Are culture driven ethical conflicts apparent in the discourse of the protagonists? A multi-year, multi-cultural study of managers by Trompenaars and Hampden-Turner resulted in two conclusions relevant to business ethics. The first is that intercultural business conflicts can often be traced to a finite set of cultural differences. The second is that enough similarities exist between cultures to provide the grounds for conflict resolution. In this paper, I will argue that it is a moral obligation for companies, firstly, to accept their moral responsibility with respect to non-discrimination, and secondly, to address the issue with a full-fledged programme, including but not limited to the countering of microsocial discrimination processes through specific policies. On the basis of a broad sketch of how some discrimination mechanisms are actually influencing decisions, that is, causing intended as well as unintended bias in Human Resources Management, I will argue that (...) the well known tools of legislation and ethical codes are necessary although insufficient to cope with the problem. However, based on empirical evidence, we know which set of measures is likely to diminish discrimination. Taking non-discrimination seriously implies complex and longitudinal policies which include assigning responsibility for a non-discrimination policy within the firm, making managers conscious of implicit stereotypes and helping them to cope with prejudices that no one can totally overcome. Insofar as corporate responsibility with respect to non-discrimination is accepted and strategies that are not prohibitively expensive are known, companies are bound to implement them. Not implementing the best set of measures may be considered at least as a moral shortcoming or, depending on the size of the company, mere lip service to the non-discrimination principle. Although the paper refers to empirical material of diverse backgrounds, its intent is clearly normative. It wishes to spell out what companies ought to do if they are committed to responsible behaviour. The discussion of effective remedies against discrimination is based on a case study of a French company. The retailer Auchan was recently surprised to learn that it was discriminating against ethnic minorities despite strong ethical standards, an ethics committee and ethical leadership. The company dropped its naïve beliefs and set up an ambitious policy cope with the issue. The case illustrates what recent empirical research has revealed about the effectiveness of diversity policies: establishing responsibility for diversity results, firm ethical commitment and support from top management make diversity programs effective. As recent social research demonstrates, the life world is increasingly impacted by a corrosion of social bonds and aggressive habits expressed, for instance, in hate speech in the social media. Significantly, such phenomena have not been prevented from evolving within the framework of constitutional liberal states. In search of an appropriate mode of challenging the current social pathologies, we should examine Kant’s claim that, alongside the “juridico-civil (political) state”, an “ethico-civil state”, uniting human beings “under laws of virtue alone”, needs (...) to be established and cultivated. Kant’s claim is discussed in comparison with “postmetaphysical” conceptions of morality, as maintained by Rawls and Habermas. These prove deficient owing to their contract-based approach. Important in the examination of the key idea of the “state of virtue” is Kant’s thesis that such a state “cannot be realized (by human organization) except in the form of a church”. In view of the fact that, today, in many parts of the world significant segments of the population adhere to agnostic or atheistic convictions, the focus is placed on Kant’s specific conception of “church” that is clearly distinct from “historical” creeds and religious practices, and on the way in which he addresses non-believers, since he insists on the intrinsic relation between morality and the “purely moral religion”. Based on these reflections, the relevance of Kant’s argument that it is “a duty of the entire human race” to establish a community in which people mutually support one another in the cultivation of moral sensitivity is scrutinised. Since COVID-19 is a global-scale pandemic, it can only be solved on the global level. In this context, intercultural dialogues are of utmost importance. Indeed, different models of traditional ethics might be of assistance in constructing a new, global ethics that could help us confront the present predicament and prepare for other possible global crises that might await us in the future. The explosive, pandemic spread of COVID-19 in 2020 clearly demonstrated that in general, one of the most effective tools (...) for containment of the epidemics is precisely human and interpersonal solidarity, which must also be accompanied by a certain degree of autonomous self-discipline. The present paper follows the presumption that these types of personal and interpersonal attitudes are—inter alia— culturally conditioned and hence influenced by different traditional models of social ethics. In light of the fact that East-Asian or Sinic societies were more successful and effective in the process of containing and eliminating the virus compared to the strategies of the Euro-American regions, I will first question the widespread assumption that this effectiveness is linked to the authoritarian political traditions of the Sinic East and Southeast Asian areas. Then, I will critically introduce the Confucian ethics of relations, which in various ways has influenced the social structures of these regions, and clarify the question of whether and in which way the relics of this ethics had an actual effect on the crisis resolution measurements. The crucial aim of this paper is to contribute to the construction of theoretical groundworks for a new, transculturally grounded global ethics, which is more needed today than ever before. (shrink)

