In this article, I will argue that it is time to rethink and reconfigure some of the established assumptions underlying our conception of moral responsibility. Specifically, there is a mismatch between the individualism of our common sense morality and the imperative for collaborative responses to global problems in what I will call the “collective age.” This must have an impact also on the way we think about the responsibility of corporations. I will argue that most plausibly we ought to reframe (...) corporate responsibility as a conception of collaborative responsibility. Such a conception of collaborative responsibility is characterized by five key elements: first, it is based on the moral imperative for collaboration. Second, it shifts emphasis from commission to omission. Third, it is not only negative but also, and perhaps essentially, positive responsibility. Fourth, it is political responsibility. And finally, it is, most basically, human rights responsibility. (shrink)

Overcoming corruption and authoritarian government in developing countries is hampered by global institutional arrangements. In particular, international borrowing and resource privileges, which entitle those exercising power in a country to borrow in its name and to effect legally valid transfers of ownership rights in its resources, can be obstacles to achieving democracy. These international conventions greatly increase the incentives toward attempts at coups d'état, especially in countries with a large resource sector. In exploring how this problem might be highlighted and (...) addressed, it is essential to understand that affluent societies have a great interest in upholding the prevailing institutional arrangements: Their banks benefit from their international lending and, far more importantly, their firms and people benefit greatly from cheap resource supplies. Institutional reform is more likely, then, to come from the developing countries.Thus, fledgling democracies may be able to improve their stability through constitutional amendments that bar future unconstitutional governments from borrowing in the country's name and from conferring ownership rights in its public property. Such amendments would render insecure the claims of those who lend to, or buy from, dictators, thus reducing the rewards of coups d'état. This strategy might be resisted by the more affluent societies, but such resistance could perhaps be overcome if many developing countries pursued the proposed strategy together, and if some moral support emerged among the citizenries of affluent societies. The article tries to inquire a third way in normative ethics between consequentialism or utilitarianism and deontology or Kantianism. To find such a third way in normative ethics, one has to analyze the elements of these classical theories and to look if they are justified. In this article it is argued that an adequate normative ethics has to contain the following five elements: (1) normative individualism, i. e., the view that in the last instance moral norms and values can only (...) be justified by reference to the individuals concerned, as its basis; (2) consideration of the individuals’ concerns and interests—aims, desires, needs, strivings—insofar as they have a justificatory function; (3) a pluralism of references of these concerns and hence of moral norms and values to all possible elements of actions; (4) the necessity of a principle of aggregation and weighing with regard to these concerns; (5) finally, as a central principle of aggregation and weighing, the principle of relative reference to self and others, operating as a generalizing meta-principle that guides the application of concrete principles and decisions. [EN] In this article the question of cultural diversity as it appears in the perspective of a republican conception of citizenship is discussed within three steps: in a first step, the ambiguous sense of the notion «citizenship» and its recently accelerated evolution will be presented; in a second step, the general features of the neo-republican approach will be outlined; and finally, the chances offered by a relecture of the republican topics with regard to an integration of the plurality of cultures (...) and ways of life, which coexist within the complex contemporary societies and which base on migration processes, will be brought to mind. El artículo defiende la tesis de que el liberalismo igualitario nos lleva a una teoría de justicia global y, como parte de ésta, a un derecho de inmigración. Así, el peso de la prueba contra la justicia global y la inmigración se desplaza hacia aquéllos que las desean limitar. Un argumento corriente es que las obligaciones especiales hacia nuestros conciudadanos tienen prioridad sobre las obligaciones generales de justicia. El artículo examina argumentos particularistas y reduccionistas a favor de estas obligaciones especiales, (...) y sostiene que éstos no justifican la restricción de la justicia hacia nuestros conciudadanos y tampoco la discrecionalidad total de los estados en el control de sus fronteras. In this paper, I examine the question of the scope of justice, in a not unusual distributive, egalitarian, and universalistic framework. Part I outlines some central features of the egalitarian theory of justice I am proposing. According to such a conception, justice is – at least prima facie – immediately universal, and therefore global. It does not morally recognize any judicial boundaries or limits. Part II examines whether, even from a universalistic perspective, there are moral or pragmatic grounds for rejecting (...) or limiting the global scope of justice. In particular, I scrutinize five universalistic objections: (1) the principle of “moral division of labor”; (2) the connection between cooperation and distributive justice; (3) the primacy of democracy; (4) the dangers of a world state; and (5) political‐pragmatic reasons. I intend to show that these objections cannot undermine the strong normative claims of global justice. At the most, political‐pragmatic reasons speak in favor of initially striving for somewhat less, in order to receive more general backing. (shrink)

