El presente artículo tiene como propósito criticar y reformular la teoría de valores del autor y filósofo argentino Risieri Frondizi. Para ello, se someterán a falsacionismo las tesis según las cuales la cualidad estructural es, primero, estructuralista y no analítica y, segundo, empírica, de acuerdo con la metodología holista de la ciencia. La crítica, así, se desarrollará a partir de los siguientes interrogantes. Inicialmente, ¿el autor acude al holismo o al reduccionismo como enfoques metodológicos de desarrollo? According to the sceptic Saul Kripke envisages in his celebrated book on Wittgenstein on rules and private language, there are no facts about an individual that determine what she means by any given expression. If there are no such facts, the question then is, what justifies the claim that she does use expressions meaningfully? Kripke’s answer, in a nutshell, is that she by and large uses her expressions in conformity with the linguistic standards of the community she belongs to. While (...) Kripke’s sceptical problem has gripped philosophers for over three decades, few, if any, have been satisfied by his proposed solution, and many have struggled to come up with one of their own. The purpose of this paper is to show that a more satisfactory answer to Kripke’s challenge can be developed on the basis of Donald Davidson’s writings on triangulation, the idea of two individuals interacting simultaneously with each other and the world they share. It follows from the triangulation argument that the facts that can be regarded as determining meaning are irreducible. Yet, contra Kripke, they are not mysterious, for the argument does spell out what is needed for an individual’s expressions to be meaningful. (shrink)

This article discusses the triage response to the COVID-19 delta variant surge of 2021. One issue that distinguishes the delta wave from earlier surges is that by the time it became the predominant strain in the USA in July 2021, safe and effective vaccines against COVID-19 had been available for all US adults for several months. We consider whether healthcare professionals and triage committees would have been justified in prioritising patients with COVID-19 who are vaccinated above those who are unvaccinated (...) in first-order or second-order triage. Given that lack of evidence for a correlation between short-term survival and vaccination, we argue that using vaccination status during first-order triage would be inconsistent with accepted triage standards. We then turn to notions of procedural fairness, equity and desert to argue that that there is also a lack of justification for using vaccination status in second-order triage. In planning for future surges, we recommend that medical institutions base their triage decisions on principles meant to save the most lives, minimise inequity and protect the public’s trust, which for the time being would not be served by the inclusion of vaccination status. We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

Staff reported paranormal experiences in connection with the outpatient Medical Assistance in Dying room at the hospital. This case study reports on staff experiences and illustrates how the Ethics team’s role expanded to deal with this novel situation by facilitating an interdisciplinary response.

El propósito central del presente artículo, es formular un enfoque sistémico-jurídico para el análisis de los sistemas sociales. Para esto, se proponen tres tipologías de consensos denominados límites del sistema social: consenso normal, consenso normativo y consenso legítimo. La función de estas tipologías es, primero elaborar una explicación sobre la constitucionalización y democratización del poder político, con base en la regla de reconocimiento y la norma fundamental de un Estado; segundo postular dos metodologías normativas, un registro positivo y una demarcación (...) positiva, que desplieguen, tanto sobre las conductas sociales como sobre la estructura del sistema social, un proceso de legalidad emergente, cuya función sea, tercero regular, realimentar y optimizar el funcionamiento de la constitución política. Finalmente, se analizan los conceptos de completitud y de legitimidad del sistema normativo, con el fin de definir el alcance institucional que debe poseer un sistema jurídico sobre los subsistemas culturales del sistema social. One of the challenges related to the discursive practices of argumentative agents is to get to know if those interactions have an institutional effect. In this article, it is argued that in the new institutionalism, theoretical approaches and deterministic analysis are outlined to investigate argumentative practices that take place in processes of legitimation and recognition. Here a double socio-institutional and discursive or constructivist approach to the argumentation theory is defended, and it is argued that this perspective could be extended to (...) a research program aimed at interpreting argumentative processes in the public sphere that act as calculation mechanism and conformation of social capital. If the cultural variations concerning knowledge and research on ordinary reasoning are part of cultural history, what kind of historiographical method is needed in order to present the history of its evolution? This paper proposes to introduce the study of theories of reasoning into a historiographic perspective because we assume that the answer to the previous question does not only depend of internal controversies about how reasoning performance is explained by current theories of reasoning. In this article, the hypothesis according to which the institutional change is determined by the mobilization of social capital is exposed. It is analysed what consequences derived from this fact in relation to the processes of deinstitutionalization of the policy. It proposes an interpretation of academically relevant results about the meaning of the term ‘deinstitutionalization’, explains some of the most important antecedents on institutional theory and, fially, proposes some fundamental ideas to advance the philosophical reflction about the so-called new institutionalism.

