News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. Este artículo analiza el modo en que la teoría de la resonancia formulada por Hartmut Rosa permite revitalizar el debate sobre las condiciones que pueden minar las bases para el diálogo en las sociedades aceleradas sin apoyarse en el concepto de (...) ethos, sino en el de modo de relacionarse con el mundo [Modus der Weltbeziehung]. En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

Este ensayo expone la manera en que el pensamiento deconstructivo de Jean-Luc Nancy desarrolla un modelo de democracia que va desde sus primeros escritos interpretando a Heidegger y lo elemental del ‘ser-con’ como la categoría por la cual recibimos nuestra experiencia del ser (en un pensamiento que llamamos ‘proto-democrático’) que luego se relacionarán de forma explícita con sus trabajos tardíos sobre la democracia. Siguiendo este trabajo exegético, proponemos una lectura interpretativa que busca argumentar que el pensamiento de Nancy puede ser (...) considerado como un pensamiento infrapolítico en cuanto busca pensar la aporía constitutiva de la democracia que se encuentra perfectamente ilustrado en la noción del ‘nudo’ (como el momento tanto de unión como separación—entre el ‘sí’ y el ‘no’). La noción del ‘nudo infrapolítico’ se utilizará como una forma de darle mayor refinamiento a estos esbozos deconstructivos que aparecen implícitamente en el trabajo de Nancy. -/- This essay elucidates the way in which Jean-Luc Nancy’s deconstructive thought develops a thought of democracy that begins with his first interpretive writings on Heidegger and the ‘being-with’ as an existential category (in a thought that we term ‘proto-democractic’) that will then explicitly relate to his later works on democracy. Following this exegetical work, we offer an interpretive reading that seeks to argue that Nancy’s thought can be considered as an infrapolitical one insofar as it seeks to think the constitutive aporia of democracy that is perfectly captured in the notion of the ‘knot’ (as the moment of both union and separation—between the ‘yes’ and ‘no’). The notion of an ‘infrapolitical knot’ will be used as a way of giving further refinement to the deconstructive sketches that appear implicitly in Nancy’s work. (shrink)

In this paper, I consider the contribution of Geoffrey Bennington's book, _Scatter 1_, to the ongoing discussion of the political dimension of deconstruction. Focusing on the resonances between Bennington's "politics of politics" and the notion of infrapolitics, I suggest that Bennington's major contribution revolves around the introduction of undecidability into political action and thought.

Some Comments on de Melo-Martin and Harris.

In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Se basa en la imitación de la conducta lingüística de humanos, y tiene como objetivo recabar evidencia empírica en favor de la tesis de que las máquinas programadas podrían pensar. Alan Turing, su creador, ha sido catalogado como conductista por la mayor parte de los comentaristas. En este capítulo muestro que no lo es. Por el contrario, Turing es un funcionalista, porque todo el énfasis del juego (...) de la imitación está en el engaño de la máquina hacia los humanos. Se le llama ‘psiquiatría biológica’ a la vertiente de la investigación psiquiátrica que busca establecer asociaciones estables entre condiciones psiquiátricas y factores biológicos específicos. La búsqueda de tales asociaciones está motivada por lo que llamo el “compromiso causal” de la psiquiatría biológica, que es la presunción de que factores biológicos específicos son las causas principales de las condiciones psiquiátricas. En este artículo argüiré que dicho compromiso es una presunción implausible sobre esas condiciones, pues la mejor evidencia psiquiátrico-biológica disponible no lo (...) respalda y es dudoso que la evidencia futura lo hará. This dissertation is a study of the relationship between dunamis and energeia in Aristotle’s ontology. Throughout his writings, Aristotle employs these terms to uncover what I call a proto-phenomenological description of the different ways of being. While contemporary scholarship has suggested the significance of dunamis and energeia for Aristotle’s understanding of being, the relationship between these terms has often been interpreted as mutually exclusive. Accordingly, dunamis would be understood as subordinate to energeia, which would function as the sole primary term (...) of Aristotle’s ontology. I argue that it is a mistake to consider dunamis and energeia as non-reciprocal and subordinate terms. Furthermore, I suggest that this mistake often leads to an underestimation of the dynamic character of Aristotle’s proto-phenomenological account of being. To recover this dimension of Aristotle’s thinking, I claim that dunamis and energeia ought to be understood as reciprocal and co-constitutive terms characterized by a constant and dynamic interrelation. To defend this interpretation, I turn to Aristotle’s conceptions of nature, movement, and soul as discussed in the Metaphysics, Physics, and De Anima. I argue that each of these key terms provide a concrete illustration of how dunamis and energeia function as co-constitutive principles for the manifestation of the being of natural beings. I propose that this proto-phenomenological approach to being remains Aristotle’s most significant and enduring contribution to Western ontology. (shrink)

For the sake of universalism and against totalitarianism, discursive ethics has shown with Jürgen Habermas a practical deficit by denying moral philosophy the possibility of reflecting on the alienating conditions for dialogue through a specific ethos. This article examines how Hartmut Rosa's theory of resonance can revitalise the debate on the conditions that can undermine the basis for dialogue in accelerated societies, based not on the concept of ethos, but on the concept of mode of world-relationship [Modus der Weltbeziehung].

