Hace ya más de 40 años desde que se comenzase a explorar las posibilidades de emplear inteligencia artificial en el campo del derecho. Existen numerosos usos y propuestas en el marco de la IA y el derecho, desde la automatización de la búsqueda de la información jurídica hasta la personalización del derecho. Estas propuestas plantean diversas cuestiones relacionadas con la filosofía del derecho. La proliferación de propuestas, en ocasiones, dificulta identificar la relación existente entre cada una de ellas con debates (...) específicos de la filosofía del derecho. Este trabajo ofrece una clasificación de usos de la IA jurídica que facilita la identificación de los temas de filosofía de derecho especialmente afectados por cada uso. Se propone distinguir tres grandes categorías: derecho formalizado, práctica jurídica algorítmica, y derecho personalizado. Esta propuesta incorpora los avances recientes en machine learning y propuestas novedosas como la personalización del derecho. Con esta clasificación resulta más sencillo identificar las premisas iusfilosóficas en que se asientan o sobre las que deben reflexionar los diversos proyectos de empleo de IA en el derecho. Este artículo de reflexión problematiza la didáctica de las lenguas extranjeras desde una inquietud filosófica-intercultural para contextos mayoritaria e históricamente monolingües como el latinoamericano. Inicialmente, se describen los rasgos de colonialidad latentes en el enfoque que el Marco Común Europeo de Referencia asume para tratar la interculturalidad. Seguidamente, se realiza un análisis crítico-filosófico de los desafíos que la interculturalidad enfrenta en América Latina en el contexto anteriormente mencionado, y se revisan las relaciones que existen entre interculturalidad y glotopolítica, asumiendo que (...) el latinoamericanismo de Mendieta, la resemantización del orientalismo de Said, el mimetismo y la hibridación bhabhiana, así como la filosofía intercultural, son quizá los desafíos filosóficos más grandes. Finalmente, se presenta un exordio para una interculturalidad crítica en lenguas-culturas extranjeras, en el que se tienen en cuenta algunas contribuciones del Grupo Modernidad/Colonialidad, concretamente de Dussel, Walsh, Castro-Gómez y Fornet-Betancourt, reconociendo que la didáctización de la interculturalidad en las licenciaturas de lenguas modernas de Colombia está por construirse. In this chapter, we discuss a selection of current views of the neural correlates of consciousness (NCC). We focus on the different predictions they make, in particular with respect to the role of prefrontal cortex (PFC) during visual experiences, which is an area of critical interest and some source of contention. Our discussion of these views focuses on the level of functional anatomy, rather than at the neuronal circuitry level. We take this approach because we currently understand more about experimental (...) evidence at this coarse level and because these results are appropriate for arbitrating between current theoretical frameworks. We discuss the Two-Visual-Systems Hypothesis (Milner & Goodale 1995; 2006), Local Recurrency (Lamme 2010; Lamme 2006), Higher Order (Lau 2008; Lau & Rosenthal 2011) and Global Workspace theories (Baars 1997; Baars 2005; Dehaene & Naccache 2001; Dehaene 2014). Despite the apparent stark differences between conscious and unconscious perceptual processing, available evidence suggests that their neural substrates must be largely shared. This indicates that the difference in neural activity between conscious and unconscious perceptual processing is likely to be subtle and highly specialized. We argue that current experimental evidence about the involvement of specific activity in prefrontal cortex supports the higher order neural theory of consciousness. In consequence, imaging techniques that focus only on marked differences between conscious and unconscious level of activity are likely to be insensitive to the relevant neural activity patterns that underlie conscious experiences. Finally, it follows from the evidence we discuss that the functional advantages of conscious over unconscious perceptual processing may be more limited than commonly thought. (shrink)

When a circular coin is rotated in depth, is there any sense in which it comes to resemble an ellipse? While this question is at the center of a rich and divided philosophical tradition (with some scholars answering affirmatively and some negatively), Morales et al. (2020, 2021) took an empirical approach, reporting 10 experiments whose results favor such perspectival similarity. Recently, Burge and Burge (2022) offered a vigorous critique of this work, objecting to its approach and conclusions on both philosophical (...) and empirical grounds. Here, we answer these objections on both fronts. We show that Burge and Burge’s critique rests on misunderstandings of Morales et al.’s claims; of the relation between the data and conclusions; and of the philosophical context in which the work appears. Specifically, Burge and Burge attribute to us a much stronger (and stranger) view than we hold, involving the introduction of “a new entity” located “in some intermediate position(s) between the distal shape and the retinal image.” We do not hold this view. Indeed, once properly understood, most of Burge and Burge’s objections favor Morales et al.’s claims rather than oppose them. Finally, we discuss several questions that remain unanswered, and reflect on a productive path forward on these issues of foundational scientific and philosophical interest. (shrink)

