Introduction: There is a general agreement among previous studies that gender, merit and catchment area criteria allows for access to university education, but the pattern of these variables over the years has not been proven in these studies. Purpose: This study used a times series approach to evaluate the enrolment patterns in federally owned universities in South-South Zone, Nigeria, based on the gender, merit and catchment area criteria. Methodology: The descriptive survey design was adopted for this study. A purposive (...) sampling technique was adopted to choose three universities based on the generation of their establishment. The evaluation covered from 2010 to 2019 using stationary time-bound data collected from the academic planning units of the institutions through a checklist. Future enrolment forecasts were made to 2031 using the moving average forecasting technique. Results: A gender-based difference in enrolment, in favour of males was recorded between 2010 and 2019; there were notable fluctuations in the enrolment pattern based on the merit criterion from 2010 to 2019; the enrolment pattern in terms of the catchment area criterion was consistent from 2010 – 2019. In terms of the projection, it was predicted that enrolment at the aggregate level would rise continuously across federal universities, but not at the institutional level. more women than men are expected to be enrolled in academic programmes at federal institutions, while at the institutional level, gender-based enrolment can fluctuate. Recommendations/Classroom Implications: Based on these findings, implications are discussed for future enrolment decisions at both the institutional and national levels. (shrink)

The study investigated assessment of sex and age impersonation as academic dishonest behaviour among post graduate students’ of Federal Universities of South-South, Nigeria. The study which is a survey research, involved a multi-stage stratified random sampling technique of 440 males and 490 females from 3 universities and 3 faculties of the same universities in South-South, Nigeria. Sample was selected through stratified random sampling approach. The study adopted frequencies, percentages, factor analysis and multiple classification analysis statistical tools. (...) A questionnaire developed and validated by the researcher titled: “Academic Dishonest Behaviour Questionnaire’’ (ADBQ) with Cronbach coefficient alpha reliability of 0.83 was used for data collection. Two research questions and one hypothesis were formulated for the study. The findings indicated that the students used for this study were involved in Sex and Age impersonation aspect of academic dishonest behaviours. Female students were seen to be more involved than male in impersonation, Students ages 25-29years are more culpable in impersonation as academic dishonest behaviour. It is therefore recommended among others that there should be synergy among stakeholders in the educational process to fight this art of impersonation. (shrink)

This study assessed tertiary students’ awareness of the emergence of the online food delivery (OFD) services could be attributed to the changing nature of urban consumers. These consumers use food delivery services for a variety of reasons but, unsurprisingly, the most common reason seems to be the need for quick and convenient meals during or after a busy day. The study used the cross-sectional survey conducted in Federal University Oye-Ekiti, Ekiti State, Nigeria, using random sampling technique. A total of (...) 245 undergraduate students at the university were assessed with a structured online questionnaire. The data collected data was analyzed using Microsoft excel and GraphPad. Results showed that a majority of the students use online food services for their food service needs, hence the study concluded that the majority of the students at the University are aware of online food service. It was recommended that the quality of service of the online food service system needs improvement by enhancing the efficiency of service as well as accessibility, which will enable more students to opt for the food service and delivery system. The Universal Core (UCore) is a central element of the National Information Sharing Strategy that is supported by multiple U.S. Federal Government Departments, by the intelligence community, and by a number of other national and international institutions. The goal of the UCore initiative is to foster information sharing by means of an XML schema providing consensus representations for four groups of universally understood terms under the headings who, what, when, and where. We here describe a project to create an (...) ontology-based supporting layer for UCore, entitled ‘Universal Core Semantic Layer’ (UCore SL), and describe how UCore SL can be applied to further UCore’s information sharing goals. The contrast between Kant’s moral philosophy and Feder’s is not less crucial than the controversy caused by the Göttingen review of the first Critique. One of main targets of Kant’s moral philosophy was Feder’s view, which can be regarded as Kant's main competitor in the contemporary debate. I thus argue that the background provided by the conflict with Feder shows significant distinctive traits of Kant's view, with regard to three fundamental issues. First, I examine how the project of a pure (...) moral philosophy opposes Feder’s empirical investigation into the will, which is in fact one of the targets of Kant's criticism against universal practical philosophy. Second, a central element of Kant’s anti-eudaemonism, the contrast between happiness and self-contentment, is a rejection of the strongly moralized view of happiness that underlies Feder’s eudaemonism. Finally, I examine Tittel's objection that Kant had provided "only a new formula" of morality and Kant's response, which display a fundamental contrast between Kant’s understanding of the aims of moral theory with Feder’s common-sense conception. The major objective of this study was to investigate whether visual impairments (VI) impact mental health literacy among first-generation university students (FGUS). A descriptive survey research method was used to examine the mental health literacy of 132 purposive sample of FGUS with and without VI from three federal universities in Southern Nigeria. A 35-item MHL Scale (MHLS) for university students (Crobach’s α=0.83) with 5-point response was used for data collection. Questionnaire distribution was achieved through the help of two (...) research assistants. Means, standard deviations, analysis of variance and regression plot were employed to analyze the research data. Participants’ mean age was 24.96±3.86 years. Results showed a higher level of mental health literacy across seven domains of the MHL Scale among students with VI compared to those without this disability. The students identified mental health literacy they possess including the ability to recognize specific disorders, the ability to seek mental health information, the ability to identify risk factors and causes, the ability to understand self-treatment options, the ability to access professional assistance, and positive behaviors that promote awareness and help-seeking. VI did not significantly impact the mental health literacy of FGUS with VI. VI explained only 6.31% of the variation in MHL among FGUS with VI. Accordingly, mental health literacy is an essential skill that should be acquired by everyone, including those who suffer from specific disorders and professionals who care for them. Further effort is required in order to improve the mental literacy of FGUS without VI in Nigerian universities. (shrink)

The article aims to determine how university professors critically perceive and evaluate information when interacting with the media sphere. The study's relevance is due to the insufficient elaboration of Russian teachers' attitude to the information in the media sphere, which is significant in developing students' critical thinking. The study analyzes theoretical sources and documents on critical thinking in the media sphere and the results of processing empirical data obtained from questioning teachers. The main measuring instrument is a questionnaire survey of (...) university professors with various lengths of service. The study involved 76 teachers from Ural Federal University named after the first President of Russia B.N. Yeltsin. Ural State Pedagogical University (Ekaterinburg, Russia). Linguistics University of Nizhny Novgorod (Nizhny Novgorod, Russia). The data obtained from the study of the teachers' attitude to the information content of the media sphere show a predominant critical attitude in assessing the reliability and availability of information on social networking platforms. Kuban State Agrarian University is the largest center of science, education and innovation in the South Federal District, and is rated by the Ministry of Education as the best agrarian university in Russia. It is headed by the Kuban State Agrarian Scientific and Educational Association, which includes 29 agrarian organizations, 12 scientific research institutes of the Russian Academy of Agricultural Sciences, and 12 colleges and technical schools of the province.