El ciclo de protestas que se abrió en las primaveras árabes ha servido para revitalizar la reflexión teórica sobre el modo en que los procesos de agenciamiento político son indisociables de los modos de producción de los espacios de coalición. Es el caso de Judith Butler en Cuerpos aliados y lucha política, junto con otras autoras que han mostrado la importancia de pensar los modos de encuentro corporal, y las políticas de acceso a los espacios de aparición, como parte central (...) de la lucha y la reflexión política. En diálogo con estas y otras provocaciones teóricas, fundamentalmente en el ámbito de los estudios queer, este ensayo explora los modos de producción del espacio de coalición transfeminista y queer a partir de experiencias activistas recientes en la ciudad de Madrid. -/- The cycle of protests opened by the Arab Springs has served to revitalize theoretical reflections on the interplay between the construction of political agency and the production of coalitional spaces. This is the case of Judith Butler in Bodies in Alliance and the Politics of the Street, along with other authors that have shown the importance of thinking bodily encounter, and the politics of accessibility to the space of appearance, as a central part of political reflection and struggle. In dialogue with these and other theoretical provocations, specially coming from Queer Studies, this essay explores the modes of production of the space of transfeminist and queer coalition drawing on recent activist experiences in the city of Madrid. This chapter weighs a challenge to the attractive notion that by enabling empathy, fiction affords wide-ranging knowledge of what others’ experiences are like. It is commonly held that ‘seeing the world through others’ eyes’ often requires the empathizer to undergo an imaginative shift in sensibility, and we might naturally think that fiction helps us to effect that shift. However, some recent work on empathy and imagination encourages the conclusion that we are actually rigidly restricted to our own sensibilities even in (...) the wildest flights of imagination great literature can inspire. Drawing on the work of the novelist Zadie Smith, the chapter argues that while our imaginative capacities are not entirely unconstrained by our sensibilities, fiction can still help us to learn about a wide range of human experiences, including the experiences of people whose sensibilities substantially diverge from our own. Notably, fiction can work on our patterns of attention in such a way that we become temporarily ‘not ourselves.’. (shrink)

Our digital society increasingly relies in the power of others’ aggregated judgments to make decisions. Questions as diverse as which film we will watch, what scientific news we will decide to read, which path we will follow to find a place, or what political candidate we will vote for are usually associated to a rating that influences our final decisions.

Knowledge, like other things of value, can be faked. According to Hawley (2011), know-how is harder to fake than knowledge-that, given that merely apparent propositional knowledge is in general more resilient to our attempts at successful detection than are corresponding attempts to fake know-how. While Hawley’s reasoning for a kind of detection resilience asymmetry between know-how and know-that looks initially plausible, it should ultimately be resisted. In showing why, we outline different ways in which know-how can be faked even when (...) a given performance is successful; and in doing so, we distinguish how know-how can be faked (no less than know-that) via upstream and downstream indicators of its presence, and within each of these categories, we’ll distinguish (in connection with detection resilience) both faking symptoms and (various kinds of) criteria. The unappreciated resilience of faked knowledge-how to successful detection highlights a largely overlooked dimension of social-epistemic risk – risk we face not just in our capacity as recipients of testimony, but in our capacity as both (would-be) apprentices and clients of knowledge-how. This paper addresses some relations between the spatial politics of queer assemblies in spaces of protest and the constitution of collective political subjects. It does so by exploring the spatial politics of queer activism within the global Occupy movements, in the light of Judith Butler’s work on the performative power of assembly and the ambivalences of the Foucauldian concept of heterotopia. Specific challenges faced by queer activists in various encampments will be addressed in order to expose some tensions between the (...) constitutive exclusions inherent to the constitution of spaces of protest and the processes of coalition building needed to effectively overcome those very constitutive exclusions. Reductive intellectualists (e.g., Stanley & Williamson 2001; Stanley 2011a; 2011b; Brogaard 2008; 2009; 2011) hold that knowledge-how is a kind of knowledge-that. If this thesis is correct, then we should expect the defeasibility conditions for knowledge-how and knowledge-that to be uniform—viz., that the mechanisms of epistemic defeat which undermine propositional knowledge will be equally capable of imperilling knowledge-how. The goal of this paper is twofold: first, against intellectualism, we will show that knowledge-how is in fact resilient to being undermined by (...) the very kinds of traditional (propositional) epistemic defeaters which clearly defeat the items of propositional knowledge which intellectualists identify with knowledge-how. Second, we aim to fill an important lacuna in the contemporary debate, which is to develop an alternative way in which epistemic defeat for knowledge-how could be modelled within an anti-intellectualist framework. Plato wrote his works during an age of instability and decline; an age when the role of Athens as the leading power in the Mediterranean was beginning to be questioned. Through an analysis of Ion and Books II, III, and X of The Republic, this essay explores the epistemological and moral —rather than aesthetic— nature of Plato’s judgment on the value of Poetry and the Arts. Yet, today, one of the greatest challenges we still face today is to deepen into the knowledge of our actual and singular deliberative cultures. The ethics of technology has primarily focused on what values are and how they can be embedded in technologies through design. In this context, some work has been done to show the efficacy of a number of design approaches. However, existing studies have not clearly pointed out the ways in which design-for-values approaches can be used by design team managers to properly organize and use technologies in practice. This chapter attempts to fill this gap by discussing the value sensitive design (...) (VSD) approach as a useful means of co-designing technologies as a toolkit for existing workflow management, in this case, Agile. It will be demonstrated that VSD shows promise as a way of democratically designing technologies as well as fostering democratic technology policy innovation. (shrink)

