In this paper I will be arguing that there are cases in which a subject, S, should have known that p, even though, given her state of evidence at the time, she was in no position to know it. My argument for this result will involve making two claims. The uncontroversial claim is this: S should have known that p when another person has, or would have, legitimate expectations regarding S’s epistemic condition, the satisfaction of these expectations would require that (...) S knows that p, and S fails to know that p. The controversial claim is that these three conditions are sometimes jointly satisfied. I will spend the majority of my time defending the controversial claim. I will argue that there are two main sources of legitimate expectations regarding another’s epistemic condition: participation in a legitimate social practice ; and moral and epistemic expectations more generally . In developing my position on this score, I will have an opportunity to defend the doctrine that there are “practice-generated entitlements” to expect certain things, where it can happen that the satisfaction of these expectations requires another’s having certain pieces of knowledge; to contrast practice-generated entitlements to expect with epistemic reasons to believe; to defend the idea that moral and epistemic standards themselves can be taken to reflect legitimate expectations we have of each other; to compare the “should have known” phenomenon with a widely-discussed phenomenon in the ethics literature—that of culpable ignorance; and finally to suggest the bearing of the “should have known” phenomenon to epistemology itself. I respond to Tim Smartt’s (2023) skepticism about epistemic blame. Smartt’s skepticism is based on the claims that (i) mere negative epistemic evaluation can better explain everything proponents of epistemic blame say we need epistemic blame to explain; and (ii) no existing account of epistemic blame provides a plausible account of the putative force that any response deserving the label “blame” ought to have. He focuses primarily on the prominent “relationship-based” account of epistemic blame to defend these claims, arguing that (...) the account is explanatorily idle, and cannot distinguish between epistemically excused and epistemically blameworthy agents. I argue that Smartt mischaracterizes the account’s role for judgments of epistemic relationship impairment, leading to mistaken claims about the account’s predictions. I also argue that the very feature of the account that Smartt mischaracterizes is key to understanding what epistemic blame does for our epistemic responsibility practices that mere negative epistemic evaluation cannot. The paper develops an account of minimal traces devoid of representational content and exploits an analogy to a predictive processing framework of perception. As perception can be regarded as a prediction of the present on the basis of sparse sensory inputs without any representational content, episodic memory can be conceived of as a “prediction of the past” on the basis of a minimal trace, i.e., an informationally sparse, merely causal link to a previous experience. The resulting notion of episodic memory (...) will be validated as a natural kind distinct from imagination. This trace minimalist view contrasts with two theory camps dominating the philosophical debate on memory. On one side, we face versions of the Causal Theory that hold on to the idea that episodic remembering requires a memory trace that causally links the event of remembering to the event of experience and carries over representational content from the content of experience to the content of remembering. The Causal Theory, however, fails to account for the epistemic generativity of episodic memory and is psychologically and information-theoretically implausible. On the other side, a new camp of simulationists is currently forming up. Motivated by empirical and conceptual deficits of the Causal Theory, they reject not only the necessity of preserving representational content, but also the necessity of a causal link between experience and memory. They argue that remembering is nothing but a peculiar form of imagination, peculiar only in that it has been reliably produced and is directed towards an episode of one’s personal past. Albeit sharing their criticism of the Causal Theory and, in particular, rejecting its demand for an intermediary carrier of representational content, the paper argues that a causal connection to experience is still necessary to fulfill even the minimal requirements of past-directedness and reliability. The New Evil Demon Problem is supposed to show that straightforward versions of reliabilism are false: reliability is not necessary for justification after all. I argue that it does no such thing. The reliabilist can count a number of beliefs as justified even in demon worlds, others as unjustified but having positive epistemic status nonetheless. The remaining beliefs---primarily perceptual beliefs---are not, on further reflection, intuitively justified after all. The reliabilist is right to count these beliefs as unjustified in demon worlds, (...) and it is a challenge for the internalist to be able to do so as well. (shrink)

A plausible condition on having the standing to blame someone is that the target of blame's wrongdoing must in some sense be your “business”—the wrong must in some sense harm or affect you, or others close to you. This is known as the business condition on standing to blame. Many cases of epistemic blame discussed in the literature do not obviously involve examples of someone harming or affecting another. As such, not enough has been said about how an individual's epistemic (...) failing can really count as another person's business. In this paper, I deploy a relationship-based account of epistemic blame to clarify the conditions under which the business condition can be met in the epistemic domain. The basic idea is that one person's epistemic failing can be another's business in virtue of the way it impairs their epistemic relationship. (shrink)

