Particularists in ethics emphasize that the normative is holistic, and invite us to infer with them that it therefore defies generalization. This has been supposed to present an obstacle to traditional moral theorizing, to have striking implications for moral epistemology and moral deliberation, and to rule out reductive theories of the normative, making it a bold and important thesis across the areas of normative theory, moral epistemology, moral psychology, and normative metaphysics. Though particularists emphasize the importance of the holism of (...) the normative, however, it is not something that they have been able to explain. In this paper I’ll show how to use a small number of simple and, I’ll argue, independently compelling assumptions in order to both predict and explain the holistic features of the normative with respect to the non-normative. The basic idea of the paper is simple. It is that normative claims are holistic because they are general, rather than because they defy generalization. (shrink)

Imperatives cannot be true or false, so they are shunned by logicians. And yet imperatives can be combined by logical connectives: "kiss me and hug me" is the conjunction of "kiss me" with "hug me". This example may suggest that declarative and imperative logic are isomorphic: just as the conjunction of two declaratives is true exactly if both conjuncts are true, the conjunction of two imperatives is satisfied exactly if both conjuncts are satisfied—what more is there to say? Much more, (...) I argue. "If you love me, kiss me", a conditional imperative, mixes a declarative antecedent ("you love me") with an imperative consequent ("kiss me"); it is satisfied if you love and kiss me, violated if you love but don't kiss me, and avoided if you don't love me. So we need a logic of three -valued imperatives which mixes declaratives with imperatives. I develop such a logic. (shrink)

Contemporary reasoning about health is infused with the work products of experts, and expert reasoning about health itself is an active site for invention and design. Building on Toulmin’s largely undeveloped ideas on field-dependence, we argue that expert fields can develop new inference rules that, together with the backing they require, become accepted ways of drawing and defending conclusions. The new inference rules themselves function as warrants, and we introduce the term “warranting device” to refer to an assembly of the (...) rule plus whatever material, procedural, and institutional resources are required to assure its dependability. We present a case study on the Cochrane Review, a new method for synthesizing evidence across large numbers of scientific studies. After reviewing the evolution and current structure of the device, we discuss the distinctive kinds of critical questions that may be raised around Cochrane Reviews, both within the expert field and beyond. Although Toulmin’s theory of field-dependence is often criticized for its relativism, we find that, as a matter of practical fact, field-specific warrants do not enjoy immunity from external critique. On the contrary, they can be opened to evaluation and critique from any interested perspective. (shrink)

Christian Kock’s essays show the essential interconnectedness of practical reasoning, rhetoric and deliberative democracy. They constitute a unique contribution to argumentation theory that draws on – and criticizes – the work of philosophers, rhetoricians, political scientists and other argumentation theorists. It puts rhetoric in the service of modern democracies by drawing attention to the obligations of politicians to articulate arguments and objections that citizens can weigh against each other in their deliberations about possible courses of action.

One response to the demandingness objection is that it begs the question against consequentialism by assuming a moral distinction between what a theory requires and what it permits. According to the consequentialist, this distinction stands in need of defense. However, this response may also beg the question, this time at the methodological level, regarding the credibility of the intuitions underlying the objection. The success of the consequentialist's response thus turns on the role we assign to intuitions in our moral methodology. (...) After presenting the demandingness objection to consequentialism and revealing the underlying methodological stalemate, I break the stalemate by appealing to research in the cognitive neuroscience of intuitions. Given the evidence for the hypothesis that our moral intuitions are fundamentally emotional (rather than rational) responses, we should give our intuitions a modest (rather than robust) role in our moral methodology. This rescues the consequentialist's response to the demandingness objection. (shrink)

‘Universalist’ moral principles have fallen into disfavour because too often they have been pretexts for unilateral impositions upon others, whether domestically or internationally. Too widely neglected has been Kant’s specifically Critical re-analysis of the scope and character of rational justification in all non-formal domains, including the entirety of epistemology and moral philosophy, including both justice and ethics. Rational judgment is inherently normative because it is in part constituted by our self-assessment of whether the considerations we now integrate into a candidate (...) judgment have been integrated as they ought, so as to form a cogent, justifiable judgment. Constitutive of this self-assessment is that rational judgments must be based upon considerations which can be communicated to all others, such that they too can assess them as sufficiently cogent justification; also constitutive of this rational self-assessment is that we actually engage with others who do assess our judgments. Kant’s Critical principles rule out in principle any unilateral imposition upon others, whether in cognition or morals. Using Kant’s Critical principles and methods in connection with ‘practical anthropology’ and the enormously important domain of acquired rights and obligations shows how Kant had already justified fundamentally universal principles of justice which can be institutionalised in variously distinctive cultures, and which form the proper bases for our acquired, specifically social rights and obligations, including those of friendship and community. In this paper, I discuss the relevance of the sense of justice for Rawls’s theory of justice. In the first part, I analyse the interpretation that Rawls offered of moral psychology for evaluating its role in the generation of the sense of justice and the acceptance of the principles of Justice. In the second part, I discuss the difficulties of accepting Rawls's proposal. Finally, I conclude that the research on moral psychology developed by Rawls allows him to recognise a way (...) of supporting his principles of justice that is different from the traditional forms of deductive justification. Understanding the social bases of what John Rawls meant by justice requires understanding a central part of Rawls’s professional life: his role as a teacher. As this essay shows, Rawls’s approach to teaching was not ancillary to his approach to heady philosophical issues like the justification of moral reasoning. Rather, there’s an ethic that runs through Rawls’s work, one focused on deliberation and consensus-seeking, and one whose strengths and weaknesses are easiest to see when you examine his teaching.

