This paper examines the extent to which dispute resolvers in customary law systems provide widely understandable justifications for their decisions. The paper first examines the liberal-democratic reasons for the importance of publicity, understood to be wide accessibility of legal justification, by reviewing the uses of publicity in Habermas’ and Rawls’ accounts of the rule of law. Taking examples from Sierra Leone, the paper then argues that customary law systems would benefit from making local dispute resolution practices, such as “begging” from (...) elders, witchcraft, and customary law judgments, more widely accessible. The paper concludes that while legal pluralism is usually taken to be an analytical concept, it may have a normative thrust as well, and that publicity standards would also apply to formal courts in developing countries, which are also typically “defective” along this dimension. This chapter analyzes traditional archetypes of divan literature—‘āşık (lover), ma‘şūk (beloved), and rakīb (opponent)—to show the presence of a dialectical discourse in classical Ottoman divan love poems. In both style and content divan poems display a comprehensive understanding of the postclassical Islamic philosophical conception of dialectic and argumentation theory, known as ādāb al-baḥth wa al-munāẓara. The focus on Ottoman love poetry and argumentation theory in this paper aims to demonstrate how the love poetry that developed in Ottoman (...) culture is more dialectical in form and content than Ottoman literary studies have recognized. This article examines the influence of the Persian mystic poet Hafi z on western poets. Interest in Hafiz started in England in the eighteenth century with the translations of Sir William Jones. In the nineteenth century, the German translation of Baron von HammerPurgstall inspired Goethe to create his masterpiece Westöstliche Divan (West-Eastern Divan). The poetry of Hafiz evoked such passion in Goethe that he referred to him as ‘Saint Hafiz’ and ‘Celestial Friend’. Inspired by Westöstliche Divan, a (...) number of German poets including Rückert and Platen composed volumes of poetry on the model of ghazal, the popular poetic form perfected by Hafi z in Persian literature. Prominent among the German thinkers influenced and fascinated by Hafiz was Friedrich Nietzsche who repeatedly mentioned him in his works. The influence of Hafiz stretched to America in 1838 when Ralph Waldo Emerson read Goethe’s West-Eastern Divan. In Hafiz, Emerson found a man who derived pleasure in the very elements which others found mean. Under the influence of Hafiz’s Saki-nameh or the Book of Wine, he created his finest poem Bacchus which, according to Harold Bloom, set the terms for the dialectic of American poetry. (shrink)

İslam dininin kutsal kitabı olan Kur’an-ı Kerim’in Orta Çağ Hristiyan Batı dünyasında yüzyıllar boyu ön kabullerle incelendiği ve uzun polemiklere konu edildiği bilinmektedir. Kur’an’ın farklı ve nispeten daha objektif okumaları ancak Aydınlanma dönemi sürecin-de kilisenin hegemonyasının kırılması sonrasında mümkün olabilmiştir. Alman şair Jo-hann Wolfgang von Goethe (1749-1832) bu yeni perspektifin en önemli temsilcilerinden biridir. Gençlik yıllarından itibaren Kur’an ile meşgul olan Goethe, farklı meallere ve kaynaklara da müracaat ederek Kur’an hakkında zengin bir bilgi birikimine sahip olmuş-tur. Yapılacak yüzeysel bir inceleme, (...) onun Kur’an ve İslam dünyasından aldığı ilhamları meşhur Doğu-Batı Divanı’nda şiirlerine yansıttığını göstermeye yetecektir. Elinizdeki bu makalede kısaca Kur’anʼın Hristiyan Batı dünyasındaki algısı anlatılacak, ardından Goet-he’nin Kur’an ile olan meşguliyeti ortaya konulacaktır. Stelele neutronice de circa 1,4 mase solare și găurile negre sunt starea finală pentru evoluția stelelor masive. De obicei o gaură neagră într-o galaxie a jucat un rol important în formarea acesteia și a structurilor cosmice aferente. Astfel de corpuri oferă un mecanism eficient pentru emisia de radiații electromagnetice și formarea de microquasari. Accreția poate duce la jeturi relativiste. Singularitățile la care se ajunge în relativitatea generală prin rezolvarea ecuațiilor lui Einstein au fost și încă mai sunt subiectul a numeroase dezbateri științifice: Există sau nu, singularități? Big Bang a fost o singularitate inițială? Dacă singularitățile există, care este ontologia acestora? Este teoria generală a relativității o teorie care și-a arătat limitele în acest caz? În acest eseu argumentez faptul că există singularități, iar teoria generală a relativității, ca de altfel oricare altă teorie științifică din prezent, nu este valabilă (...) în interiorul orizontului evenimentelor. Dar asta nu presupune, așa cum consideră unii oameni de știință, că ea trebuie considerată ca fiind perimată. După o scurtă prezentare a aspectelor specifice din teoria clasică newtoniană și teoria specială a relativității, și o scurtă prezentare a teoriei generale a relativității, în capitolul Ontologia relativității generale prezint aspectele ontologice specifice relativității generale. Următorul capitol, Singularități, este dedicat prezentării singularităților care rezultă în relativitatea generală, a aspectelor specifice ale găurilor negre și orizontul evenimentelor, inclusiv dezbaterea despre Big Bang ca singularitate inițială, și argumentele în favoarea existenței singularităților. În Ontologia singularităților vorbesc despre posibilitățile de încadrare ontologică a singularităților în general și a găurilor negre în special, despre argumentul găurii pus în evidență de Einstein, și argumentele prezentate de oamenii de știință că nu există singularități și deci că teoria generală a relativității este în impas. Închei cu Concluziile în care expun și reiau pe scurt argumentele care ămi susțin opiniile prezentate mai sus. This article investigates how Max Weber’s theory of value conflict is connected to his realist understanding of politics and how he conceives the relation of politics and ethics. This investigation also covers Weber’s views on the argumentative limits of the social sciences and ethics. The center of Weber’s philosophy of science is constituted by his methodological thoughts on “ethical neutrality” (Wertfreiheit) of the social sciences. The first thesis of this paper contends that Weber’s theory of a clash of irreconcilable values (...) and ideals goes back to Nietzsche. According to the second thesis of the article, the general claim of Weber’s philosophy of science is that there is no possibility of an ultimate rational, philosophical, or scientific grounding of values and normative theories. Weber’s endorsement of an ethics of responsibility in the field of politics led to the criticism that he contradicts his postulate of the “ethical neutrality” (Wertfreiheit) of the scientist. The third thesis of the paper claims that Weber’s arguments for a political ethics of responsibility are compatible with his methodological postulate. (shrink)
