The purpose of this essay is to articulate a specific desideratum for any theory of Latinidad, namely, that there is no adequate conception of Latinx without an attendant conception of Afro-Latinx. In order to be reflective of those whom it purports to describe in the U.S. and elsewhere in the hemisphere, the term Latinx must be plastic enough to encompass the many internal differences, and even antagonisms, between its different constituent parts. Within it, we argue here in particular, it must (...) include its Afro-descended history, which includes not just African-descended people but also a denial of the influences of African-descended culture writ large. Our central claim here, then, is that a certain African-descendedness is constitutive of Latinidad in multiple registers, including history, cultural practices, and social identificatory processes despite Latinidad’s pernicious exclusionary history. Applied to enhance vaccinations, boost retirement savings, or promote healthy habits, these interventions align with consensus-defined well-being. As governments adopt nudges, scholars have explored their role in fostering virtues. This paper argues that nudges have the potential to efficiently contribute to virtuous development by instilling and sustaining habits, respecting individual choice, and ensuring deliberation. (...) This paper critically explores the ethical dimensions of Behavioral Public Policy (BPP), a domain grounded in the understanding that human rationality is bounded and that this limitation often leads to behaviors deemed irrational. By applying the behavioral lens, which posits that people operate under bounded rationality, BPP aims to craft interventions that safeguard individuals against their biases. However, this approach raises significant ethical concerns, both in the scientific underpinnings of BPP and its application through policy interventions. Accordingly, this paper examines (...) two distinct ethical dimensions of BPP, both as a scientific discipline and through its intervention methodologies. The analysis of the first dimension argues that, viewing bounded rationality as only instrumental in decision-making processes, risks oversimplifying ethical complexities. Such simplification may ignore the moral and value-based rationalities underlying decisions, potentially misattributing instances of immorality and akrasia (the failure to act according to one's judgment) to mere deficiencies in rational thinking. Secondly, the paper examines the impact of BPP on moral behavior and character development, addressing ethical concerns like the evidentiary basis of BPP research, the bounded rationality of choice architects themselves, and the morality of behavior changes induced by policy. Overall, this article provides a much-needed examination of the moral considerations associated with behavioral strategies in public policy and its epistemological foundations, contributing to a more comprehensive understanding of their ethical implications . A modified visual search task demonstrates that humans are very good at resuming a search after it has been momentarily interrupted. This is shown by exceptionally rapid response time to a display that reappears after a brief interruption, even when an entirely different visual display is seen during the interruption and two different visual searches are performed simultaneously. This rapid resumption depends on the stability of the visual scene and is not due to display or response anticipations. These results are (...) consistent with the existence of an iterative hypothesis-testing mechanism that compares information stored in short-term memory (the perceptual hypothesis) with information about the display (the sensory pattern). In this view, rapid resumption occurs because a hypothesis based on a previous glance of the scene can be tested very rapidly in a subsequent glance, given that the initial hypothesis-generation step has already been performed. Teacher quality, its effect on students’ outcomes, and the association of these with economic growth, is the core of recent discussions in Latin America given the region’s weak results in international learning assessments. This paper investigates whether there is an effect of philosophy on the outcomes of critical reading for students in B.Ed. programs in Colombia. Relying on exact matching combined with propensity score matching with regression adjustment, we use national data from Colombia to show that students in B.Ed. in (...) philosophy outperformed students in other B.Ed. in critical reading test (0.401–0.124 SD), and, importantly, with higher effects observed for students with lower prior academic achievement (0.44 SD). This suggests that philosophy can help to narrow educational outcomes of students whose socioeconomic conditions are disadvantageous, contributing to social justice in education. (shrink)

