This paper examines the relation between Cartwright's concept of 'capacities' and Mill's concept of 'tendencies' and argues that they are not equivalent. Cartwright's concept of 'capacities' and her motivation to adopt it as a central notion in her philosophy of science are described. It is argued that the Millian concept of 'tendencies' is distinct because Mill restricts its use to a set of special cases. These are the cases in which causes combine 'mechanically'. Hence for Mill 'tendencies' do not merely (...) describe the operation of causes, but also and perhaps even primarily how they combine. This does not hold of Cartwrightian capacities which are meant to have unlimited applicability. Mill also explicitly denies the realism of 'capacities' in a sense which overlaps with Cartwright's. Her attempt to derive empirist credentials for her notion of capacity from Mill is therefore unsuccessful. (shrink)

This chapter discusses (in German) John Stuart Mill's position on paternalism and how it relates to his book 'The Subjection of Women'. It is argued that Mill's claim (in On Liberty) that one should not be allowed to sell oneself into slavery is making reference to the Victorian marriage contract through which women essentially become slaves of their husbands. As argued in Subjection, women do not freely develop the desire to get married, the social circumstances do not leave them any (...) other options. Necessarily unaware of what married life is like, the decision to get married is like crossing an unsafe bridge without knowing it is unsafe. It is not paternalist, as Mill argues, to alert them to the condition of the bridge and put them in the position to decide for themselves whether they want to cross it (or turn back half way, e.g. by divorcing). This paper argues that the proponents of epistemological scientism must take some stand on scientific methodology. The supporters of scientism cannot simply defer to the social organisation of science because the social processes themselves must meet some methodological criteria. Among such criteria is epistemic evaluability, which demands intersubjective access to reasons. We derive twelve theses outlining some implications of epistemic evaluability. Evaluability can support weak and broad variants of epistemological scientism, which state that sciences, broadly construed, are the best sources (...) of knowledge or some other epistemic goods. Since humanities and social sciences produce epistemically evaluable results, narrow types of scientism that take only natural sciences as sources of knowledge require additional argumentation in their support. Strong scientism, which takes sciences as the only source of knowledge, also needs to appeal to some further principles since evaluability is not an all-or-nothing affair. (shrink)

