There is an undeniable tendency to dismiss women's sexual assault allegations out of hand. However, this tendency is not monolithic – allegations that black men have raped white women are often met with deadly seriousness. I argue that contemporary rape culture is characterized by the interplay between rape myths that minimize rape, and myths that catastrophize rape. Together, these two sets of rape myths distort the epistemic resources that people use when assessing rape allegations. These distortions result in the unjust (...) exoneration of people we cannot conceive of as monstrous, while making it too easy to believe that some marginalized people could be rapists. I also argue that rape myths enable a novel kind of epistemic injustice. This injustice concerns how our assessments of trustworthiness and our assessments of plausibility interact. I argue that rape myths can result in runaway credibility deflations that can explain both why people fail to believe most women, and also why people may unjustly believe false allegations that white women have been raped by black men. This book argues that our success in navigating the social world depends heavily on scripts. Scripts play a central role in our ability to understand social interactions shaped by different contextual factors. -/- In philosophy of social cognition, scholars have asked what mechanisms we employ when interacting with other people or when cognizing about other people. Recent approaches acknowledge that social cognition and interaction depends heavily on contextual, cultural, and social factors that contribute to the way individuals make sense of (...) the social interactions they take part in. This book offers the first integrative account of scripts in social cognition and interaction. It argues that we need to make contextual factors and social identity central when trying to explain how social interaction works, and that this is possible via scripts. Additionally, scripts can help us understand bias and injustice in social interaction. The author’s approach combines several different areas of philosophy—– philosophy of mind, social epistemology, feminist philosophy—as well as sociology and psychology to show why paying attention to injustice in interaction is much needed in social cognition research, and in philosophy of mind more generally. -/- Scripts and Social Cognition: How we Interact with Others will appeal to scholars and graduate students working in philosophy of mind, philosophy of psychology, social epistemology, social ontology, sociology, and social psychology. Hermeneutical injustice is being unjustly prevented from making sense of one’s experiences, identity, or circumstances and/or communicating about them. The literature focusses almost exclusively on whether people have access to adequate conceptual resources. In this paper, we discuss a different kind of hermeneutical struggle caused by stigma. We argue that in some cases of hermeneutic injustice people have access to hermeneutical resources apt to understand their identity but reject employing these due to the stigma attached to the identity. We begin (...) with a reinterpretation of one of the cases discussed in the literature, Edmund White’s novel A Boy’s Own Story. We argue that in this case hermeneutic resources are available but are rejected due to the stigma attached to homosexuality. We then present two analogous kinds of cases: alcohol addiction and being the victim of intimate partner violence. Here, too, hermeneutic injustice occurs because of stigma attached to an identity rather than unavailability of resources. We close by suggesting that these cases may, additionally, involve the wrong of Tightlacing: by meddling with their self-conception, stigma can manipulate individuals into a view of themselves that licenses inappropriate demands on them and makes them complicit in an erasure of their identities. Our interpretive resources enable us to make sense of, navigate, and communicate about our shared world. These resources not only carve the world up into categories, but also guide how we, individually and collectively, are oriented towards it. In this thesis, I examine how these resources, and the dispositions they guide, may be harmful. A vital kind of interpretive resources are frames, which equip us with unified perspectives on the world. Perspectives are suites of open-ended interpretive (inquisitive, attentional, inferential, evaluative, (...) and affective) dispositions. Frames thereby guide how we interpret, respond to, and navigate the world. I show that these perspectives are epistemically powerful and indispensable. I argue that flawed perspectives, and the distorting frames that produce them, are deeply pernicious and I examine their relationship to oppression. (shrink)

