In many spheres, the law takes the legal concept of causation to correspond to the folk concept (the correspondence assumption). Courts, including the US Supreme Court, tend to insist on the "common understanding" and that which is "natural to say" (Burrage v. United States) when it comes to expressions relating to causation, and frequently refuse to clarify the expression to juries. As recent work in psychology and experimental philosophy has uncovered, lay attributions of causation are susceptible to a great number (...) of unexpected factors, some of which seem rather peripheral to causation. One of those is the norm effect (Knobe & Fraser, 2008): Agents who, in acting as they do, break a salient norm, are more likely to be considered as having caused a certain consequence than when they do not violate a norm. According to some (e.g., Alicke, 1992) this constitutes a bias. According to others (e.g., Sytsma, 2020), the folk concept of causation is sensitive to normative factors, and there’s nothing wrong with that. In this paper, we explore the question whether the norm effect should be considered a bias from the legal perspective on the one hand, and from the psychological perspective on the other. To do this, we test whether norms which are nonpertinent to the consequences or outright silly also impact causation judgements. The data from two preregistered experiments (total N=593) clearly show they do. This, we argue, makes the bias interpretation plausible from the psychological perspective, and both plausible and problematic from the legal perspective. It also shows that the law should abstain from unreflectively assuming conceptual correspondence between legal and ordinary language concepts. (shrink)

Extant research has shown that ordinary causal judgments are sensitive to normative factors. For instance, agents who violate a norm are standardly deemed more causal than norm-conforming agents in identical situations. In this paper, we explore two competing explanations for the Norm Effect: the Responsibility View and the Bias View. According to the former, the Norm Effect arises because ordinary causal judgment is intimately intertwined with moral responsibility. According to the alternative view, the Norm Effect is the result of a (...) blame-driven bias. In a series of five preregistered experiments (N = 2688), we present evidence that predominantly favours the Bias View. In particular, and against predictions made by the Responsibility View, we show that participants deem agents who violate nonpertinent or silly norms – norms that do not relate to the outcome at hand – as more causal, and that this effect cannot be explained in terms of plausible mediators such as the agent’s foreknowledge and desire, or the foreseeability of harm. We close with a discussion regarding the implications of these findings, in as regards the just assessment of proximate cause in the law. (shrink)

A growing body of literature has revealed ordinary causal judgement to be sensitive to normative factors, such that a norm-violating agent is regarded more causal than their non-norm-violating counterpart. In this paper, we explore two competing explanations for this phenomenon: the Responsibility View and the Bias View. The Bias View, but not the Responsibility View, predicts features peripheral to the agent’s responsibility to impact causal attributions. In a series of three preregistered experiments (N = 1162), we present new evidence that (...) the Norm Effect arises from such peripheral features, namely from nonpertinent or entirely silly norm violations. Furthermore, we show that this effect cannot be explained by recourse to the agent’s foreknowledge or desire of the outcome, nor by its foreseeability: the Norm Effect arises even when participants judge the norm-violating agent’s doing as equally foreseeable. When do two sentences say the same thing, that is, express the same content? We defend two-component (2C) semantics: the view that propositional contents comprise (at least) two irreducibly distinct constituents: (1) truth-conditions and (2) subject-matter. We contrast 2C with one-component (1C) semantics, focusing on the view that subject-matter is reducible to truth-conditions. We identify exponents of this view and argue in favor of 2C. An appendix proposes a general formal template for propositional 2C semantics.

When philosophers consider factors compromising autonomy in consent, they often focus solely on the consent-giver’s agential capacities, overlooking the impact of the consent-receiver’s conduct on the consensual character of the activity. In this paper, I argue that valid consent requires justified trust in the consent-receiver to act only within the scope of consent. I call this the Trust Condition (TC), drawing on Katherine Hawley’s commitment account of trust. TC constitutes a belief that the consent-receiver is capable and willing to act (...) as we expect from them. If such trust is not warranted, I argue, consent lacks the appropriate normative grounds. After establishing TC, I explore its application in the sexual arena, asserting that due to the non-contractual dimensions of sexual activity — such as the dynamic nature of sexual desires and the absence of external factors effectively binding sexual partners to the terms of consent—trust is warranted in sexual consent by means of care. I define care as a special sensitivity and attention toward the partner’s will and discuss how this approach leads to safer intimate relationships in practice. (shrink)

