This paper seeks to determine the extent to which individuals with borderline personality disorders can be held morally responsible for a particular subset of their actions: disproportionate anger, aggressions and displays of temper. The rationale for focusing on these aspects lies in their widespread acknowledgment in the literature and their plausible primary association with blame directed at BPD patients. BPD individuals are indeed typically perceived as “difficult patients” (Sulzer 2015, Bodner et al. 2011), significantly more so than schizophrenic or depressive (...) patients (Markam 2003). The “responsibility question” for patients with BPD has already been raised (Martin 2010, Zachar & Potter 2009, Bray 2003), but this paper tackles it from a novel perspective. First, I narrow down the category of things for which the responsibility question is specific to individual with BPD. After that, I argue that some of the diagnosis criteria of BPD such as emotional instability or impulsivity might serve as excusing factors targeting the “control condition” on moral responsibility. Second, this paper also considers another widely accepted condition on moral responsibility: the epistemic condition. The view defended in the paper is that the answer to the responsibility question for individuals with BPD, concerning both the control condition and the epistemic condition, hinges on an understanding of their epistemic profile. No one is responsible for their conduct because free will is an illusion, say some skeptics. Even when it seems that we have several options, we only have one. Hence, says the free will skeptic, we should reform our practices which involve responsibility attributions, such as punishment and blame. How seriously should we take this doctrine? Is it one that we could live by? One thorn in the side of the skeptic concerns deliberation. When we deliberate about what to do—what (...) film to go see, whom to befriend, which doctrine to follow—we must presume that our options are open to us. But then, every time that skeptics deliberate, they presume something which is incompatible with their doctrine, i.e. that they have several options. In a word, skeptics cannot deliberate qua skeptics. Some philosophers have responded that deliberators don’t have to presume that their options are open; they only have to presume that their choice will be efficacious. I argue that this proposal uses resources which, if they are available and successful, can be employed to refute skepticism. The upshot is that free will skeptics are pushing for a doctrine that is either false or in tension with deliberation. (shrink)

C.C.E. Schmid’s doctrine of intelligible fatalism was immensely influential in the immediate reception of Kant’s philosophy. Existing treatments of this doctrine, largely neglected by modern scholarship, echo uncharitable interpretations espoused by Schmid’s contemporaries. I demonstrate that Schmid’s intelligible fatalism is more coherent and philosophically robust than hitherto recognized. I argue for a novel interpretation of Schmid’s account of rational agency, showing that intelligible fatalism is compatible with his conceptions of freedom, obligation, and imputation. Specifically, I argue that the role of (...) consciousness in this account carves out conceptual space for a distinction between the theoretical and the practical that is sufficient to render intelligible fatalism consistent with these conceptions. The time has come to consider whether experimental philosophy’s (“x-phi”) early arguments, debates, and conceptual frameworks, that may have worn well in its early days, fit with the diverse range of projects undertaken by experimental philosophers. Our aim is to propose a novel taxonomy for x-phi that identifies four paths from empirical findings to philosophical consequences, which we call the “fourfold route.” We show how this taxonomy can be fruitfully applied even at what one might have taken to be the (...) furthest edges of possible applications of x-phi in metaphysics and formal philosophy. Ultimately, the fourfold route helps us understand a different kind of empirical fact: the development of x-phi itself. (shrink)

A common compatibilist view says that we are free and morally responsible in virtue of the ability to respond aptly to reasons. Many hold a version of this view despite disagreement about whether free will requires the ability to do otherwise. The canonical version of this view is reductive. It reduces the pertinent ability to a set of modal properties that are more obviously compatible with determinism, like dispositions. I argue that this and any reductive view of abilities faces a (...) significant challenge: it cannot adequately explain the freedom-grounding element of this ability. The problem has the form of a dilemma. This leaves reasons-responsive compatibilists with two options: abandon theories of free will grounded in abilities or abandon reductive theories of abilities. Even though the idea that privacy is some kind of control is often presented as the standard view on privacy, there are powerful objections against it. The aim of this paper is to defend the control account of privacy against some particularly pressing challenges by proposing a new way to understand the relevant kind of control. The main thesis is that privacy should be analyzed in terms of source control, a notion that is adopted from discussions about moral responsibility.

