In this article I am concerned with analogical reasoning in ethics. There is no doubt that the use of analogy can be a powerful tool in our ethical reasoning. The importance of this mode of reasoning is therefore commonly accepted, but there is considerable debate concerning how its structure should be understood and how it should be assessed, both logically and epistemically. In this paper, I first explain the basic structure of arguments from analogy in ethics. I then discuss the (...) diversity of analogical arguments that can be found in ethics. I analyse their structure, assess them from a logical viewpoint, and show how they can be epistemically challenged and defended. The result of this investigation is that, contrary to a commonly held view, analogical reasoning can be a logically valid type of ethical reasoning that can provide reasons for action that are not worse than the reasons provided by any other kind of practical reasoning. Teaching has been analyzed as a dialogue aimed at persuading the interlocutors, introducing a conceptual change that needs to be grounded on the audience’s background knowledge. This paper addresses this issue from a perspective of argumentation studies. Our claim is that argumentation schemes, namely abstract patterns of argument, can be an instrument for reconstructing the tacit premises in students’ argumentative (...) reasoning and retrieving the background beliefs that are the basis of their arguments. On this perspective, the process of premise reconstruction is followed by a heuristic reasoning process aimed at discovering the students’ previous intuitions that can explain the premises and concepts that are left unexpressed in their arguments. The theoretical insights advanced in this paper are illustrated through selected examples taken from activities concerning predictive claims on scientific issues. (shrink)

This paper discusses the method when an argument is refuted by a parallel argument since the flaw of the parallel argument is clearly displayed. The method is explicated, examined and compared with two other general methods.

Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. By clarifying the distinction between argument from example and argument from analogy, it is possible to advance a useful proposal for the treatment of argument from analogy in law. (shrink)

This paper explains the importance of classifying argumentation schemes, and outlines how schemes are being used in current research in artificial intelligence and computational linguistics on argument mining. It provides a survey of the literature on scheme classification. What are so far generally taken to represent a set of the most widely useful defeasible argumentation schemes are surveyed and explained systematically, including some that are difficult to classify. A new classification system covering these centrally important schemes is built.

Analogical reasoning projects a property taken to hold of something or things (the source) to something else (the target) on the basis of just those similarities premised in the analogy. Standard similarity-based accounts of analogical reasoning face the question: Under what conditions does a collection of similarities sufficiently warrant analogical projection? One answer is: When a thing’s having the premised similarities somehow determines its having the projected property. Standardly, this answer has been interpreted as claiming that a formally defined determination (...) relation exists between the variables of which the determining properties are values and the variable of which the determined property is a value. This paper supplies another answer: Analogical projection is warranted when an item’s having the projected property is grounded in its having the premised similarities. Drawing on the metaphysics of grounding, we propose a model of grounded analogy on which analogical reasoning is valid under metaphysical necessity. Our model thus provides one answer to John Stuart Mill’s question of how analogical reasoning based on limited information about a single source case can provide an indefeasible justification for analogical projection. Once a relation of total grounding is ascertained to hold between some similarities and the projected property, no other properties bear on the projectability of the projected property from the source to the target. The reasoning process of analogy is characterized by a strict interdependence between a process of abstraction of a common feature and the transfer of an attribute of the Analogue to the Primary Subject. The first reasoning step is regarded as an abstraction of a generic characteristic that is relevant for the attribution of the predicate. The abstracted feature can be considered from a logic-semantic perspective as a functional genus, in the sense that it is contextually essential for the attribution of (...) the predicate, i.e. that is pragmatically fundamental (i.e. relevant) for the predica-tion, or rather the achievement of the communicative intention. While the transfer of the predicate from the Analogue to the analogical genus and from the genus to the Primary Subject is guaranteed by the maxims (or rules of inference) governing the genus-species relation, the connection between the genus and the predicate can be complex, characterized by various types of reasoning patterns. The relevance relation can hide implicit arguments, such as an implicit argument from classification , an evaluation based on values, consequences or rules, a causal relation, or an argument from practical reasoning. The purpose of this paper is to analyze the structure and the defeasibility conditions of argument from analogy, addressing the issues of determining the nature of the comparison underlying the analogy and the types of inferences justifying the conclusion. In the dialectical tradition, different forms of similarity were distinguished and related to the possible inferences that can be drawn from them. The kinds of similarity can be divided into four categories, depending on whether they represent fundamental semantic features of the (...) terms of the comparison or non-semantic ones, indicating possible characteristics of the referents. Such distinct types of similarity characterize different kinds of analogical arguments, all based on a similar general structure, in which a common genus is abstracted. Depending on the nature of the abstracted common feature, different rules of inference will apply, guaranteeing the attribution of the analogical predicate to the genus and to the primary subject. This analysis of similarity and the relationship thereof with the rules of inference allows a deeper investigation of the defeasibility conditions. (shrink)

