This paper features Derk Pereboom’s replies to commentaries by Victor Tadros and Saul Smilansky on his non-retributive, incapacitation-focused proposal for treatment of dangerous criminals; by Michael McKenna on his manipulation argument against compatibilism about basic desert and causal determination; and by Alfred R. Mele on his disappearing agent argument against event-causal libertarianism.

Pereboom’s Four-Case Argument was once considered to be the most powerful of the manipulation arguments against compatibilism. However, because of Demetriou’s :595–617, 2010) response, Pereboom has significantly weakened his argument. Manipulation arguments in general have also been challenged by King : 65–83, 2013). In this paper, I argue that the Four-Case Argument resists both these challenges. One upshot is that Pereboom doesn’t need weaken his argument. Another is that compatibilists still need a response the Four-Case Argument. And another is that (...) we get a much better understanding of the Four-Case Argument, and of manipulation arguments more generally, than is currently available in the literature. (shrink)

According to manipulation arguments for incompatibilism, manipulation might undermine an agent’s responsibility even when the agent satisfies plausible compatibilist conditions on responsibility. According to Sripada, however, empirical data suggest that people take manipulation to undermine responsibility largely because they think that the manipulated act is in discord with the agent’s “deep self,” thus violating the plausible compatibilist condition of deep self concordance. This paper defends Sripada’s general methodological approach but presents data that strongly suggest that, contrary to Sripada’s contention, most (...) of the effect of manipulation on attributions of moral responsibility is unmediated by worries about inadequate information or deep self discordance. Instead, it depends largely on worries that the action is ultimately explained by factors outside the agent’s control, just as proponents of manipulation arguments have proposed. The compatibility of determinism and the ability to do otherwise has been implicitly assumed by many to be irrelevant to the viability of compatibilist responses to the manipulation argument for incompatibilism. I argue that this assumption is mistaken. The manipulation argument may be unsound. But even so, the manipulation argument, at the very least, undermines classical compatibilism, the view that free will requires the ability to do otherwise, and having that ability is compatible with determinism. This is because classical compatibilism, (...) in conjunction with any type of reply to the manipulation argument, has counterintuitive implications. In order to avoid such implications, we need not hold that determinism is incompatible with moral responsibility. But we must hold that determinism is incompatible with the ability to do otherwise. Alfred Mele’s zygote argument for incompatibilism is based on a case involving an agent in a deterministic world whose entire life is planned by someone else. Mele’s contention is that Ernie (the agent) is unfree and that normal determined agents are relevantly similar to him with regards to free will. In this paper, I examine four different ways of understanding this argument and then criticize each interpretation. I then extend my criticism to manipulation arguments in general. Incompatibilists believe free will is impossible if determinism is true, and they often claim that this view is supported by ordinary intuitions. We challenge the claim that incompatibilism is intuitive to most laypersons and discuss the significance of this challenge to the free will debate. After explaining why incompatibilists should want their view to accord with pretheoretical intuitions, we suggest that determining whether incompatibilism is in fact intuitive calls for empirical testing. We then present the results of our studies, which (...) put significant pressure on the claim that incompatibilism is intuitive. There are several argumentative strategies for advancing the thesis that moral responsibility is incompatible with causal determinism. One prominent such strategy is to argue that agents who meet compatibilist conditions for moral responsibility can nevertheless be subject to responsibility-undermining manipulation. In this paper, I argue that incompatibilists advancing manipulation arguments against compatibilism have been shouldering an unnecessarily heavy dialectical burden. Traditional manipulation arguments present cases in which manipulated agents meet all compatibilist conditions for moral responsibility, but are (allegedly) not responsible (...) for their behavior. I argue, however, that incompatibilists can make do with the more modest (and harder to resist) claim that the manipulation in question is mitigating with respect to moral responsibility. The focus solely on whether a manipulated agent is or is not morally responsible has, I believe, masked the full force of manipulation-style arguments against compatibilism. Determinism is a claim about the laws of nature: very roughly, it is the claim that everything that happens is determined by antecedent conditions together with the natural laws. Incompatibilism is a philosophical thesis about the relevance of determinism to free will: that the truth of determinism rules out the existence of free will. The incompatibilist believes that if determinism turned out to be true, it would also be true that we don't have, and have never had, free will. The (...) compatibilist denies that determinism has the consequences the incompatibilist thinks it has. According to the compatibilist, the truth of determinism does not preclude the existence of free will. (Even if we learned tomorrow that determinism is true, it might still be true that we have free will.) The philosophical problem of free will and determinism is the problem of understanding, how, if at all, the truth of determinism might be compatible with the truth of our belief that we have free will. When a person performs or fails to perform a morally significant action, we sometimes think that a particular kind of response is warranted. Praise and blame are perhaps the most obvious forms this reaction might take. For example, one who encounters a car accident may be regarded as worthy of praise for having saved a child from inside the burning car, or alternatively, one may be regarded as worthy of blame for not having used one's mobile phone to call for (...) help. To regard such agents as worthy of one of these reactions is to ascribe moral responsibility to them on the basis of what they have done or left undone. (These are examples of other-directed ascriptions of responsibility. The reaction might also be self-directed, e.g., one can recognize oneself to be blameworthy). Thus, to be morally responsible for something, say an action, is to be worthy of a particular kind of reaction —praise, blame, or something akin to these—for having performed it.[1.. (shrink)

