Christopher Hill's Perceptual experience is a must‐read for philosophers of mind and cognitive science. Here I consider Hill's representationalist account of spatial perception. I distinguish two theses defended in the book. The first is that perceptual experience does not represent the enduring, intrinsic properties of objects, such as intrinsic shape or size. The second is that perceptual experience does represent certain viewpoint‐dependent properties of objects—namely, Thouless properties. I argue that Hill's arguments do not establish the first thesis, and then I (...) raise questions about the Thouless‐property view and its role in Hill's defense of representationalism. (shrink)

A pecuária brasileira tem destaque acentuado quanto a sua participação no produto interno Bruto nacional (PIB), entretanto, dentro da cadeia produtiva das proteínas de origem animal, a ovinocultura ainda se apresenta como uma atividade com pouca expressividade e tecnificação frente a outras espécies animais domésticas, desta forma seu fomento e próspero desenvolvimento é dependente de inúmeros fatores, sendo que destes o correto manejo reprodutivo de espécies , a escolha de raças autóctones ou do exterior com boa adaptabilidade para serem criadas (...) em regiões de clima tropical e subtropical encontrados no Brasil e a correta seleção quanto a características reprodutivas de matrizes e principalmente de jovens carneiros cujos quais se deseja utilizar como reprodutores em rebanhos que buscam a constante evolução produtiva se faz muito importante. Tal cenário traz à tona a importância da realização de estudos referentes a suplementação de elementos como vitaminas e microminerais, que embora não sejam os maiores constituintes das dietas ofertadas aos animais de interesse zootécnico, exercem grande influência não só no crescimento e desenvolvimento do tecido muscular como também podem estar positivamente correlacionados quanto aos aspectos reprodutivos . O presente trabalho objetivou a avaliação da qualidade seminal e morfometria testicular de carneiros púberes submetidos a suplementação injetável de minerais e vitaminas, sendo utilizados 30 reprodutores divididos em três grupos de dez animais cada, com delineamento dos grupos inteiramente casualizado. Ao primeiro grupo foi administrada suplementação vitamínica e mineral (Grupo VM), no segundo grupo houve apenas suplementação vitamínica (Grupo VIT) e no terceiro grupo a suplementação mineral (Grupo MIN). No presente trabalho buscou-se avaliar os efeitos da aplicação de complexo vitamínico e mineral sobre a qualidade do sêmen ovino, medidas morfométricas testiculares e alteração nas concentrações dos hormônios cortisol e testosterona. Palavras chave: elementos-traço, hormônios, nutracêutico, ovinos, sêmen -/- Brazilian livestock has a strong emphasis in terms of its participation in the Gross National Product (GDP), however, within the production chain of animal proteins, sheep farming still presents itself as an activity with little expressiveness and technology compared to other domestic animal species. in this way its promotion and development depends on the correct methods, which are the reproductive of sheep species, the choice of indigenous or foreign breeds with good adaptability to be created in tropical and subtropical regions found in Brazil and the correct selection of selected animals and selection of products that are very important for the demand for products of constant breeding. This scenario leads to the development of important studies for the supplementation of such vitamins and trace minerals, which, although not the largest components of diets, exert a great influence not only on the growth of muscle tissues but can also be positively correlated with their reproductive aspects. The present evaluation of seminal quality and testicular morphometric of pubertal animals includes an injectable supplement of vitamins and minerals, using 30 sires distributed in three groups of animals each, with a completely random design of the products. The first supplementary group was given the mineral supplement (VM Group) in the second group only vitamin supplementation (VM Group) and the mineral supplementation group (MIN Group). This paper is inspired by and develops on E. J. Lowe’s work, who writes in his book The Possibility of Metaphysics that ‘metaphysical possibility is an inescapable determinant of actuality’ (1998: 9). Metaphysics deals with possibilities – metaphysical possibilities – but is not able to determine what is actual without the help of empirical research. Accordingly, a delimitation of the space of possibilities is required. The resulting – controversial – picture is that we generally need to know whether something is (...) possible before we can know whether it is actual. In order to appreciate this picture, we need to understand Lowe’s slogan: ‘essence precedes existence’ (Lowe 2008: 40). This slogan has both an ontological and an epistemic reading. The ontological reading is related to the now familiar idea that essence grounds modality, as popularised by Kit Fine. The epistemic reading suggests that we can know the essence of some entity before we know whether or not that entity exists. However, this idea is often met with puzzlement and Lowe himself sadly passed away before he had a chance to clarify this framework. I will present the framework as I understand it, develop it on my own terms, and put forward a qualified defence of it. I will also illustrate how the framework can be put to use with a case study concerning the discovery of transuranic elements. (shrink)

