This essay defends the controversial and indeed counterintuitive claim that there is a good argument to be made from a Lockean perspective for government action to guarantee access to health care. The essay maintains that this argument is in some regards more robust than the well-known argument in defense of universal health care spelled out by Norman Daniels, which this essay also examines in some detail. Locke's view that government should protect people's lives, property, and freedom–where freedom is understood as (...) independence and self-determination–justifies government action to ensure access to health care, because (roughly), just as individuals cannot protect themselves from crime and foreign invasion, so individuals are unable to provide for their own health care. Defense from disease is as important as defense from crime, and–although this is arguable–government action to guarantee access to health care does not itself undermine freedom. (shrink)

The paper focuses on the issue of truth-telling in non-fictional narratives of (in)justice. Based on examples of rape narratives, domestic abuse narratives, human trafficking narratives and asylum seeker narratives, I examine the various difficulties in telling the truth in such stories, particularly those related to various culturally conditioned ideas of how the world works, which at the same time form the basis of, among other things, legal discourse and officials’ decision-making processes. I will also demonstrate that such culturally conditioned ideas, (...) which are the basis of official discourse, can be considered within the category of both the social imaginary of the just world in the Taylorian sense of the term, and the social master narrative, which in the case of stories of (in)justice is often based on the just world hypothesis. Kaya Yanar, autor i gospodarz tego programu, jest niewątpliwie najlepszym przykładem na to, że wymienione wcześniej „typowo niemieckie” poczucie humoru odbiega w znacznym stopniu od rodzaju żartu, proponowanego właśnie przez Yanara. Was guckst du? daje możliwość zanalizowania języka audycji komediowej, odwołującej się głównie do kultury świata arabskiego i wszelkich zjawisk z nią związanych, kwestii opanowania i posługiwania się językiem niemieckim właśnie przez obcokrajowców z tego kręgu kulturowego. W przełożeniu na leksykę i jej użycie w praktyce oznacza to wykorzystanie w programie zjawiska wieloznaczności, wynikających z braku znajomości języka, jako źródła sytuacji komediowych, które w połączeniu z niezwykle barwną osobą prowadzącego, odpowiednim obrazem, charakterem postaci oraz motywami muzycznymi, jest punktem wyjścia do całościowej analizy tegoż programu. W procesie asymilacji na płaszczyźnie semantycznej wchodzą one w nowe dla (...) siebie relacje paradygmatyczne i syntagmatyczne, wpływając znacząco na strukturę danego pola wyrazowego i przyczyniając się do zmian w jego obrębie. Zapożyczone z innego języka wyrazy mogą ze względu na swe znaczenie stać się w danych polach elementami dominującymi lub też pojawić się w nowym otoczeniu leksykalnym obok rodzimych synonimów. W wyniku kontaktów polsko-niemieckich na płaszczyźnie kultury, polityki i gospodarki na przestrzeni dziejów pojawiły się w języku polskim liczne wyrazy pochodzenia niemieckiego. We współczesnej polszczyźnie występuje bardzo wiele zapożyczeń niemieckich, z czego większość stanowią rzeczowniki. Najczęściej jednak ich obce pochodzenie nie jest znane przeciętnemu użytkownikowi języka polskiego, gdyż wyrazy te zasymilowały się w polszczyźnie zarówno na płaszczyźnie fonologicznej, graficznej, jak i morfologicznej. Największą grupę rzeczowników pochodzenia niemieckiego stanowią te, w których przypadku zachowane zostało ich pierwotne znaczenie, co wiąże się z (...) faktem, że jako pojęcia i terminy fachowe nie miały w języku polskim swoich odpowiedników, pod wpływem których mogłoby ulec zmianie ich znaczenie. Wśród zapożyczeń znajdują się również takie, których znaczenie całkowicie różni się od pierwotnego znaczenia słowa niemieckiego. Znaczenie zapożyczeń ulegało zawężeniu, gdy dany wyraz pojawiał się w języku polskim nie we wszystkich swych znaczeniach pierwotnych lub też rozszerzeniu, gdy został on zapożyczony zс wszystkimi pierwotnymi znaczeniami i dodatkowo obok nich pojawiło się zupełnie nowe znaczenie. Częstym zjawiskiem jest występowanie równocześnie różnych typów zmian znaczenia wyrazu zapożyczonego, np. zawężenia i przesunięcia lub/i rozszerzenia znaczenia. (shrink)

MacKay and Robinson (2016) claim that some legal procedures that regulate organ donations (VAC, opt-in, opt-out) bypass people's rational capacities and thus are “potentially morally worse than MAC”, which only employs a very mild form of coercion. We provide a critique of their argumentation and defend the opposite thesis: MAC is potentially morally worse than the three other options.