Arguably the most foundational principle in perception research is that our experience of the world goes beyond the retinal image; we perceive the distal environment itself, not the proximal stimulation it causes. Shape may be the paradigm case of such “unconscious inference”: When a coin is rotated in depth, we infer the circular object it truly is, discarding the perspectival ellipse projected on our eyes. But is this really the fate of such perspectival shapes? Or does a tilted coin retain (...) an elliptical appearance even when we know it’s circular? This question has generated heated debate from Locke and Hume to the present; but whereas extant arguments rely primarily on introspection, this problem is also open to empirical test. If tilted coins bear a representational similarity to elliptical objects, then a circular coin should, when rotated, impair search for a distal ellipse. Here, nine experiments demonstrate that this is so, suggesting that perspectival shapes persist in the mind far longer than traditionally assumed. Subjects saw search arrays of three-dimensional “coins,” and simply had to locate a distally elliptical coin. Surprisingly, rotated circular coins slowed search for elliptical targets, even when subjects clearly knew the rotated coins were circular. This pattern arose with static and dynamic cues, couldn’t be explained by strategic responding or unfamiliarity, generalized across shape classes, and occurred even with sustained viewing. Finally, these effects extended beyond artificial displays to real-world objects viewed in naturalistic, full-cue conditions. We conclude that objects have a remarkably persistent dual character: their objective shape “out there,” and their perspectival shape “from here.”. (shrink)

Consciousness and confidence seem intimately related. Accordingly, some researchers use confidence ratings as a measure of, or proxy for, consciousness. Rosenthal discusses the potential connections between the two, and rejects confidence as a valid measure of consciousness. He argues that there are better alternatives to get at conscious experiences such as direct subjective reports of awareness (i.e. subjects’ reports of perceiving something or of the degree of visibility of a stimulus). In this chapter, we offer a different perspective. Confidence ratings (...) in general, and metacognitive measures in particular, may offer important advantages over subjective ratings. The arguments we offer here are supported by empirical, practical and socio-strategic considerations. However, we do not suggest consciousness and confidence are interchangeable. We recognize the limitations of confidence ratings in some experimental designs and for some research questions. Nevertheless, we also address a potential conceptual link between consciousness and confidence that stems from Rosenthal’s very own work on mental quality space theory. (shrink)

I discuss Clark’s predictive processing/extended mind hybrid, diagnosing a problem: Clark’s hybrid suggests that, when we use them, we pay attention to mind-extending external resources. This clashes with a commonly accepted necessary condition of cognitive extension; namely, that mind-extending resources must be phenomenally transparent when used. I then propose a solution to this problem claiming that the phenomenal transparency condition should be rejected. To do so, I put forth a parity argument to the effect that phenomenal transparency cannot be a (...) necessary condition on cognitive extension: roughly, since internal cognitive resources can fail to be transparent when used, by parity, external resources can fail to be phenomenally transparent too. Further, I argue that phenomenal transparency is not even a reliable indicator of cognitive extension; hence its absence should not be considered a problem for Clark’s extended mind-predictive processing hybrid. Lastly, I consider and allay a number of worries my proposal might raise, and conclude the paper. (shrink)

Dynamic Theodicy (DT) is a broad concept we bring up to designate some modern Philosophical Theology attempts to reconcile the necessary and perfect existence of God with the contingent characteristics of human life. In this paper we analyze such approaches and discuss how they have become incomprehensible because the metaphysical assumptions implicit in these explanations have lost their intrinsic relation to the natural human desire for salvation. In the first part we show Charles Hartshorne's DT-model, arising from the modal logic (...) of perfection, and the modern rational problems of this position in making infinite-necessary Being (God) and finite-contingent being (human) compatible. We note that at the heart of the contradictions in this DT account is a dialectical mode of thinking that makes it difficult to find a correct solution to this dichotomy, and to assume a human desire that could be considered related to lifelong goals. In the second part, supported by the proposal of Hans Urs von Balthasar's DT, we develop the concepts of bodily vulnerability, corporeal intentionality, and natural desire for salvation, which come from an Aristotelian-Thomistic thought. This theory is established in order to build an argument, following Alasdair MacIntyre’s ethical framework, on how to make possible the recovery of a metaphysical and anthropological desire that transcends natural aging and goes beyond death. We conclude that both human dependence and the virtues that arise naturally when human beings decide to seek the good of their transcendent condition, make it possible to recover the natural desire for salvation through divine and human love. The paper presents and discusses the Hubble tension with respect to recent results in cosmology. I shall argue that the measurements from the James Webb Space Telescope and TRGB stars calibrations allow us to infer that the estimates of H0 with late universe methods are robust. Building on from robustness analysis, I conclude that the resolution of the tension cannot be expected to come from new systematics, but rather from new physics.

