Since the 90’s, neurolaw is on the rise. At the heart of heated debates lies the recurrent theme of a neuro-revolution of criminal responsibility. However, caution should be observed: the alleged foundations of criminal responsibility (amongst which free will) are often inaccurate and the relative imperviousness of its real foundations to scientific facts often underestimated. Neuroscientific findings may impact on social institutions, but only insofar as they also engage in a political justification of the changes being called for, convince populations, (...) and take into consideration the ensuing consequences. Moreover, the many limits of neuroscientific tools call for increased vigilance when, if ever, using neuroscientific evidence in a courtroom. In this article, we aim at setting the basis for future sound debates on the contribution of neuroscience to criminal law, and in particular to the assessment of criminal responsibility. As such, we provide analytical tools to grasp the political and normative nature of criminal responsibility and review the current or projected use of neuroscience in the law, all the while bearing in mind the highly-publicized question: can neuroscience revolutionize criminal responsibility? Answering this question implicitly requires answering a second question: should neuroscience revolutionize the institution of criminal responsibility? Answering both, in turn, requires drawing the line between science and normativity, revolution and dialogue, fantasies and legitimate hopes. (shrink)

When people want to identify the causes of an event, assign credit or blame, or learn from their mistakes, they often reflect on how things could have gone differently. In this kind of reasoning, one considers a counterfactual world in which some events are different from their real-world counterparts and considers what else would have changed. Researchers have recently proposed several probabilistic models that aim to capture how people do (or should) reason about counterfactuals. We present a new model and (...) show that it accounts better for human inferences than several alternative models. Our model builds on the work of Pearl (2000), and extends his approach in a way that accommodates backtracking inferences and that acknowledges the difference between counterfactual interventions and counterfactual observations. We present six new experiments and analyze data from four experiments carried out by Rips (2010), and the results suggest that the new model provides an accurate account of both mean human judgments and the judgments of individuals. The sense of agency refers to an experience in which one’s own action causes a change in environment. It is strongly modulated by both the contingency between action and its outcome and the consistency between predicted and actual action outcomes. Recent studies have suggested that the action outcome can retrospectively modulate action awareness. We suspect that the sense of agency can also be retrospectively modulated. This study examined whether the quantity of action outcome could influence the sense of agency. The (...) participants’ task was to trigger dot motion in a display and rate the extent to which they could control the initiation of dot motion. Independently of both the temporal contiguity between action and its outcome and the consistency between predicted and actual action outcomes, the speed of dot motion as an action’s outcome strongly influenced the sense of agency rating. The present study suggests that the sense of agency stems partly from the inference of action efficiency based on the quantitative aspect of action outcome. (shrink)

Sense of agency is a compelling but fragile experience that is augmented or attenuated by internal signals and by external cues. A disruption in SoA may characterise individual symptoms of mental illness such as delusions of control. Indeed, it has been argued that generic SoA disturbances may lie at the heart of delusions and hallucinations that characterise schizophrenia. A clearer understanding of how sensorimotor, perceptual and environmental cues complement, or compete with, each other in engendering SoA may prove valuable in (...) deepening our understanding the agency disruptions that characterise certain focal neurological disorders and mental illnesses. Here we examine the integration of SoA cues in health and illness, describing a simple framework of this integration based on Bayesian principles. We extend this to consider how alterations in cue integration may lead to aberrant experiences of agency. (shrink)

Participants watched themselves in a mirror while another person behind them, hidden from view, extended hands forward on each side where participants’ hands would normally appear. The hands performed a series of movements. When participants could hear instructions previewing each movement, they reported an enhanced feeling of controlling the hands. Hearing instructions for the movements also enhanced skin conductance responses when a rubber band was snapped on the other’s wrist after the movements. Such vicarious agency was not felt when the (...) instructions followed the movements, and participants’ own covert movement mimicry was not essential to the influence of previews on reported control. Voluntary acts are preceded by electrophysiological (RPs). With spontaneous acts involving no preplanning, the main negative RP shift begins at about200 ms. Control experiments, in which a skin stimulus was timed (S), helped evaluate each subject's error in reporting the clock times for awareness of any perceived event.

