Jeremy Bentham

The Montreal Declaration on Animal Exploitation, which has been endorsed by hundreds of influential academic ethicists, calls for establishing a vegan economy by banning what it refers to as all unnecessary animal suffering, including fishing. It does so by appeal to the moral principle of equal consideration of comparable interests. I argue that this principle is misapplied by discounting morally relevant cognitive capacities of self-conscious and volitional personhood as distinguished from merely sentient non-personhood. I describe it as a kind of (...) anthropomorphizing moralism which I call anthropomoralism, defined as the tendency to project morally relevant characteristics of personhood onto merely sentient non-persons by discounting their existing differences with actual persons. I show that this attitude can lend support to the resurgent attempt to treat fetal pain as equally morally considerable to that of childbearing persons they gestate within. I explain that the only sound way to apply the principle of equal consideration of comparable interests is to compare experiences of actual persons. Therefore, while supporting a vegan economy may be morally praiseworthy, it should not be deemed morally obligatory. (shrink)

Kant and Moral Theory The historian Herodotus gives (...) the anecdote of Darius, King of Persia, who summoned the Greeks and asked them if they would be willing to eat the bodies of their dead fathers. They replied they would not for any money in the world. Later, Darius asked some Indians of the tribe called Callatiae, who do eat their dead parents’ bodies, if they would ever consider burning the bodies, as was the custom among Greeks. “One can see by this what custom can do” writes Herodotus. He draws the conclusion that this story vindicates the view some acts may be right for some and wrong for others, depending on their individual conceptions of morality. The Sophists were also associated with relativistic thinking, notably Protagoras who asserts that “man is the measure of all things”. However, this view was quite uncommon and moral relativism hardly flourished, as Plato and Aristotle both defended forms of moral absolutism. Ancient Greek philosophers acknowledged moral diversity, but more often under the form of moral scepticism, which states that there is no moral knowledge (rather than moral truth is relative to a culture). Over time, the actions of mankind have been the victim of two vague labels, right and wrong. The criteria for these labels are not clearly defined, but they still seem to be the standard by which the actions of man are judged. There are some people that abide by a deontological view when it comes to judging the nature of actions; the deontological view holds that it is a person's intention that makes an action right or wrong. On the other (...) hand there is the teleological view which holds that it is the result of an action is what makes that act right or wrong. In this essay I will be dealing with utilitarianism, a philosophical principle that holds a teleological view when it comes the nature of actions. To solely discuss utilitarianism is much too broad of topic and must be broken down, so I will discuss specifically quantitative utilitarianism as presented by Jeremy Bentham. In this essay I will present the argument of Bentham supporting his respective form of utilitarianism and I will give my critique of this argument along the way. (shrink)

Mill’s Principle of Utility: Origins, Proof, and Implications (Leiden: Brill, 2022) is a scholarly monograph on John Stuart Mill’s utilitarianism with a particular emphasis on his proof of the principle of utility. Originally published as Mill’s Principle of Utility: A Defense of John Stuart Mill’s Notorious Proof (Amsterdam: Editions Rodopi, 1994), the present volume is a revised and enlarged edition with additional material, tighter arguments, crisper discussions, and updated references. The initiative is still principally an analysis, interpretation, and defense of (...) the controversial proof, which has yet to attract a scholarly consensus on how it works and whether it succeeds. Well over a century and a half after Mill’s contribution, the subject matter continues to figure prominently in classroom discussions, where the principle and its proof are presented and debated in connection with the critical baggage of logical problems and conceptual confusions wrongly attributed to Mill from the beginning. The overarching aim of the book, now supplemented by a comprehensive historical background and salient philosophical implications, remains the vindication of Mill’s reasoning in pursuit of what he promises as a proof of the principle of utility. A dialogue, in three parts, on utilitarian vulnerability to exploitation.

My aim in this chapter is to push back against the tendency to emphasize Mill’s break from Bentham rather than his debt to him. Mill made important advances on Bentham’s views, but I believe there remains a shared core to their thinking—over and above their commitment to the principle of utility itself—that has been underappreciated. Essentially, I believe that the structure of Mill’s utilitarian thought owes a great debt to Bentham even if he filled in that structure with a richer (...) conception of human nature and developed it in more liberal directions. This commonality is revealed, in particular, in Mill’s own institutional designs and practical reform proposals in Considerations on Representative Government and related writings. If this is right, then the tendency of interpreters to highlight their differences rather than their similarities has been to the detriment of both Mill and Bentham scholarship, and so to our understanding of the rise of liberal utilitarianism. A discussion of Ricardo's sustained relationship with James Mill as well as of hypotheses by such commentators as Halévy and Hutchison on a decisive philosophical influenco by Mill (eithr Scottish or Benthamite) on Ricardo's eocnomic methodology.

