Wat betreft economische groei en ontwikkeling van de werkloosheid heeft de Nederlandse economie het sinds 1973 slechter gedaan dan andere OECD-landen. Op de vraag naar de oorzaken van die slechte prestatie zijn in het verleden uiteenlopende antwoorden gegeven door o.m. Bomhoff en Clavaux. Ook zijn er diverse wegen aangegeven om op te rukken naar een betere positie. In dit artikel presenteren de auteurs de resultaten van een internationale doorsnee-analyse om de verschillen in economisch succes tussen landen met behulp van een (...) eenvoudig neo-klassiek macro-economisch model te verklaren. Dit biedt de mogelijkheid om te traceren wat de rol van de exportgroei, de groei van de bevolking, de wisselkoers, de verhouding tussen de binnenlandse en de buitenlandse prijsontwikkeling en de investeringsquote voor verschillen in economische ontwikkeling is geweest. Vooral de uitvoer gecorrigeerd voor de omvang van de bevolking, de investeringsquote en de nominale wisselkoers komen als belangrijke verklarende variabelen naar voren. Op grond van hun analyse komen de auteurs tot de conclusie dat een beleid gericht op het verbeteren van de Nederlandse economische prestatie op lange termijn zich vooral zou moeten concentreren op het benutten van exportkansen en op een hoog investeringsniveau ter bevordering van technologische vernieuwing en daarmee verbetering van de concurrentiepositie. Daarbij moet worden voorkomen dat revaluatie van de gulden het exporteffect teniet doet. (shrink)

Este trabalho apresenta algumas considerações a respeito da Base Nacional Comum Curricular (BNCC), no referente às questões ligadas ao ensino da língua portuguesa no Brasil, à territorialidade e ao pertencimento racial, processos históricos, que envolvem, no campo da educação, a formação docente e a construção da cidadania dos educandos e das educandas nestes tempos de reafirmação do Estado democrático de direito e da vaga decolonial. Portanto, trata-se de uma abordagem política em termos do pensamento de Paulo Freire, patrono da educação (...) brasileira, que considerava político o ato de educar (FREIRE, 1980; 1983; 1989; 1996). É com base nesta perspectiva que a BNCC será abordada, mas sob o aporte teórico da análise pragmática do discurso, tributária da análise discursivo-desconstrutiva (cf. ARAÚJO, 2020). (shrink)

A presente investigação tem por objetivo responder à questão título considerando os argumentos apresentados, de um lado, pelos desenvolvimentistas e, de outro, pelos ambientalistas. Entendemos que os argumentos apresentados refletem um conflito de valores mais profundo que, se abordado por uma metodologia de solução de conflitos adequada, pode contribuir para elucidação da questão. A metodologia proposta é o personalismo ético de Scheler. A hierarquia de valores a ser aplicada na solução de conflitos traz (i) o valor pessoa como o mais (...) elevado, seguido dos (ii) valores espirituais, como a justiça, (iii) os vitais, como o bem estar e o útil, e (iv) os sensíveis. Através das ações de preferir e postergar, é possível encontrar pontos de equilíbrio numa permanente atitude crítica. O objetivo é contribuir para que as ações ocorram com a devida diligência para com os direitos humanos. A hipótese inicial é que, identificando os valores em conflito e aplicando a metodologia descrita, a solução de conflitos neste caso concreto permite pensar numa transição energética que concilie o desenvolvimento e o meio ambiente. Compreendemos que ambos têm como fim proteger o valor pessoa. Portanto, o que está em conflito de fato, sem com isso assumir uma postura ingênua, são os valores espirituais e vitais de cada uma das partes. Neste sentido, defendemos que, diante da inevitável demanda por energia da sociedade contemporânea e do alto custo da transição energética, é preciso conciliar o desenvolvimento com o meio ambiente a partir de uma programada transição energética financiada pela exploração do petróleo e gás, mas com metas definidas comprometidas com a neutralidade da emissão de GEE em 2050. Para tanto, é necessário regulamentação, monitoramento e fiscalização por parte do Estado e do governo federal com a finalidade de garantir a substituição dos combustíveis fósseis por fontes energéticas limpas. The use of genome embryo editing tools in reproduction is often touted as a way to ensure the birth of healthy and genetically related children. Many would agree that this is a worthy goal. The purpose of this paper is to argue that, if we are concerned with justice, accepting such goal as morally appropriate commits one to rejecting the development of embryo editing for reproductive purposes. This is so because safer and more effective means exist that can allow many (...) more prospective parents to achieve the same valued goal and that offer additional benefits. (shrink)

According to some collectivists, purposive groups that lack decision-making procedures such as riot mobs, friends walking together, or the pro-life lobby can be morally responsible and have moral duties. I focus on plural subject- and we-mode-collectivism. I argue that purposive groups do not qualify as duty-bearers even if they qualify as agents on either view. To qualify as a duty-bearer, an agent must be morally competent. I develop the Update Argument. An agent is morally competent only if the agent has (...) sufficient positive and negative control over updating their goal-seeking states. Positive control involves the general ability to update one’s goal-seeking states, whereas negative control involves the absence of other agents with the capacity to arbitrarily interfere with updating one’s goal-seeking states. I argue that even if purposive groups qualify as plural subjects or we-mode group agents, these groups necessarily lack negative control over updating their goal-seeking states. This creates a cut-off point for groups as duty-bearers: Organized groups may qualify as duty-bearers, whereas purposive groups cannot qualify as duty-bearers. (shrink)

