My dissertation addresses the question "do desires provide reasons?" I present two independent lines of argument in support of the conclusion that they do not. The first line of argument emerges from the way I circumscribe the concept of a desire. Complications aside, I conceive of a desire as a member of a family of attitudes that have imperative content, understood as content that displays doability-conditions rather than truth-conditions. Moreover, I hold that an attitude may provide reasons only if it (...) has truth-evaluable content. Insofar as desires lack truth-evaluable content, I hold that the content of a desire has the wrong kind of logical structure to provide reasons. My second line of argument claims that even if a desire did have truth-evaluable content, it would not follow that desires provide reasons. This is because a desire has no more rational significance than a guess or coin-flip. My argument relies on what I call the non-substitutability principle, the thesis that (all things being equal) one cannot substitute something that lacks rational significance, relative to some attitude, A, for something that has rational significance, relative to A, and leave the rational standing of A unchanged. For example, one cannot substitute the guess that P (i.e., something that lacks rational significance relative to the belief that P) for the perception that P (i.e., something that is rationally significant relative to the belief that P) without altering the rational standing of the belief. I argue that when the non-substitutability principle is applied to a desire that gives rise to an intention, it turns out that one can always substitute a guess or coin-flip (i.e., something that lacks rational significance relative to the intention) for the desire, without altering the rational standing of the intention. I take this to show that desires are not rationally significant relative to the intentions to which they give. (shrink)

Christine Korsgaard has attempted to defend a distinct approach to metaethics – Neo-Kantian Constructivism. Not only does she present a positive case for her own view, she also attacks existing metaethical positions and even the disctinctions that metaethics has traditionally relied on. This thesis is a sustained examination of this position. I consider whether Korsgaard can legitimately claim to be offering a metaethical position at all, providing her with some defence against the scepticism of some metaethicists. I also examine her (...) attacks on traditional metaethical positions. I argue that her attack on moral realism can be avoided if the realism on offer takes a particular form. In the case of expressivism I claim that Korsgaard’s attack, though not fully developed in her work, motivates an examination of contemporary hybrid-expressivist theories. I argue that these are, as of yet, no advance over their non-hybrid cousins. Finally I examine Korsgaard’s own position, attempting to make it clearer by combining her claims with a framework developed by Crispin Wright for judgement-dependent qualities. This gives Korsgaard her best chance of a distinctive metaethical position. Ultimately, though, the Neo-Kantian approach to morality fails. (shrink)

The distinction between intrinsic and extrinsic value can be traced back to Plato and Aristotle. I contend that the distinction has never been properly drawn. My main task is to formulate the distinction in a way that avoids the problems of the traditional formulations. ;After defending the traditional Moorean conception of intrinsic value against John Mackie's arguments from relativity and "queerness," and against recent attacks by Elizabeth Anderson and Shelly Kagan, I attempt to define two important types of extrinsic value (...) in terms of intrinsic value. First, I define instrumental value. The main problem with traditional definitions of instrumental value is that they fail to account for the fact that preventing something intrinsically evil from occurring seems to be just as worthwhile as bringing about something intrinsically good. I attempt to account for this fact by introducing a "contextualist" analysis of instrumental value. Next, I present and defend an analysis of contributory value. I compare contributory value with conditional intrinsic value, and present an argument to show that the notion of conditional intrinsic value faces problems that can be avoided by admitting the existence of contributory value. I then expand on the contextualist analysis of instrumental value, and provide an analysis of extrinsic value that explains what is common to instrumental and contributory value. I contend that my analysis can also account for other types of extrinsic value---for example, signatory value---and I defend my analysis against recent objections by Alastair Norcross involving the extrinsic values of actions. ;Finally, I argue that contributory value can help to solve a current problem in environmental ethics. The problem is this: how can it be that the last member of a species is more valuable than a similar member of a flourishing species ? I argue that diversity of goods increases the value of a whole; therefore, the last member of an endangered species has contributory value in virtue of its contribution to the world's biological diversity. The buck-passing account of value involves a positive and a negative claim. The positive claim is that to be good is to have reasons for a pro-attitude. The negative claim is that goodness itself is not a reason for a pro-attitude. Unlike Scanlon, Parfit rejects the negative claim. He maintains that goodness is reason-providing, but that the reason provided is not an additional reason, additional, that is, to the reason provided by the good-making property. I consider various ways in which (...) this may be understood and reject all of them. So I conclude that buck-passers cannot reject the negative claim. (shrink)

Para tanto, iniciaremos apresentando a noção de memória de maneira informal e geral, para depois apresentar elementos mais detalhados. Finalizamos apresentando uma teoria causal da memória que se beneficia da noção de veritação (truthmaking).