Many approaches to quantum gravity -the theory that should account for quantum and gravitational phenomena under the same theoretical umbrella- seem to point at some form of spacetime emergence, i.e., the fact that spacetime is not a fundamental entity of our physical world. This tenet has sparked many philosophical discussions: from the so-called empirical incoherence problem to different accounts of emergence and mechanisms thereof. In this contribution, I focus on the partial order relation of causal set theory and argue that (...) causation can be characterized as an a-temporal constraint over the kinematic space defined by the theory. The relation constrains the growth of a new element/event with respect to the other elements/events of a given set. Therefrom, the flow of time emerges from the collection of the possible growths of the given set, where each possibility is characterized by a classical probability assigned by the dynamics of the theory. In this contribution, I explore the possibility of characterizing the emergence of time in causal set theory (CST) in terms of the growing block universe (GBU) metaphysics. I show that although GBU seems to be the most intuitive time metaphysics for CST, it leaves us with a number of interpretation problems, independently of which dynamics we choose to favor for the theory —here I shall consider the Classical Sequential Growth and the Covariant model. Discrete general covariance of the CSG dynamics (...) does not allow us to individuate a single history of the universe (defined by a causal history of different causal sets), thereby making the claim that ‘the past exists’ at best problematic. In addition, because the evolution of the universe in CSG dynamics leads to an outward branching causal tree, it becomes impossible to determine a proper ‘line of becoming’, thereby blurring the presentists’ claim that only the present exists. Similarly, the covariant approach runs into the same, if not even more severe problems, since each configuration of the universe would amount to a set of possible causal sets, thereby making the individuation of a single configuration of the universe —and thus the physical interpretation of the theory— implausible. In the substitutional framework, validity is truth under all substitutions of the nonlogical vocabulary. I develop a theory where □ is interpreted as substitutional validity. I show how to prove soundness and completeness for common modal calculi using this definition.

Our pains can be more or less intense, our mental imagery can be more or less vivid, our perceptual experiences can be more or less striking. These degrees of intensity of conscious experiences are all manifestations of a phenomenal property I call mental strength. In this article, I argue that mental strength is a domain-general phenomenal magnitude; in other words, it is a phenomenal quantity shared by all conscious experiences that explains their degree of felt intensity. Mental strength has been (...) largely overlooked in favor of mental states’ type, representational contents, domain-specific phenomenology, or processes such as attention. Considering mental strength in our reflections about the mind illuminates debates about the relation of representational contents and phenomenal character, and it also helps address questions about the structure and functions of consciousness. Mental strength provides a unifying construct to model what is shared in the phenomenology of different types of conscious experiences. (shrink)

Most of the processes subsumed under »digitalization« have in common that they permit switching and simultaneity of sender and recipient roles over a broad range of communications. Preeminently, such communications provide and process information. However, the progress of digitalization in modern lifeworlds is not primarily driven by the development of digital technology. Digital technology is but the appropriate medium for enabling the exchange of the respective formats of information. Its thrust is embedded in a cumulative history of translation of analogue (...) world-relations into such formats of information and, moreover, the progressive transformation of reality in data-structures that can be digitally mapped and controlled. Such structures are attractive because they render our access to and handling of reality more secure and more predictable. Yet they also engender increasing helplessness and discontentment at the boundaries of the digitally controllable world. (shrink)

Psiche sets up a close-knit comparison between the psychology of Plato's Republic and Freud's psychoanalysis. Convergences and divergences are discussed in relation both to the Platonic conception of the oneiric emergence of repressed desires that prefigures the main path of Freud's subconscious, to the analysis of the psychopathologies related to these theoretical formulations and to the two diagnostic and therapeutic approaches adopted. Another crucial theme is the Platonic eros - the examination of which is also extended to the Symposium and (...) Phaedrus - taken up explicitly by Freud in relation to the concept of libido. Finally, the author also addresses the two themes - of, inter alia, a metapsychological nature - inherent to the moral dimension. -/- Psiche istituisce un confronto ravvicinato tra la psicologia della "Repubblica" di Platone e la psicoanalisi di Freud. Convergenze e divergenze vengono discusse in relazione sia alla concezione platonica dell'emersione onirica dei desideri repressi, che prefigura la via regia per l'inconscio di Freud, sia all'analisi delle psicopatologie correlate a tali impostazioni teoriche, sia ai due approcci diagnostici e terapeutici adottati. Altro tema cruciale è l'eros platonico - la cui disamina viene estesa anche al "Simposio" e al "Fedro" - ripreso esplicitamente da Freud in relazione al concetto di libido. The aim of this paper is to present a revision of international versions of the Utrecht Work Engagement Scale and to describe the psychometric properties of a Portuguese version of the UWES-9 developed simultaneously for Brazil and Portugal, the validity evidence related with the internal structure, namely, Dimensionality, measurement invariance between Brazil and Portugal, and Reliability of the scores. This is the first UWES version developed simultaneously for both countries, and it is an important instrument for understanding employees' work engagement (...) in the organizations, allowing human resources departments to better use workforces, especially when they are migrants. A total of 524 Brazilian workers and 522 Portuguese workers participated in the study. Confirmatory Factor Analysis, group comparisons, and Reliability estimates were used. The use of workers who were primarily professionals or administrative support, according to ISCO-08, reinforced the need to collect data on other professional occupations. Confirmatory factor analysis showed acceptable fit for the UWES-9 original three-factor solution, and a second-order factor structure has been proposed that presented an acceptable fit. Full-scale invariance was obtained between the Portuguese and Brazilian samples, both for the original three-factor first-order and second-order models. Data revealed that Portuguese and Brazilian workers didn't show statistically significant differences in the work engagement dimensions. This version allows for direct comparisons of means and, consequently, for performance of comparative and cross-cultural studies between these two countries. (shrink)

