I argue in a non-reductive sense for a plausible epistemic principle, which can (1) theoretically and instrumentally unify or systematize all fallacies, and (2) provide a justification for using such a principle for characterizing an erroneous argument as a fallacy. This plausible epistemic principle involves the idea of an error in the method of justification, which results in a failure to provide relevant evidence to satisfy certain standards of adequate proof. Thus, all fallacies are systematically disguised failures to provide substantive (...) proof: a failure in the attempt to persuade rationally, as opposed to emotionally or rhetorically. I argue that the epistemic idea of begging the question is essential to this idea of a fallacy as an inadequate proof. (shrink)

Though textbook tu quoque arguments are fallacies of relevance, many versions of arguments from hypocrisy are indirectly relevant to the issue. Some arguments from hypocrisy are challenges to the authority of a speaker on the basis of either her sincerity or competency regarding the issue. Other arguments from hypocrisy purport to be evidence of the impracticability of the opponent’s proposals. Further, some versions of hypocrisy charges from impracticability are open to a counter that I will term tu quoque judo.

The aim of the paper is to present a typology of argument schemes. In first place, we found it helpful to define what an argument scheme is. Since many argument schemes found in contemporary theories stem from the ancient tradition, we took in consideration classical and medieval dialectical studies and their relation with argumentation theory. This overview on the main works on topics and schemes provides a summary of the main principles of classification. In the second section, Walton’s theory is (...) briefly explained to introduce the schemes classification and its different levels. The overarching goal of this book is to differentiate and provide a highly detailed descriptive account of a specific class of arguments. To simplify, let us consider the following example: suppose one aims to persuade that “Julius Caesar was a criminal.” To support that claim various arguments may be formulated, such as: a) Joseph Stalin murdered his political opponents who openly opposed him, thus he was a criminal. Julius Caesar did the same. Therefore, if Stalin was a criminal, then Caesar (...) was also a criminal. b) Most historians studying the history of the Roman Empire consider Julius Caesar to be a criminal, so he was one. c) The majority of people believe Julius Caesar was a criminal, so he was one. d) Anyone who murders or orders the killing of others is a criminal—regardless of whether it’s in defense of the country or to maintain power. Julius Caesar issued orders resulting in thousands of deaths, so he was a criminal. Argumentation theory distinguishes and extensively describes different types of arguments, each with its own definition, argumentation scheme, subtypes, and criteria for evaluation. We may, therefore, identify that: example (a) employs the argument from analogy, (b) is an argument from authority (ad auctoritate), and (c) is an argument from popular opinion (ad populum). What about (d)? Is there a theory for such arguments? Argument in the example (d) establishes the meaning of “criminal” by extending it to those who lead troops into battle or kill in self-defense, and in this way, Caesar can also be included in the extension of a “criminal” (regardless of whether he committed genocide or simply won battles). Although there are many concepts in argumentation theory and informal logic that explain various aspect of such arguments (e.g., persuasive definitions and persuasive quasi-definitions, attributions, classification arguments, etc.) there is no theory for such arguments—or rather—there was no until now. This book is aimed to provide a concept, classification, and assessment criteria for arguments which fix the meaning to support persuasion—namely, semantic arguments. Semantic arguments manifest themselves as a common and very powerful means of persuasion in various areas of human activity, including political discourse, advertising, science, law, and philosophy. This can be illustrated through an analysis of some examples: e.g., the redefinition of “planet” proposed in 2008 to exclude Pluto from the scope of this concept, the redefinition of the term “wetland” put forward by G.W. Bush in 1988, modifications of the definition of “human being” in disputes about abortion, or the definition of “vehicle” in cases of accidents involving electric scooters. The book’s goal is to provide a model of semantic argument—differentiating arguments that fix meaning for persuasive purposes, providing definition and scheme, constructing a comprehensive classification, and developing assessment criteria. This broader aim also fills a gap in argumentation theory regarding our understanding of semantic arguments and their actual and potential applications. (shrink)