Current theories of the division of cognitive labor are confined to the “context of justification,” assuming exogenous theories. But new theories are made from the same labor that is used for developing existing theories, and if none of this labor is ever allocated to create new alternatives, then scientific progress is impossible. A unified model is proposed in which theories are no longer given but a function of the division of labor in the model itself. The interactions of individuals balancing (...) the exploitation of existing theories and the exploration of new theories results in a robust cyclical pattern. (shrink)

Excerpt (in lieu of abstract) My aim in this paper is to put the spotlight on the following questions: how do lay Christians understand the relation between science and religion, and what can this tell us about the relationship between science and Christianity in a more academic setting? My focus will be on lay Christians in the US, in particular White Evangelicals. I will argue that American lay Christians, as well as American laypeople more generally, view the relationship between science (...) and religion as one of conflict. By contrast, conflict is a minority view in the academic literature on science and religion, where most authors defend a harmonious relationship (such as independence, dialogue, and integration). This disconnect between the academic literature and public perception should lead us to reflect on the social role of the science and religion debate. (shrink)

As neuroscience progresses, we will not only gain a better understanding of how our brains work, but also a better understanding of how to modify them, and as a result, our mental states. An important question we are faced with is whether the state could be justified in implementing such methods on criminal offenders, without their consent, for the purposes of rehabilitation and reduction of recidivism; a practice that is already legal in some jurisdictions. By focusing on a prominent type (...) of view of free action, which I call bypassing views, this paper evaluates how such interventions may negatively impact the freedom of their subjects. The paper concludes that there will be a tension between the goals of rehabilitation and reduction of recidivism, on the one hand, and the negative impact such interventions may have on free action, on the other. Other things equal, the better that a particular intervention is at achieving the former, the more likely it is to result in the latter. (shrink)

Internalism about moral responsibility is the view that moral responsibility is determined primarily by an agent's mental states; externalism is the view that moral responsibility is determined primarily by an agent's overt behaviour and by circumstances external to the agent. In a series of papers, Michelle Ciurria has argued that most if not all current accounts of moral responsibility, including Strawsonian ones, are internalist. Ciurria defends externalism against these accounts, and she argues that, in contrast to his contemporary followers, P.F. (...) Strawson himself was an externalist. I believe that Ciurria's reading of Strawson is problematic. The aim of this paper is to elucidate Strawson's position with regard to the internalism-externalism issue against the background of Ciurria's reading of him. I conclude that Strawson was neither an internalist nor an externalist about moral responsibility. I draw extensively upon the whole body of Strawson's work, much of which is sadly neglected in discussions of ‘Freedom and Resentment’, although it illuminates many of the issues discussed there. The ideas behind open source software are currently applied to the production of encyclopedias. A sample of six English text-based, neutral-point-of-view, online encyclopedias of the kind are identified: h2g2, Wikipedia, Scholarpedia, Encyclopedia of Earth, Citizendium and Knol. How do these projects deal with the problem of trusting their participants to behave as competent and loyal encyclopedists? Editorial policies for soliciting and processing content are shown to range from high discretion to low discretion; that is, from granting unlimited trust to limited (...) trust. Their conceptions of the proper role for experts are also explored and it is argued that to a great extent they determine editorial policies. Subsequently, internal discussions about quality guarantee at Wikipedia are rendered. All indications are that review and ?super-review? of new edits will become policy, to be performed by Wikipedians with a better reputation. Finally, while for encyclopedias the issue of organizational trust largely coincides with epistemological trust, a link is made with theories about the acceptance of testimony. It is argued that both non-reductionist views (the ?acceptance principle? and the ?assurance view?) and reductionist ones (an appeal to background conditions, and a?newly defined??expertise view?) have been implemented in editorial strategies over the past decade. Michael Zimmerman has recently argued against the twofold Strawsonian claim that there can be no moral responsibility without a moral community and that, as a result, moral responsibility is essentially interpersonal. I offered a number of objections to Zimmerman’s view, to which Zimmerman responded. In this article, I respond to Zimmerman’s responses to my criticisms.