In this paper, I discuss a subset of preferences in which a person desires the fulfillment of a choice they have made, even if it involves the violation of their desires, as in rape fantasies. I argue that such cases provide us with a unique insight into personal autonomy from a proceduralist standpoint. In its first part, I analyze some examples in light of Frankfurt's endorsement theory and argue that even when we cannot endorse a practical decision that involves being (...) violated, we nonetheless regard those cases as instances of autonomy. Therefore, autonomy does not necessarily require endorsement. Instead, I propose that the nature of the relevant highest-order volition dictates the procedure that should be established in one’s desire structure for its fulfillment. In the second part, I discuss how an agent may effectively consent to the violation of their decision by another person. Ordinary consent typically refers to actions but fails to communicate one's higher-order desires or commitments. To address this limitation, I propose a practical tool that accomplishes this by signaling shifts in the normative context where the agents are interacting. (shrink)

Israel Gottlieb Canz’s Uberzeugender Beweiß, first published in 1741 and reprinted here in its second, expanded edition stands as his most influential discussion of the soul’s immortality, with one contemporary pronouncing it to be “one of the best [treatments of immortality] that we have.” In this text, Canz seeks to augment and supplement traditional Wolffian proofs by considering, first, the grounds for the soul’s immortality that are contained in its own nature and, second, the grounds for the same that (...) are found in God. In addition, Canz extends his treatment to include a detailed discussion of the souls of children and he offers speculations concerning the soul’s condition in the afterlife. On account of its systematic presentation and original argumentation, Canz’s Beweiß represents a key contribution to Leibniz-Wolffian rational psychology, and through the critical reaction it generated it would help shape the debate concerning the soul’s immortality for years after its original publication. Wang Yangming (1472-1529) and his School of Mind dominated the intellectual world of sixteenth-century Ming China (1368-1644), and his Confucian philosophy has since remained an essential component of East Asian philosophical discourse. Yet, the volume of publications on him in the Western-language literature has consistently paled in comparison to the volume of scholarship on classical Chinese philosophy, modern Chinese philosophy, Buddhism, and Daoism. Studying Wang Yangming: History of a Sinological Field explains the history of writing in the West about the (...) famed Ming dynasty scholar-official. From eighteenth-century French Jesuit books to English-language publications in 2020, this book provides a historical overview and summary of a literature published by scholars attempting to grapple with one of the most influential Confucians in the history of China, East Asia, and the world. Nie Bao 聶豹 (1487–1563) was a Neo-Confucian philosopher and scholar-official of sixteenthcentury Ming China. In his Ming ru xue an 明儒學案 (Case studies of Ming Confucians), Huang Zongxi 黃宗羲 placed him in the Jiangxi (Jiangyou 江右) group of Wang Yangming followers. Nie Bao met the influential founder of the Ming School of Mind in 1526 and was inspired by his teaching of the innate knowing (liangzhi 良知). However, he differed from other followers in his quietist approach to realizing and extending (...) this knowledge. While developing his ideas over the course of two decades, as a holder of the highest civil service examination degree, Nie Bao also held a series of impactful official positions, and earned a reputation for effectiveness and integrity. However, he was also the unwitting victim of factionalism at the Ming court, which led to his imprisonment in 1548. The goal of this article is to provide a sketch of Nie Bao’s political trajectory and intellectual development from his early years until his imprisonment, as well as translation of significant passages pertaining to that trajectory and development. By the time of his imprisonment, Nie Bao had articulated the essential elements of his philosophy of returning to the root (by which he meant silence), and attaining centeredness and, with that, his unique interpretation of his teacher’s central tenet. In this paper I discuss the nature of halakhic facts and I frame the discussion in a broader meta-ethical context. Most of the existing literature on the philosophy of halakha has focused on the contrast between ‘Halakhic Realism’ and ‘Halakhic Nominalism’. This theoretical contrast is vague and includes a wide range of theories. Inspired by the meta-ethical literature, I propose to focus the discussion on views that can be called ‘Halakhic Naturalism’ and ‘Halakhic Non-naturalism’. I present, develop and distinguish between (...) different meanings of 'naturalism' and consider arguments for and against 'Halakhic Naturalism'. The purpose of this paper is twofold: First, to present and demonstrate the fruitful encounter between meta-ethics and the philosophy of halakha. Sentences \(\varphi\) and \(\psi\) are _cognitive synonyms_ for one when