The context for biological emergence is modular hierarchical structures; their existence is what enables functional complexity to arise. Because of the openness of organisms to their environment, complete initial data (position, momentum) of all particles making up their structure is insufficient to determine future outcomes, because unpredictable new matter, energy, and information impacts each organism from the exterior. Consequently, through Darwinian evolution, life has developed processes to handle this issue functionally on short time scales as well on longer developmental timescales. (...) Symbolism and technology are the transforming factors handling this issue at the social levels, which is where the most sophisticated outcomes of openness occur. Considering the cosmological context, the issue is, should the universe itself be regarded as an open system over time? I make the case that is indeed so, because radically new outcomes occur such as the existence of aircraft, iPads, and the internet, which could not plausibly have been encoded in some form of data on the Last Scattering Surface in the expanding universe. This paper summarizes (in German) recent tendencies in the philosophy of the life sciences.

As populations grow and arable land becomes increasingly scarce, large-scale long- term land leases are signed at a growing rate. Countries and investors with large amounts of financial resources and a strong agricultural industry seek long-term land leases for agricultural exploitation or investment purposes. Leaders of financially poorer countries often advertise such deals as a fast way to attract foreign capital. Much has been said about the short-term social costs these types of leases involve, however, less has been said about (...) the normative dimension of their long-term environmental impact. We therefore will focus on the likely impact such deals have for soil conservation, by (1) briefly introducing the basics of long-term leasing arrangements by comparing land leases to the renting of buildings, (2) explaining from a soil sciences perspective the difficulties in assessing the current value of an estate and in calculating the damages of soil erosion and degradation, and (3) show how difficult it is to incentivize the conservation of soil quality when one cannot sufficiently and cost-effectively valorize existing environmental capital and eventual future damages. Attempting to oblige tenants through contracts to invest in sustainable stewardship has limited potential when liability payments do not reflect true costs and are hard to enforce. (shrink)

Unter dem Dach der Philosophie gingen empirische Forschung und normative Theorie lange Zeit Hand in Hand, bis sie spätestens um die Zeit der Emanzipation der Einzelwissenschaften in eine schwierige, nicht immer eindeutig bestimmbare Beziehung zueinander traten; dieses unterbestimmte Verhältnis tritt uns vor dem Hintergrund aktueller Debatten wieder entgegen. Das zeigt sich zum Beispiel auch bei Fragen der Ethik: In den letzten Jahrzehnten zeigten verschiedene wissenschaftliche Disziplinen verstärktes Interesse an empirischen Bemühungen um ein deskriptives Verständnis von Moral. Hier gibt es nach (...) wie vor eine starke Trennung zwischen den Bereichen der normativen Theorie einerseits und der empirischen Forschung andererseits, wobei in beiden Bereichen dazu tendiert wird, die jeweils anderen Diskurse zu vernachlässigen, wobei Unklarheit über die Möglichkeiten und Grenzen einer fruchtbaren Integration herrscht. Auf der anderen Seite gibt es jüngst auch verschiedene Versuche einer Integration beider Domänen. – Dies macht einen Diskurs über die Bestimmung des Verhältnisses von empirischer Forschung und normativer Theorie nötig, was in diesem Band aus verschiedenen historischen sowie systematischen Perspektiven geleistet wird. Arguments are given against the thesis that properties and propositional functions are identical. The first shows that the familiar extensional treatment of propositional functions -- that, for all x, if f(x) = g(x), then f = g -- must be abandoned. Second, given the usual assumptions of propositional-function semantics, various propositional functions (e.g., constant functions) are shown not to be properties. Third, novel examples are given to show that, if properties were identified with propositional functions, crucial fine-grained intensional distinctions would (...) be lost. (shrink)