An intuitive conception of objectivity involves an ideal of neutrality—if we’re to engage in objective inquiry, we must try to sideline our prejudices, values, and politics, lest these factors taint inquiry and unduly influence our results. This intuition underlies various “purist” epistemological frameworks, which grant epistemic significance only to “epistemic factors” like evidence or the truth of a belief. Feminist epistemologists typically condemn purist frameworks as inimical to feminist aims. They argue that purist epistemology is divorced from the ineliminably social (...) and value-laden nature of our epistemic practices, and, moreover, that it abstracts away precisely those features that are needed to explain how power shapes knowledge. As they see it, purist frameworks simply lack the conceptual space needed to ask the right kinds of questions. Thus, they go in for “impurist” frameworks, which grant epistemic significance to “non-epistemic” factors, and so shed the confining constraints of purism. I turn the tables on the impurists—where they have connected purist norms with perniciously disengaged epistemology, I connect impurist norms with a creeping anxiety that is diminishing feminist epistemology’s political possibilities. First, I demonstrate that it’s increasingly common for impurist epistemologists to use moral considerations as a means to bypass the evidence, which betrays a lack of faith that the evidence will bear out feminist commitments. Second, I demonstrate that there is needless pessimism about our capacity to understand, as evidenced by the increasingly widespread idea that privileged social positions place robust limits on what people can know about oppression that they don’t personally experience. In both cases, moral and political considerations are invoked to give the illusion of being socially engaged, while in fact they allow people to give up on the difficult project of figuring things out. An extended case study on rape culture illustrates the stakes of doing inquiry that is only superficially socially engaged; I show that the two anxious traps I’ve identified have prevented contemporary feminist theorists from detecting and rooting out racist distortion in their accounts of rape culture because both traps interfere with a genuinely intersectional approach to feminist theorizing. In the debate on epistemic injustice, it is generally assumed that testimonial injustice as one form of epistemic injustice cannot be committed (fully) deliberately or intentionally because it involves unconscious identity prejudices. Drawing on the case of sexual violence against refugees in European refugee camps, this paper argues that there is a form of testimonial injustice—willful testimonial injustice—that is deliberate. To do so, the paper argues (a) that the hearer intentionally utilizes negative identity prejudices for a particular purpose and (b) (...) that the hearer is aware of the fact that the intentionally used prejudices are in fact prejudices. Furthermore, the paper shows how testimonial injustice relates to recognition failures both in terms of a causal as well as a constitutive claim. In fact, introducing willful testimonial injustice can support the constitutive claim of such a relation that has so far received little attention. Besides arguing for a novel form of testimonial injustice and contributing to the recent debate on the relation between epistemic injustice and recognition failures, this paper is also motivated by the attempt to draw attention to the inhumane conditions for refugees at the border of Europe as well as elsewhere. Previously proposed strategies for tackling hermeneutical injustices take for granted the interests people have in certain things about them being intelligible to them and/or to others, and seek to enable them to satisfy these interests. Strategies of this sort I call interests-as-given strategies. I propose that some hermeneutical injustices can instead be tackled by doing away with certain of these interests, and so with the possibility of their unfair non-satisfaction. Strategies of this sort I call interests-in-question strategies. As a case (...) study in when such an interests-in-question strategy ought to be pursued, I look at how to tackle hermeneutical injustices arising in the context of gender-affirming healthcare as provided to adults by the National Health Service in the UK. I argue that considerations of trust, privacy, and respect all support pursuing such a strategy. One way to do so, I suggest, would be by replacing the existing gatekeeping model with an informed consent model for the provision of gender-affirming healthcare. Considerations of hermeneutical justice can hence be added to the already-impressive case for undertaking this shift. (shrink)

We are frequently confronted with moral situations that are unsettling, confusing, disorienting. We try to come to grips with them. When we do so, we engage in a distinctive type of moral inquiry: hermeneutical inquiry. Its aim is to make sense of our situation. What is it to make sense of one's situation? Hermeneutical inquiry is part of our everyday moral experience. Understanding its nature and its place in moral epistemology is important. Yet, I argue, that existing accounts of moral (...) inquiry do not give us the resources to do so. This paper develops a positive account of hermeneutical inquiry. I argue that when we engage in hermeneutical inquiry, we search for an apt perspective on our situation. (shrink)

The word “privilege” has become a part of our everyday conversations. However, it is not evident whether the various interlocutors in discussions on privilege are using it in the same sense. While different instances of privilege like white, male, or caste privilege have been discussed in contemporary academic discourses, we believe there is a lack of clarity regarding the notion of privilege. We critically analyse existing accounts of privilege to show that they leave some room for improvement. We offer an (...) alternative account of privilege as “entitlements that fail to track deserts” that circumvents prevalent definitional ambiguities and emphasises the inherent undeserving nature of privilege. The hitherto underexplored links between privileges, deserts, entitlements, and rights can help us formulate a more accurate grasp of privilege. (shrink)

