In 1976, Julian Jaynes (1920-1997) made an important statement in his work titled "The Origin of Consciousness in the Breakdown of the Bicameral Mind''. As modern humans, we are conscious beings and can think about our thoughts. However, in ancient texts it is observed that human self-awareness and self-awareness have not yet been formed in humans. Jaynes calls this way of thinking, which emerged in the 2000 BC and evolved over time, bicameral thinking. Citing exceptional examples taken from Homer and (...) the Old Testament, he argued that historical heroes could not attain consciousness and therefore could not yet become real subjects. Ancient heroes attributed the voices in their minds to supernatural powers. Janes argues that the characters in the Iliad do not sit and think about what to do like we do, nor do they have alert and introspective minds like us. According to Jaynes, the concepts of thumos, phrenes and kradie found in Homer's works can be considered primitive consciousness. Jaynes argues that the bicameral mind lacks the capacity for metacognition (reflective thinking). The bicameral mind, where episodic and semantic memory, introspection and mastery of consciousness have not yet been formed; It evolves with language use over time. In the 2000s BC, marginal social and environmental changes began to collapse due to societal needs. The stress created by new conditions requires neurological adaptation, leading to the development of consciousness and self-awareness. The heroes of tragedy have experienced traumatic events and have changed and transformed as a result; He gains consciousness as introspection and inner monologue, and provides an important example of spiritual transformation as an immortal psycho-mythological figure. During a period that can be described as a transition from myth to logos, the spirit underwent a rupture. The great social transformations and disasters experienced over time have led to the renewal of the human spirit. In fact, there have been attempts such as divination and communication with supernatural forces to reach voices that can no longer be heard. When all this state of conflict is interpreted through the inner conversations and mental transformation of the person, the dynamic structure of the mind will emerge, where the thinking patterns of the person change depending on environmental conditions. Krzysztof Trzciński, ‘The Concept of an Ethnic Upper Chamber in a Bicameral Parliament in an African State (Part 2).’ The article has been published in “Afryka” 35, 2011, pp. 11-26 and is a continuation of the previous paper published under the same title in “Afryka” 34. Part 2 explains a couple of cases (of the Senate of Lesotho, and two Houses of Chiefs, in Botswana and Zambia) that seem useful in the analysis of the Nigerian political thinker Claude Ake’s concept (...) of the ‘chamber of nationalities.’ According to the concept, in a multiethnic African state, a bicameral parliament should be constituted, of which the upper house should be created based on the existing ethnic divisions, allowing all ethnic groups to be represented in a balanced way and thus empowering the smaller of them. Implementation of this concept might contribute to the building of more peaceful and politically stable states in Africa. In the latter part of this article, a study of the political system of Bosnia and Herzegovina is discussed in short, with a particular focus on the case of the House of Peoples of Bosnia and Herzegovina that resembles Ake’s concept very closely. In the final part of the article, some drawbacks of Ake’s concept are brought up and discussed critically. (shrink)

Krzysztof Trzciński, ‘The Concept of an Ethnic Upper Chamber in a Bicameral Parliament in an African State (Part 1).’ The article has been published in “Afryka” 34, 2011, pp. 30-42. It consists of two parts. Part 1 explains Nigerian political thinker Claude Ake’s concept of the ‘chamber of nationalities,’ in the context of the idea of recognizing and strengthening the ethnic groups’ rights in a multiethnic African state. According to the concept, in an African state, a bicameral parliament should be (...) constituted. Its upper house should be created based on the existing ethnic divisions, allowing all ethnic groups to be represented in a balanced way and thus empowering the smaller of them. Implementation of this concept may contribute to the building of more peaceful and politically stable states in Africa. Ake’s opinions are enriched with the views of a Sierra Leonian philosopher George M. Carew that seem useful in the analysis of the whole concept. Next, a case study of the Ethiopian parliament’s upper chamber, House of Federation, is discussed. That chamber is a product and an essential part of the ethnic federalism system currently existing in Ethiopia. This case resembles Ake’s concept in many ways. Then, the Nigerian philosopher Ifeanyi A. Menkiti’s ideas, having some common points with the Ethiopian territorial structure and political system as a whole, are explained. Menkiti’s views teach what may be the realities of an ethnic federalism system, especially in an undemocratic environment. His opinions also seem complementary with some of Ake’s ideas concerning the ‘chamber of nationalities’ concept. (shrink)