After a brief history of Brentano's thesis of intentionality, it is argued that intentionality presents a serious problem for materialism. First, it is shown that, if no general materialist analysis (or reduction) of intentionality is possible, then intentional phenomena would have in common at least one nonphysical property, namely, their intentionality. A general analysis of intentionality is then suggested. Finally, it is argued that any satisfactory general analysis of intentionality must share with this analysis a feature which entails the existence (...) of a nonphysical "level of organization". This paper begins with a brief summary of the Self-consciousness Argument, developed in the author’s paper “Self-consciousness.” (This argument is designed to refute the extant versions of functionalism -- American functionalism, Australian functionalism, and language-of-thought functionalism.) After this summary is given, two thesis are defended. The first is that the Self-consciousness Argument is not guilty of a Fregean equivocation regarding embedded occurrences of mental predicates, as has been suggested by many commentators, including Mark McCullagh. The second thesis is that the (...) Self-consciousness Argument cannot be avoided by weakening the psychological theory upon which Ramsified functional definitions are based. Specifically, it does no good to excise psychological principles involving embedded mental predicates. Why? Because functional definitions based on the resulting sparse theories are exposed to an interesting new family of counterexamples. (shrink)

The history of holography, the technology of three-dimensional imaging that grew rapidly during the 1960s, has been written primarily by its historical actors and, like many new inventions, its concepts and activities became surrounded by myths and myth-making. The first historical account was disseminated by the central character of this paper, George W. Stroke, while a professor of Electrical Engineering at the University of Michigan. His claims embroiled several workers active in the field of holography and information processing during the (...) 1960s, but transcended personality conflicts: they influenced the early historiography of holography and the awarding of the Nobel Prize for Physics to Dennis Gabor in 1971. An extended discussion of these episodes, based on archival research, publications analysis and interviews with participants, reveals the importance and extraordinary allure of intellectual priority for practicing scientists, and how its history and explanations are woven from multiple accounts and contemporary interpretations. Schelling was the author. No one has read this book for errors. As always, any errors, mistakes or oversights etc. are mine alone. Given a couple more years, I could improve this book. This is a philosophical translation and not a philological translation. Martin Luther who did the famous early translation of the Bible into German wrote in a letter, “If anyone does not like my translation, they can ignore it… (September 15, 1530)”. There are no ‘correct’ translations. Some are just better than other translations. -/- The Oldest Systematic Program of German Idealism. The German title is: Das Älteste Systemprogramm Des Deutschen Idealismus. This title was made up by Franz Rosenzweig in 1917, when he first published the manuscript. He found the manuscript in the Royal Library in Berlin in 1913. The manuscript suggested date is around 1796 and was done by handwriting research. However, the manuscript is not dated. The Prussian State Library auctioned in March 1913 from the auction of the house Liepmannssohn in Berlin a single sheet on the front and back with Hegel's cursive handwriting. The manuscript was lost during WWII. But Dieter Henrich found it again in 1979 in the “Biblioteka Jagiellonska” in Krakow (Poland), where it is today. Address: Jagiellonian Library, Jagiellonian University, al. Mickiewicza 22, 30-059 Cracow, Poland. Later research suggests that manuscript had come from the estate of Hegel’s student Friedrich Christoph Förster (1791-1868). He was one of the editors of Hegel’s posthumous works and most likely had access to a number of Hegel’s manuscripts. This text actually being one of them. Hegel traveled around Bohemia with Marie and Friedrich Christoph Förster around the year 1820-21 (see Klaus Vieweg). -/- Philosophical mystery -- who is the author or authors of this text? -/- Take a plunge into the deep and cold waters. Maybe a quagmire or quandary, but decidedly interesting. This project is to contextualize an old handwritten manuscript which is about 225 years old. The actual author is a mystery. I offer my own assessment. You can make your own assessments. The mystery has continued to unfold since 1917. There is plenty to read. Otherwise, think about the authorship and read more of the German philosophers and authors from this period and enjoy the depth of thinking and philosophizing. On one hand, there is just the sheer fun in the puzzle of the authorship questions; and on the other hand, these are the alluring thoughts that lead to the nascent stage of German Idealism and our intellectual heritage. There is no end to the accolades for this group of