This article starts off with a historical section showing that deep disagreements among notions of social and political justice are a characteristic feature of the history of political thought. Since no agreement or consensus on distributive justice is possible, the article argues that political philosophers should – instead of continuously proposing new normative theories of justice – focus on analyzing the reasons, significance, and consequences of such kinds of disagreements. The next two sections are analytical. The first sketches five possible (...) reasons for deep disagreements among notions of social and political justice. The second discusses the meta-ethical relevance of the lack of consensus on justice and rejects ethical realism and cognitivism based on the argument from deep disagreements. (shrink)

Our reply to Fabian Freyenhagen’s article “Was ist orthodoxe Kritische Theorie?” (DZPhil 65.3 [2017], 456-469) raises the question whether his proposal that Critical Theory only “be adequately and appropriately critical” without a program of justification spares the search for any general criteria. Answering negatively we conversely want to recall, particularly with regard to Horkheimers’s and Adornos’s Dialectic of Enlightment as well as Habermas‘s concept of an emancipatory interest, that such a criterion as a normative foundation of critique is crucial not (...) only for systematical purposes, but also recognised as necessary in this respect by Adorno, who Freyenhagen wants to play off against programs of justification. Critical Theory needs to be clear in this respect. Against this background we are questioning Freyenhagen‘s recourse to an “interest in abolishing social injustice” as the “only criterion for Critical Theory.” Because Freyenhagen ignores the fact that Critical Theory has been understood by its representatives in a twofold manner – as a theoretical program of justification for one and secondly as a cultural diagnosis – his plea for an orthodox Critical Theory is endangered by decisionism. Cultural diversity is an increasingly important phenomenon that affects not only social and political harmony but also the cohesion and efficiency of organisations. The problems that firms have with regard to managing cultural diversity have been abundantly studied in recent decades from the perspectives of management theory and moral philosophy, but there are still open questions that require deeper reflection and broader empirical analysis. Managing cultural diversity in organisations is of prime importance because it involves harmonising different values, beliefs, credos (...) and customs, and, in essence, human identity. Taking into consideration these cultural differences and harmonising them is a human rights issue and a central dimension of corporate social responsibility. Here we are going to focus on theoretical reflection about the ideas that lie behind corporate policies and organisational initiatives that deal with cultural diversity. The aim of our paper is twofold: to present a critical reflection on the ideology of tolerance, and propose an ideology of respect for dealing with cultural diversity. We start by presenting the plurality of interpretations of the concept of ideology, and justify its applicability to the field of cultural diversity. We then reflect on the differences between “tolerance” and “respect” and identifying the practical implications for managing cultural diversity. And finally, we propose a culture of respect that goes beyond tolerance and complements and legitimizes the “business case” perspective for managing cultural diversity in companies. The ideology of respect is based on the Kantian tradition and on the discursive approach where rational dialogue and argumentation are considered the legitimate process for creating a culture of intercultural respect. From this theoretical discussion of the key philosophical concepts we can suggest some general principles for managing cultural diversity in organisations. (shrink)

