Since it appeared in 1971, John Rawls's A Theory of Justice has become a classic. The author has now revised the original edition to clear up a number of difficulties he and others have found in the original book. Rawls aims to express an essential part of the common core of the democratic tradition--justice as fairness--and to provide an alternative to utilitarianism, which had dominated the Anglo-Saxon tradition of political thought since the nineteenth century. Rawls substitutes the ideal of the (...) social contract as a more satisfactory account of the basic rights and liberties of citizens as free and equal persons. "Each person," writes Rawls, "possesses an inviolability founded on justice that even the welfare of society as a whole cannot override." One of the reasons why most of us feel puzzled about the problem of abortion is that we want, and do not want, to allow to the unborn child the rights that belong to adults and children. When we think of a baby about to be born it seems absurd to think that the next few minutes or even hours could make so radical a difference to its status; yet as we go back in the life of the fetus we (...) are more and more reluctant to say that this is a human being and must be treated as such. No doubt this is the deepest source of our dilemma, but it is not the only one. For we are also confused about the general question of what we may and may not do where the interests of human beings conflict. We have strong intuitions about certain cases; saying, for instance, that it is all right to raise the level of education in our country, though statistics allow us to predict that a rise in the suicide rate will follow, while it is not all right to kill the feeble-minded to aid cancer research. It is not easy, however, to see the principles involved, and one way of throwing light on the abortion issue will be by setting up parallels involving adults or children once born. Bernard Williams is remembered as one of the most brilliant and original philosophers of the past fifty years. Widely respected as a moral philosopher, Williams began to write about politics in a sustained way in the early 1980s. There followed a stream of articles, lectures, and other major contributions to issues of public concern--all complemented by his many works on ethics, which have important implications for political theory. This new collection of essays, most of them previously unpublished, addresses many of (...) the core subjects of political philosophy: justice, liberty, and equality; the nature and meaning of liberalism; toleration; power and the fear of power; democracy; and the nature of political philosophy itself. A central theme throughout is that political philosophers need to engage more directly with the realities of political life, not simply with the theories of other philosophers. Political realism is characterised by fidelity to the facts of politics and a refusal to derive political judgments from pre- political moral commitments. Even when they are not taken to make normative theorising impossible or futile, those characteristics are often thought to engender a conservative slant, or at least a tendency to prefer incremental reformism to radicalism. I resist those claims by distinguishing between three variants of realism—ordorealism, contextual realism, and radical realism—and contrasting them with both non-ideal theory and utopianism. (...) I then develop a version of radical realism as a form of debunking and vindicatory genealogy. Even though this new approach eschews both feasibility constraints (unlike non-ideal theory) and prescriptions about the ideal society (unlike utopianism), I show how it has more radical potential than morality-driven (and hence often ideological) political theory, and how it supports both open-ended, radical social critique and concrete forms of prefigurative political action. Williams did not think of political problems as a mere adjunct to ethical questions. He believed that there can be no timeless justification of political power, which he takes Kant and Rawls to aim at. Likewise, liberalism ignores that legitimation depends on historical circumstances. Williams’s historical relativism comes hand in hand with a realism that makes him object to utopian theories. A new understanding of political philosophy from one of its leading thinkers What is political philosophy? What are its fundamental problems? And how should it be distinguished from moral philosophy? Self-driving cars hold out the promise of being safer than manually driven cars. Yet they cannot be a 100 % safe. Collisions are sometimes unavoidable. So self-driving cars need to be programmed for how they should respond to scenarios where collisions are highly likely or unavoidable. The accident-scenarios self-driving cars might face have recently been likened to the key examples and dilemmas associated with the trolley problem. In this article, we critically examine this tempting analogy. We identify three important ways (...) in which the ethics of accident-algorithms for self-driving cars and the philosophy of the trolley problem differ from each other. These concern: the basic decision-making situation faced by those who decide how self-driving cars should be programmed to deal with accidents; moral and legal responsibility; and decision-making in the face of risks and uncertainty. In discussing these three areas of disanalogy, we isolate and identify a number of basic issues and complexities that arise within the ethics of the programming of self-driving cars. (shrink)