In an online, participatory class, we interpreted 'The Dream of Geese Nesting in Trees' knowing nothing of the dreamer beyond age and gender, and having none of the dreamer’s associations. Our interpretation included predictions about the dreamer. When it was complete, we asked the bringer of the dream (who had until then been mostly silent and who also gave no visual feedback to our discussion) to give us more information about the dreamer. Our main predictions were confirmed. Goslings are falling (...) on the dreamer’s head. This record is another iteration of an experiment that will be described more fully in the paper, 'The Dream of the Six-Legged Dog: An Experimental System that Tests Meaning,' soon to be published. The paper contains a general characteristics of the relation between Lev Shestov’s philosophy of existence and transcendental phenomenology of Edmund Husserl. The analysis was largely inspired by Cezary Wodziński’s research on Shestov’s writings, including his book published in Polish Wiedza a zbawienie. Studium myśli Lwa Szestowa (1991). In 1931, inspired by Descartes’ Meditationes de prima philosophiae, Husserl began a total transformation of philosophy into a science absolutely founded, assumptionless and developed in the spirit of absolute self-responsibility. Thus, the idea of (...) philosophy as an exact science and Descartes’ idea of a science absolutely founded became the aim. It resulted in a project of universal science which — according to Husserl — has been the aim of European philosophy from the beginning. Ultimately, this philosophy was to rebuild the whole model of European culture. Less than two years after the first edition of Die Krisis der europäischen Wissenchaften und die transzendentale Phänomenologie, Lev Shestov published his Athens and Jerusalem (1938) where he agrees with Husserl’s diagnosis that the whole European culture is in a stage of a deep crisis which goes to its very foundations. However, Shestov points at the radically different sources of that crisis. Paradoxically, a remarkable friendship connecting these two thinkers did not affect the similarity of their views. In fact, they are located at the opposite poles of the contemporary philosophical scene. The friendship of Shestov and Husserl was born in the atmosphere of an intense and uncompromising intellectual debate. Both thinkers are strongly convinced that the fate of European culture and European understanding what it is to be man are decided in the realm of philosophy. So, the philosophical projects they offer are two extremely critical visions of culture. Background: Biomedical research nowadays is increasingly carried out in multinational and multicenter settings. Due to disparate national regulations on various ethical aspects, such as informed consent, there is the risk of ethical compromises when involving human subjects in research. Although the Declaration of Helsinki is the point of reference for ethical conduct of research on humans, national normative requirements may diverge from its provisions. The aim of this research is to examine requirements on informed consent in biomedical research in Germany, (...) Poland, and Russia to determine how each national regulatory framework relates to the provisions of the Declaration of Helsinki. Methods: For this analysis, we conducted a search of the legal databases “Gesetze im Internet” for Germany, “Internetowy System Aktow Prawnych” for Poland, and “ГAPAHT – Garant” for Russia. The search was complemented by a review of secondary literature contained in the databases Google Scholar, PubMed, Polish National Library, and eLibrary ru. We have identified 21 normative regulations containing provisions on informed consent in clinical research in all three countries. The content of these documents was systematically categorized and analyzed. Results: The normative framework in all three countries shows a strong commitment towards the core ethical principles of research envisaged in the Declaration of Helsinki. Nevertheless, provisions on informed consent vary between these three countries. The differences range from the method and language in which information should be provided, through the amount of information required to be disclosed, to the form of documenting consent or withdrawal. In the case of research on vulnerable groups, these differences are particularly visible. Conclusions: The identified differences can negatively impact the ethical conduct of international clinical studies. Attention needs to be paid that flexibilities within national regulations are not misused to undermine the protection of research subjects. Achieving global or regional legislative harmonization might prove impossible. Such lack of legal consensus reinforces the significance of the international ethical agreements. (shrink)

