In response to the sonic media and ludicrosity of her time, Hortense J. Spillers' paradigmatic essay ""All the Things You Could Be by Now, If Sigmund Freud's Wife Was Your Mother": Psychoanalysis and Race," transfigures Charles Mingus' melodic, cryptic, and most puzzling record title into a workable theoretical cacophony. Closely written within the contexts and outside the confines of "some vaguely defined territory between well established republics," Spillers is able to open up the sarcophagus of meaning(s) within the (...) Black occupation of the psychoanalytic discourse. Mingus' original assertion, "all the things you could be by now, if Sigmund Freud's wife was your mother," means absolutely nothing insofar as it means everything in the face of constructed openings and invitations into "extending the realm of possibility for what might be known." As such, this article asks a similar question relating to what might be known about the sensual convergence of media, violence, and representation ('all the things we could see by now') of international, political, and theoretical significance. If anything, Spillers and Mingus compel us toward locating some semblance of forgotten relationality between what appears to be abstract, distant, and unfamiliar. Given our contemporary era of violent post-colonial terror and desires for alternatives to the afterlife of slavery, this article endorses the free-floating investigation into the live survey of unprotected human flesh in the specific case of Boko Haram's explosion in modern media. Is it possible that such a study is able to uncover the motive behind the assembly of spectatorship? Through a Freudian reading of human nature into international political theory, this article indicates that narrative formation and transmission is an essential component to the development of both ethno-universalisms and global constructions of race and captivity. The article “Freud on the First World War (Part 1)” by Jasna Koteska analyzes the birth of psychoanalysis as Austro-Hungarian legacy, and the role of the Austrian psychoanalytic Sigmund Freud in the events of the First World War (1914-1918). The article explains how psychoanalysts modified their doctrine in relation to the historical events, because the beginning of the World War 1 overlapped with Freud’s writings about the Thanatos as a more fundamental drive than Eros. The article (...) argues that contrary to popular belief that the Great War obstructed the rise of psychoanalysis, the evidence proves that World War I was the single most important historical event for the triumph of psychoanalysis. Originally intended to treat individuals, psychoanalysis proved to be useful for explaining the attitudes of collective entities and Freud and his pupils further developed the concepts of war neurosis, shell shock, and the so-called “theory of the stimulus shield”. The article analysis the attitude of psychoanalysis towards the war torture (especially in the so-called “The Rat Man case”), and the struggles of Freud and his pupils to adapt and rethink the methods for treatment of traumatized soldiers. Freud uses paradoxical and conflictual rhetoric to create an unstable and conflictual picture of the mind. Thus he diverges from both dominant traditions of thought in the West: the Judeo-Christian way of filling all gaps in meaning by putting a single omnipotent divinity in charge of them, and the Enlightenment quest for a final, causal language to describe reality. By both suggesting and displacing a plurality of perspectives on the unconscious, Freud’s text mirrors what it claims happens in (...) our minds, in which unconscious impulses undermine the pretense of total rational self-control. Though Freud suggests that a mechanistic description of the mind may bring us nearer to the reality of the unconscious, he also explains that this reality will remain dark. He not only develops an ostensibly mechanistic vocabulary for unconscious mental processes, but also clarifies that his terminology is most fictional precisely when it seems most scientific. Hence, Freud’s science of the unconscious cannot be assimilated to an empiricist position; its philosophical underpinnings are both Kantian and Nietzschean, with metaphors and analogies playing a crucial role. Two dramatic images, in which the mind appears as a domain of warring gods and a realm of political conflict, demonstrate that Freud did not regard the unconscious as some kind of true inner self. He depicts the mind in general and the unconscious in particular as a pagan, conflictual universe over which no god or goddess can gain exclusive control and where no rigid dictatorship is possible. In "New Introductory Lectures on Psychoanalysis", Freud discusses his views on mysticism and psychoanalysis. The concept of mysticism has changed throughout the ages. In ancient times, a mystic was one who communed with God. In Freud's world, the word mysticism became an all-inclusive word describing paranormal phenomenon occurring outside the laws of nature and science. Accordingly, science tended to dismiss or ignore mystical ideas because they were viewed as superstitious, irrational and nonsensical. -/- .