In his comment, McGann argues that in my “From Sensorimotor Dependencies to Perceptual Practices: Making Enactivism Social,” I have overlooked a group of enactivist theories that can be grouped under the participatory sense-making label. In this reply, I explain that the omission is due to the fact that such theories are not accounts of perception. It is argued that, unlike participatory sense-making, the approach of the “From Sensorimotor Dependencies to Perceptual Practices” article does not focus on the perceptual aspects of (...) things social, but on the social aspects that are constitutive of perception in general. I conclude by underscoring the central argument of the original article: that the adequate notion to make enactivism about perception social is that of “perceptual practices,” a social practices-based notion of perception. Desde que en 2008 se introdujera el concepto de nudge en el libro Nudge, que argumentaba que las pequeñas intervenciones basadas en cambios en la arquitectura de elección pueden alterar el comportamiento de las personas y facilitarles el logro de sus objetivos deseados, el uso de la economía del comportamiento en políticas públicas ha crecido significativamente, lo que ha llevado a la aparición de diferentes intervenciones basadas en conocimientos conductuales. Estas intervenciones se han aplicado en distintas áreas de políticas públicas (...) y administrativas, incluyendo salud, finanzas, o medio ambiente, con el objetivo de promover el bienestar y abordar problemas sociales y económicos. El uso de estas aplicaciones en cuestiones relacionadas con la violencia de género ha sido con frecuencia ignorado. De este modo, el objetivo de este estudio es analizar el uso de herramientas de la economía del comportamiento en políticas públicas, como nudges, boosts o auditoría de sludges y su aplicación a asuntos relacionados con este tipo de violencia. Al mismo tiempo que se señalan los posibles beneficios de su uso, también se reconocen las limitaciones del enfoque conductual, apuntando a la necesidad de una aproximación multifacética para combatir dicha violencia. Resumen: El régimen jurídico de la utilización de los drones plantea grandes retos, siendo esencial un estudio que atienda a los diferentes niveles de regulación, que al menos en la Unión Europea están afectados de provisionalidad y contingencia; así ocurre con el Reglamento 216/2008. Lo mismo ocurre a nivel interno en el Derecho español con la Ley 18/2014 y el nuevo proyecto. Sin embargo, es necesario establecer una adecuada regulación del uso civil de los drones y de la tecnología incorporada (...) -que está en constante desarrollo- garantizando al mismo tiempo seguridad jurídica para las operaciones con drones, y el respeto de los derechos fundamentales que pueden verse afectados, y ello desde una perspectiva multinivel (UE, interno). Este trabajo pretende precisamente un análisis de la actual normativa europea y española desde esa perspectiva, atendiendo en particular al uso civil de los drones. Abstract: The legal framework the use of the drones points out great challenges, and it is essential to develop a study to attend the different levels of regulation, that at least in the European Union, we can see with provisionality and contingency, as it is the case of the Regulation 216/2008. The same thing happens internally in Spanish Law with the Law 18/2014. However, we need to establish an adequate regulation of the civilian use of drones and embedded technology - which is in constant development - while ensuring legal security for drone operations, and respect for fundamental rights that may be affected, with a multi-level legal perspective (EU, internal). Health data processing fields face ethical and legal problems regarding fundamental rights. As we know, patients can benefit in the Digital Era from having health or medical information available, and medical decisions can be more effective with a better understanding of clinical histories, medical and health data thanks to the development of Artificial Intelligence, Internet of Things and other Digital technologies. However, at the same time, we need to guarantee fundamental rights, including privacy ones. The complaint about ethical and legal (...) requirements – including constitutional ones – is particularly relevant in the processing of health data. This paper is focused on the problem of the consent required to the processing of health data and the exceptions established in the new European Union General Data Regulation, which cover the processing of this special data -within other aims- for scientific, historical and statistical research as legitimate purposes, which include biomedical research. The conclusion is that these open concepts are problematic both for the protection of privacy rights and for the legal security/certainty of research. On one hand there are several interpretation problems, regarding the processing of health data and the protection of information privacy. On the other hand, professionals must follow the Multilevel legal framework and to guarantee fundamental rights in the processing of health data, so there are also problems of interpretation for researchers. La protección de los derechos fundamentales en el sistema multinivel europeo exige de criterios hermenéuticos que posibiliten la delimitación del contenido y extensión del derecho fundamental en juego. Así, debemos considerar los derechos fundamentales reconocidos a nivel nacional (Constituciones), internacional (Convenio Europeo de Derechos Humanos) y de la Unión Europea (Carta de Derechos Fundamentales de la Unión Europea). -/- Es necesario delimitar los criterios de interconexión más adecuados para llegar a los criterios de interpretación de los que se deriven las (...) exigencias y garantías de los derechos fundamentales. En el marco de los países miembros de la Unión Europea, que son a su vez parte del Consejo de Europa, es donde se da este sistema multinivel a tres bandas, donde será necesario analizar los criterios de interconexión desde el derecho de la