Final Report on Phase 1 of the New Zealand Law Foundation’s Artificial Intelligence and Law in New Zealand Project.

To be successful, policy must anticipate a broad range of constituents. Yet, all too often, technology policy is written with primarily mainstream populations in mind. In this article, drawing on Value Sensitive Design and discount evaluation methods, we introduce a new method—Diverse Voices—for strengthening pre-publication technology policy documents from the perspective of underrepresented groups. Cost effective and high impact, the Diverse Voices method intervenes by soliciting input from “experiential” expert panels. We first describe the method. Then we report on two (...) case studies demonstrating its use: one with a white paper on augmented reality technology with expert panels on people with disabilities, people who were formerly or currently incarcerated, and women; and the other with a strategy document on automated driving vehicle technologies with expert panels on youth, non-car drivers, and extremely low-income people. In both case studies, panels identified significant shortcomings in the pre-publication documents which, if addressed, would mitigate some of the disparate impact of the proposed policy recommendations on these particular stakeholder groups. Our discussion includes reflection on the method, evidence for its success, its limitations, and future directions. (shrink)

A closer look at the theories and questions in philosophy of technology and ethics of technology shows the absence and marginality of non-Western philosophical traditions in the discussions. Although, increasingly, some philosophers have sought to introduce non-Western philosophical traditions into the debates, there are few systematic attempts to construct and articulate general accounts of ethics and technology based on other philosophical traditions. This situation is understandable, for the questions of modern sciences and technologies appear to be originated from the West; (...) at the same time, the situation is undesirable. The overall aim of this paper, therefore, is to introduce an alternative account of ethics of technology based on the Confucian tradition. In doing so, it is hoped that the current paper can initiate a relatively uncharted field in philosophy of technology and ethics of technology. (shrink)

Oppression is a form of injustice that occurs when one social group is subordinated while another is privileged, and oppression is maintained by a variety of different mechanisms including social norms, stereotypes, and institutional rules. A key feature of oppression is that it is perpetrated by and affects social groups. In this article I show that because of the central role that groups play in theories of oppression, those theories face significant, and heretofore mostly unrecognized, metaphysical problems. I then identify (...) resources from analytic metaphysics that can be used to address these problems. I show that, although we should not be pessimistic about the prospects for a viable theory of oppression, it will take serious metaphysical work to develop a plausible ontology of oppression, and existing theories have for the most part failed to respond to this challenge. Achieving equity in international research is a pressing concern. Exploitation in any scenario, whether of human research participants, institutions, local communities, animals or the environment, raises the overarching question of how to avoid such exploitation. Agreed principles can be universally applied to research in any discipline or geographical area, whatever methodologies are employed. This chapter introduces a collection of case studies, presenting a range of up-to-date examples of exploitation in North-South research collaborations, in order to raise awareness of ethics dumping.

In this essay I pay homage to one of the most important but neglected philosophers of liberation in Latin America, Luis Villoro, by considering what possible lessons we can learn from his philosophy about how to approach injustices in the Americas. Villoro was sympathetic to liberatory-leftist philosophies but he became concerned with the direction they took once they grew into philosophical movements centered on shared beliefs or on totalizing theories that presume global explanatory power. These movements became vulnerable to extremes (...) or vices that undermine their liberatory promise. I examine some of these worrying tendencies among that body of literature roughly described as “decolonial thought” (e.g., Enrique Dussel, Walter Mignolo). After a concise presentation of Villoro and the decolonial turn, I consider four dangers that this new liberatory-leftist movement faces and why Villoro should be a significant voice as the decoloniality debate moves forward. This paper looks at philosophical questions that arise in the context of AI alignment. It defends three propositions. First, normative and technical aspects of the AI alignment problem are interrelated, creating space for productive engagement between people working in both domains. Second, it is important to be clear about the goal of alignment. There are significant differences between AI that aligns with instructions, intentions, revealed preferences, ideal preferences, interests and values. A principle-based approach to AI alignment, which combines these elements (...) in a systematic way, has considerable advantages in this context. Third, the central challenge for theorists is not to identify ‘true’ moral principles for AI; rather, it is to identify fair principles for alignment that receive reflective endorsement despite widespread variation in people’s moral beliefs. The final part of the paper explores three ways in which fair principles for AI alignment could potentially be identified. (shrink)

Modern digital technologies—from web-based services to Artificial Intelligence (AI) solutions—increasingly affect the daily lives of billions of people. Such innovation brings huge opportunities, but also concerns about design, development, and deployment of digital technologies. This article identifies and discusses five clusters of risk in the international debate about digital ethics: ethics shopping; ethics bluewashing; ethics lobbying; ethics dumping; and ethics shirking.