Is it necessary and is it possible to develop and justify a meaningful concept of women’s solidarity? In this contribution, I will answer both of these questions in the affirmative. Starting by developing a concept of solidarity, I then move on to discussing the intricate question of a consistent and meaningful concept of ‘woman’. After suggesting a solution to the semantic as well as ontological problems, I turn to the idea of collective experiences of oppression as a possible basis or (...) at least a starting point for women’s solidarity. The idea of collective experiences has tobe enriched, however, by referring to the idea of political imagination in order to demonstrate a way of providing convincing interpretations of shared experiences. In a last step, I discuss – following Habermas – the relation between solidarity and justice, since it is solely the idea of justice which can motivate as well as justify claims to solidarity. I end by having a brief look at conflicting claims of solidarity and the problem of intersectionality. (shrink)

Scholars have long recognized the existence of myriad widespread deep disagreements on values, justice, morality, and ethics. In order to come to terms with such deep disagreements, resistant to rational solution, this article asserts the need for developing an ethics of disagreement. The reality that theoretical disagreements often turn into practical conflicts is a major justification for why such an ethics is necessary. This paper outlines an ethics of deep disagreement that is primarily conceived of as a form of virtue (...) ethics. Such an ethics asks opposing parties in moral and intellectual conflicts to acknowledge that (a) deep disagreements exist, (b) opposing positions should be recognized as worthy of respect, and that (c) one should seek dialogue and mutual understanding. This ethical approach conceives of toleration as a moral and political virtue and presents an argument for toleration based on deep disagreements. (shrink)