Unión Europea, que es el que consagra el criterio del máximo nivel de protección aplicable, tras la entrada en vigor del Tratado de Lisboa el 1 de diciembre de 2009, y que como veremos es compatible con los límites constitucionales consagrados en la doctrina constitucional de los Estados miembros, así como con el Convenio Europeo de Derechos Humanos (teniendo en consideración la futura adhesión de la UE), puesto que este criterio implica que a la hora de tutelar los derechos fundamentales habrá que buscar el nivel más alto de protección de los mismos. It is not yet clear which response behavior requires self-regulatory effort in the moral dilemma task. Previous research has proposed that utilitarian responses require cognitive control, but subsequent studies have found inconsistencies with the empirical predictions of that hypothesis. In this paper we treat participants’ sensitivity to utilitarian gradients as a measure of performance. We confronted participants (N = 82) with a set of five dilemmas evoking a gradient of mean utilitarian responses in a 4-point scale and collected data on (...) heart rate variability and on utilitarian responses. We found positive correlations between tonic and phasic HRV and sensitivity to the utilitarian gradient in the high tonic group, but not in the low tonic group. Moreover, the low tonic group misplaced a scenario with a selfish incentive at the high end of the gradient. Results suggest that performance is represented by sensitivity correlated with HRV and accompanied with a reasonable placement of individual scenarios within the gradient. (shrink)

This paper introduces pragmatic hypotheses and relates this concept to the spiral of scientific evolution. Previous works determined a characterization of logically consistent statistical hypothesis tests and showed that the modal operators obtained from this test can be represented in the hexagon of oppositions. However, despite the importance of precise hypothesis in science, they cannot be accepted by logically consistent tests. Here, we show that this dilemma can be overcome by the use of pragmatic versions of precise hypotheses. These pragmatic (...) versions allow a level of imprecision in the hypothesis that is small relative to other experimental conditions. The introduction of pragmatic hypotheses allows the evolution of scientific theories based on statistical hypothesis testing to be interpreted using the narratological structure of hexagonal spirals, as defined by Pierre Gallais. En este ensayo desenmascaro los presupuestos erróneos de esta posición y defiendo que el altruismo como equidad no es incompatible con la selección natural. Rechazo una concepción hobbesiana de la moral, pero sugiero su empleo en la interpretación de la (...) psicología de los primates no humanos y en un modelo de progresión evolutiva que habría llevado a la moralidad como adaptación pasando por la razón instrumental. /// Sociobiologists have endorsed a "Calvinist" position captured in the following formula: if natural selection explains moral attitudes, morality is not genuinely altruistic; if morality is altruistic, then natural selection cannot explain it. I expose the false presuppositions behind this claim and argüe that altruism as fairness is not incompatible with natural selection. I reject a Hobbesian view of morality as an instrumental endorsement of fairness norms, but suggest its use to interpret primate psychology and to model an evolutionary progression ending in moral capacities as adaptations. This paper faces the problem of how to determinate the framework in which, according to Aristotle, the deliberation and his results can be assessed: the decision and the consequent action. The problem emerges mainly because of what Aristotle calls “indetermination of deliberation,” since, in situations whose options about what to deliberate are blurred, it is difficult to determinate which is the framework that can be used to determinate if the decision resulting from the deliberation is accurate or not. To face (...) this problem, in the first place, we distinguish between technical and moral deliberation. The distinction is framed in terms of the ends because in technical deliberation the end is extrinsic to the action itself, and for this reason it is possible to offer different assessments of the actions achieved. In moral deliberation, the ends are only intrinsic to the action, and they are determined only in behalf of their connection with good deliberation. So, it is only possible to establish an adequate normative framework to assess each deliberation based upon a “good deliberation model”, established by practical wisdom, and extended also for the community from which the subject takes part. Since the concept of “nudge” was introduced in 2008 by Thaler and Sunstein, proposing that small interventions based on changes in choice architectures can alter people’s behavior and make it easier for them to achieve their desired goals, the application in public policy of behavioral economics has gained significant attention. This has led to the emergence of different types of policies based on behavioral insights, which have been used in a variety of areas, including health or finance, with the goal (...) of promoting well-being and addressing social and economic issues. After providing a basic theoretical background as a frame of reference to understand gender violence, this study explores the use of tools from the field of behavioral