A standard account of privacy says that it is essentially a kind of control over personal information. Many privacy scholars have argued against this claim by relying on so-called threatened loss cases. In these cases, personal information about an agent is easily available to another person, but not accessed. Critics contend that control accounts have the implausible implication that the privacy of the relevant agent is diminished in threatened loss cases. Recently, threatened loss cases have become important because Edward Snowden’s (...) revelation of how the NSA and GCHQ collected Internet and mobile phone data presents us with a gigantic, real-life threatened loss case. In this paper, I will defend the control account of privacy against the argument that is based on threatened loss cases. I will do so by developing a new version of the control account that implies that the agents’ privacy is not diminished in threatened loss cases. (shrink)

The term “consciousness” is very often, though not always, interchangeable with the term “awareness,” which is more colloquial to many ears. We say things like “are you aware that ...” often. Sometimes we say “have you noticed that ... ?” to express similar thoughts, and this indicates a close connection between consciousness (awareness) and attention (noticing), which we will come back to later in this chapter. Ned Block, one of the key figures in this area, provides a useful characterization of (...) what he calls “phenomenal consciousness.” For him, phenomenal consciousness is experience. Experience covers perceptions, e.g., when we see, hear, touch, smell, and taste, we typically have experiences, such as seeing colors and smelling odors. It also covers bodily awareness, e.g., we typically have experiences of our own bodily temperature and positions of limbs. In this essay, I answer that question and outline a new solution to the paradox of moral luck, the source-paradox solution. This solution both explains why the paradox arises and why moral luck does not exist. To make my case, I highlight a few key connections (...) between the paradox of moral luck and two related problems, namely the problem of free will and determinism and the paradox of self-creation. Piecing together intuitions, arguments, and insights from recent work on each of these three problems, I argue that the type of control necessary for moral responsibility can only be had by someone who is a genuine source of his own actions, but the relevant notion of sourcehood admits no coherent characterization. If our commonsense view of moral responsibility is incoherent, it is unsurprising that our commitment to the existence of morally responsible agents commits us to some paradoxical things—e.g. to both the existence and impossibility of moral luck. ABSTRACTI offer an interpretation of Nietzsche's striking idea of ‘the innocence of becoming’, and a partial defense of its import, namely, that no one is ever morally responsible or guilty for what they do and that many of the so-called reactive attitudes are misplaced. I focus primarily, though not exclusively, on the arguments as set out in Twilight of the Idols. First, there is Nietzsche's hypothesis, partly psychological and partly historical or anthropological, that the ideas of ‘free’ action or free (...) will, and of responsibility for actions freely chosen or willed, were introduced primarily in order to justify punishment. Call this the Genetic Thesis about Free Will. Second, there is Nietzsche's claim that the moral psychology, or ‘psychology of the will” as he calls it, that underlies this picture is, in fact, false – that, in fact, it is not true that every action is willed or that it reflects a purpose or that it originates in consciousness. Call these, in aggregate, the Descriptive Thesis about the Will. Finally, there is articulation of a programmatic agenda, namely, to restore the ‘innocence of becoming’ by getting rid of guilt and punishment based on guilt – not primarily because ascriptions of guilt and responsibility are false, but because a world understood as ‘innocent’, one understood in terms of ‘natural’ cause and effect, is a better world in which to live. I focus in particular on a reactive attitude often ignored by philosophers, but of crucial importance for Nietzsche, namely, revenge. I aim to explain and defend Zarathustra's recommendation: ‘Enemy’ you shall say, but not villain; sick you shall say, but not scoundrel; fool you shall say, but not ‘sinner.’ Nietzsche's views are contrasted with those of important modern writers on these topics, especially P.F. The terms ‘compatibilism’ and ‘incompatibilism’ were introduced in the mid-20th century to name conflicting views about the logical relationship between the thesis of determinism and the thesis that someone has free will. These technical terms were originally introduced within a specific research paradigm, the classical analytic paradigm. This paradigm is now in its final stages of degeneration and few free-will theorists still work within it (i.e. using its methods, granting its substantive background assumptions, etc.). This chapter discusses how the ambiguity (...) of the terms ‘incompatibilism’ and ‘compatibilism’ took root as the classical analytic paradigm declined and why this matters to the contemporary debate. Among other things, I explain why the ambiguity of these anachronistic terms, though relatively innocuous when they were first introduced, is now encouraging theorists to tolerate and perpetuate serious philosophical errors (e.g. to conflate relations as different in kind and importance as correlation and causation, to promote uncontentiously invalid arguments, and to equivocate in ways that keep the free-will debate mired in pseudo-stalemates). I also suggest a new framework for anyone looking for relief from the confusion and deadlock created by quixotic attempts to redefine classical narratives and jargon so that they adequately describe the dialectical contours of the contemporary free-will debate. In addition, this new framework allows philosophers to start cross-pollinating work on free will and other famous problems of luck and control, e.g. the paradox of moral luck. It is widely thought that, to be morally responsible for some action or omission, an agent must have had, at the very least, the general ability to do otherwise. As we argue, however, there are counterexamples to the claim that moral responsibility requires the general ability to do otherwise. We present several cases in which agents lack the general ability to do otherwise and yet are intuitively morally responsible for what they do, and we argue that such cases raise problems (...) for various kinds of accounts of moral responsibility. We suggest two alternative approaches to thinking about the connection between moral responsibility and abilities to do otherwise, one of which denies that there is any ability-to-do-otherwise requirement on moral responsibility and the other of which requires only an opportunity to do otherwise. We also argue that a general-ability-to-do-otherwise requirement not only faces counterexamples but also lacks positive motivation. (shrink)

In this paper I give a novel argument for this view that the AGENT concept has an externalist semantics. The argument argues the conclusion from two premises: first, that our first relationships to agents is through a subpersonal mechanism which requires for its function an agential proto-concept which refers directly; and second, that there is a continuity of reference between this proto-concept and the mature concept AGENT. I argue the first on the basis of results in the developmental psychology of (...) social cognition. I argue the second on the basis of a process of elimination, by considering three possibilities for the relationship between the two concepts. On the basis of these two premises the conclusion is drawn that AGENT is a concept that refers directly. That has the following consequences for the philosophy of action: first, that “action” is not an appropriate term for reductive analysis, as the causal theory of action assumes; and second, that we should be looking to the appropriate empirical disciplines for an elucidation of the concept. This work develops a philosophically credible and psychologically realisable account of control that is necessary for moral responsibility. We live, think, and act in an environment of subjective uncertainty and limited information. As a result, our decisions and actions are influenced by factors beyond our control. Our ability to act freely is restricted by uncertainty, ignorance, and luck. Through three articles, I develop a naturalistic theory of control for action as a process of error minimisation that extends over time. Thus (...) conceived, control can serve to minimise the influence of luck on action and enable freedom in uncertainty. -/- In Article 1, Thor Grünbaum and I argue for a psychologically plausible account of the kind of control that is necessary for moral responsibility. We begin by establishing the relationship between agentive contribution and responsibility-level control. One way to determine whether one the right kind and degree of control to be morally responsible is to track one’s degree of contribution to an action. However, a psychologically plausible account of control in terms of agentive contribution may seem to contradict the types of functional-mechanistic explanations used in cognitive science. In cognitive psychology and cognitive neuroscience, personal-level capacities are explained by a set of sub-personal mechanisms. Often, such explanations leave no room for a contribution by the agent. By integrating insights from theories of cognitive control and incorporating them into a philosophical account of intentions, we propose a way of thinking about the distribution of cognitive control resources as something the agent does. -/- Article 2 argues that a classic argument concerning luck, originally aimed at libertarianism, generalises beyond any specific theory of free will, and regardless of whether determinism or indeterminism is true. I call this mental luck. Because we all