This article starts off with a historical section showing that deep disagreements among notions of social and political justice are a characteristic feature of the history of political thought. Since no agreement or consensus on distributive justice is possible, the article argues that political philosophers should – instead of continuously proposing new normative theories of justice – focus on analyzing the reasons, significance, and consequences of such kinds of disagreements. The next two sections are analytical. The first sketches five possible (...) reasons for deep disagreements among notions of social and political justice. Medizinethische Entscheidungsfindungsmodelle müssen nachweisen können, weshalb die mit ihnen getroffenen Entscheidungen richtig oder zumindest „belastbar“ sind. Hierfür sind theoretische Rechtfertigungsansätze aus der Ethik unverzichtbar. Der Klinischen Ethik wird aber mitunter ein Mangel an theoretischer Fundierung vorgeworfen. Um diesem Vorwurf entgegenzutreten, soll unter Bezugnahme auf ein Projekt der Klinischen Ethik („METAP“) die ethische Unterstützung in Form der ethischen Fallbesprechung und der Ethikkonsultation mittels Prinzipienethik und Diskursethik gerechtfertigt werden. Prinzipienethik und Diskursethik können einander über das Medium der ethischen Fallbesprechung oder Ethikkonsultation fruchtbar (...) ergänzen. So können einige theoretische und praktische Schwächen der beiden Ansätze durch den jeweils anderen abgefedert werden. Die Diskursethik übernimmt bspw. die Sicherung der ethischen Gültigkeit von moralischen Entscheidungen bzw. Handlungsnormen und vermindert dadurch ein Rechtfertigungsdefizit, welches bei einem rein prinzipienorientierten Verfahren auftritt. Umgekehrt antwortet die Prinzipienethik u. a. auf Fragen der ethischen Angemessenheit und dient v. a. der adäquaten Einzelfallentscheidung. Durch die Integration des einen Ansatzes in den anderen ist eine umfassendere Rechtfertigungsleistung erzielbar als bei einem alleinigen Einsatz von Prinzipienethik oder Diskursethik. Selbst wenn einige Herausforderungen bestehen bleiben und auch das integrierte Modell moralische Dissense nicht immer verhindern kann, vermag es durch seine „doppelte“ Absicherung (Prinzipien und Diskurs) ein praktisches Vertrauen in die getroffene ethische Entscheidung zu stärken und so der Klinischen Ethik mehr „Robustheit“ zu geben, als sie bisher besitzt. The article sets out to explore the international legal dimension in Jürgen Habermas' latest publications on philosophy of law. It is our view that Habermas deals with the examination of just relations beyond the nation-state first and foremost from a legal perspective, and that the key to a Habermasian reading of international justice is not through an application of discourse-theoretical models of communicative or moral action as such, but primarily through proper legal institutionalisation of the rule of law. In asserting (...) this view, we will look closer at the Kantian influence in Habermas' legal construct at the international level, and show why this institutional approach is to be sharply distinguished from and preferred to any exclusively non-institutional approach to international justice. One of the most widely accepted tenets in postmetaphysical normative ethics is the principle of dialogue as a foundational authority. Conceptually, the dialogical model is valuable, in that it allows a binding yet mutable underpinning of moral discourse. However, dialogue has its limits. The main drawback lies in the fact that deliberations can be very lengthy, perhaps even infinite. In other words, deliberation does not always lend itself to action. From the vantage point of applied ethics, in this case, bioethics (...) and forensic ethics, this is not a minor shortcoming since these disciplines are concerned with situations involving some sort of urgency. Aporia is not an option in most cases. It is thus pressing to consider the moment of decision inherent to moral judgement and action that puts an end to dialogue. From the realm of abstract norm justification, one must move on to the contextualist discourse of application. To be rational, however, decision must avoid authoritativeness or any type of arbitrariness. What, then, could serve as a reasonable criteria for the rational application of norms? What aspects should be envisaged for a sound reflective decision? This paper will attempt to sketch some answers that could contribute to the question of the necessary contextual application of accepted norms by paying heed to, systemizing and sometimes finding fault in the arguments given by judges who had to settle cases touching sensitive moral issues. Faced with an ever-growing number of ethical marketing issues and uncertainty about the impact of specialized ethics journals, researchers are struggling to keep abreast of developments in the field. In order to address these challenges, our paper provides a comprehensive review of the literature on marketing ethics over almost 50 years, offers a citation analysis and develops a unique marketing ethics impact factor (MEIF). We contribute to the field in three important ways. First, we present a state-of-the-art picture of marketing (...) ethics research. This provides an account of the research focus in each decade, assesses the importance of specific topics in the debate and identifies existing research gaps. Second, we identify the most influential papers and researchers in the marketing ethics area. Third, we evaluate the most important journals in terms of their impact on marketing ethics. To this end, we have developed an MEIF. This improves our ability to judge a journal's influence on this particular sub-discipline. (shrink)

