In this paper I argue that Kant’s psychology of moral motivation has less in common with Hutcheson’s view than interpreters have traditionally thought. I first offer an interpretation of the role that feeling, desire, and cognition play in Kant’s account of moral action. I then outline the essential features of Hutcheson’s understanding of desire before arguing that although Kant and Hutcheson share the trivial similarity that even moral action springs from a desire, Kant conceives of the desire at the root (...) of moral action as qualitatively different from all other desires in a number of important ways. Almost all philosophers interested in parthood and composition think that a composite object is a further thing, numerically distinct from the objects that compose it. Call this the orthodox view. I argue that the orthodox view is false, and that a composite object is identical to the objects that compose it (collectively). This view is known as composition as identity. -/- I argue that, despite its unpopularity, there are many reasons to favour com- position as identity over the orthodox view. (...) First, defenders of the orthodox view have not offered complete theories of composition. For instance, they have not given adequate accounts of heterogeneous properties like being black and white in composite objects. Nor have they given satisfactory explanations for the necessary connections that hold between composite objects and their proper parts. -/- Second, there appears to be no good way for defenders of the orthodox view to remedy this. Any account of the heterogeneous properties of composite objects which is compatible with the orthodox view faces serious problems, as does any account of the necessary connections between an object and its proper parts. Composition as identity, on the other hand, is compatible with intuitive responses to both of these challenges. -/- Third, there are a number of strong arguments in favour of composition as identity. For example, composition as identity fits our evidence about the way the world is better than the orthodox view does. It also allows us to easily maintain that composition sometimes occurs and sometimes does not—i.e., it allows us to easily maintain that composition is restricted. The orthodox view does not. The theories of composition put forward by most philosophers are at best incomplete or in need of improvement. At worst, they are false and composition as identity is true. (shrink)

According to the thesis of the guise of the normative, all desires are associated with normative appearances or judgments. But guise of the normative theories differ sharply over the content of the normative representation, with the two main versions being the guise of reasons and the guise of the good. Chapter 6 defends the comparative thesis that the guise of reasons thesis is more promising than the guise of the good. The central idea is that observations from the theory of (...) content determination can be used in order to constrain possible theories of the representational contents associated with desire. The authors argue that the initially most promising versions of the guise of the good fail to meet these constraints, and then explain the steep challenge confronting any who wish to craft a new guise of the good theory which meets the constraints while also preserving the initial motivations for adopting any guise of the normative theory at all. But a simple version of the guise of reasons not only avoids the troubles besetting the guise of the good but proceeds immediately from a deep diagnosis of the source of its difficulties. (shrink)

What is the status of research on implicit bias? In light of meta‐analyses revealing ostensibly low average correlations between implicit measures and behavior, as well as various other psychometric concerns, criticism has become ubiquitous. We argue that while there are significant challenges and ample room for improvement, research on the causes, psychological properties, and behavioral effects of implicit bias continues to deserve a role in the sciences of the mind as well as in efforts to understand, and ultimately combat, discrimination (...) and inequality. What is human understanding and why should we care about it? I propose a method of philosophical investigation called ‘function-first epistemology’ and use this method to investigate the nature and value of understanding-why. I argue that the concept of understanding-why serves the practical function of identifying good explainers, which is an important role in the general economy of our concepts. This hypothesis sheds light on a variety of issues in the epistemology of understanding including the role of explanation, the relationship (...) between understanding-why and knowledge, and the value of understanding-why. I conclude that understanding-why is valuable and yet knowledge plays more important roles in our epistemic life. (shrink)

Conferralism is the view that social properties are neither intrinsic to the things that have them nor possessed simply by virtue of their causal or spatiotemporal relations to other things, but are somehow bestowed (intentionally or not, explicitly or not) upon them by persons who have both the capacity and the standing to bestow them. We argue that conferralism faces a dilemma: either it is viciously circular, or it is limited in scope in a way that undercuts its motivation.