It is a common view that arguments from analogy can only be evaluated on a case-by-case basis. However, while this reflects an important insight, I propose instead a relatively simple method for their evaluation based on just (i) their general form and (ii) four core questions. One clear advantage of this proposal is that it does not depend on any substantial (and controversial) view of similarity, unlike influential current alternative methods, such as Walton’s. Following some initial clarification of the notion (...) of analogy and similarity, I demonstrate the strength of this method by analysing and evaluating three prominent arguments from analogy. The representation and classification of the structure of natural arguments has been one of the most important aspects of Aristotelian and medieval dialectical and rhetorical theories. This traditional approach is represented nowadays in models of argumentation schemes. The purpose of this article is to show how arguments are characterized by a complex combination of two levels of abstraction, namely, semantic relations and types of reasoning, and to provide an effective and comprehensive classification system for this matrix of semantic and quasilogical (...) connections. To this purpose, we propose a dichotomous criterion of classification, transcending both levels of abstraction and representing not what an argument is but how it is understood and interpreted. The schemes are grouped according to an end-means criterion, which is strictly bound to the ontological structure of the conclusion and the premises. On this view, a scheme can be selected according to the intended or reconstructed purpose of an argument and the possible strategies that can be used to achieve it. (shrink)

Work on analogy has been done from a number of disciplinary perspectives throughout the history of Western thought. This work is a multidisciplinary guide to theorizing about analogy. Argument by analogy has long been regarded as the characteristic way of arguing in ancient Chinese culture. Classic Chinese philosophers not only prefer to use analogy to argue for their own views, but also take efforts to theorize it in a systematic way. This paper aims to provide a careful study on the relevant ideas in ancient China in order to reconstruct the ancient Chinese theory of argument by analogy, and then to reveal some of its distinctive features through a (...) comparison with the Western counterpart account as developed by Aristotle. It is indicated that in ancient China analogical argument was conceived primarily as a way of arguing based on classification, with a unique mechanism of taking and giving according to kind. On that basis, it is argued that although such a characterization captures the logical structure of analogical argument in a similar way to Aristotle, the ancient Chinese theory stresses the foundational role of a particular notion of kind, thus makes the construction and application of analogical arguments become highly flexible and context-sensitive. Moreover, it is also contended that in ancient China the rationale of analogical arguments is explained from a general perspective of kind, relying upon the universal knowledge pertaining to the forming of kinds. Then it is further revealed that, unlike Aristotle who emphasizes the causal links between attributes in the physical world, ancient Chinese thinkers justify analogical argument by appealing to some normative metaphysical and epistemological principles. This paper investigates the process of reasoning through which a judge determines whether a precedent-case gives her a binding reason to follow in her present-case. I review the objections that have been raised against the two main accounts of reasoning by precedent: the rule-account and the analogy-account. I argue that both accounts can be made viable by amending them to meet the objections. Nonetheless, I believe that there is an argument for preferring accounts that integrate analogical reasoning: any account of (...) reasoning by precedent that is descriptively minimally adequate will leave some room for judicial discretion. Discretion should be used under consideration of the best legally relevant arguments for and against a decision. Integrating analogical reasoning helps the judge to bring to her own attention the strongest case for following. Analogical reasoning also eases the recognition of possible reasons for distinguishing. Thereby, it facilitates a more balanced decision-making process. (shrink)

