In this open access book, Timothy Aylsworth and Clinton Castro draw on the deep well of Kantian ethics to argue that we have moral duties, both to ourselves and to others, to protect our autonomy from the threat posed by the problematic use of technology. The problematic use of technologies like smartphones threatens our autonomy in a variety of ways, and critics have only begun to appreciate the vast scope of this problem. In the last decade, we have seen a (...) flurry of books making “self-help” arguments about how we could live happier, more fulfilling lives if we were less addicted to our phones. But none of these authors see this issue as one involving a moral duty to protect our autonomy. (shrink)

We argue that there is significant evidence for reconsidering the possibility that moral judgment constitutes a distinctive category of judgment. We begin by reviewing evidence and arguments from neuroscience and philosophy that seem to indicate that a diversity of brain processes result in verdicts that we ordinarily consider “moral judgments”. We argue that if these findings are correct, this is plausible reason for doubting that all moral judgments necessarily share common features: if diverse brain processes give rise to what we (...) refer to as “moral judgments”, then we have reason to suspect that these judgments may have different features. After advancing this argument, we show that giving up the unity of moral judgment seems to effectively dissolve the internalism/externalism debate concerning motivation within the field of metaethics. This article discusses recent work on lying and its relation to deceiving and misleading. Two new developments in this area are considered: first, the acknowledgment of the phenomenon of lying without the intent to deceive , and second, recent work on the distinction between lying and merely misleading. Both are discussed in relation to topics in philosophy of language, the epistemology of testimony, and ethics. In this paper I will use sex by deception as a case study for highlighting some of the most tricky concepts around sexuality and moral psychology, including rape, consensual sex, sexual rights, sexual autonomy, sexual individuality, and disrespectful sex. I begin with a discussion of morally wrong sex as rooted in the breach of five sexual liberty rights that are derived from our fundamental human liberty rights: sexual self-possession, sexual autonomy, sexual individuality, sexual dignity and sexual privacy. I then argue (...) (against the standard interpretation) that experimental findings in moral psychology show that the principle of respect for persons—a principle that grounds our human liberty rights—drives our intuitive moral judgments. In light of this discussion, I examine a puzzle about sex by deception—a puzzle which at first may seem to compel us to define 'rape' strictly in terms of force rather than sexual autonomy. I proceed by presenting an argument against the view that, as a rule, sex by deception undermines consent—a position held by prominent thinkers such as Philippe Patry (2001), Onora O’Neill (2003), Rubenfeld (2012), Tom Dougherty (2013a, 2013b), Joyce M. Short (2013), and Danielle Bromwich and Joseph Millum (2013, 2018). As we will see, sex following deception to increase your chances does not always constitute rape. Lying about your age, education, job, family background, marital status, or interest in a relationship, for example, does not make your sex partner incapable of consenting, which is to say that sex by deception need not be rape. I even go so far as to say that sex with another person that is facilitated by withholding information about having a venereal disease shouldn't be classified as rape. Although sex by deception doesn't compromise consent, it nonetheless violates the principle of respect for persons, not by vitiating sexual autonomy and compromising consent, but by failing to respect other sexual rights, such as our rights to sexual dignity, individuality, and privacy. It is often thought that some version of what is generally called the publicity condition is a reasonable requirement to impose on moral theories. In this article, after formulating and distinguishing three versions of the publicity condition, I argue that the arguments typically used to defend them are unsuccessful and, moreover, that even in its most plausible version, the publicity condition ought to be rejected as both question-begging and unreasonably demanding.