The gray area of sexual violations generally refers to ambiguous sexual experiences that are not readily distinguishable from rape or sex. Such experiences are describable as ambiguous or complex in a way that, to some, seems to defy existent categories of sexual experiences. This leads some feminists to approach the gray area as a puzzle that must be resolved either by understanding it as a new category, or by upholding existing rape categorization. Rather than dispelling the gray-area ambiguity by resolving (...) conceptual puzzles, I assign the gray-area ambiguity a positive analytical role by attending to it in a historical and dialectical light. By tracing histories of feminist antirape discourse, I elaborate a way of understanding the “gray area” of sexual violations, articulating it as a historical condition affecting the interpretive possibilities of our sexual experiences. Such an approach underscores the potential of the gray area to inaugurate feminist critique in virtue of its status as a historically specific yet ambiguous horizon where our experiences can contradictorily seem not-like rape, but not-like sex. We argue that stereotypes associated with concepts like he-said–she-said, conspiracy theory, sexual harassment, and those expressed by paradigmatic slurs provide “normative inference tickets”: conceptual permissions to automatic, largely unreflective normative conclusions. These “mental shortcuts” are underwritten by associated stereotypes. Because stereotypes admit of exceptions, normative inference tickets are highly flexible and productive, but also liable to create serious epistemic and moral harms. Epistemically, many are unreliable, yielding false beliefs which resist counterexample; morally, many perpetuate bigotry and oppression. Still, some normative (...) inference tickets, like some activated by sexual harassment, constitute genuine moral and hermeneutical advances. For example, our framework helps explain Miranda Fricker’s notion of “hermeneutical lacunae”: what early victims of “sexual harassment” — as well as their harassers — lacked before the term was coined was a communal normative inference ticket — one that could take us, collectively, from “this is happening” to “this is wrong.”. Content note: This paper discusses rape throughout.Abstract. In this paper, I consider arguments in favor of jury trials. While I find these generally persuasive, I argue that there can be cases where juries are not fit for purpose. In those cases, I argue that they should be replaced by judge-only trials. In doing so, I propose a framework for determining whether a type of case is unsuitable for jury trials. Partly in response to low conviction rates, there have been recent (...) suggestions that rape trials should be conducted without juries. I suggest that there is strong evidence that these offences qualify under the criteria I have described. As a result, I argue that judge-only trials should be adopted for trying rape cases. (shrink)

Cultural code-switching concerns how we adjust our overall behaviours, manners of speaking, and appearance in response to a perceived change in our social environment. We defend the need to investigate cultural code-switching capacities in artificial intelligence systems. We explore a series of ethical and epistemic issues that arise when bringing cultural code-switching to bear on artificial intelligence. Building upon Dotson’s (2014) analysis of testimonial smothering, we discuss how emerging technologies in AI can give rise to epistemic oppression, and specifically, a (...) form of self-silencing that we call “cultural smothering.” By leaving the sociodynamic features of cultural code-switching unaddressed, AI systems risk negatively impacting already-marginalised social groups by widening opportunity gaps and further entrenching social inequalities. Although the idea that sexual violence is a “structural” problem is not new, the lack of specification as to what that entails blocks effective responses to it. This paper illustrates the concept of sexual violence as structural in the sense of containing a type of moral wrong called “structural wrong” and discusses its practical implications. First, I introduce a distinction between two types of moral wrongs—interactional wrongs and structural wrongs—and I argue that the moral problem of sexual violence includes both (...) types, each of which calls for a different set of moral responses. Second, drawing on Iris Marion Young’s social connection model of responsibility, I argue that recognizing the structural-wrong element of sexual violence does not reduce individual perpetrators’ responsibility for it. Instead, it implies that a broader group of agents are required to join collective actions to reform the social structure. I conclude by evaluating some preventive programs against sexual violence through the lens of structural wrongs and providing directions to advance them. (shrink)