Se diserta sobre “RESISTENCIA TRIBUTARIA” JUSTIFICADA EN EL ECUADOR. Ello, porque gobierno del presidente Daniel Noboa estableció todo un “paquete” de “impuestos de guerra”, como la Contribución Temporal de Seguridad (CTS); un incremento del IVA, a discreción del presidente de la República, el pechaje del sector construcción, transferencias al exterior y otros impuestos. Ley Orgánica para Enfrentar el Conflicto Armado Interno, la Crisis Social y Económica (en adelante, la Ley), publicada en el Registro Oficial, Suplemento No. 516 del 12 de (...) marzo de 2024, trayendo a discusión los aspectos jurídicos que vician de posible inconstitucionalidad dicha Ley, con fundamento en la normativa constitucional y tributaria de Ecuador. Con la Ley, dado el contexto de su aprobación, el gobierno creó un ´impuesto de guerra´, para financiar una guerra inexistente, partiendo del hecho que la Corte Constitucional del Ecuador estableció que en el país no existe un “Conflicto Armado Interno” (CAI). Así lo estableció en sus Dictámenes 5-24-EE/24 del 9 de mayo de 2024 y 6-24-EE/24 del 13 de junio de 2024, en los que declaró inconstitucionales los decretos ejecutivos No. 250 de 30 de abril de 2024 y 275 del 22 de mayo de 2024, relacionados con el Estado de Excepción que ha regido en Ecuador desde el 10 de enero de 2024, soportado éste en la presunta existencia de un CAI, “decertado” y reconocido sin fundamento jurídico, pese a que no cumple con los supuestos fácticos y normativos fijados, con fuerza ius cogens, por el Derecho Internacional Humanitario (DIH)7 para ser calificado como tal. El ´impuesto de guerra´, fijado en la Ley, por inconstitucional, es confiscatorio. Los Dictámenes, en el plano de la reflexión tributaria, reflejan la patética violación al principio de la constitucionalidad y de la legalidad fiscal, resultando viciada de nulidad absoluta la Ley y, con ella, la configuración del tributo, porque el hecho imponible (CAI) es inexistente, implicando que el presupuesto establecido por la Ley para configurar cada `impuesto de guerra´ jamás tendrá materialización práctica (por inexistente) y nunca tendrá validez jurídica (por inconstitucional), resultando en un tributo confiscatorio, surgido contra la Carta Fundamental y evidente fraude a la legalidad tributaria del país, en perjucio del patrimonio personal o corporativo de los contribuyentes, residentes fiscales o establecimientos permanentes en el país a los que somete a un pago indebido sancionado en el artículo 122 10 , concordado con los artículo 306 al 307 del Código Tributario del Ecuador. La nulidad absoluta e ineficacia del hecho imponible, por inconstitucional, deriva en la invalidez plena y la irrelevancia constitucional del inexistente hecho generador del tributo -proveniente de un acto de naturaleza jurídica - por la no realización fáctica, tangible y concreta del presupuesto generatriz establecido (CAI) en la Ley para su configuración. Como consecuencia, nunca jamás surge válidamente la obligación tributaria, cuya exigencia resulta ineficaz, por ilegal e ilusoria. La obligación tributaria, tiene que calificarse, en tal sentido, como no nacida lícitamente en el ámbito fiscal. Con ello, habría de resultar confiscatorio el pago de la alicuota del `impuesto de guerra´ fijado por el gobierno ecuatoriano de modo inconstitucional abusando del ejercicio del poder tributario relacionado con la urgencia en materia económica. Ante las hondas repercusiones económicas que genera en la población y el sector productivo del país, se describen las posibles vías institucionales disponibles en la regulación ecuatoriana para impugnar la Ley ante la Corte Constitucional del Ecuador -o en la jurisdicción constitucional- sin menoscabo de la eventual activación de la competencia derogatoria de la Asamblea Nacional frente a la misma. Se reafirma el principio de justicia tributaria y la vigencia del Estado social de derechos y de justicia consagrado en la República del Ecuador y la plena efectividad de los derechos y garantías fundamentales de los hermanos ecuatorianos ubicados en la posición de destinatarios de un "impuesto de guerra" tan arbitrario como inconstitucional, que riñe con el enunciado constitucional y convencional del respeto a la dignidad humana y la incolumidad de la propiedad privada frente a actuaciones del Estado que representan un claro abuso en el ejercicio del poder público en desmedro de la legalidad fiscal, generador de un supuesto de patética injusticia tributaria adoptada a contracorriente de toda regulación en materia de impositiva con la publicación de la Ley Orgánica para Enfrentar el Conflicto Armado Interno, la Crisis Social y Económica. En la lucha contra conductas gubernamentales transgresoras de la dignidad humana y frente a leyes inconstitucionales que afectan los derechos fundamentales, la libertad económica y la propiedad privada de los hermanos contribuyentes ecuatorianos y sus empresas afectadas. Este esfuerzo