En parte, ello se debe a la falta de criterios ético-políticos que delimiten el entendimiento propio de la violencia. El presente artículo ofrece una ruta de comprensión de la violencia de tal modo que sea circunscrita en la discusión sobre la participación de la ciudadanía disidente en contextos democráticos. Defenders of moral perception have famously argued that seeing value is relevantly similar to seeing color. Some critics think, however, that the analogy between color-seeing and value-seeing breaks down in several crucial respects. Defenders of moral perception, these critics say, have not succeeded in providing examples of non-moral perception that are relevantly analogous to cases of moral perception. Therefore, it can be doubted whether there is such a thing as moral perception at all. I argue that, although the analogy between (...) color perception and moral perception does indeed break down in several crucial respects, that conclusion does not weaken the case of defenders of moral perception, because better analogies are available. If defenders of moral perception seek to draw support from an analogy, then seeing emotion will protect them better against criticisms than will seeing color. (shrink)

While the notion of chance has been central in discussions over the probabilistic nature of natural selection and genetic drift, its role in the production of variants on which populational sampling takes place has received much less philosophical attention. This article discusses the concept of chance in evolution in the light of contemporary work in evo-devo. We distinguish different levels at which randomness and chance can be defined in this context, and argue that recent research on variability and evolvability demands (...) a causal understanding of variational probabilities under which development acquires a creative, rather than a constraining role in evolution. We then provide a propensity interpretation of variational probabilities that solves a conceptual confusion between causal properties, variational probabilities and extant variation present in the literature, and explore some metaphysical consequences that follow from our interpretation, specifically with regards to the nature of developmental types. Moral philosophy has traditionally aimed for correct or appropriate moral judgments. Consequently, when asked for moral advice, the moral philosopher first tries to develop a moral judgment and then informs the advisee. The focus is on what the advisee should do, not on whether any advice should be given. There may, however, be various kinds of reasons not to morally judge, to be ‘morally modest’. In the first part of this article, I give some reasons to be morally modest when (...) moral advice is asked for. Second, I show how Wittgenstein radicalizes these reasons to such an extent that the very possibility of giving moral advice seems threatened. Third, I argue that taking Wittgenstein and the need for moral modesty seriously does not make moral advice impossible, but rather asks for a notion of moral advice in which moral advice is not necessarily linked to the ideal of a moral judgment. Fourth, I highlight some advantages of a Wittgensteinian notion of moral advice over traditional notions. (shrink)

Many virtual communities that rely on user-generated content (such as social news sites, citizen journals, and encyclopedias in particular) offer unrestricted and immediate ‘write access’ to every contributor. It is argued that these communities do not just assume that the trust granted by that policy is well-placed; they have developed extensive mechanisms that underpin the trust involved (‘backgrounding’). These target contributors (stipulating legal terms of use and developing etiquette, both underscored by sanctions) as well as the contents contributed by them (...) (patrolling for illegal and/or vandalist content, variously performed by humans and bots; voting schemes). Backgrounding trust is argued to be important since it facilitates the avoidance of bureaucratic measures that may easily cause unrest among community members and chase them away. (shrink)

Wittgenstein’s comparison of philosophical methods to therapies has been interpreted in highly different ways. I identify the illness, the patient, the therapist and the ideal of health in Wittgenstein’s philosophical methods and answer four closely related questions concerning them that have often been wrongly answered by commentators. The results of this paper are, first, some answers to crucial questions: philosophers are not literally ill, patients of philosophical therapies are not always philosophers, not all philosophers qualify as therapists, the therapies are (...) not necessarily to be thought of as psychological therapies and the ideal of health does not consist in the end of philosophy. Second, the paper shows that the comparison has had a misleading effect, because properties of therapies have been illegitimately projected onto the philosophical methods advanced by Wittgenstein. RESUMO A inseminação artificial (IA) é a biotecnologia mais empregada com vantagens superiores em relação a utilização da monta natural, cuja eficácia se dá na larga escala de reprodução entre os bovinos. Associando essa biotécnica com hormônios pode-se estabelecer manipulações do sistema reprodutivo da fêmea, levando a manejos de inúmeras cabeças de gado para inseminar a um tempo fixo. Portanto, foram realizados 5 protocolos de IATF, tendo 2 categorias de animais: nulíparas e multíparas. No protocolo 1 foram submetidas 81 multíparas, (...) resultando em 47 animais prenhes; No protocolo 2 foram protocoladas 103 animais multíparas, no qual resultou em 51 prenhes; já o protocolo 5 foram submetidas 77 animais multíparas, no qual resultou em 36 animais prenhes. Cada serviço realizado foi matematicamente calculado, sendo o ponto de partida o escore corporal, bem estar animal e a técnica bem exercida. Desta forma obteve bons resultados na (IATF) , no qual destaca-se o percentual : o protocolo 1 obteve 58,02%, o protocolo 2 obteve 49,51% na taxa de prenhez, No protocolo 3 obteve 55,67% na taxa de prenhez, o protocolo 4 obteve 53,33% de prenhes, já o protocolo 5 resultou em 46,75% de prenhez. O uso das biotecnologias da reprodução, realizadas em bovinos de corte, obteve resultado dentro do descrito pela literatura consultada. A boa taxa de prenhes apresentada na IATF deveu-se ao bom controle hormonal do ciclo estral e da qualidade do sêmen utilizado. A taxa de prenhez dos animais que foram submetidos à monta natural foi baixa pelo fato de que os reprodutores não conseguiram cobrir todas as fêmeas. ABSTRACT The artificial insemination (AI) is the most used biotechnology with superior advantages in relation to the use of natural mounting, whose effectiveness is given in the large scale of reproduction among cattle. Associating this biotechnique with hormones it is possible to establish manipulations of the reproductive system of the female, leading to managements of numerous heads of cattle to inseminate at a fixed time. Therefore, 5 IATF protocols were performed, having 2 categories of animals: nulliparous and multiparous. In protocol 1, 81 multiparous animals were submitted, resulting in 47 pregnant animals; in protocol 2, 103 multiparous animals were submitted, resulting in 51 pregnancies; and in protocol 5, 77 multiparous animals were submitted, resulting in 36 pregnant animals. Each service performed was mathematically calculated, with the starting point being the body score, animal welfare and the well exercised technique. Thus obtained good results in the (IATF), which highlights the percentage: protocol 1 obtained 58.02%, protocol 2 obtained 49.51% in pregnancy rate, in protocol 3 obtained 55.67% in pregnancy rate, protocol 4 obtained 53.33% pregnant, and protocol 5 resulted in 46.75% pregnant. The use of the reproduction biotechnologies, performed in beef cattle, obtained results within the described by the consulted literature. The good pregnancy rate presented in the IATF was due to the good hormonal control of the estrous cycle and the quality of the semen used. The pregnancy rate of animals that were subjected to natural mating was low due to the fact that the sires could not cover all the females. Keywords: Hormones. Cattle Pregnancy Rate. Este trabalho pretende defender a necessidade de se trabalhar conteúdos relacionados a ética animal nos ambientes escolares, visando descontruir a visão antropocêntrica predominante nas sociedades ocidentais. Assim como evoluímos no combate ao racismo e ao sexismo, é necessário avançarmos para a superação do especismo. Por isso, considerando o papel da escola na formação de práticas e costumes em nossa sociedade, temos a responsabilidade de conduzir nossas crianças e jovens a uma compreensão mais justa e inclusiva de sociedade. Se faz necessário, (...) assim, uma reestruturação das práticas curriculares vigentes, elevando o ensino a um novo paradigma de educação integral, justa, inclusiva e igualitária, possível apenas por meio de uma educação não-especista. Começamos apresentando alguns conceitos importantes sobre ética animal, seguidos de uma argumentação a favor da superação do especismo. Por fim, discutimos as possibilidades de um conteúdo programático crítico, que propague a ética animal de modo transversal e interdisciplinar. (shrink)

