The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. Many philosophers have found in Hume’s skeptical doubts concerning the operations of the understanding the materials for an argument that generalizes from induction to other domains, like our beliefs in the external world, other minds, and the past. This chapter offers a novel reconstruction of that argument and identifies the principles that are responsible for its capacity to generalize beyond induction. Next, it presents a classical reading of Hume’s skeptical solution and shows that Crispin Wright’s entitlement theory is close in (...) spirit to it. After that, it develops two objections to entitlement theory: it relies on the truth of deeply contingent propositions that are not a priori rational, and it does not manage to redefine the concept of epistemic rationality while offering an effective anti-skeptical response. The chapter concludes with a constructive suggestion: some passages that support a non-classical reading of Hume’s positive views on induction offer the materials to reject the steps of the skeptical argument that cause trouble for entitlement theory. In everyday life, we think of skepticism as the position of a stubborn person who has higher epistemic standards than others. Hence, the skeptic is someone who defends extravagant ideas. Some skeptics may deny that climate change is real, while others claim that the first moon landing did not take place. Contemporary philosophers think of skepticism in a different way. In their view, skepticism is the conclusion of a paradoxical argument about epistemic statuses like knowledge and reasons. A paradoxical argument (...) is a logically valid argument that, starting from seemingly plausible premises, reaches an absurd conclusion. We introduce two skeptical arguments. The regress argument purports to show that we lack reasons to believe any claim whatsoever because the search for those reasons inevitably leads to an infinite regress. The underdetermination argument seeks to prove that we lack reasons to believe that there are chairs, trees, other people, and so on; it supports that conclusion by citing skeptical hypotheses, including the idea that we might be dreaming (Descartes 1641) or the suggestion that we could be brains in a vat connected to a supercomputer that mimics the pattern of neural activity that would be produced if we were perceiving external objects (Putnam 1981). [ENGLISH] This article discusses the potential of synthetic biology to address fundamental questions in the philosophy of biology regarding the nature of life and biological functions. Synthetic biology aims to reduce living organisms to their simplest forms by identifying the minimal components of a cell and also to create novel life forms through genetic reprogramming, biobrick assembly, or novel proteins. However, the technical success of these endeavors does not guarantee their conceptual success in defining life. There is a lack of (...) consensus among researchers on how to define and classify the entities produced in the lab, whether they should be considered living or categorized differently. The criteria for minimal cells and minimal life are subject to arbitrary choices and varying interpretations. The concept of function, crucial to synthetic biology, is also difficult to define. The article highlights the need to consider the minimal set of functions that characterize life before determining the smallest genomes that code for those functions. The arbitrary nature of defining both life and function complicates the understanding and classification of these entities. The article suggests that the traditional dichotomy between the living and the non-living may no longer be valid and that the concept of life itself may not require precise scientific definition. As synthetic biology advances, the article emphasizes the importance of redefining or constructing new categories to encompass the expanding possibilities and creations in the field. The ability to create new life forms raises questions about recognition, identification, and ethical implications, requiring a conceptual and philosophical engagement beyond the technical achievements of synthetic biology. -/- [FRENCH] L'article aborde le potentiel de la biologie synthétique pour répondre à des questions fondamentales de la philosophie de la biologie concernant la nature de la vie et des fonctions biologiques. Finality, design and purpose have started to be excluded from the language of the natural sciences since the XVIIth century. Darwin succeeded in excluding them from his theory of evolution appealing to a blind and mechanical natural selection. Today, the most usual definitions for the concept of biological function take for granted that functions: 1) are not dependent on a goal; 2) are not dependent on observers, but only on nature; 3) are explicable in causal terms, either with reference to (...) the causal history of the organ (etiological definition), or with reference to its present structure and causal capabilities (dispositional definition). However, we shall see that such presuppositions cannot take into account the normative character of the concept of biological function. We show that a generalization of the concept of scientific objectivity lets us affirm that functions: 1’) are dependent on a goal; 2’) are dependent on both observers and nature; 3’) cannot be reduced to causality, nor break the laws of physics; and yet, 4) are truly objective. Theories of emotional justification investigate the conditions under which emotions are epistemically justified or unjustified. I make three contributions to this research program. First, I show that we can generalize some familiar epistemological concepts and distinctions to emotional experiences. Second, I use these concepts and distinctions to display the limits of the ‘simple view’ of emotional justification. On this approach, the justification of emotions stems only from the contents of the mental states they are based on, also known as their (...) cognitive bases. The simple view faces the ‘gap problem’: If cognitive bases and emotions (re)present their objects and properties in different ways, then cognitive bases are not sufficient to justify emotions. Third, I offer a novel solution to the gap problem based on emotional dispositions. This solution (1) draws a line between the justification of basic and non-basic emotions, (2) preserves a broadly cognitivist view of emotions, (3) avoids a form of value skepticism that threatens inferentialist views of emotional justification, and (4) sheds new light on the structure of our epistemic access to evaluative properties. Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. Goal: To assess public knowledge and attitudes towards the family’s role in deceased organ donation in Europe. -/- Methods: A systematic search was conducted in CINHAL, MEDLINE, PAIS Index, Scopus, PsycINFO, and Web of Science on December 15th, 2017. Eligibility criteria were socio-empirical studies conducted in Europe from 2008 to 2017 addressing either knowledge or attitudes by the public towards the consent system, including the involvement of the family in the decision-making process, for post-mortem organ retrieval. Screening and data collection (...) were performed by two or more independent reviewers for each record. -/- Results: Of the 1482 results, 467 studies were assessed in full-text form, and 33 were included in this synthesis. When the deceased has not expressed any preference, a majority of the public support the family's role as a surrogate decision-maker. When the deceased expressly consented, the respondents' answers depend on whether they see themselves as potential donors or as a deceased's next-of-kin. Answers also depend on the relationship between the deceased and the decision-maker(s) within the family, and on their ethnic or cultural background. -/- Conclusions: Public views on the authority of the family in organ donation decision-making require further research. A common conceptual framework and validated well-designed questionnaires are needed for future studies. The findings should be considered in the development of Government policy and guidance regarding the role of families in deceased organ donation. (shrink)