intelectual, realizado por nuestra familia de abogados, es una reverencia a la gesta de nuestros libertadores y un llamado al pueblo ecuatoriano económicamente afectado a resistir, por medios institucionales, frente al pago de impuestos arbitrarios e ilegales que atentan contra los principios fundamentales del orden público económico previsto en la Ley Fundamental. Lo anterior, como una singular expresión reglada, lícita y avanzada de dar al traste con una ley orgánica fiscal tan arbitraria como injusta, activando los mecanismos de protección de los derechos fundamentales constitucionalmente establecidos en el Ecuador. La pretensión judicial traduciría, mutatis mutandis, en la activación institucional de la añeja figura de la "resistencia tributaria" (objeción fiscal, desobediencia tributaria), que, en sus orígenes, nació como expresión de la desobediencia civil frente a leyes impositivas injustas, con el precedente del escritor estadounidense Henry David Thoreau, encarcelado por negarse a pagar un tributo electoral, reticente a contribuir con la continuidad de la esclavitud y la financiación de la Guerra entre México y EEUU, basado en la idea de que las personas deben priorizar su conciencia sobre la obediencia a leyes injustas. -/- . This essay examines an ambiguity in Hans Kelsen’s theory of a norm. On the one hand, Kelsen claims to adhere to what he considers the ‘is/ought’ dichotomy. Kelsen claims that he is describing what really is. On the other hand, Kelsen seems to be understanding the is/ought dichotomy in a very different manner than that by which his contemporaries or, indeed, today’s readers understand the distinction. The clue to this ambiguity is Kelsen’s understanding of a norm. Although legal existence is (...) said to rest with norms, this existence is very different than an existence constituted from social behaviour. Instead, in Kelsen’s view, a norm is a signifying relation between a sign and a cognitive object. Kelsen’s theory of language, however, is very different from a theory of speech acts. When addressing why a norm is binding, we find that Kelsen’s full theory of language excludes important phenomena in order to retain its purity. (shrink)

En la presente reflexión, se exponen algunos de los efectos jurídicos y procesales derivados de la Declaración Conjunta de Argyle por el Diálogo y la Paz entre Guyana y Venezuela (Declaración Conjunta, en adelante), publicada en San Vicente y Las Granadinas en fecha 14 de diciembre de 2023. Se analizan, de manera sucinta, las implicaciones procesales que la Declaración Conjunta, asumida como elemento material probatorio, genera a favor de la posición jurídica de Venezuela que puede promover, con base a una (...) serie de hechos nuevos de relevante valor y eficacia procesal, tanto la i) la excepción de inadmisibilidad sobrevenida de la demanda judicial que, por el territorio de la Guayana Esequiba, promueve Guyana contra Venezuela, en la Corte Internacional de Justicia (CIJ) dada la impprocedencia de la misma y ii) la excepción de incompetencia sobrevenida de la CIJ para tramitar y decidir el litigio... Los autores dejan enunciado que, conforme a los Principios Generales del Derecho Internacional, concordados al artículo 52 de la Convención de Viena sobre Derecho de los Tratados y con la Declaración Conjunta de Argyle, es jurídicamente factible que Venezuela, conforme a los Principios el procedimiento de los artículos 65 y 66 ejusdem, promueva la nulidad absoluta retroactiva del Tratado Arbitral de Washington de 1897 y, de manera consecuencial, la nulidad absoluta retroactiva, ya reconocida, del Laudo Arbitral de París de 1899 por la coacción y la agresión y la invasión territorial que sirvieron de contexto y pretexto para su aprobación por parte de Venezuela, como medio para tratar de darle aparente legalidad a la ocupación militar ilegal de nuestro territorio Esequibo por parte del Reino Unido. A juicio de los autores, la iniciativa de rebajar el IVA al 12% encuentra asidero legal y constitucional, desde la perspectiva jurídica y académica, como se describe en el artículo científico LA INCONSTITUCIONALIDAD DE LA LEY ORGÁNICA PARA ENFRENTAR EL INEXISTENTE “CONFLICTO ARMADO INTERNO” EN EL ECUADOR , según se explica seguidamente. La propuesta de rebajar el IVA al 12%, es una iniciativa política acertada, justa, pertinente y necesaria frente a una medida gubernamental representativa de un pago indebido de impuestos (...) sin base constitucional, castigado por el Código Tributario ecuatoriano (artículo 122 concatenado a los artículos 306 y 307) . Su aplicación, viene a obedecer al principio de constitucionalidad que hacen de la transparencia y la moralidad pública un imperativo ético de la actuación estatal orientada a restaurar la justicia tributaria y restituir la justicia social en el Ecuador. La propuesta de la candidata Luisa González, desde tal perspectiva, luce inspirada en el principio constitucional y político fundante de la República del Ecuador, que la erige como una República funcional bajo el modelo del Estado de derechos, que promueve la dignidad humana, protege y garantiza los derechos humanos fundamentales, la felicidad social y el respeto a la legalidad como presupuesto de la convivencia pacífica de la comunidad