they play the same role in one’s cognitive life. The notion is pervasive (Sect. 1 ), but elusive: it is bound to be hyperintensional (Sect. 2 ), but excessive fine-graining would trivialize it and there are reasons for some coarse-graining (Sect. 2.1 ). Conceptual limitations stand in the way of a natural algebra (Sect. 2.2 ), and it should be sensitive to subject matters (Sect. 2.3 ). A cognitively adequate individuation (...) of content may be intransitive (Sect. 3 ) due to ‘dead parrot’ series: sequences of sentences \(\varphi _1, \ldots, \varphi _n\) where adjacent \(\varphi _i\) and \(\varphi _{i+1}\) are cognitive synonyms while \(\varphi _1\) and \(\varphi _n\) are not (Sect. 3.1 ). Finding an intransitive account is hard: Fregean equipollence won’t do (Sect. 3.2 ) and a result by Leitgeb shows that it wouldn’t satisfy a minimal compositionality principle (Sect. 3.3 )._Sed contra_, there are reasons for transitivity, too (Sect. 3.4 ). In a study that goes beyond the ego affirmed by Freudian psychology, David Levin offers an account of personal growth and self-fulfillment based on the development of our capacity for listening. Drawing on the work of Dewey, Piaget, Erikson, and Kohlberg, he uses the vocabulary of phenomenological psychology to distinguish four stages in this developmental process and brings us the significance of these stages for music, psychotherapy, ethics, politics, and ecology. This analysis substantiates his claim that the development of our (...) listening capacity is a process that fits Foucault's conception of a practice of the self, forming our character as social beings and moral agents. Rapid technological advancements such as fMRI have led to the rise of neuroscientific discoveries. Coupled with findings from cognitive psychology, they are claiming to have solved the millennia-old puzzle of moral cognition. If true, our societal structures – and with that the criminal law – would be gravely impacted. This thesis concerns itself with four distinct theories stemming from the disciplines above as to what mechanisms constitute moral judgement: the Stage Model by KOHLBERG, the Universal Moral Grammar Theory by MIKHAIL, (...) the Social Intuitionist Model by HAIDT, and the Dual-Process Theory by GREENE – comparing the findings of the latter to the consequentialist and retributivist theories of punishment present in the American Criminal Law Doctrine. Analysing both a direct (link to deontology) and indirect (link to incompatibilism) approach to discrediting retributivism, I come to the conclusion that while science can have an impact on our morals and thus on the law, the current state of neuroscientific findings are not capable of shattering foundational notions of the criminal law. After being recalled to Beijing in 1510 for evaluation and reassignment in the wake of his two-year exile to Guizhou and his period of service as a magistrate, Wang Yangming was assigned to a succession of posts at the capital that kept him there through 1512. During that short time, he remained disillusioned with the Ming court and high politics and chose to put his energies into fostering a philosophical movement. He believed that by restoring the “way of master-disciple relations (...) and friendship,” he could help propagate the learning of the sages. To that end, he held jiangxue gatherings with colleagues and friends and carried on an active correspondence. In those venues, Wang Yangming engaged others with his ideas about the goal of sagehood, the obstacles to attaining it, and the methods for overcoming those obstacles. The following article reconstructs this critical period in Wang Yangming's philosophical development and the intellectual movement he sought to foster, as well as the status of his philosophy as of this point in time. -/- . Halakha consists of a variety of laws that determine the halakhic status of various actions. Halakhic laws, by their very nature, have a general aspect in that they apply to all similar actions under similar conditions. In this paper, I examine, from a philosophical-analytical point of view, the relationship between the general aspect of the halakhic laws and the fact that these laws apply to particular actions. After the introduction, this paper is divided into three parts. First, I distinguish between (...) two competing theses regarding the "metaphysical order" between the general aspect of halakhic law and its individual cases. The first one, I call 'Halakhic Generalism', according to which the general aspect of Halakhic law has essential precedence. The second one I refer to as 'Halakhic Particularism', according to which the general aspect of the halakhic law is nothing more than a generalization of all its individual cases. In the second part of the paper, I argue that the particularist position has the power to justify a unique and puzzling halakhic principle. According to this principle, in cases of normative over-determination where the same action is forbidden due to two different halakhic laws, then "a prohibition does not apply to a prohibition". Finally, I compare the reasoning I offer for this principle to alternative justifications of said principle. I argue that, compared to the alternatives, the particularist position provides the best explanation for the principle. (shrink)