Hacker communities of the 1970s and 1980s developed a quite characteristic work ethos. Its norms are explored and shown to be quite similar to those which Robert Merton suggested govern academic life: communism, universalism, disinterestedness, and organized scepticism. In the 1990s the Internet multiplied the scale of these communities, allowing them to create successful software programs like Linux and Apache. After renaming themselves the `open source software' movement, with an emphasis on software quality, they succeeded in gaining corporate interest. As (...) one of the main results, their `open' practices have entered industrial software production. The resulting clash of cultures, between the more academic CUDOS norms and their corporate counterparts, is discussed and assessed. In all, the article shows that software practices are a fascinating seedbed for the genesis of work ethics of various kinds, depending on their societal context. (shrink)

Two property regimes for software development may be distinguished. Within corporations, on the one hand, a Private Regime obtains which excludes all outsiders from access to a firm's software assets. It is shown how the protective instruments of secrecy and both copyright and patent have been strengthened considerably during the last two decades. On the other, a Public Regime among hackers may be distinguished, initiated by individuals, organizations or firms, in which source code is freely exchanged. It is argued that (...) copyright is put to novel use here: claiming their rights, authors write `open source licenses' that allow public usage of the code, while at the same time regulating the inclusion of users. A `regulated commons' is created. The analysis focuses successively on the most important open source licenses to emerge, the problem of possible incompatibility between them (especially as far as the dominant General Public License is concerned), and the fragmentation into several user communities that may result. Ao deduzir causa de efeito, ele acreditava chegar a uma causa primeira de todas as coisas. A essa primeira causa de tudo, onde toda a ordem e leis (...) tiveram início, a qual para ele assume um caráter divino, Newton aponta para um Deus sábio e poderoso e responsável pela ordem inteligente e pela a harmonia das leis físicas e universais de tudo o que existe – Deus como criador e preservador da ordem do universo. Há ainda a analogia do conceito de Deus com o espaço e o tempo, na medida em que ambos comunicam infinitude e onipresença. Por fim, nas considerações finais apontarei a importância de Newton para a metafísica moderna e como os seus estudos contribuíram para uma visão posterior do universo e suas leis e do homem enquanto ser pensante. Purpose This paper aims to formalize long-term trajectories of human civilization as a scientific and ethical field of study. The long-term trajectory of human civilization can be defined as the path that human civilization takes during the entire future time period in which human civilization could continue to exist. -/- Design/methodology/approach This paper focuses on four types of trajectories: status quo trajectories, in which human civilization persists in a state broadly similar to its current state into the distant future; catastrophe (...) trajectories, in which one or more events cause significant harm to human civilization; technological transformation trajectories, in which radical technological breakthroughs put human civilization on a fundamentally different course; and astronomical trajectories, in which human civilization expands beyond its home planet and into the accessible portions of the cosmos. -/- Findings Status quo trajectories appear unlikely to persist into the distant future, especially in light of long-term astronomical processes. Several catastrophe, technological transformation and astronomical trajectories appear possible. -/- Originality/value Some current actions may be able to affect the long-term trajectory. Whether these actions should be pursued depends on a mix of empirical and ethical factors. For some ethical frameworks, these actions may be especially important to pursue. (shrink)