Gender bias in the classroom has become an issue of global concern. This phenomenon is evident in textbooks, pedagogy, and the hidden curriculum. Since persons of all genders can equally contribute to national development, any factor that hinders persons of a particular gender from realising their full potentials should be examined and redressed. One of the areas where gender kurtosis is evident is in communication. This study, therefore, investigated the prevalence of gender skewness in academic communication. Data came from softcopies (...) of postgraduate dissertations randomly selected from a large second-generation federal university in Southern Nigeria. Four null hypotheses were stated and tested, using the independent t-test. The analyses revealed clear evidence of androcentric or male-dominant communication in postgraduate dissertations. The result showed a significant difference between male and female dissertations in androcentric communication. In addition, masters’ and doctorate degrees students also differed significantly in their androcentric communication. (shrink)

Abstract: This study focused on comparative assessment of the implementation of quality assurance mechanisms in educational management programme of federal and state universities in south-east, Nigeria. Four research questions and four null hypotheses guided the study. The study was carried out in the eight government-owned (3 federal and 5 state) universities in south-east that run educational management programme. The study adopted a survey research design on a population of eight heads of department. A 44-item researcher constructed (...) questionnaire was used to rate the implementation of quality assurance mechanisms as it relates to; moderation of examination, in-service professional development programmes, mock accreditation exercise, and infrastructural facilities. The instrument was validated by three experts, while a grand reliability index of 0.84 was obtained using crombach alpha reliability coefficient. Mean scores were used to answer the four research questions while t-test was used to test the four null hypotheses at 0.05 level of significance. The major findings of the study indicated that both federal and state universities in south-east implement the four mechanisms for quality assurance in educational management programme to a little extent. Though they both have implemented it to a little extent, the federal universities seem to record better implementation of these mechanisms compared to the state universities. This is supported by the outcome of research questions 3 & 4 as well as hypotheses 3 & 4. It was recommended among others that the National Universities Commission (NUC) should lay more emphasis on the state universities during the usual general/main accreditation exercise of institutions. This will reduce the differences that may exist in standard. Conclusions, implications and limitations of the study were made as well as suggestions for further studies. (shrink)

This study was conducted to investigate the degree to which institutional variables such as: institutional location, ownership and leadership influence the job performance of academic staff across three dimensions: teaching, research productivity and community service. This ex-post facto study by design, tested three hypotheses. A total of 449 academic, randomly drawn from three (one private and two public) universities in Cross River State, Nigeria, participated in the study. Three sets of questionnaires were used for data collection after due validity (...) and reliability tests. They included the “Institutional Variables Questionnaire (IVQ)”, the “Research Productivity and Community Service Questionnaire (RPCSQ)”, and the “Staff Instructional Delivery Questionnaire (SIDQ).” Collected data were analysed using the independent sample t-test, one-way analysis of variance (ANOVA) and simple linear analysis. Findings indicated that institutional location significantly impacts university academic staff across multiple dimensions—teaching, research, and community service— with urban institutions consistently demonstrating higher scores than their rural counterparts. There was a significant influence of institutional ownership on research productivity unlike teaching and community service. Federal institutions exhibited higher research productivity than both state and private universities. Institutional leadership significantly influenced research productivity and community service engagement, but not in the dimension of teaching among the academic staff. This study underscores the need for a holistic approach to enhancing academic staff performance. It emphasizes the importance of strategic resource allocation, collaborative endeavours, and strong leadership to create an environment where teaching, research, and community service thrive. This report presents the features of the organisation and the main ideas of the international scientific conference “‘No Right of Sedition’. Kant and the Problem of Revolution in the 18th—21st Century Philosophy.” The conference was held at the Immanuel Kant Baltic Federal University (IKBFU) in Kaliningrad on November 9—10, 2017 and was dedicated to the 100th anniversary of the Russian Revolution. The event was organised by the Academia Kantiana — a research unit on comparative studies on Russian and Western (...) philosophy at the IKBFU’s Institute for the Humanities. The reports presented at the conference focused on the analysis of the phenomenon of revolution from Kant to the present day as well as the conceptions of revolution that appeared around the time of the Russian Revolution in 1917. The report summarises all the presentations and discussions that took place at the confe­rence in accordance with the thematic clusters. The conference confirmed that Kant’s ideas on the state and the revolution are still relevant today. (shrink)

Higher education curricula are developed based on creating conditions for implementing many professional and universal competencies. In Russia, one of the significant competencies for a modern specialist is business communication in oral and written forms in the Russian language and a foreign language. Therefore, teaching students to write in a foreign language is one of the modern requirements for young specialists’ professional training. This article aimed to study the tools of online communication that are used in teaching foreign languages. The (...) article presents the results of an empirical study and analysis of factors of application of online communication technologies in foreign languages teaching, synchronous and asynchronous means used in online learning, and the advantages of integrating online communication tools into the educational process of teaching a foreign language. The study of the advantages and disadvantages of educational platforms is based on an analysis of information and online communication technologies used in the educational process. Based on the example of teaching a foreign language, the article shows how online communication platforms are involved in the educational process. Furthermore, the teachers’ and students’ opinions are presented on how online platforms are convenient. The survey involved 928 first-year students and 76 foreign language teachers of Volgograd State University (Volgograd), Linguistics University of Nizhny Novgorod (Nizhny Novgorod), Tomsk Polytechnic University (Tomsk), Ural Federal University, named after the first President of Russia B.N. Yeltsin (Ekaterinburg). It was revealed that the integration of online communication tools has positive effects on the formation and development of written communication skills. (shrink)