This paper (i) offers an interpretation of some central aspects of Jeremy Bentham’s philosophy of language, (ii) challenges the received view of its relation to analytic philosophy, and (iii) seeks to show that this investigation into the prehistory of analytic philosophy sheds light on its history proper. It has been often maintained, most notably by Quine, that Bentham anticipated Frege’s context principle and the use of contextual definition. On these bases, Bentham has been presented as one of the initiators of (...) a tradition that shares a common commitment to the “semantic priority of sentences” and that includes authors as otherwise diverse as Frege, Russell, and Wittgenstein. In opposition to this narrative, I argue that Bentham did indeed anticipate the use of contextual definition, but was not a forerunner of Frege’s context principle. The two issues should be sharply distinguished. I show that Bentham’s philosophy of language is informed by a set of empiricist assumptions that Frege’s contextualism was centrally meant to oppose. I conclude that with respect to the question of the relation between propositional and sub-propositional meaning, we should distinguish two opposed strands in the history of analytic philosophy: an empiricist strand anticipated by Bentham, represented most notably by Russell, and an anti-empiricist strand, represented most notably by Frege and Wittgenstein. I try to reconstruct the hidden agenda of nineteenth-century British controversy between Utilitarianism and Intuitionism, going beyond the image, successfully created by the two Mills, of a battle between Prejudice and Reason. When examined in depth, competing philosophical outlooks turn out to be more research programs than self-contained doctrinal bodies, and such programs appear to be implemented, and indeed radically transformed while in progress thanks to their enemies no less than to their supporters. Controversies, the propelling devices of research programs, (...) are real-words affairs, and philosophers do not engage in them just for the sake of the argument, but in order to win, and alignments are defined on the basis of strategic and tactical requirements that cross the boundaries of disciplines. I suggest that good objections and counter-objections, and most of all amendments of doctrines, were incidentally produced in the course of the fight, and they were no less valuable because of their being more side-effects than sought-for discoveries. This Article shows how three modern English thinkers — Hobbes, Locke and Bentham — construe the law as an intersection of secular eternity on the one one hand and transience in modernity on the other, allowing for immovability and movement at the same time, combining stability with change. It details how these theorists, who undoubtedly have earned themselves places of honor in the canon of modern political thought, tried to solve the problem of self-grounding in three different and yet paradigmatically (...) modern ways, each of them intertwining law and time in a different fashion, and each of them connecting both law and temporality to happiness. Thus this Article shows not only that these three British thinkers claim in one way or another that while natural desires may provide pleasure, only the law can bring happiness, but also emphasizes that, in their view, the transformation of the former into the latter entails a transformation of temporal consciousness. Thereby this Article foregrounds two elements that are crucial to an understanding of how seventeenth and eighteenth century British thinkers envisaged the transformation of pleasure into happiness by means of the law: first, the notion that the law creates or reinforces duration in social life, and second, the idea that the law can harness the immediacy of desires by assuring the legal protection of enduring pleasures, which lead to happiness. A short discussion of the emergence of the self-interest axiom during the classical phase of political economy, its roots in the previous discussion on self-love in early modern ethics and its development in the following formulation of the notion of 'homo economicus' and the definition of the agent's rationality.

The paper discusses Ricardo's relationship to Mill and Bentham. It discusses first the origins of the myth of Ricardo's dependence from Bentham through Mill, and Halévy's contribution to the freezing of such a myth. The paper reconstructs what were their shared political commitments and activities and the kind of specific political views and agenda that may be ascribed to Ricardo himself. The paper discusses then the question of Ricardo's adhesion to Benthamite ethics. It examines fragments in Ricardo's correspondence with Maria (...) Edgeworth and Francis Place, and adds fresh light on the issue by highlighting the partial overlapping between Bentham's ethics and the kind of intuitionism with theological consequentialism that Ricardo had learned from the Unitarian minister Thomas Belsham. I discuss the interpretation of the principle of utility as a factual statement, the relevance of Halévy's interetation of Bentham, and then Bentham's relationship with James Mill and David Ricardo.