A philosopher examines the complicated phenomenon of gaslighting “Gaslighting” is suddenly in everyone’s vocabulary. It’s written about, talked about, tweeted about, even sung about (in “Gaslighting” by The Chicks). It’s become shorthand for being manipulated by someone who insists that up is down, hot is cold, dark is light—someone who isn’t just lying about such things, but trying to drive you crazy. The term has its origins in a 1944 film in which a husband does exactly that to his wife, (...) his crazy-making efforts symbolized by the rise and fall of the gaslights in their home. In this timely and provocative book, Kate Abramson examines gaslighting from a philosophical perspective, investigating it as a distinctive moral phenomenon. Gaslighting, Abramson writes, is best understood as a form of interpersonal interaction, a particular way of fundamentally undermining someone. The gaslighter, Abramson argues, aims to make his target experience herself as incapable of reasoning, perceiving, or reacting in ways that would allow her to form appropriate beliefs, perceptions, or emotions in the first place. He seeks not only to induce in her this unmoored sense of herself but also to make it a reality. Using examples and analysis, Abramson gives an account of gaslighting and its immorality, and argues that such a discussion can help us understand other aspects of social life—from racism and sexism to the structure of interpersonal trust. This chapter explores the prospects for justifying the somewhat widespread, somewhat firmly held sense that there is some moral advantage to untruthfully implicating over lying. I call this the "Difference Intuition." I define lying in terms of asserting, but remain open about what precise definition best captures our ordinary notion. I define implicating as one way of meaning something without asserting it. I narrow down the kind of untruthful implicating that should be compared with lying for purposes of evaluating whether (...) there is a moral difference between them. Just as lying requires a robust form of assertion, so the kind of untruthful implicating to be compared with lying requires a robust form of implicating. Next, I set out various ways of sharpening the Difference Intuition and survey a range of approaches to justifying one class of sharpenings. I finish by sketching an approach to justifying an alternative sharpening of the Difference Intuition, which is inspired by John Stuart Mill's discussion of lying. (shrink)

Most plausible moral theories must address problems of partial acceptance or partial compliance. The aim of this paper is to examine some proposed ways of dealing with partial acceptance problems as well as to introduce a new Rule Utilitarian suggestion. Here I survey three forms of Rule Utilitarianism, each of which represents a distinct approach to solving partial acceptance issues. I examine Fixed Rate, Variable Rate, and Optimum Rate Rule Utilitarianism, and argue that a new approach, Maximizing Expectation Rate Rule (...) Is evil a distinct moral concept? Or are evil actions just very wrong actions? Some philosophers have argued that evil is a distinct moral concept. These philosophers argue that evil is qualitatively distinct from ordinary wrongdoing. Other philosophers have suggested that evil is only quantitatively distinct from ordinary wrongdoing. On this view, evil is just very wrong. In this paper I argue that evil is qualitatively distinct from ordinary wrongdoing. The first part of the paper is critical. I argue that (...) Luke Russell’s attempt to show that evil is only quantitatively distinct from ordinary wrongdoing fails. Russell’s argument fails because it is based on an implausible criterion for determining whether two concepts are qualitatively distinct. I offer a more plausible criterion and argue that based on this criterion evil and wrongdoing are qualitatively distinct. To help make my case, I sketch a theory of evil which makes a genuinely qualitative distinction between evil and wrongdoing. I argue that we cannot characterize evil as just very wrong on plausible conceptions of evil and wrongdoing. I focus on act-consequentialist, Kantian, and contractarian conceptions of wrongdoing. Are immigration restrictions compatible with liberalism? Recently, Freiman and Hidalgo have argued that immigration restrictions conflict with the core commitments of liberalism. A society with immigration restrictions in place may well be optimal in some desired respects, but it is not liberal, they argue. So if you care about liberalism more deeply than you care about immigration restrictions, you should give up on restrictionism. You can’t hold on to both. I argue here that many restrictions on contractual, economic, and associational (...) liberties seem to be justified by considerations other than liberty – thus the task for Freiman and Hidalgo is to tell us why such restrictions are justified but immigration restrictions are not. Moreover, even if this worry can be addressed, I argue, liberalism is not committed to its own demise in scenarios where there exist large enough numbers of would-be immigrants who accept and endorse illiberal norms in a way that is sufficiently resistant to change. Such a commitment requires thinking of border coercion as violating an absolute deontological constraint. This, I contend, is implausible. (shrink)