Normative research has nearly vanished from the academic ‘mainstream’ in accounting. Due to its prescriptive and value-driven approach, normative accounting research has been stigmatized as being unscientific and largely replaced by positive studies. We put this stigma into perspective. We first conceptualize the ‘positive-normative’ distinction and identify this dichotomy in accounting research history. We then challenge the dogmatic confinement of science to descriptive (positive) approaches. Moreover, we debate the basic conditions for normative accounting research and conclude that methodological and epistemological (...) pluralism in accounting research may help address a wide range of potential research questions. We point out that normative research approaches are essential in an applied science such as accounting, lest practical implications and prescriptions are to be the exclusive domain of accounting practice. ZusammenfassungIn diesem Artikel geht es um die Beziehungen zwischen der von Jürgen Habermas entwickelten Diskursethik und den Studierendenseminaren, die der Ulmer Arbeitskreis „Ethik in der Medizin“ veranstaltet. Zunächst erfolgt eine Darstellung der Kernaussagen der philosophischen Diskursethik. Sie liefert eine formale Argumentationsprozedur, mit der es möglich ist, die Legitimität strittig gewordener Normen im Diskurs zu prüfen. Anschließend wird das in Ulm von Baitsch und Sponholz entwickelte Modell der Seminare „Ethische Entscheidungskonflikte im ärztlichen Alltag“ vorgestellt. Da sich die Ulmer Seminare unter anderem (...) auf die Diskursethik als theoretischen Hintergrund berufen, werden die Gemeinsamkeiten und Unterschiede beider Konzepte untersucht. Der Hauptunterschied ist der zwischen einem Begründungs- und einem Anwendungsdiskurs. Gemeinsam sind den Ansätzen die grundsätzlich kognitivistische Einstellung und die „Spielregeln“ des Diskurses. Gender greatly impacts access to opportunities, potential, and success in corporate leadership roles. We begin with a general presentation of why such discussion is necessary for basic considerations of justice and fairness in gender equality and how the issues we raise must impact any ethical perspective on gender in the corporate workplace. We continue with a breakdown of the central categories affecting the success of women in corporate leadership roles. The first of these includes gender-influenced behavioral factors, such as the (...) requirements and expectations of gendered verbal and nonverbal communication styles as well as appearance. We move on to address the impact of family on corporate leadership opportunities and success, discussing the asymmetrical evaluation of an individual’s potential, authority, and competence based on gender stereotypes of familial obligations and expectations. Finally, we address how gender impacts access to networking and sponsorship opportunities and the long-term effects of systematic limitations on women’s inclusion in the upper echelons of corporate leadership. We conclude with a summary of the questions and issues raised by our discussion and direct individuals to consider how different ethical systems and moral requirements might influence their interpretations of gender and leadership in the corporate workplace. The author's thesis is that human rights can be substantiated on the basis of discourse theory. The argument has two steps. The first step is the justification of the rules of discourse. The second step consists in the foundation of human rights.

In recent times, representatives of American management science have been arguing increasingly for a functionalization of ethics to change economic thinking: what they are seeking is the systematic integration of ethics into the economic paradigm. Using the insights developed by Hirschman, I would like to show how one must first expose the rhetoric of those critics of change (referred to below as conservatives or reactionaries) in order then to implement that which is new (representatives of this approach are referred to (...) below as progressives). Such an ‹unmasking’ works particularly well when one can defuse the arguments of the reactionaries – which is precisely what one achieves by strategically integrating ethics into economics. In his work The Rhetoric of Reaction Hirschman examines three basic forms of reactionary thought: the perversity thesis, the futility thesis, and the jeopardy thesis. According to the perversity thesis, intended goals are transformed into their opposites. The futility thesis argues that the setting of goals is useless since history runs its own course independent of those goals. The jeopardy thesis claims to preserve what already exists since change might substantially endanger that which has already been achieved. The importance of Hirschman’s ideas for the strategic interplay between the academic disciplines can be seen quite clearly in the example of German business ethics. This will be displayed below with reference to Hirschman’s three theses. Finally, implications will be drawn for business ethics in general and for management theory in particular. (shrink)

The success of Discourse Ethics is premised on the discovery and use of shared values. If this is true what type of negotiation style, especially when used in an intercultural setting, is best suited to make use of shared values. Research focusing on moral arguments between Germans and Americans uncovered an array of shared values. But the existence of shared values, by itself, was not an adequate predictor of a negotiation's success. What did prove to be a predictor of success (...) was the use of a Constructivist style of negotiation by both parties. (shrink)

In this article the author tries to give an answer - from the point of view of the transcendental pragmatic foundation of discourse ethics - to the title question, which was raised by the Unesco conferences entitled `Universal Ethics' in Paris (27 March 1997) and Naples (December 1997). The article should be understood as a supplement to the empiristic-comparative responses of S. Bok and H. Küng, and especially to the communitarian approach of M. Walzer, proposed at the first conference. Unlike (...) traditional rationalism, this approach does not try to deduce concrete moral norms from axiomatic first principles; it begins with transcendental reflection on the undeniable moral presuppositions of argumentative discourse (which is not circumventable in philosophy). The approach first deduces from these presuppositions only the ideal procedures for the moral discourses through which all concrete moral problems ought to be solved, if possible. The second step provides a strategic-counter-strategic supplementation principle for those cases where undistorted moral discourses are not possible. (shrink)

