Pedro de Ledesma is one of the Dominican theologians of the School of Salamanca involved in the De Auxiliis controversy, i.e., the disputes around a famous book by Luis de Molina on the relation between divine foreknowledge and providence and our free will. Studying an unpublished manuscript by Ledesma and his 1611 book on this subject, the article shows that he opposed Molina with a Thomistic position that we call deflationary. According to this interpretation, God, in moving (...) the created will to do good actions, does not bring about an entity distinct from volition itself. Contrary to other Thomists, he does not think that the immediate effect of the divine motion of the will is an intermediary entity used by God to produce, with the will, the created free act. Ledesma defends his thesis by using some elements of Aristotelian-Thomistic metaphysics, in particular, a minimalist interpretation of the relation between action and passion already present in Domingo de Soto and the specific causality of immanent acts. Divine grace is the hand of Christ that sustains the Christian in his acts: such is the mystery explored at the end of the 16th century in the profound studies carried out by various Catholic theologians in a debate in Spain known as the “Controversy on divine aids” (de auxiliis). Its problematic covers both the drama of the loving agreement between divine initiative and human response, as well as the subtle questions of causal determinism or freedom of the will. In (...) this book, the participation of one of the main Dominicans involved in this dispute, Pedro de Ledesma, one of the last members of the School of Salamanca, is studied for the first time. For this purpose, his manuscript work is reviewed, contrasting it with the teachings of other Dominicans of the time. This also makes it possible to show that among the theologians of the Order of Preachers, despite their profound coincidences, there were also different approaches to providence, predestination and divine grace. Thus, this book provides a specific introduction to Ledesma, whose understanding of physical premotion is quite original, but it also provides a broad overview of the early years of the controversy on grace in the Iberian Peninsula. Throughout the history of Thomism, interpretations of the ontology of God’s physical premotion of human free will have been divided mainly into two main groups. Most authors have thought that physical premotion constitutes a certain “entity” infused by God in the creature, although not all of them accept the account of Cabrera, who affirmed that premotion was a “quality”. On the other hand, there are some authors who understand premotion as a direct intervention of God in the vital act of (...) the creature which does not originates any entity prior to the created deliberate action itself. Báñez himself never spoke of any such entity, although some of his disciples soon adopted this view. One of his disciples, Pedro de Ledesma, is the author who best developed this minimalist approach in his treatise published on the occasion of the Controversy De auxiliis. This paper studies the main reasons used by Ledesma in his book to defend such an interpretation. (shrink)

The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. Goal: To assess public knowledge and attitudes towards the family’s role in deceased organ donation in Europe. -/- Methods: A systematic search was conducted in CINHAL, MEDLINE, PAIS Index, Scopus, PsycINFO, and Web of Science on December 15th, 2017. Eligibility criteria were socio-empirical studies conducted in Europe from 2008 to 2017 addressing either knowledge or attitudes by the public towards the consent system, including the involvement of the family in the decision-making process, for post-mortem organ retrieval. Screening and data collection (...) were performed by two or more independent reviewers for each record. -/- Results: Of the 1482 results, 467 studies were assessed in full-text form, and 33 were included in this synthesis. When the deceased has not expressed any preference, a majority of the public support the family's role as a surrogate decision-maker. When the deceased expressly consented, the respondents' answers depend on whether they see themselves as potential donors or as a deceased's next-of-kin. Answers also depend on the relationship between the deceased and the decision-maker(s) within the family, and on their ethnic or cultural background. -/- Conclusions: Public views on the authority of the family in organ donation decision-making require further research. A common conceptual framework and validated well-designed questionnaires are needed for future studies. The findings should be considered in the development of Government policy and guidance regarding the role of families in deceased organ donation. (shrink)

[ENGLISH] This article discusses the potential of synthetic biology to address fundamental questions in the philosophy of biology regarding the nature of life and biological functions. Synthetic biology aims to reduce living organisms to their simplest forms by identifying the minimal components of a cell and also to create novel life forms through genetic reprogramming, biobrick assembly, or novel proteins. However, the technical success of these endeavors does not guarantee their conceptual success in defining life. There is a lack of (...) consensus among researchers on how to define and classify the entities produced in the lab, whether they should be considered living or categorized differently. The criteria for minimal cells and minimal life are subject to arbitrary choices and varying interpretations. The concept of function, crucial to synthetic biology, is also difficult to define. The article highlights the need to consider the minimal set of functions that characterize life before determining the smallest genomes that code for those functions. The arbitrary nature of defining both life and function complicates the understanding and classification of these entities. The article suggests that the traditional dichotomy between the living and the non-living may no longer be valid and that the concept of life itself may not require precise scientific definition. As synthetic biology advances, the article emphasizes the importance of redefining or constructing new categories to encompass the expanding possibilities and creations in the field. The ability to create new life forms raises questions about recognition, identification, and ethical implications, requiring a conceptual and philosophical engagement beyond the technical achievements of synthetic biology. -/- [FRENCH] L'article aborde le potentiel de la biologie synthétique pour répondre à des questions fondamentales de la philosophie de la biologie concernant la nature de la vie et des fonctions biologiques. L'article met en évidence la nécessité de prendre en compte l'ensemble minimal de fonctions qui caractérisent la vie avant de déterminer les plus petits génomes qui codent ces fonctions. La nature arbitraire de la définition de la vie et de la fonction complique la compréhension et la classification de ces entités. L'article suggère que la dichotomie traditionnelle entre le vivant et le non-vivant pourrait ne plus être valable et que le concept même de vie ne nécessite pas une définition scientifique précise. À mesure que la biologie synthétique progresse, l'article souligne l'importance de redéfinir ou de construire de nouvelles catégories pour englober les possibilités et créations croissantes dans le domaine. Finality, design and purpose have started to be excluded from the language of the natural sciences since the XVIIth century. Darwin succeeded in excluding them from his theory of evolution appealing to a blind and mechanical natural selection. Today, the most usual definitions for the concept of biological function take for granted that functions: 1) are not dependent on a goal; 2) are not dependent on observers, but only on nature; 3) are explicable in causal terms, either with reference to (...) the causal history of the organ (etiological definition), or with reference to its present structure and causal capabilities (dispositional definition). However, we shall see that such presuppositions cannot take into account the normative character of the concept of biological function. We show that a generalization of the concept of scientific objectivity lets us affirm that functions: 1’) are dependent on a goal; 2’) are dependent on both observers and nature; 3’) cannot be reduced to causality, nor break the laws of physics; and yet, 4) are truly objective. Laura Specker Sullivan (2022) makes a fairly compelling case for the value of the perspectives of Buddhist practitioners in neuroethics. In this study, Tibetan Buddhist monks have been asked, among other things, whether consciousness, in brain-injured patients in a minimally conscious state, entails a duty to preserve life. In our view, some of the participants’ responses could be used to inform the bioethical debate on death determination.