This work investigates intuitions' nature, demonstrating how philosophers can best use them in epistemology. First, the author considers several paradigmatic thought experiments in epistemology that depict the appeal to intuition. He then argues that the nature of thought experiment-generated intuitions is not best explained by an a priori Platonism. Second, the book instead develops and argues for a thin conception of epistemic intuitions. The account maintains that intuition is neither a priori nor a posteriori but multi-dimensional. It is an intentional (...) but non-propositional mental state that is also non-conceptual and non-phenomenal in nature. Moreover, this state is individuated by its progenitor, namely, the relevant thought experiment. Third, the author provides an argument for the evidential status of intuitions based on the correct account of the nature of epistemic intuition. The suggestion is the fitting-ness approach: intuition alone has no epistemic status. Rather, intuition has evidentiary value as long as it fits well with other pieces into a whole, namely, the pertinent thought experiment. Finally, the book addresses the key challenges raised by supporters of anti-centrality, according to which philosophers do not regard intuition as central evidence in philosophy. To that end, the author responds to them, showing that they fail to affect the account of intuition developed in this book. This text appeals to students and researchers working in epistemology. In this article I defend what I call a ‘particularist approach to arguments by analogy.’ Particularism is opposed to generalism, which is the thesis that arguments by analogy require a universal principle that covers cases compared and guarantees the conclusion. Particularism rejects this claim and holds that arguments by analogy operate on particular cases. I elaborate on two ideas that support this position. On the one hand, I contend that an analogy can be seen as a parallelism of argumentative relationships, (...) drawing on the distinction between similarity and analogy (Gentner 1983) and on the meta-argumentative account of arguments by analogy (Woods and Hudak 1989). On the other hand, I argue that universal principles are not necessary neither for the analysis nor the evaluation of arguments by analogy (Govier 1989) and that, rather than being a requirement, they can be seen as by-products of good analogies. Myšlenkové experimenty jsou populárním argumentačním nástrojem ve vědě i filosofii. Jejich kritika ze strany naturalistických a experimentálních filosofů vedla k vytvoření deflačních a minimalistických koncepcí, které oslabují epistemickou sílu myšlenkových experimentů a smiřují je s empirismem. Cílem článku je ukázat, že tyto pokusy nepřekonávají hlavní problémy, se kterými se myšlenkové experimenty ve filosofii střetávají. Omezená lidská racionalita a představivost znemožňují experimentátorům řešit nereálné scénáře spolehlivým způsobem. Myšlenkové experimenty se ve filosofii používají jinak než ve vědě, protože ty pravé jsou obvykle (...) neuskutečnitelné a uzavřené vůči možnosti empirické falsifikace. Navíc jsou založeny na vadných analogiích a neoprávněně přenášejí důkazní břemeno. Persvazivní úspěšnost myšlenkových experimentů je velmi nízká, a proto nedokáží přispět k řešení filosofických problémů. Závěrem článku je, že nejběžnější druhy myšlenkových experimentů by měly být odstraněny ze souboru filosofických metod. (shrink)

I offer an account of _a fortiori_ arguments in the context of a Toulmin-style theory of argumentation schemes. _A fortiori_ arguments contain a comparison of the strength of two or more arguments involving scalar inferences. We can distinguish two kinds of _a fortiori_ arguments depending on whether those scalar inferences connect the premises and the conclusion or the backing and the warrant of the arguments. The first pattern has been studied by rhetoricians and the second pattern by legal argumentation theorists.

In a recent paper, Jakob Hohwy argues that the emerging predictive processing perspective on cognition requires us to explain cognitive functioning in purely internalistic and neurocentric terms. The purpose of the present paper is to challenge the view that PP entails a wholesale rejection of positions that are interested in the embodied, embedded, extended, or enactive dimensions of cognitive processes. I will argue that Hohwy’s argument from analogy, which forces an evidentiary boundary into the picture, lacks the argumentative resources to (...) make a convincing case for the conceptual necessity to interpret PP in solely internalistic terms. For this reason, I will reconsider the postulation and explanatory role of the evidentiary boundary. I will arrive at an account of prediction error minimization and its foundation on the free energy principle that is fully consistent with approaches to cognition that emphasize the embodied and interactive properties of cognitive processes. This gives rise to the suggestion that explanatory pluralism about the application of PP is to be preferred over Hohwy’s explanatory monism that follows from his internalistic and neurocentric view of predictive cognitive systems. The nosological diagnosis is a particular type of nontheoretical diagnosis consisting of identifying the disease that afflicts the patient without explaining the underlying etiopathological mechanisms. Its origins are within the essentialist point of view on the nature of diseases, which dates back at least to 18th-century taxonomy studies. In this article, we propose a model of nosological diagnosis as a two-phase process composed of the categorization of inductive inferences and argumentations by analogy. In the inductive phase, disease entities are identified (...) by means of typicality-based categorization processes, and meaningful clinical samples are learned (abstract clinical cases, i.e., syndromes and actual cases); in the subsequent phase, those samples are used as the bases of argumentations by analogy to obtain a diagnosis for a given patient. This model extends the prototype resemblance theory of disease including also the exemplar theory proposed in cognitive science and, moreover, it frames the clinical activity of nosological diagnosis and how it can be explained within the theory of argumentation. According to it, diagnosis based on the recognition of a typical syndrome is explained in terms of the prototype theory of categorization and the antisymmetrical argumentation by analogy, while diagnosis based on a comparison with a previous clinical case is explained by the exemplar theory of categorization and by the symmetrical argumentation by analogy. This paper offers a review of the argumentation-theoretical literature on metaphor in argumentative discourse. Two methodologies are combined: the pragma-dialectical theory is used to study the argumentative functions attributed to metaphor, and distinctions made in metaphor theory and the three-dimensional model of metaphor are used to compare the conceptions of metaphor taken as starting point in the reviewed literature. An overview is provided of all types of metaphors distinguished and their possible argumentative functions. The study reveals that not all possible (...) argumentative functions of metaphor have been taken into account, such as the role of conventional direct metaphors in standpoint and starting point. Novel direct metaphor as part of an analogy argument has received most attention, while indirect metaphor can constitute argumentative moves as well, such as the introduction of a standpoint, starting point or connection premise. The overview also shows that certain combinations of variables seem to be impossible of unlikely to occur. These results have a bearing on the analysis of metaphors in argumentative discourse and show the omission in current studies of metaphor. Being aware of these dimensions of metaphor ánd of its potential in argumentation would enrich argumentation studies and metaphor studies alike. (shrink)