El Realismo Especulativo, Nuevo Realismo o Realismo Postcontinental es una corriente ecléctica que viene a superar las aporías e insuficiencias de la filosofía continental desde una perspectiva a la que se le podrían achacar los mismos problemas que la perspectiva idealista y constructivista de los filósofos continentales. Para el desarrollo de la filosofía es importante entablar conversación los autores de este movimiento. En el presente artículo se presenta una aproximación a los aciertos e insuficiencias de las ontologías de dos autores (...) de la corriente como son Markus Gabriel y Graham Harman. Se presentan los aciertos e insuficiencias del realismo neutro de Markus Gabriel y de la Ontología Orientada a los Objetos, en este orden. En el último epígrafe, a modo de conclusiones, se señalan los puntos en común de las ontologías y se aporta la idea de acontecimiento como línea de investigación que supere las aporías que emergen de la contraposición entre el idealismo y realismo. Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

The status of art in Plato's philosophy has always been a difficult problem. As a matter of fact, he even threw the poets out from his ideal state, a passage that has led some interpreters to assess that Plato did not develop a proper philosophy of art. Nevertheless, R. G. Collingwood, wrote an article titled “Plato's Philosophy of Art”. How can it be? What could lead one of the most important aesthetic scholars of the first half of the twentieth century (...) to make this thesis about Plato? To understand Collingwood's position at that time, I will review it in a new light: his own philosophy of art at that moment as it was propounded in Outlines of a Philosophy of Art, a work he published that same year. I will also examine how Collingwood's position changed when he returned to the same subject in 1938, on the publication of The Principles of Art. Finally, I will end this article defending the correctness of Collingwood's earlier interpretation of Plato's position on art. (shrink)