make decisions under conditions of relative uncertainty and limited information, it is possible for an agent to make decisions that are contrary to their own motivation. In such situations, it may be a matter of luck whether the agent makes the right decision. Mentally lucky decisions are not rationally governed by attitudes within the agent's perspective, and thus, may be indistinguishable from unlucky ones. From the perspective of the agent, such decisions may resemble the outcome of a lottery. Therefore, mental luck poses a challenge to most prominent theories of free action and moral responsibility. -/- Finally, article 3 engages with the issue of resultant luck, namely luck in how things turn out. Resultant luck raises a challenge for theories of moral responsibility because its existence suggests that one may be responsible for factors beyond one’s control. Prominent responses to resultant luck led to a choice between internalism and scepticism. I argue that familiar cases of resultant luck are based on the assumption that actions are events. Instead, I propose an alternative ontology of action as an ongoing goal-directed process with a many-shots structure. Described this way, cases of resultant luck are not representative of ordinary action. The proposal of action as a many-shots process is consistent with predictive coding, a cognitive architecture which centres around error minimisation. Under this framework, cases of resultant more luck are no longer failures of action, but rather anticipated errors to be settled within the ordinary process of action. (shrink)

The Bhagavadgītā, part of the sixth book of the Hindu epic The Mahābhārata, offers a practical approach to mokṣa, or liberation, and freedom from saṃsāra, or the cycle of death and rebirth. According to the approach, known as karmayoga, salvation results from attention to duty and the recognition of past acts that inform the present and will direct the future. In the Bhagavadgītā, Kṛṣṇa advocates selfless action as the ideal path to realizing the truth about oneself as well as the (...) ultimate reality. Kṛṣṇa proclaims that humans have rights only to actions and not to their results, whether good or bad. Therefore, humans should not desire any results whatsoever. The prisoner’s dilemma is a fictional story that shows why individuals who seek only their personal benefit meet worse outcomes than those possible by cooperating with others. The dilemma provides an effective, albeit often overlooked, method for studying the Hindu principle of niṣkāmakarma that is arguably the central teaching of the Bhagavadgītā. In the context of the prisoner’s dilemma, a prisoner who wants to uphold niṣkāmakarma may choose one of two decision-making strategies: to be indifferent and leave the decision to chance or to either pursue the common good or the other person’s benefit instead of his or her own. Assuming that followers of niṣkāmakarma can be goal-oriented, the second strategy is more appropriate than the first, as long as one pursues unselfish goals and remains both indifferent and uncommitted to personal benefit. It has often been noted that there is some tension between engaging in decision-making and believing that one’s choices might be predetermined. The possibility that our choices are predetermined forces us to consider, in our decisions, act-state pairs which are inconsistent, and hence to which we cannot assign sensible utilities. But the reasoning which justifies two-boxing in Newcomb’s problem also justifies associating a non-zero causal probability with these inconsistent act-state pairs. Put together these undefined utilities and non-zero probabilities entail that (...) expected utilities are undefined whenever it is a possibility that our choices are predetermined. There are three ways to solve the problem, but all of them suffer serious costs: always assume that, contrary to our evidence, the outcome of our present decision-making is not predetermined; give up the reasoning that justifies unconditional two-boxing in Newcomb’s problem; or allow epistemically impossible outcomes to contribute to expected utility, leading to the wrong results in a series of cases introduced by Ahmed :665–685, 2014a, Evidence, decision and causality, Cambridge University Press, Cambridge, 2014b). However they choose to respond, causal decision theorists cannot remain silent: the intuitive tension between decision-making and the possibility of predetermination can be made precise, and resolving it will require giving up something. I defend an instrumentalist account of moral responsibility and adopt Manuel Vargas’ idea that our responsibility practices are justified by their effects. However, whereas Vargas gives an independent account of morally responsible agency, on my account, responsible agency is defined as the susceptibility to developing and maintaining moral agency through being held responsible. I show that the instrumentalism I propose can avoid some problems more crude forms of instrumentalism encounter by adopting aspects of Strawsonian accounts. I then show the implications (...) for our understanding of responsibility: my account requires us to adopt a graded notion of responsibility and accept the claim that certain individuals may not be responsible because they are not susceptible to being influenced by our moral responsibility practices. Finally, I discuss whether the account is committed to allowing the instrumentalization of non-responsible individuals in cases where blaming them may benefit others’ moral agency. (shrink)

