“For what tomorrow will be, no one knows,” writes Victor Hugo. Human rights have become an important ideal in current times, yet our age has witnessed more violations of human rights than any previous less enlightened one. This book explores the historical and theoretical dimensions of this paradox. Divided into two parts, the first section offers an alternative history of natural law, in which natural rights are represented as the eternal human struggle to resist opression and to fight for a society in which people are no longer degraded or despised. At (...) the time of their birth in the 18th Century and again in the popular uprisings of the last decade, human rights became the dominant critique of law and society. The radical rhetoric of rights and its apparently endless expansive potential has led to its adoption by governments and individuals alike seeking to justify their actions on moral grounds and has undermined its radical edge. Part Two examines the philosophical logic of rights. The classical critiques of Kant, Burke, Hegel and Marx illuminate traditional aproaches to the concept of human rights. The work of Heidegger, Sartre and psychoanalysis is used to deconstruct the metaphisical essentialism of bothe universalists and cultural relativists. Finally, through a consideration of the ethics of otherness, and with reference to recent human rights violations, it is argued that the end of human rights is to judge law and politics from a moral stand point which both transcends the present and is historically relevant. Heidegger on several occasions uses the common word Vermeiden: to avoid, to flee, to dodge. What might he have meant when it comes to “spirit” or the “spiritual”? I specify immediately: not spirit or the spiritual but Geist, geistig, geistlich, for this question will be, through and through, that of language. This paper is a preparatory analysis for a jurisprudence of the singular. Through a critical analysis of the negativity and the absolving character of the transcendental metaphysics of law and justice it reads mainly through M. Heidegger, Heraclitus, G. Agamben and J-L. Nancy a realignment of the questioning of justice that takes its provisional name in ‘dike’, at thepoint where the routes of ontology, the juridical and the political intersect and reveal the pseudo-propriety of their presuppositions. Without the transcendental dialectical (...) discourse of the origin and its absolving-absolute ‘ends’, this paper re-poses the urgency of thinking the singular-multiple ‘right’ otherwise. (shrink)

My essay examines the oldest fragment ofWestern philosophy, the saying of Anaximander,with respect to its elucidation of justice as arhythmic process consisting of both `law' and`care'. In doing so, I proceed by giving areading of the Anaximander fragment by itself,focusing on the question of its rhythmicstructure and its determination of therelationship between dike and adikia. Thispart of the essay includes an excursus onAristotle's transformation of Anaximander'srhythm into a recognizable ethical science. Ina second part I engage the most profoundinterpretation of Anaximander, (...) that by MartinHeidegger. Concentrating on Heidegger'sconcept of Verwindung as well as on his emphasis on theoccurrence of the notion of tisis in the Anaximander fragment, I cull fromHeidegger the central idea that dikeand tisis exist in a necessaryrelationship. In the third and final part Iattempt a provisional examination of therelation between dike and tisistodemonstrate the shortcomings of justice-as-law,with a focus on the questions of restitutionand equity as central aspects of the law.
