Searle’s tool for understanding culture, law and society is the opposition between brute reality and institutional reality, or in other words between: observer-independent features of the world, such as force, mass and gravitational attraction, and observer-relative features of the world, such as money, property, marriage and government. The question posed here is: under which of these two headings do moral concepts fall? This is an important question because there are moral facts – for example pertaining to guilt and responsibility – (...) which hover uncomfortably close to the boundary between the observer-relative and the observer-independent. By means of a thought experiment involving an imagined Chinese society in which guilt is determined by the random throwing of sticks, I seek to show that moral concepts threaten the foundations of Searle’s philosophy of social reality. In this stimulating and thought-provoking book, the author defends the thesis that free will is incompatible with determinism. He disputes the view that determinism is necessary for moral responsbility. Finding no good reason for accepting determinism, but believing moral responsiblity to be indubitable, he concludes that determinism should be rejected.

Plural and conflicting values are often held to be conceptually problematic, threatening the very possibility of ethics, or at least rational ethics. Rejecting this view, Stocker first demonstrates why it is so important to understand the issues raised by plural and conflicting values, focusing on Aristotle's treatment of them. He then shows that plurality and conflict are commonplace and generally unproblematic features of our everyday choice and action, and that they do allow for a sound and rational ethics.

The paper offers the outlines of a response to the often-made suggestion that it is impossible to see how indeterminism could possibly provide us with anything that we might want in the way of freedom, anything that could really amount to control, as opposed merely to an openness in the flow of reality that would constitute the injection of chance, or randomness, into the unfolding of the processes which underlie our activity. It is suggested that the best first move for (...) the libertarian is to make a number of important concessions to the compatibilist. It should be conceded, in particular, that certain sorts of alternative possibilities are neither truly available to real, worldly agents nor required in order that those agents act freely; and it should be admitted also that it is the compatibilist who tends to give the most plausible sorts of analyses of many of the 'can' and 'could have' statements which seem to need to be assertible of those agents we regard as free. But these concessions do not bring compatibilism itself in their wake. The most promising version of libertarianism, it is argued, is based on the idea that agency itself (and not merely some special instances of it which we might designate with the honorific appellation 'free') is inconsistent with determinism. This version of libertarianism, it is claimed, can avoid the objection that indeterminism is as difficult to square with true agential control as determinism can sometimes seem to be. (shrink)

The study of rationality and practical reason, or rationality in action, has been central to Western intellectual culture. In this invigorating book, John Searle lays out six claims of what he calls the Classical Model of rationality and shows why they are false. He then presents an alternative theory of the role of rationality in thought and action. A central point of Searle's theory is that only irrational actions are directly caused by beliefs and desires—for example, the actions of a (...) person in the grip of an obsession or addiction. In most cases of rational action, there is a gap between the motivating desire and the actual decision making. The traditional name for this gap is "freedom of the will." According to Searle, all rational activity presupposes free will. For rationality is possible only where one has a choice among various rational as well as irrational options. Unlike many philosophical tracts, Rationality in Action invites the reader to apply the author's ideas to everyday life. Searle shows, for example, that contrary to the traditional philosophical view, weakness of will is very common. He also points out the absurdity of the claim that rational decision making always starts from a consistent set of desires. Rational decision making, he argues, is often about choosing between conflicting reasons for action. In fact, humans are distinguished by their ability to be rationally motivated by desire-independent reasons for action. Extending his theory of rationality to the self, Searle shows how rational deliberation presupposes an irreducible notion of the self. Human agents act for reasons that contribute to their good. However, in our explanation of why agents act for reasons that depend on what they value, we encounter the problem of situations in which goods are neither better than others nor are of equal value. The incommensurability of value can then be seen to lead to an incommensurability of reasons for action. Examining rationalist and classical conceptions of human agency, Raz uses the presence of incommensurability to understand how this affects (...) the relation between reasons and the will, and its effects on our practical reasoning and deliberation. A proper understanding of human agency will take for granted that the goodness of options are incommensurate and that explanations concerning what we want cannot solely be accomplished in terms of reasons. There are powerful skeptical challenges to the idea that we are free. And yet, it seems simply impossible for us to shake the sense that we really are free. Some are convinced that the skeptical challenges are insurmountable and resign themselves to living under an illusion, while others argue that the challenges can be met. Even among those who believe that our sense of ourselves as free is at least roughly accurate, there are deep differences of opinion concerning what freedom (...) requires. On the one hand, there are “libertarians” about freedom, those who believe both that we are free and that freedom requires the falsity of determinism. On the other hand, there are “compatibilists”, those who believe that freedom is compatible with determinism. While there is an impressive variety of arguments and motivations available on all sides of the debate over freedom, our inescapable sense of ourselves as free has played a recurrent and key role in the debate, sometimes explicit and sometimes not. In this paper, I explore one way that our self-conception has been used by libertarians against compatibilists, and I argue that the reasoning employed is not convincing. The libertarian appeal to our self-conception hinges on locating in each of us an essential commitment to indeterminism, or, more cautiously, a commitment to something that, with the addition of a few plausible (if not self-evident) premises, entails indeterminism. The idea, then, is that we are “natural” indeterminists, seeing our actions as undetermined (or, again, more cautiously, as having qualities that, upon reflection, we can recognize entail the falsity of determinism). By itself, this is not an argument to the effect that we are correct in 1 believing that our actions are undetermined, or to the effect that freedom requires indeterminism. But if we are in fact natural indeterminists when it comes to our own actions, then that fact serves as important motivation for libertarianism, especially if our supposed natural indeterminism captures our unshakeable sense of freedom. In response, compatibilists have advanced alternative construals of the belief in freedom presupposed by deliberation, as well as cases designed to show that determinists can deliberate without inconsistency. By deliberation we understand practical reasoning with an end in view of choosing some course of action. Integral to it is the agent's sense of alternative possibilities, that is, of two or more courses of action he presumes are open for him to undertake or not. Such acts may not actually be open in the sense that the deliberator would do them were he to so intend, but it is evident that he assumes each to be so. One deliberates only (...) by taking it for granted that both performing and refraining from any of the acts under consideration are possible for one, and that which is to be selected is something entirely up to oneself. What is it for a course of action to be presumed as open, or for several courses of action to present themselves as a range of open alternatives? Answering these questions is essential for an understanding of deliberation and choice and, indeed, for the entire issue of free will and responsibility. According to one common view, a deliberator takes the considered options to be open only by assuming he is free to undertake any of them and, consequently, that whichever he does undertake is, as yet, a wholly undetermined matter. Built into the structure of deliberation, on this theory, is an indeterministic bias relative to which any deliberator with deterministic beliefs is either inconsistent or condemned to a fatalistic limbo. An unmistakable challenge is thereby posed: is there an alternative conception of the presuppositions underlying deliberation more congenial to a deterministic perspective yet adequate to the data? Convinced that there is, I develop a partial account of deliberation that, though highly similar to the aforementioned view, diverges at a critical juncture. (shrink)