política. Suppose that you prefer A to B, B to C, and C to A. Your preferences violate Expected Utility Theory by being cyclic. Money-pump arguments offer a way to show that such violations are irrational. Suppose that you start with A. Then you should be willing to trade A for C and then C for B. But then, once you have B, you are offered a trade back to A for a small cost. Since you prefer A to B, you (...) pay the small sum to trade from B to A. But now you have been turned into a money pump. You are back to the alternative you started with but with less money. This Element shows how each of the axioms of Expected Utility Theory can be defended by money-pump arguments of this kind. This book explores the nature and significance of Pyrrhonism, the most prominent and influential form of skepticism in Western philosophy. Not only did Pyrrhonism play an important part in the philosophical scene of the Hellenistic and Imperial age, but it also had a tremendous impact on Renaissance and modern philosophy and continues to be a topic of lively discussion among both scholars of ancient philosophy and epistemologists. The focus and inspiration of the book is the brand of Pyrrhonism expounded in (...) the extant works of Sextus Empiricus. Its aim is twofold: to offer a critical interpretation of some of the central aspects of Sextus’s skeptical outlook and to examine certain debates in contemporary philosophy from a neo-Pyrrhonian perspective. The first part explores the aim of skeptical inquiry, the defining features of Pyrrhonian argumentation, the epistemic challenge posed by the Modes of Agrippa, and the Pyrrhonist’s stance on the requirements of rationality. The second part focuses on present-day discussions of the epistemic significance of disagreement, the limits of self-knowledge, and the nature of rationality. Unity of science was once a very popular idea among both philosophers and scientists. But it has fallen out of fashion, largely because of its association with reductionism and the challenge from multiple realisation. Pluralism and the disunity of science are the new norm, and higher-level natural kinds and special science laws are considered to have an important role in scientific practice. What kind of reductionism does multiple realisability challenge? What does it take to reduce one phenomenon to another? How (...) do we determine which kinds are natural? What is the ontological basis of unity? In this Element, Tuomas Tahko examines these questions from a contemporary perspective, after a historical overview. The upshot is that there is still value in the idea of a unity of science. Human nature has always been a foundational issue for philosophy. What does it mean to have a human nature? Is the concept the relic of a bygone age? What is the use of such a concept? What are the epistemic and ontological commitments people make when they use the concept? In What’s Left of Human Nature? Maria Kronfeldner offers a philosophical account of human nature that defends the concept against contemporary criticism. In particular, she takes on challenges related to social (...) misuse of the concept that dehumanizes those regarded as lacking human nature (the dehumanization challenge); the conflict between Darwinian thinking and essentialist concepts of human nature (the Darwinian challenge); and the consensus that evolution, heredity, and ontogenetic development results from nurture and nature. After answering each of these challenges, Kronfeldner presents a revisionist account of human nature that minimizes dehumanization and does not fall back on outdated biological ideas. Her account is post-essentialist because it eliminates the concept of an essence of being human; pluralist in that it argues that there are different things in the world that correspond to three different post-essentialist concepts of human nature; and interactive because it understands nature and nurture as interacting at the developmental, epigenetic, and evolutionary levels. On the basis of this, she introduces a dialectical concept of an ever-changing and “looping” human nature. Finally, noting the essentially contested character of the concept and the ambiguity and redundancy of the terminology, she wonders if we should simply eliminate the term “human nature” altogether. The title of Hare’s book refers to the gap between the demand that morality places on us and our natural capacity to live by it. Such a gap is paradoxical if we accept the “‘ought’ implies ‘can”’ principle. The solution, Hare argues, is that the gap is filled by the Christian God. So we ought to be moral and can do so—with divine assistance. Hare’s statement and defense of the existence of the gap combines a rigorously Kantian notion of the (...) moral demand with a rigorously Calvinist notion of human depravity. As such, many readers will find the gap exaggerated, but most people will admit that there is some sort of gap here to be faced, and any gap at all is a problem. (shrink)

States of affairs are entities like snow’s being white. This dissertation encompasses two projects. First, I provide a historical survey of the concept of state of affairs as it has been used in the history of ontology. Second, I provide a novel conceptual account of states of affairs.