According to MODERATISM, perceptual justification requires that one independently takes for granted propositional hinges like <There is an external world>, <I am not a brain in a vat (BIV)>, and so on. This view faces the truth problem: to offer an account of truth for hinges that is not threatened by skepticism. Annalisa Coliva has tried to solve the truth problem by combining the claim that external world propositions have a substantive truth property like correspondence with the claim that hinges (...) have a deflationary truth property. I argue that the resulting view cannot offer a coherent characterization of ‘skeptical switch scenarios’ while providing an effective anti-skeptical strategy. In a more positive vein, I defend an approach that combines a correspondence conception of truth with epistemological disjunctivism. (shrink)

This paper introduces a body of research on Organizational Behavior and Industrial/organizational Psychology that expands the range of empirical evidence relevant to the ongoing character-situation debate. This body of research, mostly neglected by moral philosophers, provides important insights to move the debate forward. First, the OB/io scholarship provides empirical evidence to show that social environments like organizations have significant power to shape the character traits of their members. This scholarship also describes some of the mechanisms through which this process of (...) reshaping character takes place. Second, the character-situation debate has narrowly focused on situational influences that affect behavior episodically and haphazardly. The OB/io research, however, highlights the importance of distinguishing such situational influences from influences that, like organizational influences, shape our character traits because they are continuous and coordinated. Third, the OB/io literature suggests that most individuals display character traits that, while local to the organization, can be consistent across situations. This puts pressure on the accounts of character proposed by traditional virtue ethics and situationism and provides empirical support to interactionist models based on cognitive-affective processing system theories of personality. Finally, the OB/io literature raises important challenges to the possibility of achieving virtue, provides valuable and untapped resources to cultivate character, and suggests new avenues of normative and empirical research. Scholars who favor shareholder primacy usually claim either that managers should not fulfill corporate duties of beneficence or that, if they are required to fulfill them, they do so by going against their obligations to shareholders. Distinguishing between structurally different types of duties of beneficence and recognizing the full force of the normative demands imposed on managers reveal that this view needs to be qualified. Although it is correct to think that managers, when acting on behalf of shareholders, are not (...) required to fulfill wide duties of charity, they are nevertheless required to fulfill a variety of narrow duties of beneficence. What is more, the obligation to fulfill these duties arises precisely because they are acting on behalf of shareholders. As such, this article 1) refines our understanding of the duties of corporate beneficence and 2) helps to identify which duties of beneficence are imposed on managers when they are acting on behalf of shareholders. We will demonstrate that this assumption is incorrect. On the one hand, there is no reason to think that this coincidence should exist. On the other, this is not the case, as we will show analysing several examples. The testing basis of a theory does not have to coincide with the explanandum of the theory. To defend this point we will endorse de metatheoretical structuralism. In addition, we will consider some repercussions that this discussion has for the assumed metatheoretical framework. This paper argues that habits, just like beliefs, can guide intentional action. To do this, a variety of real-life cases where a