Adviser: Professor Stefan Baumrin In the first chapter I introduce the distinction between metaethics and normative ethics and argue that metaethics, properly conceived, is a part of cognitive science. For example, the debate between rationalism and sentimentalism can be informed by recent empirical work in psychology and the neurosciences. In the second chapter I argue that the traditional view that one’s theory of semantics determines what one’s theory of justification must be is mistaken. Though it has been the case that (...) there are ‘typical’ combinations of semantic and justificational theories this is by no means forced on one. In the third chapter I examine two current kinds of expressivism; that of Blackburn and Copp. Each gives us an example of different combinations of semantic and justificatory theory. In Blackburn’s case he combines a use theory of meaning with a classic emotivist theory of justification, In Copp’s case it is a neo-Gricean philosophy of language with a realist’s theory of justification. I find both of these wanting as they ultimately collapse into relativistic subjectivism. In the fourth and fifth chapter I turn to developing Emotive Realism. The basic idea behind this view is that when someone says ‘x is wrong/right’ that person has (a) expressed a moral emotion about x and at the same time (b) expressed the belief that the emotion in (a) is the correct one to have. The belief expressed in (b) will be true or false depending on one’s theory of justification. In the fourth chapter I argue that we need separate semantic theories for thoughts and sentences. In the fifth chapter I fill in the details of Emotive Realism as I see it. (shrink)

In this paper I compare and contrast Rawls’s notion of reflective equilibrium with Wellman‘s notion of conductive argument. In the course of so doing I will address two key questions: Are conduc-tive argument and reflective equilibrium best understood as modes of reasoning or types of argument? and What relationship, if any, is there between them?

Assertives have a word-to-world ‘direction-of-fit’: their illocutionary point is that the word should fit the world. Directives and commissives have a world-to-word direction-of-fit: their illocutionary point is to make the world fit the word. Arguments in politics and practical argumentation generally are often about directives or commissives, and many of these cannot meaningfully be reconstructed as assertives. Nevertheless, many theorists of argumentation proceed, tacitly or explicitly, as if all arguments must be about assertives, thereby obfuscating matters.

This book presents a selection of theoretical and applied texts of Richard Hare, as well as an appendix which includes several fundamental studies for the understanding of the ethics of 20th century.

The concept of warrant reflects Toulmin's general insights that validity in reasoning comes in many forms, and that reasoning in most fields cannot possess the necessity and certainty characteristic of the 'Rationalist' paradigm. However, there is a scarcity of concepts in one part of Toulmin's theory of argument. While the pedagogical applications of Toulmin's model offer a fine-grained system of warrant types for propositions, they have only one category of warrant for practical claims – the 'motivational' warrant. Fortunately, ancient rhetorical (...) thinking can help us correct this insufficiency. For example, the author of the rhetorical textbook used by Alexander the Great proposed a typology of practical warrants. His approach highlights what I propose to call the 'multidimensionality', and hence what modern moral philosophers call the 'incommensurability' of warrants – the absence of a common measure allowing for a 'rational' balancing of conflicting warrants. The widespread occurrence of multidimensionality in practical argument lends support to Toulmin's general anti-rationalist view of reasoning. Moreover, while multidimensionality prevents 'rational' balancing, it legitimizes and even necessitates the use of rhetoric in practical reasoning. (shrink)

Since Toulmin’s discovery of the field-dependency of arguments, and Perelman’s emphasis on audiences, argumentation theorists have developed the notion of “spheres of arguments” or “argument communities”. Since argument communities are communities of discourse guided by the participants’ cog-nitive experiences, they are also cognitive communities. “Cognitive breaks” between different argument communities will produce misunderstanding and futile argument. The paper will investigate “cognitive breaks” and describe in which ways they may obstruct reasonable argumentation between communities.

Anti-theory is a multi-faceted critique of moral theory which, it appears, is undergoing something of reassessment. In a recent paper Hämäläinen discusses the relevance of an anti-theoretical perspective for the activity of applied ethics. This paper explores her view of anti-theory. In particular I examine its relevance for understanding the formal guidance on pandemic flu planning issues by the Department of Health in the UK and some subsequent discussions around triage and reverse triage decisions which may be considered by both (...) Primary and Secondary Care Trusts. in setting their own policies and which may face clinicians in the eventuality of a pandemic. Following Hämäläinen in contrasting reflective equilibrium with her anti-theory inspired suggestion of an instrumental approach to moral theory in practice I demonstrate how this understanding complements the diversity of our intuitive moral judgements. Consequentially I suggest that this anti-theoretical instrumental approach is in greater accord with the conditions under which such policy planning and decision making is, or will be, made. Furthermore, on the grounds of keeping open the ethical dimensions of medical practice in conditions of uncertainty, i.e. during a pandemic, I suggest that the anti-theoretical instrumental perspective is, ethically, the preferable approach to producing such policies and guidelines.
