The state is often ascribed a special sort of authority, one that obliges citizens to obey its commands and entitles the state to enforce those commands through threats of violence. This book argues that this notion is a moral illusion: no one has ever possessed that sort of authority.

We may call such explanations rationalizations, and say that the reason rationalizes the action. H. L. A. Hart is heir and torch-bearer of a great tradition in the philosophy of law which is realist and unromantic in outlook. It regards the existence and content of the law as a matter of social fact whose connection with moral or any other values is contingent and precarious. His analysis of the concept of law is part of the enterprise of demythologising the law, of instilling rational critical attitudes to it. Right from his inaugural lecture in Oxford (...) he was anxious to dispel the philosophical mist which he found in both legal culture and legal theory. In recent years he has shown time and again how much the rejection of the moralizing myths which accumulated around the law is central to his whole outlook. His essays on “Bentham and the Demystification of the Law” and on “The Nightmare and the Noble Dream” showed him to be consciously sharing the Benthamite sense of the excessive veneration in which the law is held in Common Law countries, and its deleterious moral consequences. His fear that in recent years legal theory has lurched back in that direction, and his view that a major part of its role is to lay the conceptual foundation for a cool and potentially critical assessment of the law are evident. Jiirgen Habermas is a radical democrat. The source of that self-designation is that his conception of democracy-what he calls "discursive democracy"-is founded on the ideal of "a self-organizing community of free and equal citizens," co- ordinating their collective affairs through their common reason. The author discusses three large challenges to this radical-democratic ideal of collective self-regulation: 1) What is the role of private autonomy in a radical-democratic view? 2) What role does reason play in collective self-regulation? 3) What relevance might (...) a radical- democratic outlook have for contemporary democracies? The author addresses these questions by considering Habermas' answers, and then presenting alternative responses to them. The alternatives are also radical-democratic in inspiration, but they draw on a richer set of normative-political ideas than Habermas wants to rely on, and are more ambitious in their hopes for democratic practice. Genuine agents are able to engage in activity because they find it worth pursuing—because they care about it. In this respect, they differ from what might be called “mere intentional systems”: systems like chess-playing computers that exhibit merely goal-directed behavior mediated by instrumental rationality, without caring. A parallel distinction can be made in the domain of social activity: plural agents must be distinguished from plural intentional systems in that plural agents have cares and engage in activity because of those cares. (...) In this paper, I sketch an account of what it is for an individual to care about things in terms of her exhibiting a certain pattern of emotions. After extending this account to make sense of an individual's caring about other agents, I then show how a certain sort of emotional connectedness among a group of people can make intelligible the group's having cares and thereby constitute that group as a plural agent. Alternative accounts of social action, by ignoring the difference between mere intentional systems and genuine agents, and so by leaving out these emotional entanglements from their accounts of social action, thereby fail to capture a whole range of social phenomena involving plural agents. Just because one has the right to vote does not mean just any vote is right. Citizens should not vote badly. This duty to avoid voting badly is grounded in a general duty not to engage in collectively harmful activities when the personal cost of restraint is low. Good governance is a public good. Bad governance is a public bad. We should not be contributing to public bads when the benefit to ourselves is low. This paper presents a moral philosophical account of free riding, specifying the conditions under which failing to pay for nonrival goods is unfair. These conditions do not include the voluntary acceptance of the goods: this controversial claim is supported on the strength of a characterization of the kind of unfairness displayed in paradigm cases of free riding. Thus a "Principle of Fairness" can potentially serve as a foundation for political obligations. Do members of democratic societies have a moral right that others not actively prevent them from engaging in wrongdoing? Many political theorists think that they do. “It is a feature of democratic government,” Michael Walzer writes, “that the people have a right to act wrongly—in much the same way that they have a right to act stupidly”. Of course, advocates of a democratic right to do wrong may believe that the scope of this right is limited. A majority in a (...) democratic society, for example, may not have a moral right against being prevented from enslaving or arbitrarily disenfranchising a minority, or if it were to launch a wrongful aggressive war against another society. But many join Walzer in asserting that it would be wrong in principle to intervene to prevent some wrongs that democratic societies would inflict. This thesis, which we call the democratic right to do wrong thesis (DRTDWT), can be formulated as follows: DRTDWT – For democratic societies A and agents B, there is a class of wrongful policies and institutions X, such that if A chooses to implement members of this class pursuant to democratic procedures, B has a duty not to actively intervene to prevent the implementation of X.
