The topic of this thesis is how we should treat tiny probabilities of vast value. This thesis consists of six independent papers. Chapter 1 discusses the idea that utilities are bounded. It shows that bounded decision theories prescribe prospects that are better for no one and worse for some if combined with an additive axiology. Chapter 2, in turn, points out that standard axiomatizations of Expected Utility Theory violate dominance in cases that involve possible states of zero probability. Chapters 3–6 (...) discuss the idea that we should ignore tiny probabilities in practical decision-making. Chapter 3 argues that discounting small probabilities solves the ‘Intrapersonal Addition Paradox’ and thus helps avoid the Repugnant Conclusion. Chapter 4 explores what the most plausible version of this view might look like and what problems the different versions have. Chapter 5 focuses on one type of problem, namely, money pumps. The Independence Money Pump, in particular, presents a difficult challenge for those who wish to discount small probabilities. Finally, Chapter 6 discusses the implications of discounting small probabilities for the value of the far future. (shrink)

We discuss some implications of the Holocaust for moral philosophy. Our thesis is that morality became distorted in the Third Reich at the level of its social articulation. We explore this thesis in application to several front-line perpetrators who maintained false moral self-conceptions. We conclude that more than a priori moral reasoning is required to correct such distortions.

Auf welchen normativen Grundlagen beruhte das NS-System? Mit welcher Rechtfertigung konnte der Führerwille dort zu einer Quelle des Rechts werden? Wie war es gemäß der NS-Strafgesetzgebung möglich, Handlungen zu bestrafen, die gegen kein geschriebenes Gesetz verstießen? Die in diesem Band versammelten und kommentierten Originaltexte geben Einblick in das Denken von Rechtstheoretikern, die mit dem Nationalsozialismus sympathisierten, und belegen deren Versuch, autoritäre und dem Rechtsstaat widersprechende Rechtsprinzipien zu legitimieren. Dabei zeigt sich ein überraschender und bis jetzt von der rechts- und moralphilosophischen (...) Forschung weitgehend unbeachteter Aspekt des NS-Unrechtssystems: der Versuch einer »Ethisierung« des Rechts und die damit verbundene Totalisierung des machtstaatlichen Einflusses. (shrink)

Ausgehend von der These, daß jeder Versuch einer Klärung der Struktur transzendentaler Argumente Kants entsprechende Ausführungen berücksichtigen muß, erfolgt zunächst eine Rekonstruktion von Kants Auffassung transzendentaler Beweise. Im folgenden wird St. Körners Kritik an Kants transzendentalen Deduktionen diskutiert und argumentiert, daß Körners Zurückweisung dieser Beweisformen eine Kant nicht ganz angemessene Interpretation transzendentaler Deduktionen zugrundeliegt. Dennoch sind transzendentale Beweisversuche nicht erfolgreich.