Capitalism: The Birth of an Idea. Amongst the Enlightenment’s emancipatory slogans was a call for the liberation of economic energy, a call that was most fully expressed by Adam Smith in Inquiry into the Nature and Causes of the Wealth of Nations. Smith provided a final analysis of the mercantilist system that had been prevailing from the beginning of the sixteenth century. By justifying the superiority of the free market economy models, Smith created the intellectual foundations for the capitalist order. (...) He proposed a model for the production and distribution of goods that was based on two pillars: the right to private property and free market institutions. The vision of capitalism created by Smith was a system of power and freedom: a system of individual sovereignty over the world of objects and a system of the free circulation of goods. The combination of these two principles resulted in a coherent system which, when used in practice, has shown remarkable efficiency. Smith’s work proved to be a reliable way to achieve worldly success, one that has worked wherever it was tried out. Capitalism, and the accompanying moral philosophy, was the most commonly pursued idea of the eighteenth century. (shrink)

Badania prezentowane w niniejszej publikacji miały na celu dostarczenie danych koniecznych do prowadzenia polskiej polityki zagranicznej rozszerzonej o wymiar samorządowy i obywatelski w województwie podlaskim. Głównym celem diagnozy było zbadanie, jak jednostki samorządu terytorialnego, organizacje pozarządowe, przedsiębiorstwa oraz uczelnie wyższe nawiązywały współpracę transgraniczną z partnerami na Litwie, Białorusi, Ukrainie i w Rosji (Obwód Kaliningradzki). W publikacji wskazano miejsca największego potencjału, jak również barier na drodze do takiej współpracy w regionie. Zwrócono szczególną uwagę na kooperację tych podmiotów, łączenie swoich potencjałów i (...) tworzenie wspólnych projektów. * Studies presented in this publication were aimed at provide data necessary for the conducting of local government and citizenship dimension of the enlarged Polish foreign policy in Podlaskie region. The main objective was to investigate the diagnosis, as the local government units, non-governmental organizations, businesses and universities alluded cross-border cooperation with partners in Lithuania, Belarus, Ukraine and Russia (Kaliningrad). The publication indicated areas of the greatest potential, as well as barriers to such cooperation in the region. There are simple mechanical systems that elude causal representation. We describe one that cannot be represented in a single directed acyclic graph. Our case suggests limitations on the use of causal graphs for causal inference and makes salient the point that causal relations among variables depend upon details of causal setups, including values of variables.

This study aims to bring out the explanatory potential of embodied predictionism versus passive feed-forward model of sensory stimulation in the pursuit of a parsimonious naturalist account of sensation as a salient feature and an end point of conscious experience. Theoretical approaches towards sensory experience are tested against specific scenarios of the absence of observable or palpable qualities including but not limited to the thought-experimental phenomenon of negative synesthesia at the conclusion of the argument. . Predictionism is first explored in (...) its own right only to be found insufficient to do justice to the actual mechanism behind full-blown immediate perception. A case is made for the soundness of predictionism reconciled with the doctrine of embodiment. (shrink)