Suppose you assert a proposition p that you falsely believe to be false with the intention to deceive your audience. The standard view has it that you lied. This paper argues against orthodoxy: deceptive lying requires that p be in actual fact false, in addition to your intention to deceive by means of untruthfully asserting that p. We proceed as follows. First, an argument is developed for such falsity condition as the non-psychological component of lying. The problem with the standard (...) view, we profess, is exactly that lying is a purely psychological relation between disbelief, assertion, and intention. Then, by scrutinising familiar cases, we revisit the alleged intuitive support for the existence of true lies. It turns out these intuitions can be explained away once we reflect on the characteristic deceptive hallmarks that are associated with the distinction between lying and botched attempts at lying. Finally, we examine the morality of lying in the light of said falsity condition. The resultant view emphasises our moral sensitivity to the practical consequences of acts of lying, while still accommodating those moral considerations that pertain exclusively to the psychological components of lying. A nexus of imperfect duty, defined as positive commitments that have practical limits, describes business behavior toward building affable and virtuous relations, maintaining reasoned social discourse, and performing the due diligence necessary for making knowledgeable business decisions. A theory of the development and extent of the limits of these imperfect managerial duties is presented here, a theory that in part explains the activities and personnel included under the firm’s umbrella. As a result, the nexus of imperfect duty is shown to (...) complement the perfect-duty-based nexus-of-contracts theory of the firm. The existence of flexible trade-offs involving these duties, trade-offs limited by contractual arrangements whether explicit or implicit, is shown to be one of the advantages of imperfect duty for developing business relations. Kant's claim that the rational will has absolute value or dignity appears to render any prudential suicide morally impermissible. Although the previous appeals of Kantians (e. g., David Velleman) to the notion that pain or mental anguish can compromise dignity and justify prudential suicide are unsuccessful, these appeals suggest three constraints that an adequate Kantian defense of prudential suicide must meet. Here I off er an account that meets these constraints. Central to this account is the contention that some suicidal (...) agents, because they are unable to fashion a rational conception of their own happiness, are diminished with respect to their dignity of humanity, and as a result, lack the pricelessness that makes prudential suicide wrong on a Kantian view. In this article I argue that it is possible to find, in the Groundwork, a perfect ethical duty to others not to lie to any other person, ever. This duty is not in the Doctrine of Virtue, or the Right to Lie essay. It is an exceptionless, negative duty. The argument given for this negative duty from the Universal Law formula of the Categorical Imperative is that the liar necessarily applies a double standard: do not lie (everyone else), and lie (...) (the liar). The basis for this double standard is a presumption of inequality: the liar treats others as less than her. However, this argument fails to exclude lies told to liars, since the liar applies a single standard in this case: (secretly) lie to those whom you believe are lying to you. The argument given for this negative duty from the Humanity formula of the Categorical Imperative is that the liar necessarily behaves in way towards the other person in a way to which she "cannot possibly" consent. However, this argument fails to exclude lies told to those who have consented to be lied to, without knowing which lies they are to be told. Kant's arguments, therefore, fail to generate a perfect exceptionalness negative duty not to lie to any person, ever. (shrink)

ABSTRACTIn this article, I will identify two key normative principles at the core of Robert L. Simon’s mutualist theory of sport, namely, the respect-for-the-opponent principle and the idea that sport is a practice aimed at pursuing excellence. The former is a Kantian principle grounded in human beings’ rationality, and the latter is an Aristotelian principle related to the development of excellences as a means to human flourishing. After having presented and analyzed both principles, I will critically evaluate Simon’s attempt to (...) combine them within his mutualist approach. If Kant’s theory of justice is known for one thing, it is for offering a vision of a perfectly just society that is utterly disconnected from the imperfect societies that we occupy. The purity of Kant’s account has attracted criticism from those who claim that if a theory of justice is to be practical, it must offer more than a vision of a perfectly just society. It must also explain how existing societies mired in injustice are to be brought into (...) ever-closer conformity with the ideal that justice prescribes. In this essay, I will argue that this is exactly what Kant’s mature legal and political theory offers. To discern this feature of Kant’s theory, a neglected component must be integrated into his broader framework. This component is what Kant refers to in Toward Perpetual Peace as a permissive law of public right. (shrink)

