Theories of social justice are necessarily abstract, reaching beyond the particular and the immediate to the general and the timeless. Yet such theories, addressing the world and its problems, must respond to the real and changing dilemmas of the day. A brilliant work of practical philosophy, Frontiers of Justice is dedicated to this proposition. Taking up three urgent problems of social justice neglected by current theories and thus harder to tackle in practical terms and everyday life, Martha Nussbaum seeks a (...) theory of social justice that can guide us to a richer, more responsive approach to social cooperation. The idea of the social contract--especially as developed in the work of John Rawls--is one of the most powerful approaches to social justice in the Western tradition. In _Beyond Animal Rights_, Josephine Donovan and Carol J. Adams introduced feminist "ethic of care" theory into philosophical discussions of the treatment of animals. In this new volume, seven essays from _Beyond Animal Rights_ are joined by nine new articles-most of which were written in response to that book-and a new introduction that situates feminist animal care theory within feminist theory and the larger debate over animal rights. The argument from species overlap has been widely used in the literature on animal ethics and speciesism. However, there has been much confusion regarding what the argument proves and what it does not prove, and regarding the views it challenges. This article intends to clarify these confusions, and to show that the name most often used for this argument (‘the argument from marginal cases’) reflects and reinforces these misunderstandings. The article claims that the argument questions not only those defences of (...) anthropocentrism that appeal to capacities believed to be typically human, but also those that appeal to special relations between humans. This means the scope of the argument is far wider than has been thought thus far. Finally, the article claims that, even if the argument cannot prove by itself that we should not disregard the interests of nonhuman animals, it provides us with strong reasons to do so, since the argument does prove that no defence of anthropocentrism appealing to non-definitional and testable criteria succeeds. It seems to be almost a given of contemporary Anglo-American political philosophy that the just society is obligated to establish and ensure the equality of its members. Debate begins when we come to delineate the forms and limits of the equality society is obligated to underwrite. In this essay I offer the subversive suggestion that equality is not something the just society should aim for. Instead I offer another objective, one which is to be preferred both because it is more (...) attainable and because it is morally more defensible than equality, either as an ideal or as an operative principle. The demand for equality of treatment, of opportunity, or of outcome, is a distraction from morally more significant aims. (shrink)

It’s widely agreed that animal pain matters morally – that we shouldn’t, for instance, starve our animal companions, and that we should provide medical care to sick or injured agricultural animals, and not only because it benefits us to do so. But do we have the same moral responsibilities towards wild animals? Should we feed them if they are starving, and intervene to prevent them from undergoing other forms of suffering, for instance from predation? Using an example that includes both (...) wild and domesticated animals, I outline two contrasting ways of thinking about our moral responsibilities with respect to assisting animals that are apparently in need. One approach is based entirely around animals’ capacities; the other takes context and historical relations into account as well. While not attempting to adjudicate between these views, I’ll point out the advantages and difficulties of both. (shrink)

One of the central debates within contemporary Anglo-American political philosophy concerns how to formulate an egalitarian theory of distributive justice which gives coherent expression to egalitarian convictions and withstands the most powerful anti-egalitarian objections. This book brings together many of the key contributions to that debate by some of the world’s leading political philosophers: Richard Arneson, G.A. Cohen, Ronald Dworkin, Thomas Nagel, Derek Parfit, John Rawls, T.M. Scanlon, and Larry Temkin.

This paper argues for ethical veganism: the thesis that it is typically wrong to consume animal products. The paper first sets out an intuitive case for this thesis that begins with the intuitive claim that it is wrong to set fire to a cat. I then raise a methodological challenge: this is an intuitive argument for a revisionary conclusion. Even if we grant that we cannot both believe that it is permissible to drink milk, and that it is wrong to (...) set fire to cats, this leaves open the question of which of these judgments we should abandon. I consider and reject three strategies for addressing this question: more methodologically naïve moral theorizing, appeal to systematic normative theory, and attacking non-moral presuppositions. I argue that philosophically satisfying the resolution of the conflict requires debunking our grounds for belief in one of the conflicting claims. Finally, I argue that ethical veganism is supported by consideration of the most salient debunking arguments available. (shrink)

