He further argues that it is necessary to rethink traditional conceptions of argument, and to find a position that avoids the limitations of both the highly abstract approach of formal logic and the highly contextualized approaches of rhetoric and communication theory.".

The New Rhetoric is founded on the idea that since “argumentation aims at securing the adherence of those to whom it is addressed, it is, in its entirety, relative to the audience to be influenced,” says Chaïm Perelman and L. Olbrechts-Tyteca, and they rely, in particular, for their theory of argumentation on the twin concepts of universal and particular audiences: while every argument is directed to a specific individual or group, the orator decides what information and what approaches will achieve (...) the greatest adherence according to an ideal audience. This ideal, Perelman explains, can be embodied, for example, "in God, in all reasonable and competent men, in the man deliberating or in an elite.” Like particular audiences, then, the universal audience is never fixed or absolute but depends on the orator, the content and goals of the argument, and the particular audience to whom the argument is addressed. These considerations determine what information constitutes "facts" and "reasonableness" and thus help to determine the universal audience that, in turn, shapes the orator's approach. /// The adherence of an audience is also determined by the orator's use of values, a further key concept of the New Rhetoric. Perelman's treatment of value and his view of epideictic rhetoric sets his approach apart from that of the ancients and of Aristotle in particular. Aristotle's division of rhetoric into three genres–forensic, deliberative, and epideictic–is largely motivated by the judgments required for each: forensic or legal arguments require verdicts on past action, deliberative or political rhetoric seeks judgment on future action, and epideictic or ceremonial rhetoric concerns values associated with praise or blame and seeks no specific decisions. For Aristotle, the epideictic genre was of limited importance in the civic realm since it did not concern facts or policies. Perelman, in contrast, believes not only that epideictic rhetoric warrants more attention, but that the values normally limited to that genre are in fact central to all argumentation. The article is the first Russian translation of the most well-known piece in conversation analysis, written by the founders of CA Harvey Sacks, Emanuel Schegloff and Gail Jefferson. It has become a milestone in the development of the discipline. The authors offer a comprehensive approach to the study of conversational interactions. The approach is based on the analysis of detailed transcripts of the records of natural conversations. The authors show that in the course of the conversation co-conversationalists use a number (...) of techniques to organize the turn-taking. These techniques are combined in four rules: the first option is the transfer of speakership via allocation of the next speaker by the current speaker; if this first option is not realized, turn-taking may happen via the self-selection by one of the participants; if the second option remains unrealized too, the current speaker continues speaking, with all three options being recurrently provided at all next transition relevant places. The result of the operation of these rules is an orderly conversation based on the principle “one speaker at a time.” According to the authors, this model is compatible with obvious observations concerning conversational practices that they make. The authors show that in every conversation there is a turn-taking system in operation, which provides for a flexible adaptation of the every conversation’s structure to any possible topics and any possible speakers’ identities. Such approach considers how the participants in social interactions order their communication with each other, achieving a sense of normally occurring interaction. (shrink)

Geometrical and anthropological perspectives don't meet these criteria, but a critical perspective does. It is explained that a pragma-dialectical approach to argumentation which agrees with this critical perspective is indeed (...) problem-valid and that strong pragmatic and utilitarian arguments can be given for its intersubjective validity. The paper's thesis is that dialogue is not an adequate model for all types of argument. The position of Walton is taken as the contrary view. The paper provides a set of descriptions of dialogues in which arguments feature in the order of the increasing complexity of the argument presentation at each turn of the dialogue, and argues that when arguments of great complexity are traded, the exchanges between arguers are turns of a dialogue only in an extended or metaphorical (...) sense. It argues that many of the properties of engaged back-and-forth exchanges of paradigmatic argument dialogues are not found in ‘solo’ arguments, and that at least some of the norms appropriate to the former type of argument, such as some of the pragma-dialectical rules of van Eemeren and Grootendorst's model, do not apply to the latter. This article analyses the fallacy of wrenching from context, using the dialectical notions of commitment and implicature as tools. The data, a set of key examples, is used to sharpen the conceptual borderlines around the related fallacies of straw man, accent, misquotation, and neglect of qualifications. According to the analysis, the main characteristics of wrenching from context are the manipulation of the meaning of the other’s statement through devices such as the use of misquotations, selective quotations, and quoting out of (...) context. The theoretical tools employed in the analysis are pragmatic theories of meaning and a dialectical model of commitment, used to explain how and why a standpoint is distorted. The analysis is based on a conception of fallacies as deceptive strategic moves in a game of dialogue. As a consequence, our focus is not only on misquotations as distortions of meaning, but on how they are used as dialectical tools to attack an opponent or win a dispute. Wrenching from context is described as a fallacy of unfairly attributing a commitment to another party that he never held. Its power as a deceptive argumentation tactic is based on complex mechanisms of implicit commitments and on their misemployment to improperly suggest an attribution of commitment. (shrink)

