constituencies of the energy sector. The idea of energy sovereignty embraces a series of values, among which we identified: (i) (...) accessibility, to allow access to everyone, (ii) empowerment and recognition, to develop and sustain capabilities to collaboratively produce solution-oriented energy system knowledge and effectively participate in governance, (iii) stewardship and sustainability, to be able to design and manage decentralised renewable systems in view of protecting the environment, (iv) self-sufficiency, to reduce the negative shocks of exploitative business practises, (v) resilience, to maintain production capacities while withstanding socioeconomic, political, environmental and climatic shocks, (vi) peace, to establish production systems that do not involve hostile relations, (vii) transparency and self-determination, to establish democratic decision-making mechanisms that give a voice to previously underrepresented groups and limit corporate takeover (viii) gender-justice, by acknowledging the contributions of women and eliminate barriers to their empowerment. With a conceptual framework of energy sovereignty, we present a rationale that draws on the key values to be considered when formulating policy solutions for the energy sector. (shrink)

Most philosophers would agree that loving one’s romantic partner (i.e., being in love) is, in principle, a good thing. That is, romantic love can be valuable. It seems plausible that most would then think that the process leading to being in love—i.e. falling in love—can be valuable too. Surprisingly, that is not the case: among philosophers, falling in love has a bad reputation. Whereas philosophy of love has started to depart from traditional (and often unwarranted or false) tropes surrounding romantic (...) life, this tendency has not yet reached the analysis of falling in love. The phenomenon continues to be looked at mostly through a compendium of generalisations taken as metaphysical truths—the view of falling in love being akin to “losing one’s mind” or “not being able to think about anything else”. Here, I analyse some of these generalisations to show that although they may reflect some experiences of what falling in love feels like, they wrongly reduce falling in love to two related, but distinct, phenomena: limerence and infatuation. My aim is to refine the current terminology to lay the foundations for a neutral view of falling in love. (shrink)

El presente artículo demuestra que el tránsito entre la naturaleza y la libertad —como es expuesto en la Introducción a la Crítica del Juicio— debe ser comprendido como un argumento teorético y práctico, cuyo propósito es demostrar la posibilidad del Sumo Bien en la naturaleza. Con este propósito, se reconstruye histórico-genéticamente el contexto en que aparece el tránsito dentro de la composición de la obra, justificando así su validez como sentido global de la Crítica. Después, se demuestra que el origen (...) de la exigencia sobre el tránsito proviene del proyecto arquitectónico, como es interpretado a partir de la Crítica de la razón pura, lo cual permite caracterizar las condiciones que debe cumplir para ser construido. Por último, se interpreta el tránsito desde el enfoque arquitectónico y se identifican los momentos de su construcción a lo largo de la crítica del Juicio estético y del teleológico, lo que demuestra su carácter argumental teorético y práctico. A partir de lo anterior, se pretende justificar la unidad del sentido de la Crítica del Juicio, así como la complementariedad entre sus dos momentos. (shrink)

Extreme inequality of opportunity leads to a number of social tensions, inefficiencies and injustices. One issue of increasing concern is the effect inequality is having on people’s fair chances of attaining meaningful work, thus limiting opportunities to make a significant positive contribution to society and reducing the chances of living a flourishing life and developing their potential. On a global scale we can observe an increasingly uneven provision of meaningful work, raising a series of ethical concerns that need detailed examination. (...) Moral encroachment states that moral factors can make a difference to what we are epistemically justified in believing. I present two motivating cases that resemble a common example in the moral encroachment literature to show that the agent's commitments and beliefs, and not the moral factors of the situation, influence epistemic justification. I call this view Structural Encroachment.