A "good" arguer is like an architect with a penchant for civil and civic engineering. Such an arguer can design and present their reasons artfully about a variety of topics, as good architects do with a plenitude of structures and in various environments. Failures in this are rarely hidden for long, as poor constructions reveal themselves, often spectacularly, so collaboration among civical engineers can be seen as a virtue. Our logical virtues should be analogous. When our arguments fail due to (...) being uncivil and demagogic, since we inhabit the arguments we build, we are all crushed beneath our flawed reasoning. This mixed metaphor takes us to a self-referential analysis of argumentation, analogy, and humor. I argue that good argumentation strives to collaboratively convince rather than belligerently persuade. A convincing means toward this end is through humorous analogical arguments, whether the matter at hand is ethical, logical, theological, phenomenological, epistemological, metaphysical, political, or about baseball. Peer Review Book Description - Maria Seykora (female, published age 28) -/- -/- Classical Logic will attempt to give a comprehensive and rigorous introduction and more advanced overview of the area of logic widely known as “classical logic,” as distinguished from modern-day “non-classical logic,” for undergraduate students in general. It will cover the topics of Informal Logic (including logical fallacies, deduction, induction, and abductive reasoning) and Formal Logic. (Because it aims to cover these two topics, the title may change to (...) Informal and Classical Logic for the first edition.) Within the category of Formal Logic, it will cover Syllogistic or Categorical Logic and Symbolic Logic. Furthermore, within Symbolic Logic, it will cover Propositional Logic, Predicate Logic, and Modal Logic. The Formal Logic component is currently unfinished, and the Informal Logic component is somewhat unfinished. The unique selling proposition is “the first comprehensive Classical Logic textbook.” It seems that many textbooks for college students today, including Patrick J. Hurley’s, are loosely organized around Classical Logic and other various areas of logic, yet there is not a clear-cut, comprehensive summation of Classical Logic in textbook form. For instance, Hurley’s textbook does not have a section on Modal Logic, and does not address some fallacies such as Hypothesis Contrary to Fact, the Genetic Fallacy, Appeal to Nature, No True Scotsman Fallacy, Emotionally Loaded Language fallacies, etc. Stan Baronett’s Logic textbook also does not include discussions of Modal Logic or these additional fallacies and others like them, and Siu-Fan Lee’s textbook does not include Modal Logic either. Additionally, abductive reasoning, which involves making an inference to the best explanation, is important in real life, yet it seems absent from most logic textbooks. (shrink)

Scientists may sometimes generalize from their samples to broader populations when they have not yet sufficiently supported this generalization. Do such hasty generalizations also occur in experimental philosophy? To check, we analyzed 171 experimental philosophy studies published between 2017 and 2023. We found that most studies tested only Western populations but generalized beyond them without justification. There was also no evidence that studies with broader conclusions had larger, more diverse samples, but they nonetheless had higher citation impact. Our analyses reveal (...) important methodological limitations of many experimental philosophy studies and suggest that philosophical training may not protect against hasty generalizations. (shrink)