A common view about the phenomenology of episodic remembering has it that when we remember a perceptual experience, we can relive or re-experience many of its features, but not its characteristic presence. In this paper, we challenge this common view. We first say that presence in perception divides into temporal and locative presence, with locative having two sides, an objective and a subjective one. While we agree with the common view that temporal and objective locative presence cannot be relived in (...) remembering, we argue that subjective locative presence – the feeling of being immersed in a certain scene – can be so. Our argument for this claim starts by determining independently the underpinning mechanisms of subjective locative presence in quasi-perceptual imagination. These mechanisms are self-projection, imaginative pretence, and attentional focus. We then proceed to establish that they have been found to underpin conscious states of episodic remembering too. We conclude that episodic remembering can bring us to relive the subjective locative presence characteristic of a perceptual experience, and that the common view is mistaken. Our view – ‘mnemonic immersivism’ – has important consequences regarding the relationships between memory and imagination and the phenomenology of episodic remembering. (shrink)

This paper asks whether there is a moral virtue of hope, and if so, what it is. The enterprise is motivated by a historical asymmetry, namely that while Christian thinkers have long classed hope as a theological virtue, it has not traditionally been classed as a moral one. But this is puzzling, for hoping well is not confined to the sphere of religion; and consequently we might expect that if the theological virtue is structurally sound, there will be a secular, (...) moral analogue. This paper proposes that there is such an analogue, and that it is closely linked to the everyday notion of “having your priorities straight,” a phenomenon which is naturally understood in terms of the attitude of hope. It turns out that the priorities model provides an abstract way of characterizing a central but underexplored virtue, one which can be developed in secular or theological ways. (shrink)

There is a loud and persistent drum beat of support for schools, for citizenship, for diversity and inclusion, and increasingly for labor market readiness with very little critical attention to the assumptions underlying these agendas, let alone to their many internal contradictions. Accordingly, in this book I examine the philosophical, motivational, and practical challenges of education theory, policy, and practice in the twenty-first century. As I proceed, I do not neglect the historical, comparative international context so essential to better understanding (...) where we are, as well as what is attainable in terms of educational justice. I argue that we must constructively critique some of our most cherished beliefs about education if we are to save the hope of real justice from the rhetoric of imagined justice. (shrink)

Moral philosophy continues to be enriched by an ongoing empirical turn,mainly through contributions from neuroscience, biology, and psychology. Thusfar, cultural anthropology has largely been missing. A recent and rapidly growing‘ethical turn’ within cultural anthropologynow explicitly and systematically studiesmorality. This research report aims to introduce to an audience in moral philosophyseveral notable works within the ethical turn. It does so by critically discussing theethical turn’s contributions to four topics: the definition of morality, the nature ofmoral change and progress, the truth of (...) moral relativism, and attempts to debunkmorality. The ethical turn uncovers a richer picture of moral phenomena on theintersubjective level, one akin to a virtue theoretic focus on moral character, withstriking similarities of moral phenomena across cultures. Perennial debates are notsettled but the ethical turn strengthens moral philosophy’s empirical turn and itrewards serious attention from philosophers. (shrink)

This paper shows how the availability heuristic can be used to justify inference to the best explanation in such a way that van Fraassen's infamous "best of a bad lot" objection can be adroitly avoided. With this end in mind, a dynamic and contextual version of the erotetic model of explanation sufficient to ground this response is presented and defended.

John D. Norton is responsible for a number of influential views in contemporary philosophy of science. This paper will discuss two of them. The material theory of induction claims that inductive arguments are ultimately justified by their material features, not their formal features. Thus, while a deductive argument can be valid irrespective of the content of the propositions that make up the argument, an inductive argument about, say, apples, will be justified (or not) depending on facts about apples. The argument (...) view of thought experiments claims that thought experiments are arguments, and that they function epistemically however arguments do. These two views have generated a great deal of discussion, although there hasn’t been much written about their combination. I argue that despite some interesting harmonies, there is a serious tension between them. I consider several options for easing this tension, before suggesting a set of changes to the argument view that I take to be consistent with Norton’s fundamental philosophical commitments, and which retain what seems intuitively correct about the argument view. These changes require that we move away from a unitary epistemology of thought experiments and towards a more pluralist position. (shrink)

Suppose that A explains B. Do A and B need to be true? Provided that we have metaphysical explanation in mind, orthodoxy answers “yes:” metaphysical explanation is factive. This article introduces and defends a non-factive notion of metaphysical explanation. I argue that we need a non-factive notion of explanation in order to make sense of explanationist arguments where we motivate a view by claiming that it offers better explanations than its competitors. After presenting and rejecting some initially plausible rivals, I (...) account for non-factive metaphysical explanation by drawing on existing applications of structural equation models to metaphysical grounding. The Growing Block Theory of time says that the metaphysical openness of the future should be understood in terms of there not being any future objects or events. But in a series of works, Ross Cameron, Elizabeth Barnes, and Robbie Williams have developed a competing view that understands metaphysical openness in terms of it being indeterminate whether there exist future objects or events. I argue that the three reasons they give for preferring their account are not compelling. And since the (...) notion of “indeterminate existence” suffers conceptual problems, the Growing Block is the preferable view. (shrink)