person acts habitually but contrary to her beliefs are discussed. The cases serve as dissociations showing that intentional agency is possible without doxastic guidance. The upshot is a model for thinking about the rationality of habitual action and the rationalizing role that habits can play in it. RESUMEN: El tema de este trabajo es la reconstrucción de la teoría de la selección natural darwiniana. Me propongo esbozar la ley fundamental de esta teoría de manera informal a partir de sus aplicaciones en El origen de las especies de Darwin y presentar sus conceptos fundamentales. Presentaré la red teórica de leyes especiales que surgen de la especialización de esta ley fundamental. Supondré el estructuralismo como marco metateórico. Señalaré también algunas consecuencias que mi propuesta tiene sobre ciertas discusiones metateóricas (...) en torno a la teoría y, finalmente, relacionaré mi reconstrucción con otras reconstrucciones disponibles.ABSTRACT: This paper is about the reconstruction of the Darwinian Theory of Natural Selection. My aim here is to outline the fundamental law of this theory in an informal way from its applications in The Origin of Species and to make explicit its fundamental concepts. I will introduce the theory-nets of special laws that arisefrom the specialization of the fundamental law. I will assume the metatheoretical structuralist frame. I will also point out many consequences that my proposal has about a few metatheoretical discussions around the theory and, finally, I will relate my propose to other reconstructions available. The work of Emmanuel Levinas has been both abundantly recognized and criticized in moral philosophy. This Janus-faced attitude is also present in ecological theories, which find fertile ground in Levinas’ thought without being able to explain its apparent anthropocentrism. Opposing hermeneutical paths tend to focus either on otherness as an absolute alterity, implying a potentially unlimited responsibility for all alterities, or on otherness as a re-foundation of humanism, leading to the conclusion that responsibility is unlimited only among humans. Here I (...) seek to disentangle Levinas from these two extreme interpretations, first by reviewing ecological readings of his philosophy, in both the Francophone and Anglophone spheres, and second by analyzing specific Levinasian terms that might be particularly helpful for a non-anthropocentric or deep ecology. The main results of this investigation are a distinction between the ethics of responsibility and the ethics of vulnerability, an explanation of Levinasian compulsory or methodological humanism, and a schematic model of sensibility as enjoyment/vulnerability capable of supporting deep ecology without the traditional notions of free will, rights, or values. According to epistemological disjunctivism (ED), in paradigmatic cases of perceptual knowledge, a subject, S, has perceptual knowledge that p in virtue of being in possession of reasons for her belief that p which are both factive and reflectively accessible to S. It has been argued that ED is better placed than both knowledge internalism and knowledge externalism to undercut underdetermination-based skepticism. I identify several principles that must be true if ED is to be uniquely placed to attain this goal. After (...) that, I use those principles to formulate a diachronic skeptical argument. This argument yields the counterintuitive conclusion that understanding a global skeptical hypothesis is all it takes for a rational subject to lose all her perceptual knowledge of the world. Next, I show that a popular Austinian move must reject one or another of the principles that underlie ED. I close by delineating a novel strategy that can block the diachronic skeptical argument while preserving all the principles. The key idea is that perceptual knowledge is grounded in primitive, perceptual and recognitional abilities. This view sheds new light on some puzzling features of global skepticism that have been noted by Descartes and Hume, among others. (shrink)