The aim of this article is twofold. First, I want to offer an introduction of and a comparison between three accounts of philistinism. Secondly, I show how the phenomenon of philistinism, a failure to speak for oneself, helps to develop an original perspective on Wittgenstein’s moral thought. It is often claimed that Wittgenstein’s personal ethics were quite unorthodox because he repeatedly seems to have supported destruction, war and slavery. I argue that, in the light of my discussion of philistinism, the (...) remarks upon which such conclusions are based should be read differently. (shrink)

A common style of argument in the literature on free will and moral responsibility is the Manipulation Argument. These tend to begin with a case of an agent in a deterministic universe who is manipulated, say, via brain surgery, into performing some action. Intuitively, this agent is not responsible for that action. Yet, since there is no relevant difference, with respect to whether an agent is responsible, between the manipulated agent and a typical agent in a deterministic universe, responsibility is (...) not compatible with the truth of determinism. In response, some theorists have argued that there is a relevant difference, and have developed two sorts of accounts of that difference: bypassing views, and manipulator-focused views. Manipulator-focused views suggest that the difference concerns the presence of a manipulator, whereas bypassing views suggest that the relevant difference concerns the fact that the action issues from attitudes that the manipulated agent acquired in a way that bypassed her capacities for control over her mental life. One sort of case used to decide between these sorts of accounts is a case of machine induction, which is just like a manipulation case, yet the change in the agent is the result of some natural force. Against the received view, Xiaofei Liu argues that such cases pose problems for bypassing views, and favor manipulator-focused views instead. Desarrollar el recuento de la producción filosófica contemporánea no es una tarea sencilla. Más en nuestro país, donde se hacen pocos esfuerzos para comprender la dimensión real del pensamiento mexicano. Ello se debe a varios factores, entre los que pueden señalarse la apatía por conocer las reflexiones alrededor de temas nacionales, el poco interés que despiertan pensadores locales, la casi nula difusión que tienen algunas propuestas filosóficas y los esfuerzos aislados por componer una historia de la “filosofía de provincia”. En (...) la mayoría de los estados de la república, no existe una tradición sólida para publicar y debatir sistemáticamente la filosofía; tan lamentable carencia deviene con regularidad en la alimentación de una filosofía ficticia o en aislamiento de meditaciones originales y novedosas que no tienen la difusión que merecen. Para comprender parte de las causas de este problema, se propone, como experimento historiográfico, hacer una revisión de cuatro tesis vinculadas con la filosofía presentadas en el estado de Chihuahua entre 1968 y 1993; se incluye también la de José Fuentes Mares, defendida en la unam en 1944. Se parte del supuesto que en trabajos de esta naturaleza puede verse con cierta claridad la vocación, talento y disposición filosófica de los autores. Dado que no participa un comité editorial o un corrector de estilo, más allá de la guía del director de tesis, es poco el mejoramiento metodológico y estilístico que reciben las tesis, con lo que se evidencian carencias y fortalezas de los sustentantes. Se revisará tan sólo una muestra; sin embargo, estos trabajos son clave porque dos de ellos son de filósofos con reconocimiento nacional (Fuentes Mares y Rico Bovio), una es la primera tesis de la extinta maestría en Filosofía de la Universidad Autónoma de Ciudad Juárez (David Mariscal). Dos más fueron escritas por profesores que no se han dedicado a la investigación filosófica (Gilberto Vargas y Rubén Lau), y otras dos fueron escritas por exrectores de universidades chihuahuenses (Rubén Lau y Fuentes Mares). Los temas tocados (filosofía del derecho, antropología filosófica, filosofía griega e historia de la filosofía mexicana) brindan una panorámica de intereses y líneas de investigación –si así pudiera llamárseles– a los que se asoman los tesistas chihuahuenses. De esta manera, se está en condiciones de esbozar un “mapa intelectual” superficial en el que también podrán visualizarse ciertas tendencias en la docencia dentro del estado. -/- Palabras clave: historiografía de la filosofía, filosofía mexicana, filosofía contemporánea del norte de México. The idea that thought and language can be clarified through logical methods seems problematic because, while thought and language are not always exact, logic (by its very nature) must be. According to Kuusela, ideal (ILP, represented by Frege and Russell) and ordinary language philosophy (OLP, represented by Strawson) offer opposed solutions to this problem, and Wittgenstein combines the advantages of both. I argue that, given Kuusela’s characterisation of OLP, Strawson was not an OLP’er. I suggest that, instead of seeing ILP (...) and OLP as opposed to one another, it is better to regard OLP as an extension of ILP. (shrink)