Mental causation, idea that it is us – via our minds – who cause bodily actions is as commonsensical as it is indispensable for our understanding of ourselves as rational agents. Somewhat less uncontroversial, but nonetheless widespread (at least among ordinary people) is the idea that the mind is non-physical, following the intuition that what is physical can neither act nor think nor judge morally. Taken together, and cast into a metaphysical thesis, the two intuitions yield interactive dualism: the view (...) that human persons and their minds are non-physical but can nonetheless interact with their bodies, most notably through their brains. This thesis has two main objectives: first, to defend interactive dualism against objections, and second, to show how it can blend in with a physical world in which laws of nature hold. The first part (chapter 1) consists in a brief motivation of interactive dualism as opposed to non-interactive dualism. I argue that non-interactive, epiphenomenalist dualism sacrifices so many crucial aspects of our human existence that interactive dualism is highly to be preferred to it, barring even stronger counterarguments against the latter. It is those putative counterarguments I address in parts II and III. Part II takes on the philosophical objections from the causal closure of the physical and from causal heterogeneity. The former takes the success of physics and physiology as basis for the doctrine of the causal closure of the physical (CCP). I argue against this that there is not only no convincing argument for CCP, but also that any science-based belief in CCP cannot be epistemically justified. As regards the causal heterogeneity objection, it is ‘weighed and found wanting’, because it relies on unwarranted assumptions about causation. In part III, I examine the objection from energy conservation. It roughly says that if interactive dualism were true, then energy would not be conserved, which physics taught us cannot be the case. My reply is that the underlying conception of energy (and momentum) conservation is wrong-headed and not the one that actual physicists use. Instead of being categorical and global, conservation laws are conditional and local, thereby making natural room for mental interaction. Some dualists, however, have sought to make interactive dualism conservation-friendly, notably by invoking quantum physics; I show that these attempts are unnecessary and create more problems than they solve. Finally, in chapter 9, I turn the tables on non-interactionists by investigating current neurophysiological literature on volitional actions, which, though not addressing the question directly, still encourages the interactive dualist picture more than a non-interactionist one. Part IV is about the interplay between interactive dualism and the laws of nature. The ultimate goal is, if possible, to come up with a theory of the laws of nature that explains the lawlike behavior of nature and at the same time makes room for interaction. I begin by pointing out that the laws of nature are or at least should be what physicalists worry about (chapter 10). I then proceed with a historical survey on the development of the notion of laws of nature (chapter 11) that sheds light on its theistic origin. This is followed by an inquiry into the question how a law of nature could possibly be broken (chapter 12) and a survey of the extant metaphysical theories of the laws of nature with special regard to their receptivity to interaction (chapter 13). Finally, in chapter 14 I develop a theory of the laws of nature both faithful to their divine origin and the possibility of mental interaction: dispositionalist divine decretalism, a synthesis of dispositionalism and Jeffrey Koperski’s divine decretalism. Drawing on the epistemology of logic literature on anti-exceptionalism about logic, we set out to investigate the following metaphilosophical questions empirically: Is philosophy special? Are its methods (dis)continuous with science? More specifically, we test the following metaphilosophical hypotheses empirically: philosophical deductivism, philosophical inductivism, and philosophical abductivism. Using indicator words to classify arguments by type (namely, deductive, inductive, and abductive arguments), we searched through a large corpus of philosophical texts mined from the JSTOR database (N = 435,703) to find patterns of (...) argumentation. The results of our quantitative, corpus-based study suggest that deductive arguments are significantly more common than abductive arguments and inductive arguments in philosophical texts overall, but they are gradually and steadily giving way to non-deductive (i.e. inductive and abductive) arguments in academic philosophy. In this paper, we set out to investigate the following question: if science relies heavily on induction, does philosophy of science rely heavily on induction as well? Using data mining and text analysis methods, we study a large corpus of philosophical texts mined from the JSTOR database (n = 14,199) in order to answer this question empirically. If philosophy of science relies heavily on induction, just as science supposedly does, then we would expect to find significantly more inductive arguments than (...) deductive arguments and abductive arguments in the published works of philosophers of science. Using indicator words to classify arguments by type (namely, deductive, inductive, and abductive arguments), we search through our corpus to find patterns of argumentation. Overall, the results of our study suggest that philosophers of science do rely on inductive inference. But induction may not be as foundational to philosophy of science as it is thought to be for science, given that philosophers of science make significantly more deductive arguments than inductive arguments. Interestingly, our results also suggest that philosophers of science do not rely on abductive arguments all that much, even though philosophers of science consider abduction to be a cornerstone of scientific methodology. While the empirical evidence pointing to a gender gap in professional, academic philosophy in the English-speaking world is widely accepted, explanations of this gap are less so. In this paper, we aim to make a modest contribution to the literature on the gender gap in academic philosophy by taking a quantitative, corpus-based empirical approach. Since some philosophers have suggested that it may be the argumentative, “logic-chopping,” and “paradox-mongering” nature of academic philosophy that explains the underrepresentation of women in the discipline, (...) our research questions are the following: Do men and women philosophers make different types of arguments in their published works? If so, which ones and with what frequency? Using data mining and text analysis methods, we study a large corpus of philosophical texts mined from the JSTOR database in order to answer these questions empirically. Using indicator words to classify arguments by type, we search through our corpus to find patterns of argumentation. Overall, the results of our empirical study suggest that women philosophers make deductive, inductive, and abductive arguments in their published works just as much as male philosophers do, with no statistically significant differences in the proportions of those arguments relative to each philosopher’s body of work. This paper builds a nine-step method for determining whether a straw man fallacy has been committed in a given case or not, by starting with some relatively easy textbook cases and moving to more realistic and harder cases. The paper shows how the type of argument associated with the fallacy can be proved to be a fallacy in a normative argumentation model, and then moves on to the practical task of building a hands-on method for applying the model to real (...) examples of argumentation. Insights from linguistic pragmatics are used to distinguish the different pragmatic processes involved in reconstructing what is said and what is meant by an utterance, and to differentiate strong and weak commitments. In particular, the process of interpretation is analyzed in terms of an abductive pattern of reasoning, based on co-textual and contextual information, and assessable through the instruments of argumentation theory. Philosophy is often divided into two traditions: analytic and continental philosophy. Characterizing the analytic-continental divide, however, is no easy task. Some philosophers explain the divide in terms of the place of argument in these traditions. This raises the following questions: Is analytic philosophy rife with arguments while continental philosophy is devoid of arguments? Or can different types of arguments be found in analytic and continental philosophy? This paper presents the results of an empirical study of a large corpus of philosophical (...) texts mined from the JSTOR database (n = 53,260) designed to find patterns of argumentation by type. Overall, the results suggest that there are no significant differences between the types of arguments advanced in analytic and continental philosophy journal articles. The findings, therefore, provide no empirical support to the hypothesis that the divide between analytic and continental philosophy has to do with the place of argument in these traditions. (shrink)