Empirical research into the ethics of emerging technologies, often involving foresight studies, technology assessment or application of the precautionary principle, raises significant epistemological challenges by failing to explain the relative epistemic status of contentious normative claims about future states. This weakness means that it is unclear why the conclusions reached by these approaches should be considered valid, for example in anticipatory ethical assessment or governance of emerging technologies. This paper explains and responds to this problem by proposing an account of (...) how the epistemic status of uncertain normative claims can be established in ethical and political discourses based on Jürgen Habermas’ discourse ethics. To better understand the nature of the problem, the relationship between norms, facts and the future is explored in light of potential meta-ethical fallacies faced in the field of empirical ethics. Weaknesses of current approaches to anticipatory ethical assessment and governance are then explored, including the Precautionary Principle and Technology Assessment. We argue that the epistemic status of uncertain normative claims can be understood within Habermas’ approach to political discourse, which requires ‘translation’ of uncertain claims to be comprehensible to other stakeholders in discourse. Translation thus provides a way to allow for uncertain normative claims to be considered alongside other types of validity claims in discourse. The paper contributes a conceptual account of the epistemic status of uncertain normative claims in discourse and begins to develop a ‘methodology of translation’ which can be further developed for approaches to research and ethical assessment supporting anticipatory evidence-based policy, governance and system design. The objective of the present research was two-fold: to provide a new definition of ethical competence, and to clarify the influence of empathy, personal values, and the five-factor model of personality on ethical competence. The present research provides a comprehensive overview about recent approaches and empirically explores the interconnections of these constructs. 366 German undergraduate students were examined in a cross-sectional study that investigated the relationship of empathy, personal values, and the five-factor model of personality with moral judgment competence and (...) counterproductive work behavior as indicators of moral judgment and behavior. We found self-transcendence values to be related to both, high levels of empathy and ethical competence, in contrast to self-enhancement values. Multiple mediation analysis revealed unique effects of empathy on ethical competence through values as mediators. Affective empathy transmitted its effect on ethical competence through benevolence, conformity, tradition, power, and hedonism. Most importantly, perspective taking lost its predictive power when investigated alongside affective empathy dimensions. These results converge to an important role of affective empathy, in particular empathic concern, with regard to personal values and ethical competence. Furthermore, the five-factor model of personality explained variance in measures of ethical competence. Our research suggests that organizational decision makers should consider the role of empathy, personal values, and the five-factor model in their human resource management in order to select employees with high ethical competence. This paper tries to provide a complete list and classification of the motives for acting in accordance with morals, to explain the mechanisms underlying the less transparent among these motives, and to probe which of these motives are suited for justifying morals. (1) After giving reasons for the importance of an empirical theory of moral motives for ethics, and after specifying the exact question of the present study (2) a general model of moral action (3) and a main classification of (...) the motives for acting morally is presented. (4) Self-transcendent motives, (5) motives close to morals, like sympathy and respect, (6) and moral motives in the narrow sense, which proceed from moral judgements, are scrutinized in detail. Only the motives near to morals and interest in cooperation but not the moral motives in the narrow sense are suited for justifying morals. (7) A concluding sketch of the development of moral judgements shows that only motives near to morals and interest in cooperation (but not e.g. pure reason) are also the sources of autonomously developed moral criteria. This article examines Robert Alexy's account of legal validity. It concludes that Alexy's account of legal validity lacks sufficient support given the author's methodological commitments. To reach that conclusion, it assesses the plausibility of simultaneously maintaining that the participant's perspective has conceptual privilege in the explanation of the nature of law, that legal discourse is a special case of general practical discourse, and that unjust considerations can be legally valid norms.