I offer a new interpretation of Heidegger’s analysis of anxiety in Being and Time as an account of the relationship between individual agents and the public normative practices of their communities. According to a prominent recent interpretation, Heidegger’s discussions of anxiety, death and the “call of conscience” together explain how we can respond to the norms of our practices as reasons and subject them to critical reflection. I argue that this is only part of the story. Anxiety is an occasion (...) for Dasein to take responsibility for its ongoing activity of interpreting the possibilities for living and acting made available by the normative practices of its community, which is presupposed and overlooked from the perspective of everyday Dasein. Public normativity underdetermines Dasein’s conception of what it would mean to take up any of the possibilities available in its world as a way of living its own life. (shrink)

In this essay we argue for the Janus-faced nature of hope. We show that attempts to sanitise the concept of hope either by separating it conceptually from other phenomena such as wishful thinking, or, more generally, by seeking to minimise the negative aspects of hope, do not help us to understand the nature of hope and its functions as regards religion. Drawing on functional accounts of religion from Clifford Geertz and Tamas Pataki, who both—in their different ways—see the function of (...) religion in terms of its capacity to satisfy deep psychological needs, we demonstrate that religion uniquely positions itself with regard to hope’s two faces, simultaneously exploiting positive and negative aspects of hope. The distinctly contemporary proliferation of pornography and hate speech poses a challenge to liberalism's traditional ideal of a 'marketplace of ideas' facilitated by state neutrality about the content of speech. This new study argues that the liberal state ought to depart from neutrality to meet this challenge.

According to the most prominent principle of early modern rationalists, the Principle of Sufficient Reason [PSR], there are no brute facts, hence, there are no facts without any explanation. Contrary to the PSR, some philosophers have argued that divine ideas are brute facts within Leibniz’s metaphysics. In this paper, I argue against brute-fact-theories of divine ideas, especially represented by Samuel Newlands in Leibniz and the Ground of Possibility, and elaborate an alternative Leibnizian theory of divine ideas.

The international protest surrounding the Copenhagen Zoo’s recent decision to kill a healthy giraffe in the name of population management reveals a deep moral tension between contemporary zoological display practices—which induce zoo-goers to view certain animals as individuals, quasi-persons, or friends—and the traditional objectives of zoos, which ask us only to view animals as specimens. I argue that these zoological display practices give rise to moral obligations on the part of zoos to their visitors, and thus ground indirect duties on (...) behalf of zoos to their animals. I conclude that zoos might take on interspecies friendship as a new zoological objective. (shrink)

In Doing Good and Ridding Evil in Ming China: The Political Career of Wang Yangming, George Israel offers an account of this influential Neo-Confucian philosopher’s official career and military campaigns. While his contribution to China’s intellectual history and the outlines of his political life are well known, the relation between his thought and what he did in his capacity as a Ming official has been given less attention. Prior writing on Wang Yangming has passed judgment on his ideas by (...) either idealizing or condemning him for how he treated those he was assigned to govern. Through a detailed reconstruction of his career in the context of issues of empire, ethnicity, and violence, George Israel demonstrates that the truth lies somewhere in the middle. (shrink)

