The 'critical turn' in tourism studies is defined as a research perspective that explores social transfor- mation in and through tourism by facing the negative impact of strategic-instrumental rationality on this activity. This work explores the features of discourse ethics that may normatively support tourism transformation, a gap that has not been thoroughly discussed in tourism research. For this purpose, the study combines the use of critical and ethical theory with an analysis of discourse ethics in tourism literature to demonstrate (...) that the use of Habermasian discourse ethics needs to be complemented with the Apelian approach. Through these steps the work reveals the theoretical bases of discourse ethics to discuss whether understandings between stakeholders guided by strategic-instrumental rationality can be reached not only in the political sphere —Habermas—, but also in the ethical field —Apel. El trabajo desarrollado por las kellys o camareras de piso se caracteriza por encontrarse dentro de lo que se podría denominar como «trabajo de cuidados», aunque se inscribe de lleno en el campo productivo y es una parte vital del sector turístico. Su caso es un claro ejemplo de la intersección entre la precariedad y la invisibilidad de unas tareas que han sido histórica y culturalmente asignadas a las mujeres y condenadas al menosprecio social. En un contexto como el actual, (...) cabe preguntarse sobre las condiciones sociales que subyacen a este colectivo y las implicaciones que se derivan de su situación de invisibilidad en un sector tan precario como el turístico dentro del Estado español, así como sobre el papel de Las Kellys –como asociación– en la reivindicación de los derechos laborales de las trabajadoras. Analizaremos su caso como una muestra de movimiento político y social que lucha por la visibilización de las tareas de cuidados y que contribuye a la repolitización de dichos trabajos en el ámbito público. The work done by the Kellys, or apartment waitresses/cleaners, is characterised by it lying in what could be called “care work”, despite being completely undertaken in the production field and forming a vital part of the tourism sector. Their case is a clear example of the intersection between precarious work and the invisibility of some tasks that have been historically and culturally appointed to women and condemned to social scorn. In today’s context, it is worth considering the social conditions underlying this group of workers and the implications that stem from their situation of invisibility in such a precarious sector as the tourism one in the Spanish State, and the role played by the Kellys, as an association, to claim these female workers’ employment rights. We will analyse their particular case as a clear example of the socio-political movement that struggles to make their care work visible and contributes to the repoliticisation of their work in the public domain. For the sake of universalism and against totalitarianism, discursive ethics has shown with Jürgen Habermas a practical deficit by denying moral philosophy the possibility of reflecting on the alienating conditions for dialogue through a specific ethos. This article examines how Hartmut Rosa's theory of resonance can revitalise the debate on the conditions that can undermine the basis for dialogue in accelerated societies, based not on the concept of ethos, but on the concept of mode of world-relationship [Modus der Weltbeziehung].