A standing question in consciousness science is whether consciousness arises gradually or in a sudden way. This empirical question is connected to a metaphysical one, concerning the kind of property that consciousness is, i.e., graded or categorical. Recently, Lee (2022) suggested that settling this question requires deciding which theory of consciousness is true. Applying an insight from Wiese (2020), this chapter pursues a way of approximating answers by examining properties that are necessary for consciousness, which consciousness must have regardless of (...) which theory turns out true in the end. One such property is attention. This chapter suggests that attention is connected to consciousness in such a way that a graded view of the former brings support for a graded view of the latter. To this effect, evidence is discussed that degrees of attention are reflected in several acknowledged dimensions of consciousness. The upshot of this view is that the transition from unconscious information processing to conscious experience is gradual and is a function of degree of attention. (shrink)

In this article, I focus on the problem of body as it is developed in Heidegger’s Zollikon Seminars, in contrast with its enigmatic concealment in Being and Time. In the first part, I emphasize the implicit connection of Heidegger’s approach of body with Husserl’s problematic of Leib and Körper, and with his phenomenological analyses of tactility. In the second part, I focus on Heidegger’s distinction between the limits of the lived body and the limits of the corresponding corporeal thing, opening (...) to an ontological understanding of the ecstatic bodying forth of the body. In the third part, I analyse this ecstatic bodiliness in relation to the problem of spatiality, exploring the tension between the here and the over there in the experience of the embodiment. Heidegger not only refuses to understand the space starting from the here of the body, but he also refuses to understand the body starting from the here of the space. Thus, there are two interconnected inversions that Heidegger operates in relation to Husserl: In the topic of spatiality, he rejects the pre-eminence of the here; in relation to the body, he contests the primacy of tactility. Finally, the conclusion stresses that, even if the bodying forth penetrates almost all behaviour of Dasein in the world, there is however a limit of embodiment, an unreachable frontier beyond any possibility of the bodying forth, namely the understanding of being. This also implies that the problem of body needs be understood in the context of the ontological difference. (shrink)

The observational-theoretical distinction has played a central role in the philosophy of science from logical empiricism onwards. Developments within the discipline have shown that such a distinction hides two non-identical distinctions: observational vs. non-observational and theoretical vs. non-theoretical. Likewise, metatheoretical structuralism proposed a more sophisticated treatment of theoricity in terms of the operational dependence or independence of concepts from the theories in which they appear. Despite this remarkable sophistication, it is still generally accepted that the distinction between theoretical and non-theoretical (...) concepts coincides with the explanatory vs. non-explanatory and testing vs. non-testing distinctions. Ginnobili and Carman argued for the independence between theoricity and explanation. In this paper we will focus on testing and argue for its independence from both theoricity and explanation. To do so, we propose an account of theory testing based on the framework of metatheoretical structuralism and apply it to natural selection theory and cladistics. (shrink)

In various responses to the COVID-19 pandemic, we can observe insufficient sensitivity towards the needs and circumstances of poorer citizens. Particularly in a context of high inequality, policy makers need to engage with the wider public in debates and consultations to gain better insights in the realities of the worst-off within their jurisdiction. When consultations involve members of traditionally underrepresented groups, these are not only more inclusive, which is in itself an ethical aim, but pool ideas and observations from a (...) much more diverse array of inhabitants. Inclusivity increases the odds to identify a larger range of weak spots for health security and to design health interventions that are less burdensome on those worst-off. (shrink)

Kitcher has proposed an ideal-theory account—well-ordered science (WOS)— of the collective good that science’s research agenda should promote. Against criticism regarding WOS’s action-guidance, Kitcher has advised critics not to confuse substantive ideals and the ways to arrive at them, and he has defended WOS as a necessary and useful ideal for science policy. I provide a distinction between two types of ideal-theories that helps clarifying WOS’s elusive nature. I use this distinction to argue that the action-guidance problem that WOS faces (...) remains even under the aims/means distinction, because the WOS’s failure is more basic than critics have suggested. In this article, we provide three generators of propositional formulae for arbitrary languages, which uniformly sample three different formulae spaces. They take the same three parameters as input, namely, a desired depth, a set of atomics and a set of logical constants (with specified arities). The first generator returns formulae of exactly the given depth, using all or some of the propositional letters. The second does the same but samples up-to the given depth. The third generator outputs formulae with exactly (...) the desired depth and all the atomics in the set. To make the generators uniform (i.e. to make them return every formula in their space with the same probability), we will prove various cardinality results about those spaces. (shrink)