In this paper, we intend to promote an analysis of the use of the artificial language Heptapod B in Story of Your Life written by Ted Chiang and in its filmic adaptation, Arrival, written by Eric Heisserer and directed by Denis Villeneuve in relation to the authors’ views on the metaphysics of time. In both literary and filmic texts, the glossopoeia is used as a plot device upon which the alien race’s time perception is constructed and explicated in connexion with (...) the strong metaphor provided by Fermat’s principle of least time. Throughout the article, we discuss these hybrid interfaces of literature, cinema and science, researching the stories’ specific diegeses, the writers’ own elicitations as well as various texts on the Philosophy of time. The result consists of a comprehensive exegesis of the problematics generated by the narratives and an extensive philosophical debate on the subject. (shrink)

Constructivism is a philosophical current that manifests itself greatly within the realm of contemporary epistemology. Its bases come from the idea that knowledge is not only actively constructed by the observer but also provides a lens through which reality can be interpreted as a result of experiences. This paper traces a brief interdisciplinary curve that outlines some of the most important philosophical approaches that contributed to the consolidation of this school of thought for more than twenty-five centuries.

Human mind has undergone a complex evolution throughout the history of our genus, Homo. The brain structures and processes that make this mental activity possible have been the result of a series of evolutionary patterns not only biological but also cultural, so it is possible to assume that consciousness did not emerge with the same characteristics in our predecessors. One of the most distinctive features that reflects the conscious image of the archaic man is the absence of a dualistic interpretation (...) of reality. This apparition stem from our analytical mind as an exaptation, commonly assigned to the activity of the left hemisphere which is attributed to play a greater role in linguistic activity. This paper introduces the idea that, along with other abilities such as linguistic predisposition, spatial perception and pattern recognition, human beings are also born with an innate tendency to interpret and represent the surrounding world in antithetical terms, that is, in antinomies. The idea of Self as an exaptation arises from the cultural development of our species closely influenced by the ripening of our cognitive structures and the evolution of human natural language. This illusory perception of Self also conditions scientific activity, giving birth to a new form of knowledge that attributes a new value judgment to man and life. (shrink)

Respect for victims requires that we have social systems for punishing and condemning (reproving) serious crimes. But, the conditions of social marginalization and political subordination of the communities from which an overwhelming number of prisoners in the United States come place serious barriers in the face of effective reprobation. Mass incarceration makes this problem worse by disrupting and disrespecting entire communities. While humanities education in the prisons is far from a total solution, it is one way to make reprobation meaningful, (...) so long as the prison classroom is a place where the educators’ values are also put at risk. Contemporary egalitarian liberals—unlike their classical counterparts—have lived through many contentious events where the right to freedom of expression has been tested to its limits—the Skokie, Illinois, skinhead marches, hate speech incidents on college campuses, Internet pornography and hate speech sites, Holocaust deniers, and cross-burners, to name just a few. Despite this contemporary tumult, freedom of expression has been nearly unanimously affirmed in both the U.S. jurisprudence and philosophical discourse. In what follows, I will examine Ronald Dworkin's influential contemporary justification for (...) freedom of expression, which claims that a thoroughgoing right to freedom of expression is justified by the fact that it guarantees and preserves liberalism's commitment to equality by offering everyone an opportunity to speak, whereas any other policy, such as state regulation, would fail to offer this equal opportunity. This justification has been challenged by feminists and critical race theorists, who find the cases of pornography and hate speech to be sufficient threats to the freedom of expression and equality of their targets—women and minorities—to warrant limiting freedom of expression in these cases. I will argue that if Dworkin is to take equality as seriously as he claims to, then, by his own lights, he must back away from an unrestricted freedom of expression, in light of these distinctly contemporary challenges of the harms of systemic racism and sexism, which underlie hate speech and pornography. 24 undergraduates were blindfolded and walked through paths laid out on a floor to investigate whether the orientation of Ss' cognitive maps (CMs) could be determined after they had learned a path by walking through it. Given the assumption that the CM is picturelike, it was predicted that it has a specific orientation, which implies that tests in which the CM is assumed to be aligned with the path should be less difficult than tests in which the CM is hypothesized (...) to be contraligned. In Exp I (8 Ss), Ss were required to draw a picture of the path they had walked through; in Exp II (14 Ss), Ss were required to locate targets in the path under conditions in which their presumed CMs were either aligned or contraligned with the path. Results show that, in Exp I, all Ss drew the 1st line segment of the path upward, suggesting that this part of the path was fixed in an upward direction in memory. In Exp II, Ss were more accurate and faster in locating points on the path when the CM was hypothesized to be aligned with the path than when it was hypothesized to be contraligned. (shrink)