El objetivo de este trabajo es esbozar las bases de un análisis crítico a través de la neuroética y la teoría social que permita señalar las implicaciones que pueden derivarse del uso de neurotecnologías para fomentar el placer en el contexto turístico. Con este propósito, el trabajo revisará los objetivos que proponen las investigaciones neuroturísticas. Para subrayar los riesgos que conllevan tanto para la autonomía de los turistas como para la configuración de los servicios turísticos y la elección de los (...) destinos, se recurrirá a la neuroética. Los trabajos aportados permitirán esbozar una problematización del alcance ético que puede conllevar configurar el turismo en torno a bases emocionales, dada la predisposición «natural» con la que, según estas inves- tigaciones, los sujetos hacemos elecciones en base a patrones emocionales. Se trata de un escenario que, finalmente, será considerado a la luz de las teorías sociales del turismo en un contexto de aceleración social, de modo que puedan vislumbrarse algunos de los riesgos que puede conllevar la utilización de técnicas neuroturísticas para el desarrollo del turismo. A través de este enfoque pretende sugerirse que, en diálogo con otras disciplinas, la ética, entendida como filosofía moral, puede contribuir a la crítica del desarrollo actual del turismo y, en última instancia, a los debates que giran en torno a la orientación del turismo hacia una actividad responsable con los destinos y servicios turísticos. Esta tesis doctoral analiza el potencial de una crítica ética sobre la continua necesidad de acelerar, crecer e innovar, así como de hacer todo disponible para el turismo. La hipótesis es que la dinámica conformada por estos aspectos puede afectar a las formas de vida y menoscabar la capacidad dialógica para la resolución de conflictos de quienes se encuentran implicados o afectados por el turismo. A partir de un estudio sistemático e interdisciplinar de la cinética del turismo, esta tesis analiza (...) la naturaleza coercitiva y cultural de sus motores aceleratorios y de sus manifestaciones, y amplía el margen de reflexión de la ética del turismo a través de la teoría crítica de la resonancia de Hartmut Rosa. Se concluye que la resonancia ofrece una base compatible con el modelo de ética procedimental exigido por el pluralismo ético y por las demandas de justicia que puede contribuir a hacer frente a los retos que la cinética plantea en el turismo a través de instituciones, prácticas sociales y modos de socialización. This doctoral thesis examines the potential of an ethical critique on the constant need for acceleration, growth and innovation, and to make everything available for tourism. The hypothesis is that the dynamics created by these aspects can affect life forms, and undermine the capacity for dialogue for conflict resolution among those involved or affected by tourism. Taking a systematic and interdisciplinary study of the kinetics of tourism as its starting point, this thesis analyses the coercive and cultural nature of the engines of its acceleration and its manifestations, and broadens the scope for reflection on the ethics of tourism through Rosa’s Resonance Critical Theory. It concludes that resonance offers foundations compatible with the model of procedural ethics required by ethical pluralism, and the demands of justice, which could help to address the challenges posed by kinetics in tourism through institutions, social practices and modes of socialization. There can be no doubt that discrimination based on sex, race, ethnicity, religion or beliefs should not be tolerated in academia. Surprisingly, however, in recent years, policies of Diversity, Inclusion and Equity(DIE), officially introduced to counteract discrimination, have increasingly led to quite the opposite result: the exclusion of individuals who do not share a radical 'woke' ideology on identity politics (feminism, other gender activisms, critical race theory, etc.), and to the suppression of the academic freedom to discuss such dogmas. This (...) subversion of academia ― disguised Trojan-horse style as universal human rights advocacy ― is unacceptable because academia must be politically neutral and protect freedom of speech, a cornerstone of professional scholarly activity without which universities as we know them will slowly but surely suffocate. -/- Our purpose here is to put together some particularly illustrative cases of such repression in a single book, testifying to a ubiquitous trend within western culture, irreducible to a few isolated complaints. Dejando de lado la discusión acerca de si hay o no una filosofía en el trabajo intelectual de Fernando González Ochoa, se propone considerar la obra del pensador colombiano como un trabajo antifilosófico que buscó socavar la seriedad de discusiones teóricas tomadas con solemnidad por intelectuales colombianos de su época. Se estudia, especialmente, la manera como González Ochoa, sin separarse de los supuestos de las tesis raciales y deterministas propuestas por intelectuales como Luis López de Meza o Miguel Jiménez López, (...) asume la discusión sobre la raza con el propósito de “empayasar el concepto” y llevarlo a instancias hilarantes a partir de la exageración, la ironía y las notas de ingenio. Su burla lo condujo a no tomar una posición seria o emprender una crítica de los supuestos relacionados con el problema como pasa, precisamente, con la posición ingeniosa de los antifilósofos. In contrast to individualistic explanations of social injustice that appeal to implicit attitudes, structural explanations are unintuitive: they appeal to entities that lack clear ontological status, and the explanatory mechanism is similarly unclear. This makes structural explanations unappealing. The present work proposes a structural explanation of one type of injustice that happens in conversations, discursive injustice. This proposal meets two goals. First, it satisfactorily accounts for the specific features of this particular kind of injustice; and second, it articulates a structural (...) explanation that overcomes their unattractiveness. The main idea is that discursive injustice is not the result of biased interlocutors, but of problematic discursive norms. (shrink)