In this article I rebut conservative objections to five phases of embryonic stem cell research. I argue that researchers using existing embryonic stem cell lines are not complicit in the past destruction of embryos because beneficiaries of immoral acts are not necessary morally tainted. Second, such researchers do not encourage the destruction of additional embryos because fertility clinics presently destroy more spare embryos than researchers need. Third, actually harvesting stem cells from slated-to-be-discarded embryos is not wrong. The embryos are not (...) sacrificed for the good of others because they would have been destroyed anyway. Fourth, harvesting stem cells from embryos that are not doomed is morally acceptable, because preserving frozen embryos is futile therapy. Finally, creating embryos solely for the sake of harvesting stem cells from them is morally acceptable because the assumption that embryos have the right to life has very counterintuitive implications. The mere means principle says it is impermissible to treat someone as merely a means to someone else’s ends. I specify this principle with two conditions: a victim is used as merely a means if the victim does not want the treatment by the agent and the agent wants the presence of the victim’s body. This principle is a specification of the doctrine of double effect which is compatible with moral intuitions and with a restricted kind of libertarianism. An extension (...) of this mere means principle, where not only using but also considering someone as merely a means is immoral, can explain and unify other deontological principles: doing versus allowing, partiality in imperfect duties of beneficence, and the asymmetry of procreational duties. A loop trolley dilemma is often presented as a counterexample of the mere means principle, but I argue that this dilemma generates a moral illusion, comparable to perceptual illusions. (shrink)

Is torturing innocent people ever morally required? I rebut responses to the ticking-bomb dilemma by Slote, Williams, Walzer, and others. I argue that torturing is morally required and should be performed when it is the only way to avert disasters. In such situations, torturers act with dirty hands because torture, though required, is vicious. Conversely, refusers act wrongly, yet virtuously, thus displaying admirable immorality. Vicious, morally required acts and virtuous, morally wrong acts are odd, yet necessary to preserve the ticking-bomb (...) dilemma’s phenomenology, the role of habituation in moral development, the virtue/continence distinction, and morality’s overridingness, consistency, and plausibility. Neo-Kantian accounts which try to ground morality in the necessary requirements of agency face the problem of “bad action”. The most prominent example is Christine Korsgaard’s version of constitutivism that considers the categorical imperative to be indispensable for an agent’s self-constitution. In my paper I will argue that a constitutive account can solve the problem of bad action by applying the distinction between constitutive and regulative rules to the categorical imperative. The result is that an autonomous agent can violate the (...) categorical imperative in so far as it amounts to a regulative rule of morality; however, an agent cannot call into question the categorical imperative as a constitutive rule of the practice of morality without losing her or his identity as a moral agent. The paper then compares this approach to bad action with the one Korsgaard provides and outlines also a new way of grounding the categorical imperative. (shrink)

Books and journal articles have become the dominant modes of presentation in contemporary philosophy. This historically contingent paradigm prioritises textual expression and assumes a distinction between philosophical practice and its presented product. Using Socrates and Diogenes as exemplars, we challenge the presumed supremacy of the text and defend the importance of ways of life as modes of practiced presentation. We argue that text cannot capture the embodied activity of philosophy without remainder, and is therefore limited and incomplete. In particular, we (...) contend that a static text is essentially alienated from our practices of philosophising, words cannot unambiguously represent lives, and practiced presentation enriches our understanding beyond words alone. After discussing some pedagogical implications, we conclude with a plea for a pluralistic approach that recognises lives as legitimate and valuable modes of philosophical presentation. (shrink)

Normative ethics usually presupposes background accounts of human agency, and although different ethical theorists might have different pictures of human agency in mind, there is still something like a standard account that most of mainstream normative ethics can be understood to rest on. Ethical theorists tend to have Rational Man, or at least some close relative to him, in mind when constructing normative theories. It will be argued here that empirical findings raise doubts about the accuracy of this kind of (...) account; human beings fall too far short of ideals of rationality for it to be meaningful to devise normative ideals within such a framework. Instead, it is suggested, normative ethics could be conducted more profitably if the idea of unifying all ethical concerns into one theoretical account is abandoned. This disunity of ethical theorizing would then match the disunited and heuristic-oriented nature of our agency. (shrink)