«Fortaleza» y «debilidad» son dos adjetivos que se han utilizado prolijamente en la literatura científica sobre institucionalismo para describir la permanencia o, por el contrario, la porosidad y maleabilidad de las reglas y principios rectores en los que están atrincheradas las instituciones que sobreviven en equilibrio y, por tanto, no son alteradas unilateralmente.

Randomization is an integral part of well-designed statistical trials, and is also a required procedure in legal systems. Implementation of honest, unbiased, understandable, secure, traceable, auditable and collusion resistant randomization procedures is a mater of great legal, social and political importance. Given the juridical and social importance of randomization, it is important to develop procedures in full compliance with the following desiderata: (a) Statistical soundness and computational efficiency; (b) Procedural, cryptographical and computational security; (c) Complete auditability and traceability; (d) Any (...) attempt by participating parties or coalitions to spuriously influence the procedure should be either unsuccessful or be detected; (e) Open-source programming; (f) Multiple hardware platform and operating system implementation; (g) User friendliness and transparency; (h) Flexibility and adaptability for the needs and requirements of multiple application areas (like, for example, clinical trials, selection of jury or judges in legal proceedings, and draft lotteries). This paper presents a simple and easy to implement randomization protocol that assures, in a formal mathematical setting, full compliance to the aforementioned desiderata for randomization procedures. This review of the idea of community will be related to the development of urban social medicine explored by Michel Foucault to delocalize the resistance to the stigmatization and normalization processes set in motion by the AIDS pandemic to think, today, emerging biopolitics in name of public health. La biología utiliza múltiples criterios para individuar fenómenos biológicos. Frente a esta diversidad, los enfoques monistas proponen criterios fundamentales para el reconocimiento unívoco de individuos, esto es, formas únicas de dividir el mundo biológico en entidades individuales. El pluralismo, por otro lado, argumenta que no deberíamos restringir el estudio de la individualidad a concepciones únicas, reconociendo, en su lugar, diferentes tipos de individuos. En este artículo, analizaré cómo ciertos enfoques monistas y pluralistas enfrentan la pluralidad de criterios de individuación utilizados (...) por la práctica científica. Siguiendo las recientes aproximaciones epistemológicas y pragmáticas en filosofía de la individualidad biológica, argumentaré por qué la diversidad de individuaciones no suele representar un inconveniente para la biología y por qué contribuye a nuestro conocimiento del mundo biológico. La conclusión general será que requerimos múltiples maneras de individuar la naturaleza para poder cumplir los diversos objetivos epistémicos de la biología, una labor que las aproximaciones monistas no suelen visibilizar. Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. The objective of this paper is to analyse, from a philosophical perspective, the 16th and 17th Century models of currency, as well as their influence on the types of society in which the models developed. For this, the author values the study by the French philosopher Michael Foucault Words and Things on this matter and the principal foundations of Ludwig von Bertalanffy´s systems theory. The 17th Century model of currency is based on the notion of a system of exchange. The (...) notion of a system of exchange represents a transformation of great significance, upon which the principal characteristics of our current globalised era are founded, not only in economic life, but also in relation to an understanding of the world that it implies. Furthermore, the notion of a system of exchange was the step before the current model of electronic payments of the digital era, in which large transactions (and also large data transfers) take place by pressing a button. The principal idea of the paper is that these economic practices hold the key to deepen a philosophical and historical comprehension of concepts such as globalisation. (shrink)