My aim is to discuss the impact of higher-order evidence on aesthetic appreciation. I suggest that this impact is different with respect to aesthetic beliefs and to aesthetic affective attitudes (such as enjoyment). More specifically, I defend the view that higher-order evidence questioning the reliability of one’s aesthetic beliefs can make it reasonable for one to revise those beliefs. Conversely, in line with a plausible account of emotions, aesthetic affective attitudes are not directly sensitive to this type of higher-order evidence; (...) they are sensitive only to those features of objects that make such attitudes (un)fitting. Thus, I argue, there are cases of non-defective recalcitrant aesthetic attitudes where the subject has both a non-defective, fitting aesthetic affective attitude and a reasonable belief questioning the fittingness of this attitude. I further discuss whether, in this type of case, the subject has decisive reasons to try to change her recalcitrant attitudes—say by trying to modify her aesthetic affective dispositions. My answer is negative. Even granting that subjects always have aesthetic reasons to try to avoid aesthetically unfitting attitudes, these can be outweighed by further reasons not to do so—perhaps including aesthetic reasons related to the construction of valuable aesthetic identities or to the value of aesthetic engagement. Due to the COVID-19 pandemic, the academe was introduced to online education, which is complicated. The sudden shift of traditional face-to-face classes to digital learning impacted every student's self-efficacy and motivation towards their studies. This study investigates the relationship between the self-efficacy and academic motivation of the 304 freshmen college students from private higher education institutions in the Philippines. Based on the data gathered, the participants' level of self-efficacy (x̄ = 3.27) and academic motivation (x̄ = 5.93) is high. Further, (...) the statistical analysis concluded a relationship between self-efficacy and academic motivation (r=.002, at 0.05 level) among the graduating college students. Implications of the study were discussed, and recommendations for future research were suggested. (shrink)

This article discusses the category of foreigner in the context of academia. In the first part I explore this category and its philosophical significance. A quick look at the literature reveals that this category needs more attention in analyses of dimensions of privilege and disadvantage. Foreignness has peculiarities that demarcate it from other categories of identity, and it intersects with them in complicated ways. Devoting more attention to it would enable addressing issues affecting foreigners in academia that go commonly unnoticed. (...) In the second part of the article I argue that current efforts to make academia a more inclusive environment should address the disadvantages that many foreign academics face. I focus on two senses of foreigner: working and living in a country that is not your country of origin, and being a nonnative speaker of the language in which you work. (shrink)

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. Self-employment merits protection and promotion, we often hear, because it confers independence from a boss. But what, if anything, is wrong with having a boss? On one of the two views that this chapter inspects, being under the power of a boss is objectionable as such, no matter how suitably checked this power may be, for it undermines workers’ agency. On a second view, which republican theorists favor, what is objectionable is subjection not to the power of a boss as (...) such but to their arbitrary power. The first view is unconvincing, I argue, as it entails (implausibly) that being under the power of others in realms like the family or the state is likewise objectionable as such. And although the second view yields compelling reasons for self-employment, it only does so when employers’ power is not suitably checked. When it is, such reasons are more easily outweighed by competing considerations, like those stemming from the further forms of dependence—on suppliers and purchasers—that self-employment may prompt. Workplace democracy is often defined, and has recently been defended, as a form of intra-firm governance in which workers have control rights over management with no ownership requirement on their part. Using the normative tools of republican political theory, the paper examines bargaining power disparities and moral hazard problems resulting from the allocation of control rights and ownership to different groups within democratic firms, with a particular reference to the European codetermination system. With various qualifications related to potentially mitigating factors, (...) such as workforce and shareholder composition or risk aversion and reallocation, the paper contends that forms of workplace democracy in which workers control and own the firm, such as cooperativism, are preferable to other forms, such as codetermination, in which ownership and control rights are formally separated. When travelling to a new city, we acquire knowledge about its physical terrain, directions, historical facts and aesthetic features. Engaging in tourism practices, such as guided walking tours, provides experiences of a city that are necessarily mediated and partial. This has led scholars in tourism studies, and more recently in philosophy, to question the epistemological value of city tours, critiquingthem as passive, lacking in autonomous agency, and providing misrepresentative experiences of the city. In response, we argue that the mediated and (...) partial knowledge of a city acquired through city tours is not epistemologically disvaluable. Although city tours involve the transmission of testimonial knowledge, this does not necessarily render tourists as passive and non-autonomous. Instead,tourists have the potential to participate in the generation of their knowledge actively. Moreover, we argue that city tours also provide a tourist with valuable ‘objectual’ knowledge of a city, whichhas the potential to be first-personal and active, and does not necessarily misrepresent the city’s identity. This type of knowledge is valuable both for tourists as credible epistemic agents, and for the city itself, as the knowledge generated by the tour can facilitate an accurate representation of the city and promote social transformation. We conclude by highlighting four further epistemic and ethical implications of our argument. (shrink)