A weak and a strong version of discourse theory can be distinguished. In the strong version the only source of normative validity in the nonspecific sense is rational consensus, where all parties concerned accept a norm for the same reasons, which are rationally convincing in the same way for all. In the weak version both rational and overlapping consensus can be sources of validity in the nonspecific sense. It is argued that the weak version is the more adequate, since it (...) can accommodate cases which the strong version cannot, and which it is unreasonable to view as cases of compromise. Discourse theory needs a weaker general discourse principle and a more flexible notion of normative consensus than is found in Habermas's Between Facts and Norms. (shrink)

This contribution is a critical and constructive engage ment with discourse ethics. First, it clarifies why discourse ethics has difficulties with the grounding and application of moral norms. Second, it turns to a positive appropriation of the formal and proce dural aspects of discourse ethics. The goal is the elaboration of an ethics that is able to incorporate the material aspects of goods and the formal dimension of ethical validity and consensuability. Every morality is the formal application of some substantive (...) good. Every ethical perspective demands its evaluation in terms of its uni versability. In order to achieve this mediation, it is suggested that we must incorporate not only the historical dimension of moral systems, but also the role of critical consciousness and the negativity embod ied by those who are victims of the existing consensus. The essay con cludes with six points that need to be considered when formulating a material ethics that is universalizable and, most importantly, that can address the massive poverty and dehumanization of those excluded from the present community of communication. An important question one can ask of ethical theories is whether and how they aim to raise claims to universality. This refers to the subject area that they intend to describe or govern and also to the question whether they claim to be binding for all (moral) agents. This paper discusses the question of universality of Luciano Floridi’s information ethics (IE). This is done by introducing the theory and discussing its conceptual foundations and applications. The emphasis will be placed on (...) the ontological grounding of IE. IE’s claims to universality will be contrasted with those raised by discourse ethics. This comparison of two pertinent ethical theories allows for a critical discussion of areas where IE currently has room for elaboration and development. (shrink)

Ob als Universitätslehrer, Kanzelredner, als politischer Reformer, Publizist, Salongänger oder Briefeschreiber – Schleiermacher war selbst ein begnadeter Kommunikator und im Begriff der Kommunikation bündeln sich wie in einem Brennglas viele zentrale Aspekte seines Denkens. Sich in Sprache manifestierendes Wissen, (...) moralisches Handeln, religiöses Erleben und der Entwurf gemeinschaftlicher Institutionen sind im beständigen Werden und nur im Austausch der miteinander streitenden, sich liebenden und hassenden, Ideen und Sinn entwerfenden und um Gemeinschaft und Individualität ringenden Menschen wirklich. Die Beiträge dieses Bandes gehen Schleiermachers Werk ebenso wie seiner gesellschaftlichen, kirchlichen und philologischen Praxis vor dem Hintergrund ihrer ideengeschichtlichen Verflechtung nach und aktualisieren sein Denken in Auseinandersetzung mit unterschiedlichen Positionen der Gegenwart. In this article, Herbert Marcuse’s nature-ethical considerations, which have to date been scarcely received, are used to develop perspectives on how the nature-ethical gap in contemporary Critical Theory could be closed. The central idea is that nature is tobe recognized as a subject in its own right without needing to anthropomorphize it in the process. The advocatory ethics of nature, which is outlined here, differs from current sustainability and environmental ethics primarily in that it maintains the tension between an anthropocentric (...) and an ecocentric approach and does not resolve it in one direction. Marcuse’s so-called “liberation of nature” is understood as a means for the “liberation of humans”, but the latter can only succeed if the former is also carried out. (shrink)

ZusammenfassungDie gegenwärtige Debatte über die normativen Grundlagen Kritischer Theorie lässt sich nur vor dem Hintergrund ihrer Geschichte verstehen: Die Defizite in den Konzeptionen der 1. und 2. Generation strukturieren das Feld der Optionen, die heute noch als aussichtsreich gelten können. Der Blick zurück schärft den Blick nach vorn. Im ersten Teil des Beitrags werde ich deshalb die Hauptthesen, ethischen Implikationen und Einseitigkeiten von Horkheimers Zur Kritik der instrumentellen Vernunft darstellen. Im zweiten Teil werde ich die von Habermas ausgearbeitete These diskutieren, (...) dass der Sprache das nicht-instrumentelle Telos der Verständigung innewohnt. Zudem werde ich zeigen, dass es Habermas nicht gelingt, den für seine Diskursethik zentralen Universalisierungsgrundsatz abzuleiten. Wie sich die Begründungsprobleme bei Horkheimer und Habermas auf die gegenwärtige Debatte auswirken, werde ich im dritten Teil besprechen. (shrink)