Addressing the slippery slope argument (SSA) in legal contexts from the perspective of pragma-dialectics, this paper elaborates the conditions under which an SSA-scheme instance is used reasonably (rather than fallaciously). We review SSA-instances in past legal decisions and analyze the basic legal SSA-scheme. By illustrating the institutional preconditions influencing the reasoning by which an SSA moves forward, we identify three sub-schemes (causal SSA, analogical SSA, and Sorites SSA). For each sub-scheme we propose critical questions, as well as four rules that (...) clarify when the SSA scheme is used reasonably. The institutional preconditions make the analogical SSA expectable in common law contexts; the Sorites SSA is expectable in civil law contexts; whereas the causal SSA is common to both contexts. This result should inform future work on the identification of typical argumentative patterns for the SSA in legal contexts. (shrink)

This paper distinguishes between two types of persuasive force arguments can have in terms of two different connections between arguments and inferences. First, borrowing from Pinto, an arguer's invitation to inference directly persuades an addressee if the addressee performs an inference that the arguer invites. This raises the question of how invited inferences are determined by an invitation to inference. Second, borrowing from Sorenson, an arguer's invitation to inference indirectly persuades an addressee if the addressee performs an inference guided by (...) the argument even though it is uninvited. This raises the question of how an invitation to inference can guide inferences that the arguer does not use the argument to invite. Focusing on belief-inducing inference, the primary aims here are to clarify what is necessary for an addressee's belief-inducing inference to be invited by an argument used as an instrument of persuasion; and to highlight the capacity of arguments to guide such inferences. The paper moves beyond Pinto's discussion by using Boghossian's Taking Condition in service of and in way that illustrates how epistemically bad arguments can rationally persuade addressees of their conclusions. This chapter presents a typology of the different kinds of inductive inferences we can draw from our evidence, based on the explanatory relationship between evidence and conclusion. Drawing on the literature on graphical models of explanation, I divide inductive inferences into (a) downwards inferences, which proceed from cause to effect, (b) upwards inferences, which proceed from effect to cause, and (c) sideways inferences, which proceed first from effect to cause and then from that cause to an additional effect. I further (...) distinguish between direct and indirect forms of downwards and upwards inferences. I then show how we can subsume canonical forms of inductive inference mentioned in the literature, such as inference to the best explanation, enumerative induction, and analogical inference, under this typology. Along the way, I explore connections with probability and confirmation, epistemic defeat, the relation between abduction and enumerative induction, the compatibility of IBE and Bayesianism, and theories of epistemic justification. Amphiboly has been widely recognized, starting from the time of Aristotle, as an informal fallacy arising from grammatical ambiguity. This paper applies the profiles of dialogue tool to the fallacy of amphiboly, providing a five-step evidence-based procedure whereby a syntactically ambiguous sentence uttered in a natural language text can be evaluated as committing a fallacy of amphiboly. A user applies the tool to a natural language text by comparing a descriptive graph, representing how the argumentation actually went, to a normative (...) graph, representing how the argumentation should ideally have proceeded. According to the so-called ‘standard theory’ of conditions, the conditionship relation is converse, that is, if A is a sufficient condition for B, B is a necessary condition for A. This theory faces well-known counterexamples that appeal to both causal and other asymmetric considerations. I show that these counterexamples lose their plausibility once we clarify two key components of the standard theory: that to satisfy a condition is to instantiate a property, and that what is usually called ‘conditionship relation’ is (...) an inferential relation. Throughout the paper this way of interpreting the standard theory is compared favourably over an alternative interpretation that is outlined in causal terms, since it can be applied to all counterexamples without losing its intuitive appeal. De uma forma apropriadamente genérica, e apesar de o território teórico abrangido ser extenso e de contornos por vezes difusos, podemos dizer que na área se investiga um conjunto de questões fundamentais acerca da natureza da linguagem, da mente, da cognição e do raciocínio humanos, bem (...) como questões acerca das conexões destes com a realidade não mental e extralinguística. In “What’s So Bad about Scientism?” (Mizrahi 2017), I argue that Weak Scientism, the view that “Of all the knowledge we have, scientific knowledge is the best knowledge” (Mizrahi 2017, 354; emphasis in original) is a defensible position. That is to say, Weak Scientism “can be successfully defended against objections” (Mizrahi 2017, 354). In his response to Mizrahi (2017), Christopher Brown (2017) provides more objections against Weak Scientism, and thus another opportunity for me to show that Weak Scientism is a (...) defensible position, which is what I will do in this reply. In fact, I think that I have already addressed Brown’s (2017) objections in Mizrahi (2017), so I will simply highlight these arguments here. (shrink)