The concept of shared mental models refers to the shared understanding among team members about how they should behave in different situations. This article aimed to develop a new shared mental model measure, specifically designed for the refereeing context. A cross-sectional study was conducted with three samples: national and regional football referees (n = 133), national football referees and assistant referees and national futsal referees (n = 277), and national futsal referees (n = 60). The proposed version of the Referee (...) Shared Mental Models Measure (RSMMM) has 13 items that are reflected on a single factor structure. The RSMMM presented good validity evidence both based on the internal structure and based on relations to other variables (presenting positive associations with team work engagement, team adaptive performance, and team effectiveness). Such promising psychometric properties point to an optimistic outlook regarding its use to measure shared mental models in futsal and football referee teams. -/- . (shrink)

Rescue workers have a stressful and risky occupation where being engaged is crucial to face physical and emotional risks in order to help other persons. This study aims to estimate work engagement levels of rescue workers (namely comparing nurses, firefighters, and police officers) and to assess the validity evidence related to the internal structure of the Portuguese versions of the UWES-17 and UWES-9, namely, dimensionality, measurement invariance between occupational groups, and reliability of the scores. To evaluate the dimensionality, we compared (...) the fit of the three-factor model with the fit of a second-order model. A Portuguese version of the instrument was applied to a convenience sample of 3,887 rescue workers (50% nurses, 39% firefighters, and 11% police officers). Work engagement levels were moderate to high, with firefighters being the highest and nurses being the lowest engaged. Psychometric properties were evaluated in the three-factor original structure revealing acceptable fit to the data in the UWES-17, although the UWES-9 had better psychometric properties. Given the observed statistically significant correlations between the three original factors, we proposed a 2nd hierarchal structure that we named work engagement. The UWES-9 first-order model obtained full uniqueness measurement invariance, and the second-order model obtained partial (metric) second-order invariance. (shrink)

The notion of schema has been given a major role by Recanati within his conception of primary pragmatic processes, conceived as a type of associative process. I intend to show that Recanati’s considerations on schemata may challenge the relevance theorist’s argument against associative explanations in pragmatics, and support an argument in favor of associative (versus inferential) explanations. More generally, associative relations can be shown to be schematic, that is, they have enough structure to license inferential effects without any appeal to (...) genuine inferential processes. Associative processes are thus able to explain a number of pragmatic and linguistic phenomena which have instead been thought to require specialized inferential processes. (shrink)

During the last few years, burnout has gained more and more attention for its strong connection with job performance, absenteeism, and presenteeism. It is a psychological phenomenon that depends on occupation, also presenting differences between sexes. However, to properly compare the burnout levels of different groups, a psychometric instrument with adequate validity evidence should be selected (i.e., with measurement invariance). This paper aims to describe the psychometric properties of the Oldenburg Burnout Inventory (OLBI) version adapted for workers from Brazil and (...) Portugal, and to compare burnout across countries and sexes. OLBI's validity evidence based on the internal structure (dimensionality, reliability, and measurement invariance), and validity evidence based on relationships with other variables (work engagement) are described. Additionally, it aims presents a revision of different OLBI's versions—since this is the first version of the instrument developed simultaneously for both countries—it is an important instrument for understanding burnout between sexes in organizations. Data were used from 1,172 employees across two independent samples, one from Portugal and the other from Brazil, 65 percent being female. Regarding the OLBI internal structure, a reduced version (15 items) was obtained. The high correlation between disengagement and exhaustion, suggested the existence of a second-order latent factor, burnout, which presented measurement invariance for country and sex. Confirmatory factor analysis of the Portuguese OLBI version presented good goodness-of-fit indices and good internal consistency values. No statistically significant differences were found in burnout between sexes or countries. OLBI also showed psychometric properties that make it a promising and freely available instrument to measure and compare burnout levels of Portuguese and Brazilian employees. (shrink)