It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

Most philosophers would agree that loving one’s romantic partner (i.e., being in love) is, in principle, a good thing. That is, romantic love can be valuable. It seems plausible that most would then think that the process leading to being in love—i.e. falling in love—can be valuable too. Surprisingly, that is not the case: among philosophers, falling in love has a bad reputation. Whereas philosophy of love has started to depart from traditional (and often unwarranted or false) tropes surrounding romantic (...) life, this tendency has not yet reached the analysis of falling in love. The phenomenon continues to be looked at mostly through a compendium of generalisations taken as metaphysical truths—the view of falling in love being akin to “losing one’s mind” or “not being able to think about anything else”. Here, I analyse some of these generalisations to show that although they may reflect some experiences of what falling in love feels like, they wrongly reduce falling in love to two related, but distinct, phenomena: limerence and infatuation. My aim is to refine the current terminology to lay the foundations for a neutral view of falling in love. (shrink)

El presente artículo demuestra que el tránsito entre la naturaleza y la libertad —como es expuesto en la Introducción a la Crítica del Juicio— debe ser comprendido como un argumento teorético y práctico, cuyo propósito es demostrar la posibilidad del Sumo Bien en la naturaleza. Con este propósito, se reconstruye histórico-genéticamente el contexto en que aparece el tránsito dentro de la composición de la obra, justificando así su validez como sentido global de la Crítica. Después, se demuestra que el origen (...) de la exigencia sobre el tránsito proviene del proyecto arquitectónico, como es interpretado a partir de la Crítica de la razón pura, lo cual permite caracterizar las condiciones que debe cumplir para ser construido. Por último, se interpreta el tránsito desde el enfoque arquitectónico y se identifican los momentos de su construcción a lo largo de la crítica del Juicio estético y del teleológico, lo que demuestra su carácter argumental teorético y práctico. A partir de lo anterior, se pretende justificar la unidad del sentido de la Crítica del Juicio, así como la complementariedad entre sus dos momentos. (shrink)

Workplace democracy is often advocated on two intertwined views. The first is that the authority relation of employee to firm is akin to that of subject to state, such that reasons favoring democracy in the state may likewise apply to the firm. The second is that, when democratic controls are absent in the workplace, employees are liable to objectionable forms of subordination by their bosses, who may then issue arbitrary directives on matters ranging from pay to the allocation of overtime (...) and to relocation and promotion. Daniel Jacob and Christian Neuhäuser have recently submitted these views to careful criticism. They argue that the parallel between firms and states is unwarranted. For, unlike managerial authority, state authority is final. The state grants firms their legal status and subjects their authority to its regulations, which citizens in democracies already control. And they also argue that suitable workplace regulation alongside meaningful exit options may suffice to prevent, with no need for democratization, objectionable forms of workplace subjection. Neither view offers, they resolve, compelling reasons to believe that justice requires that firms be democratic. I here inspect these criticisms in turn, and offer reasons for skepticism. (shrink)