Since the early 1990's the value sensitive design (VSD) approach has been a continually burgeoning design methodology for technological innovation. VSD is commonly described as a "principled approach" to technology design, given that it is explicitly orientated towards designing technologies for human values, rather than sidelining them to ad hoc and/or ex post facto design. However, in much of its near three-decades-long development, the VSD approach has mostly been adopted as a conceptual framework to assess existing technologies and to explore (...) how the consequences of the technology's development could have been influenced positively if VSD was adopted early on and throughout the design process (Friedman et al. 2002). Similarly, VSD has been adopted as a conceptual framework for analysing how future speculative technologies like molecular manufacturing (Umbrello 2019) and advanced artificial intelligence systems can be directed towards positive futures (Umbrello and van de Poel 2021). Yet, despite the benefits of these endeavours and VSD being an approach that can be adapted to any given design domain, it has yet to be widely appropriated in existing design spaces as a primary design approach. In this short paper, we aim to fill this lacuna by framing VSD as a toolkit that can be adopted by existing design teams rather than a wholesale approach. In particular, we describe how VSD maps seamlessly onto agile workflows, an approach to project management that is widely adopted globally. By doing so, we hope that the VSD approach will likewise be more attractive and thus adopted more broadly. As a consequence, a more explicit orientation towards designing technologies for human values will follow. (shrink)

Las definiciones de argumentación son tan variadas como las distintas posiciones existentes en torno a la pregunta de qué hacemos exactamente cuando argumentamos y cuándo estamos, de hecho, argumentando. Incluso el mismo autor puede ofrecer más de una definición de lo que entiende por argumentación; en parte, porque el problema de la argumentación no se circunscribe a un solo ámbito, ni del conocimiento ni de la vida práctica.

El estudio y análisis de las argumentaciones cotidianas entendidas como interacciones discursivas e intencionales encaminadas a dar cuenta de algo con el fin de lograr que aquello que se sostiene sea aceptado, sería inconcebible sin la aparición de la teoría de los actos de habla de Austin (1962), la propuesta de Searle (1969), el trabajo de Grice sobre la teoría de la conversación (1975) y el importante estudio sistemático de Hamblin sobre el argumento falaz (1970). Como una reelaboración de dichas (...) obras cabe entender la teoría pragmadialéctica de la argumentación propuesta inicialmente por Frans H. van Eemeren y Rob Grootendorst (1984). Algunos autores (Blair, 2006: 11; Woods, 1992) creen ver en ella, más que una teoría, una amalgama de varias teorías y una particular versión de la teoría pragmadialéctica de la argumentación, entendiendo ésta bajo una acepción más general. Otros consideran que ni es útil ni tampoco especulativamente productivo sostener que de toda argumentación pueda buscarse un modelo según el cual ésta buscaría resolver una diferencia de opinión (Goodwin, 1999). ‘Reasoning’ can be considered a general concept that, upon speaking, is the ‘enraonar’, a Catalan word that should not be mistaken with ‘explain’ nor with ‘discuss’ which imply more detail, and cover different situations. This article is presented as an essay on the ancient ideal of ‘enraonar’. To that end, it is explained in what sense ‘enraonar’ and reason are one of the most complex phenomena thought has to deal with. Here it is argued that these natural phenomena require a (...) systematic and ‘scientific’ study, and that withoutthis knowledge computer science cannot simulate people’s every-day ‘enraonar’. According to the standard view, Montaigne’s Pyrrhonian doubts would be in the origin of Descartes’ radical Sceptical challenges and his cogito argument. Although this paper does not deny this influence, its aim is to reconsider it from a different perspective, by acknowledging that it was not Montaigne’s Scepticism, but his Stoicism, which played the decisive role in the birth of the modern internalist conception of subjectivity. Cartesian need for certitude is to be better understood as an effect of the Stoic (...) model of wisdom, which urges the sage to build an inner space for self-sufficiency and absolute freedom. The relationship between the necessity to ensure that information is shared in the stages of deliberation and the overcoming of what Dryzek (2001) called constriction of deliberative economy is directly related to the proponents and opponents’ propensity to submit and add information differently, in a plural manner. This article describes the salient features of the deliberative turn in order to defend that this propensity is not individual. The evolution of the public space in science and in politics are both paradigmatic (...) examples to appreciate that individual deliberation, and even mere aggregation of opinions, are consistently interpreted only if they are part of social practices and collective institutions aimed at defending tolerance towards positions, beliefs and interpretations that are different or even confronted. This paper argues that the so called model of contestatory deliberative democracy contributes to the acquisition of knowledge precisely because it fosters a plurality of epistemic states associated with practices as consensus and dissent. En estas páginas hemos presentado varios argumentos para defender que existe una conexión entre el empleo de heurísticas y los procesos de deliberación. En lugar de caracterizar las heurísticas en función de las disciplinas, los campos y/o los ámbitos en que se emplean—tal y como hace, por ejemplo, el grupo ABC, i.e. racionalidad ecológica—las hemos proyectado sobre nuestros enclaves deliberativos, esto es, sobre un espacio eminentemente retórico y político. En dichos enclaves, tal y como solía recordarnos Quintín Racionero, la téchne (...) de la persuasión se nos presenta como parte del órganon de la filosofía práctica porque está aplicada a un espacio ontológico fundado por la comunicación humana. Y es en el seno de dicha comunicación como cabe entender la proliferación de razonamientos heurísticos encaminados al cálculo, la estimación y/o la ponderación, con ayuda de los cuales no sólo se orienta la acción colectiva sino las mismas fases de la deliberación. Concepts as reasonable doubt, cognitive biases and emotions are now a theoretical problem for the practice of law, and the law understood as legal argumentation. From a theoretical point of view, the screenplay written by Reginald Rose, Twelve Angry Men, is an outstanding example to analyze some of these concepts, and its influence on procedural stage. Cognitive biases and informal fallacies are theoretical challenge to legal argumentation.

