The subtle and complex relation between Confucianism and modern democracy has long been a controversial issue, and it is now again becoming a topical issue in the process of political modernization in contemporary China. This paper argues that there are some quite basic early Confucian values and principles that are not only compatible with democracy, but also may become the theoretic foundation of modern democracy in China. Early Confucianism considers 'the people's will' as the direct representative of 'Heaven's will', (...) with which it legitimizes political power. Confucian theory of 'human nature is good' endorses equal potential good for every man. These principles can be used in reasoning towards a system of democracy. In terms of decision-making, the Confucian 'Doctrine of the Mean' accords with certain democratic principles. The independent personality and committed individualism advocated by early Confucianism is a required civic merit in a democratic society. These fundamental Confucian principles, through contemporary hermeneutics, may provide a philosophic grounding for democracy and support the construction of a democratic system with a Chinese dimension. To get democracy rooted in the spirit of traditional Chinese culture will benefit the healthy and smooth development of democracy in China. (shrink)

The netherworld marriage or the wedding for dead persons is a folk religious ritual in ancientChina. It is based on ancient Chinese folk belief of afterlife in the netherworld. Through a textual research and investigation based on relevant historical records and other ancient documents, as well as some archeological discoveries, this paper tries to give a brief account of the origin and development of netherworld marriage and its cultural and ideological background in ancient China. It finds that netherworld marriage might (...) originate from human sacrifice in early ancient times, and its name varies in different periods. It has gone through its prevailing in the Tang Dynasty, declining in the Song and Yuan Dynasties, and reviving again in the Ming and Qing Dynasties. During the long history, this custom was generally criticized and condemned by orthodoxy Confucian intellectuals, yet it was practiced and sometimes even prevailed among both noble class and common people, due to its deep root in the folk belief. The paper also intends to clarify some misconceptions and misunderstandings concerning the study of this unique cultural phenomenon. (shrink)

The year 2020 and 2021 have been decimated by the pandemic, leading to outbound vacations largely scrapped. Staycation, a typical domestic journal, has then been adopted by those who are tired of self-isolation for so long. This study aims to explore and assess the drivers exerting impact on attitude of tourists toward staycation and the interrelationship among the research constructs is also examined. A quantitative analysis is employed for evaluating the roles of reduced risk perception, benign envy, and perceived (...) benefits as they exert the effect on attitude toward staycation. An online questionnaire survey was used, and a total of 213 samples were collected from target respondents in Hong Kong, which were still under lockdown at the time of the study. The results of the study showed that reduced risk perception, benign envy as well as perceived benefits will influence tourists’ attitude toward staycation. The managerial and theoretical implications of the results are discussed based on the significant relationships identified in the study. (shrink)