Essay criticizing Sigmund Freud's critique of religion and its philosophical implications.

Jakovljevic and Crnčevic review the concept of comorbidity in relation to mental disorders, which is timely. Yet they seem to ignore a longstanding and important notion of comorbidity, highlighted in psychiatry particularly by Sigmund Freud. The ignored notion is that of compensatory comorbidity. Compensatory comorbidity is a special case of compensatory phenomena in relation to disrupted health.

This work aims to spell out clear the tensions manifested by the meeting between the project of a reflexive philosophy and psychoanalysis, from a very specific event: the publication, in 1965, of the thesis De l'interprétation: essai sur Freud by Paul Ricoeur. Our question arises from the fact that psychoanalysis has introduced one of the greatest embarrassments to the philosophies of consciousness, as it established the unconscious psychic as foundation and array of subjectivity. In contrast, Paul Ricoeur strengthens its (...) belonging to the reflective tradition initiated by Husserl, but with a fundamental deviation: in your access to subjectivity, this reflexive philosophy must take the form of a hermeneutics that interprets the signs of man’s existence. Given this, the present study seeks to find out what difficulties, tensions and contributions the reading of Freud offers to hermeneutic project proposed by Ricoeur. The article aims to show how the philosophical reading of Freud allowed Ricoeur to arbitrate the different and sometimes conflicting hermeneutics approaches around the problem of symbol. (shrink)

John Locke is often understood as the inaugurator of the modern discussion of personal human identity—a discussion that inevitably falls back on his own theory with its critical reliance on memory. David Hume and Sigmund Freud would later make arguments for what constituted personal identity, both relying, like Locke, on memory, but parting from Locke's company in respect the role that memory played. The purpose of this paper will be to sketch the groundwork for Locke's own theory of (...) personal identity and consider some common objections tied to his special reliance on memory. Then, we will investigate the extent to which Hume and Freud refined their respective concepts of self-identity in ways that escape some of the most intractable objections to Locke's theory in its dependence on memory. Finally, we will consider which theorist's conception of self-identity best accords with our notion of the cyber-self, or psychological subjectivity in the context of cyberspace. For Locke, the nature of self-identity is that it is continuous across time, and to remain uninterrupted it must be beholden to a psychological process, rather than a material or immaterial substance. The article aims to discuss the suicide conceptions in the following works: Karl Marx’s Peuchet: vom Selbstmord (with “co-author” Jacques Peuchet), Émile Durkheim’s Le suicide and Sigmund Freud’s Trauer und melancolie. We can say that throughout the history of philosophy the theme was worked in two ways: as a moral and as an existential question. Discussions about suicide intensified between the late eighteenth and early nineteenth century. While many studies have focused on the moral consequences of suicidal act, (...) other researchers questioned about the nature of the forces that cross the individual to the point of self-extermination. In their conceptions, Marx, Durkheim and Freud avoided determinism and refused to associate suicide to the sin notion advocated by the Christian moral philosophy. However, this article supports the thesis that these three authors continued operating in the “morality axis” and presented suicide as a moral problem: it is precisely the moral that allows a theoretical enunciation about suicide and what sets them apart is, much more, a differentiated position in relation to moral than a radical innovation of the approach. This article compares the accounts of psychical unity in Freud and Lonergan. Following a detailed account of Freud’s understanding of psychical structure andhis deterministic psycho-biological presuppositions, Lonergan’s understanding of psychical structure in relation to patterns of experience is discussed. As opposed to Freud’s theory, which is based on an imaginative synthesis of the classical laws of natural science, Lonergan considers psychical and organic function as concretely integrated in human functionality according to probabilistic schemes of recurrence. Consequently, Lonergan (...) offers a theory of the psychological problems of repression and inhibition not primarily as functions of subverted organic desires, but more