No presente trabalho, com vistas para uma análise conceitual e crítica acerca do modelo de democracia representativa, bem como uma proposta de mudança sistemática e ordenada, iremos nos debruçar sobre os conceitos e perspectivas elencadas por Arendt e Bobbio no cerne da questão participativa. Hannah Arendt (1941-1975), ilustre teórica política, compreende a sociedade consolidada pós revoluções americana e francesa como fortemente apolitizada, visto o afastamento dos cidadãos dos assuntos públicos na atual democracia indireta. Norberto Bobbio (1909-2004), renomado jusfilósofo, define com (...) rigor analítico a categoria representativa da participação popular nas questões coletivas, indicando suas limitações e possibilidades. Em vista disso, faz-se necessário o estudo conjunto de ambas personalidades para o entendimento da disposição comum no que diz respeito à representatividade política que, segundo a autora alemã, impede a efetiva realização da vida cívica e atomiza os sujeitos, suscitando o desinteresse pela coisa pública e facilitando a oligarquização da mesma. A partir da inferência no que se refere ao foco central deste artigo, e da investigação complementar sobre os próprios riscos da implementação excessiva dos cânones reverberados pela tradição antiga — a qual pressupõe o envolvimento direto dos cidadãos no governo —, perpassaremos pela alternativa proposta por Arendt, a saber: a criação de conselhos deliberativos nos diversos níveis subnacionais a fim de fomentar o maior interesse e atuação popular na tomada de decisões, salvaguardando, assim, parte significativa do espírito revolucionário mas, sem retirar a centralidade de um governo bem estabelecido. Dessa maneira, a relação entre Arendt e Bobbio se designará no exame do sistema democrático representativo com respeito às limitações impostas pelo próprio sistema que impede a plena participação popular qualitativa, juntamente com a orientação arendtiana para rarear essa problemática — embora sem buscar a completa aniquilação do mecanismo de partidos, mas a união deste com o modelo de conselhos. Special issue: "Henri Bergson. Creative Evolution and Philosophy of Life." -/- I read the genealogy of the concept of energy through Bergson's Creative Evolution to argue that, historically, energy and its proto-concepts are grounded in spatialized notions of time. Bergson's work not only demands that we rethink energy and its relation to time, it also allows us to see that the concept of energy as we know it depicts time and materiality as a numerical multiplicity, which effaces the differences in (...) kind which are characteristic of energy transformations and real duration. To make this case, I first provide an analysis of Bergson’s concept of the cinematographical mechanism of thought, which splits duration into a composition of distinct states strung together by the idea of an impersonal becoming. Bergson claimed that this is the epistemological model for both ancient philosophy and modern science, meaning that it is also the epistemological ground within which energy concepts in western philosophy and science have been theorized. I then show how Bergson offers a way to overcome this model of theorizing through his method of intuition, and how these conclusions might be extended to future energy concepts. Thus, I argue that 1) Bergson’s work on duration allow us to interpret the genealogy of energy as the history of attempts to provide an account of change in terms of spatialized notions of time; 2) that his work offers a way of incorporating historicity into our understanding of energy; and 3) that thinking energy in the context of duration offers the possibility of conceptualizing energy as change. The following paper puts the history of race and colonialism in conversation with the history of the concept of energy. The objective is to understand what a critical decolonial perspective can teach us about the central role that energy plays in western culture, materially and epistemologically. I am interested in how this approach to political, epistemological, and ontological questions demands that we reconceptualize energy to account for the historical particularity of the concept and the phenomena of history and intersubjectivity, which (...) are eschewed in a purely materialistic and quantitative conception of energy. We will see how energy has been complicit in the racialization of black and indigenous bodies, and how the privileged place that the concept of energy has occupied in the canon of western physics has served to obscure the theological, metaphysical, and cultural assumptions that constitute it. Defensores do princípio da precaução propõem com frequência mudanças nas práticas científicas, para que elas facilitem o mesmo objetivo do princípio: evitar ameaças incertas ao ambiente ou à saúde humana. A ciência deveria ser uma ciência precautória. Apesar da importância prática da ciência precautória e da sua proximidade com os debates sobre ciência e valores, ela ainda não foi sistematicamente examinada. Neste artigo, pretende-se contribuir para a literatura sobre a ciência precautória de dois modos: sistematizando sua literatura prévia e propondo (...) uma definição de um de seus elementos principais, a precaução epistêmica, como uma orientação específica para a gestão de riscos indutivos. Rigidity does interesting philosophical work, with important consequences felt throughout metaphysics, epistemology, philosophy of mind, and so on. The authors’ aim in this article is to show that rigidity has yet another role to play, with surprising consequences for the problem of free will and determinism, for the phenomenon of rigidity has the upshot that some metaphysically necessary truths are up to us. The significance of this claim is shown in the context of influential arguments against free will. The authors (...) show that some virtually indisputable inference rules employed in formulations of the Consequence Argument, as well as in fatalistic arguments, fail with a variety of counter-examples. In debates concerning the consequence argument, it has long been claimed that [McKay, T. J., and D. Johnson. 