In this article, the authors try to answer the following questions: How can an object/instance seen for the first time extend a category or update a concept? How is it possible to determine the reference of a concept that represents a behaviour? In the first case, the authors discuss the learning of inferential linguistic competence used to update a concept through an approach based on prototype theory. In the second case, the authors discuss the learning of referential linguistic competence used (...) to determine the reference of a concept (i.e., determination of an actual behaviour) through an approach based on embodied cognition. The authors show how combining prototype-based and embodied categorization in Wittgenstein’s rule-following praxis (the individual and community dimension), linguistic learning of a concept (inferential competence), and determination of its reference (referential competence) can be traced back to the same model. My main purpose here is to provide an account of context selection in utterance understanding in terms of the role played by schemata and goals in top-down processing. The general idea is that information is organized hierarchically, with items iteratively organized in chunks—here called “schemata”—at multiple levels, so that the activation of any items spreads to schemata that are the most accessible due to previous experience. The activation of a schema, in turn, activates its other components, so as to predict (...) a likely context for the original item. Since each input activates its own schemata, conflicting schemata compete with (and inhibit) each other, while multiple activations of a schema raise its likelihood to win the competition. There is therefore a double movement—with bottom-up activation of schemata enabling top-down prediction of other contextual components—triggered by multiple sources. Another claim of the paper is that goals are represented by schemata placed at the highest-levels of the executive hierarchy, in accordance with Fuster’s model of the brain as a hierarchically organized perception action cycle. This account can be considered, in part at least, a development of ideas contained in Relevance Theory, though it may imply that some other claims of the theory are in need of revision. Therefore, a secondary purpose of the paper is a contribution to the analysis of that theory. (shrink)

The paper presents an inferential model of explicit communication based on the speaker’s interests and the addressee’s beliefs. After the introduction, the paper sets out some notions concerning explicit communication within the frameworks of truth-conditional pragmatics and relevance theory. The third section describes the phenomenon of semantic underdeterminacy, and the fourth section introduces non-demonstrative inferences in communication. The fifth section presents the model. The main notions involved are the speaker’s intended meaning and the addressee’s intended meaning. The former notion is (...) centered on the speaker’s interest in situation: a speaker intends the meaning of an utterance on the basis of a partial order of preference with respect to a set of contextually plausible meanings. The latter notion is centered on the addressee’s communicative inference, which is based on the addressee’s belief about the speaker’s interest. The paper takes the notion of interest from cognitive social theory, the notion of meaning from semantics, and the notion of explicit meaning from pragmatics; and it uses the notion of communicative inference for explicit meaning in partial accordance with relevance theory. In the sixth section, the paper argues in favor of the inferential approach compared with the associative approach in determination of “what is said.” The paper’s method is conceptual analysis of declarative utterances used in communicative situations. The main finding of the paper has been to show that, in contextual underdeterminacy cases, speaker’s interest is a determining factor in communicative processes. Across two studies, one of which was pre-registered, we find that a simple questionnaire that measures intellectual virtue and vice predicts how many fake news articles and conspiracy theories participants accept. This effect holds even when controlling for multiple demographic predictors, including age, household income, sex, education, ethnicity, political affiliation, religion, and news consumption. These results indicate that self-report is an adequate way to measure intellectual virtue and vice, which suggests that they are not fully immune to introspective awareness or (...) “stealthy” in the sense that Cassam (2015) argues. This is an important methodological result and may pave the way for future research on intellectual virtue and vice. (shrink)

Introspection is a fundamental part of our mental lives. Nevertheless, its reliability and its underlying cognitive architecture have been widely disputed. Here, I propose a principled way to model introspection. By using time-tested principles from signal detection theory (SDT) and extrapolating them from perception to introspection, I offer a new framework for an introspective signal detection theory (iSDT). In SDT, the reliability of perceptual judgments is a function of the strength of an internal perceptual response (signal- to-noise ratio) which is, (...) to a large extent, driven by the intensity of the stimulus. In parallel to perception, iSDT models the reliability of introspective judgments as a function of the strength of an internal introspective response (signal-to-noise ratio) which is, to a large extent, driven by the intensity of conscious experiences. Thus, by modelling introspection after perception, iSDT can calibrate introspection’s reliability across a whole range of contexts. iSDT offers a novel, illuminating way of thinking about introspection and the cognitive processes that support it. According to the interpretational theory of logical validity (IR), logical validity is preservation of truth in all interpretations compatible with the intended meaning of logical expressions. IR suffers from a seemingly defeating objection, the so-called cardinality problem: any instance of the statement ‘There are n things’ is true under all interpretations, since it can be written down using only logical expressions that are not to be reinterpreted; yet ‘There are n things’ is not logically true. I argue that the cardinality (...) problem is indeed a serious problem for IR, when understood in terms of ‘asymmetry of information’. I then argue that IR can be rehabilitated by making quantifiers context-sensitive: what we do not reinterpret is the Kaplanian character of a quantifier, rather than its content. ‘There are n things’ is false in a context where fewer than n things are relevant, so it is not logically true in IR. I finally discuss some objections and ramifications of my account: I discuss how to make space for the possibility of an explicitly absolutely general quantifier in my framework, how terms can be logical even though context-sensitive, and how to recapture classical logic within my framework. Why are mistaken beliefs about Covid-19 so prevalent? Political identity, education and other demographic variables explain only a part of individual differences in the susceptibility to Covid-19 misinformation. This paper focuses on another explanation: epistemic vice. Epistemic vices are character traits that interfere with acquiring, maintaining, and transmitting knowledge. If the basic assumption of vice epistemology is right, then people with epistemic vices such as indifference to the truth or rigidity in their belief structures will tend to be more susceptible (...) to believing Covid-19 misinformation. We carried out an observational study (US sample, n = 998) in which we measured the level of epistemic vice of participants using a novel Epistemic Vice Scale. We also asked participants questions eliciting the extent to which they subscribe to myths and misinformation about Covid-19. We find overwhelming evidence to the effect that epistemic vice is associated with susceptibility to Covid-19 misinformation. In fact, the association turns out to be stronger than with political identity, educational attainment, scores on the Cognitive Reflection Test, personality, dogmatism, and need for closure. We conclude that this offers evidence in favor of the empirical presuppositions of vice epistemology. (shrink)