properly according to the functioning of intellectual bias. This volume aims to develop a philosophical diagnostic of the present, focussing on contemporary technoscience. psychoanalysis submits contemporary technoscientific discourse to a symptomatic reading, analysing it with evenly-poised attention and from an oblique perspective. Psychoanalysis is not primarily interested in protons, genes or galaxies, but rather in the ways in which they are disclosed and discussed, focussing on the symptomatic terms, the metaphors and paradoxes at work in technoscientific discourse. This monograph presents a psychoanalytical assessment of technoscience. The first four (...) chapters provide a short introduction into the psychoanalysis of technoscience, its basic concepts and methods, as developed Sigmund Freud, Carl Gustav Jung, Gaston Bachelard and Jacques Lacan. In subsequent chapters, this approach is fleshed out with the help of case histories (palaeoanthropology, classical conditioning and virology). Psychoanalysis reveals that, rather than by disinterested curiosity, technoscience is driven by desire, resistance and the will to control. Moreover, the focus is on primal scenes, such as Dubois’ quixotic quest for the missing link and Pavlov’s discovery of the conditioned reflex. In addition, psychoanalysis opts for triangulation: understanding technoscientific research by comparing it to “different scenes”: to genres of the imagination, notably novels, so that, in this volume, the discovery of a Homo erectus skull by Dubois is compared to missing link novels by Jules Verne and Jack London (dating from the same period), Pavlov’s discovery of the conditioned reflex is compared with B.F. In a letter written in 1927, the French writer Romain Rolland asked Sigmund Freud to analyse the “oceanic feeling,” a religious feeling of oneness with the entire universe. I will argue that Rolland’s intentions in introducing the oceanic feeling to Freud were much more complex, multifaceted, and critical than most scholars have acknowledged. To this end, I will examine Rolland’s views on mysticism and psychoanalysis in his book-length biographies of the Indian saints Sri Ramakrishna and Swami Vivekananda, (...) which he wrote just after he mentioned the oceanic feeling to Freud in 1927. I will argue that Rolland’s primary intentions in appealing to the oceanic feeling in his 1927 letter to Freud—intentions less evident in his letters to Freud than in his biographies of Sri Ramakrishna and Vivekananda—were to challenge the fundamental assumptions of psychoanalysis from a mystical perspective and to confront Freud with a mystical “science of the mind” that he felt was more rigorous and comprehensive than Freud’s psychoanalytic science. In hyper-modern society, food has become a source of endemic discontent. Many food products are seen as ‘tainted’; literally, figuratively or both. A psychoanalytic approach, I will argue, may help us to come to terms with our alimentary predicaments. What I envision is a ‘depth ethics’ focusing on some of the latent tensions, conflicts and ambiguities at work in the current food debate. First, I will outline some promising leads provided by two prominent psychoanalytic authors, namely Sigmund Freud (...) and Jacques Lacan. Subsequently, I will elucidate why our chronic dependency on high-tech food production apparently fails to meet consumer needs, focusing on some scenarios of escape, such as anorexia, cultured meat and ersatz food. And I will use ‘genres of the imagination’ to flesh out how food consumption has become a podium for enacting cultural symptoms, moral outcries, provocative identities and practices of the Self. Notably, I will discuss a story by Franz Kafka, a painting by Pablo Picasso and a food novel by Margaret Atwood. (shrink)

The aim of this paper is to show that global scientific promises aka “scientific world-conceptions” have an interesting history that should be taken into account also for contemporary debates. I argue that the prototypes of many contemporary philosophical positions concerning the role of science in society can already be found in the philosophy of science of the 1920s and 1930s. First to be mentioned in this respect is the Scientific World-Conception of the Vienna Circle (The Manifesto) that promised to contribute (...) to the realization of an enlightened, rational and science-oriented society and culture. The Manifesto was not the only „scientific world-conception“ that philosophers and scientists put forward in the 1920s. Also the scientific world-conception of the philosopher and physicist Moritz Schlick, and the Weltanschauung of Sigmund Freud deserve to be mentioned. Still other examples of are Carnap’s Scientific Humanism and the project of The International Encyclopedia of Unified Science which was related to American pragmatism as well, as is shown by Charles W. Morris and others. Forgotten for a long time, since the beginning of the 21rst century, at least some of the Viennese projects are reconsidered in a new wave of „socially engaged philosophy of science”. (shrink)