A common style of argument in the literature on free will and moral responsibility is the Manipulation Argument. These tend to begin with a case of an agent in a deterministic universe who is manipulated, say, via brain surgery, into performing some action. Intuitively, this agent is not responsible for that action. Yet, since there is no relevant difference, with respect to whether an agent is responsible, between the manipulated agent and a typical agent in a deterministic universe, responsibility is (...) not compatible with the truth of determinism. In response, some theorists have argued that there is a relevant difference, and have developed two sorts of accounts of that difference: bypassing views, and manipulator-focused views. Manipulator-focused views suggest that the difference concerns the presence of a manipulator, whereas bypassing views suggest that the relevant difference concerns the fact that the action issues from attitudes that the manipulated agent acquired in a way that bypassed her capacities for control over her mental life. One sort of case used to decide between these sorts of accounts is a case of machine induction, which is just like a manipulation case, yet the change in the agent is the result of some natural force. Against the received view, Xiaofei Liu argues that such cases pose problems for bypassing views, and favor manipulator-focused views instead. This paper addresses Liu’s arguments, as well as a variety of cases, concluding that cases of machine induction do not provide motivation for a bypassing theorist to adopt a manipulator-focused view. I recently argued that reductive physicalist versions of libertarian free will face a physical indeterminism luck objection. John Lemos claims that one potential advocate of reductive physicalist libertarianism, Robert Kane, avoids this physical indeterminism luck objection. I here show how the problem remains.

Spontaneous freedom, the freedom of unplanned and unscripted activity enjoyed by “free spirits,” is central to everyday talk about “freedom.” Yet the freedom of spontaneity is absent from contemporary moral philosophers’ theories of freedom. This article begins to remedy the philosophical neglect of spontaneous freedom. I offer an account of the nature of spontaneous freedom and make a case for its value. I go on to show how an understanding of spontaneous freedom clarifies the free will debate by helping to (...) make sense of the libertarian claim that compatibilist varieties of freedom do not allow for genuine novelty and creativity. Manipulation arguments that start from the intuition that manipulated agents are neither free nor morally responsible then conclude to that free will and moral responsibility are incompatible with determinism. The Zygote argument is a special case of Manipulation argument in which the manipulation intervenes at the very conception of the agent. In this paper, I argue that the Zygote argument fails because (i) very few people share the basic intuitions the argument rests on, and (ii) even those who share this (...) intuition do so for reasons that are unrelated to determinism. Rather, I argue that intuitions about the Zygote argument (and Manipulation arguments in general) are driven by people's intuitions about the deep self, as shown by the fact that intuitions about manipulated agents depend on the moral value of the agent's behavior. One of my goals in what follows is to give a feel for the main lines of that debate in philosophy today. I will also be outlining a particular perspective on free will. Many working philosophers consider themselves Compatibilists; the perspective outlined, building on a number of arguments in the recent literature, is a contemporary form of such a view. (...) One of the most influential arguments against compatibilism is Derk Pereboom’s four-case manipulation argument. Professor Plum, the main character of the thought experiment, is manipulated into doing what he does; he therefore supposedly lacks moral responsibility for his action. Since he is arguably analogous to an ordinary agent under determinism, Pereboom concludes that ordinary determined agents lack moral responsibility as well. I offer a hard-line reply to this argument, that is, a reply which denies that this kind of manipulation is (...) responsibility undermining. I point out that fully fleshed-out manipulated characters in fiction can seem morally responsible for what they do. This is plausibly because we identify with such characters, and therefore focus on their options and the reasons for which they act rather than the manipulation. I further argue that we ought to focus this way when interacting with other agents. We have no reason to trust the incompatibilist intuitions that arise when we regard manipulated agents from a much more detached perspective. (shrink)