The truth about health care policy lies between two exaggerated views: a market view in which individuals purchase their own health care from profit maximizing health-care firms and a control view in which costs are controlled by regulations limiting which treatments health insurance will pay for. This essay suggests a way to avoid on the one hand the suffering, unfairness, and abandonment of solidarity entailed by the market view and, on the other hand, to diminish the inflexibility and inefficiency of (...) the control view. It suggests that the way to mitigate these problems is to recognize the malleability of motivation and the range of factors, in addition to financial incentives, that may influence the behavior of patients and especially physicians. The matter under consideration in this article is the ethnic joke as a primary element of the German TV comedy “Was guckst du?”. The starting point is a short overview of the ethnic joke and the extralingual phenomena that are associated with such jokes, and – above all – pointing at the function of stereotypes as causes for jokes about individual nations. Texts of jokes concerning individual nations were used to illustrate the reviewed problems. Coraz wiȩksze znaczenie w przemianach społeczno-gospodarczych ma sektor kultury oraz działania na rzecz kształtowania przemysłów kultury i kreatywnych, wraz z ich powi¸a}zaniami z sektorami zależnymi jak np. turystyka, architektura i wzornictwo przemysłowe. Celem artykułu jest odniesienie tych procesów i zjawisk do warunków województwa podlaskiego oraz przybliżenie głównych przesłanek powołania Regionalnego Obserwatorium (...) Kultury. Artykuł wskazuje na potrzebȩ i potencjalne korzyści z zarz¸a}dzania wiedz¸a na temat kultury na poziomie regionalnym poprzez prowadzenie prac teoretycznych i metodologicznych w ramach obserwatorium. The development of creative economy is also recognized along with emergence of a new social stratification and changes in developmental factors. Increasingly im- portant in the socio-economic transformation is cultural sector as well as promotion of culture and creative industries development including their linkages with dependent sectors such as tourism, architecture and industrial design. The aim of this article is to refer these processes and phenomena to the conditions of Podlaskie Voivodship and to discuss the main reasons of Regional Observatory of Culture establishment. Article indicates the need for and potential benefits of knowledge management on culture at the regional level by conducting theoretical and methodological work within the observatory. Essay based on an analysis of existing data and own research results highlights the main features of the region, information needs of cultural and art institutions, culture observatory possible models, potential activity areas of the regional observatory and the arising benefits from its activities. Background: The internationalization of clinical studies requires a shared understanding of the fundamental ethical values guiding clinical studies. It is important that these values are not only embraced at the legal level but also adopted by clinicians themselves during clinical studies. Objective: Our goal is to provide an insight on how clinicians in Germany and Poland perceive and identify the different ethical issues regarding informed consent in clinical studies. Methods: To gain an understanding of how clinicians view clinical studies in (...) the countries they work in, we carried out semi-structured problem-centered interviews per telephone in Poland (n = 6) and Germany (n = 6). Our interviewees concentrated on three main topics: an appraisal of the normative framework, challenges in the information process and the protection of all participants in clinical studies. Results: Clinicians generally supported the normative framework, even though they considered it quite complex. In the two study countries, a widely noted dilemma in the information process was whether to overburden participants with extensive information or risking leaving out important facts. Clinicians were ready to exclude larger population groups from participating in clinical studies when the information process could not be carried out with standard procedures or when their inclusion was ethically sensitive. Conclusion: Clinicians need to gain a better understanding of the consequences of excluding larger population groups form participating in clinical studies. They should seek assistance in improving the information process for the inclusion of underrepresented groups in clinical studies. (shrink)

The development of new methods in the field of prenatal testing leads to an expansion of information that needs to be provided to expectant mothers. The aim of this research is to explore opinions and attitudes of gynecologists in Germany, Poland and Russia towards access to prenatal testing and diagnostics in these countries. Semi-structured interviews were conducted with n = 18 gynecologists in Germany, Poland and Russia. The interviews were analyzed using the methods of content analysis and thematic analysis. Visible (...) in all three countries is a connection of prenatal medicine with the politically and socially contentious issue of pregnancy termination. Respondents in Poland and Russia concentrated on the topic of inadequate resources. Quality of information for expectant mothers is an important point in all three countries. Only in Germany was the issue of language barriers in communication raised. With regard to non-invasive prenatal testing (NIPT) respondents in Germany focused on the ethical issues of routinization of testing; in Poland and Russia they concentrated on fair access to NIPT. Challenges in all three countries arise from structural factors such as imprecise and prohibitive regulations, lack of resources or organization of healthcare services. These should be addressed on a political and medico-ethical level. (shrink)