Professor Procrastinate receives an invitation to review a book. Best would be to accept it and then write the review. But if he accepts it, he will never get around to writing. And this would be worse than declining. Should he accept? Possibilists say yes, Actualists say no, and I say we need more information. In particular, we lack some information about the level of goodness of the various options. For example, we lack information regarding how much better it would (...) be to accept and write than it would be to decline. One of the ways in which transnational medical agencies (TMAs) such as Medicins Sans Frontieres aim to increase the access of the global poor to health services is by supplying medical aid to people who need it in developing countries. The moral imperative supporting such work is clear enough, but a variety of factors can make such work difficult. One of those factors is the wrongdoing of other agents and agencies. For as a result of such wrongdoing, the attempt to (...) supply medical aid can sometimes lead to significant negative effects. What should TMAs do in such situations? On one view, TMAs should take account of any negative effects arising from the wrongdoing of others in just the same way in which they take account of negative effects arising more directly from their own actions, or from natural forces. To many people, this view seems wrong. In this paper, I articulate and discuss several different reasons why one might think this. In doing so, I hope to contribute to a debate about the more general question of how TMAs should respond to the wrongdoing of others. (shrink)

The lung allocation score system in the United States and several European countries gives more weight to risk of death without transplantation than to survival following transplantation. As a result, centers transplant sicker patients, leading to increased length of initial hospitalization. The care of patients who have accumulated functional deficits or additional organ dysfunction during their prolonged stay can be ethically complex. Disagreement occurs between the transplant team, patients and families, and non-transplant health care professionals over the burdens of ongoing (...) intensive intervention. These cases highlight important ethical issues in organ transplantation, including the nature and requirements of transplant informed consent, the limits of physician prognostication, patient autonomy and decision-making capacity following transplant, obligations to organ donors and to other potential recipients, and the impact of program metrics on individualized recipient care. We outline general ethical principles for the care of lung transplant recipients with prolonged hospitalization and give regulatory, research, and patient-centered recommendations for these cases. What counts as global ‘harm’? This article explores this question through critical engagement with Thomas Pogge’s conception of negative duties not to harm. My purpose here is to show that while Pogge is right to orient global moral claims around negative duties not to harm, he is mistaken in departing from the standard understanding of these duties. Pogge ties negative duties to global institutions, but I argue that truly negative duties cannot apply to such institutions. In order to retain the (...) global force of negative duties, we need to dissociate these duties from global institutions: each society’s negative duty to stop harming specific other societies ought to be seen as independent of global institutional change. In order to establish this thesis, I criticize both the features and the derivation of Pogge’s variant of negative duties. I conclude that one must see global negative duties as applying to the relations between specific sovereign societies as unitary agents rather than to global institutions. I then show how this view of negative duties can yield significant global reform, based on Pogge’s own accusations concerning democracies’ conferral of trading privileges upon dictators who embezzle state resources. After presenting the normative, empirical, and strategic advantages of such reform, I anticipate Poggean objections. (shrink)

This paper addresses the question of what value pluralism tells us about the pursuit of moral coherence as a method of moral reasoning. I focus on the status of the norm of ‘systematicity,’ or the demand that our principles be as few and as simple as possible. I argue that, given certain descriptive facts about the pluralistic ways we value, epistemic ways of supporting a systematicity norm do not succeed. Because it is sometimes suggested that coherence functions in moral reasoning (...) as it does in scientific reasoning, my argument considers analogies and disanalogies between moral reasoning and scientific reasoning. The critical target of my paper is the normativist stance of Kantian meta ethics. After a very short introduction, I develop a characterization of contemporary mainstream Kantism as a conjunction of a normativist claim, a rationalist claim and a proceduralist claim. In the subsequent section I make the case against the normativist claim by drawing a counterexample, and defend the relevance of such counterexample as a reason that defeats the appeal of the Kantian approach to meta ethics. I finally conclude (...) by highlighting the main reasons why the challenge my counterexample rises are not answerable within a Kantian framework. (shrink)