How children seek knowledge and evaluate claims may depend on their understanding of the source of knowledge. What shifts in their understandings about why scientists might disagree and how claims about the state of the world are justified? Until about the age of 41/2, knowledge is seen as self-evident. Children believe that knowledge of reality comes directly through our senses and what others tell us. They appeal to these external sources in order to know. The attainment of Theory of Mind (...) (ToM) at this age is commonly seen as the significant shift in development in understanding disagreements in knowledge claims. Children attaining ToM understand that someone exposed to incorrect or incomplete information might have false beliefs. Disagreement, then, is still attributed to objective sources of knowledge. The current study examines the later developing Interpretive Theory of Mind (iToM) as the basis for children’s understanding of how people with access to the same information might disagree and what this means for how to provide justification for a knowledge claim. Fourteen 2nd graders with the most iToM responses to four tasks and 14 with the fewest iToM responses were selected from a larger sample of 91. In analyses of interviews about a story in which two experts make different claims about a scientific phenomenon, those in the high iToM group noted subjective perspective and processes as the source of disagreement and suggested the need for investigation as the means to knowing. In contrast, those in the low iToM group mostly could not explain the source of disagreement and held that knowledge is acquired from external sources. A comparison of the interviews regarding the science story 2 years later allows for a qualitative description of the development. Those in the low iToM group showed more general recognition of subjective and constructive processes in knowing whereas those in the high iToM group identified interpretive processes and the relativity of perspectives with implications for how observations were conducted and interpreted. Only those in the high iToM group referred to the importance of evidence as a basis for knowledge claims at either point in the study. (shrink)

We investigate the causal uncertainty surrounding the flash crash in the U.S. Treasury bond market on October 15, 2014, and the unresolved concern that no clear link has been identified between the start of the flash crash at 9:33 and the opening of the U.S. equity market at 9:30. We consider the contributory effect of mini flash crashes in equity markets, and find that the number of equity mini flash crashes in the three-minute window between market open and the Treasury (...) Flash Crash was 2.6 times larger than the number experienced in any other three-minute window in the prior ten weekdays. We argue that (a) this statistically significant finding suggests that mini flash crashes in equity markets both predicted and contributed to the October 2014 U.S. Treasury Bond Flash Crash, and (b) mini-flash crashes are important phenomena with negative externalities that deserve much greater scholarly attention. Para el constructivismo, la ciencia y la cognición comparten intereses similares. Ambos dominios pueden describirse como dos sistemas entrelazados que se activan mutuamente y se modulan entre sí a través de un lazo interno de retroalimentación, lazo que opera mediante la dinámica interna representativa en el caso de la cognición y mediante la dinámica del desarrollo teórico en el caso de la ciencia. Cada uno de estos dominios —ciencia y cognición— busca generar un marco de interacción adecuado que garantice, por (...) parte de la ciencia, el éxito predictivo a partir de los modelos utilizados en la investigación y, por parte de la cognición, una amplia gama de estrategias funcionalmente exitosas con las que salvaguardar una imagen viable del mundo. Al pensar la ciencia como una extensión de nuestra apertura cognitiva al mundo, el constructivismo adopta la noción de viabilidad, es decir, de ajuste funcional, con el entorno como fundamental en la correcta aproximación al estudio tanto de la cognición como de la modelización, ya que, al igual que ocurre con las estructuras y procesos que conforman la arquitectura cognitiva de cualquier sistema de observación, más o menos evolucionado, los modelos en ciencia se encuentran limitados por su propia estructura teórica, así como por su dinámica operativa. Adoptando el constructivismo como una factible filosofía de la ciencia, este trabajo tiene como objetivo estudiar el fenómeno de la modelización, así como examinar el papel que asumen algunas estrategias tropológicas inherentes a la actividad científica, como la analogía y la metáfora, a la hora de configurar modelos y formular hipótesis y conjeturas que sirven de aproximación para la indagación y el estudio del mundo empírico. This study aimed to determine the significant relationship among student engagement, academic motivation, and academic performance of the Intermediate Level Students of Licup Elementary School. Utilizing descriptive correlational method of research and validated questionnaires in data analysis with Mean, and Pearson Product–Moment of Coefficient Correlation as statistical tools, results shows that there is no significant relationship among the three variables. In addition, results also indicated that the student engagement and academic motivation of the intermediate level students of Licup Elementary School (...) is low, while the Academic Performance of the intermediate students is Very Satisfactory. It was also recommended that future researchers be encouraged to conduct this kind of research in a new location and to set to expand this kind of study. (shrink)

