An account of two sources of the "minimal global ethic," one interpretive and the other creative. Humour, more specifically slapstick, is the interpretive source, while "revelation" as present in both Rabbinic Judaism and Modernism is the creative source. The question of the ethic and conflict is then briefly discussed. This version, posted 22 January 2023, is a revised form of the chapter from the book published in 2009.

The main purpose of legal interpretation is to create conditions for the effective functioning of law and its components by clarifying their true content, which eliminates any doubts and ambiguities. The purpose of this article is: first, to analyze the provisions of current Ukrainian legislation for identifying the general approaches embodied in it and the principles for the implementation of legal interpretation activities by state power bodies; secondly: presentation on the basis of modern achievements and developments of legal science of (...) the system of measures for standardization of such activity, bringing it in line with the needs of law enforcement practice. The solution of the set tasks was carried out using the method of philosophical dialectics, a system of general scientific and special scientific methods of cognition, which are based on the principles of objectivity, comprehensiveness, complexity. Based on the analysis of the normative material, it is concluded that there is no single harmonized approach in the Ukrainian legislation on the procedure for providing clarifications of the content of normative-legal acts. The authors give arguments on the need to clarify and streamline the legal interpretation activity by state bodies and propose a number of measures to achieve this goal. Based on the conducted analysis of the normative material, the authors outline the main problematic issues of the legislative definition of the basics of legal interpretation and provide specific proposals for improving the current legislation in this area. I argue that the reference for “God” is determined by the definite description “the being that is worthy of our worship.” I describe two desiderata for rival theories of the reference of “God” to meet: accessibility and scope. I explain the deficiencies of a view where God is dubbed “God” and the name passed down by causal chains and a view where “God” picks out the unique satisfier of a traditional definite description. After articulating the “Worship-Worthiness” view, I show how (...) it best satisfies the desiderata. I then respond to some putative counterexamples to the view. (shrink)

The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. This dissertation explores and argues for the import of the imagination (Phantasie) in Edmund Husserl's phenomenological method of inquiry. It contends that Husserl's extensive analyses of the imagination influenced how he came to conceive the phenomenological method throughout the main stages of his philosophical career. The work clarifies Husserl's complex method of investigation by considering the role of the imagination in his main methodological apparatuses: the phenomenological, eidetic, and transcendental reductions, and eidetic variation - all of which remained ambiguous despite (...) his extensive programmatic discussions. The work illuminates and clarifies aspects of the Husserlian phenomenological method never before explored. -/- In order to clarify Husserl's eidetic method of inquiry, I propose a new way of thinking about the imagination - as direct intuitive presentation (eigentliche anschauliche Vorstellung) and as horizonal-nexic level of consciousness exhibiting the neutrality, freedom, and possibility as its essential features. Following Husserl's studies of the imagination, I propose a three-level model of consciousness (realizing, imagining, and eidetic) and explore the dynamic flexibility of each level (as horizon within which acts such as judgments or memories can unfold). This model of consciousness allows for a rethinking of the sources and conditions for the possibility of eidetic phenomenological inquiry - topics Husserl was mostly silent about. -/- Through a rethinking of the model of consciousness, I propose a tight and substantial relationship between the natural (everyday) and artificial (methodological, theoretical) attitudes. I argue that the structure and systems of possibilities pertaining to the artificial attitude - i.e., our actual as well as possible methodological tools - are structurally and well as informationally bound to the structure and system of possibilities pertaining to the natural attitude. In order to explore the nature of the relationship between these two attitudes I argue that we must take a closer look at the structure and abilities of imagining consciousness - the sole nexic-horizonal level that can function both naturally and artificially. This insight regarding the nature of consciousness clarifies Husserl's transcendental idealism in its intimate connection to the everyday. Understanding Husserl's philosophical stance is thus purged of all possibility of mistakenly labeling it as entailing immanent detachment, solipsism, or Platonic idealism. (shrink)