En este artículo se critican aquellas posiciones que defienden la discrecionalidad de los Estados en relación al acceso de inmigrantes en el territorio de su soberanía y se investiga si desde la perspectiva de la justicia global se desprende un derecho a la movilidad libre y/o obligaciones de justicia distributiva global. Se argumenta que si lo que está en la base de la justicia global es exclusivamente la preocupación por la desigualdad de oportunidades y la pobreza, entonces existen buenas razones (...) a favor de la justicia distributiva global. Sin embargo, aun en este caso deben reconocerse restricciones importantes a la discrecionalidad estatal en temas de inmigración. (shrink)

With regard to the problem of world poverty, libertarian theories of corrective justice emphasize negative duties and the idea of responsibility whereas utilitarian theories of help concentrate on positive duties based on the capacity of the helper. Thomas Pogge has developed a revised model of compensation that entails positive obligations that are generated by negative duties. He intends to show that the affluent are violating their negative duties to ensure that their conduct will not harm others: They are contributing to (...) and profiting from an unjust global order. But the claim that negative duty generated positive obligations are more acceptable than positive duties is contestable. I examine whether Henry Shue’s model that is integrating negative duties and positive duties is more convincing concerning the foundation of positive duties to protect others. I defend the idea that there are positive duties of justice. This approach can integrate an allocation of positive duties via responsibility and maintain the advantage of an independent foundation of positive duties. (shrink)

The idea of empowerment has gained a significant role in the discourse of poverty. I outline a restricted conception of empowerment inspired by Kant’s idea of rightful honour. According to this conception, empowerment consists in enabling individuals to assert their own human rights (juridical empowerment). I apply this conception to impoverished persons and argue that it is crucial to their self-respect, their so-called ‘power-[from-]within,’ and their political agency, and has a teleological primacy regarding our efforts to reduce poverty. I also (...) defend the idea that there is a moral right to this form of empowerment and a corresponding duty to empower the impoverished as rights-asserters. Juridical empowerment will be compatible with a pluralism of substantive accounts of the moral wrongs of poverty and with broader conceptions of empowerment. (shrink)

The article deals with `The Symbolic Force of Human Rights'. First, it restricts the meaning of the term `symbolic' and of the expression `symbolic force'. Second, it discusses the concept of human rights. Having established the conceptual framework, the author goes to the core of his argument, characterizing the symbolic force of human rights as ambivalent: on one hand, it serves for their generalized affirmation and accomplishment; on the other hand, it acts as a manner of political manipulation. In this (...) regard, the article focuses, first, on the symbolic force of human rights at the level of national states, and then within the international and worldwide context, on criticizing finally the rhetorical use of human rights by nowadays' only superpower, the USA. One of the main lessons to be learned from the Greek crisis is that large scale supranational communitarisation is a danger for democracy if mutual obligations between members undermine substantially the possibilities of political choice for the single member states. I argue that a well-balanced relation between responsibility, solidarity, performance incentives and democracy involves taking subsidiarity serious, as well as to admit a certain amount of institutional flexibility. This flexibility is demanded especially in the case of large scale communities which (...) include countries as members, like the EU, and in which the basic ideas of social, economical and financial policy are rather heterogeneous. Democracy, responsibility and solidarity must be in a well balanced relation for any community to function and to be generally acceptable to the citizens. This includes the defence of rather ambitious forms of civil participation and sovereignty of the people against the paternalistic pretensions of experts or of political and cultural elites. And responsibility ―as a basic condition for democracy― requires that the design of the contractual basis of the EU must make possible that voting communities really assume responsibility for their decisions, which includes bearing possible negative consequences of these decision on themselves. Preserving a certain leeway for differing decisions about economical, financial or social questions is necessary for giving democratic substance to the demand of the primacy of politics. This puts serious limits to ambitions for treaty-based supranational communitisations. (shrink)