philosophers. A heritage that we still hear in in our attempts to move forward into our future. -/- Do your own astute exegesis (ἐξήγησις) as all paths are still open. Good old-fashioned cognitive science characterizes human thinking as symbol manipulation qua computation and therefore emphasizes the processing of symbolic representations as a necessary if not sufficient condition for “general intelligent action.” Recent alternative conceptions of human thinking tend to deemphasize if not altogether eschew the notion of representation. The present paper shows how classical American pragmatist conceptions of human thinking can successfully avoid either of these extremes, replacing old-fashioned conceptions of representation with one that characterizes both representatum and representans in (...) externalist terms. Usually regarded as a 1970s phenomenon, this article demonstrates that the debate between Jürgen Habermas and Niklas Luhmann continued until Luhmann’s death in 1998, and that the development of the two theorists’ positions during the 1980s and 1990s was characterised by convergence rather than by divergence. In the realm of legal theory, the article suggests, convergence advanced to the extent that Habermas’ discourse theory may be characterised as a normative superstructure to Luhmann’s descriptive theory of society. It is further shown (...) that the debate’s result was an almost complete absorption of Habermas’ theory by Luhmann’s systems theoretical complex – an outcome facilitated by Luhmann’s deliberate translation of central Habermasian concepts into systems theoretical concepts. The article argues that both the debate and Habermas’ conversion were made possible because not only Habermas’ but also Luhmann’s work can be considered a further development of the German idealist tradition. What Luhmann did not acknowledge was that this manoeuvre permitted the achievement of Habermas’ normative objectives; nor did he notice that it could eradicate a central flaw in the system theoretical construction, by allowing the context within which distinctions are drawn to be mapped – an issue of pivotal importance for grasping relationships between different social systems, and coordinating them, via the deployment of legal instruments. In this paper, I present and make a critical analysis of the thoughts of the Sierra Leonean philosopher George M. Carew, who is the author of one of the broadest contemporary visions of the political future of Africa. The significance of Carew's views consists mainly in the fact that he points out the importance of the concept of deliberative democracy for the African countries looking after their interests, as now they do not have any effective instruments of acting in the (...) global environment. This paper examines how Descartes’ philosophy was presented and discussed in articles and reviews published in Mind from 1900 to 1947, a period in which this most prestigious British philosophical journal was edited by George F. Stout (until 1920) and then by George E. Moore (from 1921 to 1947). The survey deals with various aspects of the reception of Cartesian philosophy in the journal: articles devoted to several topics of Cartesian thought, critical notices and reviews of the secondary literature, discussions (...) of twentieth-century English translations of Cartesian works. In line with the theoretical character of Mind, most of the interpreters discussed Cartesian philosophy with the aim either of checking its internal consistency or of proving how the Cartesian system might be rendered consistent with its own premises. In this respect, all the themes revolving around the problem of the Cartesian circle attracted the attention of commentators, and the intuitionist foundation of Cartesian theory was analyzed. Descartes’ metaphysics and natural philosophy were often evaluated from the perspective of contemporary philosophical debates, while their original historical context was neglected. Of particular relevance were issues like the mind-body problem, discussed at the beginning of the century in relation to developments in psychology, and the question of the existence of the external world, which was examined from various standpoints, metaphysically, epistemologically and from the point of view of linguistic analysis. Interest in Descartes was shown by many authors from major philosophers (such as Ward, Schiller, Taylor, Broad, Ryle) to lesser known scholars whose profiles and contributions are outlined. Through the angle of the Cartesian presence a sketch emerges of the rich and variegated philosophical scene of British culture in the first half of the twentieth century. (shrink)