This book concerns the foundations of epistemic modality and hyperintensionality and their applications to the philosophy of mathematics. David Elohim examines the nature of epistemic modality, when the modal operator is interpreted as concerning both apriority and conceivability, as well as states of knowledge and belief. The book demonstrates how epistemic modality and hyperintensionality relate to the computational theory of mind; metaphysical modality and hyperintensionality; the types of mathematical modality and hyperintensionality; to the epistemic status of large cardinal axioms, undecidable (...) propositions, and abstraction principles in the philosophy of mathematics; to the modal and hyperintensional profiles of the logic of rational intuition; and to the types of intention, when the latter is interpreted as a hyperintensional mental state. Chapter \textbf{2} argues for a novel type of expressivism based on the duality between the categories of coalgebras and algebras, and argues that the duality permits of the reconciliation between modal and hyperintensional cognitivism and modal and hyperintensional expressivism. Elohim develops a novel, topic-sensitive truthmaker semantics for dynamic epistemic logic, and develops a novel, dynamic two-dimensional semantics grounded in two-dimensional hyperintensional Turing machines. Chapter \textbf{3} provides an abstraction principle for two-dimensional (hyper-)intensions. Chapter \textbf{4} advances a topic-sensitive two-dimensional truthmaker semantics, and provides three novel interpretations of the framework along with the epistemic and metasemantic. Chapter \textbf{5} applies the fixed points of the modal $\mu$-calculus in order to account for the iteration of epistemic states in a single agent, by contrast to availing of modal axiom 4 (i.e. the KK principle). Although the “Transcendental Aesthetic” is the briefest part of the first Critique, it has garnered a lion's share of discussion. This fact reflects the important implications that Kant drew from his arguments there. He used the arguments concerning space and time to display examples of synthetic a priori cognition, to secure his division between intuitions and concepts, and to support transcendental idealism. Earlier, in the years around 1770, Kant's investigations into space and time had facilitated his turn toward “critical” philosophy. (...) Prior to that time, Kant's main interests in space and time pertained to physics and metaphysics. As he entered the critical period, he delved into the cognitive basis of our experience of space (and time), and drew his conclusions about their ideality. Kant's doctrines of space and time provoked extensive response in his own time and throughout the nineteenth century. These responses variously concerned the metaphysics, physics, epistemology, psychology, and geometry of space. Throughout the nineteenth century, philosophers, physiologists, and psychologists sought to extend or to refute Kant's theories of space. By the last decades of the nineteenth century, many had rightly concluded that the existence of non-Euclidean geometry as a candidate description of physical space refuted Kant's full doctrine of space - though some have hoped that his position might be saved by restricting it to “visual space.”. Lewis is famous as a contemporary philosophical system-builder. The most obvious way his philosophy exhibited a system was in its content: Lewis’s metaphysics, for example, provided answers to many metaphysical puzzles in an integrated way, and there are illuminating connections to be drawn between his general metaphysical views and, for example, his various views about the mind and its place in nature.

This is the first book-length philosophical study of Husserl’s transcendental phenomenology and Freud’s theory of the unconscious. The book investigates the possibility for Husserl’s transcendental phenomenology to clarify Freud’s concept of the unconscious with a focus on the theory of repression as its centre. Repression is the unconscious activity of pushing something away from consciousness, while making sure that it remains active as something foreign within us. How this is possible is the main problem addressed in the work. Unlike previous (...) literature (including Ricœur, Merleau-Ponty and Derrida) this book makes full use of the resources of genetic phenomenology and passivity in the attempt to clarify the Freudian unconscious. The central argument developed is that the structure of the lebendige Gegenwart as the core of Husserl’s theory of passivity consists of preliminary forms of bodily kinaesthesia, feelings and drives in a constantly ongoing process where repression occurs as a necessary part of all constitution. The clarification of Freudian repression thus takes place by showing how it presupposes a broad conception of consciousness such as that presented by Husserl’s genetic phenomenology. By arguing that “repression” is central to any philosophical account of subjectivity, this book takes on the most distinct challenge to philosophy posed by Freud. (shrink)

