In Fallacies and Judgments of Reasonableness, Frans H. van Eemeren, Bart Garssen and Bert Meuffels report on their systematic empirical research of the conventional validity of the pragma-dialectical discussion rules. The experimental studies they carried out during more than ten years start from the pragma-dialectical theory of argumentation developed at the University of Amsterdam, their home university. In these studies they test methodically the intersubjective acceptability of the rules for critical discussion proposed in this theory by confronting ordinary arguers who (...) have not received any special education in argumentation and fallacies with discussion fragments containing both fallacious and non-fallacious argumentative moves. The research covers a wide range of informal fallacies. In this way, the authors create a basis for comparing the theoretical reasonableness conception of pragma-dialectics with the norms for judging argumentative moves prevailing in argumentative practice. In this book some options concerning the greenhouse effect are assessed from a welfarist point of view: business as usual, stabilization of greenhouse gas emissions and reduction by 25% and by 60%. Up to today only economic analyses of such options are available, which monetize welfare losses. Because this is found to be wanting from a moral point of view, the present study welfarizes (among others) monetary losses on the basis of a hedonistic utilitarianism and other, justice incorporating, welfare ethics. For these welfarist evaluations information about the social consequences of the four options are collected from the literature and eventually corrected; then the consequences for individual well-being are assessed based on psychological research about well-being dependent on the social situation of the individual; finally the aggregation formulas of the respective welfare ethics are applied to these data. Assessments by other types of ethics, e.g. Kantian ethic, are included. The strongest abatement option is found to be optimum with great unanimity. - In addition a cost-welfare analysis of greenhouse gas abatement is undertaken revealing efficient cost-welfare ratios for these measures and the most efficient ratio for the strongest option. - A final, more theoretical part discusses the moral obligations following from such evaluations. The notion of 'moral obligation' is explained in a way that, apart from moral goodness of the required act, reinforcement by formal or informal sanctions is another necessary condition for moral obligations. This leads to a conception of a historical morality according to which the demands of morality rise in the long run. Applying this conception to the greenhouse effect implies that presently we have the moral duty to raise the standards of greenhouse gas abatement as much as is politically feasible. (shrink)

Some conspicuous characteristics of argumentation as we all know this phenomenon from our shared everyday experiences are in my view vital to its theoretical treatment because they should have methodological consequences for the way in which argumentation research is conducted. To start with, argumentation is in the first place a communicative act complex, which is realized by making functional verbal communicative moves.

The paper develops a classificatory system of basic argument types on the basis of the epis-temological approach to argumentation. This approach has provided strict rules for several kinds of argu-ments. These kinds may be brought into a system of basic irreducible types, which rely on different parts of epistemology: deductive logic, probability theory, utility theory. The system reduces a huge mass of differ-ent argument schemes to basic types and gives them an epistemological foundation.

In this paper the authors give a brief overview of the theoretical background of their research project “Linguistic indicators of argumentative moves.” Starting from the pragma-dialectical ideal model of a critical discussion, they design dialectical profiles for capturing the moves that may or must be made at a particular stage or sub-stage of such a discussion. They explain how these dialectical profiles can be methodically exploited for systematically identifying the verbal expressions that can be indicative of any of these moves (...) in argumentative practice. Mathematicians often speak of conjectures, yet unproved, as probable or well-confirmed by evidence. The Riemann Hypothesis, for example, is widely believed to be almost certainly true. There seems no initial reason to distinguish such probability from the same notion in empirical science. Yet it is hard to see how there could be probabilistic relations between the necessary truths of pure mathematics. The existence of such logical relations, short of certainty, is defended using the theory of logical probability (or objective Bayesianism (...) or non-deductive logic), and some detailed examples of its use in mathematics surveyed. Examples of inductive reasoning in experimental mathematics are given and it is argued that the problem of induction is best appreciated in the mathematical case. (shrink)