A number of companies including Google and BMW are currently working on the development of autonomous cars. But if fully autonomous cars are going to drive on our roads, it must be decided who is to be held responsible in case of accidents. This involves not only legal questions, but also moral ones. The first question discussed is whether we should try to design the tort liability for car manufacturers in a way that will help along the development and improvement (...) of autonomous vehicles. In particular, Patrick Lin’s concern that any security gain derived from the introduction of autonomous cars would constitute a trade-off in human lives will be addressed. The second question is whether it would be morally permissible to impose liability on the user based on a duty to pay attention to the road and traffic and to intervene when necessary to avoid accidents. Doubts about the moral legitimacy of such a scheme are based on the notion that it is a form of defamation if a person is held to blame for causing the death of another by his inattention if he never had a real chance to intervene. Therefore, the legitimacy of such an approach would depend on the user having an actual chance to do so. The last option discussed in this paper is a system in which a person using an autonomous vehicle has no duty of interfering, but is still held responsible for possible accidents. Two ways of doing so are discussed, but only one is judged morally feasible. (shrink)

This paper argues against the view that trolley cases are of little or no relevance to the ethics of automated vehicles. Four arguments for this view are outlined and rejected: the Not Going to Happen Argument, the Moral Difference Argument, the Impossible Deliberation Argument and the Wrong Question Argument. In making clear where these arguments go wrong, a positive account is developed of how trolley cases can inform the ethics of automated vehicles.

Trolley cases are widely considered central to the ethics of autonomous vehicles. We caution against this by identifying four problems. Trolley cases, given technical limitations, rest on assumptions that are in tension with one another. Furthermore, trolley cases illuminate only a limited range of ethical issues insofar as they cohere with a certain design framework. Furthermore, trolley cases seem to demand a moral answer when a political answer is called for. Finally, trolley cases might be epistemically problematic in several ways. (...) To put forward a positive proposal, we illustrate how ethical challenges arise from mundane driving situations. We argue that mundane situations are relevant because of the specificity they require and the scale they exhibit. We then illustrate some of the ethical challenges arising from optimizing for safety, balancing safety with other values such as mobility, and adjusting to incentives of legal frameworks. (shrink)

Autonomous vehicles must be programmed with procedures for dealing with trolley-style dilemmas where actions result in harm to either pedestrians or passengers. This paper outlines a Rawlsian algorithm as an alternative to the Utilitarian solution. The algorithm will gather the vehicle’s estimation of probability of survival for each person in each action, then calculate which action a self-interested person would agree to if he or she were in an original bargaining position of fairness. I will employ Rawls’ assumption that the (...) Maximin procedure is what self-interested agents would use from an original position, and then show how the Maximin procedure can be operationalized to produce unique outputs over probabilities of survival. Ethics for Robots describes and defends a method for designing and evaluating ethics algorithms for autonomous machines, such as self-driving cars and search and rescue drones. Derek Leben argues that such algorithms should be evaluated by how effectively they accomplish the problem of cooperation among self-interested organisms, and therefore, rather than simulating the psychological systems that have evolved to solve this problem, engineers should be tackling the problem itself, taking relevant lessons from our moral psychology. Leben draws on the moral (...) theory of John Rawls, arguing that normative moral theories are attempts to develop optimal solutions to the problem of cooperation. He claims that Rawlsian Contractarianism leads to the 'Maximin' principle - the action that maximizes the minimum value - and that the Maximin principle is the most effective solution to the problem of cooperation. He contrasts the Maximin principle with other principles and shows how they can often produce non-cooperative results. Using real-world examples - such as an autonomous vehicle facing a situation where every action results in harm, home care machines, and autonomous weapons systems - Leben contrasts Rawlsian algorithms with alternatives derived from utilitarianism and natural rights libertarianism. Political realism criticises the putative abstraction, foundationalism and neglect of the agonistic dimension of political practice in the work of John Rawls. This paper argues that had Rawls not fully specified the implementation of his theory of justice in one particular form of political economy then he would be vulnerable to a realist critique. But he did present such an implementation: a