Accounts of analogical inference are usually categorized into four broad groups: abductive, deductive, inductive and sui generis. The purpose of this paper is to defend a sui generis model of analogical inference. It focuses on the sui generis account, as developed by Juthe [2005, 2009, 2015, 2016] and Botting’s [2017] criticism of it. This paper uses the pragmadialectical theory of argumentation as the methodological framework for analyzing and reconstructing argumentation. The paper has two main points. First, that Juthe’s arguments against (...) a deductive interpretation of prima facie analogy argumentation remain unaffected by Botting’s criticism, which means that many of the reasons against deductive reformulation of analogy argumentation still stand. The additional argument, which Botting himself brings up, that a deductive interpretation cannot account for the cumulative effect of analogies, just provides further reason to reject deductivism. The second main point of this paper is that an inductive interpretation of analogical inference also fails. There are constitutional differences between inductive and analogical inference that cannot be bridged. The result is a firm defense of the sui generis view of analogical inference. (shrink)

Successful accounts of analogy in law have two burdens to discharge. First, they must reflect the fact that the conclusion of an argument by analogy is a normative claim about how to decide a certain case. Second, they must not fail to accord relevance to the fact that the source case was authoritatively decided in a certain way. We argue in the first half of this paper that the common view of the structure of analogical arguments in law cannot overcome (...) these hurdles. Drawing on insights from contemporary studies on conceptual metaphor and multimodal metaphor, the present study proposes a tentative analysis of multimodal metaphorical argument from the perspective of the extended theory of pragma-dialectics. A case, Liqun Commercial, is presented as an illustration. This commercial proves to use a conceptual metaphor, life is a journey, that underlies a multimodal metaphorical argument. The conceptual metaphor is highly acceptable in the cultural context of the Chinese target audience. Due to the restrictions imposed by the (...) institutional context, the commercial tries to convince the audience by using implicit argumentative means. In this endeavor, multimodal metaphorical argument is used to enhance the commercial’s effectiveness by foregrounding through framing the aspects the protagonist desires to show and by using a strategy to evade sanctions for ignoring institutional constraints. Analogies must be symmetric. If a is like b, then b is like a. So if a has property R, and if R is within the scope of the analogy, then b (probably) has R. However, analogical arguments generally single out, or depend upon, only one of a or b to serve as the basis for the inference. In this respect, analogical arguments are directed by an asymmetry. At a recent rally, Donald Trump resumed a habit he had developed during his election-rallies and read out the lyrics to a song. It tells the Aesopian fable of The Farmer and the Snake: A half frozen snake is taken in by a kind-hearted person but bites them the moment it is revived. Trump tells the fable to make a point about Islamic immigrants and undocumented immigrants from Southern and Central America: He claims the immigrants will cause problems and much (...) stricter immigration-policies are needed. I assume that Trump treats the fable as an argumentative device for supporting his stance on immigration. He uses it as a source-analogue both for the conclusion that immigrants will cause problems and for changing the frame in which immigrants and those willing to let them enter are seen. This gives me opportunity to examine the effect fables have as argumentative devices. Fables are a popular and effective choice for political argumentation. They are slimmed down, semi-abstract narratives, well suited for directing the audience's attention to a few properties of an otherwise complex situation. However, this also makes it easy to use them for manipulating an audience into oversimplifying complex contexts and stereotyping human beings. (shrink)