Homework effectiveness has long been a controversial issue for many educators, schools, and parents. Many researchers have tried to prove that homework is not just a nuisance we all have to face throughout the years but really can build character and good for students, like teachers and parents typically say. This bibliometrics review studied 429 documents related to homework in education from the Clarivate Web of Science from 1977 to 2020. This study aims to record the volume, growth pattern (...) of homework literature and identify critical authors, publications, and topics of this knowledge base. The review found that the homework literature has grown remarkably over the past 43 years, with the most cited authors are from the US, Germany, and Portugal. Using co-citation, co-occurrence and bibliographic coupling analysis from the VOSviewer program, this research also indicated significant results and suggestions for future research. The findings showed that homework literature increased gradually in volume, with the most publications originated in the USA, and critical authors were Cooper, Xu, and Trautwein. Additionally, five common research topics were illustrated, namely the effect of homework and its measurement, homework environment, homework tasks and feedback, family involvement in homework, and time and effort. Nghiên cứu này xem xét tác động của du lịch, tiêu thụ năng lượng tái tạo và đổi mới công nghệ lên lượng phát thải CO2 tại Việt Nam trong giai đoạn 1995-2020. Ứng dụng mô hình phân phối trễ tự hồi quy (ARDL) kết hợp với phương pháp kiểm định đường bao về mối quan hệ đồng liên kết, nghiên cứu đã cung cấp các bằng chứng về mối quan hệ giữa các biến số này cả trong dài hạn (...) và ngắn hạn. Kết quả cho thấy, trong ngắn hạn lẫn dài hạn, du lịch có xu hướng làm tăng lượng phát thải CO2, trong khi việc tiêu thụ năng lượng tái tạo giúp giảm lượng phát thải. Đổi mới công nghệ cũng giúp giảm lượng phát thải CO2 ­ trong dài hạn, tuy nhiên chưa có bằng chứng về tác động này trong ngắn hạn. Một số khuyến nghị chính sách cũng được đề xuất dựa vào các kết quả nghiên cứu trên. [This study examines the impact of tourism, renewable energy consumption, and technological innovation on CO2 emissions in Vietnam over the period 1995-2020. Applying the autoregressive distributed lag (ARDL) model combined with the envelope test method on the cointegration relationship, the study has provided evidence of the relationship between these variables over the long term and short term. The results show that, in the short and long term, tourism tends to increase CO2 emissions, while renewable energy consumption helps reduce emissions. Technological innovation also helps reduce CO2 emissions in the long term, but there is no evidence of this impact in the short term. Conscious states—state that there is something it is like to be in—seem both rich or full of detail and ineffable or hard to fully describe or recall. The problem of ineffability, in particular, is a longstanding issue in philosophy that partly motivates the explanatory gap: the belief that consciousness cannot be reduced to underlying physical processes. Here, we provide an information theoretic dynamical systems perspective on the richness and ineffability of consciousness. In our framework, the richness of conscious experience corresponds (...) to the amount of information in a conscious state and ineffability corresponds to the amount of information lost at different stages of processing. We describe how attractor dynamics in working memory would induce impoverished recollections of our original experiences, how the discrete symbolic nature of language is insufficient for describing the rich and high-dimensional structure of experiences, and how similarity in the cognitive function of two individuals relates to improved communicability of their experiences to each other. While our model may not settle all questions relating to the explanatory gap, it makes progress toward a fully physicalist explanation of the richness and ineffability of conscious experience—two important aspects that seem to be part of what makes qualitative character so puzzling. In this paper, I provide a framework for accounting for the self, based on a reconstruction of Galen Strawson’s “theory of SESMETs,” or the Pearl view, with Barry Dainton’s continuous consciousness thesis. I argue that the framework I provide adequately accounts for the self and is preferable to solely adopting either Strawson’s or Dainton’s theory. I call my reconstruction the “Necklace” view of the self.

The feeling (quale) brings the "Hard Problem" to philosophy of mind. Does the subjective feeling have a non-ignorable impact on Intelligence? If so, can the feeling be realized in Artificial Intelligence (AI)? To discuss the problems, we have to figure out what the feeling means, by giving a clear definition. In this paper, we primarily give some mainstream perspectives on the topic of the mind, especially the topic of the feeling (or qualia, subjective experience, etc.). Then, a definition of the (...) feeling is proposed through a thought experiment, the "semi-transparent room". The feeling, roughly to say, is defined as "a tendency of changing input representations by representing its inner state". Also, a formalized definition is given. The definition does not help to verify "having the feeling", but it helps to provide evidence. Based on the definition, we think these are the hard problems of intelligence — whether the "innate" feeling plays an important role in Intelligence, whether the difference between the "simulated" feeling and the "innate" feeling will have a significant influence on Artificial General Intelligence (AGI), and, if so, where the "innate" feeling comes from and how to make an artificial agent possess it. Hui Shi (370-310B.C.E.?) is a unique one among the pre-Qin scholars. The object and orientation of his scholarship emphasized on “chasing after the materials” or the research for objective knowledge of natural things. He shows a tendency of tolerating and advocating diversity and variety, and intentionally pursuing new and unusual ideas. In certain degree he judges the value of knowledge by its truthfulness rather than its usefulness. As pointed out by Wing-tsit Chan, Hui shi represents a “tendency in ancient China (...) toward intellectualism for its own sake”. (shrink)