This article reports the findings of AI4People, an Atomium—EISMD initiative designed to lay the foundations for a “Good AI Society”. We introduce the core opportunities and risks of AI for society; present a synthesis of five ethical principles that should undergird its development and adoption; and offer 20 concrete recommendations—to assess, to develop, to incentivise, and to support good AI—which in some cases may be undertaken directly by national or supranational policy makers, while in others may be led by other (...) stakeholders. If adopted, these recommendations would serve as a firm foundation for the establishment of a Good AI Society. (shrink)

The Critical Theory of the early Frankfurt School promised, in Adorno’s words, a ‘rational critique of reason’. Science and Technology Studies can play a role in the renewal of this approach. STS is based on a critique of the very same technocratic and scientistic assumptions against which Critical Theory argues. Its critique of positivism and determinism has political implications. But at its origins STS took what Wiebe Bijker called the ‘detour into the academy’ in order to institutionalize itself as a (...) social science. It adopted empirical methods, developed case histories, and limited its scope, avoiding politically controversial issues. Its latent political critique has become explicit in recent years as STS has responded to the rise of technical politics by broadening its concerns. Its wide scope converges with the equally encompassing Critical Theory. Together, STS and Critical Theory offer a new concept of politics. (shrink)

A global information ethics that seeks to avoid imperialistic homogenization must conjoin shared norms while simultaneously preserving the irreducible differences between cultures and peoples. I argue that a global information ethics may fulfill these requirements by taking up an ethical pluralism – specifically Aristotle’s pros hen [“towards one”] or “focal” equivocals. These ethical pluralisms figure centrally in both classical and contemporary Western ethics: they further offer important connections with the major Eastern ethical tradition of Confucian thought. Both traditions understand ethical (...) judgment to lead to and thus require ethical pluralism – i.e., an acceptance of more than one judgment regarding the interpretation and application of a shared ethical norm. Both traditions invoke notions of resonance and harmony to articulate pluralistic structures of connection alongside irreducible differences. Specific examples within Western computer and information ethics demonstrate these pluralisms in fact working in praxis. After reviewing further resonances and radical differences between Western and Eastern views, I then argue that emerging conceptions of privacy and data privacy protection laws in China, Hong Kong, Japan, and Thailand in fact constitute a robust, pros hen pluralism with Western conceptions. In both theory and in praxis, then, this pluralism thus fulfills the requirement for a global information ethics that holds shared norms alongside the irreducible differences between cultures and peoples. Recent efforts to argue that nonepistemic values have a legitimate role to play in assessing scientific models, theories, and hypotheses typically either reject the distinction between epistemic and nonepistemic values or incorporate nonepistemic values only as a secondary consideration for resolving epistemic uncertainty. Given that scientific representations can legitimately be evaluated not only based on their fit with the world but also with respect to their fit with the needs of their users, we show in two case studies that nonepistemic (...) values can play a legitimate role as factors that override epistemic considerations in assessing scientific representations for practical purposes. The authors suggest that postcolonial science studies can do more than expand answers to questions already posed; it can generate different questions and different ways of looking at the world. To illustrate, the authors draw on existing histories and anthropologies and critical theories of colonial and postcolonial technoscience. To move forward together, rather than remaining mired in regretful contemplation of past biases, the authors offer some analytical and practical suggestions. A rich exploration of the idea of friendship and its political consequences, past and future, by the most influential of contemporary philosophers. Until relatively recently, Jacques Derrida was seen by many as nothing more than the high priest of Deconstruction, by turns stimulating and fascinating, yet always somewhat disengaged from the central political questions of our time. Or so it seemed. Derrida's "political turn," marked especially by the appearance of Specters of Marx, has surprised some and delighted others. In The (...) Politics of Friendship Derrida renews and enriches this orientation through an examination of the political history of the idea of friendship pursued down the ages. Derrida's thoughts are haunted throughout the book by the strange and provocative address attributed to Aristotle, "my friends, there is no friend" and its inversions by later philosophers such as Montaigne, Kant, Nietzsche, Schmitt and Blanchot. The exploration allows Derrida to recall and restage the ways in which all the oppositional couples of Western philosophy and political thought—friendship and enmity, private and public life—have become madly and dangerously unstable. At the same time he dissects genealogy itself, the familiar and male-centered notion of fraternity and the virile virtue whose authority has gone unquestioned in our culture of friendship and our models of democracy The future of the political, for Derrida, becomes the future of friends, the invention of a radically new friendship, of a deeper and more inclusive democracy. In spite of decolonisation, the philosophical character of European standpoint on colonisation together with its corresponding practices remains unchanged in its relations with the erstwhile colonies. It is precisely this condition which calls for the need for the authentic liberation of Africa. This speaks of a two-fold exigency. One is that the colonised people's conceptions of reality, knowledge and truth should be released from slavery and dominance under the European epistemological paradigm. Without this essential first step there cannot evolve a (...) common authentic and liberating universe of discourse. The second exigency is that the evolving common universe of discourse must take into account the rational demands of justice to the colonised arising from the unjust wars of conquest that resulted in colonial disseizing of territory as well as the enslavement of the colonised. These rational demands of justice are specifically the restoration of territory to its indigenous rightful owners and reparations to them. This two fold exigency is the indisplensable neccessity for the authentic liberation of Africa, and indeed, all the colonised people of the world. (shrink)

"Local History/Global Designs" is one of the most important books in the historical humanities to have emerged since the end of the Cold War University. This is vintage Mignolo: packed with insights, breadth, and intellectual zeal.

For twenty years, the renowned philosopher of science Sandra Harding has argued that science and technology studies, postcolonial studies, and feminist critique must inform one another. In controversies about technology and society, there is no idea more pro vocative than the notion that technical things have political qualities. At issue is the claim that the machines, structures, and systems of modern material culture can be accurately judged not only for their contributions of efficiency and pro-ductivity, not merely for their positive and negative environmental side effects, but also for the ways in which they can embody specific forms of power and authority.