Wie war es möglich? Diese mit Blick auf den Nationalsozialismus und die Zeit von 1933 bis 1945 unausweichliche Frage stellt sich für jede Generation aufs Neue – und auf unterschiedlichen Ebenen. Im Gegensatz zur detaillierten historischen Aufarbeitung der NS-Zeit ist die philosophisch-theoretische Analyse der normativen Grundlagen des NS Systems ein bislang vernachlässigtes Gebietder Forschung. Die hier edierte Sammlung von Originaltextenführender Juristen, Rechtstheoretiker und Rechtsphilosophen, die dem nationalsozialistischen Regime loyal gegenüberstanden und an der rechtlichen Um- und Neugestaltung mitarbeiteten, will diese Lücke (...) schließen helfen und einen Beitrag zur Analyse des nationalsozialistischen Herrschaftssystems aus dem Blickwinkel der Rechtstheorie und Rechtsphilosophie leisten. Die abgedruckten Originaltexte dokumentieren nicht nur die normativen Verschiebungen im Zuge der politischen Neuentwicklung, sondern zeigen auch, dass viele Maßnahmen des NS-Regimes, die in ihrer Radikalität und Unmenschlichkeit ohne Beispiel sind, eine gesetzliche Basis hatten und theoretisch vorbereitet waren. In this paper I suggest an account of knowledge by adding a fourth condition to the traditional analysis in terms of justified true belief. I am going to make a first proposal ruling out the Gettier-counterexamples.1 This proposal will then be corrected in the light of other counterexamples. The final analysis will be a combination of a justified-true-belief-account and a causal account of knowledge. Some philosophers have disputed that Gettier‟s examples must be accepted as refutations of the justified true belief (...) analysis of knowledge.2 Their rejection rests on declining a principle underlying Gettier‟s reasoning, namely – as Thalberg calls it – the principle of deducibility of justification (PDJ). PDJ reads as following: For any proposition p, if a person S is justified in believing p, and p entails q, and S deduces q from p and accepts q as a result of this deduction, then S is justified in believing q. This principle allows, for example, the move in Gettier‟s first example from the proposition a) “Jones is the man who will get the job and Jones has ten coins in his pocket” to proposition b) “The man who will get the job has ten coins in his pocket”. 1. What picture do we get when wie apply gender analysis to mainstream moral philosophy? Starting with an analysis of Kant, Hume and Rawls, Pauer–Studer develops the categorical framework of a moral theory that is free from any "male bias".

In his ground‐breaking study Complicity, Christopher Kutz introduces the notion of ‘participatory intentions’ (individual intentions whose content is collective) to explain an agent's complicity with groups or organisations. According to Kutz, participatory intentions allow us to hold individuals morally accountable for collective wrongs independent of their causal contribution to the wrong and its ensuing harm. This article offers an alternative account of complicity. Its central claim is that an agent's complicity might be due to the dependence of his professional role (...) on the normative principles that make up the organisation or institution in whose practices he partakes. In other words, there might arise a constitutive failure in an agent's attempt to ascribe to himself a non‐complicit professional identity. I use the case of SS‐Judge Konrad Morgen in order to illustrate this understanding of complicity. (shrink)

In the last twenty years, there has been an enormous growth of scientific research concerning the process of human moral reasoning and moral intuitions. In contemporary descriptive ethics, three dominant approaches can be found – heuristic approach, dual-process theory, and universal moral grammar. Each of these accounts is based on similar empirical evidence combining findings from evolutionary biology, moral psychology, and neuroethics. Nevertheless, they come to different conclusions about the reliability of moral intuitions. The aim of this paper is to (...) critically investigate each of these approaches and compare them with recent scientific findings. Last chapter addresses implications of these findings for moral epistemology and normative ethics. The aim is to show that despite different interpretations of available data, we can reach a satisfying pragmatical conclusion which would be in compliance with the empirical evidence, yet it would not necessarily depend on it. Substance-abusing women are vulnerable to specific kinds of epistemic injustice, including stigmatization and discrimination. This article examines the development of the epistemic agency of female substance abusers by asking: How does the use of a formal discussion protocol in community rehabilitation interaction alleviate epistemic injustice and strengthen the epistemic agency of substance abusers? The data were collected in a Finnish rehabilitation center by videotaping six group discussions between social workers, peer support workers, and rehabilitation clients with substance abuse problems. Of (...) these data, one recorded group discussion between four female participants—two rehabilitation clients, a peer