Background: Adequate immunity to COVID-19 apparently cannot be attained in Germany by voluntary vaccination alone, and therefore the introduction of mandatory COVID-19 vaccination is still under consideration. We present findings on the potential acceptance of such a requirement by the German population, and we report on the reasons given for accepting or rejecting it and how these reasons vary according to population subgroup. -/- Methods: We used representative data from the Socio-Economic Panel for the period January to December 2021. We (...) linked the respondents’ answers concerning mandatory COVID-19 vaccination to information about their sociodemographic characteristics, state of health, political attitudes, and degree of confidence in the judicial and political systems. We analyzed these data using univariate, bivariate, and multivariate statistical methods. -/- Results: Just over half of the respondents (50.44% [49.08%; 51.79%]) favored mandatory COVID-19 vaccination. Among the supporters, the reason most frequently given (95.22% [94.45; 96.00]) was that, without such a requirement, not enough people would be vaccinated. Among the opponents of mandatory COVID-19 vaccination (49.56% [48.21%; 50.92%]), by far the most common reason given for opposing it was a desire to uphold individual freedom (91.36% [90.31%; 92.40%]). Persons supporting mandatory COVID-19 vaccination, on average, older than those who opposed it; they less commonly had an education beyond secondary school, were less healthy, tended to have no children, had centrist political views, and expressed more confidence in the political system. The largest difference between the two groups was that about 90% of supporters of mandatory COVID-19 vaccination were themselves vaccinated, compared to only about 62% of opponents. -/- Conclusion: The lack of consensus on this issue among politicians and physicians in Germany is reflected in a similar lack of consensus in the German population as a whole. A discussion of the appropriate understanding of individual freedom would be the most promising way to widen the acceptance of mandatory COVID-19 vaccination. Several vaccines against COVID-19 have now been developed and are already being rolled out around the world. The decision whether or not to get vaccinated has so far been left to the individual citizens. However, there are good reasons, both in theory as well as in practice, to believe that the willingness to get vaccinated might not be sufficiently high to achieve herd immunity. A policy of mandatory vaccination could ensure high levels of vaccination coverage, but its legitimacy is doubtful. (...) We investigate the willingness to get vaccinated and the reasons for an acceptance (or rejection) of a policy of mandatory vaccination against COVID-19 in June and July 2020 in Germany based on a representative real time survey, a random sub-sample (SOEP-CoV) of the German Socio-Economic Panel (SOEP). Our results show that about 70 percent of adults in Germany would voluntarily get vaccinated against the coronavirus if a vaccine without side effects was available. About half of residents of Germany are in favor, and half against, a policy of mandatory vaccination. The approval rate for mandatory vaccination is significantly higher among those who would get vaccinated voluntarily (around 60 percent) than among those who would not get vaccinated voluntarily (27 percent). The individual willingness to get vaccinated and acceptance of a policy of mandatory vaccination correlates systematically with socio-demographic and psychological characteristics of the respondents. We conclude that as far as people’s declared intentions are concerned, herd immunity could be reached without a policy of mandatory vaccination, but that such a policy might be found acceptable too, were it to become necessary. Given the importance of the principle of causality for the demonstration of God’s existence, this paper attempts to justify the evidence and necessity of the principle of causality, by following Fr. Fabro’s Thomistic defense—based on the notion of participation—but adding a particular emphasis on the notion of “being which is not per se,” this latter as an explanatory notion of the notion of “being which is by participation.” The introductory remarks touch upon two misunderstandings regarding the notion of participation employed (...) as a subject of the principle of causality: the first, considering “participated being” as a synonym of “received being,” and the second, the confusion, regarding the notion of being by participation, between its notional dependence on the notion of being as a whole and its real dependence on the real intensive Being. Then, in the first point, the defense of the principle of causality is distinguished from other related problems, like the particular applications of this principle. In the second and main point, we try to justify the necessity of being caused in the being which is experienced as being by participation, as follows: 1) that which is something by participation is not this something per se; 2) now, that which is not per se, either is not or is per aliud, 3) Therefore, that which is something by participation is per aliud. In the third and last point, we endeavor to justify the Thomism of our defense and of our emphasis on this notion of “being which is not per se” by considering two texts of St. Thomas. (shrink)

These thirteen paragraphs portray epistemology as the study, not directly of knowing as a human action (which could be considered the object also of anthropology) but as the study of the mode of being of the object in the subject and, in this sense, of intentional being. Moreover, intentional being is not understood as the being of the cognitional species or representation, which is real and subjective, but as the being of the known, as the presence of the known to (...) the knower (obviously, through the species but a being not reduced to the subjective being of the species): this kind of being is the proper object of epistemology. Other considerations regarding the distinction between metaphysics and epistemology take place as well. As regards the method, this essay attempts to apply Aquinas’ four steps of scientific reasoning to epistemology, in the following fashion and order: 1- Solution of the problem of the universals by recourse to the theory of the agent intellect (resolutio secundum rem); 2- Definition of knowledge as intentional possession of being (res. sec. rationem); 3- Judgment of value regarding the different instances of human knowledge or critique of knowledge (compositio secundum rem) and 4- Reinterpretation (in the light of the previous path) of common notions of epistemology, such as truth, certainty, evidence, and error (comp. sec. rationem). This article offers an explanation of perhaps Wittgenstein’s strangest and least intuitive thesis – the semantical mutation thesis – according to which one can never answer a mathematical conjecture because the new proof alters the very meanings of the terms involved in the original question. Instead of basing our justification on the distinction between mere calculation and proofs of isolated propositions, characteristic of Wittgenstein’s intermediary period, we generalize it to include conjectures involving effective procedures as well.