This paper aims to consider some semantic aspects of the phenomenon of hermeneutical injustice overlooked in recent literature. First, we examine different cases of hermeneutical injustices and we propose to classify them according to their semantic structure. The core of this classification lies in the distinction between cases related to problems of content and cases related to problems of circulation of social concepts. Second, we criticize a semantic conception, implicit in much of the literature concern- ing hermeneutical injustice, according to (...) which concepts are mere labels. We show that this conception cannot provide an adequate understanding of the different cases of hermeneutical injustice that we identify: first, because it fails to capture the dynamics of conceptual change or refinement that these cases involve and, second, because it leads to diagnosing them as mere problems of concept application. Genocide remembrance is a complex epistemological/ethical achievement, whereby survivors and descendants give meaning to the past in the quest for both personal-historical and social-historical truth. This paper offers an argument of epistemic injustice specifically as it occurs in relation to practices of (individual and collective) genocide remembrance. In particular, I argue that under conditions of genocide denialism, understood as collective genocide misremembrance and memory distortion, genocide survivors and descendants are confronted with hermeneutical oppression. Drawing on Sue Campbell’s relational, reconstructive account (...) of remembering, I argue that genocide denialism involves disrespectful challenges to memory, which systematically misrecognize rememberers. Adopting the case of Turkey’s denialism of the Armenian genocide, I discuss two interrelated mechanisms through which this can happen: i) through the systematic portrayal of survivors and descendants as vicious rememberers, and ii) through distortions of the very concept of ‘genocide’. Based on this, I show how hermeneutical and testimonial injustice are crucially interrelated when it comes to “contested” memories of historical injustice and the biographical testimony it gives rise to. ABSTRACT Testimony from victims of gendered violence is often wrongly disbelieved. This paper explores a way to address this problem by developing a phenomenological approach to testimony. Guided by the concept of ‘disclosedness’, a tripartite analysis of testimony as an affective, embodied, communicative act is developed. Affect indicates how scepticism may arise through the social moods that often attune agents to victims’ testimony. The embodiment of meaning suggests testimony should not be approached as an assertion, but as a process of (...) ‘articulating an understanding’. This account is deepened in the discussion of testimony as a communicative act. It is argued that testimony must be considered as a relational whole, and thus our aim in receiving victims’ testimony should be to honour the relational conditions under which the truth of testimony can be heard. Approaching testimony as the collaborative process of enabling an understanding to be articulated can enhance our conception of gendered violence, whilst also better serving the victims of gendered violence by helping to overcome the lack of trust and excessive scepticism with which victims’ testimony is often met. Two decades ago, Tarana Burke started using the phrase ‘me too’ to release victims of sexual abuse and rape from their shame and to empower girls from minority communities. In 2017, actress Alyssa Milano made the hashtag #MeToo go viral. This article’s concern is with the role of testimonial practices in the context of sexual violence. While many feminists have claimed that the word of those who claim to (...) being sexually violated by others have political and/or epistemic priority, others have failed to recognize the harm and injury of instances of sexual violence that are not yet acknowledged as such and failed to listen to victims from marginalized social groups. In fact, some feminists have attacked #MeToo for mingling accounts of ‘proper’ sexual violence and accounts that are not ‘proper’ experiences of sexual violence. My aim in this article is to show why this critique is problematic and find a philosophically fruitful way to understand the #MeToo-movement as a movement that strives for moral and conceptual progress. Often, when we are angry, we are angry at someone who has hurt us, and our anger is a protest against our perceived mistreatment. In these cases, its function is to hold the abuser accountable for their offense. The anger involves a demand for some sort of change or response: that the hurt be acknowledged, that the relationship be repaired, that the offending party reform in some way. In this paper, I develop and defend an account of a different form (...) of anger, called "outrage anger". Outrage anger does not aim to hold an abuser accountable, nor to demand repair or reform. Drawing on the work of Maria Lugones, I argue that outrage anger is directed at the state of affairs in which a violation is unintelligible to the dominant moral community. The central function of outrage anger is a psychological boundary setting: it closes off the victim’s ability to feel empathy for their abuser. Outrage has an important role to play in the context of political injustice, but that it also comes with significant costs. (shrink)

In their well-known paper, John Gardner and Stephen Shute (2000) propose a pure case of rape, in which a woman is raped while unconscious and the rape, for a variety of stipulated reasons, never comes to light. This makes the pure case a harmless case of rape, or so they argue. In this paper I show that their argument hinges on an outdated conception of trauma, one which conflates evaluative responses that arise in the aftermath of rape with the non-deliberative (...) somatic responses of a central nervous system to a threatening event. In the first part of this paper, I elaborate this objection by drawing on the neurobiological model of trauma. This gives me an opportunity to illustrate the different ways that rape harms its victims, including the central way, what I call ‘threat-circuitry harm.’ This discussion of trauma invites us to rethink the wrong of rape, and sets the groundwork for my argument, in the second part of the paper, that the wrong of rape consists in its central harm. This article develops a new approach for theorizing about hermeneutical injustice. According to a dominant view, hermeneutical injustice results from a hermeneutical gap: one lacks the conceptual tools needed to make sense of, or to communicate, important social experience, where this lack is a result of an injustice in the background social methods used to determine hermeneutical resources. I argue that this approach is incomplete. It fails to capture an important species of hermeneutical injustice which doesn’t result from a lack (...) of hermeneutical resources, but from the overabundance of distorting and oppressive concepts which function to crowd-out, defeat, or preempt the application of a more accurate hermeneutical resource. I propose a broader analysis that better respects the dynamic relationship between hermeneutical resources and the social and political contexts in which they are implemented. (shrink)