Bisher ist die Rolle von Ethikkomitees und Ethikberatenden als Ressource im Umgang mit der Covid-19-Pandemie ungeklärt. Im vorliegenden Beitrag wird diskutiert, worin spezifische Herausforderungen bei der ethischen Bewertung von Fragen an Ethikkomitees im Pandemiekontext bestehen und welche möglichen Aufgaben für Ethikberatende identifiziert werden könnten. Dabei wird die Ansicht vertreten, dass es für die kompetente, professionelle Bearbeitung dieser Fragen hilfreich wäre, das theoretische Grundverständnis der Ethikberatung für den Pandemiekontext zu reflektieren, die begründungstheoretischen, normativen Argumente aktueller Publikationen und Stellungnahmen der Fachgesellschaften zu (...) diskutieren und Weiterbildungspotenzial sowie Kompetenzgrenzen zu identifizieren. Für werden zur Kompetenzerweiterung Public-Health-Ethik und Ethik der Menschenrechte vorgeschlagen, psychische Entlastung bei ‚moralischem Stress‘ wird als ethisch-psychologischer Kooperationsbereich diskutiert und die explizite Abgrenzung vom juristischen Bereich wird empfohlen. Ethikberatung könnte den konstruktiven Umgang mit ethischen Fragen im Pandemiekontext fördern, die Qualität von Entscheidungs- und Bewertungsprozessen verbessern und in der Versorgungspraxis pragmatische, konkrete Hilfestellung anbieten. In this paper, I aim to characterize the pragmatist and anti-deflationist notions of truth. I take Habermas’s rather recent discussion and present the interpretation that his notion of truth relies on the reliabilist conception of knowledge rather than the internalist conception that defines knowledge as a justified true belief. Then, I show that my interpretation is consistent with Habermas’s project of weak naturalism. Finally, I draw some more general implications about the pragmatist notion of truth.

Neither traditional philosophy nor current applied ethics seem able to cope adequately with the highly dynamic character of our modern technological culture. This is because they have insufficient insight into the moral significance of technological artifacts and systems. Here, much can be learned from recent science and technology studies. They have opened up the black box of technological developments and have revealed the intimate intertwinement of technology and society in minute detail. However, while applied ethics is characterized by a certain (...) “technology blindness,” the most influential approaches within STS show a “normative deficit” and display an agnostic or even antagonistic attitude toward ethics. To repair the blind spots of both applied ethics and STS,the authors sketch the contours of a pragmatist approach. They will explore the tasks and tools of a pragmatist ethics and pay special attention to the exploration of future worlds disclosed and shaped by technology and the management of deep value conflicts inherent to a pluralist society. Big data-analysis is linked to the expectation to provide a general image of socially relevant topics and processes. Similar to this, the idea of the public sphere involves being representative of all citizens and of important topics and problems. This contribution, on one side, aims to explain how a normative concept of the public sphere could be infiltrated by big data. On the other, it will discuss how participative processes and common wealth can profit from a thorough use of big (...) data analysis. As important parts of the argument, two concepts will be introduced: the numerical public and total politicisation. (shrink)

The author describes Heller’s concept of ethics as a “quasi-sphere” intersecting with various fields relating to human relationships. Special attention is paid to the axiological aspects of her concept of ethics and the relationship between virtues and responsibility. The author also seeks to show how Heller integrated a traditional philosophical question—the relationship between “is” and “ought to be”—into her concept of “radical philosophy” at an earlier stage in the development of her philosophy. She initially considered the relationship between “is” and (...) “ought to be” to be contrasting. Later, when she had come to accept the political model of liberal capitalist society, the ideal of all-compassing equality became the ideal of “equality of opportunities”. The author interprets this shift as one in which the relationship becomes continual. He is also critical of Heller’s underestimation of the effect the “social a priori” has on the possibilities of human life. (shrink)