The 'critical turn' in tourism studies is defined as a research perspective that explores social transfor- mation in and through tourism by facing the negative impact of strategic-instrumental rationality on this activity. This work explores the features of discourse ethics that may normatively support tourism transformation, a gap that has not been thoroughly discussed in tourism research. For this purpose, the study combines the use of critical and ethical theory with an analysis of discourse ethics in tourism literature to demonstrate (...) that the use of Habermasian discourse ethics needs to be complemented with the Apelian approach. Through these steps the work reveals the theoretical bases of discourse ethics to discuss whether understandings between stakeholders guided by strategic-instrumental rationality can be reached not only in the political sphere —Habermas—, but also in the ethical field —Apel. In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives. En The paradox of Addition and its dissolution (1969), Mario Bunge presenta algunos argumentos para mostrar que la Regla de Adición puede ocasionar paradojas o problemas semánticos. Posteriormente, Margáin (1972) y Robles (1976) mostraron que las afirmaciones de Bunge son insostenibles, al menos desde el punto de vista de la lógica clásica. Aunque estamos de acuerdo con las críticas de Margáin y Robles, no estamos de acuerdo en el diagnóstico del origen del problema y tampoco con la manera en la (...) que se proponen solucionarlo. En esta medida, en este texto mostraremos cómo la Regla de Adición sí trae problemas semánticos que pueden ser planteados desde diferentes perspectivas contemporáneas, como la extensionalidad del condicional, los principios proscriptivos y la validez conexiva. Una de las manifestaciones más ejemplificadoras del aumento de las velocidades y del cambio social, característico de las sociedades aceleradas, se da en la creación de tendencias laborales basadas en la hibridación entre trabajo y tiempo libre. Proyectadas sobre una idea positiva de la flexibilidad y del autocontrol, mantienen una estrecha relación con niveles altos de autointensificación. Este artículo reconstruye los rasgos básicos de prácticas formalizadas como el bleisure o el workation para caracterizar un fenómeno de la aceleración más específico (...) dentro de esta tendencia, al que denomino “turistificación del trabajo”. Este concepto resalta la atribución específica de rasgos atractivos de la práctica turística al trabajo con fines productivos. Frente a los discursos positivos sobre la movilidad y el turismo asociados a este fenómeno, se sugieren las bases de un modelo de crítica para reconocer sus implicaciones alienantes negativas en relación con la vida buena. Descartes niega que una máquina pueda ser inteligente, pues los mecanismos son predecibles, inflexibles y limitados. Los seguidores de la Inteligencia Artificial clásica (o IA fuerte) argumentan lo contrario. Pese a esto, Descartes y la IA proponen que la mente podría no estar adscrita a propiedades físicas, posibilidad explorada por el primero a partir de una intuición modal que separa mente y cuerpo. La IA fuerte se acerca a esta tesis cuando reduce la mente a una Máquina de Turing cuya (...) realización física resulta irrelevante. Aunque ambos argumentos presuponen teorías e implicancias diferentes, en este trabajo examino cómo el Funcionalismo resulta compatible con una forma de Dualismo, lo que aleja a la IA clásica del Materialismo que originalmente la inspiró. El objetivo de este trabajo es esbozar las bases de un análisis crítico a través de la neuroética y la teoría social que permita señalar las implicaciones que pueden derivarse del uso de neurotecnologías para fomentar el placer en el contexto turístico. Con este propósito, el trabajo revisará los objetivos que proponen las investigaciones neuroturísticas. Para subrayar los riesgos que conllevan tanto para la autonomía de los turistas como para la configuración de los servicios turísticos y la elección de los (...) destinos, se recurrirá a la neuroética. Los trabajos aportados permitirán esbozar una problematización del alcance ético que puede conllevar configurar el turismo en torno a bases emocionales, dada la predisposición «natural» con la que, según estas inves- tigaciones, los sujetos hacemos elecciones en base a patrones emocionales. Se trata de un escenario que, finalmente, será considerado a la luz de las teorías sociales del turismo en un contexto de aceleración social, de modo que puedan vislumbrarse algunos de los riesgos que puede conllevar la utilización de técnicas neuroturísticas para el desarrollo del turismo. A través de este enfoque pretende sugerirse que, en diálogo con otras disciplinas, la ética, entendida como filosofía moral, puede contribuir a la crítica del desarrollo actual del turismo y, en última instancia, a los debates que giran en torno a la orientación del turismo hacia una actividad responsable con los destinos y servicios turísticos. To explain the evolutionary emergence of uniquely human skills and motivations for cooperation, Tomasello et al. (2012, in Current Anthropology 53(6):673–92) proposed the interdependence hypothesis. The key adaptive context in this account was the obligate collaborative foraging of early human adults. Hawkes (2014, in Human Nature 25(1):28–48), following Hrdy (Mothers and Others, Harvard University Press, 2009), provided an alternative account for the emergence of uniquely human cooperative skills in which the key was early human infants’ attempts to solicit care and (...) attention from adults in a cooperative breeding context. Here we attempt to reconcile these two accounts. Our composite account accepts Hrdy’s and Hawkes’s contention that the extremely early emergence of human infants’ cooperative skills suggests an important role for cooperative breeding as adaptive context, perhaps in early Homo. But our account also insists that human cooperation goes well beyond these nascent skills to include such things as the communicative and cultural conventions, norms, and institutions created by later Homo and early modern humans to deal with adult problems of social coordination. As part of this account we hypothesize how each of the main stages of human ontogeny (infancy, childhood, adolescence) was transformed during evolution both by infants’ cooperative skills “migrating up” in age and by adults’ cooperative skills “migrating down” in age. With his critical theory of resonance, Hartmut Rosa has proposed the basis of a model for normatively criticizing and practically addressing the consequences of social acceleration, and its inherent tendency towards growth and innovation. This model has brought a fresh perspective to Critical Theory, offering a framework to examine a dynamic that permeates virtually all social activities. However, it has also been associated with certain characteristics that could potentially justify two labels always reproached by Critical Theory: paternalism and totalitarianism. To (...) contribute to the ongoing debates sparked by Rosa's work, this article aims to demonstrate how Rosa's approach actively seeks to avoid these accusations, primarily by incorporating the concept of Weltbeziehung [relationships with the world]. Esto coincide con un esfuerzo notorio por ocultar la presencia de la muerte, movido por la aguda percepción de la contigencia que emerge en la Modernidad. La lógica subyacente a estos elementos es que la monetarización puede entenderse como una respuesta al acrecentamiento de la conciencia de la muerte. Esto tiene lugar en el contexto de una nueva comprensión de sí marcada por la importancia (...) de la memoria. Así, la lucha del hombre moderno contra la conciencia de la muerte se desarrolla en los frentes de la acumulación de riquezas, y de la memoria. -/- ENGLISH One of the main features of our time is the presence of a widespread market economy. At the same time, notororious efforts to conceal the presence of death can be easily identified in our society; they are likely driven by an acute perception of finitude originated in Modernity. The rationale behind both aspects is that monetarisation can be regarded as a reaction to the increasing awareness of death. All of this is framed by a new self-understanding, heavily characterized by the relevance of memory. Thus, the fight of the modern man against the awareness of death is led in both fronts of wealth accumulation and memory. (shrink)

Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. Higher‐order evidence can make an agent doubt the reliability of her reasoning. When this happens, it seems rational for the agent to adopt a cautious attitude towards her original conclusion, even in cases where the higher‐order evidence is misleading and the agent's original reasons were actually perfectly good. One may think that recoiling to a cautious attitude in the face of misleading self‐doubt involves a failure to properly respond to one's reasons. My aim is to show that this is not (...) so. My proposal is that (misleading) higher‐order evidence can undermine the agent's possession of her first‐order reasons, constituting what I call a dispossessing defeater. After acquiring the higher‐order evidence, the agent is no longer in a position to rely competently on the relevant first‐order considerations as reasons for her original conclusion, so that such reasons stop being available to her (even if they remain as strong as in the absence of the higher‐order evidence). In this way, an agent with misleading higher‐order evidence can adopt a cautious stance towards her original conclusion, while properly responding to the set of reasons that she possesses–a set that is reduced due to the acquisition of higher‐order dispossessing defeaters. Self-employment merits protection and promotion, we often hear, because it confers independence from a boss. But what, if anything, is wrong with having a boss? On one of the two views that this chapter inspects, being under the power of a boss is objectionable as such, no matter how suitably checked this power may be, for it undermines workers’ agency. On a second view, which republican theorists favor, what is objectionable is subjection not to the power of a boss as (...) such but to their arbitrary power. The first view is unconvincing, I argue, as it entails (implausibly) that being under the power of others in realms like the family or the state is likewise objectionable as such. And although the second view yields compelling reasons for self-employment, it only does so when employers’ power is not suitably checked. When it is, such reasons are more easily outweighed by competing considerations, like those stemming from the further forms of dependence—on suppliers and purchasers—that self-employment may prompt. El artículo analiza el rol que cumple la confianza en la construcción de la realidad social, argumentando que constituye uno de sus componentes esenciales. Lo es porque hace posible el nacimiento, permanencia y reconocimiento colectivo de las instituciones, así como su iteración y organización en subsistemas.

The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. El trabajo desarrollado por las kellys o camareras de piso se caracteriza por encontrarse dentro de lo que se podría denominar como «trabajo de cuidados», aunque se inscribe de lleno en el campo productivo y es una parte vital del sector turístico. Su caso es un claro ejemplo de la intersección entre la precariedad y la invisibilidad de unas tareas que han sido histórica y culturalmente asignadas a las mujeres y condenadas al menosprecio social. En un contexto como el actual, (...) cabe preguntarse sobre las condiciones sociales que subyacen a este colectivo y las implicaciones que se derivan de su situación de invisibilidad en un sector tan precario como el turístico dentro del Estado español, así como sobre el papel de Las Kellys –como asociación– en la reivindicación de los derechos laborales de las trabajadoras. Analizaremos su caso como una muestra de movimiento político y social que lucha por la visibilización de las tareas de cuidados y que contribuye a la repolitización de dichos trabajos en el ámbito público. The work done by the Kellys, or apartment waitresses/cleaners, is characterised by it lying in what could be called “care work”, despite being completely undertaken in the production field and forming a vital part of the tourism sector. Their case is a clear example of the intersection between precarious work and the invisibility of some tasks that have been historically and culturally appointed to women and condemned to social scorn. In today’s context, it is worth considering the social conditions underlying this group of workers and the implications that stem from their situation of invisibility in such a precarious sector as the tourism one in the Spanish State, and the role played by the Kellys, as an association, to claim these female workers’ employment rights. We will analyse their particular case as a clear example of the socio-political movement that struggles to make their care work visible and contributes to the repoliticisation of their work in the public domain. The “received view” on Kantian ethics holds that perfect duties enjoy absolute priority over imperfect duties. More recently, several Kantian scholars have reassessed this situation, arguing that imperfect duties may remain binding even if they imply breaching a perfect duty. In this article, I argue that both positions rely on a misunderstanding of the bindingness of Kantian duties. Genuine Kantian duties, I claim, remain binding even when they cannot be fulfilled. We must always strive for a total completion of our (...) duties; what it means for us to strive for it, however, will vary depending on our peculiar situation. (shrink)