Radical enactivism, an increasingly influential approach to cognition in general, has recently been applied to memory in particular, with Hutto and Peeters New directions in the philosophy of memory, Routledge, New York, 2018) providing the first systematic discussion of the implications of the approach for mainstream philosophical theories of memory. Hutto and Peeters argue that radical enactivism, which entails a conception of memory traces as contentless, is fundamentally at odds with current causal and postcausal theories, which remain committed to a (...) conception of traces as contentful: on their view, if radical enactivism is right, then the relevant theories are wrong. Partisans of the theories in question might respond to Hutto and Peeters’ argument in two ways. First, they might challenge radical enactivism itself. Second, they might challenge the conditional claim that, if radical enactivism is right, then their theories are wrong. In this paper, we develop the latter response, arguing that, appearances to the contrary notwithstanding, radical enactivism in fact aligns neatly with an emerging tendency in the philosophy of memory: radical enactivists and causal and postcausal theorists of memory have begun to converge, for distinct but compatible reasons, on a contentless conception of memory traces. In the recent metaethical literature there has been significant interest in the prospects for what I am denoting ‘Perceptual Intuitionism’: the view that normal ethical agents can and do have non-inferential justification for first-order ethical beliefs by having ethical perceptual experiences, e.g., Cullison 2010, McBrayer 2010, Vayrynen 2008. If true, it promises to constitute an independent a posteriori intuitionist epistemology, providing an alternative to intuitionist accounts which posit a priori intuition and/or emotion as sources of non-inferentially justified ethical beliefs. As (...) it is formulated, it is plausible that a necessary con- dition for the view is the truth of Ethical Perception: normal ethical agents can and do have perceptual experiences as of the instantiation of ethical properties. In this paper a sophisticated and promising account of Ethical Perception is offered. Extant objections are shown to fail. However, it will be argued that it is far from obvious that the account of Perceptual Intuitionism which emerges constitutes an independent alternative to other intuitionist accounts. This is because we have reason to think that ethical perceptual experience may be epistemically dependent on other epistemic sources, e.g. a priori intuition or emotion. (shrink)

Research in the psychology of deception detection implies that Fricker, in making her case for reductionism in the epistemology of testimony, overestimates both the epistemic demerits of the antireductionist policy of trusting speakers blindly and the epistemic merits of the reductionist policy of monitoring speakers for trustworthiness: folk psychological prejudices to the contrary notwithstanding, it turns out that monitoring is on a par (in terms both of the reliability of the process and of the sensitivity of the beliefs that it (...) produces) with blind trust. The consequence is that while (a version of) Fricker’s argument for the necessity of a reduction succeeds, her argument for the availability of reductions fails. This does not, however, condemn us to endorse standard pessimistic reductionism, according to which there is no testimonial knowledge, for recent research concerning the methods used by subjects to discover deception in non-laboratory settings suggests that only a more moderate form of pessimism is in order. This paper provides a novel argument for granting memory the status of a generative source of justification and knowledge. Memory can produce justified output beliefs and knowledge on the basis of unjustified input beliefs alone. The key to understanding how memory can generate justification and knowledge, memory generativism, is to bear in mind that memory frequently omits part of the stored information. The proposed argument depends on a broadly reliabilist approach to justification.

In recent years there has been renewed philosophical interest in the thesis that perceptual experience is cognitively penetrable, i.e., roughly, the view that the contents and/or character of a subject's perceptual experience can be modified by what a subject believes and desires. As has been widely noted, it is plausible that cognitive penetration has implications for perception's epistemic role. On the one hand, penetration could make agents insensitive to the world in a way which epistemically 'downgrades' their experience. On the (...) other hand, cognitive penetration may sometimes be epistemically beneficial by making agents more sensitive to the way the world is, i.e., by enabling them to see things that others cannot. For example, penetration could ground a 'high-level' view of perceptual content, according to which agents can have experiences as of 'complex' properties, e.g., natural kind and aesthetic properties. Relatedly, it could elucidate the view that agents can gain perceptual expertise by learning. A type of sophisticated perception which has hitherto received little attention in relation to cognitive penetration is ethical perception. In this paper I examine the significance of cognitive penetration for 'Perceptualist' views in ethics which appeal to a notion of 'ethical perception'. Although cognitive penetration could ground a literalist model of Ethical Perception according to which agents can have perceptual experiences of the instantiation of ethical properties, the results are otherwise somewhat mixed: cognitive penetrability does not support Perceptual Intuitionism, although it may provide some limited support for Virtue Ethics and Cornell Realism. However, as I stress, the significance of cognitive penetration for Perceptualism should not be overstated. (shrink)