Katarzyna de Lazari-Radek and Peter Singer have recently provided an evolutionary argument for utilitarianism. They argue that most of our deontological beliefs were shaped by evolution, from which they conclude that these beliefs are unjustified. By contrast, they maintain that the utilitarian belief that everyone’s well-being matters equally is immune to such debunking arguments because it wasn’t similarly influenced. However, Guy Kahane remarks that this belief lacks substantial content unless it is paired with an account of well-being, and he (...) adds that utilitarian beliefs about wellbeing—e.g. the belief that pleasure is good and pain is bad—were probably shaped by evolution. Logically, de Lazari-Radek and Singer should therefore reject these beliefs along with the deontological beliefs that evolved. The present paper is a defense of their argument. After considering a number of unsuccessful replies to Kahane’s objection, I put forward a more promising solution: de Lazari-Radek and Singer should combine their objectivist view in metaethics with a subjectivist account of well-being, such as the desire theory. Such a hybrid account would tackle Kahane’s challenge because subjective accounts of value are immune from evolutionary debunking arguments. And it would be compatible with utilitarianism, which doesn’t fit very well with metaethical subjectivism. Before concluding, I deal with two concerns that this solution might raise: I argue that the desire theory is actually subjective enough to escape Kahane’s objection, and I deny that retreating to the combination of ethical objectivism and prudential subjectivism is ad hoc. Katarzyna de Lazari-Radek and Peter Singer’s wonderful book, The Point of View of the Universe: Sidgwick and Contemporary Ethics, contains a wealth of intriguing arguments and compelling ideas. The present paper focuses on areas of continuing dispute. The paper first attacks LazariRadek’s and Singer’s evolutionary debunking arguments against both egoism and parts of common-sense morality. The paper then addresses their discussion of the role of rules in utilitarianism. De Lazari-Radek and Singer concede that rules should constitute our moral decision (...) procedure and our public morality. This paper argues that, if no one should be blamed for complying with the optimal decision procedure and optimal public rules, there are strong reasons to accept that these same rules determine what is morally permissible from what is morally wrong. This article shows how the MISS account of models—as isolations and surrogate systems—accommodates and elaborates Sugden’s account of models as credible worlds and Hausman’s account of models as explorations. Theoretical models typically isolate by means of idealization, and they are representatives of some target system, which prompts issues of resemblance between the two to arise. Models as representations are constrained both ontologically (by their targets) and pragmatically (by the purposes and audiences of the modeller), and these relations are coordinated (...) by a model commentary. Surrogate models are often about single mechanisms. They are distinguishable from substitute models, which are examined without any concern about their connections with the target. Models as credible worlds are surrogate models that are believed to provide access to their targets on account of their credibility (of which a few senses are distinguished). (shrink)

Several recent authors have argued that the biostatistical account offers the best hope for a naturalist account of disease. We show that the selected effect account survives the criticisms levelled by these authors relatively unscathed, and has significant advantages over the BST. Moreover, unlike the BST, it has a strong theoretical rationale and can provide substantive reasons to decide difficult cases. Policy-makers sometimes aim to improve well-being as a policy goal, but to do this they need some way to measure well-being. Instead of relying on potentially problematic theories of well-being to justify their choice of well-being measure, Daniel Hausman proposes that policy-makers can sometimes rely on preference-based measures as evidence for well-being. I claim that Hausman’s evidential account does not justify the use of any one measure more than it justifies the use of any other measure. This leaves (...) us at a loss as to which policy should be chosen in the non-trivial cases for which there is substantial disagreement between the different measures in their assessment of policy. Determining the precise nature of the connection between preference, choice, and welfare has arguably been the central project in the field of welfare economics, which aims to offer a proper guide for economists in the making of policy decisions that affect people’s welfare. The two leading approaches here historically – the revealed preference and latent preference approaches – seem equally incapable of so guiding economists. I argue that the deadlock here is due to welfare economists’ failure to recognize a crucial (...) distinction between two senses of “preference.” I analyze and defend these senses of “preference,” and argue that each shares a close connection with just one of choice and welfare. This analysis reveals how economists should conceive of both the connections between “preference,” choice, and welfare, and the proper roles of these concepts in welfare economics. I conclude by showing this analysis to best explain the plausibility of two leading alternative approaches from Hausman and Sugden. (shrink)

The paper discusses the sense in which the changes undergone by normative economics in the twentieth century can be said to be progressive. A simple criterion is proposed to decide whether a sequence of normative theories is progressive. This criterion is put to use on the historical transition from the new welfare economics to social choice theory. The paper reconstructs this classic case, and eventually concludes that the latter theory was progressive compared with the former.