In this paper, I will argue that it is a moral obligation for companies, firstly, to accept their moral responsibility with respect to non-discrimination, and secondly, to address the issue with a full-fledged programme, including but not limited to the countering of microsocial discrimination processes through specific policies. On the basis of a broad sketch of how some discrimination mechanisms are actually influencing decisions, that is, causing intended as well as unintended bias in Human Resources Management, I will argue that (...) the well known tools of legislation and ethical codes are necessary although insufficient to cope with the problem. However, based on empirical evidence, we know which set of measures is likely to diminish discrimination. Taking non-discrimination seriously implies complex and longitudinal policies which include assigning responsibility for a non-discrimination policy within the firm, making managers conscious of implicit stereotypes and helping them to cope with prejudices that no one can totally overcome. Insofar as corporate responsibility with respect to non-discrimination is accepted and strategies that are not prohibitively expensive are known, companies are bound to implement them. Not implementing the best set of measures may be considered at least as a moral shortcoming or, depending on the size of the company, mere lip service to the non-discrimination principle. Although the paper refers to empirical material of diverse backgrounds, its intent is clearly normative. It wishes to spell out what companies ought to do if they are committed to responsible behaviour. The discussion of effective remedies against discrimination is based on a case study of a French company. The retailer Auchan was recently surprised to learn that it was discriminating against ethnic minorities despite strong ethical standards, an ethics committee and ethical leadership. The company dropped its naïve beliefs and set up an ambitious policy cope with the issue. The case illustrates what recent empirical research has revealed about the effectiveness of diversity policies: establishing responsibility for diversity results, firm ethical commitment and support from top management make diversity programs effective. The objective of the present research was two-fold: to provide a new definition of ethical competence, and to clarify the influence of empathy, personal values, and the five-factor model of personality on ethical competence. The present research provides a comprehensive overview about recent approaches and empirically explores the interconnections of these constructs. 366 German undergraduate students were examined in a cross-sectional study that investigated the relationship of empathy, personal values, and the five-factor model of personality with moral judgment competence and (...) counterproductive work behavior as indicators of moral judgment and behavior. We found self-transcendence values to be related to both, high levels of empathy and ethical competence, in contrast to self-enhancement values. Multiple mediation analysis revealed unique effects of empathy on ethical competence through values as mediators. Affective empathy transmitted its effect on ethical competence through benevolence, conformity, tradition, power, and hedonism. Most importantly, perspective taking lost its predictive power when investigated alongside affective empathy dimensions. These results converge to an important role of affective empathy, in particular empathic concern, with regard to personal values and ethical competence. Furthermore, the five-factor model of personality explained variance in measures of ethical competence. Our research suggests that organizational decision makers should consider the role of empathy, personal values, and the five-factor model in their human resource management in order to select employees with high ethical competence. Der Artikel greift die Überlegung auf, dass sich die Bioethik auch deshalb der empirischen Forschung zuwenden solle, um ihre Anwendbarkeit und Kontextsensitivität zu erhöhen. Am Beispiel der Norm, dass Schmerzen zu lindern seien, und mit Hilfe eines allgemeinen Modells ethischer Urteilsbildung werden verschiedene Bedeutungen der Anwendung und der Kontextsensitivität unterschieden und es wird untersucht, welche Rolle deskriptive Annahmen hierbei jeweils spielen können. Es wird die These vertreten, dass Kontextsensitivität in den meisten ihrer Bedeutungen von fundamentalethischen Grundannahmen unabhängig ist und dass (...) deskriptive Annahmen einen Prozess der Spezifikation ethischer Urteilsbildung auslösen, der in dieser Form nicht von der ethischen Begründung von Normen und Werten aus initiiert und antizipiert werden kann, jedoch zu seinem (zumindest vorübergehenden) handlungsorientierenden Abschluss auf diese zurückverwiesen ist. This text reconstructs the Kohlberg/Gilligan controversy between a male ethics of justice and a female ethics of care. Using Karl-Otto Apel's transcendental pragmatics, the author argues for a mediation between both models in terms of a reciprocal co-responsibility. Against this backdrop, she defends the circular procedure of an exclusively argumentative-reflexive justification of a normative ethics. From this it follows for feminist ethics that it cannot do without either of the two types of ethics. The goal is to assure the evaluative (...) variety of different types of an ethics of the good without endangering the normative boundaries of a deontological discourse ethics. (shrink)