The 20th century was a bloody one, full of armed clashes which destroyed Europe, withered an entire generation’s hope of European-level peace. After the Versailles Treaty, the famous economist John Maynard Keynes uttered this prophecy: ”With such a peace treaty, you’ll be at war again within 20 years”. John Maxwell Coetzee, an important South-African novelist, called the 20th century “Satan’s century”. A tough statement yet extremely true unfortunately. Besides war, the past one hundred years also witnessed terrible totalitarian regimes occur, (...) such as the Nazi and fascism. The hardness of those regimes at least equaled the suffering caused by the world wars. One wouldn’t be wrong to call such regimes state terrorism: a leader suppressing his own citizens just to satisfy his own fantasy. The hugeness of their deeds goes beyond human imagination according to the number of victims. A classical word of wisdom describes terrorism as follows: ”It kills a few, but terrifies more”. Taking people’s longevity as a measure of good life, humankind can proudly say that the average person is living a much longer life than ever before. The AIDS epidemic has however for the first time in decades stalled and in some cases even reverted this trend in a number of countries. Climate change is increasingly becoming a major challenge for food security and we can anticipate that hunger caused by crop damages will become much more common. -/- Since many of (...) the challenges humanity faced in the past were overcome by inventive solutions coming from the life sciences, we are compelled to reconsider how we incentivize science and technology development so that those in need can benefit more broadly from scientific research. There is a huge portion of the world population that is in urgent need for medicines to combat diseases that are currently neglected by the scientific community and could immensely benefit from agricultural research that specifically targets their environmental conditions. At the same time efforts have to be made to make the fruits of current and future research more widely accessible. These changes would have to be backed by a range of moral arguments to attract people with diverging notions of global justice. This article explores the main ethical theories used to demand a greater share in the benefits from scientific progress for the poor. Since life sciences bring about a number of special concerns, a short list of conflictive issues is also offered. (shrink)