Recently, a view I refer to as “hypothetical continuism” has garnered some favour among philosophers, based largely on empirical research showing substantial neurocognitive overlaps between episodic memory and imagination. According to this view, episodically remembering past events is the same kind of cognitive process as sensorily imagining future and counterfactual events. In this paper, I first argue that hypothetical continuism is false, on the basis of substantive epistemic asymmetries between episodic memory and the relevant kinds of imagination. However, I then (...) propose and defend an alternative form of continuism, according to which episodic memory is continuous with a capacity I call “actuality-oriented imagination.” Because of the deep epistemic affinities between episodic memory and actuality-oriented imagination, it makes sense to think of them as cognitive processes of the same kind. In recent years there has been a resurgence of interest in Ethical Intuitionism, whose core claim is that normal ethical agents can and do have non-inferentially justified first-order ethical beliefs. Although this is the standard formulation, there are two senses in which it is importantly incomplete. Firstly, ethical intuitionism claims that there are non-inferentially justified ethical beliefs, but there is a worrying lack of consensus in the ethical literature as to what non-inferentially justified belief is. Secondly, it has been overlooked (...) that there are plausibly different types of non-inferential justification, and that accounting for the existence of a specific sort of non-inferential justification is crucial for any adequate ethical intuitionist epistemology. In this context, it is the purpose of this paper to provide an account of non- inferentially justified belief which is superior to extant accounts, and, to give a refined statement of the core claim of ethical intuitionism which focuses on the type of non- inferential justification vital for a plausible intuitionist epistemology. Finally, it will be shown that the clarifications made in this paper make it far from obvious that two intuitionist accounts, which have received much recent attention, make good on intuitionism’s core claim. Relativism and contextualism have been suggested as candidate semantics for “knowledge” sentences. I argue that relativism faces a problem concerning the preservation of beliefs in memory. Contextualism has been argued to face a similar problem. I argue that contextualists, unlike relativists, can respond to the concern. The overall upshot is that contextualism is superior to relativism in at least one important respect.

Generativism about memory justification is the view that memory can generate epistemic justification. Generativism is gaining popularity, but process reliabilists tend to resist it. Process reliabilism explains the justification of beliefs by way of the reliability of the processes they result from. Some advocates of reliabilism deny various forms of generativism. Other reliabilists reject or remain neutral about only the more extreme forms. I argue that an extreme form of generativism follows from reliabilism. This result weakens a long-standing argument for (...) reliabilism. (shrink)

What entitles you to rely on information received from others? What entitles you to rely on information retrieved from your own memory? Intuitively, you are entitled simply to trust yourself, while you should monitor others for signs of untrustworthiness. This article makes a case for inverting the intuitive view, arguing that metacognitive monitoring of oneself is fundamental to the reliability of memory, while monitoring of others does not play a significant role in ensuring the reliability of testimony.

Philosophers and psychologists often distinguish episodic or personal memory from propositional or semantic memory. A vexed issue concerns the role, if any, of memory “impressions” or “seemings” within the latter. According to an important family of approaches, seemings play a fundamental epistemological role vis-à-vis propositional memory judgments: it is one’s memory seeming that Caesar was murdered, say, that justifies one’s judgment that he was murdered. Yet, it has been convincingly argued that these approaches lead to insurmountable problems and that memory (...) seemings are not wellsuited to play this justifying role. As a result, many contemporary accounts of propositional memory dispense with these seemings altogether. Is the idea that memory seemings play a key role in propositional memory really the result of bad theorizing? My aim is to shed light on this issue, which I will approach as follows. In Section 1, I contrast episodic memory with propositional memory so as to clarify the nature of the latter. According to the account I put forward, episodic memory consists in the preservation of acquaintance with objects and events, whereas propositional memory consists in the preservation of thought contents. In Section 2, I turn my attention to the contrast between propositional memory contents and propositional memory as an attitude. I argue that they play different roles. Memory contents satisfy a past awareness constraint and a causal constraint; the attitude of remembering explains why we are inclined to endorse these contents. This distinction leads me to explore the attitude of remembering, and I argue, in Section 3, that the most appealing account of this attitude is in terms of feelings of familiarity. In Section 4, I turn my attention to the epistemology of propositional memory and revisit the claim that propositional memory judgments are justifi ed by memory seemings. In so doing, I contend that the attitude of remembering plays an exclusively explanatory role and does not contribute to the epistemology of propositional memory judgments. I conclude by drawing a more general lesson regarding the respective roles of attitudes and contents. (shrink)