Introduction: The development of advanced sewage technologies empowers the industry to produce high-quality recycled water, which greatly influences human’s life and health. Thus, this study investigates the mechanism of individuals’ adoption of recycled water from the technology adoption perspective. -/- Methods: Employing the mixed method of structural equation modeling and artificial neural network analysis, we examined a research model developed from the extended Unified Theory of Acceptance and Use of Technology (UTAUT2) framework. To examine the research model, this study employs (...) a leading web-survey company (Sojump) to collect 308 valid samples from the residents in mainland China. -/- Results: The structural equation modeling results verified the associations between the six predictors (performance expectancy, effort expectancy, social influence, facilitating conditions, environmental motivation, and price value), individuals’ cognitive and emotional attitudes, and acceptance intention. The artificial neural network analysis validates and complements the structural equation modeling results by unveiling the importance rank of the significant determinants of the acceptance decisions. -/- Discussion: The study provides theoretical implications for recycled water research and useful insights for practitioners and policymakers to reduce the environmental hazards of water scarcity. Although being widely considered as only a Western tradition, individualism is not absent in traditional Chinese philosophy and culture. In some of the classic Chinese philosophic works such as Zhuangzi, we can clearly identify some elements which can be appropriately attributed to “individualism”, such as the awareness of individual “self” as an independent and unique existence, advocating individual freedom and liberty, emphasizing on the value and dignity of individual life, favoring individuals’ autonomy and privacy, pursuing unconstrained development in personality and (...) spirituality. However, due to its particular pre-Qin social cultural background and its unique Daoist philosophic origin, this kind of individualism in Zhuangzi has its own unique characteristics, which has made it distinguishable from the variety of other individualist thoughts emerged in different times and places in the West. Zhuangzi has a dynamic and open view on individual or “self”, he does not consider individuals as fixed and interchangeable “atoms” but as dynamic, changing and unique beings, he set the unlimited and indefinable Dao as the only and ultimate source for individuals to conform to, thus to release individual mind into an realm of infinite openness and freedom. Zhuangzian individualism is “inward” rather than “outward”, which means while concentrating on individuals’ freedom of spirit and innate nature, it cares less about individuals’ outside material interests and rights in social reality, and does not encourage competition and rivalry among individuals. The special type of individualism in Zhuangzi has a profound influence on Chinese culture, providing a spiritual space for the development of individuality and personality in ancient China. The important feature of Dao as a philosophic category in early Confucian philosophy is its prominent practical and historical properties, which make it different from those western metaphysic categories. Confucianism emphasizes that the Dao can not be separated with the practice and the history of human being, thus the Tao should be explored in peoples’ social activities and history. They believe that the Tao only lives in the historical tradition and can only be demonstrated by the narrative of history. The (...) historical and practical properties of Dao incarnated the unity of epistemology and axiology, and integrated the value of both “Dao” and “De”. The event that King Kuai of Yan demised the crown to his premier Zizhi, is a tentative way of political power transmission happened in the social transforming Warring States Period, which was influenced by the popular theory of Yao and Shun’s demise of that time. However, this tentative was obviously a failure, coming under attacks from all Confucian, Taoist and Legalist scholars. We may understand the development of the thinking concerning the issue of political legitimacy during the Warring States Period (...) by analyzing the different commentaries by different schools on this unusual event, and get some beneficial inspirations. In the Pre-Qin time, pursuing “Dao” was the main task in the scholarship of most of the ancient Chinese philosophers, while the Ancient Greek philosophers considered pursuing “Truth” as their ultimate goal. While the “Dao” in ancient Chinese texts and the “Truth” in ancient Greek philosophic literature do share or cross-cover certain connotations, there are subtle and important differences between the two comparable philosophic concepts. These differences have deep and profound impact on the later development of Chinese and Western philosophy (...) and culture respectively. Interestingly, while the modern Chinese philosophy has gradually accepted and established the Western conception of “Truth” on its way towards modernization, the “post-modern” Western philosophy is just undergoing a process of deconstructing its traditional concept of “Truth”, thus, in a certain sense, going closer to the traditional Chinese “Dao”. From a comparative, relative and dynamic perspective, there could possibly be a fusion of horizon between the Chinese “Dao” and the Western “Truth”. (shrink)