Arguers sometimes cite a decision made in an earlier situation as a reason for making the equivalent decision in a later situation. I argue that there are two kinds of “case-to-case arguments”. First, there are arguments by precedent, which cite the mere existence of the past decision as a reason to decide in the same way again now, independent of the past decision’s merits. Second, there are case-to-case arguments from parralel reasoning which presuppose that the past decision was justified and (...) are used to show that an equivalent present decision would also be justified. Both arguments are a type of argument by analogy. They differ in their structures and conditions of cogency, even though they often look the same in presentation. Their similar appearance poses a risk of miss-evaluation and fallacious use. Therefore a clearly theorized distinction is important. (shrink)

The works of the Tibetan logician Phya pa Chos kyi seng ge (1109–1169) make abundant use of a particular type of argument that I term ‘argument by parallels’. Their main characteristic is that the instigator of the argument, addressing a thesis in a domain A, introduces a parallel thesis in an unrelated domain B. And in the ensuing dialogue, each of the instigator’s statements consists in replicating his interlocutor’s previous assertion, mutatis mutandis, in the other domain (A or B). I (...) show that such a dialogue involves two parallel arguments that develop in an intersecting zigzag pattern, and discuss the principles involved in the establishment of the conclusion from the perspective of parity of reasoning and analogical argument. I examine the overall rhetorical strategy directing the use of arguments by parallels and the pedagogical and explanatory functions they can serve. I also evaluate the plausibility of their use in Phya pa Chos kyi seng ge’s works mirroring a contemporary practice of oral debate, and reflect on the status of such arguments in the framework of Indo-Tibetan logic. Despite its importance in various fields, analogical reasoning has not yet received a unified formal representation. Our contribution proposes a general scheme of inference that is compatible with different types of logic (deductive, probabilistic, non-monotonic). Firstly, analogical assessment precisely defines the similarity of two objects according to their properties, in a relative rather than absolute way. Secondly, analogical inference transfers a new property from one object to a similar one, thanks to an over-hypothesis linking two sets of properties. Randomized experiments, as developed by Esther Duflo and Abhijit Banerjee at the Abdul Latif Jameel Poverty Action Lab, offer a novel, evidence-based approach to fighting poverty. This approach is original, in that it imports the methodology of clinical trials for application in development economics. This paper examines the analogy between J-PAL’s field experiments in development economics and randomized controlled trials in medicine. RCTs and randomized field experiments are commonly treated as identical, but such treatment neglects some of the major distinguishing (...) features that make each experiment specifically apt for use in its respective field. The central claim of this paper is that the analogy between medicine and development economics is incomplete because the central dimensions of RCTs are not simply different but altogether lacking in J-PAL’s approach. This weakens both the political and the theoretical power of such experiments in development economics. (shrink)

This paper is a case study. After formulating three norms for critical assessment of argumentation (section 1), I give a brief overview of Galileo’s argumentative strategy in his Dialogue and present his argument for the cause of the tides, which appears as an argument by analogy (section 2). I then discuss possible reconstructions of this argumentation, with one particular suggestion in detail. These arguments seem to fall short, given the aforementioned set of norms (section 3). This leads to my own (...) proposal of Galileo’s argument. I defend this proposal and it’s general idea - that is, the argument’s pattern. It will be classified as ‘interventionist’ and useful regarding the goals of critical assessment (section 4). Finally, I suggest that the pattern of argument is applicable to other cases and useful for applied theory of science (section 5). (shrink)

In this paper, I will propose a classification of analogies based on their internal structure. Selecting the criteria used in that classification first requires discussing the minimal constitutive parts of any analogy. Accordingly, I will discuss the differences between analogy and similarity and between analogy and “synalogy,” and I will stress the importance of the analogy of operations and procedures. Finally, I will set forth a classification of the different types of analogies, which lends itself to a further understanding of (...) the differences between certain modulations of the general idea of analogy, such as archetypes, prototypes, models, simulations, parables, paradigms, canons, maps, thought experiments, myths, utopias, dystopias and fables.