Having an adequate and extensively recognized resource governance system is essential for the conservation and sustainable use of crop genetic resources in a highly populated planet. Despite the widely accepted importance of agrobiodiversity for future plant breeding and thus food security, there is still pervasive disagreement at the individual level on who should own genetic resources. The aim of the article is to provide conceptual clarification on the following concepts and their relation to agrobiodiversity stewardship: open access, commons, private property, (...) state property and common heritage of humankind. After presenting each property regime, we will examine whether and how these incentivize the conservation, improvement and sharing of crop genetic resources, and conclude by defending a mixed property regime. Tal principio actuaría de un modo implícito por detrás de muchas explicaciones de la biología, pero nunca habría sido explicitado. Asumiendo que esta idea es interesante, y que los autores en cuestión tienen razón, discutiremos el modo metateórico en que presentan dicho principio, como siendo (...) parte de la teoría de la probabilidad. Esto permite a los autores afirmar que la teoría de la probabilidad brindaría la base reductiva para toda la biología evolutiva (dado que consideran que otros principios, como el de selección natural, también serían parte de la teoría de la probabilidad). Defenderemos que, efectivamente, ZFEL no es propio de la biología únicamente, pero no por formar parte de la teoría de la probabilidad, sino por tratarse de una versión específica del principio de causa común. -/- In a recent book, McShea and Brandon argue that the observed diversity and complexity of life are explainable by a principle they call the “zero-force evolutionary law” or “ZFEL”. Although this principle would be implicit in many explanations given by biologists, it would have never been made explicit. Assuming that this idea is interesting, and that the authors are right, we will discuss the metatheoretical way in which they present said principle, as being a part of probability theory. This allows the authors to claim that probability theory provides the reductive basis for all evolutionary biology. We will defend, in accordance with them, that ZFEL is not a solely biological principle, but not because it is a part of probability theory, but rather because it is a specific version of the principle of common cause. This paper argues for a revised concept of authenticity entailing two demands that must be balanced. The first demand moves authenticity from the position of a strictly self-regarding virtue towards the position of a fully social virtue, acknowledging the crucial feature of steadiness, i.e. self-consistency, as being precisely what we ‘naturally’ lack. Nevertheless, the value of personal authenticity in a modern, open society comes from the fact that it brings about not only steadiness, but also the public development of a (...) variety of existential options that can be understood as Millian ‘original experiments in living’. Thus the second demand of authenticity is a demand for ‘experimental’ authenticity which covers the whole spectrum of technologies of the self, from Nietzschean ‘brief habits’, to the use of enhancement technologies. Following some Levinasian and Derridian insights, my goal is to analyze the structural differences between interspecific and intraspecific violence by asking how the generic phenomenon of violence is modalized across various levels: from human to human, (...) from human to animal, from animal to human, from animal to animal. I will address questions of incarnated vulnerability and altered states of affectivity, and I will relate the various forms of violence emerging in the context of the anthropological difference to the question of territoriality, arguing that violence is structurally modified in relation to particular articulations of our worldly spatiality. One of the most attractive, but nevertheless highly controversial proposals to alleviate the negative effects of today’s international patent regime is the Health Impact Fund (HIF). Although the HIF has been drafted to facilitate access to medicines and boost pharmaceutical research, we have analysed the burdens for the global poor a similar proposal designed to promote the use and development of climate-friendly technologies would have. Drawing parallels from the access to medicines debate, we suspect that an analogous “Climate Impact Fund” (...) will increase the already very high scientific and technological supremacy of the developed world over the Global South. We advocate countering this dominance on the ground that countries with scarce research and development capacities will be in a difficult position to reject technologies and will not have a say on how such technologies should look like. Further, addressing global hazards should be an inclusive endeavour and not only a privilege reserved for the developed world. Incentivizing grassroots innovation would be a major step to promote scientific and technological inclusion. (shrink)

Recent years have witnessed intensive efforts to specify which requirements ethical artificial intelligence (AI) must meet. General guidelines for ethical AI consider a varying number of principles important. A frequent novel element in these guidelines, that we have bundled together under the term explicability, aims to reduce the black-box character of machine learning algorithms. The centrality of this element invites reflection on the conceptual relation between explicability and the four bioethical principles. This is important because the application of general ethical (...) frameworks to clinical decision-making entails conceptual questions: Is explicability a free-standing principle? Is it already covered by the well-established four bioethical principles? Or is it an independent value that needs to be recognized as such in medical practice? We discuss these questions in a conceptual-ethical analysis, which builds upon the findings of an empirical document analysis. On the example of the medical specialty of radiology, we analyze the position of radiological associations on the ethical use of medical AI. We address three questions: Are there references to explicability or a similar concept? What are the reasons for such inclusion? Which ethical concepts are referred to? (shrink)