Abstract One of the most important things that the Darwinian revolution affected is the previous teleological thinking. In particular, the attribution of functions to various entities of the natural world with explanatory pretensions. In this change, his theory of natural selection played an important role. We all agree on that, but the diversity and heterogeneity of the answers that try to explain what Darwin did exactly with functional biology are overwhelming. In this paper I will try to show how Darwin (...) modified previous functional biology. Pre-Darwinian naturalists did not hesitate to attribute functions in which, for example, the traits of one species were in the service of other species. I will try to show that this has consequences on the discussion regarding the nature of functional language, since the main approaches, the systemic and the etiological, do not adequately account for these changes and therefore do not account for the way functional biology regulates the kind of legitimate functions. I will outline a possible new solution to this problem: appropriate functional attributions in Darwinian functional biology could be regulated by a theory or a set of laws that provide the criteria for determining its fundamental concepts. -/- Resumen: Una de las cosas más importantes a las que la revolución darwiniana afectó es el pensamiento teleológico previo. En particular, la atribución de funciones a diversas entidades del mundo natural con pretensiones explicativas. En este cambio, su teoría de la selección natural desempeñó un papel importante. Todos estamos de acuerdo en ello, pero la diversidad y heterogeneidad de las respuestas que tratan de explicar lo que Darwin hizo exactamente con la biología funcional son abrumadoras. En este artículo intentaré mostrar cómo Darwin modificó la biología funcional anterior. Los naturalistas predarwinianos no dudaban en atribuir funciones en las que, por ejemplo, los rasgos de una especie estaban al servicio de otras especies. Intentaré mostrar que esto tiene consecuencias en la discusión sobre la naturaleza del lenguaje funcional, pues los principales enfoques, el sistémico y el etiológico, no dan cuenta adecuadamente de estos cambios y, por tanto, no dan cuenta de la forma en que la biología funcional regula el tipo de funciones legítimas. Esbozaré una posible nueva solución a este problema: las atribuciones funcionales apropiadas en la biología funcional darwiniana podrían estar reguladas por una teoría o un conjunto de leyes que proporcionen los criterios para determinar sus conceptos fundamentales. -/- . ABSTRACT:The distinction between what I call nonelective obligations and discretionary obligations, a distinction that focuses on one particular thread of the distinction between perfect and imperfect duties, helps us to identify the obligations that carry over from principals to agents. Clarity on this issue is necessary to identify the moral obligations within “shareholder primacy”, which conceives of managers as agents of shareholders. My main claim is that the principal-agent relation requires agents to fulfill nonelective obligations, but it does not always (...) require discharging discretionary obligations. I show that the requirement to fulfill nonelective obligations is more far-reaching than has been acknowledged by most defenders and critics of shareholder primacy. But I also show that managers are not bound by certain discretionary obligations like charity, showing that their moral obligations are more circumscribed than the obligations that apply to human beings in general. Evidence from cognitive science supports the claim that humans and other animals see the world as divided into objects. Although this claim is widely accepted, it remains unclear whether the mechanisms of visual reference have representational content or are directly instantiated in the functional architecture. I put forward a version of the former approach that construes object files as icons for objects. This view is consistent with the evidence that motivates the architectural account, can respond to the key arguments against (...) representational accounts, and has explanatory advantages. I draw general lessons for the philosophy of perception and the naturalization of intentionality. (shrink)

Resumen -/- El objetivo de este trabajo consiste en analizar las relaciones entre los modelos de optimalidad y la selección natural. Defenderemos que esas relaciones pueden dividirse en dos tipos, en tanto hay dos tipos de explicaciones seleccionistas, que llamaremos “históricas” y “ahistóricas”. Las explicaciones históricas revelan como una población dada adquiere un rasgo que es adaptativo en ese ambiente e involucran muchas generaciones, variación, etc. Las explicaciones ahistóricas, explican por qué, en determinado momento, ciertos tipos de organismos tienen un (...) mayor éxito reproductivo que otros. Mostraremos que los modelos de optimalidad pueden jugar un rol en la determinación del explanandum de las explicaciones histórica seleccionistas, esto es, que ayudan a reconocer qué rasgos son adaptativos. Por otra parte, mostramos que los modelos de optimalidad nos permiten determinar a veces la parte del explanans de las explicaciones ahistóricas (particularmente, el concepto de fitness). -/- Abstract -/- The goal of this paper is to analyze the relations between optimality models and natural selection. We contend that these relationships can be divided into two kinds, as there are two kinds of natural selection explanations, which we call “historical” and “ahistorical”. Historical explanations reveal how a given population acquires a trait which is adaptive in its environment, and involves many generations, variations, etc. Ahistorical ones, explain why, at a given moment, certain kinds of organisms have a greater reproductive success than others. We show that optimality models can play a role in determining the explanandum of historical selectionist explanations, that is, they help us to recognize which traits are adaptive. And, on the other hand, that optimality models sometimes allow us to determine part of the explanans of ahistorical explanations (particularly, the concept of fitness). (shrink)