Os minerais possuem uma influência direta em diversos processos fisiológicos no organismo animal e, mesmo com tamanha importância, por vezes são negligenciados pelos produtores para seu fornecimento para os animais. Este estudo teve como objetivo avaliar o desempenho reprodutivo de rebanhos de bovinos, caprinos e ovinos em 8 propriedades rurais nas cidades de Sanharó, Pesqueira, Arcoverde, Belo Jardim e São Bento do Una através da adição de suplemento mineral e mistura múltipla aos animais de forma a atender suas necessidades básicas (...) para mantença e reprodução. Foram avaliados os desempenhos de 4 touros e 25 vacas, 3 bodes e 50 cabras e 4 carneiros e 48 ovelhas em diferentes propriedades, avaliando como a adição de um suplemento mineral específico da espécie impacta de forma positiva nos índices reprodutivos avaliados que foram taxa de cio, taxa de serviço, taxa de concepção, taxa de fertilidade, taxa de prenhez, taxa de perdas gestacionais, taxa de natalidade e taxa de mortalidade. O experimento teve duração de 2 anos e pôde-se avaliar cerca de 2 partos nas vacas e, mais ou menos, 3 partos em cabras e ovelhas. Os dados foram computados e avaliados estatisticamente no Excel para conferir se os índices reprodutivos melhoraram em função da adição de minerais na ração dos animais. In this chapter, I focus on the experience of torture and, more specifically, on Jean Améry's account of it in his book *At the Mind's Limits*. There he claims that the loss of confidence in the world is the most devastating effect he experienced as a victim of torture. I thus explore what cosmopolitan aspiration may be revealed by this loss and also discuss whether it is to be discredited as an irrational reaction on the victim's side or instead as (...) proportional to the facts and, consequently, as relevant to the conditions under which a certain cosmopolitan aspiration could be achieved or, at least, favored. In this paper, I critically engage with Casey Perin's interpretation of Sextan Pyrrhonism in his book, The Demands of Reason: An Essay on Pyrrhonian Scepticism. From an approach that is both exegetical and systematic, I explore a number of issues concerning the Pyrrhonist's inquiry into truth, his alleged commitment to the canons of rationality, and his response to the apraxia objection.

In this paper, I will reread the history of molecular genetics from a psychoanalytical angle, analysing it as a case history. Building on the developmental theories of Freud and his followers, I will distinguish four stages, namely: (1) oedipal childhood, notably the epoch of model building (1943–1953); (2) the latency period, with a focus on the development of basic skills (1953–1989); (3) adolescence, exemplified by the Human Genome Project, with its fierce conflicts, great expectations and grandiose claims (1989–2003) and (4) (...) adulthood (2003–present) during which revolutionary research areas such as molecular biology and genomics have achieved a certain level of normalcy—have evolved into a normal science. I will indicate how a psychoanalytical assessment conducted in this manner may help us to interpret and address some of the key normative issues that have been raised with regard to molecular genetics over the years, such as ‘relevance’, ‘responsible innovation’ and ‘promise management’. Evolution's Arrow argues that evolution is directional and progressive, and that this has major consequences for humanity. In her book Specifications Grading, Linda B. Nilson advocates for a grading regimen she claims will save faculty time, increase student motivation, and improve the quality and rigor of student work. If she is right, there is a strong case for many faculty to adopt some version of the system she recommends. In this paper, we argue that she is mostly right and recommend that faculty move away from traditional grading. We begin by rehearsing the central features of specifications grading (...) and providing two examples of how to implement it in philosophy classes. In light of the examples, we argue that specifications grading fulfills two of Nilson’s central desiderata but not the third. Since specifications grading generates two benefits that when combined increase student learning, without adding or increasing burdens, we conclude that student learning increases when courses are revised to include aspects of specifications grading. Esto último implicaría una renuncia a considerar que el centro de la vida de las sociedades son las personas como sujetos no sólo de derechos y deberes sino principalmente sujetos capaces de decidir, (...) de elegir, entendida esta capacidad como lo que caracteriza a los seres humanos. El pensamiento personalista, principalmente en su orientación cristiana, señala un camino para la búsqueda de nuevas formas de la economía y la política, como mediaciones imprescindibles para la realización de la vida humana, de su poder transformador –entendido como capacidad— y de la superación de visiones centradas en el poder—entendido como dominio—, de macrosujetos como los Estados que se alejan de los ciudadanos o los mercados que manipulan a los consumidores. The paper reviews a book by Massimo Modica dedicated to Denis Diderot's 'Salons' and in particular to Denis Diderot's statements about painter Claude-Josef Vernet and his "Promenade" (XVIII Century).