I argue that patients who suffer genital surgery to ‘disambiguate’ their sexual anatomy, a practice labelled ‘intersex genital mutilation’ (IGM) by intersex advocates, can be understood as victims of hermeneutical injustice in the sense elaborated by Miranda Fricker. This claim is clarified and defended from two objections. I further argue that a particular subset of cases of IGM-based hermeneutical injustice instantiate a novel form of hermeneutical injustice, which I call deception-based hermeneutical injustice. In cases of complicity in one’s own unfreedom and in structural injustice, it initially appears that agents are only vicariously responsible for their complicity because of the roles circumstantial and constitutive luck play in bringing about their complicity. By drawing on work from the phenomenological tradition, this paper rejects this conclusion and argues for a new responsive sense of agency and responsibility in cases of complicity. Highlighting the explanatory role of stubbornness in cases of complicity, it is argued that although (...) agents may only be vicariously responsible for becoming complicit, they can be held more directly responsible for entrenching their complicity. The complicit agent is responsible for their complicity to the extent that they fail to take responsibility for it. (shrink)

Our autonomy can be compromised by limitations in our capacities, or by the power relationships within which we are embedded. If we insist that real consent requires full autonomy, then virtually no sex will turn out to be consensual. I argue that under conditions of compromised autonomy, consent must be socially and interpersonally scaffolded. To understand consent as an ethically crucial but nonideal concept, we need to think about how it is related to other requirements for ethical sex, such as (...) the ability to exit a situation, trust, safety, broader social support, epistemic standing in the community, and more. It is widely accepted that consent is a normative power. For instance, consent can make an impermissible act permissible. In the words of Heidi Hurd, it “turns a trespass into a dinner party... an invasion of privacy into an intimate moment.” In this chapter, I argue against the assumption that consent has such robust powers for moral transformation. In particular, I argue that there is a wide range of sex that harms or wrongs victims despite being consensual. Moreover, these cases (...) are not limited to those where con- sent is vitiated by background conditions. I start by calling this category of consensual sex Bad Sex. I then distinguish subspecies of this category, including psychological pressure, social coercion, and epistemically unsafe sex. I end by responding to an objection on which we should treat at least some subspecies of Bad Sex as rape. Though this alternative proposal is often motivated by ameliorative and strategic considerations, I argue that such considerations actually count against collapsing the categories of Bad Sex and rape. In this introduction to the special issue ‘Epistemic Injustice and Collective Wrongdoing,’ we show how the eight contributions examine the collective dimensions of epistemic injustice. First, we contextualize the articles within theories of epistemic injustice. Second, we provide an overview of the eight articles by highlighting three central topics addressed by them: i) the effects of epistemic injustice and collective wrongdoing, ii) the underlying epistemic structures in collective wrongdoing, unjust relations and unjust societies, and iii) the remedies and strategies of (...) resistance to epistemic injustice. We close by pointing to connections and issues that may motivate further research. (shrink)