support worker, and a social adviser—was used in this paper. Using conversational analysis, the findings indicate that, through the collaborative activities of sharing experiential knowledge about substance abuse and discussing the experiences of abuse in the rehabilitation interaction, substance abusers can develop novel ways to strengthen their epistemic agency by enhanced self-awareness. The discussion protocol is an epistemic tool that professionals and clients can learn to use in ethically and epistemologically successful ways in interaction. The use of a discussion protocol is an example of social professionals’ clinical knowledge of intensifying collaboration and sharing experiential knowledge in community rehabilitation and other substance abuse services. The paper argues that Toni Rønnow-Rasmussen’s fitting-attitude analysis of ‘good’ and ‘good for’ allows us to interpret and justify Kant’s Formula of Humanity (FH) in a constructive way. His classification of ‘good’ as a non-relational intrinsic final value and ‘good for’ as a relational extrinsic final value sheds light on two main features of FH, namely that it requires us to display a specific attitude to human beings, while also obligating us to recognize this value in the relational dimension. Based (...) on a reflection of what attitudes toward persons are fitting, we might well come to endorse that persons are “ends in themselves” and merit respect and recognition. I then argue (by way of an ethical reading of Kant’s demand to leave the state of nature and move to a rightful civil condition) that we have, in addition to a fitting attitude, deontic normative reasons (not mere pro tanto reasons) for making this very attitude toward persons the principal standard for our relations to others and to ourselves. The papers of this special issue are the outcome of a two-­‐day conference entitled “The Second-­‐Person Standpoint in Law and Morality,” that took place at the University of Vienna in March 2013 and was organized by the ERC Advanced Research Grant “Distortions of Normativity.” -/- The aim of the conference was to explore and discuss Stephen Darwall’s innovative and influential second-­‐personal account of foundational moral concepts such as „obligation“, „responsibility“, and „rights“, as developed in his book The Second-­‐Person Standpoint: Morality, (...) Respect, and Accountability (Harvard University Press 2006) and further elaborated in Morality, Authority and Law: Essays in Second-­‐Personal Ethics I and Honor, History, and Relationships: Essays in Second-­‐Personal Ethics II (both Oxford University Press 2013). -/- With the second-­‐person standpoint Darwall refers to the unique conceptual normative space that practical deliberators and agents occupy when they address claims and demands to one another (and to themselves). The very first sentence of Darwall’s examination of the second-­‐personal conceptual paradigm summarizes the gist of the argument succinctly when he claims that “the second-­‐person standpoint [is] the perspective that you and I take up when we make and acknowledge claims on one another’s conduct and will.” (Darwall 2006, 3) The Second-­‐Person Standpoint reminds us that this perspective has been ignored for much too long and that it better take centre stage in any philosophical analysis of moral phenomena, in order to yield a satisfying account of morality as a social institution. The negative part of Darwall’s strategy is to show that neither a purely first-­‐personal approach (represented by Kant and contemporary Kantians), nor a third-­‐personal state-­‐of-­‐affairs-­‐perspective (represented by most varieties of contemporary consequentialism) are capable of accounting for the categorical bindingness characteristic of moral obligation. The latter feat can only be accomplished, and this is the positive part of Darwall’s argument, when those second-­‐ personal normative “felicity conditions” and conceptual presuppositions are acknowledged and spelled out that are already presupposed in every instance of issuing (putatively valid) claims and demands. It is especially second-­‐personal competence and second-­‐personal authority that are the bedrock of these normative conceptual presuppositions, without which engaging in any meaningful address would be impossible. Kantians and utilitarians alike have neglected this critical dimension of the normative landscape. -/- In addition to working out an original conception of moral obligation, the first eight chapters of The Second-­‐Person Standpoint articulate this fundamental insight with respect to a variety of traditional projects in ethical theory such as developing accounts of moral responsibility, rights, dignity, and autonomy. In this context, special emphasis is to be awarded, on the one hand, to Darwall’s refreshing second-­‐personal interpretation of Strawson’s influential account of reactive attitudes and moral responsibility and, on the other, to his historically well-­‐informed reconstruction of Samuel Pufendorf’s often neglected version of an enlightened theistic voluntarism concerning moral authority. Darwall dedicates the second part of The Second-­‐Person