Scientists have complained about the inconsistency and politics of academic publishing for hundreds of years. Among the explanations offered are that evaluators lack time and use shortcuts, that they lack the expertise to judge things properly, that they can't put aside personal biases and we must hide the names of authors, and that they are conscientious instead of creative and cannot judge new ideas. All of these are actually wrong. As a literary analyst, I spent the last ten years independently (...) studying this same problem in book and movie production. I've found that the human decision-making apparatus doesn't work the way we think, and the solutions based on this misunderstanding could never have solved the problem. In this paper, we present the first method that actually can, which is a technique adapted from computer hacking, as well as a new view of how our brains make choices. (shrink)

What are the freedom-relevant conditions necessary for someone to be a morally responsible person? I examine several key authors beginning with Harry Frankfurt that have contributed to this debate in recent years, and then look back to the writings or Søren Kierkegaard to provide a solution to the debate. In this project I investigate the claims of semi-compatibilism and argue that while its proponents have identified a fundamental question concerning free will and moral responsibility—namely, that the agential properties necessary for (...) moral responsibility ascriptions are found in scenarios where the agent acts on her own as opposed to her action resulting from freedom undermining external causes such as manipulation, phobias, etc.—they have failed to show that the freedom-relevant agential properties identified in those actual-sequence scenarios are compatible with causal determinism. My argument is that only a voluntarist-libertarian theory can adequately account for the kinds of cases that the semicompatibilist identify. I argue that there are three freedom-relevant conditions necessary for someone to be a morally responsible person: a hierarchical understanding of human desires [specifically and mental states generally], an incompatibilist (non-deterministic) understanding of human action, and a historical understanding of character development. The ability to reflect critically about one’s own desires and emotions, and thus to have a kind of self-knowledge and understanding with regard to the springs of one’s own actions, is required to make it possible for the agent to be the “source” of her own actions and character. The non-deterministic understanding of human action is needed for a similar reason: if determinism is true, then every action a person performs can be ultimately traced to and exhaustively explained in terms of factors outside the agent’s control, thus making the agent’s responsibility for his actions an illusion. And finally,human nature must be such that, over time, one’s choices leave a dispositional residue self-understanding and motivation in the person’s self, out of which, in mature understanding and motivation, the person acts as a fully responsible agent. The Notion of ‘civilisation’ in European and post-Enlightenment writings has recently been reassessed. Critics have especially reread the works of Immanuel Kant by highlighting his racial categories. However, this Paper argues that something is missing in this contemporary literature: namely, the role of the European legal culture in the development of a racial and ethnic hierarchy of societies. The clue to this missing element rests in how ‘civilisation’ has been understood. This Paper examines how one of the leading jurists of (...) the 19th and 20th centuries, George W. Hegel (1770-1831), took for granted a sense of a legal culture that excluded indigenous inhabitants of the Americas as legal persons worthy of legal protection. -/- Such an exclusionary legal culture represented a crucial feature of ‘civilisation’ according to Hegel. This Paper identifies a series of factors which Hegel highlighted as instrumental in constituting a civilised society: Bildung, an ethos, a written legal culture, a self-creative author (the state), territorial knowledge, and a hierarchy of societies. Hegel emphasized the need of jurists to analytically “leap” from a traditional society to a legal culture before the jurist could identify a law. The traditional societies of the Americas, according to Hegel, were considered lawless because they lacked a European sense of a legal culture. Why Hegel characterised traditional communities as lacking a legal culture is then explained. The Paper ends by suggesting that the features of a legal culture that Hegel highlights remain with us today. (shrink)

O presente artigo pretende abordar o conceito de trágico, entendido como elemento principal ou elemento orquestrador do projecto nietzschiano em busca de uma determinação para uma nova forma de existência estética. Objectivo do autor é, pois, em primeiro lugar, explicitar o sentido da nova existência estética tal como Nietzsche, pela mão de Zaratustra, imputa à figura do Übermensch, o qual estabelece um projecto de justificação estética; em segundo lugar, trata-se de mostrar que o conceito de 'trágico'está estreitamente relacionado com o (...) conceito metafísico de 'eterno retorno'de tal modo que isso pretende, por um lado, ultrapassar a dimensão determinada da vida humana em algo maior ou melhor, e, por outro, visa a completa realização da vida humana que pode ser repetida, salientando que este movimento de repetição afirma o retorno dionisíaco do trágico. Objectivo do autor do artigo é, assim, provar que o projecto nietzschiano anuncia o Übermensch como uma nova forma de existência estética, ao mesmo tempo que recupera os conceitos de 'trágico' e 'dionisíaco', conceitos estes que animam a obra Die Geburt der Tragödie. Consequentemente, trata-se de ver até que ponto o Übermensch está afirmado como objectivo necessário e primário neste projecto, o qual permanece, contudo, uma herança enigmática em que nos deixa a filosofia de Nietzsche. /// The present article presents a brief approach to the concept of the 'tragic' understood as a main element or a conducting element in the Nietzschean project that searches for a determination of