In their attempt to defend philosophy from accusations of uselessness made by prominent scientists, such as Stephen Hawking, some philosophers respond with the charge of ‘scientism.’ This charge makes endorsing a scientistic stance, a mistake by definition. For this reason, it begs the question against these critics of philosophy, or anyone who is inclined to endorse a scientistic stance, and turns the scientism debate into a verbal dispute. In this paper, I propose a different definition of scientism, and thus a (...) new way of looking at the scientism debate. Those philosophers who seek to defend philosophy against accusations of uselessness would do philosophy a much better service, I submit, if they were to engage with the definition of scientism put forth in this paper, rather than simply make it analytic that scientism is a mistake. As a philosophy professor, one of my central goals is to teach students to think critically. However, one difficulty with determining whether critical thinking can be taught, or even measured, is that there is widespread disagreement over what critical thinking actually is. Here, I reflect on several conceptions of critical thinking, subjecting them to critical scrutiny. I also distinguish critical thinking from other forms of mental processes with which it is often conflated. Next, I present my own conception of critical (...) thinking, wherein it fundamentally consists in acquiring, developing, and exercising the ability to grasp inferential connections holding between statements. Finally, given this account of critical thinking, and given recent studies in cognitive science, I suggest the most effective means for teaching students to think critically. (shrink)

Knowledge is one of the most important factors determining the development of global economy and overcoming the present existing inequalities. Humankind needs a fair distribution of the potential of knowledge because its big social problems and difficulties today are due to the existence of deep‐going differences in its possession and use. This paper is an attempt to analyze and present certain philosophical arguments and conceptions justifying cooperative decision‐making in the searching for fair distribution of the benefits of knowledge in the (...) globalized world. Made individually or collectively, these decisions do not worsen the status of anyone ‐ rather they can lead to the use of benefits of knowledge in the interest of all people. A fair distribution of resources and achievements of a knowledge‐based economy is of key importance for the future of humankind. There exist three significant roads to justification of cooperative decisionmaking in a global aspect. The main problem here is that of how to ensure equal access of all members of the global society to benefits of knowledge.In this paper are considered communitarianism, J. Habermas` theory of communicative action and public choice theories. The right to participate in activities of the knowledge society and to share in its wealth is related to the use of social and economic benefits. A distributive justice, including such right, could be based on communitarian political and moral values and principles. Any violation of such principles means existence of social injustice, with lasting consequences, including loss of access to natural goods, such as food and water. (shrink)

In his famous essay "The Ethics of Belief," William K. Clifford claimed "it is wrong always, everywhere, and for anyone, to believe anything upon insufficient evidence." ). One might claim that a corollary to Clifford's Law is that it is wrong, always, everywhere, and for anyone, to withhold belief when faced with sufficient evidence. Seeming to operate on this principle, many religious philosophers—from St. Anselm to Alvin Plantinga—have claimed that non-believers are psychologically or cognitively deficient if they refuse to believe (...) in the existence of God, when presented with evidence for His existence in the form of relevant experience or religious arguments that are prima facie unassailable. Similarly, many atheists fail to see how believers can confront the problem of evil and still assert their belief in a benevolent, omnipotent, and omniscient Creator. In this paper, I propose to explain why religious arguments so often fail to persuade. In doing so, I first offer an account of persuasion and then apply it to religious arguments. I go on to argue that at least some religious arguments commit a form of question-begging, which I call "begging the doxastic question." An argument begs the doxastic question, on my account, when a subject would find the argument persuasive only if she antecedently believes the argument's conclusion. This form of question begging is not, strictly speaking, a case of circularity and thus, is not a fallacy; rather, it would explain why one coming to the argument would fail to be persuaded by it unless he already accepted its conclusion. This has the effect, when applied to religious argumentation, that religious arguments are rarely persuasive, which raises the further question: what good are religious arguments? I end by suggesting some non-persuasive functions of religious argument. Finally, I suggest that a full understanding of religious argumentation should give evidentialists pause, for religious beliefs look less like belief states that are sensitive to evidentiary states and more like framework principles or fundamental commitments. In this study, we examine the philosophical bases of one of the leading clinical psychological methods of therapy for anxiety, anger, and depression, Cognitive Behavioral Therapy (CBT). We trace this method back to its philosophical roots in the Stoic, Buddhist, Taoist, and Existentialist philosophical traditions. We start by discussing the tenets of CBT, and then we expand on the philosophical traditions that ground this approach. Given that CBT has had a clinically measured positive effect on the psychological well-being of individuals, (...) it becomes important to study the philosophical foundations on which this therapy is based. We have noticed a pattern of arguments that exhibit a type of irrationality or a particular informal logical fallacy that is not fully captured by any existing fallacy. This fallacy can be explored through three examples where one misattributes a cause by focusing on a smaller portion of a larger set—specifically, the last or least known—and claiming that that cause holds a unique priority over other contributing factors for the occurrence of an event. We propose to call this fallacy the (...) “last straw fallacy” and will argue why these examples actually warrant a new logical name. Finally, we will show how these cases point to a deeper insight about the contexts in which we typically invoke this type of reasoning and some significant harmful consequences of doing so. (shrink)