economics as it is applied in public policy. Regulatory (paternalistic) and non-regulatory (libertarian) interventions based on behavioral insights will be considered: nudges, boosts, shoves, budges, or sludge audits, are examined as potential interventions to use in matters related to this type of violence. After evaluating these behavioral policy instruments and their potential effectiveness, the limitations of the behavioral perspective are recognized, and the need for a multifaceted approach to combating gender violence is acknowledged. The article concludes by arguing that public policies addressing gender violence should not only utilize behavioral tools but should also incorporate strategies related to education, legislation, and social norms. I argue for the Cooperative Warrant Thesis (CWT), according to which the determinants of testimonial contents in communication are given by the practical requirements of cooperative action. This thesis distances itself from conventionalist views, according to which testimony must be strictly bounded by conventions of speech. CWT proves explanatorily better than conventionalism on several accounts. It offers a principled and accurate criterion to distinguish between testimonial and non-testimonial communication. In being goal-sensitive, this criterion captures the role of weak and robust (...) cooperation in determining the contents to which speakers testify or fail to testify. And, finally, it yields a principled explanation of why testimony entails the epistemic commitments that distinguish it as an epistemic source. (shrink)

Two Mosaic figures (Thomas Jefferson and Confucius) will be introduced here as a means of gauging whether Democracy is solely the child of the West and/or whether it can also be traced to a conceptual foundation in Confucianism, the practical political philosophy of ancient China. The teachings of Confucius (c. 551-479 BCE) as a source of political thought appear to be comprehensive enough to provide us with a just model for the administration of the state.

Epistemic Utility Theory is often identified with the project of *axiology-first epistemology*—the project of vindicating norms of epistemic rationality purely in terms of epistemic value. One of the central goals of axiology-first epistemology is to provide a justification of the central norm of Bayesian epistemology, Probabilism. The first part of this paper presents a new challenge to axiology first epistemology: I argue that in order to justify Probabilism in purely axiological terms, proponents of axiology first epistemology need to justify a (...) claim about epistemic value—what I label ‘Downwards Propriety’—much stronger than any they have offered justification. The second part of this paper offers an argument that this challenge cannot be met: that there is no hope for providing a purely axiological justification of Downwards Propriety, at least given widely accepted assumptions about epistemic value. Although vaccines are considered an efficient public health tool by medical experts, in different countries, people’s confidence in them has been decreasing. COVID-19 has elevated medical scientists’ and practitioners’ social reputation, and it may have reduced global vaccination hesitancy. Still, this alone will not altogether remove the existent frictions that prevent people from complying with vaccination schedules. This paper will review the common causes behind vaccination hesitancy. It will also explore different types of public policy interventions that health experts in (...) governments and institutions employ to fight vaccine hesitancy and non-compliance. The main objective of this article is to argue that, considering the nature of the issue (vaccine hesitancy and its causes), among the various possibilities, policies based on behavioral insights can provide an effective instrument to remove those frictions. Among them, special attention will be devoted to nudges which promise efficiency while avoiding some of the ethical and political costs of other interventions, thanks to their libertarian paternalistic frame. The article concludes by suggesting that public health policymakers should consider the libertarian paternalistic approach of nudges when deploying interventions that aim at changing people’s attitudes and behavior. Political fact-checkers evaluate the truthfulness of politicians’ claims. This paper contributes to an emerging scholarly debate on whether fact-checkers treat political parties differently in a systematic manner depending on their ideology (bias). We first examine the available approaches to analyze bias and then present a new approach in two steps. First, we propose a logistic regression model to analyze the outcomes of fact-checks and calculate how likely each political party will obtain a truth score. We test our model with a (...) sample of fact-checks from Newtral, a major Spanish fact-checker. Our model would signal bias under two assumptions: a) all political parties are on average equally accurate in their statements; b) the verification method gives precise instructions and is implemented systematically. We investigate this second assumption with a series of interviews with Newtral fact-checkers. We show that standard verification protocols are so loosely implemented that fact-checks reflect a set of journalistic decisions, rather than a bias in the statistical sense. Los desencuentros de la filosofía latinoamericana con Nietzsche pueden