É muitas vezes aceite que certas categorias, tipicamente as de género, raça, orientação sexual ou doença mental, são construções sociais e não divisões naturais no mundo. A distinção entre categorias naturais e categorias sociais, como pretende ser a distinção entre o sexo e o género, tem servido no âmbito da crítica e ciência social para advogar a abolição de certas normas sociais, e para a implementação de políticas mais equitativas. Contudo, há aspectos centrais do construtivismo que são pouco claros. O (...) que é que se nega ao rejeitar que as categorias construídas socialmente são naturais? E o que significa dizer que essas categorias são construções sociais? E será de todo verdade que certas categorias, como o género, são sociais e não naturais? Não tenho a pretensão de responder a todas estas complexas questões neste artigo, mas espero pelo menos iluminar parte do debate contemporâneo sobre estes problemas. Are values objective or subjective? To clarify this question we start with an overview of the main concepts and debates in the philosophy of values. We then discuss the arguments for and against value realism, the thesis that there are objective evaluative facts. By contrast with value anti-realism, which is generally associated with sentimentalism, according to which evaluative judgements are grounded in sentiments, value realism is commonly coupled with rationalism. Against this common view, we argue that value realism can be (...) combined with sentimentalism, and we suggest that a plausible account, which we call ‘sentimental realism’, and according to which evaluative judgements are closely related to emotions, can be developped. This 183-page introductory part of my dissertation is an overview of some key debates in philosophical moral psychology and its methodology.

This Thesis reconsiders the prospects for an approach to global justice centring on the proposal that every human being should possess a certain bundle of goods, which would include certain members of a distinctive category: the category of capabilities. My overall aim is to present a clarified and well-developed framework, within which such claims can be made. To do this, I visit a number of regions of normative and metanormative theorising. I begin by introducing the motivations for the capability approach, (...) and clarifying some of its most distinctive features. Next, I focus on Martha Nussbaum's version of the approach, and identify several problems therein. The most important concerns epistemology, and especially the challenges that constructivist theories pose. The middle part of the Thesis presents an alternative, based on the work of John McDowell, which I argue has superior prospects. Then, I turn to two further problems: that of making sense of the universalistic aspirations of cosmopolitanism, and that of integrating the microscopic prescriptions of ethics with the macroscopic analyses of political philosophy. Using the Aristotelian interpretation of its core framework that I have developed, I conclude that the capability approach can provide compelling answers to important questions about global justice. In his Introduction to Contemporary Metaethics, Alex Miller considered a defence that might be made on behalf of the moral non-reductive naturalist in response to Gilbert Harman’s explanatory objection, a response that uses Frank Jackson’s and Philip Pettit’s account of ‘program explanation.’ However, Miller went on to argue that program explanation fails to successfully defend the moral non-reductive naturalist against Harman’s objection. Recently Paul Bloomfield and Mark Nelson have argued against Miller that program explanation does in fact successfully defend the (...) moral non-reductive naturalist, because the only full explanation of why the relevant counterfactual, discussed in this thesis, is true requires the use of program explanation. Following Miller, I argue that the fact that counterfactuals are context sensitive undermines the argument developed by Nelson, and I also attempt to undermine Bloomfield’s recent defence of Nelson. Contrary to Bloomfield and Nelson, program explanation is not required in order to explain why the relevant counterfactual is true, so that Harman’s explanatory objection is left intact. (shrink)

Ronald Dworkin’s Justice for Hedgehogs renews and amplifies his earlier attacks on metaethics. This article reviews the main lineaments of Dworkin’s anti-metaethical arguments and discusses, in detail, a number of issues which arise from them. First, it is suggested that Dworkin’s appraisal of what is doing most of the explanatory work in his account is largely askew. Second, it is claimed that Dworkin’s allegation that expressivism is self-defeating is wide of the mark, but that another charge in the same vicinity (...) might be more effective. Third, it is argued that Dworkin’s incuriosity about moral metaphysics is misplaced. What his arguments actually support is an opposition to leaving metaphysical hostages to fortune, rather than an opposition to pursuing greater clarification about moral metaphysics. In this connection, it is tentatively suggested that Dworkin might be tempted by a certain version of naturalism. (shrink)