In a recent essay, Deery and Nahmias :1255–1276, 2017) utilize interventionism about causation to develop an account of causal sourcehood in order to defend compatibilism about free will and moral responsibility from manipulation arguments. In this paper, we criticize Deery and Nahmias’s analysis of sourcehood by drawing a distinction between two forms of causal invariance that can come into conflict on their account. We conclude that any attempt to resolve this conflict will either result in counterintuitive attributions of moral responsibility (...) or will undermine their response to manipulation arguments. The terms ‘compatibilism’ and ‘incompatibilism’ were introduced in the mid-20th century to name conflicting views about the logical relationship between the thesis of determinism and the thesis that someone has free will. These technical terms were originally introduced within a specific research paradigm, the classical analytic paradigm. This paradigm is now in its final stages of degeneration and few free-will theorists still work within it (i.e. using its methods, granting its substantive background assumptions, etc.). This chapter discusses how the ambiguity (...) of the terms ‘incompatibilism’ and ‘compatibilism’ took root as the classical analytic paradigm declined and why this matters to the contemporary debate. Among other things, I explain why the ambiguity of these anachronistic terms, though relatively innocuous when they were first introduced, is now encouraging theorists to tolerate and perpetuate serious philosophical errors (e.g. to conflate relations as different in kind and importance as correlation and causation, to promote uncontentiously invalid arguments, and to equivocate in ways that keep the free-will debate mired in pseudo-stalemates). I also suggest a new framework for anyone looking for relief from the confusion and deadlock created by quixotic attempts to redefine classical narratives and jargon so that they adequately describe the dialectical contours of the contemporary free-will debate. In addition, this new framework allows philosophers to start cross-pollinating work on free will and other famous problems of luck and control, e.g. the paradox of moral luck. In this paper I aim to establish that our belief in free will is epistemically innocent. Many contemporary accounts that deal with the potential “illusion” of freedom seek to describe the pragmatic benefits of belief in free will, such as how it facilitates or grounds our notions of moral responsibility or basic desert. While these proposals have their place (and use), I will not explicitly engage with them. I aim to establish that our false belief in free will is an (...) epistemically innocent belief. I will endeavour to show that if we carefully consider the circumstances in which particular beliefs (such as our belief in free will) are adopted, we can come to better appreciate not just their psychological but also their epistemic benefits. The implications, therefore, for future investigations into the philosophy of free will are that we should consider whether we have been too narrow in our pragmatic defences of free will, and that we should also be sensitive to epistemic considerations. In a series of recent papers, Justin Capes and Philip Swenson and Michael Robinson have proposed new versions of the flickers of freedom reply to Frankfurt-style cases. Both proposals claim, first, that what agents in FSCs are morally responsible for is performing a certain action on their own, and, second, that agents in FSCs retain robust alternative possibilities—alternatives in which the agent freely omits to perform the pertinent action on their own. In this paper, I argue that, by attending to (...) the details of the omissions in question, it becomes clear that agents in FSCs lack robust alternatives of this sort, for in the alternative sequences such agents do not freely omit. Since the problem for these recent proposals arises from their attempt to show that agents in FSCs retain robust alternatives, I go on to consider whether the flicker theorist might be better off either revising or rejecting the robustness requirement on alternative possibilities. I argue that neither alternative is available to the flicker theorist, and yet I also point out that the reasons why these alternatives are unavailable serve to highlight what exactly is at issue in the debate between leeway and sourcehood theorists, namely the grounds of our freedom. Skepticism