An explanation for why Smith appeared to have justified true belief is given by distinguishing between 'belief' and 'belief in truth'. In this Chapter, we address the challenge of explaining institutional change, asking whether the much-criticized rational choice perspective can contribute to the understanding of institutional change in political science. We discuss the methodological reasons why rational choice institutionalism (RCI) often assumes that institutional change is exogenous and discontinuous. We then identify and explore the possible pathways along which RCI can be extended to be more useful in understanding institutional change in political science. Finally, we reflect on what RCI theorizing would (...) look like if it started to take endogenous change seriously: by giving up some of its simplifying assumptions, RCI can be a useful tool for analyzing institutional change, but choosing this path has consequences for the generality of the models in RCI as well as for the style of its theorizing. There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. This paper discusses (in German) an idea enshrined in the recent (2012) revision of the German transplantation law. The law allows family members to make claims about what the deceased would have wanted to happen to his/her organs/tissue even though he/she never has voiced any relevant opinions. I argue that this is illegitimate.

This paper argues that the main global critiques of scientism lose their punch because they rely on an uncharitable definition of their target. It focuses on epistemological scientism and divides it into four categories in terms of how strong (science is the only source of knowledge) or weak (science is the best source of knowledge) and how narrow (only natural sciences) or broad (all sciences or at least not only the natural sciences) they are. Two central arguments against scientism, the (...) (false) dilemma and self‐referential incoherence, are analysed. Of the four types of epistemological scientism, three can deal with these counterarguments by utilizing two methodological principles: epistemic evaluability of reliability and epistemic opportunism. One hopes that these considerations will steer the discussion on scientism to more fruitful pastures in the future. In the discourse on International Justice, traditional frameworks are deeply rooted in 'embodied metaphysics'—a perspective embedded in the tangible experiences of human existence. By contrasting the physical with the digital realms, I suggest that our current global justice systems are ill-equipped to address the complexities of the digital age. Utilizing the metaphor of water to highlight the often-unseen environment shaping justice theories and practices, I argue that International Justice, as conventionally understood, reflects the constraints akin to fish oblivious to the (...) water surrounding them. In digital spaces, individuals are no longer bound by principles of singularity and locality, and instead operate by principles of multiplicity and nonlocality. These metaphysical differences disrupt many theories of global justice assuming singularity and nonlocality. My aim is to encourage scholars and practitioners to 'see water'—to acknowledge and critically reassess the foundational assumptions underlying their theories and practices in an era of digital transformation. In a world of more than 7 billion people, 80% live on less than $10 per day. Five (5) percent of global income is generated by the poorest 40 percent of the world’s population; while the wealthiest 20% of the population generates 75 percent of world income. Economics attempts to define or describe behavior and it ventures into the realm of predicting. Economics should therefore accept responsibility for controlling/directing realities. If we can understand, define and predict behavior, we should accept (...) the responsibility for changing behavior, and as economists, bring that to bear on material upliftment of the greater majority of the earth’s populace. . Since 1847, numerous role-players have debated and worked tirelessly to promote the welfare of those who are marginalised from mainstream society. To what avail? Exactly one hundred and fifty eight years later, one of the iconic statesmen of the twentieth century, Nelson Mandela, stated: “Massive poverty and obscene inequality are such terrible scourges of our time – times in which the world boasts breathtaking advances in science, technology, industry and wealth accommodation – that they have to rank alongside slavery and apartheid as social evils” (as quoted in Green 2009:2).Clearly, significant progress in addressing the issue has not been made. A concerted drive by the United Nations led to the adoption of the Millennium Development Goals in September 2000, and was endorsed by 189 world leaders. Some progress has been made during the past decade, but it is apparent that many countries are not going to be able to reach their goals. Hence, in order to address poverty at its root, attention is increasingly focused on the contribution of the informal sector and small, medium and micro enterprises. This paper explores such and offers alternatives to combat the spectres of structural unemployment and poverty. (shrink)

Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. El testimonio es nuestra mayor fuente de creencias. La gran mayoría de nuestras creencias han sido adquiridas a partir de las palabras de otros y no a través de la observación directa del mundo. Una de las peculiaridades de la mayor parte de las creencias testimoniales es que son aceptadas sin ninguna deliberación consciente. Mientras el testimonio sea consistente con nuestras creencias y la fuente sea confiable, la reacción más corriente es la aceptación automática de la información (Thagard 2004, 2005). (...) Nuestra confianza en el testimonio de los demás es un requisito no sólo para la construcción colectiva del conocimiento (Hardwig 1985, 1991), sino también para la interacción social en general. Sin embargo existen contextos en los que la aceptación apresurada de un testimonio falso puede tener consecuencias nefastas. En contextos científicos, legales, políticos y financieros, entre otros, se toman decisiones importantes y se implementan políticas cruciales a partir de las afirmaciones de otros. En estos contextos la aceptación de un testimonio debe ser el resultado de un proceso de decisión basado en criterios objetivos de justificación. Sin embargo, existen dos objeciones al intento de justificar la aceptación de un testimonio (Coady 1973, 1992). La primera es que cualquier justificación será irremediablemente circular puesto que la inmensa mayoría de testimonios obtienen su justificación, al menos en parte, de evidencia de tipo testimonial. La segunda es que nuestras inferencias acerca de la confiabilidad de ciertos tipos de testimonio nunca tendrán un apoyo inductivo lo suficientemente fuerte debido a que los casos en los que un tipo de testimonio puede ser verificado directamente en la experiencia nunca serán lo suficientemente numerosos. En este ensayo presento una solución al problema de cómo decidir racionalmente si un testimonio puede ser aceptado como evidencia probatoria en una investigación. Mi propuesta, que está basada en la teoría de revisión de creencias desarrollada por Levi (1984, 1991), muestra que la aceptación justificada de un testimonio está basada en exactamente los mismos mecanismos de adquisición de creencias que operan en el caso de evidencias no testimoniales; al mismo tiempo, la propuesta da cuenta de las particularidades que se presentan en el proceso de evaluación de una evidencia testimonial. Mi tesis es que la decisión de aceptar un testimonio es un proceso que se cumple en dos etapas. En la primera se busca una justificación pare el testimonio buscando todos los hechos que aumenten la probabilidad de que el testimonio sea verdadero, es decir, de que el testigo o declarante esté reportando verídicamente un hecho. La aceptación de estos hechos y de su relación probabilística positiva con respecto al testimonio está basada en la búsqueda de un equilibrio entre su credibilidad y su valor informativo. En la segunda etapa, se determina si la justificación obtenida en la primera es suficiente para la aceptación del testimonio, de nuevo buscando encontrar un equilibrio entre su credibilidad y la utilidad de la información que contiene en promover los intereses y metas cognitivas del investigador. In this research I present a study on the origin of alienism in the 19th century in the work of Phillipe Pinel in context. The purpose of the paper is to show how the French physician proposes alienism inspired by the anthropological ideas of his time. After the introduction, a brief historical overview of the anthropology of modernity is given to place Pinel's work in context. This is followed by a survey of Pinel's anthropological ideas, which are in a sense (...) coincident with his period. Finally, it is presented how Pinel proposes his famous alienism, situated between the understanding and the affected life, as well as the way of curing his patients as a consequence of his anthropological approach. Understanding requires the recognition of the other as a thou, the acceptance of the lack of distance from him and the openness to embrace what is said by him as a possible truth. Understanding has a dialectical structure which implies the cancellation of one’s own expectations and the access to a more comprehensive knowledge. Even though every understanding is historical, it discloses an aspect of the thing itself, which results from the interaction of the I and the thou during the process of hermeneutical conversation and constitutes a common truth with analogous characteristics to practical reason.] . Margaret Urban Walker argues that hospital ethics committees should think of their task as "keeping moral space open." I develop her suggestion with analogies: Enlarge the windows (i.e., expand what counts as an ethical issue); add rooms and doors (i.e., choose particular issues to engage). Examples include confidentiality defined as information flow, and moral distress in the healthcare workplace.