Following Michael S. Jones’ call for articles showing the contemporary value of the great 20th century Romanian philosopher Lucian Blaga in various spheres of expertise, I have immediately thought of George F. Steiner’s recently published book, Neanderthals in Plato’s Cave. The evolutionary model forwarded by Steiner draws heavily on philosophical insights provided by Blaga and, although the volume was written for a scientifically-minded public, the author has adopted, updated and expanded some of Blaga’s anthropological perspectives. In our e-mail correspondence, Steiner (...) has acknowledged Blaga’s influence and has enthusiastically endorsed my attempt to review the similarities between some of the postulates of contemporary research in the various disciplines that inform cognitive archaeology – Steiner’s field of expertise – and the conceptual evolutionary/cultural hypothesis outlined in Blaga’s philosophical system. Philosophy has long been seen as a crucial instrument for living a meaningful life. Nonetheless, for more than a decade, systematic philosophical study in Africa has been dominated by a single compound question: Is there an African philosophy, and if so, what is its nature? When it comes to Africa and philosophy, there is a lot of debate about whether or not Africans have a philosophy. Africans have long been accused of being irrational. Some Western scholars’ interpretations of African philosophy (...) may help us comprehend it better. The Aime Cesaire-led Negritude movement, the Harlem Revolution, the South African Apartheid movement, and others are all examples of recent literature expressing opposition to the perspective of black inferiority and various insults directed at black Africans. Some European scholars did accuse Africans of being irrational beings. These claims provided the impetus for the spread of various beliefs and ideologies masquerading as African philosophy. In light of this, the purpose of this essay is to disprove prejudicial claims made against Africans and African philosophy. The works of Western thinkers such as Immanuel Kant, Georg W. F. Hegel, and Lucien Levy-Bruhl would be highlighted. (shrink)

Assim surgia o Império da Alemanha, em 1871. -/- A burguesia industrial não estava preocupada em alterar de modo significativo a estrutura fundiária, e os grandes proprietários, que se encastelaram na burocracia estatal, não permitiram a formulação de uma legislação trabalhista que prejudicasse os interesses da burguesia. Assim se fez uma mudança “por cima”, sem levar em conta os interesses dos trabalhadores urbanos ou rurais. Destacam-se aqui dois importantes soció-logos alemães: Georg Simmel e Max Weber, pela presença no Brasil. Depois, brevemente, falar-se-á aqui da famosa Escola de Frankfurt. -/- 1. Georg Simmel (1858-1918) -/- Nascido em Berlim, Georg Simmel é um pensador difícil de enquadrar em alguma tendência ou campo específico do conhecimento. Vamos ler um trecho do que escreveu sobre ele o sociólogo brasileiro Leopoldo Waizbort: -/- Quem tentar esboçar a fisionomia de Georg Simmel (1858-1918), logo se encontra em meio a dificuldades que são características próprias daquilo que se quer apreender. Simmel sempre postulou para seu próprio pensamento uma mobilidade e uma plasticidade para se adaptar ao seu objeto – uma multiplicidade de direções, uma defesa do fragmento –, que se opõem a toda tentativa de fixação e acabamento, a toda pretensão de sistema. Por isso todos os rótulos que lhe são atribuídos, apesar de possuírem seu teor de verdade, sempre soam tão falsos: vitalismo, relativismo, esteticismo, formalismo, irracionalismo, psicologismo, impressionismo e tantos mais. Disto também é exemplo o fato de Simmel, hoje considerado, ao lado de Max Weber e Ferdinand Tönnies, um dos “pais” da sociologia alemã, não poder ser classificado sem mais como “sociólogo”, sob pena de se perderem várias outras dimensões que são essenciais ao seu pensamento (WAIZBORT, 2000. p. 11). -/- G. Simmel foi o último dos sete filhos de um próspero comerciante judeu convertido ao cristianismo. Com a morte do pai, herdou uma fortuna considerável que lhe permitiu independência para desenvolver a vida acadêmica. Estudou História e Filosofia na Universidade de Berlim, onde foi aluno das mais importantes figuras acadêmicas da época. Em 1881, defendeu uma tese sobre Immanuel Kant e recebeu o título de doutor em Filosofia. Entre 1885 e 1914, lecionou Filosofia, Ética e Sociologia na Universidade de Berlim, mas nunca foi incorporado formalmente à universidade. -/- Ocupou o cargo de professor titular de Filosofia somente em 1914, em Estrasburgo, cidade onde permaneceu até a morte, em 1918. -/- Na virada do século XIX para o século XX na Alemanha, houve uma intensa efervescência filosófica, cultural e artística, cenário em que se desenvolveram a psicanálise, a teoria da relatividade, o positivismo lógico e a música atonal. Nesse cenário, Simmel tornou-se um conferencista muito aclamado e escreveu artigos e ensaios sobre os mais