Object files are mental representations that enable perceptual systems to keep track of objects as numerically the same. How is their reference fixed? A prominent approach, championed by Zenon Pylyshyn and John Campbell, makes room for a non-satisfactional use of properties to fix reference. This maneuver has enabled them to reconcile a singularist view of reference with the intuition that properties must play a role in reference fixing. This paper examines Campbell’s influential defense of this strategy. After criticizing it, a (...) new approach is sketched. The alternative view introduces representational contents to explain perceptual individuation. After arguing that those contents are not satisfactional, it is concluded that there is room for a third view of reference fixing that does not fit into the singularist/descriptivist dichotomy. The strong influence that natural theology had over Darwin’s conceptualization of the adaptation phenomenon is frequently noted. The natural selection theory would explain the same phenomenon that the natural theologist intended to explain: the adaptation. Recently has been claimed, on the contrary, that the Darwinian way of conceptualizing adaptation is new. The concept of adaptation from natural theology presupposes the idea that organisms exist for realization and support of the natural equilibrium stated by the creator. In this work I will discuss this point, assuming the metatheoretical structuralism frame. (shrink)

Epistemological disjunctivism (ED) has been thought to solve the conditionality problem for epistemic externalism. This problem arises from externalists’ characterization of our epistemic standings as conditional on the obtaining of worldly facts which we lack any reflective access to. ED is meant to avoid the conditionality problem by explicating subjects’ perceptual knowledge in paradigmatic cases of perceptual knowledge via their possession of perceptual reasons that are both factive and reflectively accessible. I argue that ED’s account of reflectively accessible factive perceptual (...) reasons is also prey to the conditionality problem. After that, I submit that Stroud’s influential formulation of the conditionality problem relies on a methodological requirement that is potentially dissociable from ED. So, it is possible to put ED in the service of a more modest anti-skeptical strategy. I close by suggesting that this modest anti-skeptical strategy successfully undercuts the underdetermination-based skeptical paradox. Nevertheless, it does not have substantial advantages over some forms of epistemic externalism. (shrink)

Si bien la distinción entre estos distintos mecanismos es de suma importancia en la obra de Darwin, la tesis de este trabajo es que tanto la selección artificial como la sexual (...) no son mecanismos distintos de la selección natural. As touch remains commonly defined by the closeness it physically implies and it rhetorically evokes, the mere notion of distant touch and of distal haptic perception seems peculiar. But Aristotle’s perspective, which I wish to take as a point of departure, is firm: we perceive the objects of touch, the hot and the cold, the hard and the soft, the curved and the sharp, through other things: δι' ἑτέρων. In this article, I would like to explore this ἕτερος by showing (...) how the otherness of perception always implies an intermediary, a middle point (μέσος), i.e. an other not so other, an other that is able to translate the much more distant otherness of the perceived object. To explore these forgotten layers of alterity that fall into what we commonly conceive of as the impalpable emptiness of distance, I propose to study the idea of distant touch from the perspective of phenomenological aesthetics. In order to do so, I will first examine some aspects of the Husserlian account of perception and will then focus on the phenomenology of distant touch in Alejandra Costamagna’s novel El Sistema del Tacto [The System of Touch] (2018). Radical skepticism relies on the hypothesis that one could be completely cut off from the external world. In this paper, I argue that this hypothesis can be rationally motivated by means of a conceivability argument. Subsequently, I submit that this conceivability argument does not furnish a good reason to believe that one could be completely cut off from the external world. To this end, I show that we cannot adequately conceive scenarios that verify the radical skeptical hypothesis. Attempts to do (...) so fall prey to one or another of three pitfalls: they end up incomplete, reveal a deep contradiction or recreate a non-skeptical hypothesis. I use these results to improve upon Pritchard’s recent attempt at undercutting radical skepticism. (shrink)

Much of the climate justice discussion revolves around how the remaining carbon budget should be globally allocated. Some authors defend the unjust enrichment interpretation of the beneficiary pays principle (BPP). According to this principle, those states unjustly enriched from historical emissions should pay. I argue that if the BPP is to be constructed along the lines of the unjust enrichment doctrine, countervailing reasons that might be able to block the existence of a duty of restitution should be assessed. One might (...) think that the duty to provide restitution no longer has moral weight if many benefits were already consumed, if the particular benefits obtained from historical emissions cannot be transferred from one country to another, or if present members of developed countries framed their life plans based upon the expectation of continued possession of those benefits. I show that none of these reasons negate the duty to provide restitution. (shrink)