Der Begriff der Toleranz in der Moderne wurde erdacht mit dem Ziel, Gesellschaften zu organisieren, die sich im Umbruch befanden auf Grund des plötzlichen Eindringens von Glaubensunterschieden in die politische Raumordnung. Die Definition der Toleranz als Tugend, die auf der Nachgiebigkeit gegenüber dem Andersartigen basiert, ist ein Pseudobegriff. Die hermeneutische Veranlagung, die mit der Philosophie einhergeht, zeigt, dass die Toleranz keine schlichte moralische Tugend sein kann, sondern vielmehr eine der Beschaffenheiten der Möglichkeit rationaler Handlungen (die Arten des Seins und des (...) Sagens fallen in der Vielfältigkeit ihrer Formen zusammen). Die Geschichte der Hermeneutik zeigt seit ihren Anfängen – die exegetische Arbeit war hierbei grundlegend – die Zwickmühlen der Existenzformen der Rationalität und lässt nur ein Denken an der Grenze zu, welche ihre Grundlage ist: Es gibt keine Tatsachen, sondern Interpretationen. Este artículo muestra la conexión entre heurísticas sociales y deliberación. En lugar de caracterizar las heurísticas según disciplinas o campos, aquí se proyectan sobre nuestros enclaves deliberativos. La autora sostiene que el empleo de heurísticas sociales orienta el flujo de la información y la participación en las distintas fases deliberativas, y es necesario analizarlas para establecer indicadores con los que medir grados de deliberación. Esta hipótesis da lugar a una visión pluralista sobre la función social de las heurísticas entendidas como (...) caja de herramientas con nuevos instrumentos y utilidades sociales. Según dicha perspectiva, habría que integrar este tipo de razonamiento en un plan de acción más amplio que explicara en qué sentido las heurísticas son recursos que producen conocimiento, al tiempo que un tipo de conocimiento ya producido. La oposición a una estricta separación entre las dimensiones dialéctica y retórica de la actividad argumentativa es una de las aportaciones más destacadas y peculiares de la denominada escuela holandesa sobre argumentación. Frans H. van Eemeren y Peter Houtlosser reaccionaron contra una separación estricta entre dialéctica y retórica en varios trabajos, pero uno de los más inspiradores es sin duda su artículo “William the Silent’s argumentative discourse” (1998) presentado en la ciudad de Ámsterdam con ocasión de la cuarta conferencia organizada (...) por la International Society for the Study of Argumentation (ISSA). Sobre este tema siguieron investigando para presentar un análisis de la perspectiva dialéctica inherente al caso de Guillermo I de Orange en un congreso de la Japan Debate Association en Tokio (van Eemeren y Houtlosser, 2000).