Responsible innovation (RI), also termed Responsible Research and Innovation, has emerged due to increasing concern over how to integrate ethical and societal values into research and innovation policy and governance (Von Schomberg 2013), in response to questioning of the societal role of science as well as populist resurgence in some countries (Long and Blok 2017a). Within a RI approach, innovators must consider three dimensions of responsibility, including the dimensions of (1) ‘avoiding harm’ to people and the planet, (2) ‘doing (...) good’ through the offering of innovations that foster sustainable development, and (3) the development of facilitative global governance schemes (Voegtlin and Scherer 2017). In a gradually more interlinked world, the formation of collaborations with partners is increasingly regarded as an important driver for generating innovation. Although multidimensional proximities are important factors influencing interorganizational coinnovation performance, relevant empirical studies have not reached consistent conclusions. By focusing on organizational dyad and including intraorganizational collaboration network inefficiency as a moderating variable, we explore the effects of multidimensional proximities on interorganizational coinnovation performance. By reference to 5G patent data collected in China between 2011 and 2020, the research (...) results based on the quadratic assignment procedure (QAP) model show that geographical proximity, cognitive proximity, and institutional proximity all improve interorganizational coinnovation performance. Representing the kinetic state of a patient (posture, motion, and activity) during vital sign measurement is an important part of continuous monitoring applications, especially remote monitoring applications. In contextualized vital sign representation, the measurement result is presented in conjunction with salient measurement context metadata. We present an automated annotation system for vital sign measurements that uses ontologies from the Open Biomedical Ontology Foundry (OBO Foundry) to represent the patient’s kinetic state at the time of measurement. The annotation system is applied (...) to data generated by a wearable personal status monitoring (PSM) device. We demonstrate how annotated PSM data can be queried for contextualized vital signs as well as sensor algorithm configuration parameters. (shrink)

This essay examines Gensler's general consistency principle (GR) and its application to the moral permissibility of abortion. The central claim is that applying GR to abortion leads to the conclusion that abortion is morally impermissible. The essay presents two objections to this claim, which challenge the validity of GR and the manner in which it is applied to abortion. The first objection (O1) states that it is impossible to accurately judge the potential of an object to become a rational being, (...) while the second objection (O2) argues that applying GR to abortion involves the invalid use of a set of potential rational beings rather than a specific instance. This work presents a nuanced understanding of broader perception and cognition by examining functional relations, physical dependence, and temporal range. These concepts contribute to a more comprehensive understanding of the complex nature of perception and its connection to external stimuli.

Recent psychological research shown that the places where we live are linked to our personality traits. Geographical aggregation of personalities has been observed in many individualistic nations; notably, the mountainousness is an essential component in understanding regional variances in personality. Could mountainousness therefore also explain the clustering of personality-types in collectivist countries like China? Using a nationwide survey (29,838 participants) in Mainland China, we investigated the relationship between the Big Five personality traits and mountainousness indicators at the provincial level. Multilevel (...) modelling showed significant negative associations between the elevation coefficient of variation (Elevation CV) and the Big Five personality traits, whereas mean elevation (Elevation Mean) and the standard deviation in elevation (Elevation STD) were positively associated with human personalities. Subsequent machine learning analyses showed that, for example, Elevation Mean outperformed other mountainousness indicators regarding correlations with neuroticism, while Elevation CV performed best relative to openness models. Our results mirror some previous findings, such as the positive association between openness and Elevation STD, while also revealing cultural differences, such as the social desirability of people living in China’s mountainous areas. A. A. Long, one of the world's leading writers on ancient philosophy, presents eighteen essays on the philosophers and schools of the Hellenistic and Roman periods--Epicureans, Stoics, and Sceptics. The discussion ranges over four centuries of innovative and challenging thought in ethics and politics, psychology, epistemology, and cosmology.

The current discussions of conceptual schemes and related topics are misguided; for they have been focused too much on the truth-conditional notions of meaning/concepts and translation/interpretation in Tarski's style. It is exactly due to such a Quinean interpretation of the notion of conceptual schemes that the very notion of conceptual schemes falls prey to Davidson's attack. We argue that what should concern us in the discussions of conceptual schemes and related issues, following the initiatives of I. Hacking, T. Kuhn, and (...) N. Rescher, is not the truth-values of assertions, but rather the truthvalue-status of the sentences used to make the assertions. This is because the genuine conceptual innovation between alternative theories/languages does not lie in differences in determining the truth-values of their sentences, but turns on whether these sentences have truth-values when considered within the context of a competing one. The core of conceptual relativism does not consist in the claim that different conceptual schemes may yield incommensurable truth claims, but rather that different conceptual schemes may yield incompatible truth-value-status and therefore lead to distinct perceptions of reality. Conceptual schemes are no longer seen as sentential languages consisting of a set of sentences accepted as true, but rather seen as metaphysical presuppositions of presuppositional languages.[ABSTRACT FROM AUTHOR]. Luck egalitarians argue that distributive justice should be understood in terms of our capacity to be responsible for our choices. Both proponents and critics assume that the theory must rely on a comprehensive conception of responsibility. I respond to luck egalitarianism’s critics by developing a political conception of responsibility that remains agnostic on the metaphysics of free choice. I construct this political conception by developing a novel reading of John Rawls’ distinction between the political and the comprehensive. A surprising consequence (...) is that many responsibility-based objections to luck egalitarianism turn out to be objections to Rawls’ political liberalism as well. (shrink)