Observer memories involve a representation of the self in the memory image, which is presented from a detached or external point of view. That such an image is an obvious departure from how one initially experienced the event seems relatively straightforward. However, in my book on this type of imagery, I suggested that such memories can in fact, at least in some cases, accurately represent one’s past experience of an event. During these past events there is a sense in which (...) we adopt an external perspective on ourselves. In the present paper, I respond to a critical notice of my book by Marina Trakas. Trakas argues that my account of observer memory unfolded against the background of a problematic preservationist account of episodic memory, and that I failed to adequately account for the presence of self in observer memory. I respond these worries here, and I try to clarify key points that were underdeveloped in the book. (shrink)

This paper explores the possibility that testimony is an a priori source, even if not a basic source, of rational support for certain kinds of cognitions, particularly for a kind of acceptance that it is natural to call presumption. The inquiry is conducted in the light of two important distinctions and the relation between them. One distinction is between belief and acceptance, the other between justification and rationality. Cognitive acceptance is also distinguished from behavioral acceptance, and their normative status is (...) shown to be governed by quite different principles. A major focus in the paper is the question of how the epistemic authority of testimony for cognitive acceptance of its content may depend on normative elements implicit in the kind of language learning and social coordination that are normal for at least the majority of human beings. This article sets forth a view about how epistemic justification figures in the ongoing justification of memory belief, a view that I call moderate justificational preservationism . MJP presupposes a nontraditional notion of memorial justification according to which what makes one's present belief that p prima facie justified is that which provided one with prima facie justification to believe that p originally . The article offers support for MJP by examining a series of cases that involve forgetting, and in doing (...) so, criticizes views of Jennifer Lackey, David Owens, Michael Huemer, and George Pappas. ABSTRACT The contemporary epistemological debate regarding the epistemic role of memory is dominated by the dispute between two different views: memory preservationism and memory generativism. While the former holds that memory only preserves the epistemic status already acquired through another source, the latter advocates that there are situations where memory can function as a generative epistemic source. Both views are problematic and have to deal with important objections. In this paper, I suggest a novel argument for granting memory the status (...) of a generative source of justification and knowledge that overcomes objections raised for both preservationism and generativism. I shall call this view Memory Compatibilism. I argue that the proposed view better explains the generative epistemic character of memory.RESUMO O debate epistemológico contemporâneo acerca do papel epistêmico da memória tem sido dominado pela disputa entre duas visões diferentes: o preservacionismo da memória e o gerativismo da memória. Enquanto o primeiro sustenta que a memória apenas preserva o status epistêmico já adquirido via outra fonte, o último defende que existem situações em que a memória pode funcionar como uma fonte epistêmica geradora. Ambas as visões são problemáticas e têm de lidar com objeções importantes. Neste artigo, sugiro um novo argumento para conceder à memória o status de fonte geradora de justificação e conhecimento que supera as objeções levantadas contra o preservacionismo e o geracionismo. I argue against preservationism, the epistemic claim that memories can at most preserve knowledge generated by other basic types of sources. I show how memories can and do generate knowledge that is irreducible to other basic sources of knowledge. In some epistemic contexts, memories are primary basic sources of knowledge; they can generate knowledge by themselves or with trivial assistance from other types of basic sources of knowledge. I outline an ontology of information transmission from events to memory as an (...) alternative to causal theories of memory. I derive from information theory a concept of reliability of memories as the ratio of retrieved information to transmitted information. I distinguish the generation of knowledge from reliable memories from its generation from unreliable memories. Reliable memories can generate new knowledge by forming together narratives and via colligation. Coherent, even unreliable, memories can generate knowledge if they are epistemically independent of each other and the prior probability of the knowledge they generate is sufficiently low or high. Ascertaining the epistemic independence of memories and eliminating possible confounders may be achieved through the generation of knowledge from independent memories in different minds, when memories are primary basic sources of knowledge and the testimonies that report them are trivial.