One of the most widely accepted tenets in postmetaphysical normative ethics is the principle of dialogue as a foundational authority. Conceptually, the dialogical model is valuable, in that it allows a binding yet mutable underpinning of moral discourse. However, dialogue has its limits. The main drawback lies in the fact that deliberations can be very lengthy, perhaps even infinite. In other words, deliberation does not always lend itself to action. From the vantage point of applied ethics, in this case, bioethics (...) and forensic ethics, this is not a minor shortcoming since these disciplines are concerned with situations involving some sort of urgency. Aporia is not an option in most cases. It is thus pressing to consider the moment of decision inherent to moral judgement and action that puts an end to dialogue. From the realm of abstract norm justification, one must move on to the contextualist discourse of application. To be rational, however, decision must avoid authoritativeness or any type of arbitrariness. What, then, could serve as a reasonable criteria for the rational application of norms? What aspects should be envisaged for a sound reflective decision? This paper will attempt to sketch some answers that could contribute to the question of the necessary contextual application of accepted norms by paying heed to, systemizing and sometimes finding fault in the arguments given by judges who had to settle cases touching sensitive moral issues. This contribution is a critical and constructive engage ment with discourse ethics. First, it clarifies why discourse ethics has difficulties with the grounding and application of moral norms. Second, it turns to a positive appropriation of the formal and proce dural aspects of discourse ethics. The goal is the elaboration of an ethics that is able to incorporate the material aspects of goods and the formal dimension of ethical validity and consensuability. Every morality is the formal application of some substantive (...) good. Every ethical perspective demands its evaluation in terms of its uni versability. In order to achieve this mediation, it is suggested that we must incorporate not only the historical dimension of moral systems, but also the role of critical consciousness and the negativity embod ied by those who are victims of the existing consensus. The essay con cludes with six points that need to be considered when formulating a material ethics that is universalizable and, most importantly, that can address the massive poverty and dehumanization of those excluded from the present community of communication. Generation strukturieren das Feld der Optionen, die heute noch als aussichtsreich gelten können. Der Blick zurück schärft den Blick nach vorn. Im ersten Teil des Beitrags werde ich deshalb die Hauptthesen, ethischen Implikationen und Einseitigkeiten von Horkheimers Zur Kritik der instrumentellen Vernunft darstellen. Im zweiten Teil werde ich die von Habermas ausgearbeitete These diskutieren, (...) dass der Sprache das nicht-instrumentelle Telos der Verständigung innewohnt. Zudem werde ich zeigen, dass es Habermas nicht gelingt, den für seine Diskursethik zentralen Universalisierungsgrundsatz abzuleiten. Wie sich die Begründungsprobleme bei Horkheimer und Habermas auf die gegenwärtige Debatte auswirken, werde ich im dritten Teil besprechen. (shrink)

Neither traditional philosophy nor current applied ethics seem able to cope adequately with the highly dynamic character of our modern technological culture. This is because they have insufficient insight into the moral significance of technological artifacts and systems. Here, much can be learned from recent science and technology studies. They have opened up the black box of technological developments and have revealed the intimate intertwinement of technology and society in minute detail. However, while applied ethics is characterized by a certain (...) “technology blindness,” the most influential approaches within STS show a “normative deficit” and display an agnostic or even antagonistic attitude toward ethics. To repair the blind spots of both applied ethics and STS,the authors sketch the contours of a pragmatist approach. They will explore the tasks and tools of a pragmatist ethics and pay special attention to the exploration of future worlds disclosed and shaped by technology and the management of deep value conflicts inherent to a pluralist society. In this article the author tries to give an answer - from the point of view of the transcendental pragmatic foundation of discourse ethics - to the title question, which was raised by the Unesco conferences entitled `Universal Ethics' in Paris (27 March 1997) and Naples (December 1997). The article should be understood as a supplement to the empiristic-comparative responses of S. Bok and H. Küng, and especially to the communitarian approach of M. Walzer, proposed at the first conference. Unlike (...) traditional rationalism, this approach does not try to deduce concrete moral norms from axiomatic first principles; it begins with transcendental reflection on the undeniable moral presuppositions of argumentative discourse (which is not circumventable in philosophy). The approach first deduces from these presuppositions only the ideal procedures for the moral discourses through which all concrete moral problems ought to be solved, if possible. The second step provides a strategic-counter-strategic supplementation principle for those cases where undistorted moral discourses are not possible. (shrink)

Normative research has nearly vanished from the academic ‘mainstream’ in accounting. Due to its prescriptive and value-driven approach, normative accounting research has been stigmatized as being unscientific and largely replaced by positive studies. We put this stigma into perspective. We first conceptualize the ‘positive-normative’ distinction and identify this dichotomy in accounting research history. We then challenge the dogmatic confinement of science to descriptive (positive) approaches. Moreover, we debate the basic conditions for normative accounting research and conclude that methodological and epistemological (...) pluralism in accounting research may help address a wide range of potential research questions. We point out that normative research approaches are essential in an applied science such as accounting, lest practical implications and prescriptions are to be the exclusive domain of accounting practice. The distinction between teleology and deontology is today almost universally accepted within practical philosophy, but deontology is and has from the beginning been subordinate to utili-tarianism. ‘Deontology’ was constructed by Bentham to signify the art and science of private morality within a utilitarian worldview. The classical distinction was constructed by Broad as a refinement of Sidgwick’s utilitarianism, and then adopted by Frankena. To Broad it signified two opposite tendencies in ethics, in Frankena’s textbooks, however, it becomes an exclusive distinction, where (...) de-ontology signifies disregard for consequences, and it is therefore almost impossible to think of deontology as a framework for a com-prehensive ethical theory. This conception, however, is adopted by Rawls, and in his contractarian interpretation of deontology it is in fact no more within the sphere of ethics. (shrink)