The problem of revisionism, or efforts to deny and censor the incontrovertible history of known genocides, is a growing one. It is now clear that denial is inevitably a phase of the genocidal process, extending far beyond the immediate politically expedient denials of governments who are currently engaging in genocidal massacre or have just recently done so—i.e., the Chinese government's abject denials of the killings of some 5,000 in Tiananmen Square, or the Sri Lanka government's denials of the state-organized massacre (...) of 5,000 Tamil. Denials of genocide continue long after the event by a variety of groups and people, including successor governments or successor enemies of the victim people, such as anti-Semites against Jews, Turks against Armenians, and bigots and celebrants of violence and murder of all sorts. But such denials also occur—and this is the most perplexing fact—among a variety of not obviously malevolent people, including intellectuals who, in the process of calling for a better world, effectively exonerate, support, encourage, and participate in denials of a known genocide, implicitly condoning and even celebrating its occurrence, meanings, and portents for the future. This article is an effort to study and analyze this latter phenomenon, which has been little recognized. Together with previous essays on the psychology of more explicit malevolent denials of genocide, the intention is to generate a broader psychological theory of denials of genocide and revisionism by proposing that there are also a variety of “innocent denials” of the factual reality or significance of known cases of genocide, and a variety of “innocent disavowals of violence” which in truth celebrate the violence. These “innocent denials” join with the well-known explicit bigots in creating a vast panorama of dangerous denials of genocides and implicit calls to new genocides in our world. (shrink)

The debate concerning the scientific or unscientific status of the social sciences and the question of the (in) applicability of the methods of research in the natural sciences to social investigations are still unsettled in Philosophy of the Social Sciences. Some of the questions which are often asked concerning these issues include: are the social sciences really scientific? Do they merit the name science? Can we apply the same methods used in the natural research to social research? Are the objects (...) of inquiry in both areas the same? Attempts to answer these questions and numerous related others, have polarized Philosophers of the social sciences into two different ideological camps. Those who answer the questions affirmatively are regarded as the naturalists while those who answer negatively are regarded as the anti-naturalists or humanists. However, using the methods of critical argumentation and conceptual clarification, we intend to argue in this paper for a complementary ground between the two. Consequently, we contend that though the methods of the natural and the social sciences are different due to the fact that their respective objects of investigations are not the same, methods of the two fields are imperative to inquiries that would promote human knowledge and aid their intellectual development. This is necessary in order to foster interdisciplinary research and de-compartmentalisation of disciplines. We also intend to argue that the view that the social sciences are not scientific arose from a narrow conception of the term “science.” Our submission, therefore, is that the social sciences, legitimately, are sciences in their own right. The problem of evil is a perennial issue in metaphysics, philosophy of religion and theology. In Yorùbá thought, it has been approached, appraised, and conceptualised by scholars from different perspectives, usually in the form of thesis and antithesis. For instance, Ẹ̀bùn Odùwọlé and Kazeem Fáyẹmí disagree on whether or not the problem arises in Yorùbá thought and on its nature or formulation, if it does. Relying on the Western logical formulation of the problem, Odùwọlé maintains that the problem of evil (...) arises in Yorùbá thought exactly like it does in Western thought; hence, for her, the problem of evil is universal. Against this view, Fáyẹmí contends that the philosophical problem of evil does not arise at all in Yorùbá thought; hence, the problem, according to him, is not universal. Employing the methods of critical exposition and analysis, however, I maintain a position different from those of the two scholars mentioned. I contend, on the one hand, that the existence of the philosophical problem of evil in Yorùbá thought does not necessarily imply the logical formulation of the problem as we have in the West. On the other hand, however, I maintain that the absence of the logical formulation of the problem of evil in Yorùbá thought does not directly imply the absence of the philosophical problem of evil in it. I therefore approach the interpretation of the philosophical problem of evil in Yorùbá thought from an existentialist perspective, drawing insights from some relevant verses of Ifá. -/- . (shrink)