The aim of this article is to examine the problematic frontier that separates the phenomenology of the body and the phenomenology of animality. The main difficulty is to differentiate phenomenologically not only between embodiment and animality, but also between specifically human embodied experience and what is accessible to us through empathy in relation to the corporeality of the animal. I will tackle these questions by considering relevant textual material from the writings of Edmund Husserl and Martin Heidegger. On the one (...) hand, I will show that although embodiment and animality are convergent on the level of the naturalistic attitude in Husserl’s Ideas II, they are divergent as soon as we place ourselves in the personalistic attitude, where the body enters into a different conjunction—namely, with the idea of person and of the spiritual world. On the other hand, Heidegger claims that, in spite of the abysmal bodily kinship with the animal, there is an essential difference between the human body and the animal organism, thus opposing the tendencies to humanize the animal and to animalize the human. The concept of food sovereignty is becoming an element of everyday parlance in development politics and food justice advocacy. Yet to successfully achieve food sovereignty, the demands within this movement have to be compatible with the way people are pursuing consumer sovereignty, and vice versa. The aim of this article is to examine the different sets of demands that the two ideals of sovereignty bring about, analyze in how far these different demands can stand in constructive relations with each other (...) and explain why consumers have to adjust their food choices to seasonal production variability to promote food sovereignty and so secure future autonomy. Explanations of the genuine openness of the future often appeal to objective indeterminacy. According to the received view, such indeterminacy is indeterminacy of certain future-tensed state of affairs that presently obtain. We shall call this view the weak indeterminate present, to distinguish it from the view we will defend in this paper, which we dub the strong indeterminate present. According to our view, unsettledness of the future is grounded on the present indeterminacy of some present-tensed state of affairs. In order (...) for an indeterminate present-tensed state of affairs to explain the unsettledness of a future-tensed state of affairs, there has to be a connection between the two. We argue that this connection can only be provided if we look at the internal structure of the relevant state of affairs. Finally, we will suggest that the best background theory to explain the connection are the so-called spontaneous collapse models of quantum mechanics. (shrink)

Visual experiences often feel crisper, sharper or more vivid when one pays attention to the seen object. According to some representationalist theories of perception, these felt effects occur because attentive experiences represent more determinate or precise properties than their inattentive counterparts: a color experience represents vermillion rather than red if the color is perceived with attention rather than without it. Recently, this idea has been expressed in terms of ranges of feature values represented, so that attentive experiences shall represent narrower (...) ranges than inattentive experiences. However, the latter claim seems to run counter to evidence, recently discussed by Block (2015), that neither spatial attention nor attention as deployed in the attentional blink paradigm alters the ranges of properties represented in visual perception. In this chapter, I clarify what these findings in fact tell us about the representational contents of visual perception and argue that they do not refute the representational account of the attentional effects. Taking into consideration the extremely harsh public health conditions faced by the majority of the world population, the Health Impact Fund (HIF) proposal seeks to make the intellectual property regimes more in line with human rights obligations. While prioritizing access to medicines and research on neglected diseases, the HIF makes many compromises in order to be conceived as politically feasible and to retain a compensation character that makes its implementation justified solely on basis of negative duties. Despite that current global (...) health realities make such steps reasonable, the paper looks up the negative effects on one overlooked human right: the right to participate in scientific advancement. In this thesis we have examined the complex interaction between intellectual property rights, life sciences and global justice. Science and the innovations developed in its wake have an enormous effect on our daily lives, providing countless opportunities but also raising numerous problems of justice. The complexity of a problem however does not liberate society as a whole from moral responsibilities. Our intellectual property regimes clash at various points with human rights law and commonly held notions of justice.

As a policy instrument that is deeply rooted in technology assessment, the precautionary principle examines the effects of a given object on humans and the environment. In practice the principle is rarely used to analyze the effects of our safety measures on the object itself or the way it is produced. Yet it is exactly in the effect on the blood procurement system that blood safety regulations based on the precautionary principle have to be particularly careful, as the vast majority (...) of blood products in the Global North are obtained through donations. Are widely used measurements in the human sciences (say happiness surveys or depression scales) quantitative or merely ordinal? If they are merely ordinal, could they be developed into quantitative measurements, just like in the progression from thermoscopes to thermometers? Taking inspiration from recent philosophy of measurement, some practitioners express optimism about future human science measurements. The so-called quantity objection stands out for having the only chance of settling the debate in favour of the pessimists. It claims that the problem lies (...) not with current, or likely future, measurement practices in the human sciences, but with human science attributes themselves—they just are not quantitative, but merely ordinal. Hence, they cannot not (thus will not) be measured quantitatively. The argument has a long and distinguished pedigree. This paper assesses old and recent versions of it, namely: the objection made originally to Fechner’s psychophysics by von Kries (among others) and Michell’s recent version of this objection. To do so, the paper first draws important distinctions between different versions of the argument that have been overlooked. Then, it argues that none of the versions of the quantity objection provide a good reason for the optimists to give up their optimism. In particular, Michell’s argument characterizes the measurand (that is, the attribute to be measured) in a way that optimists do not and need not accept. Yet the optimists’ defence articulated here brings with it serious burdens to discharge. The ball is in their court. (shrink)