Logicians disagree on (1) criteria for the presence of an argument, (2) criteria for adding implicit premises and (3) criteria for linking premises. I attempt to resolve all three problems, and in the process to remove the main obstacles to teaching diagramming. The first problem is resolved by working with real discourse that students find on their own, rather than the artificial examples and problems found in logic texts; it is further reduced by examining the different uses of argument and (...) understanding the extent to which the basic rules of diagramming are the same for the various uses. The other disagreements persist because logicians neglect to clarify the principal type of eakness we remedy by adding implicit premises and linking premises: in real discourse we do so to block substantive counterexamples, an idea correlated with that of substantive deduction, discussed by Govier, Wright and others. Fallacies of relevance, a major category of informal fallacies, include two that could be called pure fallacies of relevance-the wrong conclusion (ignoratio elenchi, wrong conclusion, missing the point) fallacy and the red herring digression, diversion) fallacy. The problem is how to classify examples of these fallacies so that they clearly fall into the one category or the other, on some rational system of classification. In this paper, the argument diagramming software system, Araucaria. is used to analyze the argumentation in some (...) selected textbook examples of pure fallacies of relevance. A system of classification of these fallacies is proposed, and criteria for determining whether an example should be classified as wrong conclusion or red herring are formulated. A key difference cited is that in a case where the red herring fallacy has been committed, even if the argument may go to a wrong conclusion, there is evidence of the use ofa deceptive tactic of diversion. Textual evidence must indicate that the arguer deliberately interjects a distracting controversy to lead the respondent away from the real issue to be disputed. (shrink)

This article analyses the fallacy of wrenching from context, using the dialectical notions of commitment and implicature as tools. The data, a set of key examples, is used to sharpen the conceptual borderlines around the related fallacies of straw man, accent, misquotation, and neglect of qualifications. According to the analysis, the main characteristics of wrenching from context are the manipulation of the meaning of the other’s statement through devices such as the use of misquotations, selective quotations, and quoting out of (...) context. The theoretical tools employed in the analysis are pragmatic theories of meaning and a dialectical model of commitment, used to explain how and why a standpoint is distorted. The analysis is based on a conception of fallacies as deceptive strategic moves in a game of dialogue. As a consequence, our focus is not only on misquotations as distortions of meaning, but on how they are used as dialectical tools to attack an opponent or win a dispute. Wrenching from context is described as a fallacy of unfairly attributing a commitment to another party that he never held. Its power as a deceptive argumentation tactic is based on complex mechanisms of implicit commitments and on their misemployment to improperly suggest an attribution of commitment. (shrink)

The authors identify and offer an analysis of a new form of the Straw Man fallacy, and then explore the implications of the prevalence of this fallacy for contemporary political discourse.