In this article, I deal with Searle’s philosophy of society, the last step to complete his philosophical system. This step, however, requires an examination of the context and presuppositions, or default positions, that make possible the key concepts of this new branch of philosophy. In the first section, I address what the enlightenment vision implies. The second section focuses upon how consciousness and intentionality are biological tools that help us create and maintain the social world. In the third section, I (...) explain the importance of the difference between subjectivity and objectivity. Finally, in the fourth section I elaborate upon the default positions: the existence of one world, truth as correspondence to facts, direct perception, meaning, and causation. Importantly, I show how the context and presuppositions of the philosophy of society are an opportunity of interdisciplinary work between philosophy and the social sciences. (shrink)

The paradox of persisting opposition raises a puzzle for normative accounts of democratic legitimacy. It involves an outvoted democrat who opposes a given policy while supporting it. The article makes a threefold contribution to the existing literature. First, it considers pure proceduralist and pure instrumentalist alternatives to solve the paradox and finds them wanting — on normative, conceptual, and empirical grounds. Second, it presents a solution based on a two-level distinction between substantive and procedural legitimacy that shows that citizens are (...) consistent in endorsing the upshot of democratic procedures while opposing it. Third, it unpacks three reasons to non-instrumentally endorse such procedures — namely, the presence of reasonable disagreement, non-paternalism, and the right to democratically do wrong. In so doing, the article shows that those accounts of democratic legitimacy that rely on reasonable disagreement as a necessary condition for democratic procedures being called for are flawed, or at least incomplete, and offers a more complete alternative. La búsqueda de tales asociaciones está motivada por lo que llamo el “compromiso causal” de la psiquiatría biológica, que es la presunción de que factores biológicos específicos son las causas principales de las condiciones psiquiátricas. En este artículo argüiré que dicho compromiso es una presunción implausible sobre esas condiciones, pues la mejor evidencia psiquiátrico-biológica disponible no lo (...) respalda y es dudoso que la evidencia futura lo hará. El presente artículo ofrece una interpretación de la totalidad de la filosofía kantiana como reforma al concepto de filosofía de acuerdo con la naturaleza metafísica y moral de la razón. Para ello se articulan los elementos que sirven a la reforma, a saber, la comprensión de la filosofía bajo el concepto escolástico y bajo el cósmico, este último desprendido de la teleología racional expresada en la consideración histórica de la filosofía. Después, se construye la interpretación de la metodología arquitectónica que (...) utiliza la reforma, primero demostrando que la pregunta crítica sobre los juicios sintéticos a priori sirve para determinar los conocimientos posibles; posteriormente, argumentando que la pregunta se subsume a los intereses racionales de los seres humanos para vincular los conocimientos con el fin de la razón, lo cual corresponde a la estructuración de la filosofía según la Sabiduría a la que tiende. Por último, se propone cuál es la labor que cada Crítica tiene dentro de todo el proyecto de reforma. La interpretación, por tanto, recupera las intenciones eminentemente metafísicas y morales de la empresa kantiana, permitiendo abordarla en su conjunto. (shrink)