The present paper examines three parts of ancient school rhetoric: the issues, the topics, and the questions of style from the perspective of legal semiotics. It aims (1) to demonstrate the roles these have played and can play in the interpretation of legal discourses; and (2) to summarise what insights have been and can be gained from this classical tradition by contemporary legal research. It is argued that the promise of legal semiotics for rhetorical investigations is that it may help (...) to make sense of the functioning of the system of ancient rhetoric, and contribute to our understanding of how rhetorical tradition works, while the research of ancient rhetoric can explore a range of semiotic devices essential for lawyerly thinking, resulting in the knowledge of a richer framework of interpretation. Starting from a concept of reasonableness as well-consideredness, it is discussed in what way science could serve as a model for reasonable argumentation. It turns out that in order to be reasonable two requirements have to be fulfilled. The argumentation should comply with rules which are both problem-valid and intersubjectively valid. Geometrical and anthropological perspectives don't meet these criteria, but a critical perspective does. It is explained that a pragma-dialectical approach to argumentation which agrees with this critical perspective is indeed (...) problem-valid and that strong pragmatic and utilitarian arguments can be given for its intersubjective validity. Thus, conventional validity is promoted for a code of conduct for discussants who want to resolve their disputes reasonably by way of a critical discussion. (shrink)

The issue of the relationship between formal and informal logic depends strongly on how one understands these two designations. While there is very little disagreement about the nature of formal logic, the same is not true regarding informal logic, which is understood in various (often incompatible) ways by various thinkers. After reviewing some of the more prominent conceptions of informal logic, I will present my own, defend it and then show how informal logic, so understood, is complementary to formal logic.

This paper highlights the difference between Lilian Bermejo-Luque’s account of warrants with the quite different accounts of warrants offered by Toulmin, Hitchcock, and myself, and lays out some of the reasons why I think a “Toulminesque” account of warrants captures crucial aspects of arguing more adequately than her account does.

I characterize the deductivist ideal of justification and, following to a great extent Toulmin’s work The Uses of Argument, I try to explain why this ideal is erroneous. Then I offer an alternative model of justification capable of making our claims to knowledge about substantial matters sound and reasonable. This model of justification will be based on a conception of justification as the result of good argumentation, and on a model of argumentation which is a pragmatic linguistic reconstruction of Toulmin’s (...) model of argument. This paper argues that Habermas's conception of the rationality of moral and legal discussions has import for argumentation theorists interested in the rationality of public deliberations in politics and law. I begin with a survey of Haber mas's discourse theory and his criteria of rationality for moral and legal discourse. I then explain why, in his view, the forms of rational discourse in morality and law complement each other. My aim is to show how Habermas's account of this complementary relationship (...) opens up fruitful perspectives for argumentation theory. Specifically, his thought can stimulate research regarding, on the one hand, the ways in which legal procedures provide for presumptively rational resolutions of moral disputes and, on the other hand, the applicability of ideal argumentation-theoretic models to the legal field. This contribution discusses some problems of Pragma-Dialectics and explains them by its consensualistic view of the function of argumentation and by its philosophical underpinnings. It is suggested that these problems can be overcome by relying on a better epistemology and on an epistemological theory of argumentation. On the one hand Pragma-Dialectics takes unqualified consensus as the aim of argumentation, which is problematic, (Sect. 2) on the other it includes strong epistemological and rationalistic elements (Sect. 3). The problematic philosophical underpinnings of (...) Pragma-Dialectics, specifically Critical Rationalism as well as Logical Constructivism and Dialogic Logic of the Erlangen School, are among the sources of this incoherence (Sect. 4). A detailed critique of the Pragma-Dialectical discussion rules shows the negative consequences of this foundation and indicates how they could be avoided (Sects. 5, 6). (shrink)

The paper's thesis is that dialogue is not an adequate model for all types of argument. The position of Walton is taken as the contrary view. The paper provides a set of descriptions of dialogues in which arguments feature in the order of the increasing complexity of the argument presentation at each turn of the dialogue, and argues that when arguments of great complexity are traded, the exchanges between arguers are turns of a dialogue only in an extended or metaphorical (...) sense. It argues that many of the properties of engaged back-and-forth exchanges of paradigmatic argument dialogues are not found in ‘solo’ arguments, and that at least some of the norms appropriate to the former type of argument, such as some of the pragma-dialectical rules of van Eemeren and Grootendorst's model, do not apply to the latter. Philosophy has rendered a close attention to audiovisual communication in recent times, but this interest has not always had a parallel in the attention that television has paid to philosophical themes. Nevertheless, some examples of television approaches to philosophy have reached a quite remarkable level of quality. This paper will focus on one of such instances (the DVD Gadamer. Memoria de un siglo, produced by the Spanish Open National University). By means of an analysis of its main virtues and its (...) flaws (from a communicational outlook), we will try to obtain some general conclusions about how philosophical didactics and television can move ahead in their just begun cooperation. How do Dutch people let each other know that they disagree? What do they say when they want to resolve their difference of opinion by way of an argumentative discussion? In what way do they convey that they are convinced by each other’s argumentation? How do they criticize each other’s argumentative moves? Which words and expressions do they use in these endeavors? By answering these questions this short essay provides a brief inventory of the language of argumentation in Dutch.

