Che cosa distingue, concettualmente, l’esattore delle tasse che esiga da un uomo, a pena di sanzioni, una determinata somma di denaro, dal bandito che gli intimi, sotto la minaccia di un’arma, di consegnargli la medesima somma? È sul soddisfacimento del requisito della giustizia che si fonda, come sostenne Agostino, l’eterogeneità tra uno Stato e un’accolita di furfanti? «Se non è rispettata la giustizia, che cosa sono gli Stati, se non delle grandi bande di ladri? Perché le bande di briganti che (...) cosa sono, se non dei piccoli Stati?». Il volume ripercorre le risposte più autorevoli fornite nel XX secolo, entro un orizzonte postmetafisico, alla domanda agostiniana: prima dell’avvento del regime nazista, la tesi che un’associazione a delinquere sia indistinguibile da uno Stato è stata sostenuta da Benedetto Croce, Santi Romano e Hans Kelsen; dopo l’esperienza del nazismo e delle sue atrocità, perpetrate in nome dello Stato e della legge, le questioni relative alla natura del diritto e alla relazione tra morale e diritto hanno assunto – come ha osservato Robert Alexy – «l’urgenza di un problema scottante», e la domanda filosofica sulla validità della legge ingiusta è apparsa ineludibile non solo ai maggiori filosofi del diritto (Herbert L.H. Hart, Alf Ross, Ronald Dworkin e lo stesso Alexy), ma alle stesse corti tedesche. (shrink)

Considerando la disciplina degli effetti civili del matrimonio canonico, improntata a diversi “sistemi matrimoniali”, il volume ripercorre le vicende politiche e culturali che hanno segnato la storia dei rapporti tra le autorità statali e le autorità ecclesiastiche, lungo un periodo che copre circa due secoli, dal Code civil napoleonico del 1804 ai Codici degli Stati preunitari, dal Codice civile del 1865 del Regno d’Italia ai Patti Lateranensi stipulati dal regime fascista nel 1929, dalla discussione nell’Assemblea costituente nell’Italia repubblicana alle vicende (...) politiche degli anni Cinquanta e Sessanta, sino ai negoziati bilaterali che portarono all’Accordo di Villa Madama, ratificato il 25 marzo 1985. Esaminando le innovazioni formali e sostanziali introdotte nella riforma del matrimonio concordatario, si evidenziano le questioni che continuano a essere oggetto di controversie dottrinali e di sentenze delle corti di giustizia, volte a colmare le lacune e contraddizioni dell’attuale normativa matrimoniale. We have been observing how infants between 3 and 21 months react when a vibrotactile stimulation (a buzzer) is applied to different parts of their bodies. Responses included in particular movement of the stimulated body part and successful reaching for and removal of the buzzer. Overall, there is a pronounced developmental progression from general to specific movement patterns, especially in the first year. In this article we review the series of studies we conducted and then focus on possible mechanisms that (...) might explain what we observed. One possible mechanism might rely on the brain extracting “sensorimotor contingencies” linking motor actions and resulting sensory consequences. This account posits that infants are driven by intrinsic motivation that guides exploratory motor activity, at first generating random motor babbling with self-touch occurring spontaneously. Later goal-oriented motor behavior occurs, with self-touch as a possible effective tool to induce informative contingencies. We connect this sensorimotor view with a second possible account that appeals to the neuroscientific concepts of cortical maps and coordinate transformations. In this second account, the improvement of reaching precision is mediated by refinement of neuronal maps in primary sensory and motor cortices—the homunculi—as well as in frontal and parietal corti- cal regions dedicated to sensorimotor processing. We complement this theoretical account with modeling on a humanoid robot with artificial skin where we implemented reaching for tactile stimuli as well as learning the “somatosensory homunculi”. We suggest that this account can be extended to reflect the driving role of sensorimotor contingencies in human development. In our conclusion we consider possible extensions of our current experiments which take account of predictions derived from both these kinds of models. (shrink)

This paper concerns metaphysical indeterminacy and, in particular, the issue of whether quantum mechanics gives motivation for thinking the world contains it. In a previous paper (Darby G, Pickup M. Synthese 198:1685–1710, 2021), we have offered one way to think about metaphysical indeterminacy which we take to avoid some issues arising from certain features of quantum mechanics (such as the Kochen-Specker theorem). This approach has recently been criticised by Corti (Synthese, forthcoming), and we take this opportunity to respond. Our (...) paper will therefore reply to Corti’s argument, but we also take it as a case study in ‘naturalistic metaphysics’ and hence to contribute to a more general discussion of the relationship between philosophy of science and analytic metaphysics.