Although political argumentation is not institutionalized in a formal sense, it does have recurrent patterns and characteristics. Its constraints include the absence of time limits, the lack of a clear terminus, heterogeneous audiences, and the assumption that access is open to all. These constraints make creative strategic maneuvering both possible and necessary. Among the common types of strategic maneuvering are changing the subject, modifying the relevant audience, appealing to liberal and conservative presumptions, reframing the argument, using condensation symbols, employing the (...) locus of the irreparable, and argumentative use of figures and tropes. It is difficult to evaluate strategic maneuvering in political argumentation, however, because the activity types dictate wide latitude for the arguers, so there are few cases of unquestionable derailment. This investigation uses the technique of the profile of dialogue as a tool for the evaluation of arguments from ignorance (also called lack-of-evidence arguments, negative evidence, ad ignorantiam arguments and ex silentio arguments). Such arguments have traditionally been classified as fallacies by the logic textbooks, but recent research has shown that in many cases they can be used reasonably. A profile of dialogue is a connected sequence of moves and countermoves in a conversational exchange of a type that is goal-directed (...) and can be represented in a normative model of dialogue. Selected case studies are used to probe special features of using the profile technique as applied to arguments from ignorance of a kind that occur frequently in everyday conversational exchanges. One of these special features is the use of Gricean implicature. Another is the need to use negative profiles of argument. (shrink)

A specific issue for argumentation theory is whether information and communication technologies play any role in governing argument — that is, as parties engage in practical activities across space and time via ICTs, does technology matter for the interplay of argumentative content and process in managing disagreement? The case made here is that technologies do matter because they are not merely conduits of communication but have a role in the pragmatics of communication and argumentation. In particular, ICTs should be recognized (...) as communication-information services that are delegated degrees of responsibility for managing disagreements arising from practical activities. These services are organized around practical theories for designing disagreement space. However, recognizing this relationship between argument and technology requires accounting for procedures, techniques, or rules and speech acts that are not argumentative propositions in any strict sense but that are consequential for what becomes argumentation in any setting. An account about designing disagreement space, grounded in Jackson and Jacobs’s theory of Disagreement Management, is put forward to address these issues while more generally contributing to understanding argument in context. Dialectical approaches traditionally conceptualize argumentation as a discussion in which two parties debate on “two sides of an issue”. However, many political issues engender multiple positions. This is clear in multi-party online deliberations in which often an array of competing positions is debated in one and the same discussion. A proponent of a given position thus addresses a number of possible opponents, who in turn may hold incompatible opinions. The goal of this paper is to shed extra light on such (...) “polylogical” clash of opinions in online deliberation, by examining the multi-layered participation in actual online debates. The examples are drawn from the readers’ discussions on Osama bin Laden’s killing in online versions of two British newspapers: The Guardian and The Telegraph. As a result of the analysis, a distinction between sides, positions, and cases in argumentative deliberation is proposed. (shrink)

This article challenges the view that rhetoric, dialectic and logic are three perspectives on argument, relating respectively to its process, its procedure, and its product. It also questions the view that rhetorical arguments represent a distinctive type. It suggests that, as related to argument, rhetoric is the theory of arguments in speeches, dialectics the theory of arguments in conversations, and logic the theory of good reasoning in each.