Space is one of the most fundamental concepts over which scientific knowledge has been constructed. But it is also true that space concepts extrapolate by far the scientific domain, and permeate many other branches of human knowledge. Those are fascinating aspects that could di per se justify the compilation of a long bibliography. Another one is the passion for books. My interest in some physical, historical and philosophical problems concerning the concept of space in Physics, and its properties, can be (...) traced back to the early 1980. Since that time, I have being studying, with several collaborators, the influence of space dimensionality in different physical phenomena, like the Casimir Effect, neutron diffraction, Cosmic Microwave Background Radiation and the stability of Schrödinger’s and Dirac’s hydrogen atom in arbitrary number of dimensions, as well as epistemological aspects of the works of Kant, Ehrenfest an others on this particular subject. Meanwhile, I gave lectures about the History of the Concepts of Space in Physics at the Centro Brasileiro de Pesquisas Físicas (CBPF), at the Program of History of Sciences, Technics and Epistemology of the Federal University of Rio the Janeiro (UFRJ) and also at the Physics Institute of the State University of Rio de Janeiro (UERJ). As a consequence of both this interest and my love for books, I continuously bought books on space for my personal library which contains now quite one half of all the books quoted here. In 1996, Roberto Moreira and I published the Sources for the History of Space concepts in Physics: From 1845 to 1995 in the series Notas de Física of the CBPF (NF # 084/96), which is still available online. This was a first initiative to share our bibliography on space. At that time, it contained 1075 references, including 414 books entirely devoted to space, 380 articles in periodical journals and proceedings and 281 miscellaneous citations. After fifteen years, I decided to focus my attention here to collect what in my opinion are the 601 essential books which could be useful for anyone interested on learning about space. An important restriction is imposed here by language: only texts written in English, French, German, Italian, Spanish, Portuguese and Latin were considered. References are given in chronological order covering the period between 1739 and 2010. For each year, the books are listed in alphabetical order of authors’ name. Organized by the Brazilian Logic Society (SBL), its main goal is to promote the dissemination of research in logic in a broad sense. This study analyzed the behavioral characteristics of ICT users among postgraduate students leveraging the Latent Class Analysis (LCA). The study, anchored on the Planned Behavior Theory, followed the exploratory research design. It adopted the cluster random sampling technique in selecting 1,023 respondents from a population of 2,923 postgraduate students in four federal universities in South-South Nigeria. “Behavioural Characteristics and Job Creation Questionnaire (BCJCQ),” developed by the researchers, was used for data collection. Upon data collection and LCA analysis, the (...) five-class solution was accepted as the best-fitting model, based on statistical fit indicators (such as AIC, BIC, entropy, Gsq, and Chsq) and theoretical grounds. Consequently, five classes of behavioral ICT users were identified and named based on their item–response probability, conditional on class. The five classes were named Trendy, Outmoded, Pragmatic, Disciplined, and Social users of ICT, with their unique characteristics discussed. The study tested for job creation differences among the classes using a one-way ANOVA and found a significant difference. On average, pragmatic users of ICT created more jobs than social, disciplined, and outmoded users. Trendy users were, on average, the minor job-creating class of ICT users. The study compared the bivariate differences in job creation among the classes using the Tukey HSD test of multiple pairwise comparisons. Based on the results obtained, discussions were made with implications for further research in the evolving area of LCA. (shrink)

The literature provides different methodologies for sampling social wasps, including, flight intercept trap type Malaise and Attractive trap, however, there is no consensus on its use. In this respect, the aim of this study was to evaluate the best use of Malaise traps and Attractive trap in biodiversity work of social wasps, and generate a collection protocol for the use of these traps. The study was conducted in the Parque Estadual do Rio Doce, located in the east of the state (...) of Minas Gerais, in the years 2000, 2001, 2002 and 2004 and in the Botanical Garden of the Federal University of Juiz de Fora, located in the southeastern state of Minas Gerais, in years 2011, 2012 and 2013. 15 species were collected using Malaise traps, and, 26 species of social wasps were collected using Attractive traps. Although the negative aspects of both traps, complementary methodologies surveys varying social wasps are useful and it is recommended to choose for using in accordance with the logistical field. Taking the Pará Amazon as a place of reflection, an effort is made to rethink the power relation-ship constituted by a specific point of view in the history of image. This text had the collaboration of Izabelle Louise Anaúa Tremembé, an indigenous student at Federal University of Pará (UFC). In her accounts, she talks (...) about appropriation culture, exotification of sacred objects, and sexualization of female bodies, as well in her speech, she affirms the lack of knowledge when it comes to their rituals and even brought up that indigenous autonomy in making art has always existed. RESUMO A inseminação artificial em tempo fixo (IATF) é uma das biotecnologias de reprodução mais estudadas dos últimos anos, e a busca pelo equilíbrio entre a fisiologia animal e o controle hormonal fomenta uma série de estudos. Sendo assim, o objetivo com este trabalho foi avaliar a eficiência da aplicação do hormônio liberador de gonadotrofinas (GnRH) no dia zero (D0) do protocolo de IATF, a base de estrógeno e progesterona sobre a taxa de penhez por IATF. O experimento foi desenvolvido (...) na Universidade Federal de Uberlândia (UFU), na Fazenda Experimental do Glória, localizada no município de Uberlândia, no estado de Minas Gerais. Foram avaliadas 69 inseminações de vacas leiteiras mestiças, divididas em dois grupos com diferentes protocolos; Controle: sem aplicação de GnRH e Tratamento: aplicação de GnRH no dia zero do protocolo. Todos os animais foram inseminados com sêmen previamente analisado. O diagnóstico de gestação foi realizado 32 dias após a inseminação, com aparelho de ultrassonografia equipado com probe linear transretal de 7,5 MHz. Os dados foram analisados por análise descritiva, sendo avaliado o efeito da relação protocolo e presença de corpo lúteo no início do protocolo e efeito da relação protocolo e ordem de IA Pós-Parto sobre a taxa de concepção. A taxa de concepção após a realização do Protocolo Tratamento foi de 53% (17/32) e do Protocolo Controle foi de 43% (16/37). Portanto, conclui-se que o protocolo de sincronização de vacas leiteiras mestiças com a aplicação de GnRH no dia zero do protocolo resultou em um aumento no número da taxa de