This chapter explores an unappreciated psychological dimension of intellectual humility. In particular, I argue there is a plausible connection between intellectual humility and epistemic egocentrism. Epistemic egocentrism is a well-known cognitive bias – often called ‘the curse of knowledge’ – whereby an agent attributes his or her own mental states to other people. I hypothesize that an individual who exhibits this bias is more likely to possess a variety of traits that are characteristic of intellectual humility. This is surprising because (...) intellectual humility is often regarded as an antidote to cognitive biases, whereas I claim that a particular cognitive bias (namely, the curse of knowledge) may help foster an intellectual virtue. “We are experiencing an ecological and social crisis, driven by exponential capital accumulation, whose end result will be the extinction of human civilisation” (p. 18). While it is easy to shrug off such a dramatic claim, in Alienation, Spectacle, & Revolution: A Critical Marxist Essay, Neil Faulkner takes this relatively strong claim and endeavors to demonstrate its truth. Thus begins his project of updating our understanding of alienation—not an easy task, but one that Faulkner does well. In a time of (...) a simultaneous dearth and deluge of information, Faulkner attempts to pull apart the dialectical and economic structures of the third industrial revolution and follows the breadcrumbs until he comes to a different “end of history.” Faulkner, who died in February 2022, was an archeologist and a political activist. He was a member of the Socialist Workers Party in the U.K. for many years and later a founding member of Anti-Capitalist Resistance. He wrote on topics ranging from the Arab-Anglo conflict to the history of the Olympics. While his corpus spanned several subjects, his books and articles all have a bitingly Marxist take that brought Faulkner much acclaim. (shrink)

The comprehension of anaphoric relations may be guided not only by discourse, but also syntactic information. In the literature on online processing, however, the focus has been on audible pronouns and descriptions whose reference is resolved mainly on the former. This paper examines one relation that both lacks overt exponence, and relies almost exclusively on syntax for its resolution: adjunct control, or the dependency between the null subject of a non-finite adjunct and its antecedent in sentences such as Mickey talked (...) to Minnie before ___ eating. Using visual world eyetracking, we compare the time course of interpreting this null subject and overt pronouns (Mickey talked to Minnie before he ate). We show that when control structures are highly frequent, listeners are just as quick to resolve reference in either case. When control structures are less frequent, reference resolution based on structural information still occurs upon hearing the non-finite verb, but more slowly, especially when unaided by structural and referential predictions. This may be due to increased difficulty in recognizing that a referential dependency is necessary. These results indicate that in at least some contexts, referential expressions whose resolution depends on very different sources of information can be resolved approximately equally rapidly, and that the speed of interpretation is largely independent of whether or not the dependency is cued by an overt referring expression. I argue that in purely professional games of pure chance, such as slot machines, roulette, baccarat or pachinko, any instance of cheating that successfully deceives the judge can be ‘part of the game’. I examine, and reject, various proposals for the ‘ethos’ that determines how we ought to interpret the formal rules of games of pure chance, such as being a test of skill, a matter of entertainment, a display of aesthetic beauty, an opportunity for hedonistic pleasure, and a fraternal (...) activity. Ultimately, I argue that ‘winning the benefit’ is the only ethos that can apply in purely professional games of pure chance, and that if we interpret the formal rules according to this ethos, cheating that is undertaken with respect for the judge’s authority, but that attempts to cause the judge of the game to ‘voluntarily’ relinquish the benefit of the game by deceiving them into thinking that the formal rules of the game have been followed, is impermissible but acceptable cheating, and is therefore within, rather than outside, the game. Here, I define ‘games of pure chance’ as games in which chance is the only determinant of winning. (shrink)