Dichotomies are ubiquitous in deliberative thinking, in decision making and in arguing in all spheres of life.[i] Sticking uncompromisingly to a dichotomy may lead to sharp disagreement and paradox, but it can also sharpen the issues at stake and help to find a solution. Dichotomies are particularly in evidence in debates, i.e., in argumentative dialogical exchanges characterized by their agonistic nature. The protagonists in a debate worth its name hold positions that are or that they take to be opposed; they (...) argue against each other’s positions; and they defend their positions from the adversary’s attacks. In some cases, this may lead to a polarization of the debate through treating it as grounded on one or more dichotomies. In others, the contenders may construe the opposition as non-dichotomous and therefore less irreconcilable. Whereas the former attitude, which leads to ‘dichotomization’, is likely to radicalize a debate, rendering it difficult – sometimes impossible – to resolve, the latter, which leads to ‘de-dichotomization’, opens possibilities of solution of the debate other than all out victory of one side and defeat of the other. In addition to its effect on the outcome of a debate, the contenders’ attitude towards dichotomies in the debate’s management has further, important implications. It is intrinsically connected with the typology of debates and their typical argumentative moves. For the appropriateness of one or the other of these attitudes for best capturing the nature of the antagonism that underlies a debate is in fact an indicator of the kind of debate it actually is or is perceived by the contenders to be. Furthermore, such ‘attitudes’ are expressed by the contenders’ preferred choices of argumentative moves; and these, in turn, can be recognized, in a given debate context, as subservient either to a dichotomizing or to a de-dichotomizing strategy vis-à-vis a dichotomy taken to be at the root of the divergence. This study investigates how dispute-mediators handle impasse in the re-negotiation of divorce decrees by divorced couples. Three sources of impasse and three strategies for handling impasse are identified based on analysis of mediation transcripts. The concern here lies not so much in the disputant's arguments but in the discussion procedures dispute-mediators use to craft the disputant's argumentation into a tool to solve conflict. Their moves are understood here as a practice of reconstructing argumentative discourse that is neither naïve nor critical (...) but reconstruction as design. Mediator's reconstruction reveals a type of communication work in contemporary societies involved in the crafting of forums and formats that mediate argumentative communication. This work is often invisible and strategic which makes its interpretation, judgment, and development a challenge for pragma-dialectical theory. How reconstruction as design can be understood is discussed by building on prior pragma-dialectical theory and research. (shrink)

Pragma-dialectics is dynamic, context-sensitive, and multi-agent; it promises theories of fallacy and argumentative structure. But pragma-dialectic theory and practice are not yet fully in harmony. Key definitions of the theory fall short of explicating the analyses that pragma-dialecticians actually do. Many discussions involve more than two participants with different and mutually incompatible standpoints. Success in such a discussion may be more than success against each opponent. Pragma-dialectics does well at analyzing arguments advanced by one party, directed at another party; it (...) does much less well at analyzing arguments directed at several opponents at once or at convincing an audience. I suggest a strategy of construing fallacies as defeasible arguments relying on reasonable default principles but applying them in circumstances in which they are undercut or overridden. (shrink)

In normative pragmatics, a kind of empirical discourse analysis organized by normative theory, the analysis of any communication process begins with an idealized model of the discourse that can be compared with actual practices. Idealizations of argumentation can be found, among other places, in theoretical descriptions of ‘critical discussion’ and other dialogue types. Comparing ideal models with actual practices can pinpoint defects in the models (leading to theoretical refinements), but it can also identify deficiencies in practice. This latter possibility invites (...) redesign around well-justified idealizations. This paper outlines an approach to the design of discourse processes and illustrates the approach with contrastive analysis of several recently developed protocols for discussion and debate on the worldwide web. Seneca in his Moral Epistles to Lucilium ridicules Protagoras’ claim that both sides of any position can be equally well argued. Cicero, on the contrary, in the surviving fragments of his dialogue, the Republic, maintains in the person of Laelius that the thorough exploration of the strengths and weaknesses of any position pro and con is the best and often the only dialectical avenue to the discovery of difficult truths. There are therefore at least two sides to the issue of (...) whether philosophers ought to address their arguments to the two sides of any issue. This paper examines the epistemic advantages and disadvantages of the same reasoning agent playing both roles of advocate and critic, as opposed to encouraging only distinct independently minded reasoning agents each to consider any of the opposing sides of an issue in dispute. The question in argumentation theory posed by this inquiry in simplest terms is whether a single thinker considering both sides of an issue is more able to arrive at truth, or whether, as the popular adage has it, two minds are inherently dialectically better than one. The answer proposed here is that it does not matter provided that the conflict of opposing views are in some manner resolved with the sincere intention of arriving at the truth. (shrink)