concepção de vacas leiteiras mestiças. ABSTRACT The artificial insemination at fixed time (AIFT) is one of the most studied reproduction biotechnologies in recent years, and the search for a balance between animal physiology and hormonal control fosters a series of studies. Therefore, the objective of this work was to to evaluate the efficiency of gonadotrofine hormone inducer (GnRH) on day zero (D0) of the AIFT protocol, an estrogen and progesterone base on an AIFT rate. The experiment was developed at the Federal University of Uberlândia (UFU), at the Experimental Farm of Glória, located in the municipality of Uberlândia, in the state of Minas Gerais. Were evaluated 69 inseminations of crossbred dairy cows divided into two groups with different protocols; Control: without application of GnRH and Treatment: application of GnRH on day zero of the protocol. All animals were inseminated with previously analyzed semen. The diagnosis of pregnancy was performed 32 days after insemination, with an ultrasound device equipped with a 7.5 MHz transrectal linear probe. The data were analyzed by descriptive analysis, evaluating the effect of the protocol relationship and the presence of corpus luteum at the beginning of the protocol and the effect of the protocol relationship and postpartum AI order on the conception rate. The conception rate after performing of the Treatment Protocol was 53% (17/32) and the Control Protocol was 43% (16/37). Therefore, it is concluded that the synchronization protocol of crossbred dairy cows with the application of GnRH on day zero of the protocol resulted in an increase in the number of conception rates of crossbred dairy cows. The article is devoted to one of the crucial aspects of sustainable development, with the example of analyzing the possibilities for the development of environmental education in the Russian Federation. The strategic goal of environmental education in Russia is the formation and development of an environmental outlook among students of all ages, which is based on scientific knowledge, environmental culture, and ethics. This paper investigates the cultural significance of black holes and suns as metaphors in continental European literature and art, drawing on theoretical insights from French continental authors such as Jean-François Lyotard and Ray Brassier. Lyotard suggests that black holes signify the ultimate form of the sublime, representing the displacement of humanity and our unease with our place in the cosmos. On the other hand, Brassier views black holes as a consequence of the entropic dissolution of matter, reflecting physical reality's indifference (...) to subjective or teleological significance. The study also presents a curated collection of literary works and artworks that employ black holes and suns as metaphors, examining the emergence of these metaphorical objects and identifying discursive and epistemological shifts in society. Belief is taking a proposition to be true and disbelief taking it to be false. Judging also dichotomizes: accepting a proposition results in belief and rejecting in disbelief. Stating follows suit: asserting a proposition conveys belief and denying conveys disbelief. Traditional (...) logic implicitly focused on logical relations and processes needed in expanding and organizing systems of beliefs. Deducing a conclusion from beliefs results in belief of the conclusion. Deduction presupposes consequence: one proposition is a consequence of a set of a propositions if the latter logically implies the former. The role of consequence depends on its being truth-preserving: every consequence of a set of truths is true. This paper, which builds on previous work by the second author, explores roles of logic in expanding and organizing systems of disbeliefs. Aducing a conclusion from disbeliefs results in disbelief of the conclusion. Aduction presupposes contrequence: one proposition is a contrequence of a set of propositions if the set of negations or contradictory opposites of the latter logically implies that of the former. The role of contrequence depends on its being falsity-preserving: every contrequence of a set of falsehoods is false. A system of aductions that includes, for every contrequence of a given set, an aduction of the contrequence from the set is said to be complete. Historical and philosophical discussion is illustrated and enriched by presenting complete systems of aductions constructed by the second author. One such, a natural aduction system for Aristotelian categorical propositions, is based on a natural deduction system attributed to Aristotle by the first author and others. There are five eruvim in Chicago, five in Brooklyn, twenty three in Queens and Long Island, and at least three in Manhattan. The US Supreme Court is (like most other major US Federal Government buildings) located within the eruv of Washington DC. In many cases, not all of those living within or near the area of an actual or proposed eruv will themselves be Orthodox Jews, and this has sometimes led to protests against eruv creation. Abstract The values of the healthcare sector are fairly ubiquitous across the globe, focusing on caring and respect, patient health, excellence in care delivery, and multi-stakeholder collaboration. Many individual pharmacists embrace these core values. But their ability to honor these values is significantly determined by the nature of the system they work in. -/- The paper starts with a model of the prevailing pharmacist workforce model in Scotland, in which core roles are predominantly separated into hierarchically disaggregated jobs focused on (...) one professional ‘pillar’: Clinician /Practice Provider; Educator; Leader/Manager; and Researcher. This is the ‘Atomistic’ Model. This skills-segregation yields a workforce of individuals working in isolation rather than collaborating together, and lacking a shared information flow, purpose and identity. Key strategic flaws include suboptimal responsiveness to population and subpopulation needs, inconsistency and inequity of care, an erosion of professional agency, and lower job satisfaction. It is conjectured that this results from a lack of congruence between values, professional ethos, and organizational structure. ‘Atomism’ culminates in a syndrome of widespread professional-level cognitive dissonance. -/- The paper contrasts this with a new emerging workforce vision, The Collaborative Care Model. This new model defines a systems-first-approach, built on the principle that all jobs must include all four professional ‘pillars’. Vertical skills integration, involving education and task sharing, will support sustainability and succession planning. Horizontal skills integration (across practice, leadership and research) is included to improve responsiveness to population need and individual professional agency. The working conditions, supportive ethos, and career structure needed to make the model work are described. Moral theory and workforce theory are used to justify why the model may be more effective for population health, delivering greater job satisfaction for individuals and ultimately helping systematically realize and honor healthcare values. Finally, the paper sketches the first steps needed to implement the model at the national level, starting with the operationalization of new multi-pillar professional curricula across the career spectrum. In his Welcome Message for the XXII World Congress of Philosophy hosted by Seoul National University in August 2008 the President