Höffe comparte con Kant la tesis de que la paz internacional no ha de entenderse como el resultado provisional de un equilibro de fuerzas entre distintas potencias ni como la ausencia empírica de hostilidades, sino como una paz jurídica basada en las pautas del derecho internacional. Abstract: To respond to globalization-related challenges, many contemporary political theorists have argued for forms of democracy beyond the level of the nation-state. Since the early 1990s, however, political theory has also witnessed a renewed normative defense of nationhood. Liberal nationalists have been influential in claiming that the state should protect and promote national identities, and that it is desirable that the boundaries of national and political units coincide. At first glance, both positions—global democracy and nationalism—seem to contradict each other. We (...) do not share this oppositional picture. In seiner Geschichtsphilosophie, insbesondere der „Idee zu einer allgemeinen Geschichte in weltbürgerlicher Absicht" (1784) erforscht Kant die Geschichte nicht in der bunten Fülle der Geschehnisse. Diese Aufgabe überlässt er der „eigentlichen bloß empirisch abgefassten Historie". Er betrachtet die Geschichte vielmehr, insoweit sie für den Menschen als praktisches Vernunftwesen von Interesse ist. Dabei wahrt er den Zusammenhang mit der transzendentalen Vernunftkritik und fragt, unter welchen erfahrungsunabhängigen Bedingungen der Gang der Geschichte als vernünftig, als sinnvoll erscheint. A diferencia de la guerra, la paz es una tarea de largo alcance. debido a los presupuestos comprendidos en ella, que sólo pueden verse a fondo considerando el conjunto de la obra kantiana, siendo precisamente ello lo presentado aquí.

Der Beitrag verfolgt das Ziel, die Entwicklung der Idee der Gerechtigkeit in der Neuzeit im Kontext des sozialen Wandels zu erhellen. Zu diesem Zweck wird nach einer einleitenden Erörterung des dieser Idee zugrundeliegenden Gerechtigkeitsbegriffs zuerst das Projekt einer vertragstheoretischen Begründung einer gerechten staatlichen Ordnung in der frühen Neuzeit vor dem Hintergrund des Herausbildung des modernen Staates behandelt. Im Anschluss werden die theoretischen Leitideen und gesellschaftlichen Triebkräfte des Kampfes um bürgerliche Freiheit und demokratische Teilhabe beleuchtet, wovon ausgehend dann die Entstehung der (...) heute vorherrschenden Vorstellung von sozialer Gerechtigkeit einer näheren Betrachtung unterzogen wird. Der Beitrag endet mit einigen Bemerkungen über die Gerechtigkeitsprobleme der Gegenwart und die künftigen Herausforderungen im Kampf um Gerechtigkeit. (shrink)

A presente obra assume-se como um projeto genuinamente interdisciplinar de reflexão ética, interrogando os seus fundamentos e explorando as suas interseções com diversas áreas das Ciências Humanas e Sociais. Reunindo especialistas de distintas áreas, oriundos de países diferentes, o livro tem como fio condutor um diálogo polifónico com o pensamento ético contemporâneo, enraizando-se na tradição crítica que procura refundar a racionalidade prática na construção humana de sentido e, por conseguinte, refutar o niilismo e o relativismo axiológico absoluto.

My paper consists of two parts. The first part deals with the fundamental normative standards of domestic social justice on the one hand and global justice on the other, standards that are requisite in order to identify injustices on both levels. On this basis, the second part focuses on the interrelations between domestic social justice and global justice with particular attention to the interdependencies between domestic and global injustices.

Este artículo discute algunas tesis acerca de la inmigración en general y de la inmigración clandestina en particular. Éstos son los pasos: 1) La manera mejor para discutir sobre la cuestión de la inmigración es servirse del concepto foucaltiano de dispositivo, que permite considerar el debate sobre tal cuestión como parte del mecanismo de control de la propia inmigración. 2) Hay una primera dificultad en la definición de la propia figura del inmigrante. 3) En el debate acerca de la inmigración (...) se pueden distinguir dos discursos oficiales: el discurso del control y el discurso de la adaptación, que todavía esconden una posición de rechazo del Otro. 4) El debate establece una distinción ontológica entre los inmigrantes y los ciudadanos, en el sentido de una ontología política que busca definir la comunidad política a través de la contraposición al Otro. Resumen La historia ocupa un papel marginal en las teorías actuales de la globalización. Esto no deja de sorprender, pues “globalización” es, en esencia, un concepto que describe un proceso de la historia. Menos aún se habla de la filosofía de la historia, sobre todo porque ha caído en descrédito. Sin embargo, casi todas las argumentaciones emplean modelos de interpretación propios de la filosofía de la historia. Se conjetura qué tendencias generales le son inherentes a la globalización y si apuntan (...) a un “progreso” o a una “decadencia” de la civilización humana. Por último, el problema ético de la justicia global debe tomar en consideración el desarrollo de la historia acontecida. Estos temas dejan claro que el recurso a la historia con implicaciones filosóficas es imprescindible para resolver los problemas de la globalización.Contemporary theories of globalisation seldom mention history. This is surprising, because “globalisation” is essentially a term describing an historical process. There is still less mention of the philosophy of history, especially due to the discredit cast upon it. And yet nearly all of the relevant arguments operate with patterns of interpretation borrowed from the philosophy of history. The authors speculate on which general tendencies are inherent to globalisation and whether they are more indicative of the “progress” or of the “downfall” of human civilisation. Finally, the ethical problem of global justice requires us to take into account the course of history thus far. These topics underline that resorting to history with all of its philosophical implications is essential if we are to resolve the problems caused by globalisation. (shrink)