Influential thinkers such as Young, Sugden, Binmore, and Skyrms have developed game-theoretic accounts of the emergence, persistence and evolution of social contracts. Social contracts are sets of commonly understood rules that govern cooperative social interaction within societies. These naturalistic accounts provide us with valuable and important insights into the foundations of human societies. However, current naturalistic theories focus mainly on how social contracts solve coordination problems in which the interests of the individual participants are aligned, not competition problems in which (...) individual interests compete with group interests. In response, I set out to build on those theories and provide a comprehensive naturalistic account of the emergence, persistence and evolution of social contracts. My central claim is that social contracts have culturally evolved to solve cooperation problems, which include both coordination and competition problems. I argue that solutions to coordination problems emerge from “within-group” dynamics, while solutions to competition problems result largely from “between-group” dynamics. (shrink)

In this essay we argue for the Janus-faced nature of hope. We show that attempts to sanitise the concept of hope either by separating it conceptually from other phenomena such as wishful thinking, or, more generally, by seeking to minimise the negative aspects of hope, do not help us to understand the nature of hope and its functions as regards religion. Drawing on functional accounts of religion from Clifford Geertz and Tamas Pataki, who both—in their different ways—see the function of (...) religion in terms of its capacity to satisfy deep psychological needs, we demonstrate that religion uniquely positions itself with regard to hope’s two faces, simultaneously exploiting positive and negative aspects of hope. We argue that, insofar as one accepts either supersubstantivalism or strong composition as identity for the usual reasons, one has (defeasible) reasons to accept the other as well. Thus, all else being equal, one ought to find the package that combines both views—the Identity Package—more attractive than any rival package that includes one, but not the other, of either supersubstantivalism or composition as identity.

This chapter introduces and discusses the concepts of necessary and sufficient conditions.

We study active set methods for optimization problems in Block Angular Form (BAF). We begin by reviewing some standard basis factorizations, including Saunders' orthogonal factorization and updates for the simplex method that do not impose any restriction on the pivot sequence and maintain the basis factorization structured in BAF throughout the algorithm. We then suggest orthogonal factorization and updating procedures that allow coarse grain parallelization, pivot updates local to the affected blocks, and independent block reinversion. A simple parallel environment appropriate (...) to the description and complexity analysis of test procedures is defined in Section 5. The factorization and updating procedures are presented in Sections 6 and 7. Our update procedure outperforms conventional Updating procedures even in a purely sequential environment. (shrink)

This paper investigates Kant’s account of “real essence” and of a thing’s “nature”. Notwithstanding their wide negligence in the literature, these concepts belong to the central ones of Kant’s metaphysics. I argue that, on the one hand, Kant is in continuity with the Aristotelian-Scholastic tradition of essence. But, on the other hand, he also follows Locke in distinguishing between “logical” and “real” essence. Contrary to recent attempts of aligning real essence with contemporary approaches to essence, I will defend the thesis (...) that Kant equates real essence and (formal) nature, and that real essence has a causal, but no constitutive role. I shall also respond to potential objections and discuss some developments of Kant’s views. (shrink)

In diesem Aufsatz argumentiere ich, dass die Standardauffassung von Propositionen und propositionalen Einstellungen inadäquat ist, ein Artefakt der gegenwärtig herrschenden theorielastigen Auffassung von Intentionalität, Sprache und Rationalität, und skizziere eine alternative Auffassung. Im folgenden Abschnitt belege ich erst einmal die These der Theorielastigkeit anhand einiger Beispiele vor allem aus der gegenwärtigen analytischen Philosophie. Der dritte Abschnitt erklärt, wie diese Theorielastigkeit im Standardverständnis von Propositionen und propositionalen Einstellungen verkörpert ist. Im vierten Abschnitt argumentiere ich, dass dieses Standardverständnis der Proposition zwei unvereinbare (...) Rollen zuweist. Sie kann nicht sowohl einen Sachverhalt repräsentieren, der Gegenstand praktischer genauso wie theoretischer Stellungnahmen sein kann, als auch wie eine theoretische Stellungnahme Wahrheitswertträger sein. Im neunten Abschnitt verorte ich die tieferen Wurzeln der Theorielastigkeit in dem Verlangen, das Praktische an die dem Theoretischen eigene Form der Objektivität zu assimilieren. Dieses Verlangen muss aber fruchtlos bleiben, und die dem Praktischen eigene Form der Objektivität wird so verfehlt. Kant’s doctrine of the “transcendental object” has always puzzled interpreters. On the one hand, he says that the transcendental object is the object to which we relate our representations. On the other hand, he declares the transcendental object to be unknowable and identifies it with the thing in itself. I argue that this poses a problem that Kant only in the B edition of the Critique solves in a satisfactory manner. According to this solution, we ascribe sensible predicates to things (...) in themselves, but only insofar as they appear. I conclude that this could motivate a phenomenalist account of Kant’s idealism, but one that gives due weight to the role of things in themselves. (shrink)