Recent advances in genomic research have led to the development of new diagnostic tools, including tests which make it possible to predict the future occurrence of monogenetic diseases (e.g. Chorea Huntington) or to determine increased susceptibilities to the future development of more complex diseases (e.g. breast cancer). The use of such tests raises a number of ethical, legal and social issues which are usually discussed in terms of rights. However, in the context of predictive genetic tests a key question arises (...) which lies beyond the concept of rights, namely, What should we want to know about our future? In the following I shall discuss this question against the background of Kant’s Doctrine of Virtue. It will be demonstrated that the system of duties of virtue that Kant elaborates in the second part of his Metaphysics of Morals offers a theoretical framework for addressing the question of a proper scope of future knowledge as provided by genetic tests. This approach can serve as a source of moral guidance complementary to a justice perspective. It does, however, not rest on the – rather problematic – claim to be able to define what the “good life” is. (shrink)

Gender greatly impacts access to opportunities, potential, and success in corporate leadership roles. We begin with a general presentation of why such discussion is necessary for basic considerations of justice and fairness in gender equality and how the issues we raise must impact any ethical perspective on gender in the corporate workplace. We continue with a breakdown of the central categories affecting the success of women in corporate leadership roles. The first of these includes gender-influenced behavioral factors, such as the (...) requirements and expectations of gendered verbal and nonverbal communication styles as well as appearance. We move on to address the impact of family on corporate leadership opportunities and success, discussing the asymmetrical evaluation of an individual’s potential, authority, and competence based on gender stereotypes of familial obligations and expectations. Finally, we address how gender impacts access to networking and sponsorship opportunities and the long-term effects of systematic limitations on women’s inclusion in the upper echelons of corporate leadership. We conclude with a summary of the questions and issues raised by our discussion and direct individuals to consider how different ethical systems and moral requirements might influence their interpretations of gender and leadership in the corporate workplace. A weak and a strong version of discourse theory can be distinguished. In the strong version the only source of normative validity in the nonspecific sense is rational consensus, where all parties concerned accept a norm for the same reasons, which are rationally convincing in the same way for all. In the weak version both rational and overlapping consensus can be sources of validity in the nonspecific sense. It is argued that the weak version is the more adequate, since it (...) can accommodate cases which the strong version cannot, and which it is unreasonable to view as cases of compromise. Discourse theory needs a weaker general discourse principle and a more flexible notion of normative consensus than is found in Habermas's Between Facts and Norms. (shrink)

Are culture driven ethical conflicts apparent in the discourse of the protagonists? A multi-year, multi-cultural study of managers by Trompenaars and Hampden-Turner resulted in two conclusions relevant to business ethics. The first is that intercultural business conflicts can often be traced to a finite set of cultural differences. The second is that enough similarities exist between cultures to provide the grounds for conflict resolution. The research reported here gives credence to their study when applied to an ethical conflict viewed from (...) French and American perspectives. (shrink)