The ArgumentThis essay examines Freud's construction of a mythical moment during early childhood, in which differences between male and female sexual identities are said to originate. It focuses on the way in which Freud divides fear and envy between the sexes, allocating the emotion of fear to men, and that of envy to women. On the one hand, the problems of this construction are pointed out, but on the other hand, it is shown that even a much-maligned myth (...) may still provide food for thought.Then, four critiques of Freud which have been articulated by prominent feminist psychoanalysts – Karen Horney, Nancy Chodorow, Luce Irigaray, and Jessica Benjamin – are presented, as well as the alternative visions of sexual identities which these thinkers have developed. The basic metaphors or economies guiding these visions of sexual difference are appraised in terms of their breadth and depth, with particular reference to their ability to acknowledge and integrate the presence of fear and envy as passions which are evoked but also repressed in the face of sexual difference.From this angle, the contributions of Nancy Chodorow and Luce Irigaray are found to be more limited than those of Karen Horney and Jessica Benjamin, since the former two theorists allocate fear primarily or exclusively to men, as Freud has done, while they remain completely silent on envy. Differences in the scope or reach of the four feminist approaches are explained as a result of the theorists' differing perceptions of the social, political, and cultural position of women in patriarchal society. This essays argues that Freud’s vision of the rule of law may be worthwhile pondering by legal scholars. It can heighten awareness of its unconscious dimensions and point to a variety of ways in which the law functions as part of culture or civilization, rather than as a system with its own rules. The first two parts of the essay seek to reconstruct Freud’s notion of the rule of law as a dialectical or paradoxical civilizatory force, restraining the (...) passions even though they drive it. These two parts retrace Freud’s genealogy of the law’s prehistoric origins and unconscious dynamics, which can be found in Totem and Taboo and, in summary form, in Moses and Monotheism. Then, the third section critically assesses the problems and limitations of some of the uses legal scholars made of Freud’s genealogy. Finally, the essay returns to the intellectual context of Freud’s conception of the rule of law, concluding with the claim that a Freudian perspective implies, in fact, that legal studies should be conceived as cultural studies. 1900 was a remarkable year for science. Several ground-breaking events took place, in physics, biology and psychology. Planck introduced the quantum concept, the work of Mendel was rediscovered, and Sigmund Freud published The Interpretation of Dreams . These events heralded the emergence of completely new areas of inquiry, all of which greatly affected the intellectual landscape of the 20 th century, namely quantum physics, genetics and psychoanalysis. What do these developments have in common? Can we discern a family (...) likeness, a basic affinity between them, so that we can use the one to deepen our understanding of the other? One common denominator is that they open up realms of inquiry that are significantly different from the world of everyday experience, namely the realm of elementary particles, of genes and genomes, and of the unconscious. But to what extent can we meaningfully argue, for instance, that the genome is the biological unconscious, and the unconscious the psychic genome? To address these questions, I will build on the work of two key intellectual figures who have explored the affinities of these developments in depth, namely Erwin Schrödinger (a quantum physicist and avid reader of Schopenhauer who initiated molecular biology) and Jacques Lacan (who reframed the specificity of psychoanalysis with the help of 20 th century science: the era of structural linguistics, but also of quantum physics, molecular biology, bioinformatics and DNA). Why did human beings throughout the millennia so often think about a doomsday? Could there be a profit to our inner pleasure and pain equilibrium, when believing that doomsday is nearing, an idea suggested