1996. “A Reconsideration of an Argument Against Compatibilism.” Philosophical Topics 24 (2): 113–122] demonstrated the invalidity of rule (β). Here, I argue that their result is not as robust as we might like to think. First, I argue that McKay and Johnson's counterexample is successful if one adopts a certain interpretation of ‘no choice about’ and if one is willing to deny the (...) conditional excluded middle principle. In order to make this point I demonstrate that (β) is valid on Stalnaker's theory of counterfactuals. This result is important and should not be neglected, I argue, because there is a particular line of objection to the revised formulations of the consequence argument that does not succeed against the original version. We explore Peirce’s pragmatic conception of sign action, as a distributed and emergent view of cognition and exemplify with the emergence of classical ballet. In our approach, semiosis is a temporally distributed process in which a regular tendency towards certain future outcomes emerges out of a history of sign actions. Semiosis self-organizes in time, in a process that continuously entails the production of more signs. Emergence is a ubiquitous condition in this process: the translation of signs into signs cannot be (...) inferred from the properties of the components of a semiotic triad alone, but has to take into account a complex interaction between a micro-semiotic and macro-semiotic level of description. This interaction can be understood as an interplay of potentialities and tendencies, or upward constitutive determinative relations and downward selective determinative relations. According to this view, emergence is a central defining condition of processes of meaning. Ballet is a sign in action. The emergence of classical ballet is a self-regulatory process, in which a system of different kinds of cognitive artifacts (musical, bodily/motor, spatial/architectonic) and agents obtained a stable semiotic relation throughout many phases of development between the 16th and the 19th Century. One case is the development of the verticality of dance in classical ballet as a semiotic relation connecting proscenium arch stages, dancing bodies, and audiences. This development is micro-semiotically determined by the spatial constraints of the proscenium arch stage, and macro-semiotically determined by a historical construction of the dancing body as a sign within a network of semiotic chains, such as the intersemiotic regulation of body of the dancer by principles coming from painting. This is not only the emergence of actual meaning, but also the emergence of an open-ended field of potential and general meanings, an autonomous tendency of development. To say that ballet, as sign action, emerges, is to say that cognitive artifacts such as dancer’s bodies, stages and audience’s point of view, musical compositions, costumes, all sorts of supporting institutions, etc, constitute a niche for sign action, interacting according to tendencies of development that didn’t exist before. This paper aims to map the different theoretical options related to the Precautionary Principle (PP). Great part of the literature on it can be systematized by answering to three different questions: is there a basic structure in the PP? If so, in which interpretation of the PP does this structure express itself? Finally, are its damage or knowledge conditions fixed or adjustable? The first question separates realist from non-realist approaches. The second question allows us to discriminate monist, dualist, or pluralist (...) positions in relation to the three interpretations of the PP: decision rule, procedural requirement, or epistemic rule. Finally, the third question distinguishes rigid from non-rigid formulations of the principle. Based on this mapping, one can not only navigate through the different formulations of the PP present both in official documents and in specialized literature, but also deflect some of its common objections, and understand Hans Jonas’ eventual connection with PP. Notwithstanding, this mapping does not capture other important themes attached to PP, which motivates a final distinction between narrow and broader forms of PP. (shrink)

Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. As touch remains commonly defined by the closeness it physically implies and it rhetorically evokes, the mere notion of distant touch and of distal haptic perception seems peculiar. But Aristotle’s perspective, which I wish to take as a point of departure, is firm: we perceive the objects of touch, the hot and the cold, the hard and the soft, the curved and the sharp, through other things: δι' ἑτέρων. In this article, I would like to explore this ἕτερος by showing (...) how the otherness of perception always implies an intermediary, a middle point (μέσος), i.e. an other not so other, an other that is able to translate the much more distant otherness of the perceived object. To explore these forgotten layers of alterity that fall into what we commonly conceive of as the impalpable emptiness of distance, I propose to study the idea of distant touch from the perspective of phenomenological aesthetics. In order to do so, I will first examine some aspects of the Husserlian account of perception and will then focus on the phenomenology of distant touch in Alejandra Costamagna’s novel El Sistema del Tacto [The System of Touch] (2018). Brian Cutter objected to the consequence argument due to its dependence on the principle that miracle workers are metaphysically impossible. A miracle worker is someone who has the ability to act in a way such that the laws of nature would be violated. While there is something to the thought that agents like us do not have this ability, Cutter claims that there is no compelling reason to regard miracle workers as metaphysically impossible. However, the paper contends that miracle workers (...) are indeed impossible according to well-known theories concerning the laws of nature. This result highlights the reliance of the consequence argument on a plausible premise, which is widely accepted by proponents of non-Humean views of laws. The paper also provides a way to explain away the intuition that miracle workers are possible, but this has the upshot that a recent, two-dimensional formulation of the consequence argument is unsound. Aproximaciones a la escuela francesa de epistemología Los problemas que dominan a la epistemología pueden contextualizarse históricamente como una forma de racionalidad filosófica. La filosofía se ha presentado a lo largo de la historia como un discurso en el que sus diversos componentes (metafísica, ontología, gnoseología, ética, lógica, etc.) se mostraron unidos en el molde de la ?unidad del saber?. En este marco unitario alguna de las formas del saber filosófico detenta usualmente una posición dominante. El énfasis colocado en la (...) unidad del saber filosófico, o en ?la unidad del pensamiento humano?, es una herencia que el pensamiento filosófico recibe de sus raíces mítico-teológicas. Dicha visión se vio sometida, en la historia de la filosofía, a un proceso de secularización por el cual la instancia dominante pasó de la teología a la metafísica y de ésta a la teoría del conocimiento. Entre los siglos XIX y XX, este proceso atestiguó un cambio ulterior, colocando a la epistemología como instancia dominante de la racionalidad filosófica. La sucesión debe verse como una consecuencia de la funcionalización social de los dispositivos de creencias (ideología), lo que provoca que los mismos se conviertan, en determinado momento, en un obstáculo para la producción de nuevos conocimientos. De