SummaryWhat does our analysis mean for moral education? Let's take the first of our four aims mentioned above, the development of moral judgement abilities. With regard to the subject matter, the method, the teacher as person, and the community, we might follow from a postmodern point of view:second, that there is not just one valid method to de‐equilibrate children's moral cognitive schemata, but, again, that the chosen method is believed to be effective–knowing that it is just one option;third, that there (...) is a multitude of positions within the same approach. For instance, the just‐community approach might go along with different social, political and moral reasons, intentions, and meanings. Nevertheless, teachers can stick to ‘their model’, even if they know that their choice is also a pragmatic one.In concluding, I should probably give an answer to the question of the title of my presentation: Can a curriculum of moral education be postmodern? I think to have shown that it can and that it is a necessity if we think about postmodernism not as an attempt to pour out the baby of moral education with the metaphysical bath water of modern dreams. Moral education will exist as long as education does, and conceptions of moral education have to react reflectively to changes of and critiques of modern belief systems. A ring is still a ring, even if it is a just copy of something we do not believe in anymore. (shrink)

El objetivo de este trabajo es explicar la conexión entre reglas discursivas y normas morales en el marco de la ética del discurso. El trabajo comienza con un análisis de la diferencia entre acción y operación y con una reconstrucción del concepto de discurso. Luego es presentada la diferencia y la relación entre ley y obligación. La conclusión es que la conexión entre acción y discurso posible está implícita en la noción de responsabilidad moral.

By focusing on the reasoned debate in the discourse -ethical approach to business ethics, this paper discusses the possibilities and limitations of moral reasoning as well as applied economic and business ethics. Business ethics, it is contended, can be looked at from the standpoint of two criteria: justification and application. These criteria are used to compare three approaches: the Integrative Business Ethics, developed by Swiss philosopher Peter Ulrich, the Cultural Business Ethics of the Nuremberg School in German business ethics, and (...) the concept of “Good Conservation” by Frederick Bird. It is argued that discourse -ethical approaches can be called upon for justifying moral principles. Improving the chances of their application, however, necessitates a good understanding of lifeworlds and culturally developed institutional settings. Bearing this in mind, further research perspectives stressing a linkage between discourse -ethical and critical approaches in social sciences are suggested. (shrink)

Der Beitrag diskutiert Möglichkeiten emotionalen Lernens in einzelfallbezogenen Lernarrangements wie etwa klinische Ethikberatungen und Workshops, die mit Einzelfällen arbeiten. Es wird ein didaktisches Rahmenkonzept entwickelt, das vor allem auf die Ermöglichung emotionalen Lernens abzielt. Dabei werden entsprechende Lernziele formuliert, emotionale Themen in diesen Lernarrangements benannt und Methoden dargestellt, wie Erwachsenenbildner diese emotionalen Themen so bearbeiten können, dass ein emotionales Lernen ermöglicht wird. Dabei wird auch ein konzeptueller Rahmen für diese Lernarrangements benannt, der von einem deliberativen Ethikverständnis ausgeht. Emotionales Lernen als (...) Förderung der Sozial- und Selbstkompetenz wird dabei als eine Schlüsselqualifikation verstanden, die gegen die Fach- und Methodenkompetenz abgegrenzt wird. (shrink)

la théorie de l'argumentation est l'un des points les moins travaillés par Habermas dans ses considérations théoriques. Mais son importance est radicale, puisqu'elle définit le statut même de la rationalité, si l'on accepte une prétention de validité qui était problématique. Nous cherchons ici à définir le statut et le cadre de la théorie de l'argumentation chez Habermas. Nous prétendons aussi suggérer que la façon de parler sur l’argumentation a partir de la notion de l'intérêt général est problématique, ce qui peut (...) être corrigé selon le fondement de la propre théorie habermasienne, à condition qu'elle soit bien comprise. This text reconstructs the Kohlberg/Gilligan controversy between a male ethics of justice and a female ethics of care. Using Karl-Otto Apel's transcendental pragmatics, the author argues for a mediation between both models in terms of a reciprocal co-responsibility. Against this backdrop, she defends the circular procedure of an exclusively argumentative-reflexive justification of a normative ethics. From this it follows for feminist ethics that it cannot do without either of the two types of ethics.