entenderse como un sínto-ma de algo más que un problema de legibilidad o malentendido. En tanto pensamiento de lo uno, la filosofía latinoamericana (mayoritaria) no puede servirse del pensamiento nietzscheano: es imposi-ble construir un pensamiento del origen y la unidad desde un pensamiento de lo múltiple, como el de Nietzsche. La identidad, tan buscada por esa filosofía latinoamericana mayoritaria, es una ansiedad antigenealógica. En ese sentido, esa filosofía y su procedencia no (...) es solo eurocéntrica, como ya ha sido expuesto por otros comentaristas, sino reactiva, y esto vale para tres de sus tendencias principa-les: la filosofía normalizadora, la corriente historicista y la filosofía latinoamericana de la liberación. De ahí, de paso, la fascinación de dicho pensamiento con la idea de carencia —nunca hemos sido lo suficientemente civilizados—. Esto ha instaurado un cuerpo sufriente en América Latina, atrapado en la dialéctica de la víctima y el victimario. Se trata entonces de pensar con Nietzsche para intentar pensar sin resentimiento desde América Latina y sobre esta. ¿Nietzsche en América Latina? This article faces the classic problem of the interpretation of what Aristotle calls in de An. III, 5 “the intellect that produces all things”, which is commonly named agent intellect. Historically, there have been two approaches: one that goes back to Alexander of Aphrodisias, who associates the agent intellect with the unmoved mover and the divinity, and another one, associated with Theophrastus but whose major representatives are Philoponus and St. Thomas of Aquinas, who consider that agent intellect is an exclusively (...) human faculty. This last interpretation has been the most accepted historically. Nevertheless, in recent years there has been a resurgence of interpretations of the agent intellect as divine (Caston, Frede, Burnyeat, and others). What we want to demonstrate in this article is that this revival, more than responding to a reinterpretation of the agent intellect, is due to a different understanding of the divinity in Aristotle’s philosophy, which supposes immanent characteristics closer to the human intellect. Many think that expressivists have a special problem with negation. I disagree. For if there is a problem with negation, I argue, it is a problem shared by those who accept some plausible claims about the nature of intentionality. Whether there is any special problem for expressivists turns, I will argue, on whether facts about what truth-conditions beliefs have can explain facts about basic inferential relations among those beliefs. And I will suggest that the answer to this last question is, (...) on most plausible attempts at solving the problem of intentionality, ‘no’. (shrink)

In line with recent efforts to empirically study the folk concept of weakness of will, we examine two issues in this paper: (1) How is weakness of will attribution [WWA] influenced by an agent’s violations of best judgment and/or resolution, and by the moral valence of the agent’s action? (2) Do any of these influences depend on the cognitive dispositions of the judging individual? We implemented a factorial 2x2x2 between–subjects design with judgment violation, resolution violation, and action valence as independent (...) variables, and measured participants’ cognitive dispositions using Frederick’s Cognitive Reflection Test [CRT]. We conclude that intuitive and reflective individuals have two different concepts of weakness of will. The study supports this claim by showing that: a) the WWA of intuitive subjects is influenced by the action’s (and probably also the commitment’s) moral valence, while the WWA of reflective subjects is not; b) judgment violation plays a small role in the WWA of intuitive subjects, while reflective subjects treat resolution violation as the only relevant trait. Data were collected among students at two different universities. All subjects (N=710) answered the CRT. A three-way ANOVA was first conducted on the whole sample and then on the intuitive and reflective groups separately. This study suggests that differences in cognitive dispositions can significantly impact the folk understanding of philosophical concepts, and thus suggests that analysis of folk concepts should take cognitive dispositions into account. On a view implicitly endorsed by many, a concept is epistemically better than another if and because it does a better job at ‘carving at the joints', or if the property corresponding to it is ‘more natural' than the one corresponding to another. This chapter offers an argument against this seemingly plausible thought, starting from three key observations about the way we use and evaluate concepts from en epistemic perspective: that we look for concepts that play a role in explanations (...) of things that cry out for explanation; that we evaluate not only ‘empirical' concepts, but also mathematical and perhaps moral concepts from an epistemic perspective; and that there is much more complexity to the concept/property relation than the natural thought seems to presuppose. In this essay I revise, based on the notion of the ‘enlightened ruler’ or mingzhu and his critique of the literati of his time, the common belief that Han Fei was an amoralist and an advocate of tyranny. Instead, I will argue that his writings are dedicated to advising those who ought to rule in order to achieve the goal of a peaceful and stable society framed by laws in accordance with the dao.