I argue that there are instances in which lying to an innocent and generally competent person respects her autonomy, contrary to arguments by Christine Korsgaard and Onora O’Neill. These authors say that respect for a person’s autonomy requires treating her in a way consistent with the possibility of consent, but I contend that the possibility of consent condition is unworkable. I maintain that lying can respect individual autonomy when being truthful to a person undermines her choices and lying gets her (...) what she would reasonably see herself as having most reason to choose in the circumstances. This entry considers the question “What is objectification?” After preliminary remarks about different methodological approaches, several possible answers, or groups of answers, are introduced, separated out in terms of broad themes. Each is situated in relation to historical and more contemporary authors. These themes are: objectification as instrumentalization; objectification as reduction to the body; objectification as negation of subjectivity or agency; objectification as naturalization. Objectification is considered in relation to both sexual and racial contexts. Critics often charge that Kantian ethics is implausibly rigoristic: that Kantianism recognizes a set of perfect duties, encapsulated in rules such as ‘don’t lie,’ ‘keep one’s promises,’ etc., and that these rules apply without exception. Though a number of Kantians have plausibly argued that Kantianism can acknowledge exceptions to perfect duties, this acknowledgment alone does not indicate how and when such exceptions ought to be made. This article critiques a recent attempt to motivate how such exceptions are to be made, (...) namely, the constitutive approach developed by Tamar Schapiro. I argue that the constitutive approach is vulnerable to the objection that it is too permissive, justifying many morally dubious exceptions to perfect duties. I conclude by briefly outlining an alternative ‘fine print’ approach to the rigorism objection that appears to avoid the objection leveled at Schapiro’s approach, focusing on how modifying the constituents of agents’ maxims can change the deontic status of an act of a generally impermissible kind. It has been argued that, on Kantian grounds, pedophiles, rapists and murderers are morally obligated to take their own lives prior to committing a violent action that will end their moral agency. That is, to avoid destroying the agent's moral life by performing a morally suicidal action, the agent, while he still is a moral agent, should end his body's life. Although the cases of dementia and the morally reprehensible are vastly different, this Kantian interpretation might be useful in the (...) debate on the permissibility of suicide for those facing dementia's effects. If moral agents have a duty to act as moral agents, then those who will lose their moral identity as moral agents have an obligation to themselves to end their physical lives prior to losing their dignity as persons. Sometimes we make mistakes, even when we try to do our best. When those mistakes are about normative matters, such as what is required, this leads to a puzzle. This puzzle arises from the possibility of misleading evidence about what rationality requires. I argue that the best way to solve this puzzle is to distinguish between two kinds of evaluation: requirement and appraisal. The strategy I defend connects three distinct debates in epistemology, ethics, and normativity: the debate over how our (...) theories of epistemic rationality should accommodate misleading evidence, the debate over the relationship between complying with requirements and deserving particular appraisals, and the debate over whether normative ignorance can excuse. Part 1 shows how three apparently plausible claims about epistemic rationality generate a puzzle when agents have misleading evidence about what rationality requires. Part 2 solves this puzzle by distinguishing between evaluations of requirement and appraisal and rejecting the idea that one is required to conform to the Enkratic Principle. I argue instead that complying with the Enkratic Principle provides defeasible evidence that the agent should be positively appraised. One of the consequences of this solution is that false normative beliefs can sometimes excuse agents from negative appraisal they would otherwise deserve for violating requirements. Part 3 defends the view that false normative belief can sometimes excuse against the rival views that false normative belief always excuses, and that false normative belief never excuses. I argue that false normative belief can sometimes excuse violations of requirements, when it is the case that the agent has done what it is reasonable to expect of her. (shrink)