Luck egalitarianism is a family of egalitarian theories of distributive justice that aim to counteract the distributive effects of luck. This article explains luck egalitarianism's main ideas, and the debates that have accompanied its rise to prominence. There are two main parts to the discussion. The first part sets out three key moves in the influential early statements of Dworkin, Arneson, and Cohen: the brute luck/option luck distinction, the specification of brute luck in everyday or theoretical terms and the specification (...) of advantage as resources, welfare, or some combination of these. The second part covers three later developments: the democratic egalitarian critique of luck egalitarianism, the luck egalitarian acceptance of pluralism, and luck egalitarian doubts about the significance of the brute luck/option luck distinction. The paper is concerned with whether the reductio of the natural-harm-argument can be avoided by disvaluing non-human suffering and death. According to the natural-harm-argument, alleviating the suffering of non-human animals is not a moral obligation for human beings because such an obligation would also morally prescribe human intervention in nature for the protection of non-human animal interests which, it claims, is absurd. It is possible to avoid the reductio by formulating the moral obligation to alleviate non-human suffering and death with (...) two constraints: The first concerns the practicability of intervention and establishes a moral obligation to intervene only in cases where this is humanly possible. The other constraint acknowledges that lack of competence in humans can risk producing more harm than good by intervening. A third way of avoiding the problematic version of the natural-harm-argument considers whether human and non-human suffering and death are sufficiently different to allow different types of responses. I argue that the attempt to avoid the reductio of the natural-harm-argument by disvaluing non-human death can only work with an anthropocentric bias, which accords to non-human suffering and death a fundamentally different value and that it fails to dismiss the moral obligation created by the harm that non-human animals face in the wild. In spite of the considerable literature nowadays existing on the issue of the moral exclusion of nonhuman animals, there is still work to be done concerning the characterization of the conceptual framework with which this question can be appraised. This paper intends to tackle this task. It starts by defining speciesism as the unjustified disadvantageous consideration or treatment of those who are not classified as belonging to a certain species. It then clarifies some common misunderstandings concerning what this means. Next, (...) it rejects the idea that there are different kinds of speciesism. Such an idea may result from confusion because there are (1) different ways in which speciesism can be defended; and (2) different speciesist positions, that is, different positions that assume speciesism among their premises. Depending on whether or not these views assume other criteria for moral consideration apart from speciesism, they can be combined or simple speciesist positions. But speciesism remains in all cases the same idea. Finally, the paper examines the concept of anthropocentrism, the disadvantageous treatment or consideration of those who are not members of the human species. This notion must be conceptually distinguished from speciesism and from misothery (aversion to nonhuman animals). Anthropocentrism is shown to be refuted because it either commits a petitio principia fallacy or it falls prey to two arguments: the argument from species overlap (widely but misleadingly known as “argument from marginal cases”) and the argument from relevance. This rebuttal identifies anthropocentrism as a speciesist view. (shrink)

All humans have an equal basic moral status. They possess the same fundamental rights, and the comparable interests of each person should count the same in calculations that determine social policy. Neither supposed racial differences, nor skin color, sex, sexual orientation, ethnicity, intelligence, nor any other differences among humans negate their fundamental equal worth and dignity. These platitudes are virtually universally affirmed. A white supremacist racist or an admirer of Adolf Hitler who denies them is rightly regarded as beyond the (...) pale of civilized dialogue. However, a very simple line of argument developed by Peter Singer challenges our understanding of these platitudes and forces us to rethink the basis and nature of the moral equality of all humans. What I call the “Singer Problem” arises if one accepts that the morally significant cognitive capacities that are relevant to the determination of the fundamental moral status of a being vary from individual to individual by degree. The problem is to specify a moral principle determining fundamental moral status that assigns a superior status to humans compared to other animals on the basis of the superior cognitive capacities of humans but also assigns all human persons an equal fundamental moral status regardless of their differing cognitive capacities. More broadly posed, the problem is to specify moral principles that yield intuitively satisfactory implications for the treatment of human individuals and other individual animals given that cognitive capacities differ across species and individuals. A search for a resolution of the Singer problem leads to disappointing results. (shrink)

hen the Right Honorable and Reverend Francis Henry, earl of Bridgewater, died in February, 1829, he left £8,000 to support a series of books "on the power, wisdom and goodness of God, as manifested in the creation." William Buckland, England's first official academic geologist and later dean of Westminster, was invited to compose one of the nine Bridgewater Treatises. In it he discussed the most pressing problem of natural theology: if God is benevolent and the creation displays his "power, wisdom (...) and goodness," then why are we surrounded with pain, suffering, and apparently senseless cruelty in the animal world? Welfare biology is the study of living things and their environment with respect to their welfare. Despite difficulties of ascertaining and measuring welfare and relevancy to normative issues, welfare biology is a positive science. Evolutionary economics and population dynamics are used to help answer basic questions in welfare biology : Which species are affective sentients capable of welfare? Do they enjoy positive or negative welfare? Can their welfare be dramatically increased? Under plausible axioms, all conscious species are plastic and all (...) plastic species are conscious. More complex niches favour the evolution of more rational species. Evolutionary economics also supports the common-sense view that individual sentients failing to survive to mate suffer negative welfare. A kind of God-made fairness between species is also unexpectedly found. The contrast between growth maximization, average welfare, and total welfare maximization is discussed. It is shown that welfare could be increased without even sacrificing numbers. Since the long-term reduction in animal suffering depends on scientific advances, strict restrictions on animal experimentation may be counter-productive to animal welfare. (shrink)

In his Tanner Lecture of 1979 called ‘Equality of What?’ Amartya Sen asked what metric egalitarians should use to establish the extent to which their ideal is realized in a given society. What aspect of a person’s condition should count in a fundamental way for egalitarians, and not merely as cause of or evidence of or proxy for what they regard as fundamental?