By examining the global public good nature of pandemic preparedness we can identify key social justice issues that need to be confronted to increase citizens’ voluntary compliance with prevention and mitigation measures. As people tend to cooperate on a voluntary basis only with systems they consider fair, it becomes difficult to ensure compliance with public health measures in a context of extreme inequality. Among the major inequalities that need to be addressed we can find major differences in the extensiveness and (...) intensiveness of quarantine experiences, lack of opportunities to participate in common efforts, hardship in complying with disease control recommendations, and an unfair distribution of the cooperative surplus. A wide range of proposals to alleviate the negative effects of intellectual property regimes is currently under discussion. This article offers a critical evaluation of six of these proposals: the Health Impact Fund, the Access to Knowledge movement, prize systems, open innovation models, compulsory licenses and South-South collaborations. An assessment on how these proposals target the human rights affected by intellectual property will be provided. The conflicting human rights that will be individually discussed are the rights: to benefit from one’s (...) own scientific work, to benefit from the advancement of science, to participate in scientific enterprises and to self-determination. New technologies such as smart sensors improve rehabilitation processes and thereby increase older adults’ capabilities to participate in social life, leading to direct physical and mental health benefits. Wearable smart sensors for home use have the additional advantage of monitoring day-to-day activities and thereby identifying rehabilitation progress and needs. However, identifying and selecting rehabilitation priorities is ethically challenging because physicians, therapists, and caregivers may impose their own personal values leading to paternalism. Therefore, we develop a discussion template consisting of a (...) series of adaptable questions for the patient–physician encounter based on the capability approach. The goal is to improve geriatric rehabilitation and thereby increase participation in social life and well-being. To achieve this goal, we first analyzed what is considered important for participation on basis of the capability approach, human rights, and ethics of care. Second, we conducted an ethical analysis of each of the four identified dimensions of participation: political, economic, socio-cultural, and care. To improve compliance with rehabilitation measures, health professionals must align rehabilitation measures in an open dialogue with the patient’s aspiration for participation in each dimension. A discussion template based on the capability approach allows for a proactive approach in patient information and stimulates a critical assessment of treatment alternatives while reducing the risk of imposing personal values. It has been argued that quantum mechanics forces us to accept the existence of metaphysical, mind-independent indeterminacy. In this paper we provide an interpretation of the indeterminacy involved in the quantum phenomena in terms of a view that we call Plural Metaphysical Supervaluationism. According to it, quantum indeterminacy is captured in terms of an irreducibly plural relation between the actual world and various misrepresentations of it.

El presente artículo ofrece una interpretación de la totalidad de la filosofía kantiana como reforma al concepto de filosofía de acuerdo con la naturaleza metafísica y moral de la razón. Para ello se articulan los elementos que sirven a la reforma, a saber, la comprensión de la filosofía bajo el concepto escolástico y bajo el cósmico, este último desprendido de la teleología racional expresada en la consideración histórica de la filosofía. Después, se construye la interpretación de la metodología arquitectónica que (...) utiliza la reforma, primero demostrando que la pregunta crítica sobre los juicios sintéticos a priori sirve para determinar los conocimientos posibles; posteriormente, argumentando que la pregunta se subsume a los intereses racionales de los seres humanos para vincular los conocimientos con el fin de la razón, lo cual corresponde a la estructuración de la filosofía según la Sabiduría a la que tiende. Por último, se propone cuál es la labor que cada Crítica tiene dentro de todo el proyecto de reforma. La interpretación, por tanto, recupera las intenciones eminentemente metafísicas y morales de la empresa kantiana, permitiendo abordarla en su conjunto. (shrink)