O presente estudo, fruto de inquietação surgida em aulas de Filosofia no curso de mestrado em Direito pela Pontifícia Universidade Católica de São Paulo (PUC-SP), investiga a concepção filosófica da liberdade humana e o impacto da pena de prisão, visando à compreensão da eficácia da ressocialização. Com esta pesquisa, busca-se verificar como ocorre a privação de liberdade no Brasil para que se possa compreender de que forma o sistema de Justiça brasileiro persegue a almejada ressocialização prevista no art. 1º da (...) Lei nº 7.210/1984 (Lei de Execução Penal). Utilizando metodologia de levantamento bibliográfico, aborda-se inicialmente a perspectiva de renomados filósofos sobre a liberdade. Em seguida, traça-se uma análise histórica das origens das prisões e sua evolução como forma de punição estatal. O artigo também examina a realidade contemporânea do sistema carcerário, destacando violações de Direitos Humanos e dados estatísticos relevantes, além de considerar decisões da Suprema Corte brasileira. Conclui-se que a restrição da liberdade pode não ser o caminho para se atingir a ressocialização de pessoas que não utilizaram bem sua liberdade e, como consequência, cometeram crimes. Com isso, não se quer defender o fim da pena privativa de liberdade, mas reservar essa intervenção aos casos estritamente necessários. Diante do atual cenário de encarceramento em massa e do Estado de Coisas Inconstitucional do sistema carcerário, o Estado brasileiro não proporciona efetivavas condições à ressocialização dos detentos. Este estudo contribui para a discussão crítica da política de encarceramento a fim de contribuir com soluções para os desafios enfrentados pelo sistema prisional. (shrink)

Este trabalho trata do conceito Exu Diaspórico, o qual foi forjado para lidar com as pesquisas empíricas situadas dentro do quadro teórico da vaga decolonial. Sua concepção está ligada às tradições iorubanas diaspóricas nessa parte do Atlântico Sul onde emergiram outros sistemas resultantes, quer seja de fragmentos e vestígios de narrativas em gestos de memória e resistência, quer seja da tradução realizada pelo outro, muitas vezes, por meio de um processo de carnavalização cultural, que, por sua vez, se deu pela (...) convivência com os bantu, com os povos autóctones e com o colonizador europeu. Este conceito se articula com o conceito de língua-linguagem como encruzilhada apresentado por Araújo (2021a), mas pode ser tomado, ainda, de forma independente. Portanto, trata-se de uma discussão conceitual que visa contribuir com as reflexões e pesquisas decoloniais. O conceito também está a cargo de noções como negritude e Baianidade. Contudo, ele aparece para reunir todas as representações de Exu que resultaram da diáspora negra em meio a um processo de carnavalização das tradições iorubanas em contato com outras culturas e cosmologias. In order to fight massive vandalism the English- language Wikipedia has developed a system of surveillance which is carried out by humans and bots, supported by various tools. Central to the selection of edits for inspection is the process of using filters or profiles. Can this profiling be justified? On the basis of a careful reading of Frederick Schauer’s books about rules in general (1991) and profiling in particular (2003) I arrive at several conclusions. The effectiveness, efficiency, and risk-aversion of (...) edit selection all greatly increase as a result. The argument for increasing predictability suggests making all details of profiling manifestly public. Also, a wider distribution of the more sophisticated anti-vandalism tools seems indicated. As to the specific dimensions used in profiling, several critical remarks are developed. When patrollers use ‘assisted edit- ing’ tools, severe ‘overuse’ of several features (anonymity, warned before) is a definite possibility, undermining profile efficacy. The easy remedy suggested is to render all of them invisible on the interfaces as displayed to patrollers. Finally, concerning not only assisted editing tools but tools against vandalism generally, it is argued that the anonymity feature is a sensitive category: anons have been in dispute for a long time (while being more prone to vandalism). Targeting them as a special category violates the social contract upon which Wikipedia is based. The feature is therefore a candidate for mandatory ‘underuse’: it should be banned from all anti-vandalism filters and profiling algorithms, and no longer be visible as a special edit trait. Os Ensaios Políticos de Hume tiveram uma enorme audiência e considerável influência sobre seus contemporâneos. Mas as reflexões de Hume sobre a política nem sempre tiveram a atenção que merecem, situação que ultimamente vem se revertendo graças a uma série de estudos que iluminam a sua importância. É por isso mais que oportuna a publicação desta edição dos Ensaios, enriquecida com o estudo de João Paulo Monteiro, que, de forma pioneira em língua portuguesa, soube situar o interesse de Hume pela (...) política no quadro mais amplo de suas preocupações filosóficas, bem como mostrar a relevância de sua ciência política, entendida como uma ciência do possível, fundada na experiência histórica, dedicada ao estudo das leis constitucionais e de seus efeitos sobre a sociedade, de forma comprometida com as questões e impasses políticos de seu tempo. In this paper, I contend that Socrates' four arguments for the soul's immortality fail to provide conclusive proof. Instead, these arguments can be seen as attempts to infer the most plausible explanation. However, a closer examination reveals that Socrates' best explanation relies on a sequence of informal fallacies and ambiguities, ultimately resulting in inconsistencies within his comprehensive argument. These fallacies, ambiguities, and inconsistencies will become evident as we delve into Socrates' four arguments for soul immortality in the Phaedo.