This paper surveys the contributions to the study of argumentation in the two decades since the work of Toulmin and Perelman. Developments include Radical Argumentativism (Anscombre and Ducot), Communication and Rhetoric (American Speech Communication Theory), Informal Logic (Johnson and Blair), Formal Analyses of Fallacies (Woods and Walton), Formal Dialectics (Barth and Krabbe), and Pragma-Dialectics (van Eemeren and Grootendorst). From the survey it is concluded that argumentation theory has been considerably enriched. If the contributions can be made to converge, a sound (...) basis will be created for developing educational methods for producing, interpreting and evaluating argumentative discourse. Thus, argumentation theory may be instrumental in improving the quality of democracy by furthering a reasonable management of differences of opinion. (shrink)

This paper offers an account of the Hellnistic doctrine of krinomenon, elaborating on the idea of rhetoric’s restoration as a major tool of contemporary research and philosophical study. As opposed to theories of argumentation that identify judgment with its propositional version and establish legitimization on speaker-audience identity, failing to acknowledge difference and controversy, the doctrine of krinomenon focuses on the question posed, connecting rhetoric to judgment. The crucial difference from classical rhetoric lies in the concept of zētēma: In the doctrine (...) of krinomenon, participants in a common inquiry are reasonable, while logos refers to judgment itself – not the audience. Whereas a proposition dismisses its own problematization, controversy, i.e. non-identity that gives meaning to utterances, is inscribed in krinomenon, which is the product of dialectic between contradictory utterances. Beyond the two opposite logics of dogmatism and relativism, difference in the doctrine of krinomenon is judgment’s very condition. (shrink)

The aim of the paper is to advance the theory of argument or inference schemes by suggesting answers to questions raised by Walton's Argumentation Schemes for Presumptive Reasoning (1996), specifically on: the relation between argument and reasoning; distinguishing deductive from presumptive schemes, the origin of schemes and the probative force of their use; and the motivation and justification for their associated critical questions.

The Rhetoric to Alexander (about 340 B.C.) contains a list of proofs (pisteis) and other types of argumentation which may be seen as the oldest surviving typology of argumentation schemes (avant la lettre). In the present article this typology is derived and compared with modern proposals. The conclusion is that the oldest typology is surprisingly similar to the most recent classifications.

Do not define argument by its use to persuade. for other uses of arguments exist. An argument is a proposition and a reason for it. and argumentation is an interchange involving two or more parties resulting in the assertion of one or more arguments coupled with anticipated or actual critical responses. A logically good argument has grounds adeq uate for the purposes at hand (true, probable, plausible, acceptable to the audience) and the grounds provide adequate support for the conclusion. According to the argument scheme approach, to evaluate a given scheme-saturating instance completely does entail asking all critical questions relevant to it. Although this is a central task for argumentation theorists, the field currently lacks a method for providing a complete argument evaluation. Approaching this task at the meta-level, we combine a logical with a substantive approach to the argument schemes by starting from Toulmin’s schema: ‘data, warrant, so claim’. For the yet more general schema: ‘premise; if premise, then conclusion; (...) so conclusion’, we forward a meta-level CQ-list that is arguably both complete and applicable. This list should inform ongoing theoretical efforts at generating appropriate object-level CQs for specific argument schemes. (shrink)