Purpose: The method of diagnosing diabetic retinopathy (DR) through artificial intelligence (AI)-based systems has been commercially available since 2018. This introduces new ethical challenges with regard to obtaining informed consent from patients. The purpose of this work is to develop a checklist of items to be disclosed when diagnosing DR with AI systems in a primary care setting. -/- Methods: Two systematic literature searches were conducted in PubMed and Web of Science databases: a narrow search focusing on DR and a (...) broad search on general issues of AI-based diagnosis. An ethics content analysis was conducted inductively to extract two features of included publications: (1) novel information content for AI-aided diagnosis and (2) the ethical justification for its disclosure. -/- Results: The narrow search yielded n = 537 records of which n = 4 met the inclusion criteria. The information process was scarcely addressed for primary care setting. The broad search yielded n = 60 records of which n = 11 were included. In total, eight novel elements were identified to be included in the information process for ethical reasons, all of which stem from the technical specifics of medical AI. -/- Conclusions: Implications for the general practitioner are two-fold: First, doctors need to be better informed about the ethical implications of novel technologies and must understand them to properly inform patients. Second, patient's overconfidence or fears can be countered by communicating the risks, limitations, and potential benefits of diagnostic AI systems. If patients accept and are aware of the limitations of AI-aided diagnosis, they increase their chances of being diagnosed and treated in time. (shrink)

In contrast to individualistic explanations of social injustice that appeal to implicit attitudes, structural explanations are unintuitive: they appeal to entities that lack clear ontological status, and the explanatory mechanism is similarly unclear. This makes structural explanations unappealing. The present work proposes a structural explanation of one type of injustice that happens in conversations, discursive injustice. This proposal meets two goals. First, it satisfactorily accounts for the specific features of this particular kind of injustice; and second, it articulates a structural (...) explanation that overcomes their unattractiveness. The main idea is that discursive injustice is not the result of biased interlocutors, but of problematic discursive norms. (shrink)

Intellectual property regimes necessarily create artificial scarcity leading to wastage, both by blocking follow-up research and hindering access to those who are only able to pay less then the actual retail price. After revising the traditional arguments to hinder access to people’s intellectual labour we will examine why we should be more open to allow free-riding of inventive efforts, especially in cases where innovators have not secured the widest access to the fruits of their research and failed to cooperate with (...) follow-up innovators. We will do so by questioning the voluntariness involved in consumption of objects of innovation, restating the positive social externalities that arise when wider access to the fruits of innovation is assured, and examining the eventual harms innovators face. Die Diversität von Nahrungspflanzen, ein Ergebnis Jahrtausende langer Zuchtbemühungen, ist in den letzten Jahrzehnten dramatisch zurückgegangen. Schätzungen zufolge machen von den über 7000 Nahrungspflanzenarten ganze 103 Sorten 90% der Nahrungsmittelproduktion aus. Dieser Verlust könnte in Zukunft gewaltige negative Auswirkungen auf die Nahrungsmittelsicherheit haben, da die Biodiversität eine zentrale Rolle bei der Absorbierung biotischer und abiotischer Stressfaktoren spielt, die auf die Pflanzen wirken. Darüber hinaus stellt der Verlust eine bedeutende Verarmung nicht nur des Pools genetischer Ressourcen dar, die zukünftigen Generationen zur (...) Verfügung stehen, sondern auch der kulturellen Diversität, indem die Nahrungsmittelvielfalt der Landesküchen eingeschränkt und sowohl Kulturlandschaften als auch Stadtgärten vereinheitlicht werden. Wegen der grundlegenden Funktion, die die Agrobiodiversität in der menschlichen Gesellschaft erfüllt, werden wir im Folgenden verschiedene Schwierigkeiten bei der Pflege der Agrobiodiversität als ein gemeinsames Erbe der Menschheit in einer stark ungleichen Welt erörtern. Zuvor jedoch möchten wir untersuchen, was Agrobiodiversität eigentlich ist und welche Funktion sie für das menschliche Wohlbefinden erfüllt. Ziel dieses Artikels ist zu zeigen, inwieweit sich verschiedene Anreizsysteme unterschiedlich auf den Erhalt von Agrobiodiversität auswirken. (shrink)