The goal of this dissertation is to offer a practice-based account of intentionality. My aim is to examine what sort of practices agents have to engage in so as to count as talking and thinking about the way the world is – that is, what sort of practices count as representational. Representational practices answer to the way the world is: what is correct within such practices depends on the way things are, rather than on the attitudes of agents. An account (...) of representation must explain how such objective standards of correctness are introduced in human practices: one must explain how the world gets to have a say in what is correct in human discursive practices. Roughly, my proposal is that human discursive practices become responsive to the way things are by virtue of involving practical interactions with the world. The outcomes of these interactions depend on the way the world is and the evaluation of such outcomes contributes to determining which moves within the practice count as correct. Due to our practical engagement with the environment, thus, the world gets to constrain discursive practices. In order to flesh out my proposal, I develop a practice-based characterization of intentional or representational content. On this sort of approach, expressing intentional contents is seen as a matter of playing a certain role in relevant practices, rather than as a matter of engaging in some word-world relation. The expression of content, thus, is explained in terms of use. In particular, I adopt an inferentialist perspective, according to which discursive moves express contents because of their role in practices of giving and asking for reasons. I investigate how practical engagement with the environment introduces friction with the world in these practices of giving and asking for reasons. One of the main conclusions reached in the dissertation is that defeasibility is an essential feature of objective representational practices – so that attributions of representational correctness are revisable in an open-ended way. The discussion of defeasible reasoning – and of the way in which defeasibility shapes human representational practices – is a central point of this dissertation. (shrink)

The principle aim of this thesis is to provide an account of the nature of health. The starting-point is that health is a normative concept: health implies a standard or norm in relation to which an organism’s state is evaluated. Many philosophers take this to imply that health must be defined in subjective terms. They either think health consists in a certain type of subjective experience, or that health is relative to subjective values and goals. I argue that subjective definitions (...) of health fail to capture the essential properties of health and attempt to show that health is something normative and yet entirely objective. This would imply that there are normative facts in the world, and to support this claim I turn to debates in contemporary meta-ethics. I develop a meta-ethical theory according to which a subset of non-moral goods is grounded in objective features of living beings, and argue that this meta-ethical theory opens the possibility for an objective account of health. I then proceed to develop a theory of health that aims to capture what it means for any living to be healthy. I argue that the concept of health latches onto organisms’ capacities : the greater an organism’s range of capacities, i.e. the more it is capable of doing, the healthier it is. The norm relative to which an organism’s range of capacities is measured in evaluations of health, I go on to argue, is the maximum range of capacities possible for the species. Accordingly, an organism is healthy if it is capable of performing all species-specific activities. A closer analysis of this claim yields the formal definition that health consists in a multiplicity of potential activity vis-à-vis factual limitations set by the species. This definition of health is defended against various objections and potential counterexamples. In the context of human health, I attempt to show this definition of health captures both physical and mental dimensions of health; that it establishes a direct link between health and individual autonomy; and that it supports a Nietzschean account of ‘the greathealth’—the idea that being able to give up the concern for one’s health constitutes a superior kind of health. In the conclusions, I reflect on whether this conception of health could function as an ethical ideal, and consider the form that a health-based ethics could take. (shrink)

The goal of this thesis is to create a distinctively Aristotelian-Thomistic ethical schema. I shall do this in four stages. First, in chapter one, I am going to present a summary of Aristotelian metaphysics. I will present a slightly Thomistic take on Aristotelian metaphysics specifically when it comes to the distinction between accidental and substantial form. However, I will present a more classically Aristotelian account when it comes to the source of teleology. Along the way I will explore whether science (...) can disprove any aspects of Aristotelian metaphysics. In particular, I will examine whether science can show that there are no final causes, and whether evolution poses problems for the Aristotelian concept of form and essence in biology. Second, in chapter two, I shall explain the nature of goodness within this metaphysical schema. I will also engage with competing accounts of the nature of goodness and will argue that my Aristotelian account is superior. Third, in chapter three, I will list and defend my account of the basic goods. I will also explain why certain things, such as pleasure and freedom, are not included in my list of the basic goods. I will then explain how and why they do fit into my schema. Finally, in chapter four, I will move onto duties. I will show how we can derive a list of pro tanto duties from the Aristotelian ethical schema. Along the way I will also briefly sketch out an account of human rights. My ethical theory will differ from many contemporary neo-Aristotelians in that it will place emphasis on, and smoothly follow from, Aristotelian metaphysics. At the same time, my ethical theory will differ from more traditional neo-Aristotelians and the medieval neo-Aristotelians in the way that it reconciles an Aristotelian ethical schema with a non-natural account of goodness and a reasons-based account of obligation. Traditional philosophy has been under attack from several quarters in recent years. The traditional philosopher views philosophy as an armchair discipline relying, for the most part, on reason and reflection. Some philosophers doubt the legitimacy of this type of inquiry. Their arguments usually occur along two dimensions. Some argue that the primary data source for the armchair philosopher--intuition--does not provide evidence for philosophical theories. Others argue that conceptual analysis, which is the preferred method of inquiry for armchair philosophers, can't yield (...) the results the philosopher is looking for, since concepts like 'knowledge' or 'free-will' vary from culture to culture or even between persons within a culture. Finally, some philosophers argue that we should abandon the armchair program because philosophy should be an empirical enterprise continuous with the sciences. I argue that attempts to undermine intuition fail and that one can justify the evidential status of intuition in a non-question begging way. I then argue that attacks on the belief in shared concepts do not succeed because they often conflate the nature of scientific objects with those of interest to the philosopher. However, if concepts do vary from culture to culture, I show that the philosopher need not abandon the armchair. She can still do conceptual analysis but it will be only the entry point into the philosophical dialogue. I apply this approach to epistemology arguing that the central epistemic questions ought to be the existential and the normative. This approach helps to vindicate epistemic internalism. (shrink)