Standpoint to the urgent question: how should one respond to the sceptical challenge that expresses utter indifference to the second-­‐person standpoint, including all its multifarious normative presuppositions and implications? What commits us to all this? It is at this point that Darwall, firstly, refines his criticisms of the Kantian, first-­‐personal, paradigm of normativity and emphasizes that only if one already incorporates the second-­‐personal conceptual apparatus into a Kantian analysis of moral obligation is the latter going to yield a convincing account. Secondly, and this certainly is one of the highlights of Darwall’s theory, the Second-­‐Person Standpoint employs themes from Fichte’s philosophy of right in order to strengthen the case for the inescapability of taking up the second-­‐person standpoint of moral obligation. In his contribution for this special issue Darwall further develops his diagnosis that Fichte’s thought offers in many respects a more promising, since more second-­‐personal, foundation of morality than, for example, Kant’s. -/- By now, the impact of Darwall’s second-­‐person standpoint theory has far transcended the confines of contemporary debates on moral obligation. Darwall has put to use the second-­‐personal apparatus to critical engagements with Joseph Raz’s theory of legal authority and Derek Parfit’s convergence arguments for his recent Triple Theory of moral wrongness. The constant theme that unifies all these diverse applications remains the one so impressively presented in The Second-­‐Person Standpoint: without paying attention to the “interdefinable” and “irreducible” circle of (four) foundational second-­‐ personal concepts (valid demand, practical authority, second-­‐personal reason, and accountability), neither superior epistemic status (Raz) nor the identification of optimific states of affairs (Parfit) are potent enough sources to generate anything close to the authority relationships that underlie the idea involved in obligating ourselves and one another. Given all of the above, it comes as no surprise that Darwall reserves his strongest sympathies for a specific ethical theory, namely contractualism. Our commitment to equal basic second-­‐personal authority, that Darwall arrives at through his Fichtean rectification of the Kantian project, leads him to the endorsement of a contractualist paradigm in the spirit of broadly Rawls and Scanlon. -/- . This article explores Darwall’s second-­‐personal account of morality, which draws on Fichte’s practical philosophy, particularly Fichte’s notions of a summons and principle of right. Darwall maintains that Fichte offers a philosophically more appealing account of relations of right than Kant. Likewise, he thinks that his second-­‐personal interpretation of morality gives rise to contractualism. I reject Darwall’s criticism of Kant’s conception of right. Moreover, I try to show that Darwall’s second-­‐personal conception of morality relies on a Kantian form of contractualism. Instead (...) of accepting Darwall’s claim that contractualism depends upon a second-­‐personal account of morality, I will argue that contractualism provides the foundations not only for second-­‐personal moral relations, but also for first-­‐personal moral authority. Erklärtes Ziel der Nationalsozialisten war, die Übertragung der Kanzlerschaft als Instrument zur umfassenden Machtausübung zu benützen. Die Strategie richtete sich von Beginn an auf die Ausschaltung des Reichstages und das Verbot der anderen politischen Parteien. Die Einschränkung der in der Weimarer Verfassung garantierten Grundrechte und Grundfreiheiten sollte die völlige Kontrolle politischer Gegner ermöglichen und absichern.

According to Longtermism, our acts’ expected influence on the expected value of the world is mainly determined by their effects in the far future. There is, given total utilitarianism, a straightforward argument for Longtermism due to the enormous number of people that might exist in the future, but this argument does not work on person-affecting views. In this paper, we will argue that these views might also lead to Longtermism if Prudential Longtermism is true. Prudential Longtermism holds for a person (...) if and only if our acts’ overall influence on that person’s expected well-being is mainly determined by the acts’ effects in the far future. We argue that (due to a small chance of anti-ageing and uploading) there could be an enormous amount of prudential value for some contemporary person in the far future and that value may be so large that it dominates their overall expectation of lifetime well-being. Justification logics are modal-like logics with the additional capability of recording the reason, or justification, for modalities in syntactic structures, called justification terms. Justification logics can be seen as explicit counterparts to modal logics. The behavior and interaction of agents in distributed system is often modeled using logics of knowledge and time. In this paper, we sketch some preliminary ideas on how the modal knowledge part of such logics of knowledge and time could be replaced with an appropriate justification logic.