Skepticism about moral responsibility, or what is more commonly referred to as moral responsibility skepticism, refers to a family of views that all take seriously the possibility that human beings are never morally responsible for their actions in a particular but pervasive sense. This sense is typically set apart by the notion of basic desert and is defined in terms of the control in action needed for an agent to be truly deserving of blame and praise. Some moral responsibility skeptics (...) wholly reject this notion of moral responsibility because they believe it to be incoherent or impossible. Others maintain that, though possible, our best philosophical and scientific theories about the world provide strong and compelling reasons for adopting skepticism about moral responsibility. What all varieties of moral responsibility skepticism share, however, is the belief that the justification needed to ground basic desert moral responsibility and the practices associated with it—such as backward-looking praise and blame, punishment and reward (including retributive punishment), and the reactive attitudes of resentment and indignation—is not met. Versions of moral responsibility skepticism have historically been defended by Spinoza, Voltaire, Diderot, d’Holbach, Priestley, Schopenhauer, Nietzsche, Clarence Darrow, B.F. Skinner, and Paul Edwards, and more recently by Galen Strawson, Derk Pereboom, Bruce Waller, Neil Levy, Tamler Sommers, and Gregg D. Caruso. -/- Critics of these views tend to focus both on the arguments for skepticism about moral responsibility and on the implications of such views. They worry that adopting such a view would have dire consequences for our interpersonal relationships, society, morality, meaning, and the law. They fear, for instance, that relinquishing belief in moral responsibility would undermine morality, leave us unable to adequately deal with criminal behavior, increase anti-social conduct, and destroy meaning in life. Optimistic skeptics, however, respond by arguing that life without free will and basic desert moral responsibility would not be as destructive as many people believe. These optimistic skeptics argue that prospects of finding meaning in life or of sustaining good interpersonal relationships, for instance, would not be threatened. They further maintain that morality and moral judgments would remain intact. And although retributivism and severe punishment, such as the death penalty, would be ruled out, they argue that the imposition of sanctions could serve purposes other than the punishment of the guilty—e.g., it can also be justified by its role in incapacitating, rehabilitating, and deterring offenders. The proposal of moral enhancement as a valuable means to face the environmental, technological and social challenges that threaten the future of humanity has been criticized by a number of authors. One of the main criticisms has been that moral enhancement would diminish our freedom. It has been said that moral enhancement would lead enhanced people to lose their ‘freedom to fall’, that is, it would prevent them from being able to decide to carry out some morally bad actions, and (...) the possibility to desire and carry out these bad actions is an essential ingredient of free will, which would thus be limited or destroyed—or so the argument goes. In this paper we offer an answer to this criticism. We contend that a morally enhanced agent could lose the ‘freedom to fall’ without losing her freedom for two reasons. First, because we do not consider that a morally well-educated person, for whom the ‘freedom to fall’ is a remote option, is less free than an evildoer, and there is no reason to suppose that bioenhancement introduces a significant difference here. Second, because richness in the amount of alternative possibilities of action may be restored if the stated loss is compensated with an improvement in sensitivity and lucidity that can lead to seeing new options and nuances in the remaining possible actions. I here consider the reasonableness of punishing future autonomous military robots. I argue that it is an engineering desideratum that these devices be responsive to moral considerations as well as human criticism and blame. Additionally, I argue that someday it will be possible to build such machines. I use these claims to respond to the no subject of punishment objection to deploying autonomous military robots, the worry being that an “accountability gap” could result if the robot committed a war crime. (...) (Sparrow 2007). But these robots will be blameworthy and morally responsible for their wrongful