The main aim of this paper is to investigate how sexist ideology distorts our conceptions of sexual violence and the hermeneutical gaps such an ideology yields. I propose that we can understand the problematic issue of hermeneutical gaps about sexual violence with the help of Fricker’s theory of hermeneutical injustice. By distinguishing between hermeneutical injustice and hermeneutical misfire, we can distinguish between the hermeneutical gap and its consequences for the victim of sexual violence and those of the perpetrator of such (...) violence. I then argue that perpetrators are both morally responsible and accountable for their acts, even if they are the result of a hermeneutical misfire. Ultimately, I show that with regard to sexual violence, we should opt for accountability to change the behaviour of the perpetrator and the social structure. Miranda Fricker's original presentation of Hermeneutical Injustice left open theoretical choice points leading to criticisms and subsequent clarifications with the resulting dialectic appearing largely verbal. The absence of perspicuous exposition of hallmarks of Hermeneutical Injustice might suggest scenarios exhibiting some – but not all – such hallmarks are within its purview when they are not. The lack of clear hallmarks of Hermeneutical Injustice, moreover, obscures both the extent to which Fricker's proposed remedy Hermeneutical Justice – roughly, virtuous communicative practices – (...) adequately addresses the injustice, and the accuracy of criticisms suggesting that Hermeneutical Justice is insufficient to the task. In what follows, after briefly defending necessary and sufficient conditions for what I take to be the best candidate interpretation of Hermeneutical Injustice, I build on recent work on moral responsibility to construct and defend a rigorous explication of Hermeneutical Justice. Miranda Fricker’s account of hermeneutical injustice and remedies for this injustice are widely debated. This article adds to the existing debate by arguing that theories of recog- nition can fruitfully contribute to Fricker’s account of hermeneutical injustice and can provide a framework for structural remedy. By pairing Fricker’s theory of hermeneutical injustice with theories of recognition, I bring forward a modest claim and a more radical claim. The first concerns a shift in our vocabulary; recognition theory can give a name (...) to the seriousness of the long-term effects of hermeneutical injustice. The second claim is more radical: thinking of hermeneutical injustice as preventing what I call “self-recogni- tion” provides a structural remedy to the phenomenon of hermeneutical injustice. Because hermeneutical injustice is first and foremost a structural injustice, I contend that every virtue theory of hermeneutical justice should be complemented by structural remedies in terms of recognition. Finally, what I argue sheds light on the seriousness of cases of exclusion of and discrimination against women in academia and helps to draw our attention to new ways to combat such problems. Congdon (2017), Giladi (2018), and McConkey (2004) challenge feminist epistemologists and recognition theorists to come together to analyze epistemic injustice. I take up this challenge by highlighting the failure of recognition in cases of testimonial and hermeneutical injustice experienced by victims of sexual harassment and sexual assault. I offer the #MeToo movement as a case study to demonstrate how the process of mutual recognition makes visible and helps overcome the epistemic injustice suffered by victims of sexual harassment and sexual assault. I argue that in declaring “me too,” the epistemic subject emerges in the context of a polyphonic symphony of victims claiming their status as agents who are able to make sense of their own social experiences and able to convey their knowledge to others. This volume has its roots in two recent developments within mainstream analytic epistemology: a growing recognition over the past two or three decades of the active and social nature of our epistemic lives; and, more recently still, the increasing appreciation of the various ways in which the epistemic practices of individuals and societies can, and often do, go wrong. The theoretical analysis of these breakdowns in epistemic practice, along with the various harms and wrongs that follow as a consequence, constitutes (...) an approach to epistemology that we refer to as non-ideal epistemology. In this introductory chapter we introduce and contextualise the ten essays that comprise this volume, situating them within four broad sub-fields: vice epistemology, epistemic injustice, inter-personal epistemic practices, and applied epistemology. We also provide a brief overview of several other important growth areas in non-ideal epistemology. (shrink)

Under current UK legislation, only a man can commit rape. This paper argues that this is an unjustified double standard that reinforces problematic gendered stereotypes about male and female sexuality. I first reject three potential justifications for making penile penetration a condition of rape: it is physically impossible for a woman to rape a man; it is a more serious offence to forcibly penetrate someone than to force them to penetrate you; rape is a gendered crime. I argue that, as (...) these justifications fail, a woman having sex with a man without his consent ought to be considered rape. I then explain some further reasons that this matters. I argue that, not only is it unjust, it is also both a cause and a consequence of harmful stereotypes and prejudices about male and female sexuality: men are ‘always up for sex’; women’s sexual purity is more important than men’s; sex is something men do to women. Therefore, I suggest that, if rape law were made gender neutral, these stereotypes would be undermined and this might make some difference to the problematic ways that sexual relations are sometimes viewed between men and women more generally. This paper begins with the idea that there are sometimes gaps in our shared linguistic/ conceptual resources that make it difficult for us to understand our own social experiences, and to make them intelligible to others. In this paper, I focus on three cases of this sort, some of which are drawn from the literature on hermeneutical injustice. I offer a diagnosis of what the gaps in these cases consist in, and what it takes to fill them. I argue that (...) these gaps are filled in, at least initially, by labels of a particular kind. Specifically, these are labels that allow us to see the experiences in question as novel instances of phenomena with which we are already normatively familiar. Further, I also show that these labels bring with them important downsides: they introduce distortions into our understandings of these experiences. Using a pair of case studies (‘statutory rape,’ ‘sexual harassment’), I illustrate these distortions. (shrink)

Increasingly, metaphors are the target of political critique: Jewish groups condemn Holocaust imagery; mental health organizations, the metaphorical exploitation of psychosis; and feminists, “rape metaphors.” I develop a novel model for making sense of such critiques of metaphor.