As recent social research demonstrates, the life world is increasingly impacted by a corrosion of social bonds and aggressive habits expressed, for instance, in hate speech in the social media. Significantly, such phenomena have not been prevented from evolving within the framework of constitutional liberal states. In search of an appropriate mode of challenging the current social pathologies, we should examine Kant’s claim that, alongside the “juridico-civil (political) state”, an “ethico-civil state”, uniting human beings “under laws of virtue alone”, needs (...) to be established and cultivated. Kant’s claim is discussed in comparison with “postmetaphysical” conceptions of morality, as maintained by Rawls and Habermas. These prove deficient owing to their contract-based approach. Important in the examination of the key idea of the “state of virtue” is Kant’s thesis that such a state “cannot be realized (by human organization) except in the form of a church”. In view of the fact that, today, in many parts of the world significant segments of the population adhere to agnostic or atheistic convictions, the focus is placed on Kant’s specific conception of “church” that is clearly distinct from “historical” creeds and religious practices, and on the way in which he addresses non-believers, since he insists on the intrinsic relation between morality and the “purely moral religion”. Based on these reflections, the relevance of Kant’s argument that it is “a duty of the entire human race” to establish a community in which people mutually support one another in the cultivation of moral sensitivity is scrutinised. Since COVID-19 is a global-scale pandemic, it can only be solved on the global level. In this context, intercultural dialogues are of utmost importance. Indeed, different models of traditional ethics might be of assistance in constructing a new, global ethics that could help us confront the present predicament and prepare for other possible global crises that might await us in the future. The explosive, pandemic spread of COVID-19 in 2020 clearly demonstrated that in general, one of the most effective tools (...) for containment of the epidemics is precisely human and interpersonal solidarity, which must also be accompanied by a certain degree of autonomous self-discipline. The present paper follows the presumption that these types of personal and interpersonal attitudes are—inter alia— culturally conditioned and hence influenced by different traditional models of social ethics. In light of the fact that East-Asian or Sinic societies were more successful and effective in the process of containing and eliminating the virus compared to the strategies of the Euro-American regions, I will first question the widespread assumption that this effectiveness is linked to the authoritarian political traditions of the Sinic East and Southeast Asian areas. Then, I will critically introduce the Confucian ethics of relations, which in various ways has influenced the social structures of these regions, and clarify the question of whether and in which way the relics of this ethics had an actual effect on the crisis resolution measurements. The crucial aim of this paper is to contribute to the construction of theoretical groundworks for a new, transculturally grounded global ethics, which is more needed today than ever before. (shrink)

Transcendental Pragmatics and Discourse Ethics. Elements and Perspectives of Apel's Discourse-Philosophy. The author follows Apel's intellectual biography and shows the conception of a critique of meaning qua ‘reflection upon the discourse within the discourse’ to be the centre of Apel's language-pragmatic ‘Transformation of Philosophy’. Beginning with an explication of the situation of a speaker/thinker, especially of the situation of a philosophising speaker/thinker, Apel reconstructs a two fold apriori of communication: Every thought is situated within the context of a particular, historically (...) evolved, community of language and interaction. At the same time, however, the validity-claims of thoughts transcend the context of their origin towards an unlimited community of argumentation. On the basis of the first apriori Apel criticises the methodical solipsism as well as the objectivism of modern philosophy and theory of science. Drawing upon the second apriori he develops a universalist critique of meaning of relativism and contextualism. In the sixties and seventies Apel worked out a differentiated theory of the – more or less – communicatively cognizing humanities and set it apart from the theory of the causal-explanatory natural sciences, thus challenging the objectivism of a Theory of Unified Science. Building upon this work Transcendental Pragmatics, as developed by Apel and others, sets philosophy primarily two tasks: firstly, a internal reconstruction of argumentative discourse as the situation of speech and thought which seeks to elucidate the conditions of the meaningfulness, i. e. the presuppositions, of discourse. These presuppositions comprise, thus Apel with Habermas, the four validity-claims to intelligibility, sincerety/credibility, truth and normative rightness/legitimacy. Their moral content consists, thus Apel, not only in the recognition of the equality of all beings capable of discursive reasoning but also in their recognition of a co-responsibility for the realizability of discourses and of responsibility. The author argues that the existence of a co-responsibility of this kind is indisputable because the discursive claims to validity are intertwined with a set of ‘primordial promises of dialogue’. Only with the elucidation and explication of these promises can the reconstruction of the internal conditions of discourse be completed.The second task of a pragmatics of argumentation isthe strict resp. actual reflection of the thinker upon the presuppositions of the discourse in which he currently engages. This reflection has a Socratic character and can only be done in the form of discussion and debate with critics of the reconstruction. In this context, the author proposes a method of Socratic reflection upon the presuppositions of dialogue which suspends the usual, theoretically oriented, attitude of the scientist and the philosopher in favour of an actual reflective attitude. Within a dialogue with a sceptic who doubts one of the results of the internal reconstruction of dialogical presuppositions, say X, it is tested whether his doubt as to the unrestricted validity of X can be understood as a sincere contribution to the current dialogue or whether this particular sceptical thesis does not make sense, because it is incompatible with the role of a sincere participant of argumentation which, after all, the sceptic cannot refuse to claim for himself.Finally the author explains Apel's characterization of the tension between “Discourse and Responsibility”. In the course of discussions with Max Weber, Lawrence Kohlberg, Hans Jonas et al., Apel formulates and justifies an ethics of responsibility and gives an affirmative answer to the crucial question of whether the fulfilment of the moral obligations connected with the recognition of co-responsibility can be demanded within the non-dialogical circumstances of social reality. Apel's answer employs the idea of counter-strategies which are morally legitimate in virtue of their being worthy of argumentative consensus. (shrink)