property-owning democracy. How should autonomous vehicles be programmed to behave in the event of an unavoidable accident in which the only choice open is one between causing different damages or losses to different objects or persons? This paper addresses this ethical question starting from the normative principles elaborated in the law to regulate difficult choices in other emergency scenarios. In particular, the paper offers a rational reconstruction of some major principles and norms embedded in the Anglo-American jurisprudence and case law on the (...) “doctrine of necessity”; and assesses which, if any, of these principles and norms can be utilized to find reasonable guidelines for solving the ethical issue of the regulation of the programming of autonomous vehicles in emergency situations. The paper covers the following topics: the distinction between “justification” and “excuse”, the legal prohibition of intentional killing outside self-defence, the incommensurability of goods, and the legal constrains to the use of lethal force set by normative positions: obligations, responsibility, rights, and authority. For each of these principles and constrains the possible application to the programming of autonomous vehicles is discussed. Based on the analysis, some practical suggestions are offered. (shrink)

The discourse around self-driving cars has been dominated by an emphasis on their potential to reduce the number of accidents. At the same time, proponents acknowledge that self-driving cars would inevitably be involved in fatal accidents where moral algorithms would decide the fate of those involved. This is a necessary trade-off, proponents suggest, in order to reap the benefits of this new technology. In this article, I engage this argument, demonstrating how an undue optimism and enthusiasm about this technology is (...) obscuring our ability to see what is at stake and explaining how moving beyond the dominant utilitarian framings around this technology opens up a space for both ethical inquiry and innovative design. I suggest that a genuine caring concern for the many lives lost in car accidents now and in the future—a concern that transcends false binary trade-offs and that recognizes the systemic biases and power structures that make certain groups more vulnerable than others—could serve as a starting point to rethink mobility, as it connects to the design of our cities, the well-being of our communities, and the future of our planet. How should automated vehicles (AVs) react in emergency circumstances? Most research projects and scientific literature deal with this question from a moral perspective. In particular, it is customary to treat emergencies involving AVs as instances of moral dilemmas and to use the trolley problem as a framework to address such alleged dilemmas. Some critics have pointed out some shortcomings of this strategy and have urged to focus on mundane traffic situations instead of trolley cases involving AVs. Besides, these authors rightly (...) point out the political nature of the most interesting debates involving AVs. However, in our view, they do not offer an adequate account of the distinction between ethics and politics and still see their proposals as contributions to the ethics of AVs. We argue that many of the interesting questions about how AVs should behave, both in emergency and other situations, are of political, and not moral, nature. This view is based on a conception of politics and political normativity that we have developed elsewhere and that we call “political minimalism.” Additionally, we show that this proposed perspective has significant consequences for the design, management, and regulation of transport systems. Political realists like Bernard Williams and Raymond Geuss reject political moralism, where ideal ethical theory comes first, then applied principles, and politics is reduced to a kind of applied ethics. While the models of political moralism that Williams criticizes are endorsed by G.A. Cohen and Ronald Dworkin respectively, I argue that this realist case against John Rawls cannot be sustained. In explicating and defending Rawls’s realistically utopian conception of ideal theory I defend a Kantian conception of theory where it is (...) by abstracting from immediate realities that theory is fit to guide practice by providing a framework for political judgment. The objective of this thesis – Reflective Equilibrium as a Form of Life – is to contribute to the deepening of understanding of the method of reflective equilibrium – a method of internal epistemic justification. In the first part of the study, four paradigmatic conceptions of the method will be analyzed in order to carve out a conceptual core: The ones by John Rawls – who coined the name of the method – Norman Daniels, Michael DePaul and Catherine Elgin. I (...) will argue that the conceptual core of the method contains four elementary rules: 1) A minimalistic fallibilism, 2) a moderate holism, 3) a minimalistic rationality, and 4) a weak foundationalism. Compliance with these rules is necessary and jointly sufficient for any epistemic procedure of justification to be in accordance with the method of reflective equilibrium. The second part of the study is intended to answer some of the open questions concerning this definition of the conceptual core of the method. It will be argued that the a minimalistic fallibilism, as a very central element of the method, is