What the authors attempt to address in this paper is a Kantian question: not whether, but how is cross -cultural understanding possible? And specifically, what is a more effective approach for cross -cultural understanding? The answer lies in an analysis of two different models of cross -cultural understanding, that is, propositional and hermeneutic understanding. To begin with, the author presents a linguistic interpretation of culture, i.e., a culture as a linguistically formulated and transmitted symbolic system with its conceptual core as (...) a scheme of basic cultural presuppositions, which it referred to as a cultural language. After exploring the essential role of cultural presuppositions in cross -cultural understanding, the author discusses the traditional model of cross -cultural understanding, namely, the propositional model. Through critically examining the two popular versions of the propositional model, i.e., the projective approach and the adoptive approach to cross -cultural understanding, it is found that cross -cultural propositional understanding is doomed to failure. To move us beyond the absolutism -relativism trap embedded within propositional understanding, the author first introduces and discusses Hans-Georg Gadamer’s hermeneutic understanding, and then applies Hans-Georg Gadamer’s hermeneutic model of understanding to cross -cultural understanding. It is finally concluded that cross -cultural understanding is essentially hermeneutic—including the case of cultural learning, not propositional. Therefore, cross -cultural understanding is hermeneutically possible. (shrink)

In his article "Thoughts" (MIND, July 1960) William Ginnane argues that "thought is pure intentionality," and that our thoughts are not embodied essentially in the mental imagery and other elements of phenomenology that cross our minds along with the thoughts. Such images merely illustrate out thoughts. In my discussion I resist this claim pointing out that our thoughts are often embodied in events that can be described in phenomenological terms, especially when our reports of our thinking are introduced by the (...) colorful phrases that Ginnane himself suggests, such as "It crossed my mind that.." or "It occurred to me that…" It is true that we also have a mode of speech in which we report what we have thought in well-formed sentences. Sometimes the very utterance of such sentences is what we call thinking out loud. More often than not, however, our thoughts are fragmentary enough so that if someone asks us what we were thinking, we must stop and rather carefully formulate the expression of those thoughts. In this case there has been nothing running through our minds which can be phenomenologically described as complete sentences, yet in formulating the significance of what has been passing through our minds we do use complete sentences. It is true that one of the confusions we have been bothered by in the past is the idea that in describing the contents of our minds we must somehow find there a proto-type of the report we give in propositional form. The philosopher's phrase "entertaining a proposition" only encourages this confusion, as it looks like an attempt to describe one's mental history phenomenologically. Nevertheless, the successive phenomenological events that occur in our minds often seem to be not merely illustrations accompanying our thoughts, but to embody what we say occurred to us. (shrink)

Some bioethicists argue that a doctor may frame treatment options in terms of effects on survival rather than on mortality in order to influence patients to choose the better option. The debate over such framing typically assumes that the survival and mortality frames convey the same numerical information. However, certain empirical findings contest this numerical equivalence assumption, demonstrating that framing effects may in fact be due to the two frames implying different information about the numerical bounds of survival and mortality (...) rates. In this paper, I use these findings to argue that framing is presumptively wrong because it violates the duty of proper disclosure. Along the way, I highlight morally relevant features affecting the permissibility of framing, tackle three objections and draw some general lessons for the ethics of nudging. (shrink)

I have recently argued that if the causal theory of reference is true, then, on pain of absurdity, no normative ethical theory is true. In this journal, Michael Byron has objected to my reductio by appealing to Frank Jackson’s moral reductionism. The present essay defends reductio while also casting doubt upon Jackson’s moral reductionism.