esta manera, los nuevos conocimientos, para desarrollarse, se ven forzados a provocar reestructuraciones en el campo filosófico, ya sea mediante el reemplazo de la instancia dominante, la incorporación o creación de nuevas formas de saber filosófico -tal el caso de la epistemología-, o de la marginalización relativa de otras. Se trata de en un proceso complejo (que no es ni lineal, ni biunívoco), en el que cabe no obstante discernir un esquema de la sucesión temporal de las formas filosóficas que dominan la pretendida ?unidad del pensamiento humano? (filosofía). El que acabamos de describir es un proceso lento de sustitución y reemplazo en el tipo de garantías que se le exige elaborar a la filosofía. Algunos momentos, como el ocaso de las garantías de la fe, acaecido con el surgimiento de la filosofía moderna, podrían parecer a primera vista contrajemplos para esta concepción de la evolución del saber filosófico. Podría creerse, en efecto, que con la constitución de esferas autónomas de discurso (teología, ciencia, filosofía), del discurso filosófico se desgajó en un discurso de una naturaleza diferente: la ciencia. Sin embargo, una mirada más atenta revela un paisaje diferente, puesto que esta transformación estuvo acompañada, primero, por la aparición de una nueva instancia dominante de la unificación del conocimiento filosófico. Se trata de la búsqueda de una nueva clase de garantías, las del origen y el fundamento del conocimiento, es decir, las de la gnoseología o teoría del conocimiento, en el interior de la cual se verificó finalmente un nuevo desplazamiento, con la constitución, a fines del siglo XIX y principios del siglo XX, de la ?filosofía de la ciencia? o epistemología. Este modelo para la conceptualización del desarrollo del discurso filosófico tiene la ventaja de permitirnos pensar la relación que la epistemología guarda con la instancia de saber filosófico dominante en el seno de la cual se desarrolla: la de la gnoseología. A partir de las relaciones que la epistemología guarda con la temática de las garantías del conocimiento podemos apresar, en un esquema heurístico que será complejizado de diversos modos en este libro, la diferencia entre las tesis características de la epistemología anglosajona y de la epistemología francesa. De acuerdo con en este esquema heurístico, el rasgo más característico de la epistemología anglosajona es su sujeción, en la mayor parte de su desarrollo, a la teoría del conocimiento, lo que se revela en la persistencia de algunos aspectos de la filosofía de la representación y en la reproducción de la oposición idealista entre sujeto y objeto como dos polos cuya armonía debería establecerse, filosóficamente, en términos de la verdad. En su lugar, la epistemología francesa se propuso el estudio de los mecanismos de producción de los conocimientos. La epistemología, desde esta perspectiva, ya no fue vista primordialmente como el estudio de los fundamentos del conocimiento científico, sino como la teoría de las condiciones y las formas de la práctica científica y la historia de esta práctica, tal como aparece en las distintas ciencias concretas. Expresado de otra manera, el contraste se podría establecer mediante la observación de que mientras los anglosajones hacen filosofía de la ciencia como una extensión de la lógica, los franceses la hacen como una extensión de la historia de la ciencia, es decir, encontrando en la historia el laboratorio del epistemólogo. Ahora bien, según veremos, el campo de la epistemología francesa ha cobijado una buena cantidad de debates que tienen que ver primordialmente con dos tendencias en tensión: la que enfatiza la autonomía de lo epistemológico y aquella que destaca la determinación social del pensamiento. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

Families play an essential role in deceased organ procurement. As the person cannot directly communicate his or her wishes regarding donation, the family is often the only source of information regarding consent or refusal. We provide a systematic description and analysis of the different roles the family can play, and actions the family can take, in the organ procurement process across different jurisdictions and consent systems. First, families can inform or update healthcare professionals about a person’s donation wishes. Second, families (...) can authorize organ procurement in the absence of deceased’s preferences and the default is not to remove organs, and oppose donation where there is no evidence of preference but the default is to presume consent; in both cases, the decision could be based on their own wishes or what they think the deceased would have wanted. Finally, families can overrule the known wishes of the deceased, which can mean preventing donation, or permitting donation when the deceased refused it. We propose a schema of 4 levels on which to map these possible family roles: no role, witness, surrogate, and full decisional authority. We conclude by mapping different jurisdictions onto this schema to provide a more comprehensive understanding of the consent system for organ donation and some important nuances about the role of families. This classificatory model aims to account for the majority of the world’s consent systems. It provides conceptual and methodological guidance that can be useful to researchers, professionals, and policymakers involved in organ procurement. (shrink)

The work of Emmanuel Levinas has been both abundantly recognized and criticized in moral philosophy. This Janus-faced attitude is also present in ecological theories, which find fertile ground in Levinas’ thought without being able to explain its apparent anthropocentrism. Opposing hermeneutical paths tend to focus either on otherness as an absolute alterity, implying a potentially unlimited responsibility for all alterities, or on otherness as a re-foundation of humanism, leading to the conclusion that responsibility is unlimited only among humans. Here I (...) seek to disentangle Levinas from these two extreme interpretations, first by reviewing ecological readings of his philosophy, in both the Francophone and Anglophone spheres, and second by analyzing specific Levinasian terms that might be particularly helpful for a non-anthropocentric or deep ecology. The main results of this investigation are a distinction between the ethics of responsibility and the ethics of vulnerability, an explanation of Levinasian compulsory or methodological humanism, and a schematic model of sensibility as enjoyment/vulnerability capable of supporting deep ecology without the traditional notions of free will, rights, or values. One important objection to the Condition Of ReasonNable Epistemic Access (CORNEA) is that it is incompatible with inductive evidence. This objection, however, relies on a counterfactual interpretation of CORNEA, and Wykstra and Perrine have shown that CORNEA need not be interpreted in that way, but rather in terms of conditional probability. Here, we show that there is an important gap in this recent response to the counterfactual-based criticism of CORNEA. We argue that the main response to this criticism ultimately depends (...) on a specific semantics for counterfactual conditionals. More specifically, it ultimately depends on the denial of the conditional excluded middle principle. We then investigate and suggest a hitherto unknown defense of CORNEA’s counterfactual interpretation. (shrink)

Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. La obra es un estudio de una de las nociones fundamentales en la filosofía de Gadamer, el concepto de aplicación. Se intenta dar cuenta de la manera en que dicho concepto viene a solucionar, o tal vez sería mejor decir, a disolver, en la reflexión del siglo XX, el problema que enfrentaban las ciencias históricas en el siglo XIX para convertirse en conocimiento objetivo. Dicho problema consistía en dos importantes dificultades vinculadas entre sí: la imposibilidad de disponer de un objeto (...) independiente, el pasado “tal cual ocurrió” para confrontar la adecuación de las visiones del mismo constituidas desde el presente, por un lado, y la imposibilidad de erradicar la perspectiva del presente (intereses, ideologías, etc.)en los relatos históricos. Para abordar este problema, Gadamer acomete nada menos que una revisión de las categorías fundamentales en las cuales se inserta esta dificultad, esto es, las nociones de conocimiento, realidad y verdad modeladas, a través de Kant, de acuerdo a la perspectiva de la moderna ciencia de la naturaleza. Un paso fundamental será entonces examinar el problema del valor cognitivo del arte, esto es, elucidar las nociones de realidad y experiencia a partir de la experiencia artística, para extender luego estas conclusiones a la historia y el lenguaje. En el marco de esta revisión se perfila el concepto de aplicación, el cual destaca que nuestra condición de agentes históricos, insertos en una tradición y en una comunidad lingüística, no es un obstáculo, sino justamente la condición que hace posible que podamos comprender lo diferente a lo propio, ya sea en la forma de la alteridad histórica, lingüística o meramente personal. La tesis de la obra que presentamos es que la estructura de la aplicación, con la consecuente historicidad que acarrea, se presenta de manera semejante tanto en las macro-estructuras de la comprensión (comprensión de textos, de la tradición, del arte) como en las estructuras de un nivel inferior o más básico, como la realización de juicios y la comprensión de conceptos, punto que se elabora, en esta obra, a través de una comparación con las ideas del segundo Wittgenstein. The classification of preserved hypothalamic activity in brain death and brainstem death as functional or non-functional has become a subject of debate. While proponents of the neurological criterion claim that these activities lack functional significance (Shemie et al. 2014), Nair-Collins and Joffe (2023) argue for their functional physiological role. However, the interpretation of the term "function" within the medico-legal framework, where death is characterized by the irreversible cessation of all brain functions, remains unclear. -/- My intention here is not to (...) engage in a debate over the validity of different viewpoints regarding the functional significance of preserved activities in the hypothalamus or the heart. Rather, I aim to highlight the critical importance of exploring and defining the concept of function in medicine, which currently lacks clarity. My point is that, whatever our position in the brain death debate, reaching a consensus on this conceptual matter would minimize misunderstandings and establish a robust foundation for further insightful analysis. In a recent paper in this Journal San Pedro I formulated a conjecture relating Measurement Independence and Parameter Independence, in the context of common cause explanations of EPR correlations. My conjecture suggested that a violation of Measurement Independence would entail a violation of Parameter Independence as well. Leszek Wroński has shown that conjecture to be false. In this note, I review Wroński’s arguments and agree with him on the fate of the conjecture. I argue that what is interesting about (...) the conjecture, however, is not whether it is true or false in itself, but the reasons for the actual verdict, and their implications regarding locality. En este trabajo analizamos la reivindicación gadameriana del valor cognitivo de arte como un ejemplo de un modo de conocimiento que permite concebir de mejor manera la comprensión que tiene lugar en las ciencias del espíritu. Dicha reivindicación presupone el desconocimiento del valor cognitivo del arte operado por la subjetivización de la estética con Kant y una vuelta a los presupuestos de la tradición humanista. Por ello en la introducción presentamos en esquema los conceptos humanistas de tacto, gusto, sentido común (...) y juicio y comparamos el concepto de experiencia que corresponde a los mismos con la noción de experiencia modelada por la ciencia moderna. En la primera parte del trabajo examinamos en detalle la subjetivización de la estética que comienza con Kant y culmina con la “conciencia estética”. En la segunda parte examinamos cómo la reivindicación del valor cognitivo del arte corre pareja con el desarrollo de una ontología de la obra de arte. Concluimos señalando cómo el recorrido realizado facilita la comprensión de la especificidad de las ciencias del espíritu (humanidades). (shrink)

The European project European and Latin American Systems of Ethics Regulation of Biomedical Research Project (EULABOR) has carried out the first comparative analysis of ethics regulation systems for biomedical research in seven countries in Europe and Latin America, evaluating their roles in the protection of human subjects. We developed a conceptual and methodological framework defining ‘ethics regulation system for biomedical research’ as a set of actors, institutions, codes and laws involved in overseeing the ethics of biomedical research on humans. This (...) framework allowed us to develop comprehensive national reports by conducting semi-structured interviews to key informants. These reports were summarised and analysed in a comparative analysis. The study showed that the regulatory framework for clinical research in these countries differ in scope. It showed that despite the different political contexts, actors involved and motivations for creating the regulation, in most of the studied countries it was the government who took the lead in setting up the system. The study also showed that Europe and Latin America are similar regarding national bodies and research ethics committees, but the Brazilian system has strong and noteworthy specificities. (shrink)