El derecho a una muerte digna es ampliamente ignorado por el ordenamiento jurídico brasileño. Esta invisibilidad del proceso de finitud y sus consecuencias son el objeto de este estudio, que tiene como objetivo realizar una encuesta exploratoria para identificar los puntos relevantes que deben desarrollarse para garantizar un proceso de finitud digno. Se analizaron 50 publicaciones a través de una encuesta online y física de obras publicadas hasta marzo de 2023. Los estudios analizados expresan preocupación por los dilemas éticos de (...) la atención a seres humanos en finitud, pero no analizan las formas de pro-tección a la finitud existentes ni cuáles son las áreas que aún necesitan regulación para hacer efectiva esta atención. Se espera que esta investigación contribuya a fortalecer la visión crítica de la finitud, considerando la protección actual de la finitud, los límites jurídicos del Estado y los posibles pasos futuros para avanzar en los estudios aplicados a la actualización práctica del sistema jurídico brasileño. Friendship with the ancients is a set of imaginative exercises and engagements with the work of deceased authors that allows us to imagine them as friends. Authors from diverse cultures and times such as Mengzi, Niccolò Machiavelli, W.E.B Du Bois, and Clare Carlisle have engaged in it. The aim of this paper is to defend this practice, showing that friendship with the ancients is a species of philosophical friendship, which confers the unique benefits such friendships offer. It is conducive to (...) epistemic virtue, notably the related virtues of epistemic humility and of relational understanding. When we cultivate friendship with the ancients, we are not learning facts about them, but aim at understanding their views in their full scope in a way that a relationship between friends allows. In this paper we present an overview, with historical and critical remarks, of two articles by S. Jaśkowski ([20, 21] 1948 and [22, 23] 1949), which contain the oldest known formulation of a paraconsistent logic. Jaśkowski has built the logic – he termed discussive (D2) – by defining two new connectives and by introducing a modal translation map from D2 systems into Lewis’ modal logic S5. Discussive systems, for their formal details and their original philosophical justification, have attracted discrete attention (...) among experts. Indeed, in what follows, after having introduced Jaśkowski methodology of building D2 and his main philosophical motivations for providing such a system, we will explore some of the main contributions to the development of D2. In this paper, I argue that Callicles presents plausible reasons to accuse Socrates of employing subtle rhetorical maneuvers concerning the concepts of nature and convention. The central focus here is not whether Callicles' accusation against Socrates holds, but rather, it is an exploration of how Plato, through the dialogue between Socrates and Callicles, reveals the compelling rationale behind Callicles' belief in his correctness. Initially, Socrates treats Callicles as a worthy opponent in the conventional sense, engaging in dialectic discourse. However, as (...) Socrates' philosophical approach fails to resonate with Callicles, it becomes apparent that Socrates holds a different perspective on Callicles than he initially expressed. To support this thesis, this paper will closely examine Callicles' Great Speech and Socrates' concise speeches preceding and following it. (shrink)