In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. Moreover, that, in this particular process of reasoning, (...) doctrinal topics must follow a certain order. Thus, in particular, I argue that the distinction between essence and act of being in every creature cannot be argued before arguing the existence of God. I touch upon the notion of separation in metaphysics and I compare Aquinas' notion of resolution with Fabro's notion. (shrink)

Se concluye mostrando la oposición que se da entre ambos autores en la manera de considerar el modo de ser del lenguaje y el acontecimiento del ser que en éste tiene lugar. [/] -/- In permanent contrast with Heidegger’s thought, this study develops Gadamer’s conception of otherness, its place in the hermeneutic project of Truth and Method and the reformulation that all this entails of human existence disclosedness and the event of being itself. Work starts raising Gadamer’s critique to the ontological [42] recognition of the others by Heidegger; it shows then the opposition between the “being-towards-death” and “being-for-history”, and the relevance of practical life and the idea of dialogue as a model of understanding in Gadamer’s philosophy. The article introduces a cognitive and componential view of religious emotions. General emotions are claimed to consist of at least two compounds, the cognitive compound and the affective compound. Religious emotions are typically general emotions which are characterized by three specific conditions: they involve a thought of God or godlike, they are significant for a person feeling them and their meaning is derived from religious practices. The article discusses the notion of spiritual emotions in Ancient theology and compares the idea (...) of it with emotions in music. By referring to the notion of mental language, it is argued that some religious emotions are like emotions in music and as such they can be interpreted as tones of Logos. (shrink)

¿Existe alguna diferencia filosóficamente significativa entre una explicación científica y las explicaciones que se ofrecen en el curso de la vida diaria? Dado que la mayor parte de las discusiones en la filosofía de la ciencia se refieren al primer tipo de explicaciones, debemos considerar si existe un concepto específico que corresponda al término “explicación científica”, y que sea discontinuo de su contraparte cotidiana. El ensayo tiene cuatro secciones. En cada una de ellas considero diferentes criterios que podrían ser utilizados (...) para establecer una distinción de clase entre las explicaciones científicas y las cotidianas. En la primera sección exploro la posibilidad de establecer un criterio puramente sociológico: el estatus científico de una explicación dependería del estatus institucional de las personas que dan origen a la explicación. El segundo criterio estudiado fue propuesto por Hempel: las explicaciones científicas deben hacer uso explícito de leyes naturales, y la ausencia de leyes invalida cualquier intento de ofrecer una explicación científica. Un tercer criterio se basa en la naturaleza del explanandum. Algunos filósofos han defendido la idea de que la única diferencia filosóficamente significativa entre las explicaciones científicas y las no científicas reside en el tipo de explanandum del que se ocupa cada una de ellas. En la vida diaria explicamos eventos individuales, mientras que en la ciencia se pretende explicar regularidades. Finalmente, examino el criterio propuesto por Wesley Salmon según el cual la diferencia entre los dos tipos de explicación está determinada por el tipo de comprensión que proporciona cada uno de ellos. Al final concluyo que ninguno de estos criterios es adecuado y que la aparente diferencia entre los dos tipos de explicaciones es una diferencia de grado y no de clase. Las explicaciones científicas ciertamente tienen un mayor grado de precisión, detalle y complejidad que sus contrapartes en la vida cotidiana. Normalmente involucran el uso de las matemáticas y de lenguajes altamente regimentados. Pero a pesar de estas diferencias, concluyo que los elementos que hacen que algo sea una explicación son esencialmente los mismos en ambos casos. (shrink)