Richard Boyd has long campaigned for a view of natural kinds he calls the Homeostatic Property Cluster account. This account has been particularly exciting for philosophers of biology unhappy with traditional essentialism about natural kinds and the views that biological kinds are, in one way or another, “historical entities”. Though defenders of HPC kinds have done much to further articulate the view, many questions about the account remain. One pressing question concerns the way in which HPC kinds are supposed to (...) accommodate our inductive and explanatory practices via causal, homeostatic mechanisms. In addressing the question, I am led to an alternative conception of what a property cluster kind might be. I call my alternative, in deference to its Boydian origins, the Stable Property Cluster account of natural kinds. Rather than emphasizing homeostasis or causal mechanism, the SPC account emphasizes the stability of a property cluster over the various ways stability may be maintained. In virtue of this modest change of emphasis, the SPC account does not advertise itself as an account of a kind of natural kind — it is, I think, an attractive candidate for a general natural kind concept, able to accommodate the diversity of natural kinds we find in the world. Many fields (social choice, welfare economics, recommender systems) assume people express what benefits them via their 'revealed preferences'. Revealed preferences have well-documented problems when used this way, but are hard to displace in these fields because, as an information source, they are simple, universally applicable, robust, and high-resolution. In order to compete, other information sources (about participants' values, capabilities and functionings, etc) would need to match this. I present a conception of values as *attention policies resulting from constitutive judgements*, and (...) use it to build an alternative preference relation, Meaningful Choice, which retains many desirable features of revealed preference. I discuss first the meaning of naturalism in philosophy and then the sense in which it has been introduced in ethics: that of American Naturalism, that of Dewey’s pragmatism, the sense of a negation of Moore’s negation of naturalism, the neo-Aristotelian, and the one of the external realists. I will argue a fundamental heterogeneity of these meanings and will add that the reasons for the apparent unity of a naturalist front in recent philosophical debates lies more in factors pertaining to (...) the sociology of knowledge. I will suggest that there is one sense in which a naturalism claim may be defended, the sense of Aristotle and Dewey, according to which moral good is not specifically moral in its nature. I will add that programs of scientific exploration into biological bases of behaviour and co-ordination of behaviour within groups are highly promising, but are in no sense ‘naturalistic’ and are indeed compatible with ethical intuitionism, or Kantian ethics. Legal theorists in this century have often perceived a need for a theory capable of occupying a stable middle ground between natural law theory and nineteenth-century legal positivism. The prolific German-American legal philosopher, Hans Kelsen, was perhaps not the first to feel the need for such a theory, but he was certainly among the first to attempt to construct one. n1 Although Kelsen's own efforts failed, in many ways they defined the ambitions of twentieth-century legal theory and inspired others to (...) take up the challenge. In order to understand the nature of the challenge, which confronts us still today, it is helpful to examine central difficulties with Kelsen's own Pure Theory of Law. (shrink)

In his paper How to Be a Moral Realist Boyd attempts to show how cases of ethical indeterminacy can be accounted for from an ethical realist’s standpoint. Boyd describes cases of extensional vagueness in the life-sciences which arise from knowable and definite underlying structures and draws an analogy to ethics to argue his case. This paper argues that an equally compelling analogy can be drawn between another type of scientific indeterminacy – that in quantum mechanics – and the related ethical (...) cases. Because quantum mechanical uncertainty is a real and not merely epistemic limitation on physical description, it cannot be explained by reference to an underlying real structure. Thus this new analogy, where it seems valid, provides an argument for ethical antirealism in describing indeterminate ethical situations. (shrink)