An important question one can ask of ethical theories is whether and how they aim to raise claims to universality. This refers to the subject area that they intend to describe or govern and also to the question whether they claim to be binding for all (moral) agents. This paper discusses the question of universality of Luciano Floridi’s information ethics (IE). This is done by introducing the theory and discussing its conceptual foundations and applications. The emphasis will be placed on (...) the ontological grounding of IE. IE’s claims to universality will be contrasted with those raised by discourse ethics. This comparison of two pertinent ethical theories allows for a critical discussion of areas where IE currently has room for elaboration and development. (shrink)

This paper considers the distribution of responsibility for prevention of negative social or ecological effects of production and consumption. Responsibility is related to ability and ability depends on welfare. An increase in competition between Western companies depresses their profitability, but increases the welfare of Western consumers and,hence, their ability to acknowledge social values. Therefore, an increase in competition on consumer markets shifts the balance in responsibility from companies to consumers to prevent negative external effects from production and consumption patterns. The author describes Heller’s concept of ethics as a “quasi-sphere” intersecting with various fields relating to human relationships. Special attention is paid to the axiological aspects of her concept of ethics and the relationship between virtues and responsibility. The author also seeks to show how Heller integrated a traditional philosophical question—the relationship between “is” and “ought to be”—into her concept of “radical philosophy” at an earlier stage in the development of her philosophy. She initially considered the relationship between “is” and (...) “ought to be” to be contrasting. Later, when she had come to accept the political model of liberal capitalist society, the ideal of all-compassing equality became the ideal of “equality of opportunities”. The author interprets this shift as one in which the relationship becomes continual. He is also critical of Heller’s underestimation of the effect the “social a priori” has on the possibilities of human life. (shrink)

ZusammenfassungIn diesem Artikel geht es um die Beziehungen zwischen der von Jürgen Habermas entwickelten Diskursethik und den Studierendenseminaren, die der Ulmer Arbeitskreis „Ethik in der Medizin“ veranstaltet. Zunächst erfolgt eine Darstellung der Kernaussagen der philosophischen Diskursethik. Sie liefert eine formale Argumentationsprozedur, mit der es möglich ist, die Legitimität strittig gewordener Normen im Diskurs zu prüfen. Anschließend wird das in Ulm von Baitsch und Sponholz entwickelte Modell der Seminare „Ethische Entscheidungskonflikte im ärztlichen Alltag“ vorgestellt. SummaryWhat does our analysis mean for moral education? Let's take the first of our four aims mentioned above, the development of moral judgement abilities. With regard to the subject matter, the method, the teacher as person, and the community, we might follow from a postmodern point of view:second, that there is not just one valid method to de‐equilibrate children's moral cognitive schemata, but, again, that the chosen method is believed to be effective–knowing that it is just one option;third, that there (...) is a multitude of positions within the same approach. For instance, the just‐community approach might go along with different social, political and moral reasons, intentions, and meanings. Nevertheless, teachers can stick to ‘their model’, even if they know that their choice is also a pragmatic one.In concluding, I should probably give an answer to the question of the title of my presentation: Can a curriculum of moral education be postmodern? I think to have shown that it can and that it is a necessity if we think about postmodernism not as an attempt to pour out the baby of moral education with the metaphysical bath water of modern dreams. Moral education will exist as long as education does, and conceptions of moral education have to react reflectively to changes of and critiques of modern belief systems. I argue in this article that responsible leadership (Maak and Pless, 2006) contributes to building social capital and ultimately to both a sustainable business and the common good. I show, first, that responsible leadership in a global stakeholder society is a relational and inherently moral phenomenon that cannot be captured in traditional dyadic leader–follower relationships (e.g., to subordinates) or by simply focusing on questions of leadership effectiveness. Business leaders have to deal with moral complexity resulting from a multitude of stakeholder (...) claims and have to build enduring and mutually beneficial relationships with all relevant stakeholders. I contend, second, that in doing so leaders bundle the energy of␣different constituencies and enable social capital building. Social capital can be understood as actual or potential resources inherent to more or less institutionalized relationships of mutual recognition (Bourdieu 1980). By drawing on network analysis I suggest, third, that responsible leaders weave durable relational structures and ultimately networks of relationships which are rich in ties to otherwise unconnected individuals or groups. Against this background I argue, fourth, that responsible leadership may result in the creation of value networks (Lord and Brown, 2001) of multiple stakeholders, which enhance social capital and thereby contribute to both a sustainable business and the common good. This paper tries to provide a complete list and classification of the motives for acting in accordance with morals, to explain the mechanisms underlying the less transparent among these motives, and to probe which of these motives are suited for justifying morals. (1) After giving reasons for the importance of an empirical theory of moral motives for ethics, and after specifying the exact question of the present study (2) a general model of moral action (3) and a main classification of (...) the motives for acting morally is presented. (4) Self-transcendent motives, (5) motives close to morals, like sympathy and respect, (6) and moral motives in the narrow sense, which proceed from moral judgements, are scrutinized in detail. Only the motives near to morals and interest in cooperation but not the moral motives in the narrow sense are suited for justifying morals. (7) A concluding sketch of the development of moral judgements shows that only motives near to morals and interest in cooperation (but not e.g. pure reason) are also the sources of autonomously developed moral criteria. This article examines Robert Alexy's account of legal validity. It concludes that Alexy's account of legal validity lacks sufficient support given the author's methodological commitments. To reach that conclusion, it assesses the plausibility of simultaneously maintaining that the participant's perspective has conceptual privilege in the explanation of the nature of law, that legal discourse is a special case of general practical discourse, and that unjust considerations can be legally valid norms.