In this review essay, I critically evaluate the concept of autonomy and the role that it plays in the philosophy of sex and love in Patricia Marino’s book, Philosophy of Sex and Love: An Opinionated Introduction.

The paper applies the theoretical frameworks of epistemic injustice and narrativist philosophy of history to read the process of re-signification of an event that took place in a prison in the city of Buenos Aires, Argentina, in 1978, called “Massacre in the Seventh Ward” or “Mutiny of the Mattresses”. By looking into this case, we explore the exercise of epistemic resistance through category expansion, drawing on the most recent developments on hermeneutical injustice as a deficiency in the application (and not (...) only in the content) of the available concepts. This allows us to identify the selected case as an example of hermeneutical injustice, and to highlight some characteristics of such injustice that remain under-analysed in the specialised literature, linked to agency, temporality, and the concrete forms adopted by resistance. Among the latter, we highlight the role that can be played by the exercise of what in philosophy of history has been called the “practical past”: an intervention in the dispute of meanings about the past, born out of an explicit commitment to the present. Finally, the conclusions present some caveats to be considered in the study of epistemic injustice in the context of institutions such as prisons. (shrink)

The narratives we have about ourselves are important for our sense of who we are. However, our narratives are influenced, even manipulated, by the people and environments we interact with, impacting our self-understanding. This can lead to narratives that are limited, even harmful. In this paper, I explore how our narrative agency is constrained, to greater and lesser degrees, through a process I call ‘narrative railroading’. Bringing together work on narratives and 4E cognition, I specifically explore how using features of (...) our socio-material environments to support and construct our narratives does not simply offer up possibilities for creating more reliable and accurate self-narratives (Heersmink 2020 ) but can lead to increasingly tight narrative railroading. To illustrate this idea, I analyse how digital technologies do not neutrally distribute our narratives but dynamically shape and mould narrative agency in ways that can restrict our self-understanding, with potentially harmful consequences. As such, I argue that we need to recognise that digital devices not only support narratives but work as powerful narrative devices, shaping and propagating the kinds of narratives that we self-ascribe and act in accordance with. This article analyses how child victims of abuse may be subjected to hermeneutical injustice. I start by explaining how child victims are hermeneutically marginalised by adults’ social and epistemic authority, and the stigma around child abuse. In understanding their abuse, I highlight two epistemic obstacles child victims may face: (i) lack of access to concepts of child abuse, thereby causing victims not to know what abuse is; and (ii) myths of child abuse causing misunderstandings of abuse. When these epistemic obstacles (...) cause the child victims to fail to see themselves as being abused and/or to get adults to recognise that they are being abused, I argue that this constitutes hermeneutical injustice. While some may justify obstructing epistemic access to concepts of abuse on the grounds of parental rights and protection of children’s innocence, I reply that both grounds are unjust in light of children’s basic rights and the fact that children can easily be taught such concepts in a child-appropriate manner. The case of child abuse prompts important reflections on existing epistemic injustice literature, particularly on the ways in which hermeneutical injustice materialises, the epistemic responsibilities of institutional bodies and individuals, and the interrelationship between testimonial and hermeneutical injustice. This article revisits Miranda Fricker’s Epistemic Injustice through one specific aspect of Axel Honneth’s recognition theory. Taking a first cue from Honneth’s critique of the limitations of the “language-theoretic framework” in Habermas’ discourse ethics, it floats the idea that the two categories of Fricker’s groundbreaking analysis—testimonial and hermeneutical injustice—likewise lean towards a speech-based metric. If we accept, however, that there are also implicit, preverbal, affective, and embodied ways of knowing and channels of knowledge transmission, this warrants an expansion of Fricker’s (...) original concept. By drawing on Honneth’s recognition theory, I argue it is possible to extend the account of epistemic injustice beyond Fricker’s two central categories, to glimpse yet another register of serious “wrong done to someone specifically in their capacity as a knower.” I define this harm as prediscursive epistemic injury and offer two central cases to illustrate this additional form of epistemic injustice. In this paper, I aim to shed some light on what rape myths are and what we can do about them. I start by giving a brief overview of some common rape myths. I then use two philosophical tools to offer a perspective on rape myths. First, I show that we can usefully see rape myths as an example of what Miranda Fricker has termed ‘epistemic injustice’, which is a type of wrong that concerns our role as knowers. Then, I (...) show that it is important to recognise that rape myths are instances of misogyny. This word is of course a more familiar one, but I'll be drawing on a specific philosophical account of what misogyny is, developed by Kate Manne, that I think is useful here. In this paper, I use the example of rape myths to argue that certain real-life phenomena compel us to adjust our philosophical methods such that we explicitly endorse feminist commitments and strive for democratic practices in our philosophical thinking. The concept of rape has evolved significantly over the past few decades both in law and common usage. But despite decades of work to dispel rape myths, they persist and interfere with the proper application of the concept. This paper aims to (...) account for this problem and propose a solution. First, I consider three examples that show how rape myths and other problematic schemas can distort our dominant working understanding of phenomena. All three examples are cases of grave injustices to the victims. I suggest that a revisionary project of conceptual amelioration can help counter injustices like these. In a second step, I argue that problematic schemas (such as rape myths) not only distort our working understanding or the accurate application of an existing concept, but can furthermore interfere with our philosophical analyses—even in cases of amelioration. As a solution, taking clues from theories of epistemologies of ignorance, I propose a more democratic and progressive method for engaging in conceptual amelioration. (shrink)