In our daily lives, we need to predict and understand others’ behavior in order to navigate through our social environment. Predictions concerning other humans’ behavior usually refer to their mental states, such as beliefs or intentions. Such a predictive strategy is called ‘adoption of the intentional stance.’ In this paper, we review literature related to the concept of intentional stance from the perspectives of philosophy, psychology, human development, culture, and human-robot interaction. We propose that adopting the intentional stance might be (...) a pivotal factor in facilitating social attunement with artificial agents. The paper first reviews the theoretical considerations regarding the intentional stance and examines literature related to the development of the intentional stance across life span. Subsequently, we discuss cultural norms as grounded in the intentional stance, and finally, we focus on the issue of adopting the intentional stance toward artificial agents, such as humanoid robots. At the dawn of the artificial intelligence era, the question of how – and also when – we predict and explain robots’ behavior by referring to mental states is of high interest. The paper concludes with a discussion on ethical consequences of adopting the intentional stance toward robots, and sketches future directions in research on this topic. (shrink)

Living organisms appear to have agency, the ability to act freely, and humans appear to have free will, the ability to rationally decide what to do. However, it is not clear how such properties can be produced by naturalistic processes, and there are indeed neuroscientific measurements that cast doubt on the existence of free will. Here I present a naturalistic theory of agency, consciousness, and free will. Elementary forms of agency evolved very early in the evolution of life, utilizing an (...) extension of the basic Darwinian scheme that combines and entangles deterministic and stochastic causation. The extension effectively produces an active form of causation, as well as meaning intrinsic to the organism. Consciousness arose when animals evolved advanced nervous systems and social lifestyles that enabled communication mutually affecting each animal’s intrinsic meaning. I argue that various forms of agency that subsequently arose in evolution, preconscious, conscious, intelligent, symbolic, and rational agency, still coexist in humans. This coexistence, combined with the fact that agency is not instantaneous but takes time to build up, makes simple interpretations of neuroscientific results on free will problematic. The conclusion of the study is that conscious free will, including a form of agent causation, is fully consistent with a naturalistic world-view and can be produced by the specific processes discussed. The result closely resembles existing approaches to life and mind that are inspired by phenomenology. (shrink)

Philosophers have proposed accounts of shared intentions that aim at capturing what makes a joint action intentionally joint. On these accounts, having a shared intention typically presupposes cognitively and conceptually demanding theory of mind skills. Yet, young children engage in what appears to be intentional, cooperative joint action long before they master these skills. In this paper, I attempt to characterize a modest or ‘lite’ notion of shared intention, inspired by Michael Bacharach’s approach to team–agency theory in terms of framing, (...) group identification and team reasoning. I argue that the account of shared intentions this approach yields is less cognitively and conceptually demanding than other accounts and is thus applicable to the intentional joint actions performed by young children. I also argue that it has limitations of its own and that considering what these limitations are may help us understand why we sometimes need to take other routes to shared intentions. (shrink)

Actions unfold in time, and so do experiences of agency. Yet, despite the recent surge of interest in the sense of agency among both philosophers and cognitive scientists, the import of the fact that agentive experiences unfold in time remains to this day largely underappreciated. This chapter argues that agentive experiences should be conceptualized as continuants, whose contents evolve as actions unfold. It attempts to characterize these content shifts, distinguishing two main dimensions of change—changes in scale, or fine-grainedness, and changes (...) in tense—as well as the main action control and action specification processes that underlie them. The chapter further argues that taking into account this temporal dynamics of agentive experiences can help researchers better appreciate in what sense some of the apparently conflicting empirical models of the sense of agency proposed in recent years can be seen as complementary, rather than as rival, thus refining integrative models. People have little difficulty distinguishing effects they cause and those they do not. An important question is what underlies this sense of agency. A prevailing idea is that the sense of agency arises from a comparison between a predictive representation of the effect and the actual effect that occurs, with a clear match between the two producing a strong sense of agency. Although there is general agreement on this comparison process, one important theoretical issue that has yet to be fully (...) determined is whether these computations are consciously performed. Here, we studied this issue by requiring participants to perform a simple judgment of agency task under conditions of different concurrent working memory load. Working memory operations are known to tax conscious cognitive resources. We found that agency judgments were moderated by working memory load, with lower agency ratings being observed in the high load condition, suggesting that the sense of agency is dependent on the availability of conscious cognitive resources. An examination of the time-course of this load effect suggests that it is the construction of the mental representation of the predicted effect which is particularly dependent on said resources. After a long period of neglect, the phenomenology of action has recently regained its place in the agenda of philosophers and scientists alike. The recent explosion of interest in the topic highlights its complexity. The purpose of this paper is to propose a conceptual framework allowing for a more precise characterization of the many facets of the phenomenology of agency, of how they are related and of their possible sources. The key assumption guiding this attempt is that the processes through (...) which the phenomenology of action is generated and the processes involved in the specification and control of action are strongly interconnected. I argue in favor of a three-tiered dynamic model of intention, link it to an expanded version of the internal model theory of action control and specification, and use this theoretical framework to guide an analysis of the contents, possible sources and temporal course of complementary aspects of the phenomenology of action. The now growing literature on the content and sources of the phenomenology of first-person agency highlights the multi-faceted character of the phenomenology of agency and makes it clear that the experience of agency includes many other experiences as components. This paper examines the possible relations between these components of our experience of acting and the processes involved in action specification and action control. After a brief discussion of our awareness of our goals and means of action, it will focus on (...) the sense of agency for a given action, understood as the sense the agent has that he or she is the author of that action. I argue that the sense of agency can be analyzed as a compound of more basic experiences, including the experience of intentional causation, the sense of initiation and the sense of control. I further argue that the sense of control may itself be analysed into a number of more specific, partially dissociable experiences. (shrink)