justified since there is no belief whose truth is transparent to an epistemic agent. Even if it were the case that such beliefs exist, there would be attractive options of retreat which provide a quasi-universal justification of minimalistic fallibilism. It will also be argued that all alternative methods of justification are either compatible with the method of reflective equilibrium or are not justified. While a metajustification of the method – understood as a justification of the method employing the method itself – is on the one hand not completely satisfactory, as it presupposes the acceptance of the method before it is justified, it is epistemically acceptable on the other hand, since it allows for a critical inquiry and is open-ended. It will be pointed out that a moderate foundationalism can be justified by the method for some specific area of inquiry insofar as basic beliefs can be identified. Yet, the default-position of the method is only a weak foundationalism (often also termed “coherentism”). With regard to the possibility of a formal interpretation of the method with which one could specify key terms used in the definition of the conceptual core, I will sketch general ways such a formalization might take. However, I will argue that the informal interpretation of the method has priority over any formal interpretation. In the third and concluding part of the study, I will present the claim that one should interpret the method of reflective equilibrium as a form of life. This means that the method is at least implicitly accepted by some epistemic agents: they have developed a disposition and ability to act according to the method. This interpretation of the method can be related to the notion of critical thinking, which, as a civic virtue and educational ideal, is subject of empirical research and practical application. A possible misunderstanding with respect to the method of reflective equilibrium as a form of life should be avoided: To interpret the method as a form of life does not indicate that it must be a comprehensive form of life. Acknowledging it in private life is optional. According to the proposed understanding of the method it is primarily a public and political form of life. (shrink)

Questions of what a self-driving car ought to do if it encounters a situation analogous to the ‘trolley problem’ have dominated recent discussion of the ethics of self-driving cars. This paper argues that this interest is misplaced. If a trolley-style dilemma situation actually occurs, given the limits on what information will be available to the car, the dynamics of braking and tyre traction determine that, irrespective of outcome, it is always least risky for the car to brake in a straight (...) line rather than swerve. What is the relationship between morals and politics? What is the relationship between moral philosophy and political philosophy? Defenders of political moralism postulate moral aims or constraints for politics, and hence they see political philosophy as a chapter of moral philosophy. Contrastingly, advocates of political realism describe politics as an independent endeavor aiming at providing order and security, and conceive of political philosophy as an autonomous discipline. This article claims that political moralism and political realism share the mistake of assuming (...) that politics has substantial, permanent goals or constraints. After criticizing political substantialism, the article explains the main ingredients of its alternative, political minimalism: the idea that politics, understood as collective instrumental rationality, aims at providing adequate means for the accomplishment of people's goals, whatever these are; and the conception of the relationship between morality and politics as one of “reciprocal containment.” Finally, it addresses some foreseeable criticisms of political minimalism. The introduction of new technologies in society is sometimes met with public resistance. Supported by public policy calls for “upstream engagement” and “responsible innovation,” recent years have seen a notable rise in attempts to attune research and innovation processes to societal needs, so that stakeholders’ concerns are taken into account in the design phase of technology. Both within the social sciences and in the ethics of technology, we see many interdisciplinary collaborations being initiated that aim to address tensions between various (...) normative expectations about science and engineering and the actual outcomes. However, despite pleas to integrate social science research into the ethics of technology, effective normative models for assessing technologies are still scarce. Rawls’s wide reflective equilibrium is often mentioned as a promising approach to integrate insights from the social sciences in the normative analysis of concrete cases, but an in-depth discussion of how this would work in practice is still lacking. In this article, we explore to what extent the WRE method can be used in the context of technology development. Using cases in engineering and technology development, we discuss three issues that are currently neglected in the applied ethics literature on WRE. The first issue concerns the operationalization of abstract background theories to moral principles. The second issue concerns the inclusiveness of the method and the demand for openness. The third issue is how to establish whether or not an equilibrium has been