about moral responsibility, or what is more commonly referred to as moral responsibility skepticism, refers to a family of views that all take seriously the possibility that human beings are never morally responsible for their actions in a particular but pervasive sense. This sense is typically set apart by the notion of basic desert and is defined in terms of the control in action needed for an agent to be truly deserving of blame and praise. Some moral responsibility skeptics (...) wholly reject this notion of moral responsibility because they believe it to be incoherent or impossible. Others maintain that, though possible, our best philosophical and scientific theories about the world provide strong and compelling reasons for adopting skepticism about moral responsibility. What all varieties of moral responsibility skepticism share, however, is the belief that the justification needed to ground basic desert moral responsibility and the practices associated with it—such as backward-looking praise and blame, punishment and reward (including retributive punishment), and the reactive attitudes of resentment and indignation—is not met. Versions of moral responsibility skepticism have historically been defended by Spinoza, Voltaire, Diderot, d’Holbach, Priestley, Schopenhauer, Nietzsche, Clarence Darrow, B.F. Skinner, and Paul Edwards, and more recently by Galen Strawson, Derk Pereboom, Bruce Waller, Neil Levy, Tamler Sommers, and Gregg D. Caruso. -/- Critics of these views tend to focus both on the arguments for skepticism about moral responsibility and on the implications of such views. They worry that adopting such a view would have dire consequences for our interpersonal relationships, society, morality, meaning, and the law. They fear, for instance, that relinquishing belief in moral responsibility would undermine morality, leave us unable to adequately deal with criminal behavior, increase anti-social conduct, and destroy meaning in life. Optimistic skeptics, however, respond by arguing that life without free will and basic desert moral responsibility would not be as destructive as many people believe. These optimistic skeptics argue that prospects of finding meaning in life or of sustaining good interpersonal relationships, for instance, would not be threatened. They further maintain that morality and moral judgments would remain intact. And although retributivism and severe punishment, such as the death penalty, would be ruled out, they argue that the imposition of sanctions could serve purposes other than the punishment of the guilty—e.g., it can also be justified by its role in incapacitating, rehabilitating, and deterring offenders. Matt King has recently argued that the manipulation argument against compatibilism does not succeed by employing a dilemma: either the argument infelicitously relies on incompatibilist sourcehood conditions, or the proponent of the argument leaves a premise of the argument undefended. This article develops a reply to King’s dilemma by showing that incompatibilists can accept its second horn. Key to King’s argument for the second horn’s being problematic is “the parallel manipulation argument.” I argue that King’s use of this argument is (...) problematic, but I suggest that a (modified) parallel manipulation argument is effective for a different, though more restricted, purpose. In the recent article “A new approach to manipulation arguments,” Patrick Todd seeks to reframe a common incompatibilist form of argument often leveraged against compatibilist theories of moral responsibility. Known as manipulation arguments, these objections rely on cases in which agents, though they have met standard compatibilist conditions for responsibility, have been manipulated in such a way that they fail to be blameworthy for their behavior. Traditionally, in order to get a manipulation argument off the ground, an incompatibilist must illustrate (...) that a manipulated agent is not at all responsible for her behavior. Todd argues that this is an unnecessarily heavy burden—the incompatibilist need only show that the presence of manipulation mitigates ascriptions of responsibility. Though innovative, Todd fails to present his modified manipulation argument in a way that poses a true threat to the compatibilist. In fact, by introducing a scalar conception of moral responsibility, Todd gives the compatibilist the tools necessary to better handle the incompatibilist’s original manipulation argument. (shrink)