by Sigmund Freud? An analogous instinctive dynamics was thought by Nietzsche who wrote that human beings do prefer to want the nothingness rather than not to want anything at all. In conclusion, I suggest a speculative and tentative hypothesis for self-deception that suggests an alternative to Freud and Sartre’s account of self-deception, one that views the self or self-system as having a disposition for self-deception when understood as having the capacity for fluid working self-states that are ‘expandable’ and ‘contractable’ that differ in self-complexity. The article presents Erwin W. Straus’ unpublished manuscript “Temporal Horizons” from 1952. In the paper, in addition to an extensive philosophical discussion with St. Augustine, Henri Bergson and Sigmund Freud, Straus elaborates on his idea of a unified view of temporal experience, comprising both the personal and the impersonal dimensions of time. The manuscript also contains an interview with a psychotic patient, which is supposed to exemplify Straus' core idea on the psychotic temporal experience, according to which the (...) break of the invisible bond between immanent or personal, and clock or impersonal time leads to a loss of a sense of reality. Why did millions of people respond to the failures of neoliberal capitalism by voting in leaders that further undermine their existence? In this article, I combine the insights of the early Frankfurt School Critical Theory (Theodor W. Adorno) with the insights of psychoanalytic theory (Sigmund Freud) to show how economic factors interact with psychological factors in the rise of the far-right today. The propaganda techniques used by far-right leaders create conditions in masses that are akin to hypnoses. Such (...) techniques induce regressions in far-right followers in which the unconscious predominates, and far-right leaders use to manipulate the masses. Para demostrar ese acápite, retomo los estudios críticos que se han hecho en torno a este cortometraje, así como las categorías pertinentes de las vanguardias del dadaísmo y el surrealismo, junto con el psicoanálisis de Sigmund Freud y Jacques Lacan. Con todo ello, propongo que el objetivo de este trabajo es fundamentar las razones que generaron (...) que esta producción fílmica estuviera orientada a transgredir lo tradicional y lo ético de la sociedad europea. Evidentialism as its leading proponents describe it has two distinct senses, these being evidentialism as a conceptual analysis of epistemic justification, and as a prescriptive ethics of belief—an account of what one ‘ought to believe’ under different epistemic circumstances. These two senses of evidentialism are related, but in the work of leading evidentialist philosophers, in ways that I think are deeply problematic. Although focusing on Richard Feldman’s ethics of belief, this chapter is critical of evidentialism in both senses. However, I (...) share with authors like Feldman and Earl Conee, that epistemology has important prescriptive functions, and that a sound, civic ethics of belief is of more than merely philosophic importance. One reason why an ethics of belief might be important to problems of practice is the need we have for tools to more effectively mediate the renewed round of ‘culture wars’ we are experiencing in Anglo-American cultures. I mean especially that grand cultural clash between science and religion, reason and faith, secularist atheism and religious fundamentalism, etc. Let us start with the genealogical question of why there is such a grand cultural debate in the first place, and why the debate especially as played out in public and popular forums and even in the courtrooms seems so volatile and so often to confusedly drag everything—beliefs, values, passions, etc., with it. These are questions that I think Sigmund Freud’s classic Civilization and its Discontents can help us understand. Freud was a major voice in criticism of the stern and often hypocritical Victorian morality, a voice pointing out the price of its sometimes high-handed, guiltinducing curtailments of the satisfactions sought by the individual. But for Freud while there are real differences in the moral demands that different societies or traditions place upon people, there is something inevitable about the conflict itself, for “replacement of the power of the individual by the power of a community constitutes the decisive step of civilization... Li Zehou’s work can be understood as an account of a Chinese modernity, a vision for Chinese society that seeks to integrate three distinct philosophical approaches. These are Chinese history and culture, which Li understands as largely Confucian; Marxism, which has exerted such influence on