The study investigated the management of students’ academic failure among secondary school students for high productivity in Obingwa Local Government Area of Abia State. The study was guided by two research questions and two hypotheses. Descriptive survey research design was used while the population of the study comprised thirty public secondary schools. A sample size of 10 secondary schools was selected from the 30 public secondary schools using stratified random sampling technique. Self-designed instrument entitled “Management Students’ Academic Failure Questionnaire” (MSAFQ) (...) was utilized. The validity of the instrument was ensured. Test retest method was used and reliability co-efficient of 0.80 and 0.83 was obtained through Cronbach Alpha Statistics. Mean was used to answer the research questions while Z-test statistics was used to test the hypotheses at 0.05 level of significant. The findings include but not limited to: lack of instructional material and inability of the teachers to stimulate students are causes of academic failures among students. It is therefore recommended that the government or appropriate agency should ensure adequate supply of functional instructional resources and teachers’ should do well to motivate students to learn thereby save students from incessant failures that could mar their future and life expectations. This article reintroduces Fr. Zeferino González, OP (1831-1894) to scholars of Church history, philosophy, and cultural heritage. He was an alumnus of the University of Santo Tomás in Manila, a Cardinal, and a champion of the revival of Catholic Philosophy that led to the promulgation of Leo XIII’s encyclical Aeterni Patris. Specifically, this essay presents, firstly, the Cardinal’s biography in the context of his experience as a missionary in the Far East; secondly, the intellectual tradition in Santo Tomás in Manila, (...) which he carried with him until his death; and lastly, some reasons for his once-radiant memory to slip into an undeserved forgetfulness. The choice of this topic is a curious one, perhaps, for art seems to be such a personal creation that even its appreciation may be relative and most of the time considered as subjective or reliant on impressions. Whether this idea is rightfully founded or not is reviewed in this paper: Is art’s meaning simply an impression? Does it come to exist merely because of whims and ecstasies? Is the experience of art such that it cannot but be dominated by (...) personal ideas? In answering these questions, I present a synthesis of some of the works of Jacques Maritain (1882–1973), a Thomist who has important insights concerning aesthetic experience. -/- Since the experience of art starts from its causes to the work’s appreciation by other people, the progression of this discussion is presented as follows: first, the concept of inspiration, to which artists usually attribute their creations, is assessed; then the aesthetic experience is reviewed to understand art’s qualities; and finally, the purpose and meaning of the artwork are examined. Philosophers of different cultural traditions have written extensively on the nature of the human being. In the ancient times, Aristotle contended that human beings are not naturally good but are led to be good in the society through education. He also expounded a doctrine of the golden mean, a kind of middle-way philosophy, as a theory on how human beings learn to be good, achieve happiness and live the good life. In the modern times, Hobbes, Locke and Rousseau also provided (...) some political reflections on these topics. Other cultures apart from the West have developed explanations on the nature of human beings. For instance, Confucianism in the East talks about the nature of human beings in their natural conditions and prescribes a middle-way doctrine for the ultimate happiness of human beings in the society. This paper takes a comparative approach to understand the areas of convergence and divergence in the thoughts of Aristotle, Confucius and Rousseau on the middle-way philosophy and the natural goodness of man. This is necessary in order to know the points at which various cultures and philosophical traditions or thought systems in the world can connect and overlap or differ on certain philosophical matters. -/- .