The intentional stance is the strategy of prediction and explanation that attributes beliefs, desires, and other states to systems and predicts future behavior from what it would be rational for an agent to do, given those beliefs and desires. Any system whose performance can be thus predicted and explained is an intentional system, whatever its innards. The strategy of treating parts of the world as intentional systems is the foundation of but is also exploited in artificial intelligence and cognitive science (...) more generally, as well as in evolutionary theory. An analysis of the role of the intentional stance and its presuppositions supports a naturalistic theory of mental states and events, their content or intentionality, and the relation between levels of explanation and neurophysiological or mechanistic levels of explanation. As such, the analysis of the intentional stance grounds a theory of the mind and its relation to the body. (shrink)

According to the prevailing paradigm in social-cognitive neuroscience, the mental states of individuals become shared when they adapt to each other in the pursuit of a shared goal. We challenge this view by proposing an alternative approach to the cognitive foundations of social interactions. The central claim of this paper is that social cognition concerns the graded and dynamic process of alignment of individual minds, even in the absence of a shared goal. When individuals reciprocally exchange information about each other's (...) minds processes of alignment unfold over time and across space, creating a social interaction. Not all cases of joint action involve such reciprocal exchange of information. To understand the nature of social interactions, then, we propose that attention should be focused on the manner in which people align words and thoughts, bodily postures and movements, in order to take one another into account and to make full use of socially relevant information. I argue that in order to solve the main difficulties confronted by the classical versions of the causal theory of action, it is necessary no just to make room for intentions, considered as irreducible to complexes of beliefs and desires, but also to distinguish among several types of intentions. I present a three-tiered theory of intentions that distinguishes among future-directed intentions, present-directed intentions and motor intentions. I characterize each kind of intention in terms of its functions, its type of content, (...) its dynamics and the rationality and time constraints that bear on it. There is widespread agreement that there should be a principle requiring that artificial intelligence be ‘explicable’. Microsoft, Google, the World Economic Forum, the draft AI ethics guidelines for the EU commission, etc. all include a principle for AI that falls under the umbrella of ‘explicability’. Roughly, the principle states that “for AI to promote and not constrain human autonomy, our ‘decision about who should decide’ must be informed by knowledge of how AI would act instead of us” :689–707, 2018). There (...) is a strong intuition that if an algorithm decides, for example, whether to give someone a loan, then that algorithm should be explicable. I argue here, however, that such a principle is misdirected. The property of requiring explicability should attach to a particular action or decision rather than the entity making that decision. It is the context and the potential harm resulting from decisions that drive the moral need for explicability—not the process by which decisions are reached. Related to this is the fact that AI is used for many low-risk purposes for which it would be unnecessary to require that it be explicable. A principle requiring explicability would prevent us from reaping the benefits of AI used in these situations. Finally, the explanations given by explicable AI are only fruitful if we already know which considerations are acceptable for the decision at hand. If we already have these considerations, then there is no need to use contemporary AI algorithms because standard automation would be available. In other words, a principle of explicability for AI makes the use of AI redundant. (shrink)

This chapter aims at investigating the phenomenology of joint action and at gaining a better understanding of (1) how the sense of agency one experiences when engaged in a joint action differs from the sense of agency one has for individual actions and (2) how the sense of agency one experiences when engaged in a joint action differs according to the type of joint action and to the role one plays in it.