The point of departure in this article is the Danish debate about democracyin schools. This article presents a first step in a study of how the relationshipbetween democracy and education can be understood. A juxtaposition of thetwo concepts requires, first of all, an analysis of how the concept of democracyis used in the educational debate. In this article three models of democracy areapplied as an analytical framework: a liberal model (Hobbes, Locke, Kant, Rawls,Dworkin), a communitarian model (MacIntyre, Sandel, Nussbaum) and (...) a communicative/deliberativemodel (Walzer, Benhabib, Taylor, Habermas). Numerous contradictions and tensionsbetween concepts of democracy and education can be found in such a juxtaposition,depending on which conception of democracy one chooses to apply. In this articleI discuss which conception affords us the most meaningful concept of democraticteaching. As an introduction, a brief historical overview of the interplay betweendemocracy and education in Danish school is provided. (shrink)

In this article, Herbert Marcuse’s nature-ethical considerations, which have to date been scarcely received, are used to develop perspectives on how the nature-ethical gap in contemporary Critical Theory could be closed. The central idea is that nature is tobe recognized as a subject in its own right without needing to anthropomorphize it in the process. The advocatory ethics of nature, which is outlined here, differs from current sustainability and environmental ethics primarily in that it maintains the tension between an anthropocentric (...) and an ecocentric approach and does not resolve it in one direction. Marcuse’s so-called “liberation of nature” is understood as a means for the “liberation of humans”, but the latter can only succeed if the former is also carried out. (shrink)

In recent times, representatives of American management science have been arguing increasingly for a functionalization of ethics to change economic thinking: what they are seeking is the systematic integration of ethics into the economic paradigm. Using the insights developed by Hirschman, I would like to show how one must first expose the rhetoric of those critics of change in order then to implement that which is new. Such an 'unmasking' works particularly well when one can defuse the arguments of the (...) reactionaries — which is precisely what one achieves by strategically integrating ethics into economics. In his work The Rhetoric of Reaction Hirschman examines three basic forms of reactionary thought: the perversity thesis, the futility thesis, and the jeopardy thesis. According to the perversity thesis, intended goals are transformed into their opposites. The futility thesis argues that the setting of goals is useless since history runs its own course independent of those goals. The jeopardy thesis claims to preserve what already exists since change might substantially endanger that which has already been achieved. The importance of Hirschman's ideas for the strategic interplay between the academic disciplines can be seen quite clearly in the example of German business ethics. This will be displayed below with reference to Hirschman's three theses. Finally, implications will be drawn for business ethics in general and for management theory in particular. (shrink)