En su artículo clásico, Gould y Lewontin (1979) han esgrimido críticas no siempre claras - contra el así llamado "programa adaptacionista". Puesto que una "adaptación" en uno de los sentidos más utilizados del vocablo - refiere a un rasgo cuya fijación en una población se explica por selección natural, el encuentro de adaptaciones ha sido considerado una heurística que guía a los biólogos en la aplicación de la teoría de la evolución por selección natural, procurando extender el campo de aplicación (...) de la teoría a priori, y sin restricción alguna, al mejor estilo kuhneano. Este trabajo procura elucidar, breve, pero integralmente, las críticas contenidas en el artículo aludido, donde se reconocen objeciones de diversa índole, a saber: empíricas, metodológicas, conceptuales, y pragmáticas, aunque con solapamientos. Se evalúa el filo de algunas de ellas, y se estipula la utilidad potencial que elucidaciones conceptuales como las que se ofrecen aquí pueden tener para con la filosofía de la biología. (shrink)

Austere relationism rejects the orthodox analysis of hallucinations and illusions as incorrect perceptual representations. In this article, I argue that illusions of optimal motion present a serious challenge for this view. First, I submit that austere-relationist accounts of misleading experiences cannot be adapted to account for IOMs. Second, I show that any attempt at elucidating IOMs within an austere-relationist framework undermines the claim that perceptual experiences fundamentally involve relations to mind-independent objects. It is widely assumed that perception is a source of reasons (SR). There is a weak sense in which this claim is trivially true: even if one characterizes perception in purely causal terms, perceptual beliefs originate from the mind's interaction with the world. When philosophers argue for (SR), however, they have a stronger view in mind: they claim that perception provides pre- or non-doxastic reasons for belief. In this article I examine some ways of developing this view and criticize them. (...) I exploit these results to formulate a series of constraints that a satisfactory account of the epistemic role of perception should fulfil. I also make a positive suggestion: coherentists are right when they claim that only beliefs can be reasons for other beliefs. Nevertheless, I depart from traditional coherentism, for I do not buy its conception of perception as bare sensation, nor explicate the justificatory status of beliefs in terms of coherence. My point is rather that, when one invokes experience to justify a belief, the justifying state must have structural features of beliefs. (shrink)

:In this essay, I present an account of forgiveness as a process of emotional distancing. The central claim is that, understood in these terms, forgiveness does not require a change in judgment. Rationally forgiving someone, in other words, does not require that one judges the significance of the wrongdoing differently or that one comes to the conclusion that the attitudes behind it have changed in a favorable way. The model shows in what sense forgiving is inherently social, shows why we (...) should be pluralists about it, and provides a basis for arguing against the existence of necessary conditions of forgiving. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. The scientific revolution of the XVII siècle is normally described as erasing final causes and the teleology of physics. Nevertheless, the functional language plays a central role in certain areas of biological practice. This is why many philosophers have tried to explicate the concept of function, sometimes to defend the relevance of its use, some other times to show that it is merely a way of speaking that could be easily eliminated without any relevant information loss. The principal purpose of (...) this paper is to show the necessity of appealing to functional concepts for an adequate reconstruction of the Darwinian natural selection theory. Thus, functional language is used in the conceptualization of the theory’s domain of application, and that domain should be determined independently of the natural selection theory. (shrink)

The rule account of self-conscious thought holds that a thought is self-conscious if and only if it contains a token of a concept-type that is governed by a reflexive rule. An account along these lines was discussed in the late 70s. Nevertheless, very few philosophers endorse it nowadays. I shall argue that this summary dismissal is partly unjustified. There is one version of the rule account that can explain a key epistemic property of self-conscious thoughts: Guarantee. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. In this paper, I compare the Megarian thesis of Metaphysics IX 3 with other sources on the Megarians in order to clarify two questions: that of the unity and nature of the so-called Megarian school and that of Aristotle’s broader argument in IX 3. I first review the disputed issue of the status of the Megarian school and then examine two hypotheses regarding the identity behind Aristotle’s allusion in IX 3. Third, I explore the connection between Megarianism and Plato’s Euthydemus, (...) a task that helps us to contextualize Aristotle’s anti-Megarian polemic. Lastly, I build on the preceding argument in a re-examination of the Eleatic hypothesis with regard both to the Megarians as a whole and to the thesis that Aristotle transmits. (shrink)