Our goal in this paper is to articulate a precise concept of at least a certain kind of disease-mongering, showing how pharmaceutical marketing can commercially exploit certain diseases when their best definition is given through the success of a treatment in a clinical trial. We distinguish two types of disease-mongering according to the way they exploit the definition of the trial population for marketing purposes. We argue that behind these two forms of disease-mongering there are two well-known problems in the (...) statistical methodology of clinical trials (the reference class problem and the distinction between statistical and clinical significance). El presente artículo tiene por propósito construir una interpretación de La docta ignorancia de Nicolás de Cusa que articula su contexto histórico-cultural con la obra para ofrecer un sentido: la limitación de la razón humana para aprehender una verdad absoluta y las propuestas de una armonía interreligiosa y una reestimación del cosmos como consecuencias. Ello implica (I) reconstruir el horizonte sobre el cual surge y con el cual dialoga Nicolás de Cusa; (II) elaborar una interpretación crítica de La docta ignorancia (...) que muestre su estructura conceptual; y (III) descifrar la manera específica en que la obra de Cusa responde a su horizonte planteándose un sentido. Lo anterior sustenta una interpretación no lineal del texto de Cusa que le representa como crítico radical, no sólo reformador, de cuestiones filosóficas medievales, al limitar los alcances de la ontología y señalar un ámbito metafísico incognoscible. Typically, existentialist analyses of “America” have been limited to North America (more specifically, the United States). I argue that developing an adequate framework for existentially analyzing America requires a turn to Mexican existentialism. In Emilio Uranga’s and Jorge Portilla’s writings, we discover new conceptual tools for understanding Americanness as such. These thinkers help us imagine an account of American being that does not restrict itself to the United States by using the concepts of existentialism to describe the crises their neighbors (...) to the north as well as they themselves face. American existence has been historically characterized by a convergence (oftentimes clash) of disparate races, ethnicities, languages, cultures, religions, and identities. As history unfolded, this convergence led to various existential crises across the Americas. Whereas the US American way of life is marred by a blustering, naïve, and purposeless misuse of freedom that disregards the other, the existential crisis the Mexican lives is characterized by “accidentality” and “zozobra.” Despite these important differences, all existentialists, and the Mexican existentialists of the Hyperion Group especially, remind us that there is a common way to overcome the various existential crises plaguing the Americas, and that is to exercise freedom in a purposeful, communally conscious manner. People who experience love often experience break-ups as well. However, philosophers of love have paid little attention to the phenomenon. Here, I address that gap by looking at the grieving process which follows unchosen relationship terminations. I ask which one is the loss that, if it were to be recovered, would stop grief or make it unwarranted. Is it the beloved, the reciprocation of love, the relationship, or all of it? By answering this question I not only provide with an (...) insight on the nature of break-ups, but also make a specific claim about the nature of love. I argue that the object that is universally lost in all break-ups is a person with certain intrinsic qualities, who is in a relationship characterised by certain shared activities and recognized as romantic. That means that, at least in romantic terminations, the beloved and the relationship are not independent objects of grief. So, plausibly, they may not independent objects of value in love. Hence, those who state otherwise should face up to this objection coming from the study of break-ups. (shrink)

The idea that appearances provide justifications for beliefs—the principle of phenomenal conservatism—is self-evidently true. In the case of cognitive penetration, however, it seems that certain irrational etiologies of a belief may influence the epistemic quality of that belief. Susanna Siegel argues that these etiologies lead to ‘epistemic downgrade.’ Instead of providing us with a decisive objection, cognitive penetration calls for us to clarify our epistemic framework by understanding the formative parts of appearances. In doing so, the two different but inseparable (...) ideas of sensation and intellection provide us with a basis of our appearances. These appearances, in turn, provide us with the objective evidence needed to test our judgements. Thus, the extra-sensory concepts of intellectual identification and the appearances they help form become an epistemic groundwork. (shrink)

In this paper we develop a view about the disorientation attached to the process of falling out of love and explain its prudential and moral value. We start with a brief background on theories of love and situate our argument within the views concerned with the lovers’ identities. Namely, love changes who we are. In the context of our paper, we explain this common tenet in the philosophy of love as a change in the lovers’ self-concepts through a process of (...) mutual shaping. This, however, is potentially dangerous for people involved in what we call ‘subsuming relationships’, who give up too much autonomy in the process of mutual shaping. We then move on to show how, through the relation between love and the self-concept, we can explain why the process of falling out of love with someone is so disorientating: when one is falling out of love, one loses an important point of reference for self-understanding. While this disorientating process is typically taken to be harmful to the person experiencing it, we will explain how it can also have moral and prudential value. By re-evaluating who we were in the relationship and who we are now, we can escape from oppressive practices in subsuming relationships. We finish by arguing that this gives us reason to be wary of seeking to re-orient ourselves -or others- too quickly after falling out of love. (shrink)

