Though responses to Stout's book, "Democracy and Tradition," have touched on his discussion of rights, none has comprehensively examined his position on the subject. Having endorsed several objections Stout raises against some influential views on democracy and rights, this article proceeds to criticize Stout's description and theoretical account of the natural and human rights traditions. The central argument is that Stout cannot successfully both affirm the traditions and adhere to his account.

IN THIS ESSAY I BEGIN BY NAMING A "TURN TO CULTURE" THAT MARKS A wide range of works in contemporary theology and ethics. I describe how the turn plays out in books by Stanley Hauerwas and Delores S. Williams and argue that their idealist versions of the turn uncritically replicate core features of the dominant cultures they try to criticize. I explain how their idealism in conceiving the oppositional cultures to which they turn constructs those cultures as "others" to the (...) culture being criticized, wholes unto themselves, and symbols that directly participate in some ultimate good or truth. I then gesture toward a more critical, self-conscious performance of the turn to culture. I argue that turns to culture should not obscure but rather thematize the role of the critic in making the turn. I use the work of Pierre Bourdieu and Walter Benjamin to argue that self-conscious critique will involve a set of resignations to reflexivity rather than otherness, to a hodgepodge of highly mobile practices rather than a single, unified tradition, and to regarding cultural artifacts as mixed allegories rather than pure symbols. This essay critically explores resources and reasons for the study of culture in religious ethics, paying special attention to rhetorics and genres that provide an ethics of ordinary life. I begin by exploring a work in cultural anthropology that poses important questions for comparative and cultural inquiry in an age alert to "otherness," asymmetries of power, the end of value-neutrality in the humanities, and the formation of identity. I deepen my argument by making a foundational case for the importance of (...) culture as a topic of normative analysis through a discussion of the emotions as cultural artifacts. To illustrate how cultural analysis can inform religious ethics, I turn to works by Wayne Meeks, Margaret Trawick, and Charles Taylor. I conclude by sketching some implications of a "cultural turn" for future work in religious ethics. (shrink)

Christian realism has provided a theological understanding of politics that identifies the limits within which all political choices are made. Those limits are set by a theological understanding of judgment, which reserves the ultimate meaning of history to divine judgment, and by a theological understanding of responsibility, which gives proximate meaning to the choices between greater and lesser goods that are available to human politics. The assessments of global politics offered by Reinhold Niebuhr and other Christian realists during the Second (...) World War and the Cold War which followed owe their influence partly to an astute and historically informed reading of events, but primarily, their influence is due to this basic theological understanding of politics. While the world has changed in ways that clearly reveal limitations in the original formulations of Christian realism, the theological principles of judgment and responsibility continue to provide an understanding of global politics adequate to the new realities of the twenty-first century. In Virtues of the Will, Bonnie Kent traces late thirteenth-century debates about the freedom of the will, moral weakness, and other issues that helped change the course of Western ethics. She argues that one cannot understand the controversies of the period or see Duns Scotus in perspective without paying due attention to his immediate predecessors: the influential secular master Henry of Ghent, Walter of Bruges, William de la Mare, Peter Olivi, and other Franciscans. Seemingly radical doctrines in Scotus often turn (...) out to be moderate in comparison to other near-contemporary views, and striking Scotistic innovations often turn out to be something approaching commonplaces of Franciscan thought. This study presents the controversies of the period less as a reaction by theologians against philosophy than as genuine philosophical debates about problems raised by Aristotle's thought. And it presents Scotus's teachings less as a break with tradition than as a reasonably natural response to issues debated by his predecessors. The overall aim is to recover part of a late thirteenth-century dialogue about the will and morality. By explaining in a clear, accessible style the sometimes complex issues debated during this period, Virtues of the Will helps readers understand not only the historical and doctrinal context but also the more enduring philosophical problems posed by Aristotle's teachings. The essay sets forth a historical style in ethics. At the center is the explication of meanings forming the life worlds of representative actors in concrete situations. The sense of life world is sketched in terms of intentionality, intersubjectivity, temporality and embodiment. The essay then delineates the kinds of interpretative activity relevant for understanding life situations: the application of received conventions; suspicion of those conventions as distortions of underlying personal/social dynamics; and a dialectical interplay between a retrieval of one's own (...) traditions, and hospitality to understandings of others differently oriented to the situations in question. The goal is the achievement of common ground which enables us to determine "fitting" action, or at least to keep open the wholeness it promises. (shrink)

The discipline of religious ethics consists in critical reflection on religious varieties of ethical discourse, but to study a variety of ethical discourse, we must look at particular examples of it. Which examples should we be look- ing at? What varieties or traditions shall we take them to represent? In answering these questions, scholars reveal much about their normative commitments. When "religious ethics" replaced "theological ethics" as a cur- ricular rubric in some schools, many ethicists attempted to present their work (...) as value neutral, but it is better to admit that commitments matter and are unavoidable. The new traditionalists make no secret of their nor- mative commitments, which imply an indictment of modern ethical dis- course as a whole. Their candor is commendable, but their indictment can be challenged. Debunkers of modernity have trouble accounting for their own position. Their samples of modern ethical discourse are not repre- sentative. Many democratic voices evidently remain unacknowledged and unexplained. (shrink)