I argue that John Hick’s soul-making theodicy is committed to opposing social progress. By focusing on justifying the current amount and distribution of suffering and evil, Hick’s theodicy ends up having to condemn even positive change as undesirable. First, I give a brief outline of Hick’s theodicy, with a particular emphasis on the role of earned virtue in justifying the existence of evil. Then I consider two understandings of social progress: progress as the elimination of suffering and evil; and progress (...) as the promotion of earned virtue. I further distinguish the earned virtue understanding of social progress into two kinds, in which the relationship between social structures and moral growth either: allows members of a more advanced society to start closer to perfection; or allows members of a more advanced society to progress more quickly. I argue that no matter which approach we take, Hick’s theodicy struggles with the idea of social progress. Hick is either straightforwardly committed to opposing social progress, or he can support it only at the expense of being unable to justify status quo of suffering and evil. (shrink)

Kant’s postulate of possibility states that possible is whatever agrees with the formal conditions of experience. As has often been noted, this is a definition of real possibility. However, little attention has been paid to the relation of Kantian real possibility to the German philosophical tradition before him. I discuss three kinds of possibility present in this tradition – internal, external, and (Crusian) real possibility – and argue that Kant endorses internal and external possibility. Furthermore, I show, specifically with respect (...) to the concept of state (Zustand), that the three traditional conceptions are reminiscent of three conceptions of real possibility that Kant implicitly distinguishes. Lastly, I argue that, according to Kant, we need experience to prove real possibility (at least as regards the three conceptions of the real possibility of states) because otherwise we could not know whether the formal conditions of experience obtain. In addition to the Frege point, Frege also argued for the force-content distinction from the fact that an affirmative answer to a yes-no question constitutes an assertion. I argue that this fact more readily supports the view that questions operate on and present assertions and other forceful acts themselves. Force is neither added to propositions as on the traditional view, nor is it cancelled as has recently been proposed. Rather higher level acts such as questioning, but also e.g. conditionalizing, embed (...) assertive or directive acts that are forceful and committal, while suspending commitment to them. The Frege point confounds different varieties of force and the question whether something is merely presented for consideration with the question what is so presented. Force is representational: through assertoric and directive force indicators subjects non-conceptually present positions of theoretical or practical knowledge, while interrogative acts indicate positions of wondering which strive for such knowledge. Dualism about possible worlds says that merely possible worlds aren’t concrete objects, but the actual world is concrete. This view seems to be the natural one for ersatzers about merely possible worlds to take; yet one is hard-pressed to find any defenders of it in contemporary modal metaphysics. The main reason is that Dualism struggles with the issue of how merely possible worlds could have been actual. I explain that there are two different Dualist strategies that can be taken to (...) address the problem. Furthermore, one or other of these strategies should be plausible to anyone who accepts both Existentialism—which tells us that the existence of singular propositions depends on what they directly refer to—and Serious Actualism—which tells us that things must exist in order to instantiate properties. One of the main tasks for an account of the Christian doctrine of the atonement is to explain how and in what ways the salvifically relevant work of Christ heals the damage wrought by human sin on our souls, our relationships with one another, and our relationship with God. One kind of damage often neglected in philosophical treatments of the atonement, but discussed at some length in Eleonore Stump’s forthcoming At-one-ment, is what she, following St. Thomas Aquinas, calls the stain (...) on the soul. The stain on the soul comprises the “moral leftovers” of serious evil, damage to the soul that goes beyond the guilt, shame, and separation from God brought about by sin and that lingers in a person even after she has repented and been forgiven. In this paper, I critically examine Stump’s account of how the work of Christ deals with the problem of the stain on the soul. I offer reasons for thinking that if the stain is exactly as she describes it, then it is indelible; and then I explore possible ways forward for her account of the atonement. (shrink)