En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. Why does social injustice exist? What role, if any, do implicit biases play in the perpetuation of social inequalities? Individualistic approaches to these questions explain social injustice as the result of individuals’ preferences, beliefs, and choices. For example, they explain racial injustice as the result of individuals acting on racial stereotypes and prejudices. In contrast, structural approaches explain social injustice in terms of beyond-the-individual features, including laws, institutions, city layouts, and social norms. Often these two approaches are seen as competitors. (...) Framing them as competitors suggests that only one approach can win and that the loser offers worse explanations of injustice. In this essay, we explore each approach and compare them. Using implicit bias as an example, we argue that the relationship between individualistic and structural approaches is more complicated than it may first seem. Moreover, we contend that each approach has its place in analyses of injustice and raise the possibility that they can work together—synergistically—to produce deeper explanations of social injustice. If so, the approaches may be complementary, rather than competing. (shrink)

In this note, my aim is to point out a phenomenon that has not received much attention; a phenomenon that, in my opinion, should not be overlooked in the professional practice of philosophy, especially within feminist efforts for social justice. I am referring to the way in which being a non-native speaker of English interacts with the practice of philosophy.1 There is evidence that non-native speakers are often perceived in prejudiced ways. Such prejudiced perception causes harm and, more importantly, constitutes (...) wrongdoing. As in other cases of prejudiced perception and biased behavior, it would be pretentious and misguided to expect philosophers and the philosophy profession to be free from this vice. There are good reasons to think that this prejudiced perception is bad not only for the persons who are perceived in such a way, but also for the profession, for it might make us miss important things that could improve philosophy in general. I claim we should be more sensitive to this phenomenon, both out of concern for justice, and for the sake of doing better philosophy. (shrink)

In times of climate change and public debt, a concern for intergenerational justice should lead us to have a closer look at theories of intergenerational justice. It should also press us to provide institutional design proposals to change the decision-making world that surrounds us. This book provides an exhaustive overview of the most important institutional proposals as well as a systematic and theoretical discussion of their respective features and advantages. It focuses on institutional proposals aimed at taking the interests of (...) future generations more seriously, and does so from the perspective of applied political philosophy, being explicit about the underlying normative choices and the latest developments in the social sciences. It provides citizens, activists, firms, charities, public authorities, policy-analysts, students, and academics with the body of knowledge necessary to understand what our institutional options are and what they entail if we are concerned about today's excessive short-termism. Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

Metaphysical considerations aside, today’s inheritors of the tradition of natural philosophy are primarily scientists. However, they are oblivious to the human factor involved in science and in seeing how political, religious, and other ideologies contaminate our visions of nature. In general, philosophers observe human (historical, sociological, and psychological) processes within the construction of theories, as well as in the development of scientific activity itself. -/- In our time, feminism—along with accompanying ideas of identity politics under the slogan “diversity, inclusion, equity”—has (...) emerged in science policies. The vast majority of scientists (including myself) are convinced that discrimination is reprehensible. We also believe that all individuals of any sex, race, ethnic group, or ideology should be valued in academia solely based on his or her merits and potential through equality programs. However, as I will show in this article, political indoctrination has inadmissibly undertaken the struggle for equality in academic institutions in Western countries. I argue here that universities and research institutes should be politically free (neutral) to encourage academic freedom. -/- One negative aspect of equality programs is that worldwide, scientists are harassed for expressing opinions related to the “gender” issue. This situation severely restricts scientists’ freedom of expression, even within the limits of the law. Codes of conduct extending beyond legal boundaries are examples of this issue. Scientists who express their views about “gender” are often harassed, bullied, and socially or academically excluded. Thus, we are witnessing a wave of proselytizing in research institutes and science-associated media. Today, there is widespread biased propaganda of “victimhood”. This propaganda proposes positive discrimination and increasing women’s participation in unnatural ways. It also bends the history of science by overvaluing the creations of forgotten women, offering lectures on indoctrination, organizing congresses on gender and science, and persecuting anyone who sees the subject differently. All of this covered by a multitude of associations that financially benefit from these discourses through succulent subsidies of public money. Apparently, feminism is no longer about fighting against discrimination. Instead, it is about imposing an ideology and giving more power to one group of people. Thus, we must ask whether the end justifies the means. (shrink)

Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)