a new form of aesthetic existence. The author aims, thus, at two things: first, to explicit the meaning of this new aesthetic existence that Nietzsche, by the hand of Zarathustra, imputes to the figure of the Übermensch, which establishes a project of aesthetic justification; secondly, to show that the concept of the 'tragic' is closely related to the metaphysical concept of the 'eternal return' in such a way that it purposes, on the one hand, to surpass a determined dimension of human life into something bigger or better, and, on the other, to bring about a complete realisation of human life that can be repeated, so that the movement of repetition qffirms the dionysiac return of the tragic. The goal of the article is, moreover, to prove that the Nietzschean project announces the Übermensch as a new form of aesthetic existence while recovering the main concepts of 'tragic' and 'dionysiac', concepts that animate the book Die Geburt der Tragödie. Therefore, we shall see how the Ubermensch is placed as a necessary and prime objective in this project, which remains part of the enigmatic legacy with which Nietzsche's philosophy leaves us. In Nicomachean Ethics 2.1, Aristotle draws a now familiar analogy between aretai ('virtues') and technai ('skills'). The apparent basis of this comparison is that both virtue and skill are developed through practice and repetition, specifically by the learner performing the same kinds of actions as the expert: in other words, we become virtuous by performing virtuous actions. Aristotle’s claim that “like states arise from like activities” has led some philosophers to challenge the virtue-skill analogy. In particular, Aristotle’s skill analogy is (...) sometimes dismissed because of the role that practical wisdom or phronesis purportedly plays in character virtue. In this paper, I argue that a proper understanding of character virtue, phantasia-based emotions, and Aristotle’s implicit distinction between habituated and strict or full virtue (aretè kuria) grounds his virtue-skill analogy. Character virtue stems from the non-rational orektikon and is developed through the habituation of passionate elements, primarily phantasia and pathé. Pathé are pleasurable or affective perceptions, not judgments or beliefs. Thus, pathé are subject to non-rational habituation. Practical wisdom, on the other hand, is an intellectual virtue stemming from the rational part of the soul. Though practical wisdom is necessary for full virtue (aretè kuria), it is not necessary for the habituated character virtue that Aristotle refers in Book II. Once we understand the phantastic basis of emotions and the distinction between habituated and full virtue, the virtue-skill analogy is apt. I conclude by briefly mentioning two contemporary forms of emotion regulation—cognitive reappraisal and cognitive behavioral therapy—that lend support from empirical psychology to Aristotle’s claim that emotions (pathé) can be habituated. Character virtue is indeed a skill; it is—at least in part—the skill of emotion regulation. (shrink)

My observations here are meant to address a current lacuna in discussions of Kant's aesthetics, namely the beauty of poetry. There are, I admit, numerous treatments of poetry considered in the light of Kant's aesthetic theory, but what may not be noticed is that in discussions of poetry and Kant's aesthetics, the topic of poetic beauty only rarely comes up. This virtual silence on the beauty of poetry is surprising, given that the beautiful is obviously one of the two foundational (...) aesthetic categories in Kant's aesthetics. This silence stands out all the more given that Kant himself explicitly mentions that poems can be beautiful and furthermore declares poetry to be the highest form of fine art. Why, then, is the beauty of poetry almost never discussed in relation to Kant's aesthetics? Ultimately, I will be arguing that this silence on the beauty of poetry is a motivated one, albeit an unintentionally motivated one, namely because Kant's conception of free beauty militates against its being applied to poetry. In other words, this lacuna in discussions of Kant's aesthetics rests on a lacuna in the field of products of fine art to which the Kantian conception of free beauty can be applied. It seems that this lacuna has been overlooked in the literature principally because Kant himself overlooks it; in addition, interpreters of Kant may well independently overlook it for the same reasons that Kant apparently did. This book demonstrates how the authors have experienced the power of phenomenology in their therapeutic work with patients, especially those struggling with horrific trauma; in their encounters with psychological and philosophical theories; and in their efforts to comprehend destructive ideologies and the collective traumas that give rise to them. The Power of Phenomenology presents the trajectory of this work. Each chapter begins with a contribution written by one or both authors, extending the power of phenomenological inquiry to one or more (...) of these diverse contexts. The contributions are followed, one or two at a time, by a dialogue between the authors, illustrating the dialectical process of their long collaboration. In this paper, I discuss several temporal aspects of paleontology from a philosophical perspective. I begin by presenting the general problem of “taming” deep time to make it comprehensible at a human scale, starting with the traditional geologic time scale: an event-based, relative time scale consisting of a hierarchy of chronological units. Not only does the relative timescale provide a basis for reconstructing many of the general features of the history of life, but it is also consonant with the cognitive (...) processes humans use to think about time. Absolute dating of rocks, fossils, and evolutionary events (such as branching events on the tree of life) can be accomplished through the use of radiometric dating, chronological signals extractable from fossil growth patterns, and the “molecular clock.” Sometimes these different methods of absolute dating, which start from largely independent assumptions and evidentiary bases, converge in their temporal estimates, resulting in a consilience of inductions. At other times they fail