In this paper, we have two goals. First, we argue for a blueprint for hermeneutical injustice that allows us to schematize existing and discover new varieties of hermeneutical injustices. The underlying insight is that Fricker provides both a general concept of hermeneutical injustice and a specific conception thereof. By distinguishing between the general concept and its specific conceptions, we gain a fruitful tool to detect such injustices in our everyday lives. Second, we use this blueprint to provide a further example (...) of hermeneutical injustice that draws our attention to yet another distinction: Some hermeneutical injustices result from a lack or distortion in the collective conceptual resource and some are due to problems in the application of existing concepts. We argue that to combat hermeneutical injustices, we have to make sure not only that individuals have accurate concepts at their disposal but that they have the capabilities to use these concepts adequately. According to Miranda Fricker, being hindered from rendering something significant about oneself intelligible to someone constitutes a hermeneutical injustice only if it results from the hermeneutical marginalization of some group to which one belongs. A major problem for Fricker’s picture is that it cannot properly account for the paradigm case of hermeneutical injustice Fricker herself takes from Ian McEwan’s novel Enduring Love. In order to account properly for this case, I argue that being hindered from rendering something significant about oneself (...) intelligible to someone can constitute a hermeneutical injustice so long as it results from the hermeneutical marginalization of some group - whether or not one belongs to that group. One upshot is that Fricker’s distinction between systematic and incidental cases of hermeneutical injustice needs redrawing, and I show how this can be done. Another is that hermeneutical injustice is more widespread than Fricker recognizes. (shrink)

On Miranda Fricker’s influential account, the central case of testimonial injustice occurs if and only if the speaker receives a credibility deficit owing to identity prejudice of the hearer. Her critics have taken issue with her view, arguing that cases in which speakers are given more credibility than they deserve, may also amount to testimonial injustice. Furthermore, they argue, these cases cannot be captured by Fricker’s account of objectification as the primary epistemic harm of testimonial injustice; rather, it is an (...) account of othering that best captures a wide range of epistemic injustices. In this paper, I join Fricker’s critics in advancing a novel case of testimonial injustice through identity-prejudicial credibility excess – the adultification of black girls in testimony-giving settings. When testifying, black girls are likely to receive a credibility excess with respect to adult topics such as sex and consent because they are perceived as older, more self-reliable, and mature than they actually are by the hearers. Nevertheless, when examining the girls’ intersecting social identities defined by age, race and gender, it becomes clear that this constitutes an unjustly and prejudicially inflated estimation of their credibility. These cases also involve hermeneutical injustice since the identity-prejudicial credibility excess denies the victims a meaningful opportunity to make sense of their traumatic experiences of sexual assault. I conceptualize this compounded injustice as testimonial obfuscation, where an identity-prejudicial credibility evaluation (either in excess or deficit) causes an experience to remain unintelligible to the hermeneutically marginalized speaker.