This paper proposes a novel reading of Kant’s account of the dependence of possibility on God in the pre-Critical Beweisgrund. I argue that Kant has a theistic-potentialist conception of the way God grounds possibility, according to which God grounds possibility by his understanding and will. The reason is that Kant accepts what I call the Principle of Possible Existence: If something is possible, then it is possible that it exists. Furthermore, I explore the connection between causal powers and possibility, the (...) influence of Crusius on Kant, and the significance of the distinction between internal and external possibility. In this article, I advance a novel hypothesis on the evolution of hominin bipedalism. I begin by arguing extensively for how the transition to bipedalism must have been problematic for hominins during the Neogene. Due to this and the fact that no other primate has made the unusual switch to bipedalism, it seems likely that the selection pressure towards bipedalism was unusually strong. With this in mind, I briefly lay out some of the most promising hypotheses on the evolutionary origin (...) of hominin bipedalism and show how most, if not all, fail in the face of the need for an unusually strong selection pressure. For example, some hypotheses maintain that hominins became bipedal so they could use their hands for carrying infants, food, or other valuable objects. But extant apes are able to carry objects in one of their front limbs (while walking with the other three), and thus it does not seem plausible that our hominin ancestors went through the troublesome transition to bipedalism just so they could carry objects a little more efficiently. After I show that past hypotheses are wanting in the face of this challenge, I argue that there is only one selection pressure powerful enough to instigate a strange and problematic evolutionary adaptation like bipedalism, and that is sexual selection. Specifically, from the fact that bipedal locomotion is an important strategy for intimidating others and ascending the dominance hierarchy in extant apes, I argue that for no particular selective reason bipedal locomotion became a signal for high fitness (much as a large and intricate tail became a signal for high fitness for peahens), and this led to the trait being continuously reinforced in spite of all its deleterious fitness consequences. How can consciousness, how can the mind be causally efficacious in a world which seems—in some sense—to be thoroughly governed by physical causality? Mental causation has been a nagging problem in philosophy since the beginning of the modern age, when, inspired by the rise of physics, a metaphysical picture became dominant according to which the manifest macrophysical world of rocks, trees, colors, sounds etc. could be eliminated in favor of, or identified with, the microconstituents of these entities and their basic (...) physical properties, plus their effects on human or animal minds. Against the background of this ontology, the argument from causal closure, or the causal completeness of physics, exerts strong pressure to also identify consciousness with microphysical entities—or even to eliminate it in favor of the latter—the only other options apparently being either the denial of the causal closure of the physical level, epiphenomenalism about the mind, or the view that its physical effects are generally overdetermined. In this paper, however, I want to introduce what I call the “microstructure view” (MV) of the brain-consciousness relation, and I want to try to make plausible that the problem of mental causation can also be solved, or perhaps rather dissolved, on the basis of this account. On the MV, the minimal neuronal correlates of consciousness—of the global state of consciousness, or specific states of consciousness such as pain—are not identical with these states, but rather constitute their microstructure, or, as I shall also say, equivalently, compose them. How can the law be characterized in a theory of collective intentionality that treats collective intentionality as essentially layered and tries to understand these layers in terms of the structure and the format of the representations involved? And can such a theory of collective intentionality open up new perspectives on the law and shed new light on traditional questions of legal philosophy? As a philosopher of collective intentionality who is new to legal philosophy, I want to begin exploring these questions (...) in this paper. I will try to characterize the law in terms of the layered account of collective intentionality that I have introduced in some earlier writings (Schmitz 2013; 2018). In the light of this account I will then discuss a traditional question in the philosophy of law: the relation between law and morality. I begin by giving a brief sketch of the layered account in the next section. Collective intentionality should be understood in terms of experiencing and representing others as co-subjects, rather than as objects, of intentional states and acts on different layers or levels. I distinguish the nonconceptual layer of the joint sensory-motor-emotional intentionality of joint attention and joint bodily action, the conceptual level of shared we-mode beliefs, intentions, obligations, values, and so on, and the institutional level characterized through role differentiation, positions taken in role-mode, e.g. as a judge or attorney, and writing and other forms of documentation. In the third section I introduce a set of parameters for representations such as their degree of richness, of context-dependence, of density and differentiation of representational role and of durability and stability, which can be used to more precisely distinguish different layers. I also put forward the hypothesis that these properties are connected and tend to cluster, and that higher levels can only function and determine conditions of satisfaction against lower level ones. In the fourth and final section I critically discuss the sharp positivistic separation of morality and the law according to which whether something is a law is completely independent of its moral merits. I argue that this only seems plausible if we take an observational stance towards the law, but not towards morality. When we treat them the same way, it rather appears that the moral attitudes of the co-subjects of a society will determine whether and to what extent they will accept its legal order. I conclude by proposing to think of the law as being itself an institutionalized form of morality. (shrink)