reached. These issues should be taken into account when applying the methods to real-world cases involving technological risks. Applying the WRE method in the context of engaged interdisciplinary collaboration requires sensitivity for issues of power and representativeness to properly deal with the dynamics between the technical and normative researchers involved as well as society at large. The present article explores the rationales of scientists and engineers for distributing moral responsibilities related technology development. On the basis of a qualitative case study, it was investigated how the actors within a research network distribute responsibilities for these issues. Rawls’ Wide Reflective Equilibrium model was used as a descriptive framework. This study indicates that there is a correlation between the actors’ ethics position and their responsibility rationale. When discussing how to address ethical issues or how to distribute the responsibility (...) for addressing them, actors with similar normative background theories referred to the same type of normative arguments. It was found that these deliberative processes could best be interpreted in terms of an interplay between different layers of morality. The case suggests that people seek coherence between these layers rather than work through them one-directionally. By distinguishing between rationales for distributing responsibilities and the actual distributions, possible sources of misunderstanding can be identified. The benefit from acknowledging these different rationales is that it enables actors to recognize the legitimacy of other people’s opinions, ultimately contributing to a responsibility distribution that is both complete and accepted by all as justified. Insights from social science are increasingly used in the field of applied ethics. However, recent insights have shown that the empirical branch of business ethics lacks thorough theoretical grounding. This article discusses the use of the Rawlsian methods of wide reflective equilibrium and overlapping consensus in the field of applied ethics. Instead of focussing on one single comprehensive ethical doctrine to provide adequate guidance for resolving moral dilemmas, these Rawlsian methods seek to find a balance between considered judgments and intuitions (...) concerning particular cases on the one hand and general principles and theories on the other. In business ethics this approach is promissing because it enables decision-making in a pluralist context with different stakeholders who often endorse different or even conflicting cultural and moral frameworks without giving priority to any of them. Moreover, the method is well founded in political theory. A taxonomy of different kinds of applications is developed, and classified according to the purpose, the content, and the type of justification. On the basis of this taxonomy an inventory of 12 recent applications is made. In terms of the purpose and content of the method the applications are rather diverse. Two conceptual obstacles for applying Rawlsian methods are identified, viz. inclusiveness and the communitarian objection that people have to become detached from their personal life. It is found that methodological questions, such as the question how to retrieve the relevant empirical data, are scarcely addressed in the literature. To advance the use of empirical approaches in general, and that of Rawlsian approaches in particular, it is important not only to use empirical data but to use methodological insights from social sciences in order to further advance the field of empirical ethics. It is recommended that stakeholders be given a more active role in the assessment and justification of these methods. (shrink)

In this article, we develop an approach for the moral assessment of research and development networks on the basis of the reflective equilibrium approach proposed by Rawls and Daniels. The reflective equilibrium approach aims at coherence between moral judgments, principles, and background theories. We use this approach because it takes seriously the moral judgments of the actors involved in R & D, whereas it also leaves room for critical reflection about these judgments. It is shown that two norms, namely reflective (...) learning and openness and inclusiveness, which are used in the literature on policy and technological networks, contribute to achieving a justified overlapping consensus. We apply the approach to a case study about the development of an innovative sewage treatment technology and show how in this case the two norms are or could be instrumental in achieving a justified overlapping consensus on relevant moral issues. This article contrasts the sense in which those whom Bernard Williams called ‘political realists’ and John Rawls are committed to the idea that political philosophy has to be distinctively political. Distinguishing the realist critique of political moralism from debates over ideal and non-ideal theory, it is argued that Rawls is more realist than many realists realise, and that realists can learn more about how to make a distinctively political vision of how our life together should be organised from his theorising, (...) although it also points to a worrying tendency among Rawlsians to reach for inappropriately moralised arguments. G. A. Cohen's advocacy of socialism and the second season of HBO's The Wire are used as examples to illustrate these points. (shrink)