One cannot understand the extreme schizophrenia and sadomasochistic psychopathy of mankind--and hence the appeal that etatism holds for many--without incorporating the crucial insight provided by psychologist Julian Jaynes in his 1976 monograph The Origin of Consciousness in the Breakdown of the Bicameral Mind. And here I'm not speaking of so-called "aberrant" human psychology, but rather simply standard human psychology that all humans are born with due to natural evolution.

En concreto, el artículo estudia cómo se desarrolla en ella el concepto de identidad, uno de los que más están cambiando en nuestra época. El análisis revela la necesidad de abordarlo desde un punto de vista complejo, en el que se dé una importancia especial a la vivencia personal, tanto desde el punto de vista corporal como psicológico para el despertar de la conciencia. A su vez, dichos elementos se mostrarán esenciales para comprender la propuesta de identidad narrativa que subyace en la serie. Por todo ello, los planteamientos de Westworld suponen una interesante reflexión sobre cómo se concibe la identidad hoy en día. (shrink)

We subsist under the law where we claim our rights and are obliged to do something enforced. What is a law? The question would be perplexing in history, and one of crucial themes with many lawyers or legal philosophers. As we know, two most important perspectives had earned a universal and historical forge in academics, to say, the natural law and legal positivism. The concept of natural law deals in its primacy for the humanity and natural order which often can (...) be traded as something inviolable or inalienable. The concept has strands in several aspects; (i) its anchor with the civil democratic revolution around 17 and 18 centuries (ii) its supremacy with the new constitutional states (iii) less quality as a realist law from ambiguities and lack of clear definition. The concept of public policy may be related with the social justice, ethics and administration. It generally pursues a justice and desired state of public or community where the tension and conflict always exist between the ruling class and citizens. Historically, the public policy could be mightier to address the society than law where the benevolent Kings or Sovereigns liked to address both their needs and social justice. They may abrogate, more in endowment and divinity, the laws or social customs. The tension between the public power and private interests could be one reason as well as offers a good dualism in understanding the rule of law concept and advent of modern democracy. In this dimension, the King would no longer be divine nor entitled to exercise a plenary power of state rule. Instead, the popular sovereignty in the US democracy or parliamentary type in the UK were to be established to resolve a feudal conflict within the class and society. Lighted to be in vein of influence could arise the two contexts which are a contractarian view and plutocracy desire of the founding fathers. They underlay the mood and philosophical ethos of US revolution. Hence, three concepts as a pillar in private law were sanctified in the very foundation of US constitutional state, sanctity of property right, freedom of contract and due limits for the civil liability. The governmental power should be limited to protect the life and limb of citizens which addressed the Hobbes’ evil, “war against all the rest.” The due process concept was expressed as a fundamental principle of constitution where the human rights are inviolable and inalienable. The separation of powers principle could serve the freedom and wealth of new civil class in the continent, and bicameralism was devised for the check and balance within the federal congress. They see the role of judicial branch is important to preserve their civil interest. Then we can derive some assumptions between the law and public policy. First, a law plays to protect the private interest while the public policy pursues the social justice and mediates the competing interests, “private v. private” and “public v. private.” The civil courts may address a first nature of conflict and the law of takings or regulatory laws may deal with the second aspect. Second, the public or administrative law can shape a legal plane of bureaucracies or public administration, and may guarantee the rule of law ideals. It plays as an enabling authority and, on the other, monitors an arbitrariness and unfairness in the bureaucratic government. In this context, the unresponsive and unfathomable bureaucracy in the Kafka’s could be remedied. Third, for the welfare state in the late 19th and 20th century, a law can well be seen as one of authoritative expression of public policy to redress the evils of capitalist states. Some public laws, such as the Sherman Act classically and Lanham Act recently, may act to regulate the monopoly or oligopoly while other laws were enacted to restore justice between the labor and employers. Through the chapters, the fundamentals of law and public policy will be considered to address their proper status. (shrink)
