The renowned philosopher John Searle reveals the fundamental nature of social reality. What kinds of things are money, property, governments, nations, marriages, cocktail parties, and football games? Searle explains the key role played by language in the creation, constitution, and maintenance of social reality. We make statements about social facts that are completely objective, for example: Barack Obama is President of the United States, the piece of paper in my hand is a twenty-dollar bill, I got married in London, etc. (...) And yet these facts only exist because we think they exist. How is it possible that we can have factual objective knowledge of a reality that is created by subjective opinions? This is part of a much larger question: How can we give an account of ourselves, with our peculiar human traits DS mind, reason, freedom, society - in a world that we know independently consists of mindless, meaningless particles? How can we account for our social and mental existence in a realm of brute physical facts? In answering this question, Searle avoids postulating different realms of being, a mental and a physical, or worse yet, a mental, a physical, and a social. There is just one reality: Searle shows how the human reality fits into that one reality. Mind, language, and civilization are natural products of the basic facts of the physical world described by physics, chemistry and biology. Searle explains how language creates and maintains the elaborate structures of human social institutions. These institutions serve to create and distribute power relations that are pervasive and often invisible. These power relations motivate human actions in a way that provides the glue that holds human civilization together. Feminist analyses of gender concepts must avoid the inclusion problem, the fault of marginalizing or excluding some prima facie women. Sally Haslanger’s ‘ameliorative’ analysis of gender concepts seeks to do so by defining woman by reference to subordination. I argue that Haslanger’s analysis problematically marginalizes trans women, thereby failing to avoid the inclusion problem. I propose an improved ameliorative analysis that ensures the inclusion of trans women. This analysis yields ‘twin’ target concepts of woman, one concerning gender as class and (...) the other concerning gender as identity, both of which I hold to be equally necessary for feminist aims. This book explores the epistemic side of racial and sexual oppression. It elucidates how social insensitivities and imposed silences prevent members of different groups from listening to each other.

In this paper, we defend two main claims. The first is a moderate claim: we have a negative duty to not use binary gender-specific pronouns he or she to refer to genderqueer individuals. We defend this with an argument by analogy. It was gravely wrong for Mark Latham to refer to Catherine McGregor, a transgender woman, using the pronoun he; we argue that such cases of misgendering are morally analogous to referring to Angel Haze, who identifies as genderqueer, as he (...) or she. The second is a radical claim: we have a negative duty to not use any gender-specific pronouns to refer to anyone, regardless of their gender identity. We offer three arguments in favor of this claim (which appeal to concerns about inegalitarianism and risk, invasions of privacy, and reinforcing essentialist ideologies). We also show why the radical claim is compatible with the moderate claim. Before concluding, we examine common concerns about incorporating either they or a neologism such as ze as a third-person singular gender-neutral pronoun. These concerns, we argue, do not provide sufficient reason to reject either the moderate or radical claim. (shrink)

If the world itself is metaphysically indeterminate in a specified respect, what follows? In this paper, we develop a theory of metaphysical indeterminacy answering this question.

Stewart Shapiro's aim in Vagueness in Context is to develop both a philosophical and a formal, model-theoretic account of the meaning, function, and logic of vague terms in an idealized version of a natural language like English. It is a commonplace that the extensions of vague terms vary with such contextual factors as the comparison class and paradigm cases. A person can be tall with respect to male accountants and not tall with respect to professional basketball players. The main feature (...) of Shapiro's account is that the extensions of vague terms also vary in the course of a conversation, even after the external contextual features, such as the comparison class, are fixed. A central thesis is that in some cases, a competent speaker of the language can go either way in the borderline area of a vague predicate without sinning against the meaning of the words and the non-linguistic facts. Shapiro calls this open texture, borrowing the term from Friedrich Waismann.The formal model theory has a similar structure to the supervaluationist approach, employing the notion of a sharpening of a base interpretation. In line with the philosophical account, however, the notion of super-truth does not play a central role in the development of validity. The ultimate goal of the technical aspects of the work is to delimit a plausible notion of logical consequence, and to explore what happens with the sorites paradox.Later chapters deal with what passes for higher-order vagueness - vagueness in the notions of 'determinacy' and 'borderline' - and with vague singular terms, or objects. In each case, the philosophical picture is developed by extending and modifying the original account. This is followed with modifications to the model theory and the central meta-theorems.As Shapiro sees it, vagueness is a linguistic phenomenon, due to the kinds of languages that humans speak. But vagueness is also due to the world we find ourselves in, as we try to communicate features of it to each other. Vagueness is also due to the kinds of beings we are. There is no need to blame the phenomenon on any one of those aspects. (shrink)