In this paper, I argue that the quest for identifying Dionysus' Indian counterpart is a challenging endeavor, one that can only bear fruit when we shift our focus towards understanding Dionysus as a divine force of nature, which manifests in various ways, aligning with the essence conveyed in the Rig Veda verse mentioned earlier. Drawing from Nietzsche's perspective, where he perceives the Dionysian as an inherent force of nature within humanity, it becomes a more plausible hypothesis to establish a connection (...) between Dionysus and India through the lens of Indo-European comparative mythology and philology. De todos os aspectos do comportamento não-verbal, a face é sem dúvida uma das mais ricas e importantes fontes de informação sobre o estado inter- no do outro. Mas expressões faciais são raramente percebidas de forma isolada. Ao contrário, são tipicamente inseridas em contextos sociais ricos e dinâmicos, que incluem gestos e posturas corporais, conhecimento situacional, etc. Com base nessas observações, podemos nos perguntar se o contexto no qual uma expressão é percebida pode influenciar a percepção de emoções nesta expressão. (...) No caso de uma resposta afirmativa, de que modo se daria essa influência contextual, e quais seriam os seus limites? O propósito desse artigo é explorar algumas possibilidades sobre o papel do contexto na percepção de emoções, desde a teoria das emoções básicas, que defende que categorias discretas de emoções podem ser lidas diretamente da face de forma invariável, a abordagens mais contemporâneas, que atribuem um papel constitutivo para o contexto na percepção de emoções. Embora o debate esteja longe de ser resolvido, as conclusões deste artigo apontam para um novo modo de se pensar sobre fenômenos emocionais, onde a díade de interação torna-se a unidade básica de análise, e onde emoções são concebidas como propriedades emergentes de relações em contextos particulares de interação social. At the heart of this debate lies the contentious issue of attire. Both Jain sects acknowledge that Mahāvīra and his early adherent mendicants practiced nudity. However, their perspectives diverge significantly. For Digambaras, the act of going naked is considered fundamental and indispensable in the pursuit of liberation. According to their beliefs, one cannot achieve moksha without (...) embracing this practice, which is seen as a manifestation of perfection in one of the three jewels of Jainism: right conduct. A evidência textual primária confirma que Schopenhauer estava ciente da adoção generalizada do confinamento solitário no sistema penitenciário americano e alguns de seus efeitos prejudiciais. Ele entende sua perniciosidade no que diz respeito ao tédio, fenômeno pelo qual é conhecido por ter nele pensado e analisado extensivamente. Neste artigo, eu interpreto o relato de Schopenhauer sobre o tédio e sua relação com o confinamento solitário. Defendo Schopenhauer contra a objeção de que os casos de confinamento servem apenas para ilustrar a (...) inadequação geral de sua explicação do tédio como a falta de coisas para se querer. Esta defesa chega à conclusão de que, ao contrário, alguém pode muito bem sofrer da falta de coisas para querer como resultado direto de estar confinado; e que o tédio, entendido como a privação de vontade — fenômeno que sugiro poder ser chamado de privação conativa — faz uma contribuição esclarecedora para a nossa compreensão teórica da nocividade do confinamento solitário. Throughout Herman Hesse's "Demian," the strategic use of verbal irony is a powerful tool to shed light on Sinclair's arduous journey in navigating his immaturity and eventual growth. Sinclair's initial hesitancy to confront his callowness is evident as he cautiously explores his evolving sense of self through interactions with friends and family. He often cloaks his true feelings in indirect speech, avoiding confrontations with the consequences of his immaturity. As Sinclair matures, he finds himself straddling the delicate balance between the (...) security of his familial cocoon and the intimidating outside world. He grapples with the fear that speaking his unfiltered thoughts and facing the repercussions might jeopardize the comfort of his closest relationships, guiding him on his path. Despite his awareness of the existential loneliness and isolation that awaits him beyond these relationships, he yearns for personal growth, even if it entails enduring solitude and pain. The use of verbal irony plays a pivotal role in illuminating the gradual transformation Sinclair undergoes as he shifts from callousness to a budding acceptance of his existential reality, ultimately coming to terms with his true self. This transformation is evident in moments such as when Demian chastises him for attempting to offer money to Kromer, when he grapples with the guilt of hurting Pistorius, and when his father confronts him during his time at the boarding school. In the late 18th and early to mid-19th century, the secular approach of certain German scholars towards the study of Sanskrit in Europe significantly impacted the creation of the Wales Professorship of Sanskrit at Harvard. This influence stood in stark contrast to the religious concerns of some English scholars. While these English academics were focused on assisting in converting Hindus to Christianity, their German counterparts were pioneering the field of comparative philology. This dynamic led to the establishment of the Boden (...) Professorship of Sanskrit at Oxford, the dominance of German scholars in teaching Sanskrit on the European continent, and the mentorship provided by German academics to early American scholars interested in studying India. These developments underscore the interplay between the secular, scholarly approach of German academics and the religious concerns of their English counterparts in the study of Sanskrit. (shrink)

Este ensaio celebra as cinco décadas da publicação do livro A ordem do discurso de Michel Foucault, realizando uma reflexão acerca de sua repercussão entre as ciências sociais e sobre seus usos, principalmente, no campo da linguagem na parte relacionada à análise do discurso de linha francesa. Portanto, trata-se de uma retrospectiva crítica cuja análise começa com a entrevista que Foucault concedeu algumas semanas antes de proferir esta aula aos brasileiros Sergio Paulo Rouanet e José Guilherme Merquior. Em seguida, o (...) presente trabalho faz uma breve história da entrada de Foucault ao Collège de France e, por fim, lida com a microfísica do discurso que se encontra nesta aula, sobretudo, da rarefação do sujeito, além dos seus usos nas ciências humanas e sociais mais o campo da linguagem em torno da pragmática e das análises de discurso. Many approaches have been taken regarding this topic, some of them are anthropological or scientific that pursue the understanding of why we eat meat, but from the philosophical lens this question is solved in the field of applied ethics, which is the area that debate about the moral status of animals (nonhuman animals) and where different theorizations that tried to explain the relationship between animals and humans and the examination of the morality of meat consumption take place. O presente artigo aborda a instituição de órgãos de polícia como representantes do poder e da autoridade do Estado sob a ótica da filosofia, sobretudo no contexto do contrato social, fundamentada em revisão bibliográfica. Ainda que o homem tenha preterido sua liberdade natural em prol de uma liberdade assistida, e sendo a polícia um dos órgãos responsáveis por essa assistência, não há como afirmar que esse trabalho está correspondendo aos anseios da sociedade, sobretudo ao se analisar os índices de violência (...) que a envolvem. Nesse sentido, a sociedade vem questionando a necessidade da existência dessas instituições, muitas vezes, inclusive, pedindo sua extinção. (shrink)