Un mundo con “fronteras abiertas”, que no un “mundo sin fronteras”, aporta el marco institucional más propicio para el respeto de los derechos humanos y la instauración de la justicia distributiva a nivel planetario. En este artículo se argumenta a favor de esta tesis. El horizonte propuesto se compara con el actual estado de cosas, caracterizado por la obstrucción sistemática de la libre circulación de personas. Ante este panorama, y con el fin de afrontar de manera más integral la cuestión (...) de las migraciones internacionales, se señala la necesidad de adoptar una mirada cosmopolita. Mantener a la vista una opción situada más allá de lo realmente existente, que no de lo posible, resulta imprescindible para poder someter a una mirada crítica la inquietante perspectiva que nos presenta la movilidad humana como una potencial amenaza para el orden establecido. La imparable pérdida del poder soberano de los Estados nacionales y el correlativo afloramiento de una constelación postnacional serían dos de las grandes tendencias que, según Habermas, caracterizarían en términos políticos el actual estado de cosas en el mundo. Ante este contexto geopolítico emergente, cuyos lineamientos definitivos aún estarían por definir, Habermas perfila una posible respuesta política en clave democrática: recuperar el proyecto cosmopolita de Kant y avanzar en la juridificación de la esfera internacional. En ese horizonte, compatibilizar la necesidad (...) de una gobernanza global de los asuntos comunes de la humanidad y las exigencias de participación democrática constituye uno de los mayores escollos a salvar. La conformación de una praxis democrática postwestfaliana en concordancia con una estructuración multinivel de las relaciones internacionales podría representar una salida plausible. (shrink)

This interview explores the extent to which Kant’s philosophy, which postulates certain moral principles categorically, has influenced the contemporary theory of justice. Many academics believe such principles to be relative and emphasise that justice lies beyond the remit of science. Otfried Höffe is convinced that categorical legal principles remain a valid subject for an academic discussion. In his works, he often appeals to Kantian philosophy. In the interview, Prof. Dr. О. Höffe refers to such famous German Neo-Kantian philosophers of law (...) as R. Stammler and G. Radbruch. He also mentions J. Rawls and J. Habermas — self-confessed adherents of the Kantian tradition in moral philosophy. Prof. Dr. Höffe expounds his views on the problems discussed by these authors. He dismisses G. W. F. Hegel’s criticism of Kant and denies the dependence of the fundamental principles of justice on the Zeitgeist and the opinions of the masses. The interviewee calls freedom the supreme human value, advocates the idea of a democratic constitutional state (he considers the principles of a social state as a mission of the state rather than a subjective right of citizens), and argues that dictatorship and tyranny deserve resistance. Prof. Dr. Höffe gives detailed definitions of the notions of transcendental exchange, categorical legal principles, enlightened liberal democracy, and a world republic. This interview will supplement the body of Prof. Dr. Höffe’s works that have already been translated into Russian. (shrink)

Democracy seems to be no longer self-evident. Colin Crouch and others describe a growing sense of alienation in politics: democratic institutions and procedures may be working properly, yet they themselves promote non-democratic values such technocracy, oligarchy, elitism. For the citizens, only an illusion of democracy persists. The article argues that the weakening of democracy in practice mirrors the vanishing of democracy in political theory and philosophy. We may face a crisis of democratic politics as a result of a crisis of (...) democratic theory. Predominant theories of democracy fail, for the most part, to adequately reflect the changing social conditions in democratic societies and to offer a conception of democratic politics that would address current legitimacy deficits. The article discusses prominent theoretical approaches and points out that all have difficulties conceptualizing possible resources for democratization adequate to contemporary issues and conditions. A new version of political theory is outlined and defended, such that builds upon a redefined notion of democratic sovereignty and communicative power, complex enough to reflect the sociological reality of today’s politics and to reach beyond the institutionalized and formalized setting of democracy.