a modernizing China; and Western learning more generally, as expressed by figures such as Immanuel Kant and Sigmund Freud. Li also frequently expresses the hope that a Chinese modernity will be one in which (...) the importance of the individual is recognized, and rights and freedoms upheld (e.g., 2006, p. 182). But this stance raises an important question: how are individuality and freedom understood in Li’s philosophical system? In this paper, I want to examine what resources Li offers to help us conceptualize their place in a modernity with Chinese characteristics. Confucian culture is often regarded as authoritarian and hierarchical, less interested than more liberal traditions in an ideal such as freedom. So how does freedom relate to the Confucian root of Chinese culture, as construed by Li? In this paper I explore how Li Zehou’s study of Confucian aesthetics can deliver a novel conception of freedom, one grounded in Confucian thinking about personal cultivation, and aimed at the free creation of delight (樂). In 1935, A. G. Tansley, who was knighted later, proposed the ecosystem concept. Nevertheless, this concept was not without predecessors. Why did Tansley’s ecosystem prevail and not one of its competitors? The purpose of this article is to pin the distinguishing features of Tansley’s ecosystem down, as far as the published record allows. It is an exercise in finding the difference that made a difference. Besides being a pioneering ecologist, Tansley was an adept of psychoanalysis. His interest even led him (...) to visit Sigmund Freud in Vienna for a while. Psychologists had to regard the mind as an entity in its own right, while knowing that it truly was part of a larger whole (body + mind), because the causal relation between body and mind was unknown. This lead Tansley to conclude that psychologists must not objectify the system under study, have to search for causes within their own field, and must not speculate unless this serves a scientific purpose. In 1925, Tansley defended psychoanalysis in a prolonged controversy against a concerted attack criticizing its speculative content and poor scientific standing. This could have been the reason why Tansley kept his ecosystem free of speculative content and unscientific connotation. The competing ecosystem-like concepts, however, have contained philosophical speculation, non-deterministic properties like vitalism or entelechy, or have been burdened with unscientific connotations. Hence, rigorous restraint distinguished the ecosystem concept and made it ready for use by later researchers. (shrink)

In this paper, I seek to defend the proposition that bewilderment can contribute to the interest we take in artworks. Taking inspiration from Alois Riegl’s underdeveloped explanation of why his contemporaries valued some historically distant artworks higher than recent art, I interpret the historical case of the European audiences’ fascination with the Fayum mummy portraits as involving such a bewilderment. I distinguish the claim about effective bewilderment from the thesis that aesthetic meaning resists discursive understanding and seek to establish that (...) bewilderment can figure positively in art appreciation, drawing on Richard Wollheim’s argument—developed in engaging Sigmund Freud’s essays on art—that posing obstacles to our understanding can actually contribute considerably to art’s effect: it prolongs and intensifies our engagement with the work. Riegl’s observation that some historically distant artworks have an especially strong effect is thus explained in terms of their anachronism: the effect is caused by the difficulties experienced in making sense of their contemporary look and their distant origin. O presente artigo tem por objetivo mostrar, desde a psicanálise freudiana, um caminho possível que a leva ao encontro da filosofia de orientação fenomenológica. Em O eu e o isso, de 1923, Sigmund Freud emprega uma nova noção pouco explorada na literatura psicanalítica: o eu-corpo. O escopo de nossa análise delimita-se à interpretação e à explicitação da noção de eu-corpo tal como esta foi apresentada por Freud, confrontando-a com a fenomenologia em Merleau-Ponty e Michel Henry. Para tanto, (...) propomos uma análise em quatro tempos. Inicialmente, evidenciaremos o entendimento de Freud sobre o modelo de psicologia originada em Brentano que tem como um de seus desdobramentos a fenomenologia. Depois, mostraremos como a concepção do isso, segundo o próprio texto de Freud, foi determinante para que ele formulasse uma revisão da primeira tópica e a incorporasse em uma segunda tópica. Por fim, nas últimas duas partes, examinaremos o tratamento dado por Merleau-Ponty e Michel Henry à questão do corpo. Concluímos que é possível o encontro entre a psicanálise e a fenomenologia via a noção de eu-corpo freudiano; contudo, tal condução implicará reformulações em teses centrais da psicanálise. (shrink)