variados temas da Filosofia, como lógica, teoria do conhecimento, ética, estética ou metafísica, além de temas da Psicologia, da Sociologia, da História e da religião. -/- Escreveu também muitas biografias (de Johann Wolfgang von Goethe, de Friedrich Nietzsche, de Immanuel Kant e de Rembrandt, entre outros). -/- Suas obras sociológicas mais importantes são: Da diferenciação social (1890), A filosofia do dinheiro (1907), Sociologia (1908) e Questões fundamentais da Sociologia (1917). Georg Simmel teve influência marcante no desenvolvimento da Sociologia na Alemanha, nos Estados Unidos (em especial na Escola de Chicago) e na França (em Durkheim e seus colaboradores diretos). Suas obras foram traduzidas para o francês e o inglês, muitas vezes antes de ser publicadas em alemão. -/- 2. Max Weber (1864-1920) -/- Max Weber nasceu em 21 de abril de 1864, em Erfurt, e morreu em Munique, em 1920. De família abastada, teve uma educação formal de boa qualidade, o que lhe permitiu uma erudição notável. Com 18 anos, ingressou na Universidade de Heidelberg, onde escolheu como área de concentração o Direito e como correlatas a História, a Filosofia e a Economia. Nessa universidade, teve o primeiro contato com os escritos de Immanuel Kant e com neokantianos, os quais nunca deixou de lado em seus estudos. -/- Em 1889, concluiu o doutorado em Direito Comercial com uma tese sobre a história das sociedades comerciais da Idade Média. Em 1891, defendeu outra tese: A importância da história agrária romana para o direito público e privado. Em 1894, tornou-se professor de Economia na Universidade de Freiburg e, dois anos depois, transferiu-se para a Universidade de Heidelberg. -/- A partir de 1897, acometido de uma depressão profunda, não conseguiu desenvolver as atividades acadêmicas. Entre 1902 e 1903, retomou as atividades intelectuais, mas fora da universidade, pois não tinha condições psicológicas para ministrar aulas. No ano seguinte, tornou-se coeditor do Arquivo de Ciências Sociais, publicação muito importante para o desenvolvimento dos estudos sociológicos na Alemanha. -/- Entre agosto e dezembro de 1904, viajou, com Ferdinand Tönnies e Werner Sombart, aos Estados Unidos, por ocasião da Exposição Universal de Saint-Louis, onde entrou em contato com as igrejas e seitas protestantes daquele país e também com vários escritos de Benjamin Franklin (1706-1790), o que foi fundamental para suas pesquisas sobre a relação entre a ética protestante e o capitalismo. -/- Em 1907, recebeu uma herança significativa. A partir de então, dedicou-se exclusivamente à investigação histórica e sociológica. Em 1909, colaborou na fundação da Sociedade Alemã de Sociologia. Ao ser deflagrada a Primeira Guerra Mundial, em 1914, Weber foi convocado como oficial da reserva para dirigir um hospital militar. Entre as atividades no hospital encontrou tempo para continuar a escrever partes do livro que foi publicado postumamente por sua esposa, com o título Economia e sociedade. Além disso, desenvolveu estudos sobre ética econômica e as religiões universais e escreveu uma série de artigos para os grandes jornais da Alemanha. Nesses artigos, criticou a estrutura partidária do país e a burocratização das esferas políticas na Alemanha, afirmando que aquela situação ainda era a herança de Otto von Bismarck. -/- Em 1917, pronunciou uma conferência – A ciência como vocação – e produziu um escrito, no qual explicitou seu método – Ensaio sobre neutralidade axiológica nas ciências sociológicas e econômicas. -/- Pelas ideias expostas em debates e nos jornais e por sua erudição, Max Weber, após a derrota alemã na Primeira Guerra Mundial, fez parte da comissão que redigiu, em 1919, a nova constituição política alemã, conhecida como a Constituição de Weimar. -/- Pode-se afirmar que a vida de Max Weber foi dedicada aos estudos, à pesquisa e à participação ativa na política alemã de seu tempo, por meio de conferências e artigos para jornais e revistas. -/- Weber não media esforços para analisar e com-preender mais profundamente os temas que elegia. Aprendeu grego e hebraico para ler a Bíblia no original, espanhol para ler os documentos sobre as companhias de navegação e comércio espanhol, russo para ler os jornais sobre os acontecimentos na Rússia de 1905 até a revolução de 1917, inglês para ler os textos estadunidenses sobre a vida religiosa e a ética dos protestantes. -/- Para Max Weber, o indivíduo é o núcleo de análise por ser o único que pode definir intenções e finalidades para seus atos. Desse modo, o ponto de partida da Sociologia é a compreensão da ação dos indivíduos, atuando e vivenciando situações sociais com determinadas motivações e intenções. Instituições como Estado e família só ganham sentido quando vistas da perspectiva das relações sociais. Assim, Max Weber não concebe a sociedade como um bloco, uma estrutura una, mas como