As part of this effort, the breast-milk substitutes industry is proposing to use renewable gas as a (...) substitute for fossil natural gas. However, decarbonising the industrial processing of breast-milk substitutes can increase social license for these products, potentially undermining breastfeeding. World Health Organisation nutrition targets aim to increase exclusive breastfeeding to at least 50% globally by 2025 to improve maternal, infant, and young child health and nutrition. This target will have implications for the energy transition. A weakness of existing energy models is that demands for end-use products such as breast-milk substitutes are typically not considered explicitly. This paper develops an analytical framework for explicitly representing infant feeding methods in energy systems models. We compare the emissions saved in Ireland from decarbonising the industrial processing of breast-milk substitutes with renewable gas with the emissions saved by an increase in exclusive breastfeeding to 50% in both Ireland and a key export market, China. We demonstrate that the emissions saved from achieving the minimum global breastfeeding target are greater than when renewable gas is used to displace natural gas in the production of breast-milk substitutes in Ireland. We discuss the decarbonisation of breast-milk substitutes in relation to the principle of justice as non-maleficence, a principle based on the commitment to avoid harm, a novel application of a principle of justice. We conclude that breastfeeding support can be considered a demand-side measure for mitigating climate change by reducing the demand for energy services to produce breast-milk substitutes. A key recommendation is to position breastfeeding support as both a public health and a climate justice issue that is relevant for a just transition. The framework developed for this paper could be applied to support the inclusion of a wider range of mitigation options with social justice outcomes in energy system models. [Open access]. (shrink)

This article provides a brief introduction to some contemporary challenges found in the intersection of bioethics and international criminal law involving genetic privacy, organ trafficking, genetic engineering, and cloning. These challenges push us to re-evaluate the question of whether the international criminal law should hold corporations criminally liable. I argue that a minimalist and Strawsonian conception of corporate responsibility could be useful for deterring the wrongs outlined in first few sections and in answering compelling objections to corporate criminal liability.

According to Cian Dorr, non-cognitivism has the implausible implication that arguments like the following are cases of wishful thinking: If lying is wrong, then the souls of liars will be punished in the afterlife; lying is wrong; therefore, the souls of liars will be punished in the afterlife. Dorr further claims that if non-cognitivism implies that the above argument and similar arguments are cases of wishful thinking, then non-cognitivism remains implausible even if one solves the so-called Frege-Geach problem. Dorr’s claims (...) have faced a number of objections, but I believe that Dorr is on to something. So, after summarizing Dorr’s argument and briefly describing three flaws in what Dorr claims, I shall present a distinct objection to non-cognitivism and use the preceding to show what Dorr’s argument gets right and what it gets wrong. Mark White has developed a provocative skepticism about antitrust law. I first argue against three claims that are essential to his argument: the state may legitimately constrain or punish only conduct that violates someone’s rights, the market’s purpose is coordinating and maximizing individual autonomy, and property rights should be completely insulated from democratic deliberation. I then sketch a case that persons might have a right to a competitive market. If so, antitrust law does deal with conduct that violates rights. The (...) main thread running throughout the article is that what counts as a legitimate exercise of property rights is dynamic, sensitive to various external conditions, and is the proper object of democratic deliberation. Berkeley, Hume, and Russell rejected the traditional analysis of substances in terms of qualities which are supported by an "unknowable substratum." To them the proper alternative seemed obvious. Eliminate the substratum in which qualities are alleged to inhere, leaving a bundle of coexisting qualities--a view that we may call the Bundle Theory or BT. But by rejecting only part of the traditional substratum theory instead of replacing it entirely, Bundle Theories perpetuate certain confusions which are found in the Substratum Doctrine. (...) I examine two major types of BT developed by Russell and by G. F. Stout with the intention of showing that (1) the seemingly innocuous concept of "a quality" employed by these versions cannot be used to state their theories coherently, and (2) the fatal problems that the BT encounters point to a more satisfactory and interesting alternative to both the Substratum Doctrine and the BT. This is a view that I call the Qualified Particulars Theory. In a final section I draw morals from this discussion that apply to the analogous Humean view that a mind is a "bundle of perceptions and sensations.". (shrink)