La educación tradicional concebida en compartimientos estancos que coquetean en torno al árbol de la ciencia, ha formado a un individuo descontextualizado, sin capacidad de respuesta para enfrentar la complejidad del mundo actual. La Multiversidad Mundo Real “Edgar Morin” asume la misión de una enseñanza educativa basada en los postulados del Pensamiento Complejo de Edgar Morin; pero aún quedan pendientes nuevas definiciones que rompan con los esquemas de la educación basada en el paradigma simplificador. La meta es emprender el gran (...) viraje que haga posible que la reforma paradigmática implique también una reforma de las mentes y del lenguaje, porque nombrar lo nuevo con la palabra vieja dificulta a nivel inconsciente detonar el cambio. This paper investigates how the simulation of intelligence, an activity that has been considered the notional task of Artificial Intelligence, does not comprise its duplication. Briefly touching on the distinction between conceivability and possibility, and commenting on Ryan’s approach to fiction in terms of the interplay between possible worlds and her principle of minimal departure, we specify verisimilitude in Artificial Intelligence as the accurate resemblance of intelligence by its simulation and, from this characterization, claim the metaphysical impossibility of duplicating intelligence, (...) as neither verisimilarly nor convincingly simulating intelligence involves its duplication. To this end, we argue by a representative case of simulation that, albeit conceivable, Turing’s test for machine intelligence wrongly equates the occurrence of indistinguishable intelligence performance to intelligence duplication, which is grounded in a prima facie conceivable but metaphysically impossible view that separates intelligence from its origin. Finally, we establish the following criterion for evaluating simulation in Artificial Intelligence: simulations succeed in AI if and only if they are able to epistemically persuade human beings that intelligence has been duplicated, that is, if and only if verisimilar simulations can convincingly minimally depart from actual intelligence. In times of climate change and public debt, a concern for intergenerational justice should lead us to have a closer look at theories of intergenerational justice. It should also press us to provide institutional design proposals to change the decision-making world that surrounds us. This book provides an exhaustive overview of the most important institutional proposals as well as a systematic and theoretical discussion of their respective features and advantages. It focuses on institutional proposals aimed at taking the interests of (...) future generations more seriously, and does so from the perspective of applied political philosophy, being explicit about the underlying normative choices and the latest developments in the social sciences. It provides citizens, activists, firms, charities, public authorities, policy-analysts, students, and academics with the body of knowledge necessary to understand what our institutional options are and what they entail if we are concerned about today's excessive short-termism. Our goal in this paper is to articulate a precise concept of at least a certain kind of disease-mongering, showing how pharmaceutical marketing can commercially exploit certain diseases when their best definition is given through the success of a treatment in a clinical trial. We distinguish two types of disease-mongering according to the way they exploit the definition of the trial population for marketing purposes. We argue that behind these two forms of disease-mongering there are two well-known problems in the (...) statistical methodology of clinical trials (the reference class problem and the distinction between statistical and clinical significance). Esta tesis doctoral analiza el potencial de una crítica ética sobre la continua necesidad de acelerar, crecer e innovar, así como de hacer todo disponible para el turismo. La hipótesis es que la dinámica conformada por estos aspectos puede afectar a las formas de vida y menoscabar la capacidad dialógica para la resolución de conflictos de quienes se encuentran implicados o afectados por el turismo. A partir de un estudio sistemático e interdisciplinar de la cinética del turismo, esta tesis analiza (...) la naturaleza coercitiva y cultural de sus motores aceleratorios y de sus manifestaciones, y amplía el margen de reflexión de la ética del turismo a través de la teoría crítica de la resonancia de Hartmut Rosa. Se concluye que la resonancia ofrece una base compatible con el modelo de ética procedimental exigido por el pluralismo ético y por las demandas de justicia que puede contribuir a hacer frente a los retos que la cinética plantea en el turismo a través de instituciones, prácticas sociales y modos de socialización. This doctoral thesis examines the potential of an ethical critique on the constant need for acceleration, growth and innovation, and to make everything available for tourism. The hypothesis is that the dynamics created by these aspects can affect life forms, and undermine the capacity for dialogue for conflict resolution among those involved or affected by tourism. Taking a systematic and interdisciplinary study of the kinetics of tourism as its starting point, this thesis analyses the coercive and cultural nature of the engines of its acceleration and its manifestations, and broadens the scope for reflection on the ethics of tourism through Rosa’s Resonance Critical Theory. It concludes that resonance offers foundations compatible with the model of procedural ethics required by ethical pluralism, and the demands of justice, which could help to address the challenges posed by kinetics in tourism through institutions, social practices and modes of socialization.