In this article I argue that doing the lesser evil in politics is always permitted and even required. I call this view “pragmatism”. I defend it against “purism”, which claims that it is never permissible to do (the lesser) evil. I reject three arguments for purism, which are based on Alan Gewirth’s principle of intervening action, on an alleged epistemic difference between doing and allowing evil, and on rule-consequentialism. In On What Matters Derek Parfit advocates the Kantian Contractualist Formula as one of three supreme moral principles. In important cases, this formula entails that it is wrong for an agent to act in a way that would be partially best. In contrast, Parfit’s wide value-based objective view of reasons entails that the agent often have sufficient reasons to perform such acts. It seems then that agents might have sufficient reasons to act wrongly. In this paper I will argue that (...) such reasons are a symptom of a fundamental inconsistency between the Kantian Contractualist Formula and Parfit’s view of reasons. The formula requires that we consider what everyone could rationally will, while a wide value-based objective view requires that we consider only what the agent has sufficient reasons for doing. The same inconsistency is particularly obvious in Parfit’s version of the Consent Principle, which share important features with the Kantian Contractualist Formula. Parfit accepts that moral principles might entail that we sometimes have sufficient reasons to act wrongly. However, to accept that supreme moral principles have such implications is objectionable if you, like Parfit, also hold that principles with such implications should be rejected or revised. I suggest that we could abandon the requirement that we have to consider the reasons of everyone. This would make the Kantian Contractualist Formula consistent with Parfit’s view of reasons, at least in this respect. I also argue that we can keep most implications of the Kantian Contractualist Formula that Parfit finds attractive. (shrink)

The principle of right is Kant's main formulation of the rules of politics, and it has obvious affinities with the moral law. Do we have moral reasons to obey the principle? I argue that we may have moral reasons to obey the principle ourselves, but not coercively to enforce it. Do we have prudential reasons to obey the principle? I argue that we do not have reasons based on happiness, but that we may have prudential reasons of a wholly different, (...) but distinctively Kantian kind. These may be reasons both to obey the principle ourselves and to enforce it. (shrink)

A series of attempts have been made to determine Kant’s exact position towards theodicy, and to understand whether it is a direct consequence of his critical philosophy or, rather, whether it is merely linked to some inner development within his critical philosophy. However, I argue that the question of Kant’s critical relation to theodicy has been misunderstood; and that in fact, Kant redefines the essence of the theodicean question anew. After introducing some major aspects of Kant‘s new conception of theodicy, (...) I show how understanding this conception is necessary for correctly analysing his specific arguments against theodicy. I demonstrate this point by examining Kant’s second argument against theodicy, in which he tackles the Leibnizian problem of ‘metaphysical evil’, and show why, in light of the above, interpretations thus far have failed to capture the essence of Kant’s claim in this regard. Kant’s reputation for making absolutist claims about universal and necessary conditions for the possibility of experience are put here in the broader context of his goals for the Critical philosophy. It is shown that within that context, Kant’s claims can be seen as considerably more innocuous than they are traditionally regarded, underscoring his deep respect for “common sense” and sharing surprisingly similar goals with Wittgenstein in terms of what philosophy can, and at least as importantly cannot, provide.

Biometric identification is thought to be less vulnerable to fraud and forgery than are traditional forms of identification. However biometric identification is not without vulnerabilities. In a ‘spoofing attack’ an artificial replica of an individual’s biometric trait is used to induce a system to falsely infer that individual’s presence. Techniques such as liveness-detection and multi-modality, as well as the development of new and emerging modalities, are intended to secure biometric identification systems against such threats. Unlike biometrics in general, the societal (...) and ethical issues raised by spoofing and anti-spoofing techniques have not received much attention. This paper examines these issues. (shrink)