To find the neural substrates of consciousness, researchers compare subjects’ neural activity when they are aware of stimuli against neural activity when they are not aware. Ideally, to guarantee that the neural substrates of consciousness—and nothing but the neural substrates of consciousness—are isolated, the only difference between these two contrast conditions should be conscious awareness. Nevertheless, in practice, it is quite challenging to eliminate confounds and irrelevant differences between conscious and unconscious conditions. In particular, there is an often-neglected confound that (...) is crucial to eliminate from neuroimaging studies: task performance. Unless subjects’ task performance is matched (and hence perceptual signal processing is matched), researchers risk finding the neural correlates of perception, rather than conscious perception. Here, we discuss the theoretical motivations for the performance matching framework and review empirical demonstrations of, and theoretical inferences derived from, obtaining differences in consciousness while controlling for task performance. We summarize signal detection theoretic modeling frameworks that explain how it is that we can derive performance-matched differences in consciousness without the effect being trivially driven by differences in criterion setting, and also provide principles for designing experimental paradigms that yield performance-matched differences in awareness. Finally, we address potential technical and theoretical issues that stem from matching performance across conditions of awareness, and we introduce the notion of “triangulation” for designing comprehensive experimental sets that can better reveal the neural substrates of consciousness. Metacognition is the capacity to evaluate the success of one's own cognitive processes in various domains; for example, memory and perception. It remains controversial whether metacognition relies on a domain-general resource that is applied to different tasks or if self-evaluative processes are domain specific. Here, we investigated this issue directly by examining the neural substrates engaged when metacognitive judgments were made by human participants of both sexes during perceptual and memory tasks matched for stimulus and performance characteristics. By comparing patterns (...) of fMRI activity while subjects evaluated their performance, we revealed both domain-specific and domain-general metacognitive representations. Multivoxel activity patterns in anterior prefrontal cortex predicted levels of confidence in a domain-specific fashion, whereas domain-general signals predicting confidence and accuracy were found in a widespread network in the frontal and posterior midline. The demonstration of domain-specific metacognitive representations suggests the presence of a content-rich mechanism available to introspection and cognitive control. (shrink)

Abstract. This paper argues that the “Argument from Moral Peer Disagreement” fails to make a case for widespread moral skepticism. The main reason for this is that the argument rests on a too strong assumption about the normative significance of peer disagreement (and higher-order evidence more generally). In order to demonstrate this, I distinguish two competing ways in which one might explain higher-order defeat. According to what I call the “Objective Defeat Explanation” it is the mere possession of higher-order evidence (...) that explains defeat. I argue that this type of explanation is problematic and that it at best collapses into another explanation I call the “Subjective Defeat Explanation”. According to this explanation, it is coming to believe that one’s belief fails to be rational that explains defeat. Then I go on to argue that the Subjective Defeat Explanation is able to provide a straightforward explanation of higher-order defeat but that it entails that peer disagreement (and higher-order evidence more generally) only contingently gives rise to defeat, and importantly, that the condition it is contingent upon is very often not satisfied when it comes to moral peer disagreement specifically. As a result, it appears that moral knowledge is seldom threatened by moral peer disagreement. (shrink)

When visual attention is directed away from a stimulus, neural processing is weak and strength and precision of sensory data decreases. From a computational perspective, in such situations observers should give more weight to prior expectations in order to behave optimally during a discrimination task. Here we test a signal detection theoretic model that counter-intuitively predicts subjects will do just the opposite in a discrimination task with two stimuli, one attended and one unattended: when subjects are probed to discriminate the (...) unattended stimulus, they rely less on prior information about the probed stimulus’ identity. The model is in part inspired by recent findings that attention reduces trial-by-trial variability of the neuronal population response and that they use a common criterion for attended and unattended trials. In five different visual discrimination experiments, when attention was directed away from the target stimulus, subjects did not adjust their response bias in reaction to a change in stimulus presentation frequency despite being fully informed and despite the presence of performance feedback and monetary and social incentives. This indicates that subjects did not rely more on the priors under conditions of inattention as would be predicted by a Bayes-optimal observer model. These results inform and constrain future models of Bayesian inference in the human brain. (shrink)