ABSTRACT Many phenomena appear to be indeterminate, including material macro-object boundaries and certain open future claims. Here I provide an account of indeterminacy in metaphysical, rather than semantic or epistemic, terms. Previous accounts of metaphysical indeterminacy have typically taken this to involve its being indeterminate which of various determinate states of affairs obtain. On my alternative account, MI involves its being determinate that an indeterminate state of affairs obtains. I more specifically suggest that MI involves an object's having a determinable (...) property, but not having any unique determinate of that determinable. I motivate the needed extension of the traditional understanding of determinables, then argue that a determinable-based account of MI accommodates, in illuminating fashion, both ‘glutty’ and ‘gappy’ cases of MI, while satisfactorily treating concerns about MI stemming from Evans’ argument and the problem of the many. In this article, I identify a distinctive form of injustice—ontic injustice—in which an individual is wronged by the very fact of being socially constructed as a member of a certain social kind. To be a member of a certain social kind is, at least in part, to be subject to certain social constraints and enablements, and these constraints and enablements can be wrongful to the individual who is subjected to them, in the sense that they inflict a moral injury. The (...) concept of ontic injustice is valuable in three main ways: it draws our attention to the role played by social kinds in enacting wrongful constraints and enablements; it clarifies our options for developing accounts of the ontology of particular social kinds, such as gender kinds; and, along with the related concept of ‘ontic oppression’, it helps us to understand and respond to oppression. What’s important about ‘coming out’? Why do we wear business suits or Star Trek pins? Part of the answer, we think, has to do with what we call agential identity. Social metaphysics has given us tools for understanding what it is to be socially positioned as a member of a particular group and what it means to self-identify with a group. But there is little exploration of the general relationship between self-identity and social position. We take up this exploration, developing (...) an account of agential identity—the self-identities we make available to others. Agential identities are the bridge between what we take ourselves to be and what others take us to be. Understanding agential identity not only fills an important gap in the literature, but also helps us explain politically important phenomena concerning discrimination, malicious identities, passing, and code-switching. These phenomena, we argue, cannot be understood solely in terms of self-identity or social position. (shrink)

Terence Parsons presents a lively and controversial study of philosophical questions about identity. Because many puzzles about identity remain unsolved, some people believe that they are questions that have no answers and that there is a problem with the language used to formulate them. Parsons explores a different possibility: that such puzzles lack answers because of the way the world is (or because of the way the world is not). This is a systematic philosophical and conceptual study of the notion of a social practice. Raimo Tuomela explains social practices in terms of the interlocking mental states of the agents; he shows how social practices are 'building blocks of society'; and he offers a clear and powerful account of the way in which social institutions are constructed from these building blocks as established, interconnected sets of social practices with a special new social status. His analysis is based on the novel (...) concept of shared 'we-attitudes', which represent a weak form of collective intentionality, and he makes instructive connections to major topics and figures in philosophy and the social sciences. What does woman mean? According to two competing views, it can be seen as a sex term or as a gender term. Recently, Jennifer Saul has put forward a contextualist view, according to which woman can have different meanings in different contexts. The main motivation for this view seems to involve moral and political considerations, namely, that this view can do justice to the claims of trans women. Unfortunately, Saul argues, on further reflection the contextualist view fails to do justice (...) to those moral and political claims that motivated the view in the first place. In this article I argue that there is a version of the contextualist view that can indeed capture those moral and political aims, and in addition, I use this case to illustrate an important and more general claim, namely, that moral and political considerations can be relevant to the descriptive project of finding out what certain politically significant terms actually mean. What kind of entity is a committee, a book group or a band? I argue that committees and other such social groups are concrete, composite particulars, having ordinary human beings amongst their parts. So the committee members are literally parts of the committee. This mereological view of social groups was popular several decades ago, but fell out of favour following influential objections from David-Hillel Ruben. But recent years have seen a tidal wave of work in metaphysics, including the metaphysics of (...) parts and wholes. We now have the resources to rehabilitate the mereological view of social groups. Philosophers of language have tended to focus on examples that are not politically significant in any way. We spend a lot of time analyzing natural kind terms: We think hard about “water” and “pain” and “arthritis.” But we don’t think much about the far more politically significant kind terms (natural or social—it's a matter for dispute) like “race,” “sex,” “gender,” “woman,” “man,” “gay,” and “straight.” In this essay, I will try to show, using the example of “woman,” that it's worth (...) thinking about terms like these, for at least three reasons: (1) There are some interesting puzzles. (2) Politically significant terms matter to people's lives— and it's worth spending at least some of our energy thinking about things that matter in this way. (3) Most importantly, interesting methodological issues emerge at the intersection of philosophy of language and politics. (shrink)

In this article, I consider the harms inflicted upon transgender persons through “misgendering,” that is, such deployments of gender terms that diminish transgender persons' self-respect, limit the discursive resources at their disposal to define their own gender, and cause them microaggressive psychological harms. Such deployments are morally contestable, that is, they can be challenged on ethical or political grounds. Two characterizations of “woman” proposed in the feminist literature are critiqued from this perspective. When we consider what would happen to transgender (...) women upon the broad implementation of these characterizations within transgender women's social context, we discover that they suffer from two defects: they either exclude at least some transgender women, or else they implicitly foster hierarchies among women, marginalizing transgender women in particular. In conclusion, I claim that the moral contestability of gender-term deployments acts as a stimulus to regularly consider the provisionality and revisability of our deployments of the term “woman.”. We say that each social group is identical to its members. The group just is them; they just are the group. This view of groups as pluralities has tended to be swiftly rejected by social metaphysicians, if considered at all, mainly on the basis of two objections. First, it is argued that groups can change in membership, while pluralities cannot. Second, it is argued that different groups can have exactly the same members, while different pluralities cannot. We rebut these objections, (...) and argue that our plural view is superior to alternative reductive proposals which would identify social groups with the sets or fusions of their members. Finally we deal with some further potential challenges for the view of groups as pluralities. Thus we aim to establish it as a serious contender in the metaphysics of groups. (shrink)