An important source of doubt about our knowledge of the "external world" is the thought that all of our sensory experience could be delusive without our realizing it. Such wholesale questioning of the deliverances of all forms of perception seems to leave no resources for successfully justifying our belief in the existence of an objective world beyond our subjective experiences. I argue that there is there is a fatal flaw in the very expression of philosophical doubt about the "external world." (...) Therefore, no such justification is necessary. The feature of skepticism which I believe renders it vulnerable is the assumption that each of us has a right to be certain of his own existence as a subject of conscious experience even in the face of comprehensive doubt about our empirical beliefs. Responsible innovation (RI), also termed Responsible Research and Innovation, has emerged due to increasing concern over how to integrate ethical and societal values into research and innovation policy and governance (Von Schomberg 2013), in response to questioning of the societal role of science as well as populist resurgence in some countries (Long and Blok 2017a). Within a RI approach, innovators must consider three dimensions of responsibility, including the dimensions of (1) ‘avoiding harm’ to people and the planet, (2) ‘doing (...) good’ through the offering of innovations that foster sustainable development, and (3) the development of facilitative global governance schemes (Voegtlin and Scherer 2017). ChatGPT – a large language model – recently passed the U.S. bar exam. The startling rise and power of generative artificial intelligence (AI) systems such as ChatGPT lead us to consider whether and how more specialized systems could be used to overcome existing barriers to the legal system. Such systems could be employed in either of the two major stages of the pursuit of justice: preliminary information gathering and formal engagement with the state’s legal institutions and professionals. We focus on (...) the former and argue that developing and deploying publicly funded AI legal advisors can reduce economic and shame-based cultural barriers to the information-gathering stage of pursuing justice. The idea that we may continue to exist in a bodiless condition after our death has long played an important role in beliefs about immortality, ultimate rewards and punishments, the transmigration of souls, and the like. There has also been long and heated disagreement about whether the idea of disembodied existence even makes sense, let alone whether anybody can or does survive dissolution of his material form. It may seem doubtful that anything new could be added to the (...) debate at this late date, but I hope to show that this is not so. I will explore the problem of disembodiment from a somewhat different direction than has been tried before, one that leads to what seem to me more interesting and more definite conclusions about its unintelligibility. Furthermore, the approach I will be taking puts both the traditional mind-body problem and the competing claims of dualism and physicalism in a fresh light that can help us to understand better the nature of our embodied existence. In his Meditations Descartes concludes that he is a res cogitans, an unextended entity whose essence is to be conscious. His reasoning in support of the conclusion that he exists entirely distinct from his body has seemed unconvincing to his critics. I attempt to show that the reasoning which he offers in support of his conclusion. although mistaken, is more plausible and his mistakes more interesting than his critics have acknowledged.

I argue in this paper that philosophers have not clearly introduced the concept of a body in terms of which the problem of other minds and its solutions have been traditionally stated; that one can raise fatal objections to attempts to introduce this concept; and that the particular form of the problem of other minds which is stated in terms of the concept is confused and requires no solution. The concept of a "body" which may or may not be the (...) body of a person, which is required to state the traditional problem, is, on close examination, incoherent and cannot be introduced into a reasonable philosophical discussion. I defend the thesis that psychological states can be literally ascribed only to living creatures and not to nonliving machines, such as sophisticated robots. Defenders of machine consciousness do not sufficiently appreciate the importance of the biological nature of a subject for the psychological significance of its behavior. Simulations of a computer-controlled, nonliving autonomous robot cannot carry the same psychological meaning as animate behavior. Being a living creature is an essential link between genuinely expressive behavior and justified psychological ascriptions.

Antony Duff argues that the criminal law’s characteristic function is to hold people responsible. It only has the authority to do this when the person who is called to account, and those who call her to account, share some prior relationship. In systems of domestic criminal law, this relationship is co-citizenship. The polity is the relevant community. In international criminal law, the relevant community is simply the moral community of humanity. I am sympathetic to his community-based analysis, but argue that (...) the moral community must play a greater role in the domestic case and that the collection of individual political communities must play a greater role in the international case. In ‘Measuring the Consequences of Rules’, Holly Smith presents two problems involving the indeterminacy of compliance, which she takes to be fatal for all forms of rule-utilitarianism. In this reply, I attempt to dispel both problems.