In many industrialized countries ethicists and lawyers favour advance directives as a tool to guarantee patient autonomy in end-of-life-decisions. However, most citizens seem reluctant to adopt the practice; the number of patients who have an advance directive is low across most countries. The article discusses the key argument for seeing such documents as an instrument of self-interpretation and life-planning, which ultimately have to be interpreted by third parties as well. Interpretation by third parties and the process of self-reflection are conceptually (...) linked by a qualitative concept of identity. Identity is conceived here as constructed in a processual dialogue between a personal and a cultural perspective. How the cultural dimension comes into play in understanding the motivation, rejection or content of wished for end-of-life-decisions, is shown by a brief review of empirical and cultural studies. Understanding advance directives as a culturally embedded tool of self-interpretation should help to overcome urgent moral problems in clinical settings: how to interpret such documents, how to deliberate on the content and on the best form. According to the author there is no doubt that one has to distinguish between the justification and the application of norms. Problems are seen only to arise if one asks what exactly the distinction is and which consequences have to be drawn from it. Recently, Klaus Günther, in particular, has searched for this distinction and connected it with far‐reaching conclusions concerning the theory of norms, arguments, and morals. His theses are the object of the author's considerations.

Seine Philosophie, Theologie und philologische Praxis zeichnen sich durch ihre emphatische Prozesshaftigkeit jenseits starrer Systeme aus. Sich in Sprache manifestierendes Wissen, (...) moralisches Handeln, religiöses Erleben und der Entwurf gemeinschaftlicher Institutionen sind im beständigen Werden und nur im Austausch der miteinander streitenden, sich liebenden und hassenden, Ideen und Sinn entwerfenden und um Gemeinschaft und Individualität ringenden Menschen wirklich. Die Beiträge dieses Bandes gehen Schleiermachers Werk ebenso wie seiner gesellschaftlichen, kirchlichen und philologischen Praxis vor dem Hintergrund ihrer ideengeschichtlichen Verflechtung nach und aktualisieren sein Denken in Auseinandersetzung mit unterschiedlichen Positionen der Gegenwart. The article sets out to explore the international legal dimension in Jürgen Habermas' latest publications on philosophy of law. It is our view that Habermas deals with the examination of just relations beyond the nation-state first and foremost from a legal perspective, and that the key to a Habermasian reading of international justice is not through an application of discourse-theoretical models of communicative or moral action as such, but primarily through proper legal institutionalisation of the rule of law. In asserting (...) this view, we will look closer at the Kantian influence in Habermas' legal construct at the international level, and show why this institutional approach is to be sharply distinguished from and preferred to any exclusively non-institutional approach to international justice. Faced with an ever-growing number of ethical marketing issues and uncertainty about the impact of specialized ethics journals, researchers are struggling to keep abreast of developments in the field. In order to address these challenges, our paper provides a comprehensive review of the literature on marketing ethics over almost 50 years, offers a citation analysis and develops a unique marketing ethics impact factor (MEIF). We contribute to the field in three important ways. First, we present a state-of-the-art picture of marketing (...) ethics research. This provides an account of the research focus in each decade, assesses the importance of specific topics in the debate and identifies existing research gaps. Second, we identify the most influential papers and researchers in the marketing ethics area. Third, we evaluate the most important journals in terms of their impact on marketing ethics. To this end, we have developed an MEIF. This improves our ability to judge a journal's influence on this particular sub-discipline. (shrink)

Empirical research into the ethics of emerging technologies, often involving foresight studies, technology assessment or application of the precautionary principle, raises significant epistemological challenges by failing to explain the relative epistemic status of contentious normative claims about future states. This weakness means that it is unclear why the conclusions reached by these approaches should be considered valid, for example in anticipatory ethical assessment or governance of emerging technologies. This paper explains and responds to this problem by proposing an account of (...) how the epistemic status of uncertain normative claims can be established in ethical and political discourses based on Jürgen Habermas’ discourse ethics. To better understand the nature of the problem, the relationship between norms, facts and the future is explored in light of potential meta-ethical fallacies faced in the field of empirical ethics. Weaknesses of current approaches to anticipatory ethical assessment and governance are then explored, including the Precautionary Principle and Technology Assessment. We argue that the epistemic status of uncertain normative claims can be understood within Habermas’ approach to political discourse, which requires ‘translation’ of uncertain claims to be comprehensible to other stakeholders in discourse. Translation thus provides a way to allow for uncertain normative claims to be considered alongside other types of validity claims in discourse. The paper contributes a conceptual account of the epistemic status of uncertain normative claims in discourse and begins to develop a ‘methodology of translation’ which can be further developed for approaches to research and ethical assessment supporting anticipatory evidence-based policy, governance and system design.