uma teia de relações capazes de produzir sentido. -/- A obra de Max Weber é vasta e engloba história, direito e economia, passando pelas questões religiosas, pelos processos burocráticos, pela análise da cidade, da música e, enfim, pela discussão metodológica das ciências humanas e dos conceitos sociológicos. -/- Entre os seus escritos, podemos destacar: A ética protestante e o “espírito” do capitalismo (1904-1905/1920), A ciência como vocação (1917), A política como vocação (1919), Economia e sociedade (1920), História geral da economia (1923) e Ensaios reunidos de sociologia da religião (1917/1920). -/- Outros sociólogos alemães mantiveram-se em atividade após a Primeira Guerra Mundial, como Ferdinand Tönnies, Leopold von Wiese (1876 -1969), Hans Freyer (1887-1969) e Franz Oppenheimer (1864 -1943), que fundou, em 1919, a primeira cátedra de Sociologia na Alemanha, em Frankfurt. -/- 3. A Escola de Frankfurt -/- Logo após a morte de Max Weber, abriu-se um novo horizonte para a Sociologia alemã com a fundação do Instituto de Pesquisa Social, vinculado à Universidade Johann Wolfgang Goethe de Frankfurt, que ficou conhecido como Escola de Frankfurt. Em 1923, um grupo de intelectuais – entre eles Friedrich Pollok (1894-1970), Leo Löwenthal (1900-1993), Karl August Wittfogel (1896-1988), Max Horkheimer (1895-1973) e Theodor Adorno (1903-1969) – desenvolveu uma análise da sociedade contemporânea com base em concepções filosóficas de Immanuel Kant, Friedrich Hegel e Friedrich Nietzsche, em visões sociológicas de Karl Marx e de Max Weber e no pensamento de Sigmund Freud. -/- Os integrantes do grupo de Frankfurt pretendiam desenvolver uma teoria crítica da sociedade capitalista e buscavam explicar fenômenos que iam da análise da personalidade autoritária à indústria cultural. Mantiveram a crítica ao positivismo e ao pragmatismo, procurando demonstrar a necessida-de de refletir sobre as condições que permitiram a emergência do nazismo e sobre o significado dessa ideologia. As reflexões desses intelectuais culminaram com uma crítica à razão instrumental e às formas de controle sobre a sociedade contemporânea. -/- Além dos estudiosos citados, são representantes desse pensamento Walter Benjamin (1892-1940), Erich Fromm (1900-1980) e Herbert Marcuse (1898-1979), entre outros. Todos os integrantes da Escola de Frankfurt precisaram sair da Alema-nha por causa da perseguição nazista. Adorno e Horkheimer voltaram ao país depois do fim da Segunda Guerra Mundial. Abstract Both parties in the active philosophical debate concerning the conceptual character of perception trace their roots back to Kant's account of sensible intuition in the Critique of Pure Reason. This striking fact can be attributed to Kant's tendency both to assert and to deny the involvement of our conceptual capacities in sensible intuition. He appears to waver between these two positions in different passages, and can thus seem thoroughly confused on this issue. But this is not, in fact, the (...) case, for, as I will argue, the appearance of contradiction in his account stems from the failure of some commentators to pay sufficient attention to Kant's developmental approach to philosophy. Although he begins by asserting the independence of intuition, Kant proceeds from this nonconceptualist starting point to reveal a deeper connection between intuitions and concepts. On this reading, Kant's seemingly conflicting claims are actually the result of a careful and deliberate strategy for gradually convincing his readers of the conceptual nature of perception. In the transcendental deduction, the central argument of the Critique of Pure Reason, Kant seeks to secure the objective validity of our basic categories of thought. He distinguishes objective and subjective sides of this argument. The latter side, the subjective deduction, is normally understood as an investigation of our cognitive faculties. It is identified with Kant’s account of a threefold synthesis involved in our cognition of objects of experience, and it is said to precede and ground Kant’s proof of the (...) validity of the categories in the objective deduction. I challenge this standard reading of the subjective deduction, arguing, first, that there is little textual evidence for it, and, second, that it encourages a problematic conception of how the deduction works. In its place, I present a new reading of the subjective deduction. Rather than being a broad investigation of our cognitive faculties, it should be seen as addressing a specific worry that arises in the course of the objective deduction. The latter establishes the need for a necessary connection between our capacities for thinking and being given objects, but Kant acknowledges that his readers might struggle to comprehend how these seemingly independent capacities are coordinated. Even worse, they might