He argues that it can be fully understood in terms of the agency of individuals, and concepts derived from our understanding of individual action. He thus argues for a strong form of methodological individualism.

What kind of semantics should someone who accepts the epistemicist theory of vagueness defended in Timothy Williamson’s Vagueness (1994) give a definiteness operator? To impose some interesting constraints on acceptable answers to this question, I will assume that the object language also contains a metaphysical necessity operator and a metaphysical actuality operator. I will suggest that the answer is to be found by working within a three-dimensional model theory. I will provide sketches of two ways of extracting an epistemicist semantics (...) from that model theory, one of which I will find to be more plausible than the other. (shrink)

This article explores “determining gender,” the umbrella term for social practices of placing others in gender categories. We draw on three case studies showcasing moments of conflict over who counts as a man and who counts as a woman: public debates over the expansion of transgender employment rights, policies determining eligibility of transgender people for competitive sports, and proposals to remove the genital surgery requirement for a change of sex marker on birth certificates. We show that criteria for determining gender (...) differ across social spaces. Gender-integrated spaces are more likely to use identity-based criteria, while gender-segregated spaces, like the sexual spaces we have previously examined, are more likely to use biology-based criteria. In addition, because of beliefs that women are inherently vulnerable and men are dangerous, “men’s” and “women’s” spaces are not policed equally—making access to women’s spaces central to debates over transgender rights. Vague existence can seem like the worst kind of vagueness in the world, or seem to be an entirely unintelligible notion. This bad reputation is based upon the rumour that if there is vague existence then there are non-existent objects. But the rumour is false: the modest brand of vague existence entailed by certain metaphysical theories of composition does not deserve its bad reputation.

This chapter defends the account of metaphysical indeterminacy of Barnes and Williams against Eklund's objections.

I argue, pace Timothy Williamson, that one cannot provide an adequate account of what it is for a case to be borderline by appealing to facts about our inability to discriminate our actual situation from nearby counterfactual situations in which our language use differs in subtle ways. I consider the two most natural ways of using such resources to provide an account of what it is for a case to be borderline and argue that both face crippling defects. I argue (...) that the problems faced by these two accounts point to more general reasons to be skeptical of the claim that facts about semantic indiscriminability provide sufficient resources for an analysis of what it is for a case to be borderline. This paper considers the connections between semantic shiftiness (plasticity), epistemic safety and an epistemic theory of vagueness as presented and defended by Williamson (1996a, b, 1997a, b). Williamson explains ignorance of the precise intension of vague words as rooted in insensitivity to semantic shifts: one’s inability to detect small shifts in intension for a vague word results in a lack of knowledge of the word’s intension. Williamson’s explanation, however, falls short of accounting for ignorance of intension.

In "Amelioration and Inclusion: Gender Identity and the Concept of Woman," Katharine Jenkins argues that Sally Haslanger's focal analysis of gender problematically excludes nonpassing trans women from the category "woman." However, Jenkins does not explain why this exclusion contradicts the feminist aims of Haslanger's account. In this paper, I advance two arguments that suggest that a trans-inclusive account of "woman" is crucial to the aims of feminism. I claim that the aims of feminism are to understand and combat women's oppression. (...) First, I argue that denial of trans identities reinforces cultural ideas that perpetuate both transphobic violence and sexual violence against women. Consequently, a feminist account of "woman" that fails to respect trans identities indirectly contributes to the oppression of women. Second, I prove that nonpassing trans women are oppressed as women through the internalization of sexual objectification. I then conclude that an account of "woman" that excludes nonpassing trans women cannot successfully advance a complete understanding of women's oppression. (shrink)

In 2013, controversy sparked student protests, campus debates, and national attention when Smith College denied admittance to Calliope Wong—a trans woman. Since then, eight women’s colleges have revised their admissions policies to include different gender identities such as trans women and genderqueer people. Given the recency of such policies, we interrogate the ways the category “woman” is determined through certain alignments of biology-, legal-, and identity-based criteria. Through an inductive analysis of administrative scripts appearing both in student newspapers and in (...) trans admittance policies, we highlight two areas U.S. women’s colleges straddle while creating these policies: inclusion/exclusion scripts of self-identification and legal documentation, and tradition-/activism-speak. Through these tensions, women’s college admittance policies not only construct “womanhood” but also serve as regulatory norms that redo gender as a structuring agent within the gendered organization.