of the International Federation of Philosophical Societies (FISP), Peter Kemp, said that—inter alia—it will be an occasion “for rethinking the great philosophical questions.” Amongst there questions how we in the present understand the philosophical past is surely a perennial query before us. In this short paper I will refer to the endeavor of understanding past philosophical thought on its own (...) terms or as presented in a current idiom as “philosophical translation.” The latter can take three forms: logical, analytical, or hermeneutic. This paper will briefly discuss all three forms vis-à-vis modern attempts to understand the medieval concept of “supposition” with special regard to the role metalanguage plays in philosophical translation. The ideal of the United Nations was first put forward by Immanuel Kant in his 1795 essay Perpetual Peace. Kant, in the tradition of Locke and Rousseau is a liberal who believes that relations between individuals can either be based upon law and consent or upon force and violence. One way that such the ideal of world peace could be achieved would be through the creation of a single world state, of which every human being was a citizen. Such an (...) ideal was advocated by a number of eighteenth century liberals. Kant, however, rejects this ideal and instead argues that the universal rule of law can be achieved through the establishment a federation of independent states. I examine the relevance of Kant’s arguments today, focusing on two questions: Firstly, as advocates of the rule of law, why advocate a federation of independent nations rather than a single world state. Secondly, is this ideal realizable? Is Kant right to think that republics are natural and are likely to live peacefully with one another? Kant’s arguments on this issue have been taken up again in recent decades by defenders of the theory of the “democratic peace”, the theory that democracies are more likely to live at peace with one another. The book was developed by Rinat Nugayev who graduated from Kazan State University relativity department and got his M.Sci at Moscow State University department of philosophy of science and Ph.D at Moscow Institute of (...) Philosophy, Russian Academy of Science. He has forty years of philosophy of science and relativistic astrophysics teaching and research experience evincing in more than 200 papers in the scientific journals of Russia, Ukraine, Belorussia, USA, Great Britain, Germany, Spain, Italy, Sweden, Switzerland, Netherlands, Canada, Denmark, Poland, Romania, France, Greece, Japan and some other countries, and 8 monographs. Revolutions in physics all embody theoretical unification. Hence the overall aim of the present book is to unfold Einstein’s unificationist modus operandi, the hallmarks of actual Einstein’s methodology of unification that engendered his 1905 special relativity, as well as his 1915 general relativity. To achieve the object, a lucid epistemic model is exposed aimed at an analysis of the reasons for mature theory change in science (chapter1). According to the model, scientific revolutions were not due to fanciful creation of new ideas ‘ex nihilo’, but rather to the long-term processes of the reconciliation, interpenetration and intertwinement of ‘old’ research traditions preceding such breaks .Accordingly, origins of scientific revolutions lie not in a clash of fundamental theories with facts, but of “old” mature research traditions with each other, leading to contradictions that can only be attenuated in a more general theoretical approach. In chapter 2 it is contended that Einstein’s ingenious approach to special relativity creation, substantially distinguishing him from Lorentz’s and Poincaré’s invaluable impacts, turns to be a milestone of maxwellian electrodynamics, statistical mechanics and thermodynamics reconciliation design. Special relativity turns out to be grounded on Einstein’s breakthrough 1905 light quantum hypothesis. Eventually the author amends the received view on the general relativity genesis by stressing that the main reason for Einstein’s victory over the rival programmes of Abraham and Nordström was a unificationist character of Einstein’s research programme (chapter 3). We subsist under the law where we claim our rights and are obliged to do something enforced. What is a law? The question would be perplexing in history, and one of crucial themes with many lawyers or legal philosophers. As we know, two most important perspectives had earned a universal and historical forge in academics, to say, the natural law and legal positivism. The concept of natural law deals in its primacy for the humanity and natural order which often can (...) be traded as something inviolable or inalienable. The concept has strands in several aspects; (i) its anchor with the civil democratic revolution around 17 and 18 centuries (ii) its supremacy with the new constitutional states (iii) less quality as a realist law from ambiguities and lack of clear definition. The concept of public policy may be related with the social justice, ethics and administration. It generally pursues a justice and desired state of public or community where the tension and conflict always exist between the ruling class and citizens. Historically, the public policy could be mightier to address the society than law where the benevolent Kings or Sovereigns liked to address both their needs and social justice. They may abrogate, more in endowment and divinity, the laws or social customs. The tension between the public power and private interests could be one reason as well as offers a good dualism in understanding the rule of law concept and advent of modern democracy. In this dimension, the King would no longer be divine nor entitled to exercise a plenary power of state rule. Instead, the popular sovereignty in the US democracy or parliamentary type in the UK were to be established to resolve a feudal conflict within the class and society. Lighted to be in vein of influence could arise the two contexts which are a contractarian view and plutocracy desire of the founding fathers. They underlay the mood and philosophical ethos of US revolution. Hence, three concepts as a pillar in private law were sanctified in the very foundation of US constitutional state, sanctity of property right, freedom of contract and due limits for the civil liability. The governmental power should be limited to protect the life and limb of citizens which addressed the Hobbes’ evil, “war against all the rest.” The due process concept was expressed as a fundamental principle of constitution where the human rights are inviolable and inalienable. The separation of powers principle could serve the freedom and wealth of new civil class in the continent, and bicameralism was devised for the check and balance within the federal congress. They see the role of judicial branch is important to preserve their civil interest. Then we can derive some assumptions between the law and public policy. First, a law plays to protect the private interest while the public policy pursues the social justice and mediates the competing interests, “private v. private” and “public v. private.” The civil courts may address a first nature of conflict and the law of takings or regulatory laws may deal with the second aspect. Second, the public or administrative law can shape a legal plane of bureaucracies or public administration, and may guarantee the rule of law ideals. It plays as an enabling authority and, on the other, monitors an