As Richard Bernstein has suggested, there is a very rich and interesting story to be told about how the classical pragmatists (Dewey, Peirce, and James) understood G. W. R Hegel, made use of Hegel, and ultimately distanced themselves from Hegel. That story cannot be told here. Indeed, the story is so rich and complicated that even its beginnings cannot be told here. But what can be provided, perhaps, is a limited, though hopefully illuminating, perspective on a few salient aspects of (...) the relationship between the classical pragmatists and Hegel. While the following reflections offer no definitive answers about this relationship, they might at least suggest some fruitful lines of enquiry for future discussion. (shrink)

In an important article published in this journal, Dryzek, Bächtiger and Milewicz (2011) champion the convocation of a Deliberative Global Citizens’ Assembly (DGCA). In this article, I aim to further strengthen the case for a DGCA by addressing: (i) why a DGCA is likely to take a long-term perspective in the global interest and (ii) why it is so vital that a global institution should do so. I start by analyzing the nature of the issues requiring global policy. These issues, (...) I will argue, are typically global cooperation problems. Cooperation problems pose two major challenges. The first is to prevent freeriding – i.e. serving one’s short-term interests at the expense of the long-term global interest. The second is to align on an efficient global policy. In both respects, I will argue, a DGCA is a good candidate to yield desirable results (and is likely to do better than current supranational institutions). (shrink)

We address the most fundamental yet routinely ignored issue in economics today: that of distributive impact of the monetary system on the real economy. By re-examining the logical implications of token re-presentation of value and Irving Fisher’s theory of exchange, we argue that producers of value incur incidental expropriation of wealth associated with the deflationary effect that new value supply has on the purchasing power of money. In order to remedy the alleged inequity we propose a value-added negative tax (VANT) (...) based on net individual contribution to the economic output, which is structured as a negative tax function geared to profits derived from eligible productive activities in consideration of their estimated deflationary impact. We show that an adequately optimised VANT can be non-inflationary and have zero net cost to the public. Furthermore, economic output stands to improve due to direct incentivisation of value creation, making the proposed scheme not only politically feasible but economically desirable. The proposal advances the principle of ‘fair money’, where all forms of economic value are attributed to their rightful owners prior to any positive taxation. (shrink)

With its June 2004 statement Catholics in Political Life, the United States Conference of Catholic Bishops opened an important and far-reaching discussion about how Catholic individuals ought to comport themselves in political life, and-indirectly-about how Catholic institutions-including Catholic law schools-ought to decide whether or not to give awards, honors, or platforms to those whose views about key moral and political issues may differ from the views expressed in the teachings of the Catholic Church. On the basis of a simple and (...) straightforward reading of the 2004 statement, it might appear that the bishops wanted to say that no Catholic institution-and thus no Catholic law school-should give awards, honors, or platforms to those who endorse or promote views that differ from the fundamental moral teachings of the Church. An important part of the statement plainly declares: "The Catholic community and Catholic institutions should not honor those who act in defiance of our fundamental moral principles. They should not be given awards, honors or platforms which would suggest support for their actions." A few moments of reflection will reveal, however, that the issue here is somewhat more complicated than what one might infer from a simple and straightforward reading of the statement. The aim of the present paper is not to settle the question of whether and how a Catholic law school ought to give awards, honors, or platforms to certain individuals or groups. Instead, the aim is to begin articulating some of the underlying conceptual issues that perhaps ought to be addressed in preparation for answering the further question of whether and how a Catholic law school ought to give awards, honors, or platforms to certain individuals or groups. This book develops an evolutionary account of animal choice and human freedom, thus supplementing the conceptual account of freedom with an explanation how it developed.