What effect has finding the Archimedean point in ourselves had on how we look at ethics? The modern era of philosophy began with Descartes finding within himself an unshakable point from which to pursue knowledge of the world and himself. This intellectual alienation from the world into the universal mathematical structures of the human mind has led to a reversal where, henceforth, production, rather than contemplation, of knowledge became epistemologically superior. Guided by Hannah Arendt’s discussion of the Archimedean point and (...) Earth alienation in the Human Condition, I will argue that this scientific form of thinking made its way into ethical investigation in the age of modern philosophy. Furthermore, I will provide an analysis of Kant’s categorical imperative and John Stuart Mill’s utilitarianism to show that despite modern science’s success in elucidating universal laws of nature, a scientific approach to ethics has not universalized our judgments of good and evil. Der Denkweg Hegels kann als ein Bildungsprozess von Einheitsbegriffen angesehen werden. Dieser Weg lässt sich in zwei Phasen einteilen: eine spekulative und eine vorspekulative Phase. Die These dieses Aufsatzes besteht darin, dass der Begriff der Einheit sich innerhalb beider Phasen jenes Denkweges entwickelte und dabei die gleichen allgemeinen Formen annimmt. Von daher kann der Weg dieses Denkens durch einen Doppel-Begriff, den der spekulativen und den der vorspekulativen Einheit, rekonstruiert werden. Im Blick auf das Ganze lässt sich also sagen, dass beide (...) Phasen am Ende durch die fundamentale Entscheidung Hegels eines „Eingreifens in das Leben der Menschen“ verbunden sind. Und die letzte Form der Einheit in der spekulativen Phase – die der absoluten Idee – wird dementsprechend eine gewisse aufgehobene Bewegung der Subjektivität und der Objektivität sein, an der sich die Einheit als Freiheit zeigt. The first part of this paper develops an outline of the history of hermeneutics organised around the problem of the method, understood as the question of guarantee of objectivity, the central problem of XIX century hermeneutics. In this outline XX century neo-Wittgensteinian philosophers like Peter Winch and Charles Taylor, appears as establishing the legitimacy of the methodological autonomy of hermeneutically oriented approach to social studies. Second part of the paper follows Georgia Warnke suggestion that specific Gadamerian contribution is to refuse (...) objectivity and intersubjective validity as necessary requisites for interpretation to be successful. We find in an analogy with phenomenological analysis of perception of material object and in hermeneutical analysis of the function of “distance” the grounds in Gadamer´s thought that supports this interpretation. We conclude assessing whether Gadamer position implies a methodological conclusion of the kind "everything goes" and which is the role intersubjectivity has to play in Gadamerian new scenery. A comienzos de los años 60 el marxismo althusseriano y el psicoanálisis lacaniano coincidían en un punto: su voluntad de intervenir críticamente en una coyuntura teórica caracterizada por el avance de las ciencias humanas. Ambas corrientes señalaban, con grandes convergencias, que las “ciencias humanas” (de manera evidente en sus versiones “tecnocráticas”: ego psychology, pisicología social, sociología en sus distintos avatares, etc.) cumplían funciones de adaptación de los individuos al sistema social, considerado como un invariante. Dichas ciencias humanas se presentaban como (...) obstáculos epistemológicos para lo que entonces se pensaba como el re-comienzo del materialismo histórico y del psicoanálisis. El hallazgo de obstáculos semejantes no es una mera coincidencia. Ambas líneas de pensamiento convergen en puntos importantes, afirmando, en lo que podría pensarse como una común tendencia materialista, la subordinación de la esfera biológica a la de lo simbólico o a la práctica social, la primacía del significante sobre el sentido, la necesidad de conceptualizar formas originales de la causalidad, cuyo leit-motiv es la sobredeterminación. El presente trabajo busca explorar algunas de las tensiones contenidas en esta coincidencia. El punto de mayor tensión lo suscitan los desarrollos de Althusser y algunos de sus seguidores (en particular Pêcheux y Lecourt) acerca de la relación entre la categoría de sujeto, la de ideología y el conocimiento científico en tanto que “proceso sin sujeto”, al sostener la imposibilidad de un “sujeto de la ciencia”, tesis que sin embargo juega un rol importante en el pensamiento de Lacan. Esta tensión remite a diferentes factores: la diferente herencia epistemológica (Bachelard en un caso, Koyré en el otro), la diferente recepción de la historia de la filosofía (el caso de Descartes), como así también diferencias de registro de los conceptos clave: inconsciente por un lado, ideología y lucha de clases, por el otro. En este trabajo haremos algunas observaciones sobre los efectos que acarrea la diferente recepción de la filosofía de Descartes. (shrink)

Der vorliegende Aufsatz stellt das Erbe der Kantischen Theorie der Konstitutions- und Regulationsleistung der Erfahrung – die Analytik der Grundsätze – dar, das unserer Auffassung nach zur Begründung der rein spekulativen Philosophie Hegels führt. In diesem Zusammenhang werden einerseits die transzendental-konstitutiven Grundsätze – Axiome der Anschauung und Antizipationen der Wahrnehmung – und andererseits die transzendental-regulativen Grundsätze – Analogien der Erfahrung und Postulate des empirischen Denkens überhaupt – als grundlegendes Material der Exegese benutzt. Als Resultat der Deutung erscheint das Problem des (...) Doppel-Verhältnisses zwischen Erfahrung und Verstandesgrundsätzen. Ein solches Verhältnis entfaltet sich nicht nur als die erfahrungsmäßige Verwirklichung der Grundsätze, sondern auch als die grundsätzliche Ermöglichung der Erfahrung. Der notwendige Charakter der Wahrheit in transzendentaler Hinsicht begründet sich dabei durch die allgemeine Beziehung der transzendentalen Grundsätze des reinen Verstandes zur Gesamtheit der Erfahrung. Es wird die These vertreten, dass die Auffassung der Natur – d.h. die das Dasein der Erscheinungen in der Zeit ermöglichende Einheit – das Hauptvermächtnis Kants für den Deutschen Idealismus im Allgemeinen und für Hegels Philosophie im Besonderen darstellt. The goal of this essay is twofold. First, it provides a quick look at the foundations of modern relational mechanics by tracing its development from Julian Barbour and Bruno Bertotti's original ideas until present-day's pure shape dynamics. Secondly, it discusses the most appropriate metaphysics for pure shape dynamics, showing that relationalism is more of a nuanced thesis rather than an elusive one. The chapter ends with a brief assessment of the prospects of pure shape dynamics in light of quantum physics.