arbitrariness and unfairness in the bureaucratic government. In this context, the unresponsive and unfathomable bureaucracy in the Kafka’s could be remedied. Third, for the welfare state in the late 19th and 20th century, a law can well be seen as one of authoritative expression of public policy to redress the evils of capitalist states. Some public laws, such as the Sherman Act classically and Lanham Act recently, may act to regulate the monopoly or oligopoly while other laws were enacted to restore justice between the labor and employers. Em meados do século XVI, surgiu a ideia de autonomia do indivíduo, que deu origem ao individualismo e ao liberalismo político. A concepção de democracia que se desenvolveu com base nesses princípios assumiu um perfil bastante diferente daquele utilizado na Grécia antiga. Se antes a democracia estava diretamente ligada à ideia de igualdade, em sua nova versão passou a ser relacionar primordialmente com a ideia de liberdade. Em decorrência dos ideais desenvolvidos naquele momento histórico, o principal dilema político fundamentava-se na (...) limitação de poder do soberano (que às vezes se confundia com o próprio Estado) e na ampliação das liberdades individuais, como o direito a dispor da propriedade material e a defender-se judicialmente. Até hoje, grande parte do debate político tem como tema a defesa dos ideias liberais ou a crítica a eles. Na perspectiva do filósofo inglês Thomas Hobbes, a constituição e o funcionamento de uma sociedade pressupõem que os indivíduos cedam, por transferência, seus direitos naturais (mantendo somente o direito de conservarem sua vida) ao soberano. O autor entendia que os seres humanos, em estado de natureza (isto é, compartilhando do direito a tudo o que existe, em razão de não haver limitação legal), tendem a agir pela força e pela violência para conseguir o que desejam, o que acabaria provocando uma guerra contínua entre todos. Para Hobbes, a justificativa para o poder absoluto dos reis residia na compreensão de que os homens em estado de natureza se encontrariam em constante conflito. Na foto, palácio na Arábia Saudita, em 2012, uma das poucas monarquias absolutas da atualidade. Por isso, para disciplinarem a si mesmos e garantirem o bem-estar físico e material, seria necessário que os indivíduos firmassem um contrato social regulado por uma autoridade soberana. Hobbes manifestou preferência pela monarquia absolutista, pois acreditava que as assembleias e os Parlamentos estimulam os conflitos graças às disputas entre diferentes facções e partidos. O poder absoluto defendido por Hobbes se justificava pela transferência dos direitos dos indivíduos ao soberano. É um nome desse contrato social que o poder deve ser exercido, e não para a realização da vontade pessoal do soberano. Por conta dessa perspectiva, Hobbes não pode ser considerado defensor da democracia. Entretanto, seu pensamento é importante, pois serve de parâmetro para as reflexões sobre a organização do poder construídas posteriormente. No século XVII, John Locke, também filósofo inglês, propôs uma reflexão bem diferente das de Hobbes. Para ele, o poder soberano deve permanecer nas mãos dos cidadãos, que são os melhores juízes dos próprios interesses. Cabe ao governante retribuir a delegação de poderes ao garantir as prerrogativas individuais: segurança jurídica e propriedade privada. Assim, o contrato social teve como função garantir os direitos naturais para todos. Esse pensamento é uma das bases do liberalismo político. Entretanto, deve ser ressaltado que sua implantação não permitiu a construção da igualdade propagada por Locke, mas foi uma das estruturas de consolidação do poder da burguesia. As ideias de Locke são uma das referências para o desenvolvimento da democracia representativa. Na imagem, vemos o palácio de Westminster, em Londres, onde estão situadas as casas do Parlamento e ocorrem as principais decisões políticas do Reino Unido. Para Locke, o princípio da maioria é fundamental para o funcionamento das instituições políticas democráticas, assim como as leis, que devem valer para todos. Por isso, segundo o filósofo, a elaboração das leis precisa estar a cargo de representantes escolhidos pelo povo, que exerceriam o papel de legisladores no interesse da maioria: o regime político proposto por Locke é, portanto, uma democracia representativa. O escritor e filósofo político suíço Jean-Jacques Rousseau se preocupou com o problema da legitimidade da ordem política. Para ele, a desigualdade ocasionada pelo advento da propriedade privada é a causa de todos os sentimentos de ruins do ser humano. No contrato social, é preciso definir a questão da igualdade e do comprometimento de todos com o bem comum. Se a vontade individual é particular, a do cidadão, que vive em sociedade e tem consciência disso, deve ser coletiva e voltada para o bem comum. A participação política é, portanto, ato de deliberação pública que organiza a vontade geral, ou seja, traduz os elementos comuns a todas as vontades individuais. Esse seria, portanto, o núcleo do conceito de democracia. Em seu livro Do Contrato Social2 , Rousseau afirma que a democracia só pode existir se for diretamente exercida pelos cidadãos, sem representação política, pois a vontade geral não poderia ser representada, apenas exercida diretamente. Para Rousseau, a democracia direta é o único sistema legítimo de autoridade e de ato político.3 Em O espírito das leis, o filósofo e político Montesquieu, afirmou que igualdade na democracia é algo muito difícil de garantir plenamente. Partindo do princípio de que é necessário um controle externo para que os sistemas políticos funcionem bem, esse pensador defende a criação de regras que estabeleçam limites aos detentores do poder a fim de manter a liberdade dos indivíduos. Por isso, propôs a divisão da esfera administrativa em três poderes ou funções independentes entre si: o Legislativo, o Executivo e o Judiciário. De maneira resumida, cabem ao poder Legislativo as funções de fiscalizar o poder Executivo, votar leis de interesse público nas instâncias relativas (municipal, estadual e federal) e, em situações específicas, julgar autoridades como o presidente da República ou os próprios membros do Parlamento. O Executivo é o poder do Estado que, nos moldes da Constituição de um país, tem por atribuição governar a nação e administrar os interesses públicos, colocando em prática políticas públicas e leis, e garantindo o acesso aos direitos. Por fim, o poder Judiciário é exercido pelos juízes, que têm a capacidade e a prerrogativa de julgar com base nas regras constitucionais e nas leis criadas pelo poder legislativo. A democracia, na perspectiva de Montesquieu, seria garantida pelo equilíbrio entre os três poderes, assegurando assim maior liberdade aos indivíduos. A liberdade, porém, só existiria com moderação, o que equivaleria a fazer tudo o que as leis permitissem (pois, se um cidadão pudesse fazer tudo o que as leis proibissem, não teria mais liberdade, por que todos poderiam fazer o mesmo). Karl Marx e Friedrich Engels acreditavam que um governo democrático seria inviável numa sociedade capitalista, pois a regulação democrática da vida não poderia se realizar com as limitações impostas pelas relações capitalistas de produção. Seria necessário, portanto, mudar as bases da sociedade para criar possibilidade de uma política democrática. Para entender a posição desses autores com relação à democracia, é necessário entender como eles percebem a função do Estado na sociedade capitalista. Para Marx e