Theodicy and Toleration Seem at first glance to be an unlikely pair of topics to treat in a single paper. Toleration usually means putting up with beliefs or actions with which one disagrees, and it is practiced because the beliefs or actions in question are not disagreeable enough to justify interference. It is usually taken to be a topic for moral and political philosophy. ABSTRACT The received view is that Yunjidang’s feminist philosophy focuses on female sagehood, drawing on the theory of the equal human nature of women and men. I argue that there is much more to it than that, and that her views are anchored in and a development of Mengzi’s philosophy. She creatively interpreted and extended his philosophy, adopting the neo-Confucian metaphysics of the One and the Many. She argued not just for the potential but for the actual gender equality of (...) women and men. In addition, she laid the groundwork for a gender inclusive virtue ethics. Showing as much requires understanding the historical place of Yunjidang in Joseon dynasty, the neo-Confucian metaphysics that informs her arguments, and her views on gender essentialism and virtue ethics. This article exposes and explains Yunjidang’s comprehensive feminist philosophy and her bold theses: the actual gender equality of embodied women and men and a gender inclusive virtue ethics. Criteria of empirical significance are supposed to state conditions under which reference to an unobservable object or property is “empirically meaningful”. The intended kind of empirical meaningfulness should be necessary for admissibility into the selective contexts of scientific inquiry. I defend Justus’s recent argument that the reasons generally given for rejecting the project of defining a significance criterion are unpersuasive. However, as I show, this project remains wedded to an overly narrow conception of its subject matter. Even the most cutting (...) edge significance criteria identify empirical significance with predictive power, and thereby rule out vocabulary with legitimate scientific functions. In a nutshell, the problem is that there are terms that reduce the computational burden of extracting predictions from theory, and that may therefore be scientifically useful, but that do not produce any additional predictions, and so are ruled scientifically inadmissibility by existing significance criteria. I spell out this objection by specifying terms of this kind that are ruled inadmissible by Creath’s and Schurz’s criteria. Having objected in this way to extant criteria, and to the equation of empirical significance with predictive power in general, I discuss an approach to defining empirical significance that is capable of avoiding my objection and, more ambitiously, that may break the cycle of “punctures and patches” that has plagued the project from the beginning: I gloss Goldfarb and Ricketts’s idea of “case-by-case” delineations of empirically significant terms as the provision of special rather than general explications of the informal concept of empirical significance. The theory that AIDS originated from contaminated polio vaccines raises a number of challenging issues with ethical dimensions. The Journal of Medical Ethics dealt with a submission about the theory a decade ago; subsequent developments have raised further issues. Four areas of contention are addressed: whether the theory should be investigated; whether anyone should be blamed; whether defamation actions are appropriate, and whether the scientific community has a responsibility to examine unorthodox theories.

Spirit Christology has emerged as an important focus in recent theology. It offers new perspectives on christology and pneumatology. Can these new perspectives lead to advances in trinitarian theology itself? The classical theologies o f both East and West tended to express great reserve about moving too easily from the economy o f salvation to ideas about God in se. In the 20th century, Karl Rahner’s axiom that the “economic” Trinity is the “immanent” Trinity and vice versa helped lead to (...) a significant erosion of this reserve, though not without controversy. Coffey contributes significantly to reflection on this nexus of questions. He explores the relation of Spirit Christology to Logos Christology, arguing that the former need not supplant the latter. He reformulates Rahner’s axiom, suggesting ways of overcoming some o f its ambiguities. He shows that Spirit Christology offers an “ascending” basis for a “mutual love” pneumatology, in the service of a renewed trinitarian theology. This dissertation presents an analysis of Coffey’s achievement in its various contexts, historical and contemporary. It highlights his methodological balance. It argues that his theology represents an important development within the tradition, casting new light on issues of pressing contemporary interest. (shrink)

This chapter investigates a specific case of Baconian experimentation, that is, a series of controlled experimental trials Bacon undertook in order to study the processes of maturation and putrefaction. The results of these trials were repeatedly used by Francis Bacon in his writings to illustrate the motions of spirits enclosed in matter. In this chapter, I reconstruct some of Bacon’s experiments with apples placed under different circumstances and conditions, as recorded in Historia vitae et mortis, De vijs mortis, Novum organum (...) and Sylva Sylvarum. I argue that they help reassess several problematic aspects concerning Bacon’s attitude towards the experimental knowledge of nature. Firstly, they offer a paradigmatic situation in which one can explore Bacon’s creative and critical handling of sources. Secondly, they show Bacon at work as an experimenter who carefully and accurately observed, recorded and imagined interesting experimental set-ups and variations of experimental parameters, while displaying an interest in experimental methodology and the limits of experimental procedure. Finally, Bacon’s apples are a good way of exemplifying the multiple uses and functions experiments play in his natural and experimental histories. (shrink)

This article takes a step toward filling the gap in the scholarly literature by examining the impact of religious intervention in the military on civil-military relations. Using the case of Israel, I argue that although the subordination of the Israeli military to elected civilians has remained intact, and the supreme command has been mostly secular, external religious authorities operate within the formal chain of command and in tandem with the formal authorities, managing the military affairs. This religious influence is apparent (...) in three major domains: the theological influence on military deployment, the exclusion of women from equal participation in military service, and the role expansion of the Military Rabbinate as a quasi-state agency and its reflection in the socialization of secular soldiers and the development of alternative military ethics. ‘Natural-History’ is one of the key concepts in the thought of the Frankfurt School critical theorist Theodor W. Adorno, appearing from his very earliest work through to his very last. Unfortunately, the existing literature provides little illumination as to what Adorno’s concept of natural-history is, or what it is supposed to do. This paper thus seeks to supply the required understanding. Though abortion is legal in Canada, policies currently in place at various levels of the health care system, and the individual actions of medical professionals, can inhibit access to abortion. This paper examines the various extra-legal barriers to abortion access that exist in Canada, and argues that these barriers are unjust because there are no good reasons for the restrictions on autonomy that they present. The paper then outlines the various policy measures that could be taken to improve access.