Intentaremos reconstruir la controversia acerca de la posibilidad de un lenguaje privado. Analizamos primero las posiciones “epistemológicas” (Malcolm y Fogelin), mostrando sus fallos. Luego analizamos la versión “semántica” (Kenny y Tugendhat) encontrándolas igualmente fallidas. La crítica de Barry Stroud a los argumentos trascendentales como argumentos antiescépticos nos permite discernir el presupuesto común que debilita las posiciones anteriores. Asimismo, la reconstrucción permite apreciar mejor la manera en la que la versión de Kripke evita comprometerse con este presupueto. Argumentamos que esta versión (...) es la única versión consistente del argumento. Esta afirmación obliga afrontar algunas de las objeciones corrientes dirigidas a la propuesta de Kripke: el problema de la objetividad de la regla, ¿puede un individuo estar acertado en contra de la opinión comunitaria consensuada?; y el problema de las relaciones internas entre reglas y casos, presuntamente violentada por el rol que la noción de acuerdo comunitario desempeña en la misma. Sostenemos que nuestra reconstrucción de la controversia permite encontrar razones para mostrar por qué las objeciones mencionadas no se le aplican. -/- This paper tries to reconstruct the controversy on the possibility of private language. First, we analyse “epistemological” trends in the argument (Malcolm, Fogelin) showing their failures. Then, we analyse “semantic” versions (Kenny, Tugendhat) finding they are also failed. Barry Stroud’s criticism of transcendental arguments as refutations of scepticism allows us to discern the common presupposition that weakens the versions of the argument considered. Moreover, this reconstruction allows us to see how Kripke’s deals with the problem of the previous discussion in order to avoid committing himself with this presupposition. We consider Kripke’s version to be the only consistent version of the argument. Such a statement obliges us to consider two of the most important criticisms directed against Kripke’s Wittgenstein: The problem of objectivity of the rule: Can a single individual be right in contradicting communal assent?; and the problem of internal relationships between rules and their applications, allegedly violated because of the role played by communal agreement. We claim that our reconstruction of the controversy provides good reasons to show that the above-mentioned objections don’t apply to Kripke’s Wittgenstein version. (shrink)

Ian Rumfitt (2000) developed a bilateralist account of logic in which the meaning of the connectives is given by conditions on asserted and rejected sentences. An additional set of inference rules, the coordination principles, determines the interaction of assertion and rejection. Fernando Ferreira (2008) found this account defective, as Rumfitt must state the coordination principles for arbitrary complex sentences. Rumfitt (2008) has a reply, but we argue that the problem runs deeper than he acknowledges and is in fact related to (...) the challenge of establishing proof-theoretic harmony. We motivate a distinctively bilateral criterion for harmony and show how the bilateralist can meet it. This also resolves Ferreira's complaint. (shrink)

The present paper deals with the consequences Kripke’s interpretation of Wittgenstein’s private language argument has for political and social thought. We will show this is particularly important because it challenges the framework where ordinarily is located the discussion of the political and social relevance of Wittgenstein’s thought. Classical discussion has been concerned mainly with the role of communitary agreement, its relativistic or conservative consequences, the room for criticism and disagreement that it leaves, etc. We discern in classical reading a commitment (...) with some epistemological problems (warrants for knowledge) which is not completely overcame, its semantic jargon notwithstanding. Instead, we will argue, the new framework proposed by Kripke, overcome this epistemological problematic, rising new concerns, close to which, in French contemporary thought, has been called “philosophies of the subjection of the subject”. La comparación se produce porque el tratamiento del lenguaje de la filosofía del segundo Wittgenstein es particularmente apropiado para abordar la intervención del discurso en el proceso por el cual la ideología interpela a los individuos como sujetos, según Althusser. El descentramiento del sujeto obliga a repensar la dimensión de la agencia, y con ella, la de la política. Tanto Wittgenstein como Althusser desembocan (...) en una encrucijada: negación teórica de la noción de sujeto y reconocimiento de la existencia paradójica de la misma en la práctica. Ello implica deconstruir el par "determinismo-libertad" sobre el que se asienta la pregunta por la agencia. Sobre el final retomamos el trabajo de Michel Pêcheux sobre los efectos retroactivos del discurso, lo que implica un replanteo del vocabulario de la determinación, prominente en los escritos althusserianos. -:-:-:-:--:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-ABSTRACT:- The present paper compares Ludwig Wittgenstein’s and Louis Althusser’s approach to the problem of subject. This comparison is motivated by the fact that second Wittgenstein’s approach to language is particularly appropriate to think of the intervention of discourse in the process of ideological interpellation which, according to Althusser,constitutes individuals as subjects. The decentering of the involved subject requires rethinking the dimension of agency and, consequently, of politics. Both, Wittgenstein and Althusser, end in a crossroads: they refuse theoretical prominence to the notion of the subject, but at the same time they recognise the practical priority of this notion, which gives it a sort of