conduct. Kako u svakodnevnom životu, tako i u pravu većinu ljudi smatramo odgovornim za postupke pretpostavljajući da su to njihovi postupci u smislu da nad njima imaju kontrolu. Pretpostavka koja dominira tradicionalnim filozofskim raspravama o moralnoj odgovornosti i teorijama kazne jeste da se osoba smatra moralno (pravno) odgovornom za počinjeni postupak ako taj postupak zavisi od nje na takav način da bi zaslužila osudu (kaznu) odnosno pohvalu (nagradu). Izazov koji prirodne nauke postavljaju pred ovakvo razumevanje moralne odgovornosti ne zaustavlja se na (...) klasičnoj mehanici već svoj novi, kompleksniji oblik zadobija pojavom kvantne mehanike, ali i razvojem neuronauke i psihologije. Relevantnost istraživanja prirodnih nauka za filozofske probleme objašnjavamo činjenicom da su drugu polovinu XX veka obeležila naturalistička metafizička i epistemološka nastojanja. Na ovaj način je otvoreno novo poglavlje odnosa filozofije i prirodnih nauka, a mi ga u ovom radu ispitujemo kroz razmatranje problema kompatibilnosti determinizma i moralne odgovornosti. Cilj rada je da ispitivanjem kako empirijskih argumenata kojima se u pitanje dovodi moralna odgovornost, tako i filozofskih argumenata koji figuriraju u ovim diskusijama ukažemo da rezultati naučnih istraživanja mogu biti plodonosni u kontekstu rasprava o slobodi volje, moralne odgovornosti i teorija kazne, isključivo ako na adekvatan način komuniciraju sa rezultatima filozofskih istraživanja zasnovanim na primeni filozofskih metoda poput metoda pojmovne analize. Claims about freedom and predestination are ubiquitous in movies, novels, and myths. These claims touch upon the philosophical problem of the compatibility of free will and determination. In order to make an informed judgment about whether these claims are true, it is helpful to know what philosophers have to say about free will. However, philosophical discussions are usually absent in popular culture. It is perhaps no wonder, since free will is a topic that has been discussed for millennia. Consequently, these (...) discussions have become quite complicated and not easy to decipher. This essay is a popular introduction to these discussions, accessible to readers without former acquaintance with the topic. I provide references to other works for readers interested in knowing more. My aim is to show that while there are persuasive arguments against free will, there are no fewer persuasive replies to these arguments. Free will is a fascinating topic, and I hope that acquaintance with the relevant philosophical discussion will prove useful for those who wonder if anyone is free to create their own destiny. There is an argument for incompatibilism that is based on the experience of agency. Authors who endorse this argument place pro tanto evidential weight on one or more of two putative aspects of the experience of being an agent: i) the experience of being the causal source of our actions; ii) the experience of having robust alternative possibilities available to one. With some exceptions, these authors and their critics alike neglect a third significant aspect of the experience of agency: iii) (...) the experience of the future as being modally open. This aspect is either neglected or conflated with or. In this paper I rehabilitate as a notable aspect in its own right, and demonstrate that it is a good candidate for having the same pro tanto evidential weight in the experiential argument for incompatibilism. Then, I go on to assess the prospects of this revised argument in the face of central compatibilist objections that are central to the literature. I find that it fares just as well, if not better, than the original argument. (shrink)

The main issue of this article is how to harmonize determinism and moral responsibility (the classic problem of free will) by reconsidering the philosophy of Avicenna. Certainly, Avicenna believes in determinism and in various works has emphasized the necessity of the effect by its sufficient cause. Avicenna, on the other hand, certainly believes in the moral responsibility of autonomous agents, including human beings. We have shown in the first step that he denies free will in the libertarian sense (the ability (...) to do otherwise) for any agents; Because this notion of free will requires objective possibilities and is not compatible with causal determinism. Avicenna has identified a new type of voluntary agent who does not need to have an over-intentional intention to do something. Here, he looks very similar to proponents of agent causation; His idea, however, was not intended to defend a libertarian notion of free will, but to get rid of the challenge of the infinite regress of wills. Hence, Avicenna can be considered one of the few proponents of the "compatibilist agent causation." In the second step, an overview of Avicenna's theory of action is drawn. Here, in particular, emphasis is placed on the activity of the soul in the stages of the causal process leading to action, and the quality of these activities is introduced as a criterion for the morality degree of the agent..