In _Beyond Prejudice_, Evelyn B. Pluhar defends the view that any sentient conative being—one capable of caring about what happens to him or herself—is morally significant, a view that supports the moral status and rights of many nonhuman animals. Confronting traditional and contemporary philosophical arguments, she offers in clear and accessible fashion a thorough examination of theories of moral significance while decisively demonstrating the flaws in the arguments of those who would avoid attributing moral rights to nonhumans. Exposing the traditional (...) view—which restricts the moral realm to autonomous, fully fledged "persons"—as having horrific implications for the treatment of many humans, Pluhar goes on to argue positively that sentient individuals of any species are no less morally significant than the most automomous human. Her position provides the ultimate justification that is missing from previous defenses of the moral status of nonhuman animals. In the process of advancing her position, Pluhar discusses the implications of determining moral significance for children and "abnormal" humans as well as its relevance to population policies, the raising of animals for food or product testing, decisions on hunting and euthanasia, and the treatment of companion animals. In addition, the author scrutinizes recent assertions by environmental ethicists that all living things or that natural objects and ecosystems be considered highly morally significant. This powerful book of moral theory challenges all defenders of the moral status quo—which decrees that animals decidedly do not count—to reevaluate their convictions. (shrink)

This article presents an argument for veganism, using a formal-axiomatic approach: a list of twenty axioms are explicitly stated. These axioms are all necessary conditions to derive the conclusion that veganism is a moral duty. The presented argument is a minimalist or core argument for veganism, because it is as parsimonious as possible, using the weakest conditions, the narrowest definitions, the most reliable empirical facts and the minimal assumptions necessary to reach the conclusion. If someone does not accept the conclusion, (...) logical consistency requires that s/he should be able to point at axiom on which s/he disagrees. Humans often intervene in the wild for anthropocentric or environmental reasons. An example of such interventions is the reintroduction of wolves in places where they no longer live in order to create what has been called an “ecology of fear”, which is being currently discussed in places such as Scotland. In the first part of this paper I discuss the reasons for this measure and argue that they are not compatible with a nonspeciesist approach. Then, I claim that if we (...) abandon a speciesist viewpoint we should change completely the way in which we should intervene in nature. Rather than intervening for environmental or anthropocentric reasons, we should do it in order to reduce the harms that nonhuman animals suffer. This conflicts significantly with some fundamental environmental ideals whose defence is not compatible with the consideration of the interests of nonhuman animals. (shrink)

Down through the past decade and more, no philosophical writer has taken a greater interest in the issues of how we ought to act in relation to animals, nor pressed more strongly the case for according them rights, than Tom Regan, in many articles, reviews, and exchanges at scholarly conferences and in print. Now, in The Case for Animal Rights we have a substantial volume in which Regan most fully and systematically presents his case for a strong panoply of rights (...) for animals. The argument is direct and cumulative, leading up to a final chapter in which Regan draws his conclusions: vegetarianism is obligatory, hunting and trapping wrong, and virtually no use of animals permissible in scientific experimentation. These are radical conclusions; few of us would be unaffected by them, and most of us, indeed, would be in for a terrific alteration in various aspects of our lifestyles. It certainly behooves us, then, to follow his arguments with care. In the present essay, my main concern will be to examine the arguments in this book. But I shall also be concerned to develop an alternative viewpoint, though at lesser length than the subject merits. (shrink)

Can material Egalitarianism (requiring, for example, the significant promotion of fortune) include animals in the domain of the equality requirement? The problem can be illustrated as follows: If equality of wellbeing is what matters, and normal mice are included in this egalitarian requirement, then normal mice have a much stronger claim to resources than almost any human. This is because normal mice have a much stronger claim to resources than almost any human. This is because their wellbeing is much lower (...) than that of normal humans. Thus, equality of wellbeing requires a massive shift of resources away from most humans to mice. This view, however, seems crazy. I explore this problem and propose a solution. (shrink)

Health, Luck, and Justice is the first attempt to systematically apply luck egalitarianism to the just distribution of health and health care.

One common objection to ethical vegetarianism—that is, vegetarianism for ethical reasons—concerns the morality of the predator-prey relationship. If it is morally acceptable for wolves to kill sheep for food, why is it wrong for human beings to eat meat? The objection raised here is sometimes called the “predation argument.” In this article, I critically examine three versions of the argument.

"Nobis argues that Singer's consequentialist approach is inadequate for defending the moral obligation to become a vegetarian or vegan. The consequentialist case rests on the idea that being a vegetarian or vegan maximizes utility -- the fewer animals that are raised and killed for food, the less suffering. Nobis argues that this argument does not work on an individual level -- my becoming a vegetarian makes no difference to the overall utility of reducing animal suffering in a context of a (...) huge industry and market unaffected by my actions. Nobis merges the insights of virtue ethics with consequentialism to argue that individuals can bring about more goodness if they have the virtues of compassion, care, and sensitivity to unnecessary cruelty and suffering. If one ought to be compassionate, sensitive to cruelty, resist injustice, and be morally integrated, then, Nobis argues, one ought to be a vegetarian or vegan.". (shrink)