Das Netz der Fischer ist dabei weniger ein Gleichnis für ein Werkzeug, mit dem man Fische überlisten kann um (...) sie zu fangen und zu verspeisen, das Netz hält etwas zusammen, wenn es denn gepflegt und an schwachen Stellen immer wieder geflickt wird. Das Netz ist etwas, das unter der Benutzung verschleißt, und es muss, in Stunden der Ruhe, gepflegt werden. Wenn wir heute vom Vernetzt- Sein sprechen und sagen, dass wir unser Netzwerk pflegen müssen, wenn wir uns fragen, ob wir vernetzt sind oder uns verheddert haben, dann meinen wir etwas ganz anderes, als das, was mit dem Fischernetz im Evangelium angesprochen ist. Ich möchte diesen Unterschied deutlich machen und zeigen, dass das Vernetzt-Sein wie es uns heute im Internet, aber auch außerhalb der so genannten Sozialen Medien oder sozialen Netzwerke, begegnet, eben keine notwendige Lebensbedingung des Menschen ist, dass wir nicht etwa schon immer das Streben nach Vernetzung in uns getragen haben, jedenfalls nicht in der Form, wie wir es heute im Internet betreiben. Social entrepreneurship is usually understood as an economic activity which focuses at social values, goals, and investments that generates surpluses for social entrepreneurs as individuals, groups, and startups who are working for the benefit of communities, instead of strictly focusing mainly at the financial profit, economic values, and the benefit generated for shareholders or owners. Social entrepreneurship combines the production of goods, services, and knowledge in order to achieve both social and economic goals and allow for solidarity building. From a (...) broader perspective, entities that are focused on social entrepreneurship are identified as parts of the social and solidarity economy. These are, for example, social enterprises, cooperatives, mutual organizations, self-help groups, charities, unions, fair trade companies, community enterprises, and time banks. Social innovation is a key element of social entrepreneurship. Social innovation is usually understood as new strategies, concepts, products, services, and organizational forms that allow for the satisfaction of needs. Such innovations are created in particular in the contact areas of various sectors of the social system. For example, these are spaces between the public sector, the private sector, and civil society. These innovations not only allow the solving of problems but also extend possibilities for public action. (shrink)

Studying the neural correlates of conscious awareness depends on a reliable comparison between activations associated with awareness and unawareness. One particularly difficult confound to remove is task performance capacity, i.e. the difference in performance between the conditions of interest. While ideally task performance capacity should be matched across different conditions, this is difficult to achieve experimentally. However, differences in performance could theoretically be corrected for mathematically. One such proposal is found in a recent paper by Lamy, Salti and Bar-Haim [Lamy (...) D, Salti M, Bar-Haim Y. Neural correlates of subjective awareness and unconscious processing: an ERP study. J Cognitive Neurosci 2009,21:1435-46], who put forward a corrective method for an electroencephalography experiment. We argue that their analysis is essentially grounded in a version of High Threshold Theory, which has been shown to be inferior in general to Signal Detection Theory. We show through a series of computer simulations that their correction method only partially removes the influence of perfor- mance capacity, which can yield misleading results. We present a mathematical correction method based on Signal Detection Theory that is theoretically capable of removing performance capacity confounds. We discuss the limitations of mathemati- cally correcting for performance capacity confounds in imaging studies and its impact for theories about consciousness. (shrink)

Structural representations are increasingly popular in philosophy of cognitive science. A key virtue they seemingly boast is that of meeting Ramsey's job description challenge. For this reason, structural representations appear tailored to play a clear representational role within cognitive architectures. Here, however, I claim that structural representations do not meet the job description challenge. This is because even our most demanding account of their functional profile is satisfied by at least some receptors, which paradigmatically fail the job description challenge. Hence, (...) the functional profile typically associated with structural representations does not identify representational posits. After a brief introduction, I present, in the second section of the paper, the job description challenge. I clarify why receptors fail to meet it and highlight why, as a result, they should not be considered representations. In the third section I introduce what I take to be the most demanding account of structural representations at our disposal, namely Gładziejewski's account. Provided the necessary background, I turn from exposition to criticism. In the first half of the fourth section, I equate the functional profile of structural representations and receptors. To do so, I show that some receptors boast, as a matter of fact, all the functional features associated with structural representations. Since receptors function merely as causal mediators, I conclude structural representations are mere causal mediators too. In the second half of the fourth section I make this conclusion intuitive with a toy example. I then conclude the paper, anticipating some objections my argument invites. (shrink)

The purpose of this article is to examine two important issues concerning the agency theory of causality: the charge of anthropomorphism and the relation of simultaneous causation. After a brief outline of the agency theory, sections 2–4 contain the refutation of the three main forms in which the charge of anthropomorphism is to be found in the literature. It will appear that it is necessary to distinguish between the subjective and the objective aspect of the concept of causation. This will (...) lead, in section 5, to contrast two kinds of anthropomorphism, one which has been rightly rejected by modern science and one which is fully compatible with the objective reality of the causal processes. Finally, section 6 will apply the preceding considerations to simultaneous causation. On the one hand, in a basic sense, there can be no simultaneous causal relations. On the other hand, simultaneous causation arises when we consider the natural change by abstracting from the agent and from her/his projects of interven.. (shrink)