to agree, either because fossils and molecules are giving temporal information about different aspects of nature and should not be expected to agree, or because of flawed assumptions that give rise to an inaccurate estimate. I argue that in general, despite the fact that it can be difficult to integrate disparate kinds of evidence, the principle of total evidence should be applied to the dating of evolutionary events. As a historical science, paleontology studies past events we cannot observe directly. This raises questions of epistemic access, meaning that due to the fragmentary nature of the fossil record we may find ourselves without access to the relevant traces to adjudicate between rival hypotheses about the past. The problems and prospects of epistemic access are explored through a case study of the reconstruction of the colors of dinosaurs. The paper closes with a reflection on the Darwin- Lyell metaphor of the fossil record as a highly fragmentary history book, and a call for a reconsideration of the book metaphor in favor of a systems view of the geologic and fossil records. The Centre for Society and Genomics (CSG) was established in 2004, funded by NGI (the Netherlands Genomics Initiative). Funding was continued in 2008. This report summarises the basic outcomes of almost a decade of interactive societal research, in close collaboration with the other centres of the NGI network. There are two reasons for presenting these results. First of all, at the end of this year, the CSG Next programme (2008-2013), encompassing more than 50 research projects conducted at 10 Dutch universities, (...) will be completed. Moreover, we are currently preparing ourselves for the years to come. The network of principal investigators, together with the research communities they represent and the societal and international networks they are involved in, have agreed to continue to work together, on the basis of mutual learning, transdisciplinary collaboration and collegial support. Notably, we offer our networks, experiences and expertise to help prepare the ground for promoting Responsible Research and Innovation (RRI) in the context of Horizon2020, together with our European colleagues. This report summarises what our type of research can achieve and how we want to continue our activities in the future. After a concise sketch of the life sciences landscape as it has evolved during the past seven decades or so, we explain how CSG came about and what kind of approach we have developed. Subsequently, we list our main results, notably in the form of project vignettes, so as to make the harvest of the CSG Next programme as tangible and concrete as possible. Finally, we explain how we see our role in the future. As is already indicated by the title: this is not merely a retrospective summary of our results (CSG harvest), but an invitation to readers (from academia, industry, policy and civil society) to reassemble and to optimally prepare ourselves for things to come, by strengthening and broadening our collaborative efforts, building on what we have achieved so far. This paper investigates Jesus’ Principles of Breaking Barriers: A Reflection on John 4:3-42 as a pivot and principle for breaking barriers from biblical perspective. Worthy of note is the fact that there existed socio-ethnic barrier between the Jews and Samaria; gender barrier imposed by Jesus’ androcentric culture and a moral barrier imposed by the Samaritan woman’s assumed behaviour. This paper using hermeneutical theory of biblical interpretation and historical insight into this Johannine text brings to the fore that, the Jewish-Samaritan barrier (...) had ethnic, religious and political undertones which made the Samaritans and Jews to see themselves as ‘enemies’; the interaction with the Samaritan woman broke barriers and set a new agenda for relationship with ‘inferior’ gender and morally low in the human society. Herein exists principles of breaking barriers set by Jesus which are worthy of emulation in the twenty-first century which is plagued by socio-ethnic, religious, gender and moral barriers. (shrink)

Several scholars familiar with Sextus Empiricus’s Pyrrhonism who have attentively read his Against the Ethicists have gotten the impression that something strange is going on in this book. For, at variance with the ‘official’ Pyrrhonian attitude of universal suspension of judgment, a number of passages of Against the Ethicists seem to ascribe to the Pyrrhonist both a type of negative dogmatism and a form of realism, which together amount to what may be called ‘moderate ethical realism’. Aristotle's Poetics has been the basis for theories of entertainment for over 2,000 years. But the general approach it uses has led to a number of gaps, contradictions, and difficulties in predicting the success of books, plays, movies, and entertainment as a whole, so much so that sayings like "there are no rules, but you break them at your peril," and "in Hollywood, nobody knows anything" have become widespread and accepted. -/- However, it turns out that a model of (...) entertainment that defines literary conventions by the pleasurable feelings they release in the brain, and then equates them with outside experiences that people subconsciously attach to the literary work, in the same way that we can be conditioned to feel love when we view our wedding rings, can actually resolve almost every seeming contradiction in Aristotle's ideas and traditional theories of storytelling when compared to real-world results. -/- Furthermore, this approach can be extended to the other major forms of art, including painting, music and even video games, leading to a "Non-Aristotelian" theory that modifies the fundamental aspects of each of these fields, but in a natural and necessary way, which strengthens both our understanding and our ability to predict the success or failure of art in the future. -/- My work as a vlogger and writer, mostly done via my Youtube channel "StoryBrain," has been viewed over 6 million times, and written about in MovieMaker magazine, Creative Screenwriting magazine, on the front page of major sites like Reddit, Roger Ebert online, and in international newspapers like the Sydney Morning-Herald in Australia and Fotogramas in Spain.