paradoxical existence. This implies deconstructing the pair “determinism–liberty” where the priority of agency is located. We end with the work of Michel Pêcheux on the retroactive effects of discourse, that entail (in agreement with Wittgenstein) rethinking the vocabulary of determination, prominent in Althusserian writings. El presente trabajo es un estudio del libro de Martin Kusch acerca den las tesis sostenidas en "Wittgenstein on Rules and Private Language" (WRPL) por Saul Kripke examinado a la luz de la controversia desatada por la publicación del mismo en 1982, una de las más intensas que han ocurrido en los últimos 25 años en el seno de la filosofía analítica. En nuestro estudio procedemos en tres etapas. En la primera, presentaremos el desafío del Wittgenstein de Kripke de una (...) manera lo más neutral que podemos. En la segunda, presentaremos las características más notables trabajo de Kusch. En la tercera parte rebasamos los límites más estrictos de un comentario crítico para proponer una hipótesis propia acerca de la manera en la que la interpretación de Kusch permite comprender el vínculo de la propuesta de Kripke con la discusión clásica acerca del lenguaje privado como así también la discusión clásica permite realizar algunas observaciones críticas acerca de la propuesta de Kusch. El presente trabajo de Alex Ibarra Peña recoge los resultados de una investigación cuyo tema es la constitución de un campo de estudios ligado a la filosofía analítica en Chile. El autor se propone una tarea informativa y crítica en la que cifra la novedad de su propuesta. En otros términos, la suya es una labor de rescate, de algunos filósofos y corrientes de pensamiento relegados en las narraciones hegemónicas de la institucionalización de la filosofía en Chile y una tarea (...) que busca corregir el papel asignado a Chile en las visiones panorámicas de mayor circulación sobre la emergencia de la filosofía analítica en nuestro continente. En el cruce de estos dos vectores radica la novedad de la empresa de Ibarra Peña: proponer una visión más ajustada de la recepción de los filósofos analíticos en Chile. En nuestra reseña comentamos los núcleos centrales del trabajo y proponemos algunas hiótesis sobre los conflictos internos al campo cultural que subyacen a las opciones realizadas por el autor. Para finalizar indicamos lo que nos parece ser una falencia del trabajo: un estudio de la constitución de la filosofía analística como campo de estudios no debería dejar de tener en cuenta que el énfasis en la delimitación de la cientificidad por la filosofía analítica tenía en los años 60 y 70 adversarios concretos en el marxismo y el psicoanálisis. This paper analyses the question concerning the scope, possibility and legitimation of critical discourse. For this we understand the kind of discourse in which a single individual or a minority group sustain claims against what is considered correct by a majority. We concentrate in a controversy where this problem receives a focal attention: the debate between Habermas and Gadamer. The problem with critical discourse there is its apparent paradoxical status. On the one side, it is questioned whether the conditions of (...) meaning elucidated by hermeneutics does not make critical discourse impossible. Hermeneutics replies asking whether the scope of critical discourse critical theory is committed to is not beyond the condition of any possible discourse. Our analysis of the dispute elucidates a common assumption to both perspectives: the similar role both attribute to implicit recognition (although understood in a very different material way) in the constitution of the symbolic domain. We take profit of the inscription of Wittgenstein in the debate in order to asses critically the controversy through the analysis of this assumption. (shrink)

Resumen: En el presente trabajo intentaremos analizar cierta serie o tradi-ción de reflexiones sobre el conocimiento científico que lo caracteri-zan por su discontinuidad en relación al conocimiento ordinario osentido común. El origen de esta serie puede localizarse en la obrade Gaston Bachelard y su peculiar estudio de los actos epistemológicoscon los que se rompe con el pasado en una disciplina científica. Estosactos contrastan con lo que este autor califica como el “mitocontinuista” del empirismo. Esta posición será apropiada porAlthusser y desarrollada (...) por sus discípulos Balibar y Pêcheux. Inten-taremos mostrar que el factor común de la discontinuidad no consti-tuye una posición monolítica, sino que cabe reconocer, en las posi-ciones que consideramos, maneras diversas de entender la naturale-za de la misma. En este sentido, la revisión de las posiciones queAlthusser efectuó en su “autocrítica” constituye un punto de obser-vación privilegiado del abanico de alternativas que algunos de susdiscípulos desarrollarían sobre bases diversas. -/- Abstract In the present paper we analyze a tradition of reflections onscientific knowledge which distinguish it because of its“discontinuity” with common sense or ordinary knowledge. The beginning of this tradition can be traced back to Gaston Bachelardand his peculiar study of the epistemological acts which allows ascientific field to break with its past. The study of these acts helps toovercome what Bachelard considers is the empiricist myth ofcontinuity of knowledge. Bachelard’s views were retaken by Althusser and further developed by his students Balibar and Pêcheux.We will try to show the common commitment with discontinuity isnot an homogeneous view. Consequently we will try to showdifferences in the understanding of discontinuity. The revision of hisown positions made by Althusser in his “Self-criticism” is a specialstandpoint in order to consider the alternatives that his disciplesdeveloped on different grounds. (shrink)