Some philosophers search for the mark of the cognitive: a set of individually necessary and jointly sufficient conditions identifying all instances of cognition. They claim that the mark of the cognitive is needed to steer the development of cognitive science on the right path. Here, I argue that, at least at present, it cannot be provided. First (§2), I identify some of the factors motivating the search for a mark of the cognitive, each yielding a desideratum the mark is supposed (...) to satisfy (§2.1). I then (§2.2) highlight a number of tensions in the literature on the mark of the cognitive, suggesting they’re best resolved by distinguishing two distinct programs. The first program (§3) is that of identifying a mark of the cognitive capturing our everyday notion of cognition. I argue that such a program is bound to fail for a number of reasons: it is not clear whether such an everyday notion exists; and even if it existed, it would not be able to spell out individually necessary and jointly sufficient conditions for cognition; and even if it were able to spell them out, these conditions won’t satisfy the desiderata a mark of the cognitive should satisfy. The second program is that of identifying a mark of the cognitive spelling out a genuine scientific kind. But the current state of fragmentation of cognitive science, and the fact that it is splintered in a myriad of different research traditions, prevent us from identifying such a kind. And we have no reason to think that these various research traditions will converge, allowing us to identify a single mark. Or so, at least, I will argue in (§4). I then conclude the paper (§5) deflecting an intuitive objection, and exploring some of the consequences of the thesis I have defended. (shrink)

A central feature of experimental development economics is the use of randomized controlled trials (RCTs) to evaluate the effectiveness of prospective socioeconomic interventions. The use of RCTs in development economics raises a host of ethical issues which are just beginning to be explored. In this article, I address one ethical issue in particular: the routine use of the status quo as a control when designing and conducting a development RCT. Drawing on the literature on the principle of standard care in (...) medical research ethics, as well as considerations of distributive justice in non-ideal circumstances, I argue that the practice of using the status quo as a control is ethically justifiable. However, I add an important qualification based on the natural duty of rescue to address the concern that my account is overly permissive. (shrink)

Constitutions enshrine the fundamental values of a people and they build a framework for a state’s public policy. With regard to generational change, their endurance gives rise to two interlinked concerns: the sovereignty concern and the forgone welfare concern. If constitutions are intergenerational contracts, how (in)flexible should they be? This article discusses perpetual constitutions, sunset constitutions, constitutional reform commissions and constitutional conventions, both historically and analytically. It arrives at the conclusion that very rigid constitutions are incompatible with the principle of (...) intergenerational justice. Recurring constitutional reform commissions in fixed time intervals would give each generation of citizens a say without leaning too much to the side of flexibility. (shrink)

A recent fMRI study by Webb et al. (Cortical networks involved in visual awareness independent of visual attention, Proc Natl Acad Sci U S A 2016;113:13923–28) proposes a new method for finding the neural correlates of awareness by matching atten- tion across awareness conditions. The experimental design, however, seems at odds with known features of attention. We highlight logical and methodological points that are critical when trying to disentangle attention and awareness.

Grice in pragmatics and Levelt in psycholinguistics have proposed models of human communication where the starting point of communicative action is an individual intention. This assumption, though, has to face serious objections with regard to the alleged existence of explicit representations of the communicative goals to be pursued. Here evidence is surveyed which shows that in fact speaking may ordinarily be a quite automatic activity prompted by contextual cues and driven by behavioural schemata abstracted away from social regularities. On the (...) one hand, this means that there could exist no intentions in the sense of explicit representations of communicative goals, following from deliberate reasoning and triggering the communicative action. On the other hand, however, there are reasons to allow for a weaker notion of intention than this, according to which communication is an intentional affair, after all. Communicative action is said to be intentional in this weaker sense to the extent that it is subject to a double mechanism of control, with respect both to present-directed and future-directed intentions. Austin's theory of performatives has recently inspired much literature on political correctness, based on the idea that they can be essential for the individuals' identity construction, but also for oppression and offence. In this paper I intend to analyze the power but also the limitations of performatives: we should refrain from attributing them magical efficacy, insofar as their power is actually constrained by objective conditions. This invites a revision of post-modern theories according to which any speech creates its own «regime (...) of truth», without any chance for an objective analysis of ideology. (shrink)

This article focuses on an Ethno philosophy through intercultural philosophy and dialogue. This philosophical reflection stands on an historical, cultural and ethical subject known as “us” in the Latin American experience. From an intercultural dialog and its philosophy, there will be an approach of Ethno philosophy as a new way of thinking and doing philosophy from interculturalism, the recovery of ancestral knowledge and the dialogue of different forms of knowledge from the diversity of worldviews of different cultures and ethnic groups.