Carl Schmitt, one of the most influential legal and political thinkers of the twentieth century, is known chiefly for his work on international law, sovereignty, and his doctrine of political exception. This book argues that greater prominence should be given to his early work in legal studies. Schmitt himself repeatedly identified as a jurist, and Hugo E. Herrera demonstrates how for Schmitt, law plays a key role as an intermediary between ideal, conceptual theory and the messiness and complexity of practical, (...) concrete situations. Law is concerned precisely with balancing the extremes of theory and reality, and in this respect, Schmitt associates it with philosophical thinking broadly as being able to understand and explain the tensions in human experience. Reviewing and analyzing prevailing interpretations of Schmitt by Jacques Derrida, Heinrich Meier, and others, Herrera argues that the importance of Schmitt's legal framework is both significant and overlooked. The Appendix considers whether instrumental value of any sort depends upon intrinsic goodness. It is argued that most familiar sorts do not so depend, but one can be shown to do so by a kind of First Cause argument. ;Chapter IV begins with an attempt to give a clear and complete formulation of hedonism--the theory according to which only pleasure is intrinsically good. The formulation builds upon the efforts of Warren Quinn and Edward Oldfield. Then an argument against hedonism by (...) Brentano is critically assessed. C. D. Broad's objection to the effect that the pleasure of malice is not intrinsically good is then evaluated, as is G. E. Moore's objection to the effect that beauty is also intrinsically good. It is contended that hedonism does not succumb to any of these objections. ;In Chapter III the question is whether the concept of pleasure enters into an analysis of the concept of being intrinsically good. This topic is approached through writings by Franz Brentano. It is argued that no such analysis is possible. ;Chapter III is concerned with whether pleasure can help us to identify the bearers of intrinsic goodness. Again, some of Brentano's work is central to the topic, as is work by Charles Baylis. It is argued that pleasure is of no special help in discovering the intrinsic goods. ;The three major philosophical connections between concepts are analysis, epistemic mark, and general theoretical link. Each has been thought to relate pleasure to intrinsic goodness. The Introduction consists in a brief study of the nature of these connections. The body of the thesis examines whether pleasure and intrinsic goodness are so related. (shrink)

This course on logic and theory of knowledge fell exactly midway between the publication of the Logical Investigations in 1900-01 and Ideas I in 1913. It constitutes a summation and consolidation of Husserl’s logico-scientific, epistemological, and epistemo-phenomenological investigations of the preceding years and an important step in the journey from the descriptivo-psychological elucidation of pure logic in the Logical Investigations to the transcendental phenomenology of the absolute consciousness of the objective correlates constituting themselves in its acts in Ideas I. In (...) this course Husserl began developing his transcendental phenomenology as the genuine realization of what had only been realized in fragmentary form in the Logical Investigations. Husserl considered that in the courses that he gave at the University of Göttingen he had progressed well beyond the insights of the Logical Investigations. Once he exposed the objective theoretical scaffolding needed to keep philosophers from falling into the quagmires of psychologism and skepticism, he set out on his voyage of discovery of the world of the intentional consciousness and to introduce the phenomenological analyses of knowledge that were to yield the general concepts of knowledge needed to solve the most recalcitrant problems of theory of knowledge understood as the investigation of the thorny problems involving the relationship of the subjectivity of the knower to the objectivity of what is known. This translation appears at a time when philosophers in English-speaking countries have heartily embraced the thoughts of Husserl’s German contemporary Gottlob Frege and his concerns. It is replete with insights into matters that many philosophers have been primed to appreciate out of enthusiasm for Frege’s ideas. Among these are: anti-psychologism, meaning, the foundations of mathematics, logic, science, and knowledge, his questions about sets and classes, intensions, identity, calculating with concepts, perspicuity, and even his idealism. This thesis articulates the philosophy of The New School of Dawson College, an alternative pre-university Arts programme in a community college in Montreal. The roots of The New School's philosophy are examined and critiqued in the works of: Dewey, the existentialists, popular educational critics of the 1960s, Maslow, Rogers, the humanistic and "Values" educators, Kozol, Freire, Aronowitz, Giroux and feminist educational theorists.