The thesis of this paper is that an argument's possessing the form of affirming the consequent does not suffice to make its premises at all favorably relevant to its conclusion. In support of this thesis I assume two premises and argue for a third. My two assumptions are these: (1) that an argument's possessing the form of affirming the consequent does not suffice to make its conclusion certain relative to its premises (this is widely, if not universally, acknowledged by writers (...) on logic), and (2) premises are favorably relevant to a conclusion only if it is certain or probable relative to them (I argued for this in an earlier paper). The premise I argue for in this paper is that an argument's possessing the form of affirming the consequent does not suffice to make its conclusion probable relative to its premises. To establish this third premise, I first refute a defense of the contrary position (namely, that an argument's possessing the form of affirming the consequent suffices to make its conclusion probable relative to its premises), then offer counterexamples to that position, and finally demonstrate the failure of several attempts to save it. An ad hominem fallacy is committed when an individual employs an irrelevant personal attack against an opponent instead of addressing that opponent’s argument. Many discussions of such fallacies discuss judgments of relevance about such personal attacks, and consider how we might distinguish those that are relevant from those that are not. This paper will argue that the literature on bias and testimony can helpfully contribute to that analysis. . A heuristic search procedure for inventing legal arguments is built on two tools already widely in use in argumentation. Argumentation schemes are forms of argument representing premise‐conclusion and inference structures of common types of arguments. Schemes especially useful in law represent defeasible arguments, like argument from expert opinion. Argument diagramming is a visualization tool used to display a chain of connected arguments linked together. One such tool, Araucaria, available free at , helps a user display an argument on the (...) computer screen as an inverted tree structure with an ultimate conclusion as the root of the tree. These argumentation tools are applicable to analyzing a mass of evidence in a case at trial, in a manner already known in law using heuristic methods and Wigmore diagrams . In this paper it is shown how they can be automated and applied to the task of inventing legal arguments. One important application is to proof construction in trial preparation. (shrink)

Four Basic Logical Issues: The paper addresses what we see as the four major issues in logic. The overriding issue is that of the choice of logic. We start with some discussion of the preliminary issue of whether there is such a 'one true logic,' but we reserve the main discussion for the first issue of 'classical logic versus nonclassical logic.' Here, we discuss the role of meaning and truth, the relation between classical logic and classical negation, and whether and, (...) if so, how classical logic should reside at the base world. Given the argument in favor of an overall use of nonclassical logic, the second issue is that of the choice of nonclassical logic. Brady's logic MC of meaning containment is argued for, with some comparison made with other relevant logics. For the remaining two issues, we make a case for relevant deduction, in comparison with classical deduction, and we explore possibilities for the appropriate metalogic, comparing classical and nonclassical approaches. In this paper it is shown is that although poisoning the well has generally been treated as a species of ad hominem fallacy, when you try to analyze the fallacy using ad hominem schemes, even by supplementing with related schemes like argument from position to know, the analysis ultimately fails. The main argument of the paper is taken up with proving this negative claim by applying these schemes to examples of arguments associated with the fallacy of poisoning the well. Although (...) there is a positive finding in this quest, in that poisoning the well is shown to be based on and associated with these forms of argument in interesting ways, the paper in the end is led to the conclusion that the fallacy is irreducibly dialectical. Poisoning the well is thus analyzed as a tactic to silence an opponent violating her right to put forward arguments on an issue both parties have agreed to discuss at the confrontation stage of a critical discussion. It is concluded that it is a special form of strategic attack used by one party in the argumentation stage of a critical discussion to improperly shut down the capability of the other party for putting forward arguments of the kind needed to properly move the discussion forward. A broad assumption in argumentation theory is that argumentation primarily regards resolving, confronting, or managing disagreement. This assumption is so fundamental that even when there does not appear to be any real disagreement, the disagreement is suggested to be present at some other level. Some have questioned this assumption (most prominently, Perelman and Olbrechts-Tyteca, and Doury), but most are reluctant to give up on the key idea that persuasion, the core of argumentation theory, can only regard disagreements. We argue here (...) that this assumption is false. Argument may be as much about strengthening or maintaining agreement as it is about disagreement. Once we see how argument is possible and manifestly enacted under conditions of agreement, then we have tools to explain otherwise curious fallacies and argumentative phenomena. (shrink)