Desfăşurând harta lumii -/- Istoria şi geografia sunt lecţii pe care omenirea le-a învăţat, dar nu le-a respectat. Adesea surprinzătoare, istoria ne oferă exemple de măreţie şi de uimitor declin. Geografia ne arată cum se pot dezvolta popoarele lumii dacă sunt ajutate de mediul înconjurător. Studierea acestor lecţii ne oferă un paradox. State cu o istorie bogată, dar cu o geografie dezavantajoasă, au devenit mari puteri economice şi tehnologice ‒ un exemplu clasic este Japonia. State cu o istorie şi cu (...) o civilizaţie nu atât de bogată sunt exemple de prosperitate datorită unei geografii avantajoase ‒ Arabia Saudită sau Emiratele Arabe Unite. Un singur stat a putut să înmănuncheze aceste lecţii şi să devină cea mai mare putere cunoscută a lumii ‒ Statele Unite ale Americii. Stat cu un destin manifest şi cu o dorinţă de a arăta lumii că libertatea este cel mai de preţ lucru. Am desfăşurat harta lumii şi am rămas uluit de ce am observat. Regiuni pline de resurse care se afundă într-o subdezvoltare uluitoare ‒ Africa, Rusia şi America Latină ‒ şi regiuni cu resurse puţine şi cu o dezvoltare impresionantă ‒ Japonia, Germania, China şi, într-o anumită măsură, şi Statele Unite ale Americii. Dacă nu ne putem alege geografia, putem măcar să ne facem istoria. După acest dicton s-au condus multe state care şi-au dorit să atingă un nivel înalt de civilizaţie. Totuşi, de acest clivaj? O sumedenie de răspunsuri ne vin în minte: model cultural, arhetip civilizaţional, dorinţa de a se dezvolta. Toate aceste state au trăit în realitatea pe care şi-au creat-o, dar şi în utopia la care au visat. Lumea este condusă de vise şi speranţe, refuzând realitatea. Expansiunea islamului este paradigma utopică a mântuirii tuturor, expansiunea capitalistă este utopia dezvoltării lumii şi avansului civilizaţiei iar utopia democratică este dorinţa ascunsă a omului de a fi egal cu toţi ceilalţi. Toate aceste utopii formează din actuala lume în care trăim o lume conflictuală, o lume avidă de resurse, o lume în care puterea este mai importantă decât modelul civilizaţional. Am denumit această carte Noua Utopie după ce am deschis cartea de istorie a lumii şi am desfăşurat harta lumii, realizând că fiecare popor şi-a format propriul său vis. Conflictul izbucnit în lume a fost declanşat de reala dorinţă a fiecărui popor de a-şi exprima liber propriul vis. Fiecare vis s-a întâlnit cu alt vis şi aşa a ieşit o realitate deformată, în care popoarele lumii, cu structură bio-genetică asemănătoare, au intrat într-un conflict fratricid, care modelează această lume în care trăim. Când scriu aceste rânduri o serie de evenimente ne-au demonstrat că utopia globalistă a lumii este desuetă şi că se revine la o nouă eră a naţionalismelor. De ce am numit aceste idei filosofice, politice şi morale utopii?