This is the first Italian translation of Bentham’s “Deontology”. The translation goes with a rather extended apparatus meant to provide the reader with some information on Bentham’s ethical theory's own context. Some room is made for so-called forerunners of Utilitarianism, from the consequentialist-voluntarist theology of Leibniz, Malebranche, John Gay, Thomas Brown and William Paley to Locke and Hartley's incompatible associationist theories. After the theoretical context, also the real-world context is documented, from Bentham’s campaigns against the oppression of women and cruelty (...) to animals to his projects of political reform. A reply to Fransisco Vergara's attack on Halévy's interpretation of Bentham in Philosophy, January, 1998. Vergara had argued that Halévy was mistaken in interpreting Bentham's principle of utility as a psychological law as well as the ethical greatest happiness principle. Mongin and Sigot show that Halévy correctly interpreted Bentham's texts and that the psychological law is necessary to Bentham's legal theory, economics and politics; they also argue that it is incorrect to confuse the principle of utility with a theory of (...) universal selfishness, and that this misunderstanding underlies Vergara's mistaken picture of both Halévy and Bentham. A brief reconstruction of the birth, rise and ironical destiny of an almost universal expansion to other disciplines going with a dissolution within the original birthplace of the conception of an economic man, a male-only abstraction forgetful of its own abstract character.

The book is quite convincing as far as it argues more autonomy from Mill and a more pro-working-class picture than the received image of Ricardo allows for. A severe pitfall is having ignored the relevance of Unitarianism as a matrix of political radicalism. A related defect is not having exploited less obvious sources than those included in Sraffa’s edition.

Élie HALÉVY (1870-1937), philosophe et historien des idées, fut professeur à l'École libre des sciences politiques, l'ancêtre de l'actuel Sciences Po. Comme son autre grand ouvrage, l'Histoire du peuple anglais au XIXe siècle, paru en six tomes de 1913 à 1932, les trois tomes de La formation du radicalisme philosophique, parus en 1901 pour les deux premiers et en 1904 pour le troisième, reflètent pour partie ses enseignements de l'Ecole libre consacrés à l'histoire britannique. Le premier tome, La jeunesse de (...) Bentham 1776-1789, étudie la doctrine utilitariste non seulement chez celui qu'on regarde comme son fondateur principal, Jeremy Bentham, mais aussi chez les nombreux auteurs qui, en Grande-Bretagne et sur le continent, en dessinèrent avant lui les contours. Le deuxième tome, L’évolution de la doctrine utilitaire de 1789 à 1815, montre comment l'utilitarisme revêtit la forme non seulement d'une école de pensée, mais aussi d'un mouvement pour la réforme économique, sociale et politique. Le rôle coordonnateur nouveau de James Mill, ainsi qu'une convergence de vues avec les économistes, qui poussaient dans le sens des réformes, marquèrent notamment cette évolution. Le troisième tome, Le radicalisme philosophique, continue d'étudier la transformation de l'école en mouvement après la fin des guerres napoléoniennes, lorsque celle-ci commence à engranger ses premiers grands succès réformistes. Bentham, James Mill et les autres penseurs utilitaires sont alors réunis sous l'appellation de philosophic radicals. Le terme temporel de l'ouvrage est le Reform Act de 1832, première étape vers la modernisation du système électoral, que la propagande de ce groupe ne contribua pas peu à faire aboutir. Quoique l'ouvrage d'Halévy vaille en premier lieu par l'immense savoir qu'il déploie, et le nombre et l'excellence des citations qu'il propose, il comporte aussi des thèses historiques et philosophiques originales. On peut citer parmi les premières la thèse, qui relie les trois tomes, voulant que l'utilitarisme britannique trouve sa forme achevée dans l'intervention sur la société, lorsqu'il se mue en radicalisme philosophique, et parmi les secondes, la thèse, énoncée au début du premier tome, voulant qu'il existe trois modèles dominants de jonction des intérêts individuels (la fusion sympathique, l'identification naturelle et l'identification artificielle). Une autre grande thèse, à la fois historique et philosophique, affirme en substance que l'économie politique classique serait un département spécialisé de la pensée utilitaire. La question de savoir jusqu'à quel point Smith, Ricardo et Malthus ont pu adhérer au "principe d'utilité" de Bentham est toujours débattue. En même temps que les élucidations apportées à ce principe, elle contribue à expliquer l'intérêt que les historiens de la pensée économique continuent de porter à l'ouvrage. L'auteur a participé à la réédition de La formation du radicalisme philosophique en 1995 par les Presses Universitaires de France (P.U.F.), suivant un projet collectif lancé par Monique Canto-Sperber. Dans le présent article, antérieur à cette réédition, l'auteur tentait de résumer brièvement un livre qui demeure irremplaçable en dépit d'une conception et d'un style quelque peu datés. (shrink)