Analogical reasoning projects a property taken to hold of something or things (the source) to something else (the target) on the basis of just those similarities premised in the analogy. Standard similarity-based accounts of analogical reasoning face the question: Under what conditions does a collection of similarities sufficiently warrant analogical projection? One answer is: When a thing’s having the premised similarities somehow determines its having the projected property. Standardly, this answer has been interpreted as claiming that a formally defined determination (...) relation exists between the variables of which the determining properties are values and the variable of which the determined property is a value. This paper supplies another answer: Analogical projection is warranted when an item’s having the projected property is grounded in its having the premised similarities. Drawing on the metaphysics of grounding, we propose a model of grounded analogy on which analogical reasoning is valid under metaphysical necessity. Our model thus provides one answer to John Stuart Mill’s question of how analogical reasoning based on limited information about a single source case can provide an indefeasible justification for analogical projection. Once a relation of total grounding is ascertained to hold between some similarities and the projected property, no other properties bear on the projectability of the projected property from the source to the target. There is a robust tendency within the contemporary feminist mainstream to argue against and ultimately reject the so-called ‘dualising or dualist philosophy’ since it is the supportive paradigm background for any gender discrimination originated from the hegemonic sovereignty of masculinity over femininity. In this paper, having dived deeper into the feminist critical depiction of the logical binarist foundation on which the dualising philosophy is said to be well-grounded, I will proceed to portray and examine a sequence of doctrines that feminist (...) philosophers have developed to shed light on the fact that the hegemonic sovereignty of masculinity over femininity has been theoretically initiated from the logical disjunction 'p or not p' to masculinity essentialism. Finally, I will end by pointing to a tension between underlying assumptions of the feminist sequentialist approach and what feminists themselves claim to adhere to as the highest ideal: non-naturalising gender differences. Cogency is the central normative concept of informal logic. But it is a loose evaluative concept and I argue that a generic notion covering all of the qualities of a well-reasoned argument is the most plausible conception. It is best captured by the standard RSA criterion: in a good argument acceptable (A) and relevant (R) premises provide sufficient (S) grounds for the conclusion. Logical qualities in a broad sense are affected by the epistemic qualities of the premises and “consequence” in (...) a broad sense exhibits an interplay of form and content. There are four proposals for the premise—conclusion relation: (i) no strictly logical connection (“non-logical” consequence); (ii) one type of connection only (deductivism); (iii) a few types of connection (deduction, induction, perhaps conduction and analogical reasoning); (iv) many types of connection (argumentation schemes). Deductivism is a serious option but in its strong version, as the discussion about petitio shows, it fails to establish that arguments which are not cogent are thereby invalid. And weak deductivism, very attractive from the pedagogical point of view, has some deficiencies (implausible hidden premises; preservation of truth, not probability). I argue that the idea of a counterexample, when we regard certain components of the argument as fixed and others as variable, is the best approach to the analysis of the illative core of every-day arguments (the approach of David Hitchcock on material consequence). This article applies tools from argumentation theory to slippery slope arguments used in current ethical debates on genetic engineering. Among the tools used are argumentation schemes, value-based argumentation, critical questions, and burden of proof. It is argued that so-called drivers such as social acceptance and rapid technological development are also important factors that need to be taken into account alongside the argumentation scheme. It is shown that the slippery slope argument is basically a reasonable form of argument, but is often (...) flawed when used in ethical debates because of failures to meet the requirements of its scheme. Woods and Walton deserve credit for including a discussion of “economic reasoning” and its susceptibility to the “fallacy of composition.” Unfortunately, they did not sufficiently pursue the topic, and argumentation scholars have apparently ignored their pioneering effort. Yet, obviously, economic argumentation is extremely important, and economists constantly harp on this fallacy. This paper calls attention to this problem, elaborating my own approach, which is empirical, historical, and meta-argumentational.

This article aims to restore a way to approach Derrida by revisiting the essentialist ‘logic’ that Leonard Lawlor put forward in 2002. Lawlor argues that the early Derrida developed a ‘logic of totality’ from Hyppolite's reading of Hegel, which formed the basis for a ‘logic of contamination’ and différance; moreover, Lawlor demonstrated such progress. We will situate his implicit premises before following his sequential argument, and thus isolate how Lawlor is aware that Derrida disputes Hyppolite's basic premises and outcomes, so (...) as to suggest the difficulty is methodological. By that we will support Lawlor's discovery that Derrida's earliest work can be approached ‘logically’, so as to help re-orientate both an approach and strands of thought that Derrida helped to inspire. In this paper I argue that the debate over the purported distinction between deductive and inductive arguments can be bypassed because making the distinction is unnecessary for successfully evaluating arguments. I provide a foundation for doing logic that makes no appeal to the distinction and still performs all the relevant tasks required of an analysis of arguments. I also reply to objections to the view that we can dispense with the distinction. Finally, I conclude that the distinction between inductive and (...) deductive arguments is not one of the most important and fundamental ideas in logic, but rather is unnecessary. (shrink)

This paper defends the view that the classification of an argument as being deductive ought to rest exclusively upon psychological considerations; specifically, upon whether the argument's author holds certain beliefs. This account is justified on theoretical and pedagogical grounds, and situated within a general taxonomy of competing proposals. Epistemological difficulties involved in the application of psychological definitions are recognized but claimed to be ineliminable from the praetice of argumentation. The paper concludes by discussing embryonic arguments where the author's relevant beliefs (...) are not sufficiently fine-grained so as to accord the argument deductive or inductive status. (shrink)