The fine-structure constant, which determines the strength of the electromagnetic interaction, is briefly reviewed beginning with its introduction by Arnold Sommerfeld and also includes the interest of Wolfgang Pauli, Paul Dirac, Richard Feynman and others. Sommerfeld was very much a Pythagorean and sometimes compared to Johannes Kepler. The archetypal Pythagorean triangle has long been known as a hiding place for the golden ratio. More recently, the quartic polynomial has also been found as a hiding place for the golden ratio. The (...) Kepler triangle, with its golden ratio proportions, is also a Pythagorean triangle. Combining classical harmonic proportions derived from Kepler’s triangle with quartic equations determine an approximate value for the fine-structure constant that is the same as that found in our previous work with the golden ratio geometry of the hydrogen atom. These results make further progress toward an understanding of the golden ratio as the basis for the fine-structure constant. (shrink)

Part one is a broad overview of the place of Heidegger in Dugin’s political theory. Part two outlines how Dugin uses Heidegger to elaborate a specifically Russian political theory. Part three shows how apparently unphilosophical political concepts from Dugin’s political theory have a Heideggerian meaning for him. Because of what he regards as a homology between the philosophical and the political, his (...) readers must always be aware of the philosophical significance of his political concepts and vice versa. examine the dominant conversations on cultural appropriation. The first part of the essay will examine the ideological configuration of what constitutes cultural appropriation (hereafter as CA) first, as the politics of the diaspora and second, within a normative understanding of culture and its diachronic contradictions. This will be followed by a critical reevaluation of our subject theme as primarily a discourse of power with multiple implications. Framed as a discourse of power, CA is equally exposed to ideological distortions, and its (...) critics becoming afflicted with the same virus they set out to cure in the first place. I am interested in the aspect of culture as a constant location of tensions and rupture, yet constitutive of core credential in the making of modern identity. I argue that the failure of dominant criticisms of cultural appropriation is precisely because they do not leave epistemic space for prior commitments: the internal variation of culture. If as critics have argued that CA enables cultural violence, we need to understand the epistemic space where cultural violence occurs in order to make a meaningful proposal for identity discourse and conversation. I will make a case for what may be termed multiple humanity (ies) as a way of transcending the homogenous claims imposed upon cultural memories. (shrink)

Though this volume is a bit dated, there are few recent popular books dealing specifically with the psychology of murder and it’s a quick overview available for a few dollars, so still well worth the effort. It makes no attempt to be comprehensive and is somewhat superficial in places, with the reader expected to fill in the blanks from his many other books and the vast literature on violence. For an update see e.g., Buss, The Handbook of Evolutionary Psychology 2nd (...) ed. V1 (2016) p 265, 266, 270–282, 388–389, 545–546, 547, 566 and Buss, Evolutionary Psychology 5th ed. (2015) p 26, 96–97,223, 293-4, 300, 309–312, 410 and Shackelford and Hansen, The Evolution of Violence (2014). He has been among the top evolutionary psychologists for several decades and covers a wide range of behavior in his works, but here he concentrates almost entirely on the psychological mechanisms that cause individual people to murder and their possible evolutionary function in the EEA (Environment of Evolutionary Adaptation—i.e., the plains of Africa during the last million years or so). -/- Buss starts by noting that as with other behaviors, ‘alternative’ explanations such as psychopathology, jealousy, social environment, group pressures, drugs and alcohol etc. do not really explain, since the question still remains as to why these produce homicidal impulses, i.e., they are the proximate causes and not the ultimate evolutionary (genetic) ones. As always, it inevitably boils down to inclusive fitness (kin selection), and so to the struggle for access to mates and resources, which is the ultimate explanation for all behavior in all organisms. Sociological data (and common sense) make it clear that younger poorer males are the most likely to kill. He presents his own and others homicide data from industrialized nations, and tribal cultures, conspecific killing in animals, archeology, FBI data and his own research into normal people's homicidal fantasies. Much archeological evidence continues to accumulate of murders, including that of whole groups, or of groups minus young females, in prehistoric times. -/- After surveying Buss’s comments, I present a very brief summary of intentional psychology (the logical structure of rationality), which is covered extensively in my many other articles and books. -/- Those with a lot of time who want a detailed history of homicidal violence from an evolutionary perspective may consult Steven Pinker’s ‘The Better Angels of Our Nature Why Violence Has Declined’(2012), and my review of it, easily available on the net and in two of my recent books. Briefly, Pinker notes that murder has decreased steadily and dramatically by a factor of about 30 since our days as foragers. So, even though guns now make it extremely easy for anyone to kill, homicide is much less common. Pinker thinks this is due to various social mechanisms that bring out our ‘better angels’, but I think it’s due mainly to the temporary abundance of resources from the merciless rape of our planet, coupled with increased police presence, with communication and surveillance and legal systems that make it far more likely to be punished.