Engels, os princípios que protegem a liberdade dos indivíduos e defendem o direito à propriedade tratam as pessoas como iguais apenas formalmente. O movimento em favor do sufrágio universal e de igualdade política é reconhecido por Marx como um passo importante, mas, segundo esse autor, seu potencial emancipador está limitado pelas desigualdades de classe. Desse modo, as democracias liberais seriam cerceadas pelo capital privado, que restringiria sistematicamente as opções políticas. De acordo com esse olhar, a liberdade nas democracias capitalistas é, portanto, puramente formal, pois a desigualdade de classe prevalece. Centripetalism is often perceived as a type of a political system for a multi-segmental, especially multi-ethnic, country in order to create among the members of the political elite of moderate, accomodative, and integrative political behavior cross-cutting segmental divisions which, reaching beyond group interests, depoliticize the segmental separateness and, in this manner, reduce their significance. One of the central institutions of centripetalism is decentralization leading to a division of large segments into smaller parts that inhabit different, ideally multi-segmental regions, thus inclining (...) regional political elites of different segments to collaborate. Although both Nigeria and Indonesia have similar centripetal territorial structures, only Nigeria is a federation. Alison L. LaCroix is Assistant Professor of Law at the University of Chicago Law School, where she specializes in legal history, federalism, constitutional law and questions of jurisdiction. She has written a fine, scholarly volume on the intellectual origins of American federalism. LaCroix holds the JD degree (Yale, 1999) and a Ph.D. in history (Harvard, 2007). According to the author, to fully understand the origins of American federalism, we must look beyond the Constitutional Convention of 1787 and range over the (...) colonial, revolutionary, and founding periods including developments in the early republic. LaCroix questions both the idea that American federalism originated, all at once, at the Constitutional Convention of 1787 and the idea that republican ideology (with its strong emphasis on legislative power) was the single dominant framework of eighteenth-century American political thought. Abstract: This paper examined the impact of crude oil price fluctuation on tertiary education survival in Nigeria from 2011-2018. Ex-post facto research design was used. Data were extracted from Education Trust Fund (ETF), Federal Ministry of Education (FME), and National Bureau of Statistics (NBS). The data were analyzed using multiple regression analysis with the aid of Statistical Packages for Social Sciences (SPSS) version 20.0 software package. The findings of this study revealed that Crude oil price fluctuation is a critical (...) determinant of tertiary education survival in Nigeria. There is a significant relationship between crude oil price fluctuation and budget allocation to tertiary education in Nigeria. This paper recommend that a policy that permits tertiary education survival through education tax fund allocation from profits of registered petroleum companies proceed should be extended and apply to established Alumni Tax Fund. The Alumni Tax Fund will generate pool of fund from graduate of Nigeria Universities, Colleges of Education and Polytechnic Education. (shrink)

The problem of cultural degradation and high respect for foreign cultures of Europe and America more than Nigerian cultures are the major problems in this study. The paper sets to examine media imperatives for the globalization of Nigerian cultures. The paper answers the question of if Nigeria has a culture in the affirmative and adopts the analytical research method to identify Nigerian cultures, to find out how foreign cultures have affected Nigerian cultures and to explain how Nigerian cultures can be (...) upgraded to be universally appreciated. The paper concludes that foreign cultures have been preferred to local cultures by many Nigerians, while some have are not ready to associate with local cultures. The paper recommends that Nigerian material cultural objects should be upgraded, refined and promoted through media channels such as the Nigerian film industry and other outlets by the Federal Ministry of Information and Cultural orientation. Introduction. Taking into account the priorities of the state policy in the field of economic and innovative development of the Perm region, assessment of the regional potential of the digital economy, the strategic importance of economic activities implemented by SMEs for the economy of the region and the country as a whole, the actual impact of the norms on the instruments of development of small and medium-sized enterprises in the Perm region is assessed. The purpose of this study is to (...) improve the regional regulatory platform of tools for the development of small and medium-sized businesses in the Perm region in order to gain the status of an investment-attractive region in the digital economy of the Russian Federation, taking into account the Strategy of the information society in the Russian Federation, which will ultimately contribute to the development of e-business in the Perm region, rehabilitation and competitiveness of the economy of the Perm region in the global market. Methodology. The General methodological basis of the study was the dialectical- materialistic method of cognition of legal reality, which allowed to study the tools of development of small and medium-sized businesses in the Perm region in their development, to consider the problems of tools for the integrated development of small and medium-sized businesses in the Perm region, taking into account the changed socio-economic conditions in inseparable unity with other related tools relevant to the needs of digitalization of society. Such universal scientific methods as analysis and synthesis of doctrinal and normative materials were used in the work. In addition, special legal methods were used: the method of legal modeling, which allows to design possible legal situations using digital tools for the development of small and medium- sized businesses in the Perm region; the method of systematic interpretation used in assessing the actual impact of regional norms on the tools of development of small and medium-sized businesses in the Perm region. Results. The article proposes a new tool for the development of SMEs as a regional electronic platform for the promotion of goods, works and services of SMEs in the Perm region. Attention is paid to the level of digital literacy of SMEs and consumers of their goods, works and services: the conclusion about the lack of digital competence. Conclusion. It is necessary to improve the regional regulatory platform taking into account economic trends: it is important to introduce digital competencies everywhere, including at the professional level in relation to SMEs in the Perm region, in order to increase the business activity of young people and other representatives of the working population. As for the actual introduction of new tools for the development of small and medium-sized businesses in the Perm region, we propose that the regional legislator develop a new electronic information platform at the expense of the regional budget to promote goods, works and services sold by SMEs in the Perm region. Sentencing outcomes turn on moral and evaluative determinations. For example, a finding of “irreparable