well believe that in asserting this necessary connection, Kant’s position amounts to an implausible subjective idealism. The subjective deduction ismeant to allay these concerns by showing that they rest on a misunderstanding of the relation between these faculties. This new reading of the subjective deduction offers a better fit with Kant’s text. It also has broader implications, for it reveals the more philosophically plausible account of our relation to the world as thinkers that Kant is defending – an account that is largely obscured by the standard reading of the subjective deduction. In attempts to compare different distributions with regards to need, so-called “measures of need-based distributive justice” have emerged in recent years. Each of the proposed measures relies on a single dimension of need that is taken into account. This is shown to be problematic since humans experience different kinds of need that appear to be incommensurable. A strategy to deal with this problem is introduced by using multidimensional measures.

Verteilungsgerechtigkeit befasst sich mit der Verteilung von Gütern innerhalb einer Gruppe, wobei verschiedene Verteilungsprinzipien und -ergebnisse als mögliche Ideale einer solchen Verteilung verhandelt werden. Diese normativen Ansätze sind oft rein verbal formuliert, wodurch ihre Anwendung auf unterschiedliche konkrete Verteilungssituationen, die hinsichtlich ihrer Gerechtigkeit beurteilt werden sollen, häufig schwer fällt. Eine Möglichkeit, fein abgestufte Gerechtigkeitsbeurteilungen verschiedener Verteilungen präzise erfassen zu können, besteht in der formalen Modellierung solcher Ideale durch Maße oder Indizes. Die Auswahl eines geeigneten Maßes, das ein gewisses Ideal abbilden (...) soll, muss ihrerseits eine Fundierung erfahren, was durch die Forderung von begründeten Axiomen erreicht werden kann, denen ein Maß genügen soll. In der vorliegenden Arbeit werden solche Axiome für Maße der Verteilungsgerechtigkeit am Beispiel von Bedarfsgerechtigkeit eingeführt. Ferner werden exemplarische Maße der Bedarfsgerechtigkeit vorgestellt. Damit wird für die Beurteilung und Modellierung von Maßen der Verteilungsgerechtigkeit eine erste diskutable Grundlage gelegt. Distributive justice deals with allocations of goods and bads within a group. Different principles and results of distributions are seen as possible ideals. Often those normative approaches are solely framed verbally, which complicates the application to different concrete distribution situations that are supposed to be evaluated in regard to justice. One possibility in order to frame this precisely and to allow for a fine-grained evaluation of justice lies in formal modelling of these ideals by metrics. Choosing a metric that is (...) supposed to map a certain ideal has to be justified. Such justification might be given by demanding specific substantiated axioms, which have to be met by a metric. This paper introduces such axioms for metrics of distributive justice shown by the example of needs-based justice. Furthermore, some exemplary metrics of needs-based justice and a three dimensional method for visualisation of non-comparative justice axioms or evaluations are presented. Therewith, a base worth discussing for the evaluation and modelling of metrics of distributive justice is given. (shrink)

Plato’s tripartite soul plays a central role in his account of justice in the Republic. It thus comes as a surprise to find him apparently abandoning this model at the end of the work, when he suggests that the soul, as immortal, must be simple. I propose a way of reconciling these claims, appealing to neglected features of the city-soul analogy and the argument for the soul’s division. The original true soul, I argue, is partitioned, but in a finer manner (...) than how we encounter it in our everyday lives. (shrink)

Attempts to justify the special moral status of human beings over other animals face a well-known objection: the challenge of marginal cases. If we attempt to ground this special status in the unique rationality of humans, then it becomes difficult to see why nonrational humans should be treated any differently than other, nonhuman animals. We respond to this challenge by turning to the social contract tradition. In particular, we identify an important role for the concept of recognition in attempts to (...) secure rights through a social contract. Recognition, which involves identifying with or seeing ourselves as others, is the key to establishing the scope of justice, and we argue that this scope extends to all humans—even the so-called marginal cases—but not to other animals. If this is correct, then we have a principled reason for why all humans have certain rights that other animals lack. (shrink)

This paper focuses on the history of dzogchen within the heart essence tradition.