Duties of beneficence are said to allow for leeway to discharge them. By distinguishing between two different types of leeway, Mejia identified three structurally different duties of beneficence. In this Commentary I deploy those distinctions to clarify the nature of a fourth type of duty of beneficence, one prompted by a global pandemic, a duty with a peculiar, and seldom recognized, conceptual logic. I provide some guidelines that should orient managers when they take themselves to be fulfilling such a duty (...) on behalf of shareholders. (shrink)

One of the main highlights from last year’s event was the 2022 Philippine National and Local Elections. The Philippine elections involve a lot of people interaction from poll workers and other deputized agencies. Further, this study explores the lived experiences, challenges, and coping mechanisms of poll watchers during the 2022 Philippine election. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) Filipino workers value a good-paying job and preferred meaningful work. (2) Amidst the experiences and challenges, the (...) poll watchers remain determined and motivated to take part in the seasonal election. (3) Poll watchers must be physically, emotionally, and mentally prepared to participate in this crucial work. Mainly, pollwatching is a self-reliant job. (shrink)

Most human actions are complex, but some of them are basic. Which are these? In this paper, I address this question by invoking slips, a common kind of mistake. The proposal is this: an action is basic if and only if it is not possible to slip in performing it. The argument discusses some well-established results from the psychology of language production in the context of a philosophical theory of action. In the end, the proposed criterion is applied to discuss (...) some well-known theories of basic actions. (shrink)

Philosophers of perception are familiar with the argument from illusion, at least since Hume formulated it to challenge a naïve form of realism. In this paper, I present an analogous argument but in the domain of action. It focuses on slips, a common kind of mistake. But, otherwise, it is structurally similar. The argument challenges some contemporary views about the nature of action inspired by Wittgenstein. The discussion shows how thinking about these common mistakes helps illuminate aspects of human agency (...) that tend to be overlooked whenever too much emphasis is placed on the rationality of human actions. Aunque parece una teoría relativamente simple, la teoría de la selección natural ha traído muchas discusiones al respecto de su reconstrucción. En particular, los autores han tenido dificultades a la hora de elucidar el concepto de aptitud (fitness) adecuadamente. El punto de vista de este trabajo consiste en que para entender adecuadamente esta cuestión, y además, para dar cuenta de manera adecuada de las explicaciones seleccionistas, tanto las dadas por Darwin como sus aplicaciones más actuales, es necesario a la hora (...) de reconstruir la teoría utilizar más conceptos de los que habitualmente se utilizan. En este trabajo se explayará sobre este punto y se presentará una reconstrucción de la teoría en cuestión con las herramientas del estructuralismo metateórico. -/- Title: Structuralist Reconstruction of Natural Selection Theory Abstract: Despite seeming relatively simple Natural Selection Theory has brought up many discussions regarding its reconstruction. In particular, many authors have had difficulties in explicating the concept of fitness. The point of view of this paper is that more concepts are needed in order to, on the one hand, understand more adequately this issue, and on the other hand, to account for selectionist explanations, both Darwin’s and current applications, in an adequate way. Having this in mind, I will offer a reconstruction of Natural Selection Theory using the tools of metatheoretical structuralism. (shrink)

Algunos aspectos de La expresión de las emociones de Charles Darwin pueden resultar intrigantes, pues, en la explicación de cómo tales expresiones se originan, Darwin casi nunca apela a la selección natural. En cambio, apela principalmente a la idea de que movimientos voluntarios se asocian a emociones, volviéndose por hábito innatos e involuntarios al heredarse a la descendencia. Si bien Darwin da varias razones para defender esta explicación, en este trabajo trataré de mostrar que, si se entiende el libro sobre (...) las expresiones en relación con los objetivos explícitos e implícitos de El origen del hombre, el asunto se entiende mejor. En particular, resulta interesante la tesis que Desmond y Moore plantean respecto a la importancia de los ideales antiesclavistas de Darwin a la hora del tratamiento de las razas. Defenderé en este trabajo que el enfoque de Desmond y Moore puede extenderse al libro acerca de las expresiones. Específicamente, estableceré vínculos entre la explicación del origen de las razas y la explicación del origen del rubor.