corruption” is generally a precondition for juvenile life without parole. A finding that the “aggravating factors outweigh the mitigating factors” determines whether a defendant receives the death penalty. Should such moral determinations that expose defendants to extraordinary penalties be subject to a standard of proof? A broad range of federal and state courts have purported to decide this issue “in the abstract and without reference to (...) our sentencing case law,” as the Supreme Court recently put it. Kansas v. Carr, 577 U.S. 108, 119 (2016). According to these courts, “it would mean nothing” to ask whether the defendant “deserves mercy beyond a reasonable doubt” or “more-likely-than-not deserves it” because moral questions are not “factual.” Instead, moral determinations are highly subjective “value calls” to which concepts of doubt and certainty do not intelligibly apply. -/- Implicit in these rulings is a controversial view of the nature of moral judgment. This Article traces the contours of the view and argues that it is out of step with the way the broader public thinks about morality and fails to address the issues defendants have raised. Courts should avoid wading into such controversial waters for two reasons. First, the judiciary has historically maintained neutrality on issues of significant public concern. Second, even if moral determinations are not factual, applying a standard of proof to at least some moral decisions at sentencing would change the outcome of the sentencer’s deliberations, and improve the legitimacy of the legal system. For the reasonableness of doubt depends on context; and moral questions—"are you certain the defendant deserves death?”—make salient the stakes relative to which a person should decide what to believe about ordinary empirical matters. On the resulting view, reasonable doubt in the final moral analysis is not just intelligible, but essential for correcting a bias in the structure of the bifurcated criminal trial that systematically disadvantages defendants: the tendency for de-contextualized "factual findings” in the guilt phase to control outcomes at sentencing. I explore what and when hypocrisy is a moral wrong by interrogating the case of hypocrisy of Julien in Stendhal's The Red and The Black. I conclude hypocrisy is most morally vexed in those sphere where sincerity is required.

With the passage and implementation of the “first-to-file” provisions of the America Invents Act of 2011, the U.S. patent system must rely more than ever before on patent documents for its own ontological commitments concerning the existence of claimed kinds of useful objects and processes. This Article provides a comprehensive description of the previously unrecognized function of the patent document in incurring and securing warrants to these ontological commitments, and the respective roles of legal doctrines and practices in the patent (...) system’s ontological project. Among other contributions, the resulting metaphysical account serves to reconcile competing interpretations of the written description requirement that have emerged from the Federal Circuit’s recent jurisprudence, and to explain why the patent system is willing and able to examine, grant and enforce claims reciting theoretical entities. While this Article is entirely descriptive, it concludes by identifying promising normative and prescriptive implications of this work, including the formulation of an appropriate test for the patent-eligibility of software-implemented inventions in the post-Bilski era. Discussing federal statutes, Justice Scalia tells us that “[t]he stark reality is that the only thing that one can say for sure was agreed to by both houses and the president (on signing the bill) is the text of the statute. The rest is legal fiction." How should we take this claim? If we take "text" to mean the printed text, that text without more is just a series of marks. (...) If instead we take "text" (as we must) to refer to something off the page such as the "meaning" of the series of marks at issue, what is that meaning and how do we know that all the legislators "agreed" on that "meaning"? In seeking answers here, we necessarily delve into semiotics (i.e., the “general theory of signs”) by noting that meaningful ink marks ("signifiers) signify a meaning beyond themselves (the "signified.") Thus, understanding how signs function is integral to lawyers' textual and linguistic analysis. Additionally, as this article demonstrates, legal analysis and rhetoric are much impoverished if lawyers ignore nonverbal signs such as icons, indices, and nonverbal symbols. In providing a broad overview of semiotics for lawyers, this article thus (1) begins with a general definition of signs and the related notion of intentionality. It then turns to, among other things, (2) the structure and concomitants of signs in more detail (including the signifier and the signified), (3) the possible correlations of the signifier and the signified that generate signs of interest to lawyers such as the index, the icon, and the symbol; (5) the expansion of legal rhetoric through use of the index, the icon, and the non-verbal as well as the verbal symbol, (6) the nature of various semiotic acts in public and private law (including assertives, commissives, directives, and verdictives); (7) the interpretation and construction of semiotic acts (including contracts as commissives and legislation as directives); (8) the role of speaker or reader meaning in the interpretation and construction of semiotic acts; (9) the semiotics of meaning, time, and the fixation of meaning debate; (10) the impact of signifier drift; (11) the distinction between sense and understanding; and (12) some brief reflections on semiotics and the First Amendment. The paper discusses the philosophical conclusions, which the interrelation between quantum mechanics and general relativity implies by quantum measure. Quantum measure is three-dimensional, both universal as the Borel measure and complete as the Lebesgue one. Its unit is a quantum bit (qubit) and can be considered as a generalization of the unit of classical information, a bit. It allows quantum mechanics to be interpreted in terms of quantum information, and all physical processes to be seen as informational in a generalized (...) sense. This implies a fundamental connection between the physical and material, on the one hand, and the mathematical and ideal, on the other hand. Quantum measure unifies them by a common and joint informational unit. Quantum mechanics and general relativity can be understood correspondingly as the holistic and temporal aspect of one and the same, the state of a quantum system, e.g. that of the universe as a whole. Apology is arguably the central act of the reparative work required after wrongdoing. The analysis by Claudia Card of complicity in collectively perpetrated evils moves one to ask whether apology ought to be requested of persons culpably complicit in institutional evils. To better appreciate the benefits of and barriers to apologies offered by culpably complicit wrongdoers, this article examines doctors’ complicity in a practice that meets Card's definition of an evil, namely, the non-medically necessary, nonconsensual “normalizing” interventions performed on babies (...) born with intersex anatomies. It argues that in this instance the complicity of doctors is culpable on Card's terms, and that their culpable complicity grounds rightful demands for them to apologize. (shrink)