Two questions often shape our view of the world. On the one hand, we ask what there is, on the other hand, we ask what there ought to be. Empirical research and normative theory, the methodological traditions concerned with these questions, entered a difficult relationship, from at least as early as around the time of the advent of modern sciences. To this day, there remains a strong separation between the two domains, with both tending to neglect discourses and results from (...) the other. Contrary to a verdict of strict segregation between »is« and »ought«, there are, nowadays, various attempts to integrate both theoretical approaches. This calls for a newly intensified discourse on the relation between empirical research and normative theory. In this volume, scholars from different disciplines – including psychology, sociology, economics, and philosophy – discuss possible desired or undesired influences on, and limits of, the integration of these two approaches. We present a vignette study conducted with a quota sample of the German population (n = 400). Subjects had to redistribute a good between two hypothetical persons who contributed equally to the available amount but differed in quantity needed and the reason for their neediness. On a within-subjects level, we tested for the effects of need, accountability, and resource availability on their third-party distribution decisions. Between subjects, we further varied the kinds of needs: The persons either needed the good as (...) a means to survive, to live a decent life, to participate in society, or to be autonomous. Despite equal productivity, the mean share allocated to the needier person was significantly higher than an equal share. However, this share turned out significantly smaller when the needier person was accountable for needing more than the other. Nonetheless, even if accountable, the needier person still got a share larger than their contribution would suggest. When there was a surplus of resources, the needier person got an even higher share than when resources were scarce. (shrink)

This work examines Kant’s remarkable decision to rewrite the core argument of the first Critique, the Transcendental Deduction of the Categories. I identify a two-part structure common to both versions: first establishing an essential role for the categories in unifying sensible intuitions; and then addressing a worry about how the connection between our faculties asserted in the first part is possible. I employ this structure to show how Kant rewrote the argument, focusing on Kant’s response to the concerns raised in (...) an early review by Johann Schultz. Schultz’s dissatisfaction with the original Deduction lies in its second part, and Kant’s subsequent revisions are focused on providing a better answer to this how-possible question. The new Deduction offers a more direct and convincing account of how our faculties work together to make experience possible. (shrink)

We report the results of a vignette experiment with a quota sample of the German population in which we analyze the interplay between need, equity, and accountability in third-party distributive decisions. We asked subjects to divide firewood between two hypothetical persons who either differ in their need for heat or in their productivity in terms of their ability to chop wood. The experiment systematically varies the persons’ accountability for their neediness as well as for their productivity. We find that subjects (...) distribute significantly fewer logs of wood to persons who are held accountable for their disadvantage. Independently of being held accountable or not, the needier person is always compensated with a share of logs that exceeds her contribution, while the person who contributes less is punished in terms of receiving a share of logs smaller than her need share. Moreover, there is a domain effect in terms of subjects being more sensitive to lower contributions than to greater need. (shrink)

Der Diskurs um den doxastischen Voluntarismus behandelt die Frage, ob es möglich ist, einen Glaubenszustand intentional und mehr oder minder spontan herbeizuführen. Dabei sind historisch verschiedenste Positionen verhandelt worden. Es soll nicht versucht werden, eine Antwort auf die Frage nach der Möglichkeit zu liefern; vielmehr sollen methodische Überlegungen zur Klärung der Frage in den Fokus gerückt werden. Es wird gezeigt, dass die eigentliche Frage präzisierungsbedürftig ist. Exemplarisch wird ein ausgewählter Präzisierungsversuch aus dem zeitgenössischen Diskurs kritisch beleuchtet und ihm wird ein (...) Verständnis der Frage entgegengesetzt, das die Diskussion um die Möglichkeit eines doxastischen Voluntarismus in einen neuen Rahmen einbetten kann. (shrink)