Les dernières décennies ont vu apparaître une nouvelle approche de l’histoire de la philosophie liée à la tradition analytique. L’auteur propose de montrer dans cette étude le lien entre la naissance de l’approche analytique de l’histoire de la philosophie et le travail réalisé par trois figures de l’histoire de la philosophie médiévale au XXème siècle : Kretzmann, Pinborg et Kenny. Epistemic rationality is typically taken to be immodest at least in this sense: a rational epistemic state should always take itself to be doing at least as well, epistemically and by its own light, than any alternative epistemic state. If epistemic states are probability functions and their alternatives are other probability functions defined over the same collection of proposition, we can capture the relevant sense of immodesty by claiming that epistemic utility functions are (strictly) proper. In this paper I examine (...) what happens if we allow for the alternatives to an epistemic state to include probability functions with different domains. I first prove an impossibility result: on minimal assumptions, I show that there is no way of vindicating strong immodesty principles to the effect that any probability function should take itself to be doing at least as well than any alternative probability function, regardless of its domain. I then consider alternative, weaker generalizations of the traditional immodesty principle and prove some characterization results for some classes of epistemic utility functions satisfying each of the relevant principles. La metafísica después de ser ignorada por años ha regresado al centro de la escena en la filosofía contemporánea. Tomás de Aquino ha vivido una historia muy parecida, lo que dio nacimiento al tomismo analítico. A pesar de los trabajos desarrollados en esta línea de investigación, la metafísica del Aquinate ha sido fuertemente ignorada. Sin embargo, la metafísica de Tomás de Aquino tiene una ventaja, poco discutida entre los tomistas y tomasinos, y es la de ser una metafísica esencialista. Así, (...) en armonía con el trabajo del metafísico E. J. Lowe, quien presenta su metafísica como “esencialista seria”, se quiere mostrar que la metafísica del Aquinate tiene las mismas virtudes del “esencialismo serio”, lo que permite postularla como una posición válida y plausible para la metafísica contemporánea. Proponents of enactivism should be interested in exploring what notion of action best captures the type of action-perception link that the view proposes, such that it covers all the aspects in which our doings constitute and are constituted by our perceiving. This article proposes and defends the thesis that the notion of sensorimotor dependencies is insufficient to account for the reality of human perception, and that the central enactive notion should be that of perceptual practices. Sensorimotor enactivism is insufficient because (...) it has no traction on socially dependent perceptions, which are essential to the role and significance of perception in our lives. Since the social dimension is a central desideratum in a theory of human perception, enactivism needs a notion that accounts for such an aspect. This article sketches the main features of the Wittgenstein-inspired notion of perceptual practices as the central notion to understand perception. Perception, I claim, is properly understood as woven into a type of social practices that includes food, dance, dress, music, etc. More specifically, perceptual practices are the enactment of culturally structured, normatively rich techniques of commerce of meaningful multi- and inter-modal perceptible material. I argue that perceptual practices explain three central features of socially dependent perception: attentional focus, aspects’ saliency, and modal-specific harmony-like relations. (shrink)

This paper presents an impact evaluation of the policies for teacher education programs within the framework of the National Development Plan 2014-2018. The programs were compelled to obtain high-quality accreditation, increase the credits in school practices, and the English level, among other requirements. Relying on multivariable regression, it shows that, for the year 2021, there is no association between high-quality accreditation in most modules of the Saber Pro tests, or it is negative in the global score and quantitative reasoning. In (...) a second step, using Differences–in–Differences, it evidences how the changes made by the programs had positive effects on the performance of students compared to other professional programs. The results show significant improvement in most modules of the Saber Pro test, except for the English module. The effects were homogeneous by characteristics of the students and institutions, but heterogeneous by area of knowledge, indicating that the effect is mainly due to the curricular changes of the programs.