It has been proposed that inferring personal authorship for an event gives rise to intentional binding, a perceptual illusion in which one’s action and inferred effect seem closer in time than they otherwise would . Using a novel, naturalistic paradigm, we conducted two experiments to test this hypothesis and examine the relationship between binding and self-reported authorship. In both experiments, an important authorship indicator – consistency between one’s action and a subsequent event – was manipulated, and its effects on binding (...) and self-reported authorship were measured. Results showed that action-event consistency enhanced both binding and self-reported authorship, supporting the hypothesis that binding arises from an inference of authorship. At the same time, evidence for a dissociation emerged, with consistency having a more robust effect on self-reports than on binding. Taken together, these results suggest that binding and self-reports reveal different aspects of the sense of authorship. (shrink)

We investigate the processes underlying the feeling of control over one’s actions . Sense of agency may depend on internal motoric signals, and general inferences about external events. We used priming to modulate the sense of agency for voluntary and involuntary movements, by modifying the content of conscious thought prior to moving. Trials began with the presentation of one of two supraliminal primes, which corresponded to the effect of a voluntary action participants subsequently made. The perceived interval between movement and (...) effect was used as an implicit measure of sense of agency. Primes modulated perceived intervals for both voluntary and involuntary movements, but the modulation was greatest for involuntary movements. A second experiment showed that this modulation depended on prime–movement contiguity. We propose that sense of agency is based on a combination of internal motoric signals and external sensory evidence about the source of actions and effects. (shrink)

It is nearly 10 years since Patrick Haggard and colleagues first reported the ‘intentional binding’ effect . The intentional binding effect refers to the subjective compression of the temporal interval between a voluntary action and its external sensory consequence. Since the first report, considerable interest has been generated and a fascinating array of studies has accumulated. Much of the interest in intentional binding comes from the promise to shed light on human agency. In this review we survey studies on intentional (...) binding, focusing, in particular, on the link between intentional binding and the sense of agency . We suggest that, whilst it is yet to be fully explicated, the link between intentional binding and the sense of agency is compelling. We conclude by considering outstanding questions and future directions for research on intentional binding. (shrink)

This paper on the phenomenology of joint agency proposes a foray into a little explored territory at the intersection of two very active domains of research: joint action and sense of agency. I explore two ways in which our experience of joint agency may differ from our experience of individual agency. First, the mechanisms of action specification and control involved in joint action are typically more complex than those present in individual actions, since it is crucial for joint action that (...) people coordinate their plans and actions. I discuss the implications that these coordination requirements might have for the strength of the sense of agency an agent may experience for a joint action. Second, engagement in joint action may involve a transformation of agentive identity and a partial or complete shift from a sense of self-agency to a sense of we-agency. I discuss several factors that may contribute to shaping our sense of agentive identity in joint action. (shrink)

The lack of consensus on how to characterize humans’ capacity for belief reasoning has been brought into sharp focus by recent research. Children fail critical tests of belief reasoning before 3 to 4 years (Wellman, Cross, & Watson, 2001; Wimmer & Perner, 1983), yet infants apparently pass false belief tasks at 13 or 15 months (Onishi & Baillargeon, 2005; Surian, Caldi, & Sperber, 2007). Non-human animals also fail critical tests of belief reasoning but can show very complex social behaviour (e.g., (...) Call & Tomasello, 2005). Fluent social interaction in adult humans implies efficient processing of beliefs, yet direct tests suggest that belief reasoning is cognitively demanding, even for adults (e.g., Apperly, Samson & Humphreys, 2005). We interpret these findings by drawing an analogy with the domain of number cognition, where similarly contrasting results have been observed. We propose that the success of infants and non-human animals on some belief reasoning tasks may be best explained by a cognitively efficient but inflexible capacity for tracking belief-like states. In humans this capacity persists in parallel with later-developing, more flexible but more cognitively demanding theory of mind abilities. (shrink)

The sense of agency has received much attention in the context of individual action but not in the context of joint action. We investigated how the sense of agency developed during individual and dyadic performance while people learned a haptic coordination task. The sense of agency increased with better performance in all groups. Individuals and dyads showed a differential sense of agency after initial task learning, with dyads showing a minimal increase. The sense of agency depended on the context in (...) which the task was first learnt, as transfer from joint to individual performance resulted in an illusory boost in the sense of agency. Whereas the quality of performance related to the sense of agency, the generated forces to achieve the task did not. Our findings are consistent with a predictive model account at the perceptual level, such that the sense of agency relies most strongly on sharable perceptual information. (shrink)

Experimental studies investigating the contribution of conscious intention to the generation of a sense of agency for one’s own actions tend to rely upon a narrow definition of intention. Often it is operationalized as the conscious sensation of wanting to move right before movement. Existing results and discussion are therefore missing crucial aspects of intentions, namely intention as the conscious sensation of wanting to move in advance of the movement. In the present experiment we used an intentional binding paradigm, in (...) which we distinguished between immediate intention, as usually investigated, and longer standing intention. The results showed that the binding effect was significantly enhanced for distal intentions compared to proximal intentions, indicating that the former leads to stronger sense of agency. Our finding provides empirical support for a crucial distinction between at least two types of intention when addressing the efficacy of conscious intentions. (shrink)