This chapter explores the concept and practice of responsible management of innovation. Responsible innovation is a key response to the grand challenges faced by society, helping to develop innovations with society in mind, and limit any unintended consequences. Responsible managers with influence over innovations need knowledge and understanding of how responsible innovation applies to their roles and how as individuals they can manage innovation responsibly. While the application of responsible innovation to these contexts faces a number of practical and conceptual (...) challenges, this chapter will focus on the contribution and potential of responsible management of innovation processes to provide economic and societal benefits. This chapter explores these issues through the perspective of individual managers, at the level of the organisation and finally at the level of the innovation system. (shrink)

As the title of the article suggests, “The Burqa Ban”: Legal Precursors for Denmark, American Experiences and Experiments, and Philosophical and Critical Examinations, the authors embark on a factually investigative as well as a reflective response. More precisely, they use The 2018 Danish “Burqa Ban”: Joining a European Trend and Sending a National Message (published as a concurrent but separate article in this issue of INTERNATIONAL STUDIES JOURNAL) as a platform for further analysis and discussion of different perspectives. These include (...) case-law at the international level while focusing attention on recent rulings and judicial reasoning by the ECtHR and the ECJ; critical thought-experiments in religion, morality, human rights, and the democratic public space; a contextualized account of burqa-wearing interventions by federal and state governments and, moreover, various courts in the United States; and philosophical commentary and, in some instances, criticism of the Danish and/or European (French, etc.) approach. The different contributions have different aims. The section on case-law at the international level reports on those central judgments that, in effect, helped to pave the path for the Kingdom of Denmark’s burqa ban. Concerning the concurring judges at the ECtHR, the opinions served to uphold a preexisting ban and to grant a wide margin of appreciation to the national authorities, thereby limiting the Court’s own review. -/- As regards to the ECJ, the legality of company rules that contain a policy of neutrality for the workplace was examined, with a similar outcome. The authors who discuss religion, morality, human rights and the democratic public space are endeavoring to, respectively, appeal to ethics as a testing stone for law and to both challenge and address several forms of “expressivist worry” in connection with face veils. In doing so, the authors ask a number of thought-provoking questions that hopefully will inspire public policymakers to careful analysis. While the section that is devoted to American perspectives highlights a comprehensive survey of political and legal responses to, in particular, full-face veils like the burqa, the relevant author also incorporates public perceptions and, in the course of examining these, draws a parallel to “the fate” of the hoodie. The constitutionality of burqa-wearing in America, so it also appears, is partially an open question, but differentiating between religious, political, or personal reasons is a de jure premise. Given that the Danish legislators who drafted law L 219 to ban burqa-wearing in public places rely on a reference to political Islam, they relegate religious and personal reasons to the private domain, thereby also adopting secularism as a premise. This is explored in the last author response of the article, more precisely, in an account of the underlying materialism that, in turn, is applied to Muslim women. If policymakers and legislators engaged in Thinking Things Through exercises, they could, as a minimum, avoid law-making strategies that are not in the spirit of the theory they themselves invoke, albeit tacitly. While the aim of, as it were, arresting culturally self-contradicting legislators is unique for the section in question, all the authors who contribute to the joint research project have one end-goal in common, namely to inform about important perspectives while at the same time opening up for parameters for (more) fruitful, constructive and (if need be) critical debate in the future. With this in mind, four recommendations are presented by the research director for the project. Legally, politically, socially and culturally, conflict-resolution should not translate the relationship between rulers and the ruled into a separation ideology, an instance of controllers versus the controlled. All things being equal, that is the objective limit for a democratic society. (shrink)

Much mischief concerning the concept of a human body is generated by the failure of philosophers to distinguish various important senses of the term 'body.' I discuss three of those senses and illustrate the issues they can generate by discussing the concept of a Lockean exchange of bodies as well as the brain-body switch.

Luck egalitarianism makes a fundamental distinction between inequalities for which agents are responsible and inequalities stemming from luck. I give several reasons to find luck egalitarianism a compelling view of distributive justice. I then argue that it is an incomplete theory of equality. Luck egalitarianism lacks the normative resources to achieve its ends. It is unable to specify the prior conditions under which persons are situated equivalently such that their choices can bear this tremendous weight. This means that luck egalitarians (...) need to become pluralists who understand equality not merely in terms of choice, luck, and responsibility. After developing my critical argument that luck egalitarianism is incomplete, I sketch a strategy for rehabilitating and filling out the theory. (shrink)