In the present article I attribute to the common topic in the Rhetoric a two-fold suggestive function and a guarantee function. These three functions are possible because this type of topic, while often quite abstract, nevertheless contains thought-steering, substantial terms, and formulates a generally empirical or normative endoxon. Assuming that according to Aristotle an enthymeme has at least two premises, it would appear that a common topic is the abstract principle behind the often implicit major premise. This means that the (...) topic may be regarded as the – generalizing – if-then statement in a modern argumentation scheme. Therefore it should be possible to see the enthymemes of Rhetoric 2.23 as a combination of a logical argument form (which can usually be reconstructed as modus ponens) and an argumentation scheme – even though we may not attribute this idea to Aristotle himself. This article provides a basic general introduction to Ramus, and evaluates his role in the history of logic and rhetoric, especially with relation to the study of argumentation. The author agrees with Ong and other historians of logic that Ramus is not to be taken seriously as a logician, and that his undoubted importance in the history of ideas is to be found elsewhere.Ramus advocates a belief in nature, experience and reason, and rejects the reliance on the authority of ancient (...) philosophers, above all Aristotle, though ‘experience’ does not mean scientific experiment and, paradoxically, includes the example of great philosophers and writers. In the end Ramus is seen as responsible for substituting for ancient classical rhetoric an entirely ornamental rhetoric of figures which was to take over education (with the exception of the Jesuit schools) almost until our own day. This curtailing and diminishing of rhetoric is seen as a degeneration. Ancient five-part rhetoric had been concerned with convincing and persuading: Aristotle distinguished the analytic, scientific reasoning of logic, from dialectic which was based on opinion and probability and had close links with rhetoric; by the time of Cicero and Quintilian, who addressed themselves to jurists and politicians, logic has given way to dialectic. In the Middle Ages and the Renaissance the two become assimilated; the evolution of this is traced here through the thirteenth-century Summulae logicales of Peter of Spain to the fifteenth-century German humanist logician Rudolph Agricola, who influenced Ramus partly through the intermediary of Johann Sturm. Ramus took over their topical theories but restricted them to logic/dialectic, and left rhetoric with little more than tropes and figures. He believed that there was only one method for teaching all the arts, and one dialectic common to them all. The distinction between analytical and dialectical has disappeared, with far-reaching consequences for the study of argumentation. Over the centuries logic has lost its connection with controversy and persuasion. With the development of the post-Cartesian, post-Baconian emphasis on the clarity of scientific discourse, and the mid-nineteenth-century interest in mathematical and formal logic, the process was complete. Frank and William DriscollScholars do not have access to a complete bibliography of the new rhetoric project. We have redressed this problem by compiling what we believe is the most comprehensive bibliography to date of the works of Chaïm Perelman and of those he coauthored with Lucie Olbrechts-Tyteca. The bibliography includes all the English and French titles, as well as titles (...) that saw first publication in other languages. Translations we believe Perelman may have authorized or endorsed are included.With this bibliography, scholars can now better understand how the new rhetoric project was conceived and how it unfolded. Within the larger constellation of the project, Perelman's bibliography is the most extensive, numbering almost three hundred entries. The trajectory of Perelman's scholarship reveals the origins of the new rhetoric project and how it evolved between the time of his announcement in 1949 that he and Olbrechts-Tyteca had embarked on a program designed to rehabilitate reason and the period of his final articles in the 1980s. A review of the articles and books that came out of the Perelman and Olbrechts-Tyteca collaboration reveals both a phase of conceptualization and development of the project and a phase of culmination. In the first phase, commencing with Rhétorique et philosophie, the authors established the need for a rhetorically grounded philosophy. As they built toward the publication of the Traité, [End Page 449] the culmination of their ten-year effort, they wrote articles elaborating on "notions" in argumentation (1955) and on the tenets of the "new rhetoric" (1956). In 1958, the year the Traité appeared, they published articles on classical and romantic loci in argumentation and on time in argumentation. The Rhetoric to Alexander (second half of the fourth century B.C.) is among the oldest contributions to the study of argumentation. From antiquity on, this treatise, which abounds in opportunistic advice, has come under heavy criticism on normative grounds. And yet, as I shall maintain here, it clearly takes into account the requirements of rational argumentation which are still in use today. Moreover, it contains the seeds of a whole series of doctrines found in modern normative argumentation theory. There are (...) reasonable grounds for maintaining that some of these modern doctrines stem indirectly from the tradition to which the Rhetoric to Alexander belongs. (shrink)