Derek Parfit argues that fission is prudentially better for you than ordinary death. But is having more fission products with good lives prudentially better for you than having just one? In this paper, we argue that it is. We argue that, if your brain is split and the halves are transplanted into two recipients (who both have good lives), then it is prudentially better for you if both transplants succeed than if only one of them does (other things being equal). (...) This upshot rules out, among other things, that the prudential value of standing in the relation that matters in survival to multiple people is equal to their average well-being. (shrink)

Many social situations require a mental model of the knowledge, beliefs, goals, and intentions of others: a Theory of Mind (ToM). If a person can reason about other people’s beliefs about his own beliefs or intentions, he is demonstrating second-order ToM reasoning. A standard task to test second-order ToM reasoning is the second-order false belief task. A different approach to investigating ToM reasoning is through its application in a strategic game. Another task that is believed to involve the application of (...) second-order ToM is the comprehension of sentences that the hearer can only understand by considering the speaker’s alternatives. In this study we tested 40 children between 8 and 10 years old and 27 adult controls on (adaptations of) the three tasks mentioned above: the false belief task, a strategic game, and a sentence comprehension task. The results show interesting differences between adults and children, between the three tasks, and between this study and previous research. (shrink)

Patient and public involvement is widely thought to be important in the improvement of health care delivery and in health equity. Purpose: The article examines the role of experiential knowledge in service co-production in order to develop opiate substitution treatment services (OST) for high-risk opioid users. Method: Drawing on social representations theory and the concept of social identity, we explore how experts’ by experience and registered nurses’ understandings of OST contain discourses about the social representations, identity, and citizenship of the (...) participants and the effects these may have on developing or hindering inclusive and bottom-up forms of patient and public involvement. Results: The meeting sessions that potentially offer room for creativity and problem-solving fail to provide any new propositions for fixing the system. The health care professionals primarily identify themselves as regulators who protect the correctness of their actions and show little interest in considering experiential knowledge on opioid addiction. Conclusion: The participation of patients has been one of the prominent reforms implemented in health care. The goal of client-centered thinking is often emphasised; however, the implementation is not simple due to the strongly institutionalised knowledge and related working patterns and practices in health care. Albert Newen and Petra Vetter argue that neurophysiological considerations and psychophysical studies provide striking evidence for cognitive penetration. This commentary focuses mainly on the neurophysiological considerations, which have thus far remained largely absent in the philosophical debate concerning cognitive penetration, and on the cognitive penetration of perceptual experiences, which is the form of cognitive penetration philosophers have debated about the most. It is argued that Newen and Vetter's evidence for cognitive penetration is unpersuasive because they do not sufficiently scrutinize (...) the details of the empirical studies they make use of-the details of the empirical studies are crucial also when the studies are used in philosophical debates. The previous does not mean that cognitive penetration could not occur. Quite the contrary, details of the feedback connections to the visual perceptual module and one of the candidates presented by Newen and Vetter suggest that cognitive penetration can occur in rare cases. According to an often repeated definition, economics is the science of individual choices and their consequences. The emphasis on choice is often used – implicitly or explicitly – to mark a contrast between markets and the state: While the price mechanism in well-functioning markets preserves freedom of choice and still efficiently coordinates individual