Dialectical fallacies are typically defined as breaches of the rules of a regulated discussion between two participants. What if discussions become more complex and involve multiple parties with distinct positions to argue for? Are there distinct argumentation norms of polylogues? If so, can their violations be conceptualized as polylogical fallacies? I will argue for such an approach and analyze two candidates for argumentative breaches of multi-party rationality: false dilemma and collateral straw man.

In this article, the conceptual instrument that pragma-dialectical argumentation theory offers is elaborated for the analysis and evaluation of problem-solving discussions. The elaboration is aimed expressly at taking into account the discussion character of the discourse, in order to show how the developing process evolves and what the obstacles are therein. In addition, it focuses expressly on the verbal behaviour of the participants and on showing how this behaviour controls the evolving process. In this article, the pragma-dialectical model of a critical discussion is demonstrated to provide a useful instrument for discovering causes of an unsatisfactory development of problem-solving discussions. First a sketch is given of the development of a problem-solving discussion which, in the opinion of the participants themselves, developed in an unsatisfactory fashion. Then it is argued that this development can be traced back to flaws in the execution of the stages of a critical discussion.

This work discusses an empirical study of reasoning as it occurs in conversations. Reasoning in this context has features not usually accounted for in standard methods for describing argumentation (e.g., Toulmin, (1964), Toulmin, Rieke, and Janik (1984)). For example, insufficient attention has been paid to challenges which can be used to shift the ground of an argument and to the development of multiple conversational grounds. Moreover, even though the value of cooperative efforts in building arguments is widely recognized, more needs (...) to be said about analyzing co-constructed arguments. This empirical work was primarily descriptive and concerned with how people construct arguments in conversations, but one goal of the study was to lay groundwork for comparing the quality of reasoning in conversations which differ with respect to whether the arguments they contain are primarily the contributions of individuals or are genuinely co-constructed arguments. In public political discussions, an accusation of inconsistency can play a role in a number of discussions that run simultaneously. In this paper, I discuss the implications of considering the different simultaneous discussions to which the accusation contributes when examining it. While the different politi-cal considerations derived from these discussions can shed significant light on the strategic function of the accusation, such considerations may also lead to an inconsistent critical evaluation of it.

The purpose of this paper is to briefly describe and compare the original goals and perspectives of both rhetoric and dialectic in theory and in practice. Dialectic is the practice and theory of conversations; rhetoric that of speeches. For theory of dialectic, this paper will turn to Aristotle's Topics and Sophistical Refutations; for theory of rhetoric, to his Rhetoric. Thus it will appear that rhetoric and dialectic are pretty close. Yet, on the other hand, there is a long tradition of (...) mutual antagonism. The paper tries to summarize the common features of, as well as the differences between, the two. To get a taste of both dialectic and rhetoric in practice the reader is invited to enter the House of Callias, as we know it from Plato's Protagoras. After this visit there remains no doubt that rhetoric and dialectic are intertwined on the level of practice. Moreover, we may look forward to their integration on the level of theory. (shrink)

Recent proposals for computer-assisted argumentation have drawn on dialectical models of argumentation. When used to assist public policy planning, such systems also raise questions of political legitimacy. Drawing on deliberative democratic theory, we elaborate normative criteria for deliberative legitimacy and illustrate their use for assessing two argumentation systems. Full assessment of such systems requires experiments in which system designers draw on expertise from the social sciences and enter into the policy deliberation itself at the level of participants.