Over the years, various critics have accused Kant of a rigorism that is the moral equivalent of fiat iustitia ruat caelum. But this involves a greatly mistaken view of the nature and bearing of his categorical imperative. What Kant does in ethics is to employ a two domain approach that separates a rigoristic realm of theory from a more flexible realm of praxis that is oriented towards the real world of our experience. In the moral sphere demands of the former, (...) theoretical realm are indeed rigoristic, but this rigorism cannot reasonably be extended into the practical realm of action, decision, and advice. Im Beitrag wird die übliche, intuitionsbasierte Bewertung ethischer Gedankenexperimente hinterfragt und stattdessen für ein neo-kantisches Verfahren der Bewertung argumentiert. Hierzu wird nach einer kurzen systematisch-historischen Verortung zunächst eine grobe Kategorisierung vorgenommen, die erstens nach der Funktion, zweitens nach der Fragestellung erfolgt, auf die Gedankenexperimente antworten. Das vorgeschlagene, neo-kantische Verfahren eignet sich insbesondere zur Bewertung einer bestimmten Kategorie von Gedankenexperimenten: Dilemmatische Situationen, in denen eine Abwägung von Menschenleben zur Debatte steht, weil nicht alle Beteiligten überleben können. Anhand von drei ausgewählten Gedankenexperimenten (...) wird das jeweilige Bewertungsverfahren betrachtet. Im Zuge des neokantischen Verfahrens wird ein „Rollentausch“ vorgenommen und danach gefragt, was alle Betroffenen „rationalerweise wollen“ können. Während die Präferenzen der Täter, die das Dilemma erst verursachen, nicht in die Überlegung eingehen, hängt die Bewertung der Perspektive der Opfer von Art und Ausmaß ihrer Bedrohung ab. Passagiere und Crew des entführten Flugzeugs, deren Tod unausweichlich bevorsteht, könnten einem Abschuss, der vielen anderen das Leben rettet, rationalerweise zustimmen. Beim Gedankenexperiment von Jim und den Indianern ist dies nur bedingt der Fall. In fast allen Varianten des Trolley-Experiments kann nicht davon ausgegangen werden, dass die jeweilige Person der Opferung ihres Lebens für andere zustimmt. In einem letzten Punkt wird auf den Einwand Humes eingegangen, dass weder ein radikal egoistisches noch ein übertrieben altruistisches Wollen als „irrational“ bezeichnet werden kann. (shrink)

The boundaries of honesty are the focal point of this exploration of the individualistic origins of modernist ethics and the consequent need for a more pragmatic approach to business ethics. The tendency of modernist ethics to see honesty as an individual responsibility is described as a contextually naive approach, one that fails to account for the interactive effects between individual choices and corporate norms. By reviewing the empirical accounts of managerial struggles with ethical dilemmas, the article arrives at the contextual (...) preconditions for encouraging the development of reflective moral agents in modern corporations. Social decisions are often made under great uncertainty – in situations where political principles, and even standard subjective expected utility, do not apply smoothly. In the first section, we argue that the core of this problem lies in decision theory itself – it is about how to act when we do not have an adequate representation of the context of the action and of its possible consequences. Thus, we distinguish two criteria to complement decision theory under ignorance – Laplace’s principle (...) of insufficient reason and Wald’s maximin criterion. After that, we apply this analysis to political philosophy, by contrasting Harsanyi’s and Rawls’s theories of justice, respectively based on Laplace’s principle of insufficient reason and Wald’s maximin rule – and we end up highlighting the virtues of Rawls’s principle on practical grounds (it is intuitively attractive because of its computational simplicity, so providing a salient point for convergence) – and connect this argument to our moral intuitions and social norms requiring prudence in the case of decisions made for the sake of others. Este ensayo se interroga críticamente por la noción de excepción moral desde una cierta manera de entender la moral categórica de Kant, y en contraste con explicaciones consecuencialistas. No tiene propósitos exegéticos sino sistemáticos. El objetivo general es pensar conjuntamente las nociones de excepcionalidad y violencia morales, así como el papel que en ello juegan los conceptos de igualdad y de dignidad. El trabajo contiene una serie de propuestas entrelazadas: que la violencia moral conlleva una ruptura de la igualdad moral, (...) la cual forma parte de las condiciones de asentimiento de una acción, y que, en ausencia de condiciones de asentimiento, se desvanece, localmente, la vinculatoriedad de los deberes morales. Así, las excepciones pueden entenderse como producto de la ruptura local de las condiciones de asentimiento, sin por ello desacreditar la moralidad como un todo. Por el contrario, las excepciones, adecuadamente entendidas, se hacen con la moralidad y por la moralidad. El trabajo sugiere, asimismo, una noción de dignidad kantiana –como concepto límite, y no como el concepto de una propiedad intrínseca de los agentes—, la cual no sólo es compatible con la idea de igualdad moral propuesta, sino que la complementa; además, contribuye a entender la compleja noción de excepción moral dentro del marco de una moral categórica kantiana.