actions, the state has to rely to some degree on coercion to coordinate individual actions. Since coercion should not be used arbitrarily, coordination by the state needs to (...) be legitimized by the consent of its citizens. The emphasis in economic theory on freedom of choice in the market sphere suggests that legitimization in the market sphere is “automatic” and that markets can thus avoid the typical legitimization problem of the state. In this paper, I shall question the alleged dichotomy between legitimization in the market and in the state. I shall argue that it is the result of a conflation of choice and consent in economics and show how an independent concept of consent makes the need for legitimization of market transactions visible. I Alderdommen (1970) fremsetter Simone de Beauvoir en filosofisk analyse av alderdom og eldre menneskers situa- sjon, og hevder at behandlingen de får er «skandaløs»; samfunnet «returnerer dem som en vare det ikke lenger er bruk for». Hun tilkjennegir et like stort engasjement mot den urett som eldre utsettes for som hun gjør i Det annet kjønn (1949) når det gjelder undertrykkelsen av kvinner. Likevel påstår Beauvoir at alderdommen først og fremst er et problem for mannen, og det har blitt (...) hevdet at Alderdommen er et verk om aldersdiskriminering hvor mannens aldringsprosess gjøres til norm – ikke et feministisk verk på linje med Det annet kjønn. I denne artikkelen argumen- terer Tove Pettersen for at det nettopp er den feministiske filosofien Beauvoir utvikler i Det annet kjønn som ligger til grunn for hennes undersøkelser av undertrykkelse og diskriminering av eldre. I tillegg demonstrerer Beauvoirs omfattende analyse av alderdommen at hverken alder eller kjønn kan studeres uavhengig av hverandre. Alder og kjønn virker sammen, og må ses i lys av den situasjon disse fenomenene fremtrer i hvor også klasse er av stor betydning. Alderdommen kan derfor leses som et verk hvor Beauvoir viser hvordan ulike former for undertrykkelse virker sammen og bidrar til marginalisering og diskriminering av eldre. Nøkkelord: Simone de Beauvoir, Alderdommen, Det annet kjønn, feministisk filosofi, Den andre, aldersdiskriminering, alderisme******* -/- In The Coming of Age (1970), Simone de Beauvoir presents a philosophical analysis of old age and the elderly’s situa- tion, and claims that the treatment they receive is “scandalous”; society ‘returns them as a commodity that is no longer needed.’ She exhibits the same level of commitment regarding the injustice to which the elderly are exposed as she does in The Second Sex (1949) when it comes to the oppression of women. Nevertheless, Beauvoir claims that old age first and foremost is a problem for men, and it has been argued that The Coming of Age is a work on age discrim- ination where the male aging process is made the norm – not a feminist work on par with The Second Sex. In thisarticle, Tove Pettersen argues that it is precisely the feminist philosophy that Beauvoir develops in The Second Sex that enables her to analyze the oppression and discrimination of the elderly. Additionally, Beauvoir's comprehensive analysis of old age demonstrates that neither age nor gender can be studied independently. Age and gender intersect, and must be be seen in light of the situation in which class is of great importance. Thus, The Coming of Age can be read as a work in which Beauvoir shows how different forms of oppression work together and contribute to the mar- ginalization and discrimination of the elderly. Tato studie je inspirována knížkou Petra Urbana Jak rozumíme druhým? Studie o sociálním rozumění a sdílení světa nejen u člověka a věnuje se současným diskuzím o povaze sociálního rozumění, zejména v případě nelinguálních tvorů. Nejvýraznější pozice zastává na jedné straně skupina srovnávacích psychologů kolem M. Tomasella, která vychází z filosofů kolektivní intencionality, na straně druhé D. Leavens a K. Bardová, kteří mají blízko k interaktivistické interpretaci problému sociálního rozumění. Bude ukázáno, že rozdíly ve výsledcích empirických výzkumů mají základ v (...) ontologických závazcích jednotlivých výzkumných programů, přičemž důležitou roli hraje vymezení se vůči problému antropologické diference. Studie se táže, je-li možné prostředky filosofi e vědy mezi soupeřícími teoriemi rozhodnout. Na závěr je uvedena možnost biosémiotické reinterpretace mimo-lidského sociálního rozumění na pozadí teorie umweltu. (shrink)