In this article, the author examines different theories and approaches to mass movements in the historical process and their impact on the condition of Western culture. In the short introduction, the main historical, cultural and philosophical origins of the mass movements from antiquity to present time are described. This paper examines the question why the social and cultural influence of the man of mass is difficult to predict. To answer this question, the author demonstrates the continuing transition from the psychology (...) of the crowd to the structure of mass instinct and collective interaction. The first part exposes general psychological characteristics of the mob according to the ideas of Gustave Le Bon (1841–1931). Le Bon describes masses as emotional, irresponsible, uncritical and conservative, although marks heroism and sacrifice as their positive manifestations. In the second part, the author reflects upon the perspective of Gabriel Tard (1843–1904) on this problem. Tard’s term “public opinion” deals with the representatives who – while living in separation – participate in the mass communication. In the third part, attestations of the mass such as humility, conformism and obsession are investigated based on the ideas of Sigmund Freud (1856–1939). The next point of the article is devoted to Jose Ortega y Gasset’s (1883–1955) concept of the revolt of masses. Ortega captures the ambivalence of masses who express the power ambition and indifference to culture. From the point of view of Hannah Arendt (1906–1975), masses become terrible, self-satisfied, atomized, unstructured and anonymous. However, Elias Canetti (1905–1994) defines masses as compressed and scattered, closed and open, fast and slow. Yet different parameters of the masses one can find in Siegfried Kracauer’s (1889–1966) writing – namely aesthetics, technicism, ritual. Finally, in the last part, the author appeals to Jean Baudrillard’s (1929–2007) approach to the problem who declares that masses became silent and indistinct. (shrink)

In this work we will analyze the concept of Real in Jacques Lacan's thought, and at the same time we will try to understand the functioning of après-coup temporality on the relationship between the time of trauma and the time of symptom. Doing this, we will try to answer an essential question: if the concept of Real is the key concept (...) of last Jacques Lacan's thought, which is his own temporality? A tese defende o antiplatonismo presente na obra do jusfilósofo Hans Kelsen como núcleo argumentativo da sua teoria do direito. Sustenta que a melhor definição da sua filosofia não é como neokantiana, mas como antiplatônica. Isso porque há significativas inconsistências na sua interpretação de Kant, o que a impossibilita de ser classificada como tal. Além, encontra-se na sua leitura sobre Platão referências mais sólidas e conceitos mais claros. Nesse sentido, advoga a hipótese de que a obra de Kelsen tem como (...) constante e como chave de entendimento a sua objeção e contestação às teses de Platão, sobretudo a questão da separação entre alma e corpo, isto é, forma e matéria. O primeiro e segundo capítulos defendem a hipótese da inconsistência das teses de Kelsen sobre Kant. Entende que a sua pressuposição de contradição entre a razão pura e a razão prática, assim como a ideia de uma contradição entre ser e dever-ser, não se sustenta considerando as próprias obras de Kant e a literatura especializada sobre o autor. No segundo capítulo apresenta a sua leitura sobre Platão, concentrada na obra A Ilusão da justiça (Dei Illusion der Gerechtigkeit). O quarto capítulo expõe, sopesando seu antiplatonismo, as duas principais referências teóricas para Kelsen a par de Kant, isto é, as teorias de David Hume e Sigmund Freud. O quinto capítulo demonstra como o antiplatonismo de Kelsen articula com os principais conceitos de suas teses, isto é, mostra que mesmo refutando a classificação do autor como neokantiano, conceitos como norma fundamental, liberdade, o monismo entre direito e Estado, monismo entre direito internacional e nacional e o problema da decisão judicial possuem justificativa e base filosófica coerente. Finalmente, conclui com a possiblidade da ideia de uma teoria kelseniana do direito desvinculada do neokantismo e fundada sobre os pressupostos céticos humeanos e freudianos, tanto moral, quanto teórico, ou seja, reconhece a unidade das obras do autor, desde que condicionada a sua interpretação como antiplatônica.