Derk Pereboom has advanced a four-case manipulation argument that, he claims, undermines both libertarian accounts of free action not committed to agent-causation and compatibilist accounts of such action. The first two cases are meant to be ones in which the key agent is not responsible for his actions owing to his being manipulated. We first consider a “hard-line” response to this argument that denies that the agent is not morally responsible in these cases. We argue that this response invites a (...) dialectically uncharitable reading of the argument. We then propose an alternative interpretation; it affirms that, at least prima facie, the manipulated agent in the first two cases is not responsible. Finally, we question Pereboom’s rationale for why the manipulation in these cases subverts responsibility. (shrink)

Agents have no control over the formation of their own zygote. Others may do. According to a well-known argument, the so-called Zygote Argument for incompatibilism, these facts, together with a prima facie plausible further assumption, are sufficient to prove that human agents cannot be responsible for their actions if they live in a deterministic universe. This paper argues that the lack of agents’ control over the constitution of their own zygote can undermine their responsibility only in exceptional conditions and that (...) the occurrence or non-occurrence of those conditions has nothing to do with the truth or falsity of determinism. What undermines agents’ responsibility in the situations described by the Zygote Argument is the occurrence of some specific initial conditions which may render the manipulation of agents’ behaviour possible, and not the truth of determinism. Cases involving clandestine manipulation pose a significant challenge to compatibilist conceptions of free will. But compatibilists often argue that they are not alone and that modest libertarian conceptions of free will are also susceptible to the problem. I take issue with this claim. I argue that agent-causal libertarian views are not susceptible to the problem. I then argue that the compatibilist cannot cite a relevant difference between agent-causal libertarian views and modest libertarian views. Therefore from a compatibilist's perspective modest libertarian (...) views are impervious to the problem of clandestine manipulation. (shrink)

If determinism is a threat to freedom, that threat derives solely from its alleged eradication of power. The source incompatibilist mistakenly supposes that special views about the self are required to insure that we are the ultimate source of and in control of our decisions and actions. Source incompatibilism fails whether it takes the form of Robert Kane’s event-causal libertarianism or the various agent-causal varieties defended by Derk Pereboom and Randolph Clarke. It is argued that the sort of control free (...) agents need to possess and exercise can be secured without metaphysical excess. If there is a free will problem, it is the one G. E. Moore addressed in 1912. He concluded that persons can act otherwise in a deterministic world. We should continue to try to figure out whether he was right or wrong. (shrink)

The article aims to show that compatibilism can be defended against Pereboom’s ‘Four Case’ Manipulation Argument, hereinafter referred to as 4-Case MA, by combining the soft-line and the hard-line replies. In the first section, I argue that the original version of the 4-Case MA was refuted by the soft-line reply, but Pereboom’s modified version of the argument can’t be refuted this way. In the second section, I analyse McKenna’s hard-line reply to the original Pereboom’s 4-Case MA and argue that it (...) wasn’t completely successful. In section three, I present five new Pereboom-style cases. In section four, I argue that these new cases constitute a combination of the soft-line and hard-line defence against Pereboom’s modified multiple case manipulation argument. (shrink)

In a recent paper, Kristin Mickelson argues that Alfred Mele’s Zygote Argument, a popular argument for the claim that the truth of determinism would preclude free action or moral responsibility, is not valid. This sort of objection is meant to generalize to various manipulation arguments. According to Mickelson, the only way to make such arguments valid is to supplement them with an argument that is an inference to the best explanation. In this paper, I argue that there are two other (...) ways in which the proponent of such manipulation arguments can modify their argument, neither of which requires an inference to the best explanation. I then briefly consider and respond to a worry with one of these proposed solutions. (shrink)

This is the introduction to a volume of new essays in the metaphysics of moral responsibility by John Martin Fischer, Carl Ginet, Ishtiyaque Haji, Alfred R. Mele, Derk Pereboom, Paul Russell, and Peter van Inwagen. I provide some background for the essays, cover the main debates in the metaphysics of moral responsibility, and emphasize some of the authors' contributions to this area of philosophy.

Vicarious responsibility exists. It is (also) a species of moral responsibility. Nevertheless, it is seldomly discussed or considered as such in the main debates within moral philosophy. This article presents a case for the relevance of vicarious moral responsibility to several of these discussions. It seeks to provide new insights for the debate between historicism and structuralism and presents a further case for distinguishing between various facets of moral responsibility. Furthermore, the article demonstrates that an agent need not enter into (...) the relation of vicarious responsibility freely in order to be responsible. This idea then allows us to present new cases for compatibilism, demonstrating the consistency of moral responsibility with determinism. (shrink)