The objective of this article is to try to elucidate Wittgenstein’s ex-travagant thesis that each and every mathematical advancement involves some “semantical mutation”, i.e., some alteration of the very meanings of the terms involved. To do that we will argue in favor of the idea of a “modal incompati-bility” between the concepts involved, as they were prior to the advancement, and what they become after the new result was obtained. We will also argue that the adoption of this thesis profoundly (...) alters the traditional way of con-struing the idea of “progress” in mathematics. (shrink)

Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

Testimony about the future dangerousness of a person has become a central staple of many judicial processes. In settings such as bail, sentencing, and parole decisions, in rulings about the civil confinement of the mentally ill, and in custody decisions in a context of domestic violence, the assessment of a person’s propensity towards physical or sexual violence is regarded as a deciding factor. These assessments can be based on two forms of expert testimony: actuarial or clinical. The purpose of this (...) paper is to examine the scientific and epistemological basis of both methods of prediction or risk assessment. My analysis will reveal that this kind of expert testimony is scientifically baseless. The problems I will discuss will generate a dilemma for factfinders: on the one hand, given the weak predictive abilities of the branches of science involved, they should not admit expert clinical or actuarial testimony as evidence; on the other hand, there is a very strong tradition and a vast jurisprudence that supports the continued use of this kind of expert testimony. It is a clear case of the not so uncommon conflict between science and legal tradition. (shrink)

Exposed in 1948, within his masterpiece on the scope and limits of human knowledge, the epistemological tenets that Bertrand Russell regarded as fundamental elements in the construction of scientific knowledge, are still worthy of a detailed discussion today. Given the excellence of the author, it will not be surprising to see that Russell's gnoseologic postulates, even for the present scientific view, address some of the most controversial questions still to be solved in the theory of knowledge.

Uno de los principios éticos mencionados más frecuentemente en los lineamientos para el desarrollo de la inteligencia artificial (IA) es la transparencia algorítmica. Sin embargo, no existe una definición estándar de qué es un algoritmo transparente ni tampoco es evidente por qué la opacidad algorítmica representa un reto para el desarrollo ético de la IA. También se afirma a menudo que la transparencia algorítmica fomenta la confianza en la IA, pero esta aseveración es más una suposición a priori que una (...) tesis basada en evidencia empírica. Tampoco se discute mucho hasta qué punto es técnicamente posible volver transparente la caja negra de la IA a través de los métodos de explicabilidad. En este capítulo haré un análisis de la interrelación entre los conceptos de transparencia, explicabilidad y confianza. Inicialmente, analizaré los diferentes tipos de opacidad algorítmica para entender mejor cuál es el problema al que nos enfrentamos. En las secciones subsiguientes trazaré la relación entre explicabilidad y transparencia, y presentaré los límites de los métodos actuales de explicabilidad. En la sección final, examinaré la evidencia empírica acerca de la relación entre transparencia y confianza en las decisiones automatizadas basadas en sistemas de IA. (shrink)

Aunque el derecho probatorio y el derecho procesal se han dedicado desde siempre al estudio de los problemas relacionados con las pruebas y el establecimiento de los hechos en los procesos judiciales, el énfasis ha estado siempre en el aspecto formal, doctrinal y procedimental en detrimento de los fundamentos filosóficos y teóricos. Durante los últimos años ha habido un intento sostenido de explorar estos fundamentos combinando no sólo las herramientas tradicionales proporcionadas por la lógica, la gramática y la retórica, sino (...) también los avances hechos en ciencias como la estadística y la probabilidad, la medicina y la psicología forenses, la psicología de la percepción, la epistemología y la filosofía de la ciencia. El presente libro reúne las contribuciones de destacados juristas y filósofos latinoamericanos a esta nueva perspectiva interdisciplinaria, conocida como epistemología jurídica. El libro está dividido en tres grandes temas: la primera parte explora los problemas epistemológicos del conocimiento de los hechos en los procesos judiciales; la segunda se enfoca en el problema de los estándares de prueba; y la sección final discute el testimonio de los expertos. En su conjunto el libro ofrece un panorama tanto de los problemas centrales de la epistemología jurídica, como del estado del arte de la disciplina. (shrink)
